uying a brand-new home offers you an opportunity to customize it to your liking. It can be a dream come true and an investment for the future – but don’t forget, it’s also legal transaction. The term “get it in writing” has never been more important in the case of the newhome purchase since such a document outlines everything your home will have in it, on it and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms and conditions between you and your builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon. Since building a home is much more complicated than a resale transaction where the unit and/or property likely already exists, there is no set Agreement of Purchase and Sale or standard contract for buying a new home. In some provinces, builders may have standard contracts prepared by the local home builders’ association or their new-home warranty program. Builders often prepare their own agreements so contracts can vary from one builder/developer to another and from province to province. Before you sign a contract, review it carefully with the builder and ask questions to make sure you fully understand what it contains. Your next step is to then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document and an agreed-upon contract, so seeking the services of an experienced real estate lawyer is an important step toward ensuring that your dream home becomes a reality. SOLID OPTIONS IN LOWRISE Gains point to strong choices in location, value
T
he recent news (see pages 16 and 20) that lowrise sales in the GTA are making a comeback – or at least did so in January – may surprise at first. But upon closer examination, perhaps it really shouldn’t come as any surprise at all. What partly explains why lowrise sales captured 63 per cent of the market share in January 2012, compared to the same month the previous year, is the cyclical nature of the highrise business; builders typically sell off existing inventory early in the year before launching new projects in the spring. According to the Building Industry and Land Development Association (BILD), GTA lowrise sales in January 2012, at 1,128 units, held their own against the 2011 level of 1,137. What’s less visible in these sales trends is where, specifically, the lowrise growth is occurring – and therefore where the opportunities for buyers are. Statistics from RealNet Canada Inc. indicate most of the increase in lowrise sales occurred in Durham Region, which includes communities such as Pickering, Ajax, Whitby, Oshawa and Uxbridge; and York Region, home to Newmarket, Aurora, Vaughan, Markham and Richmond Hill. Many of these areas are also high performers; in our Outlook 2012 cover story in our Jan. 7 issue, we cited stats from Canada Mortgage and Housing Corp. which pointed out these areas were showing above average price appreciation over the last three years.

LOWRISE NEW HOME SALES

T
his week, we got the tally of new home sales across the GTA in the month of January from BILD’s source of new home market intelligence, RealNet Canada Inc. Typically, as compared to Januarys of the past, sales are just beginning to take off. Still, a total of 1,794 units is no small feat, especially since most builders use the month to sell off inventory as they prepare to launch new phases and projects in February and March. What’s interesting about the breakdown is that this is the first time in 12 months that the majority of units were sold in our lowrise sector. Lowrise sales totalled 1,128 — a nearly-identical figure to January 2011 sales — while capturing 63 per cent of the market share. Of the lowrise units sold last month, the majority of them were in York Region. It was pretty much the same story in January last year with lowrise sales outpacing highrise sales, and York being the most active region. If you’ve been following my column, you might recall that York Region is also a hot spot for highrise sales. In the months that followed January last year, highrise sales across the GTA increased steadily, and while the city of Toronto had the most units sold last year, York saw highrise sales more than double over 2010. So far this year, York remains desirable, as sales in the highrise sector continue strong, increasing from what we saw last January. I have to say that the dip in highrise sales across the GTA is to be expected in the first month of the new year. Last January, we saw similar statistics, and looking back now, it was just the start of a record-breaking year for highrise
sales. Every month in 2011, highrise sales climbed and the market share flipped. I don’t have a crystal ball (don’t we all wish we did sometimes?), so we’ll just have to wait and see how 2012 sales shape up, but as the market stabilizes over the next few months, what it really means for newhome buyers is more choice. Whether you’re looking for a detached or semidetached home, a townhouse or a condo – this could be your year. One more important result of the January sales numbers is jobs, jobs, jobs. As units are sold and projects move into the next phase of development, our industry mobilizes to turn those floorplans into real-life homes. That’s what I see when I look at our January sales, and the year is only just beginning.

