This handbook has been designed for your convenience and information. We hope it will assist you in answering any questions that may occur. It is important that students and parents understand the school rules, procedures and facts concerning Ewalt Elementary School. SCHOOL HOURS: Early Childhood Morning Afternoon

Payment of fees STUDENT CONDUCT: We expect our Ewalt students to be respectful toward their fellow students and all individuals who exercise control over them during the school day or at school activities. We believe all students can behave appropriately while at school. We will allow no student to stop the teacher from teaching or prevent other students from learning. Each classroom establishes rules, rewards, and consequences. There are also guidelines for out of class behavior; in the halls, restrooms, lunchroom, bus and on the playground. The choice of behavior is the student's. 6


STUDENT DISCIPLINE: For further reference see USD 402 BOE policies: JD, JDA, JDB, JDC, JDD, and JDDA. A copy of the Kansas School Safety and Security Act is included in the appendix of this handbook. Students, parents, and community members may anonymously report any impending school violence to the Kansas School Safety Hotline (1-800-626-8203). District Goal: To establish an effective discipline system in all district schools which will provide the best possible educational opportunity by: Establishing respect as an expected behavior from all students towards administrators, teachers, staff, students and property; and Dealing with infractions in a firm and consistent manner at the lowest possible level. Behavior Code Policy Statement: 1. Students shall respect constituted authority. This shall include conformity to school rules and regulations and those provisions of law which apply to the conduct of juveniles or minors. 2. Student conduct shall reflect consideration for the rights and privileges of others and demonstrate cooperation with all members of the school community. 3. High personal standards of courtesy, dress, decency, morality, clean language, honesty, integrity, and wholesome relationships with others shall be maintained. Respect for real and personal property, pride in one's work, and achievement within one's ability shall be expected of all students. 4. Every student who gives evidence of a sincere desire to remain in school, to be diligent in studies, and to profit by the educational experiences provided will be given every opportunity to do so and will be assisted in every way possible to achieve scholastic success. 5. In order to be eligible for participation in an interschool activity program a student must be a bona fide undergraduate member of that school and in good standing. A student who is under penalty of suspension or whose conduct brings discredit to the school or to the student, as determined by the principal, is not in good standing and is ineligible for a period of time as specified by the principal. EWALT ELEMENTARY P.A.W.S. PROGRAM: It is the belief of the Ewalt Elementary faculty that the student is responsible for their learning. We feel that if we set clear and consistent limits and consequences for our students, provide uniform follow-through, and offer students warmth, support and rewards for appropriate behavior, positive attitudes will succeed, PAWS. PARENT ORGANIZATION: The Ewalt Parent Teacher Organization actively supports the school program through fundraising, as volunteers and by sponsoring special events. All parents are invited to join. Ewalt Elementary P.T.O. Executive Board President: Jennifer Dromey Vice-President: Debi Pfeifer Secretary: Erin Pankratz Treasurer: Sami Zweifel Volunteer Coordinator: Melissa Carrell SCHOOL SITE COUNCIL: An Ewalt School Site Council composed of teachers, parents and local business people will be developed to review progress of school goals and assist in revising plans as needed to continue the process of school improvement. All parents are encouraged to attend site council meetings. The site council meets on the first Tuesday of each month, at 5pm in the school library. ARRIVAL OF STUDENTS AT SCHOOL: Students may arrive at Ewalt in the morning between 7:40 and 7:55 a.m.. When students arrive between the 7:40 and 7:55 times, they are to report to the gym and sit with their class until dismissal. STUDENT CHECK OUT FROM SCHOOL: Whenever a student must leave school for any reason, they must check in the office until the responsible party arrives and signs the student out. BUS RIDERS: Only regular bus riders are allowed to ride the bus. Insurance regulations will not allow transportation of any student who is not a regular bus rider. If any exceptions are allowed, the school must have in writing, permission and explanation from all parents involved. Please do not allow your child to bring unauthorized items (i.e. pets), on the bus. Bus students will be dropped off and picked up on the north side bus turn around. Students should enter and leave the school building by the main entrance. Riding the bus is a privilege and may be revoked for students not following district bus rules. 8