GTA lowrise market
GAINS GROUND T he lowrise sector outsold its highrise counterpart for first time in 12 months this January, the Building Industry and Land Development Association (BILD) has revealed. According to RealNet Canada Inc., BILD’s official source of new home market intelligence, there were 1,794 new homes and condominium units sold in the GTA in January. Lowrise sales amounted to 1,128 sales – a nearly identical figure to that of

January 2011 – while capturing 63 per cent of the market share. The highrise sector took an expected dip in January as builders sell off existing inventory before launching new projects in the spring. “This time of year is typically used for developers to sell existing units while agencies put together new marketing campaigns and construct sales offices,” says BILD Chair Paul Golini Jr. “While the 40 per cent decline in the highrise sector might seem like a lot, it follows a record-breaking year in condominium sales, so it’s not a fair comparison.” The continuing trend of activity in the 905 regions carried into 2012, particularly in York, where highrise and lowrise sales both increased by a combined total of 12.5 per cent. The lowrise price index in the GTA rose seven per cent over January 2011 to $551,372 while the highrise price index went virtually unchanged at $445,854.

Last month, I sold a $500,000 real estate investment that I purchased three years ago for a $120,000 profit. How much tax will I pay? Can I use the losses in my stock portfolio to offset these gains? Ricky, King City
A.
Not a shabby profit on a three-year investment. Real estate continues to set sale and price records, although many experts predict a slowdown and possibility of a price decline. Some factors that could cause a slowdown include an expected increase in interest rates over the next several months, the new harmonized sales tax, new mortgage qualification requirements, changes to MLS and house listings, and affordability by individuals. Pretty well all of these factors will happen. So hold on for the ride. Generally, an individual is taxed on half (50 per cent x $120,000 = $60,000) of a capital gain. A taxpayer in the 40-per-cent tax bracket would pay (40 per cent of $60,000) $24,000 income tax. A common strategy to reduce capital gains tax is to use offsetting capital losses. An unrealized loss from your stock portfolio cannot be used to reduce gains in your real
estate. There must be a disposition or a deemed disposition. The sale of the shares must occur to realize a loss for tax purposes. Therefore, you must sell your shares in order to offset your real estate gains. Excess gains can be carried back three years to recover taxes paid on prior years’ capital gains. However, a gift of shares to a child (a minor) at fair market value would be considered a deemed disposition and may be acceptable to the Canada Revenue Agency (CRA). Another tax benefit from the gifting tax loss shares to children occurs on the subsequent sale of the shares. Any future capital gains are taxed at the hands of the recipient (the child). For 2011, a child with no other income but capital gains of $20,640 would pay no taxes, due to the basic personal tax credits available to all taxpayers. That’s a handsome amount kept in the family. Although, the gifting parent is relieved of capital gains tax, dividends or interest are attributed back to the parent who must report this income, at least until the child turns 18 years old. Taxpayers should proceed with caution before executing these types of transactions or obtain professional advice.

Canadian residents must report foreign property in excess of $100,000, when fi ling their income tax returns. You do not pay tax on this declaration but the amounts must be reported. In the event of a husband and wife, each can own $100,000 worth of foreign property and therefore not report the amounts to CRA.

f you’re about to go through the home-buying experience, particularly as a first-time buyer, no doubt you have a lot of questions in terms of what type of home to buy. What type of homes will you be visiting with the idea of buying? Do you see yourself living in a detached singlefamily home, or perhaps a townhouse? You may have a number of options to consider, depending on your area and your budget.

SINGLE-FAMILY SEMI-DETACHED: A semi-detached home is a single-family home that is joined on one side to another home. It can offer many of the advantages of a singlefamily detached home. It is often less expensive to buy and maintain. DUPLEX: A duplex is a building containing two single-family homes, located one above the other. Sometimes, the owner lives in one unit and rents the other. TOWNHOUSE: Also sometimes called row houses, these
homes are several similar single-family homes, side-byside, joined by common walls. They can be freehold or condominiums. They offer less privacy than a single-family detached home, although each has a separate outdoor space. These homes can cost less to buy and maintain, even though some are large, luxury units. STACKED TOWNHOUSE: Stacked townhouses are usually two-