The USD 402 Transportation Regulations are located in the appendix of this handbook. ATTENDANCE AND ABSENCES: Regular school attendance is important if your child is to make satisfactory progress in school. When a child is absent from school the parent should contact the school office stating the reason for the absence. The school number is 775-0056. When the student returns, they must bring in a note signed by the parent or guardian stating the reason for their absence if they did not contact the office by phone. If parents do not contact the office prior to the student's return to school, the absence will be considered "pending.". It is the responsibility of the student and parent to clear absences. It is important that this be done so appropriate academic credit can be awarded. Students not in attendance the day of a school sponsored activity will not be allowed to participate in that activity. DISTRICT ATTENDANCE POLICY: The district attendance policy has been included in this handbook. B.O.E. policies addressing attendance are JB and JBB. Questions or concerns should be addressed to the school office. TARDIES: It is important that students are at school on time. Classes begin at 8:00 a.m. Lunch counts and daily plans are discussed during the first few minutes of each day. Students arriving late need to go to the office first to get an admit slip to class. USD 402 has definite expectations for students who attend Augusta Schools. According to school policy ... “Students are to be diligent in study, which includes being regular and punctual in attendance. STUDENT SEARCHES Principals are authorized to search students if there is reasonable suspicion that district policies, rules, or directives are being violated. Strip searches shall not be conducted. All searches by the principal shall be carried out in the presence of another adult. NOTICE OF NONDISCRIMINATION: Augusta, USD 402 does not discriminate on the basis of sex, race, color, national origin, religion, handicap/disability, or age in its programs or activities. Any questions regarding the District’s compliance with Title IV, Title IX, Section 504, Americans with Disabilities Act, and the Age Discrimination Act may be directed to the Compliance Coordinator who can be reached at 775-5484.

DISMISSAL OF SCHOOL: School is dismissed at 3:15 P.M. Please make sure that your child does not linger around the school after hours. If you are going to be late in picking up your child, please make sure proper arrangements have been made. SCHOOL MESSENGER The School Messenger system will notify parents or guardians of school closures due to weather or other emergencies. Bulletins will be carried on the major radio and television stations in Wichita, El Dorado, and the Augusta Cable News Channel. Please refrain from calling the school during these weather emergencies. STORM ALERTS: The policy adopted at the elementary school is that CHILDREN WILL NOT BE SENT HOME WHEN THERE IS A STORM ALERT. Bad weather drills are practiced during school hours. The Ewalt building has been constructed with a tornado shelter as an extra safety precaution. Students will not be released from school unless parents accompany them home. Proper student check out procedures should be followed. TELEPHONE USE AND MESSAGES: The telephone of a school should be used for business purposes only. Students will be given permission to use the telephone for emergencies. Students and staff will not be called to the phone unless an emergency exists. Telephone messages will be forwarded to respective individuals. COLD WEATHER POLICY - OUTSIDE PARTICIPATION: The school policy pertaining to student participation outside during cold weather is as follows: Students who are to be kept inside need daily permission notes written by the parent, not to exceed a MAXIMUM OF THREE DAYS. If the student's condition still exists at the end of the three days, a medical excuse, signed by a doctor, will need to be filed with the office. Students will go out to recess if the wind chill is above 10 degrees. LEARNING PACKETS: Each Wednesday your child will receive their learning packet to take home. Materials included will be communications from the office and staff, notes from the PTO, and completed assignments. These papers should be reviewed and packets signed and returned to school the following day. Students losing their packets will be charged an additional 25 cents for new packets.

DRESS CODE: The primary purpose of the school program is education. Students in their manner of dress and grooming must be considerate of their fellow students so as not to distract them or cause disruption. The administration shall be responsible for determining the appropriateness of a student’s attire relative to this policy. (BOE policy JCDB) Students should dress appropriately and groom themselves for school attendance in a way which reflects personal pride. This might be described as neat, clean, attractive, tasteful, moderate, modest dress. Extremes in dress and personal appearance which tend to cause distraction or pose health problems cannot be tolerated at school. The following is a list of specifics which can be helpful when faced with questions of inappropriate school dress: 1. It is recommended that all students wear shoes that adhere to the feet for obvious safety and hygiene purposes. 2. The hemline of any outfit shall come no higher than 4 inches above the knee, show no undergarments, and leave no doubt as to the decency of the outfit. Shirt/blouse hemlines must be such as to prevent midriff exposure at all times. 3. Spaghetti, halter, strapless, midriff or tank tops, as well as low/revealing necklines will not be permitted. 4. Clothing promoting or advertising drugs, alcohol, and/or tobacco is unacceptable as it is clothing with offensive slogans or pictures or explicit/implies meanings. 5. Jeans should be regular fit. They may not drag on the floor or sag. 6. Hair design and color, as with attire and appearance, should not be excessive or disruptive. 7. Hats, caps, coverings/bandanas, headbands, chains, and sunglasses are unacceptable at school. 8. Facial piercing which may create health/safety issues or disruption to school may not be allowed. No set of guidelines can take into account every possibility. The cooperation of parents and students is requested. The administration shall be responsible for determining the appropriateness of a student’s attire relative to this policy and may adopt additional guidelines, as they deem appropriate. FIELD TRIPS: These trips are to be of an educational nature and parental consent will be necessary. Parental permission slips will be sent out by the office at the beginning of the year for completion by parents. Parents will be notified of upcoming trips so that parents can notify the school if their child/children are not to attend. See BOE policies JH, IFCB, and KFB for further information. VISITATION: Ewalt is your school and we strongly encourage you to become a part of your child's educational process. However, please contact the teacher before coming to visit and please check in the office before going to the room.

CARE OF SCHOOL PROPERTY: Damage to school property, carelessly or inadvertently done, such as carving or marking on desks, walls, chairs, books, etc. will not be tolerated. Any occurrence of such will result in disciplinary action suggested in the USD 402 District Discipline Policy. COMPUTER USE AND MATERIAL: Students and parents must sign the “Student Internet/Computer/Network Access Agreement” prior to use of district computers. Students shall have no expectation of privacy when using district e-mail or computer systems. E-mail messages shall be used only for approved educational purposes. Students must use appropriate language in all messages. Students are expected to use the system following guidelines approved by teachers or the administration. Any e-mail or computer application or information in district computers or computer systems is subject to monitoring by the staff and/or administration. The school retains the right to duplicate any information created by students in a computer system or on any individual computer. Students who violate these rules or any other classroom rules relating to computer use are subject to disciplinary action, up to and including suspension from school. CRISIS PLAN: Fire and tornado drills are held each year in accordance with state law. A complete copy of the building crisis plan is available in the Ewalt office. CHILD ABUSE All Ewalt employees will follow BOE policies (GAAD) in reporting suspected child abuse. STUDENT PRIVACY RIGHTS A copy of the Student Privacy Rights is included in the Appendix. HARASSMENT Harassment of any kind will not be tolerated at Ewalt. We will follow BOE policies JGEC and JGECA. You will find a copy of the policy in the Appendix. HEALTH: Please keep us informed of any changes in your child’s health during the course of the year. Parents desiring to take their child out of school for an illness, or any other reason, should check in at the office and not go directly to the classroom. If you anticipate being out of town during the school year and leaving your children with friends, please provide the school office with pertinent information. Requirements of children starting kindergarten or Kansas 12


schools for the first time are listed in the Appendix under the heading "Kansas School Immunization Law." EXCLUSIONS FROM SCHOOL DUE TO ILLNESS If your child becomes ill at school, you will be asked to pick them up from school as soon as possible. While our intent is not to put undue stress on working parents, allowing a child with a contagious illness to remain at school is not in the best interest of the sick child or the other students and staff members. Children must be free of any vomiting, diarrhea, or fever (anything over 100 degrees) for at least 24 hours without the aid of medication before returning to school. There are certain common contagious illnesses that will require a doctor’s note before being able to return to school: strep throat, conjunctivitis (pink eye), influenza, upper respiratory infections, chicken pox, gastroenteritis (prolonged vomiting/diarrhea), or any undiagnosed skin rash. Children may attend school with minor coughs; colds provided that the cough is not e\severe enough to be a distraction to the classroom environment, mucous is clear, and the child has enough energy to be able to participate in the daily activities of the school day. MEDICINE PROCEDURE: Because of the complexity in the handling and administering of many medicines, USD 402 has established a procedure in regards to giving students medicine during the school day. The schools will no longer accept responsibility for giving any medicine to a student. If your child is on a permanent type of medicine you will need a signed authorization from a doctor (see form in handbook). The medication must be in the correct pharmacy container and left in the office. Your child will be responsible for taking his/her medicine. For short term medicines, such as antibiotics, these should not be sent to school with your student and will not be given by school personnel. Any parent or babysitter may come to school and give this medicine at the proper time. GRADING SYSTEM: The evaluation of student progress is extremely important to the educational community and home. Therefore, we want to make the reporting process as clear and understandable as possible. Upper grade students will receive what most individuals consider regular grades: A B C D F