DOES ANYONE WEAR A BLACK HAT IN THE RESIDENTIAL BUILDING PROCESS?
I like to think not. Many people worry and ask whether the builder is going to take advantage of them; whether their home will be delivered on time; whether the quality will be as promised; whether the sales agent is truthful or whether they will be deceived later. When purchasing a new home, what can go wrong? The real answer is as follows. When purchasing a new home, the purchaser and the builder are really entering into a partnership, not in the legal sense but on a moral and common sense basis. Like anything in life, there may be good and bad purchasers and good and bad builders, but on the whole, you have two distinct entities coming together for the accomplishment of a common goal. You, the purchaser, want your home to be completed on time and in accordance with the standards represented. The builder wants your home completed on time because he does not need the aggravation of delays, wants to maintain his good relationship with you and every day that goes by he is losing money on interest. Likely he is worried about quality both as a matter of pride in workmanship and in order that you will refer him to new customers. YOU BOTH HAVE THE SAME GOAL QUALITY COMPLETION OF YOUR HOME
Problems can arise over which the builder has no control. Problems such as trades not showing up, showing up late, materials being delayed, shortage of critical experienced people, are all matters beyond the builder’s ability to simply wave a magic wand and repair. All of these items can and do cause delays, delays that cost everyone. Today, 36 NEW HOME GUIDE GTA | MARCH 3 - 17, 2012
because of the large demand for homes, this lack of experienced people to work on the projects can, beyond the delays, result in mistakes and poor workmanship. The builder does not want this but he is caught between the time demands to deliver the home and the need to do it right. “Not our problem,” the purchaser says, but truly the common sense answer is to work with the builder, explaining deficiencies and get them corrected. Generally speaking, material and workmanship quality are high and the builders care. So, what should one do? Use your Tarion inspections to deal with the difficulties. Speak to your builder rationally and respectfully. Almost always the builder will come forward, front and centre, to do the right thing. What is the moral of today’s story? Work with your builder, not against him; recognize you have the same objectives, but continue to protect your rights and safeguard your position with your lawyer and through Tarion. Perhaps the most difficult part of writing these articles relates not the actual writing, but thinking of a topic to address. Do you know how your
MORTGAGE PROVIDER GETS PAID? — By Calum Ross —
I
n all the mortgages that I arrange, I find it surprising how few people actually ask me how I get paid. A recent study in the US indicated that less than 10 per cent of people could properly identify how different types of mortgage providers get paid during the transaction. Don’t you want to know whether that person who is so eager to sign you up has a financial advantage to selling a particular product? You definitely should care – and here is why. Almost every single provider in the mortgage marketplace has a potential financial gain by selling a particular mortgage product and rate. To make matters worse, that financial gain or pat-onthe-back is often gained at the expense of the consumer. Let’s take a look at your main mortgage providers to see what to watch for:
BANK BRANCH MANAGER This friendly and trusted advisor has a sales quota to hit just like everyone else (you did notice that Canadian banks do fairly well financially, right?). Their salary increase, bonus and promotion depends on results. Typically, bank managers have sales quotas for particular products as well as growth targets on the loan/investment portfolios. Their targets are often based on the size of their mortgage portfolio as well as the average term of the portfolio. The longer the term, and larger the size of the mortgage, the better the Christmas bonus. Furthermore, these managers are increasingly being graded on the profitability of these portfolios. When you go to your old bank branch and it has moved to a new location, where do you think one of the bank managers went? Which one do you think they kept with the bank? The one with the great discounted loans and mortgage rates, or the one that is making the bank the most money? BANK MORTGAGE REPRESENTATIVES These are typically contract employees of the bank who are usually paid on a straight commission basis. Most only sell one bank’s mortgages, while some sell several. The ones that sell other bank’s products are often only permitted to do so once they have met a quota of their own bank’s 42 NEW HOME GUIDE GTA | MARCH 3 - 17, 2012
products. These individuals are usually paid based on three criteria: the size of the mortgage, the term of the mortgage and the discount given. That means that these representatives can make more money by putting you in a longer term at a higher rate. MORTGAGE CONSULTANTS/MORTGAGE BROKERS These people are independent mortgage providers that theoretically work for you and not for one particular bank. They are paid a finder’s fee (or commission) from the institution that the mortgage is funded with. The problem is that not all banks are paying the same amount for each of the mortgage products. The lenders pay brokers based on the size of the loan and the term selected. The longer the term selected, the bigger the commission to the broker. On top of the different payoffs for the terms, some lenders also pay more for the same product. A broker could make more money funding a five-year term through one lender over another. Typically, there is no advantage to the broker if the consumer gets a higher rate, but there are exceptions to that rule. So now that you know how it works, who do you trust? When you go mortgage shopping, don’t believe that everyone is out to get you. While the incentive systems are there, many mortgage providers will look out for your best interest. A satisfied past client that refers family, friends and colleagues is worth a lot more than one big commission payout. Do your research, ask for testimonials, or ask your friends. A mortgage is a huge financial decision. Make sure it is a decision being based on your financial situation, and not your mortgage provider’s bank account. rying to get through life without a budget is like trying to drive a car with no steering wheel. You can lurch your way along, jamming on the breaks every time a threat looms, or you can put the pedal to the metal, but the whole time you’re careening down the road you’ll be worrying about what you’re going to hit. And if you’ve got any passengers, there will be some mess to clean up when you finally reach your destination. Everyone I know who lives on a budget couldn’t get by without it. And it seems it’s only the people who refuse to make a plan who end up bellyaching about getting to the end of the money before they get to the end of the month. If you were building a house, you wouldn’t dream of using an architect who declared, “Relax. I’ve done this before. I promise I’ll put everything in the right place.” Noooo. You’d insist on seeing some drawings. And here’s why you should, as the architect of your financial house, draw up a budget. Whether paper-based or electronic, the discipline of managing your budget will help to keep you organized. Annual bills, like car insurance, won’t surprise you, sending shock waves through your cash flow. And unexpected expenses, which have a category in a spending plan, won’t throw you for a loop. A spending plan is made up of two parts: income and expenses. Income is the money that comes in: your salary, commission, dividends or interest income, alimony, child support, pension, or disability income. It doesn’t include money you think you might get. So, if your bonus is not guaranteed, don’t include it in your budget. Keep it in reserve to boost your RRSP or take you to the sunshine next winter.