REPORT CARDS: Report cards are issued at the end of each nine week grading period. The exact distribution dates will be announced by the school. PARENT TEACHER CONFERENCES: Each year the school schedules an important educational opportunity for parents, teachers and students--Parent Teacher Conferences. Conferences will be scheduled during both first and second semester and for your convenience during a two day period and during the evening hours. Information will be distributed to parents prior to the scheduled conference dates. If needed, parents or school officials may request a conference at any time. INAPPROPRIATE ITEMS: Students should not bring articles which are hazardous to the safety of others or interfere in some way with school procedures. Only those items needed for classroom use should be brought to school. Items not needed in class will be impounded and returned to the parent if requested. Absolutely no weapons nor any facsimile of a weapon should be brought on school grounds. See BOE policy JCDBB for further information. BICYCLES/SKATEBOARDS: Bicycle racks will be provided for Ewalt students. This area should be used at all times. Students are asked not leave bicycles in this area overnight. The school will not be responsible for bicycles left unlocked or left overnight. Skateboards are not allowed on school grounds. LOST AND FOUND: Please mark your child's belongings for easy identification. If an article becomes lost it is much easier to find if proper identification is used. The office will collect lost and found items and any usable clothing will be turned into local food and clothing center personnel at the close of the school year. PARTY TIMES AND INVITATIONS: Please do not send after school party invitations for distribution during school time. Classroom birthday treats will be allowed the last 10 minutes of the school day. Teachers may change this time if there is a schedule conflict. Parents should contact the teacher before planning this activity. Please keep the treats inexpensive, simple and appropriate. Classroom holiday parties (Christmas, Valentine's Day, etc.) will be announced by individual schools.

COST OF LOST BOOKS: The cost of district funded textbooks and materials are becoming more expensive. We ask that students be responsible in the care of textbook and workbooks. Replacement costs will be accessed in the following manner: 1st year: 2nd year: 3rd year: 4th year: 5th year:

Library books will be assessed at the full replacement cost. Other damaged books that can be rebound, will be assessed at the current cost of rebinding books. AWARDS: Students who have excelled or who have contributed to the improvement of Ewalt Elementary School are honored throughout the school year. Teachers will be choosing students who have demonstrated outstanding effort and responsibility in various areas. Other awards may be given in physical education, music, art, library and other important areas. LUNCH PROGRAM: The school's service of breakfast and noon lunches will begin the first day of school. Those who want meal service the first day of school should purchase a lunch ticket prior to the start of school or at enrollment time. It is recommended that the exact amount for lunch tickets be enclosed in an envelope and sent to school in order to facilitate the sale of tickets and to minimize the possibility of losing money. Milk is provided with all hot lunches, however, if a student desires additional milk, or for those students who "brown bag it," it can be purchased for $.40. To receive breakfast, a student meal account must be in good standing. Breakfast will be served between 7:40 and 7:55 a.m. daily. Discipline problems created while participating in breakfast will result in loss of that privilege.

EWALT PLAYGROUND RULES: The following rules are designed to insure the safety of the children of Ewalt School. Common sense prevails and will allow for a fun recess period for all children, however, many rules at home are just not compatible with school rules due to the number of students we are supervising. 1. 2. 3.

SAFETY IS RULE #1! Follow directions of the supervisor(s). Pupils are not to re-enter the building during recess or noon except with permission of the playground supervisor. Jackets or coats will be worn if needed. SWINGS - ONLY ONE STUDENT is to swing on a swing at a time. Students are to swing forward with no twisting or turning. Children are not to play or stand between swings or inside the swing poles. Children are not to push others in the swings and are not to jump out while swinging. SLIDES - are to be used, one person at a time, feet first, sitting up straight. Students are to climb up the ladder and not the slide. Wait until you see person exit the slide before you go down. Flips, cartwheels, round offs (gymnastics) will not be allowed on the playground. No "tackle" games of any kind. No chasing/running with sticks or poles. Students should not pick up rocks, sand, sticks, bees, ice, snow, etc. Throwing of these items is not permitted. Kicking balls on the blacktop or near the building is not permitted. On "blacktop days" the no kicking rule remains; balls for basketball and 4 square are all that are allowed. Limit of 4 people on the teeter totter at a time. Fights, of any kind, will not be tolerated. Shoes must be worn at all times and places of the playground. No personal toys from home will be allowed outside at recess.