Expenses are the items you have to pay for monthly. (Divide annual bills, such as insurance, by 12 to come up with a monthly amount.) The best way to figure out your expenses is to look at what you’ve been spending. Collect your bank statements, credit card bills, and whatever other records you have of where your money went over the past year. Put each bill in an appropriate category – utilities, food, clothing, childcare, gifts. Total the figures for each category and divide by 12. That’s your monthly average. Add the categories together. That’s what you’ve been spending. L
ast year proved to be another banner year for the new lowrise housing market. The total market area witnessed 19,844 new home sales in 2011, which is 94.5 per cent of the Trimart forecast. This is an increase of 0.6 per cent over the 19,724 sales realized in 2010. Lowrise sales continue to show solid gains, achieving 892 sales in December. Despite serious lot shortages, planning delays and price pressure, the industry rallied to achieve this successful performance. By December 2011, The Top 20 builders realized 51 per cent of all lowrise year-to-date sales. The 2011 top builder goes to Mattamy Homes, with 2,011 sales, largely the result of sales at the Hawthorne Village site in Milton and Mount Pleasant North in Brampton. Fernbrook Homes takes second place with 729 sales and Aspen Ridge Homes in third place with 651 sales. Monarch Homes takes fourth place with 649. At year end, six top builders were in a close range between 555 to 651 annual sales. (See Figure 1). Overall, the end of 2011 brought good news for the new housing market where the new home industry was successful in introducing new types of product urban town homes and the four- and five-storey midrise residences which are gaining in stature, design, consumer acceptance and affordability. Despite lot shortages and price pressure, many new-home builders were able to achieve higher sales volume through aggressive marketing programs that accelerated the Total Market Area sales for the third consecutive year. (See Figure 2). In 2011, the total market witnessed an increase of 31 per cent more openings and releases compared to the previous year with more than 80 new openings and releases already scheduled for 2012, the market will continue to realize growth. In addition, the Bank of Canada will maintain its low interest rate with the Banks rapidly following with historically low mortgage rates. This affordability, coupled with new affordable product, will set the stage for further new home sales growth in 2012. According to a recent report from BMO Economics, sales will show positive activity, stable prices are anticipated throughout 2013, and low interest rates maintain affordability, allowing household income to catch up with prices. Strong sales will continue in Alberta, Saskatchewan, Newfoundland and Labrador, as well as in Toronto, Montreal, Winnipeg, Halifax and Ottawa with previously red-hot Vancouver softening. The report added that while household debt in Canada has been a point of concern, debt levels relative to income are not as troublesome as some suggest and will likely not trigger a severe market correction. Contrary to some reports, Canadians have nowhere near the debt burden of Americans at the peak of the housing bubble. Even today, after four years of US deleveraging, household debt ratios are lower in Canada.