SEVERE DISRUPTIONS are immediately sent to the office with an Office Discipline Referal Form (ODR) and include: 1. A child willfully inflicts or attempts to commit physical harm to another student or adult 2. A child willfully destroys property 3. A child is disrespectful to any person in authority PRINCIPAL'S DISCIPLINE PLAN: When a child is sent to the principal for disciplinary consequences, it is regarded as a serious matter. There will be a record of the student's visit made by the principal. 1st Referral

Principal will have a conference with the student to counsel about behavior. 2nd Referral Principal will contact the parent for a phone or office conference. 3rd Referral A conference will be scheduled among the student, parent, teacher and principal. Consequences for Severe Disruptions could involve, but not be limited to, In-School Suspension, Out of School Suspension or an USD 402 Discipline Hearing. DRUG-FREE SCHOOLS: Maintaining drug free schools is important in establishing an appropriate learning environment for the district's students. The unlawful possession, use, or distribution of illicit drugs and alcohol by students on school premises or as a part of any school activity is prohibited. For further information see the District Intervention Program. See BOE policies GAOB, JDDA and LDD for further information. OPEN ENROLLMENT USD 402 has implemented an open enrollment policy. In the spring of each year, parents are asked to fill out forms regarding enrollment for the upcoming school year. Please contact the office if you would like further details. STUDENT CELL PHONES: Cell phones brought to school must be turned off and placed in student’s backpack during the school day. SUBSTITUTE TEACHERS: Our school district is fortunate in having capable substitute teachers to assist our school when regular teachers are not in attendance. A substitute teacher is a visitor whose impression of our school will be carried into the community. Let us be certain that these are good impressions by being polite, helpful and considerate. ACTIVITY EXEMPTION: When a student is exempt from physical activity the following procedure will be used: 1. Secretary/Nurse get Doctor’s note from parent. 2. Secretary/Nurse gives a copy of note to principal, classroom teachers, specials teachers, and special education teachers if applicable. 3. Meeting is set by principal and teachers to discuss note and confirm procedures for PE/Recess. 4. Students who are not allowed to participate in the activity will be placed in an alternate setting based on a group recommendation. 5. Letter or phone call to parents to confirm Doctor’s note and alternative arrangements during physical activity time. 6. Student will not be allowed to participate in physical activity until we receive a note from the Doctor or on the date listed on the original Doctor’s note. MTSS - MULTI TIER SUPPORT STRUCTURE MTSS is a framework to help schools and teachers give every child the support they need to learn, grow and succeed. At Ewalt we identify each child's needs and provide support as early as possible. Tier 1 - provides instruction and support provided to all students, Tier 2 - is supplemental help to students requiring more help, additional instruction occurs in small groups, Tier 3 - students are provided with intensive instruction to enable them to succeed, instruction often occurs in groups of 1 or 2 (www.KPRIC.org). STUDENT IMPROVEMENT TEAM (SIT) Students who are experiencing academic or speech difficulties are referred to the SIT. The SIT team identify intervention strategies to support student success and make recommendations for additional support. Additionally, students who are performing significantly above grade level are referred to SIT for recommendations on extension activities, and to discuss testing for the gifted program.

EWALT Accelerated Reader Program The most precious gift you can give your child is the gift of reading. The child who loves to read will not only do well in English and language arts course, but will, in fact, excel in every area of schoolwork and of life. This is why Ewalt Elementary has decided to place emphasis on improving reading throughout our classes. To accomplish this goal, we use a program called Reading Renaissance. Reading Renaissance is made up of the STAR reading assessment software, Accelerated reading software and reading incentives and is currently used by more than 27,000 schools in North America. Reading Renaissance has four main objectives: 1. To dramatically improve student reading performance, as measured by standardized tests, and STAR reading. 2. To improve students’ critical-thinking skills. 3. To instill a lifelong love of reading in students. 4. To improve students’ reading through practice reading. Each student is given an AR goal for each nine weeks. That goal is compromised of three parts – reading accuracy (85% or above), reading points and a reading level determined by STAR reading. All of these parts must be met to achieve the AR goal. Students may monitor their goal by logging into AR during school hours. Parents may monitor their child’s goal by using Home Connect. You will receive information about your student’s goal and Home Connect in Wednesday packets.