Bathroom trends

T
he bathroom has had a long history and when you’re at a cottage with no indoor plumbing, you develop a whole new appreciation for that room. Essentially, the elements haven’t changed much over the years – a toilet, a sink, a tub and or shower, some storage. There is no doubt, however, that the way we organize those elements and what’s new in the world of bathrooms evolves year after year. The basic rules of form following function never change, and it is always important that you create a great plan, for fashion and function purposes. Before you get excited about all the new features that can be incorporated into the bathroom, determine what is most important to you and your family. You may find, for example, that members of your household prefer to shower as opposed to bathe, and as a result, you want to spend the majority of your “trend/ splurge” dollars on the shower. As a general trend, we are seeing the bathroom being tiled from floor to ceiling, all around the room or at the very least, a tiled feature wall. In the past, people might have tiled
only the walls in the shower and left the rest of the walls painted. But with the increased popularity of fully glassed-in shower stalls in order to keep the room looking as large as possible, it is now much more common to tile the shower stall and then continue that finish straight across the room onto the next wall. This is the less-expensive version of tiling the entire room from top to bottom. There are certainly many interesting damask patterns in tiles that look like wallpapers, but offer more durability. As many past trends in home design are experiencing a revival, we are again seeing lots of white and grey marble in the bathroom, both in countertops and tiles. Tiles like Carrara marble have made resurgences although this particular material has been around since the construction of St. Marco’s Cathedral in Venice. In the tile department, the sizes of marble tiles have increased dramatically since the last time they were popular. In the past, a six-by-six-in. tile may have been all the rage. However, we now are seeing tile sizes such as 12-by-24-, 24-by-24- and as large as 36-by-36in. The advantage of the larger format is that it allows for a Continued on pg.66

The only thing it doesn’t do, is get you the paper! Faucets are available in a variety of shapes, sizes and finishes to suit any taste. They are also available in touch-free models for residential applications. Electronics have also made their way into the room, with televisions set behind mirrors and surround sound installed in the ceiling scape. Try not to be overwhelmed with the vast selection, and when you’re ready to shop, head out with a plan and a budget in mind. Finally, the room is there to house a toilet and to allow you to get ready in the morning. Beyond that, it’s all the luxury you want. The trends in these kinds of rooms tend to last for many years before they change, so feel free to treat yourself to a few fun things but never lose sight of what your budget is. Happy showers!

With the thaw only weeks away, BMO Bank of Montreal offers first-time homebuyers strategies for finding their ideal home while keeping financial priorities in check. Buying a home can be the largest and most important financial decision one can make, so it is important to be aware of all the factors that go into making a responsible purchasing decision. “The first step is figuring out how much you can afford to spend on homeownership, which means an honest assessment of the household balance sheet,” says Laura Parsons, mortgage expert, BMO Bank of Montreal. “Once you have a clear idea of where you stand financially, you can then make a responsible decision of what you can afford, including your down payment, monthly mortgage costs and other expenses like utility costs and property taxes.” BMO offers the following tips for Canadians looking to buy a home.
MAKING AN AFFORDABILITY ASSESSMENT

HBO Canada and TIFF Bell Lightbox have joined forces to bring a free exhibit based on the hit show Game of Thrones. The exhibit will include six costumes, props, weaponry, tableware and banners from the different Houses. The never before seen costume of season two's Melisandre is on display, as well as one of Daenerys' dragon eggs and King Baratheon's stag crown. The infamous Iron Throne will be in the lobby of the Lightbox, where visitors can have their picture taken as King or Queen.
Canada’s premiere fashion event returns to Toronto, with media, industry, buyers and consumers coming together to view collections of some of the best Canadian independent and international fashions of the season. You love the home SEE WHAT YOU CAN AFFORD!
Use this rule-of-thumb to see if you’ll qualify for a mortgage on your dream home 1. Calculate the combined monthly before-tax income of you and your spouse. 2. Divide by three. This figure is the monthly payment you can afford to make on your house. 3. Take the total price of the house and subtract the amount of money you expect to make as a down payment. This is the money you will have to borrow. 4. Look to the chart on the opposite page. Look down the left column and locate the interest rate you expect to pay. Line this up with the amortization period of your choice. (Most first-time buyers take the 25-year amortization. 5. Multiply this figure by the amount you need to borrow. Divide by 1,000. 6. Add to this your estimated monthly heating costs and monthly property taxes. 7. If this figure is equal to or less than one third of your gross monthly income, (calculated in Step 2) you’ll qualify for a mortgage on your dream home. The table on the opposite page shows the monthly payment of principal and interest for each $1,000 of mortgage.
Bear in mind this is a rough estimate. If you have several other large loans already, you may qualify for less. Also, banks and trust companies vary in their policies. The best way to know what you can afford, is to go to the lending institution of your choice and get pre-qualified.
EXAMPLE: The monthly principal and interest payment for a $300,000 mortgage with a 25-year amortization period at 5% is as follows: ($300,000 ÷ 1,000) X 5.82 = $1,746 At current rates you can get a three-year mortgage for 4.15%, and a one-year mortgage at 3.90% (correct as of February 21st, 2012).

espite what you often hear, buying a home isn’t only about location, location, location. True, this is the time-tested first rule of real estate, but there are other determining factors you must consider as part of your selection process. Indeed, there’s a new rule of thumb for buying real estate.
LOCATION First, what does that old adage really mean? Of course, we’d all love a high-end home in the best neighbourhood. But that’s not always possible. For your own enjoyment while you live in your home as well as for future resale potential, proximity to transportation, shopping, schools and other amenities is among the key determinants that affect your property’s appeal and ultimately its value. After all, those are the qualities potential buyers look for when searching for a home; the more of them your home has when you go to sell, the more desirable it will be to a greater number of people. This equates to demand – multiple offers and a higher price. INFORMATION Whether you’re a first-time homeowner, “buying up” to accommodate a growing family or “right-sizing” as an empty nester, education is critical. And these days, with digital media and mobile technology, all the information you need is at your fingertips. more knowledge you have, the better equipped you are to make informed decisions about buying, maintaining and eventually selling your home. TIMING Though your home is your primary residence, it is also an investment. Where you buy is usually determined largely by where you want to live, work and play. But when you buy and sell is also important. Like any financial instrument, real estate can fluctuate in value and your timing can determine how good of an investment it is. Given today’s challenging economic climate, there’s no shortage of media reports on the ups, downs, crashes and surges of the housing market. But if you’ve done your research, you won’t be spooked – or excited – by big-picture reports on short-term market performance. You know that real estate is not national or even regional – it’s very specific. You don’t buy the Canadian market and you don’t buy a provincial or even regional market. You buy a specific home, on a specific street in a specific neighbourhood. So, it’s not just about “location, location, location.” The new adage is “location, information and timing.” Do well with all three, and over the long haul your home is going to be one of the best lifestyle and investment decisions you ever made.