STUDENT PRIVACY RIGHTS District employees may have ongoing opportunities to access confidential information or records that are required to be kept confidential. Much of the student information processed by district employees is confidential, and state and federal law limits its release; for examplele, driver record and vehicle registration information, confidential student records, criminal history background check information, information obtained pursuant to Social and Rehabilitation Services (SRS) interventions, social security number information, and professional misconduct background checks. Employees are prohibited from divulging information contained in the student records and files of the district, except to other, authorized employees who may need such information for an educational purpose in connection with their duties and to authorized persons or agencies only in accordance with law, district policies, and administrative rules. If an employee is approached to provide information inappropriately, the employee must refuse to release the requested information unless authorized by his/her supervisor or otherwise be required to release the information under law or court order. In all cases, the employee’s immediate supervisor shall immediately be informed, of any requests. Any employee who inappropriately releases information, or uses confidential information obtained in the course of his/her employment and with the district will be disciplined in accordance with board policies, the negotiated agreement, and district procedures. USD 402 ANTI-BULLYING PLAN The USD 402 Board of Education Policy JDDC Bullying prohibits acts of bullying (Approved August 20, 2007). Demonstration of appropriate behavior, treating others with civility and respect, and refusing to tolerate bullying behavior is expected of administrators, faculty, staff, and volunteers to provide positive examples for student behavior. DEFINITION Bullying Behaviors are:  Intentional, and largely unprovoked, efforts to harm another  Repeated negative actions by one or more against another  Imbalance of physical or psychological power  Negative action can be physical or verbal, and direct or indirect in nature including electronically transmitted acts – i.e. internet, cell phone, personal digital assistant (PDA), or wireless hand held device. EXPECTATIONS The USD 402 Board of Education believes that standards for student behavior must be set cooperatively through interaction among the students, parents and guardians, staff, and community members of the school district, producing an atmosphere that encourages students to grow in self-discipline. The development of this atmosphere requires respect for self and others, as well as for district and community property on the part of students, staff and community members. CONSEQUENCES Consequences for a student who commits an act of bullying shall be unique to the individual incident and will vary in method and severity according to the nature of the behavior, the developmental age of the student, and the student’s history of problem behaviors and performance, and must be consistent with the Board of Education’s approved code of student conduct. Consequences may include, but are not limited to: detention, suspension, or expulsion. Remedial measures shall be designed to: correct the problem behavior, prevent another occurrence of the behavior, and protect the victim of the act. Effective discipline should employ a school-wide approach.

COMPLAINT PROCESS The USD 402 Board of Education requires the principal and/or designee at each school to be responsible for receiving complaints alleging bullying behaviors. All school employees are required to report alleged bullying behaviors to the principal and/or designee. All other members of the school community, including students, parents, volunteers, and visitors, are encouraged to report any act that may be deemed a bullying behavior. The USD 402 Board of Education requires the principal and/or designee to be responsible for determining whether an alleged act constitutes bullying behavior. In so doing, the principal and/or designee shall conduct a prompt, thorough, and complete investigation of each alleged incident. When appropriate, these offenses will be reported to law enforcement officials using the district approved form. ANNUAL REVIEW The school administrators shall develop an annual process for sharing information pertaining to bullying behaviors with students, staff and community. The school district shall incorporate information into each school employee training program and handbook. TRAINING Staff and student training will be implemented in each building annually. Information regarding this plan will be made available to the community.

Emergency Safety Interventions (See JRB, JQ, JQA, and KN)

GAAF

The board of education is committed to limiting the use of Emergency Safety Interventions (“ESI”), such as seclusion and restraint, with all students.

The board of education encourages all

employees to utilize other behavioral management tools, including prevention techniques, de-escalation techniques, and positive behavioral intervention strategies. This policy shall be made available on the district website with links to the policy available on any individual school pages. In addition, this policy shall be included in at least one of the following: each school’s code of conduct, school safety plan, or student handbook. Definitions (See K.A.R. 91-42-1) “Emergency Safety Intervention” is the use of seclusion or physical restraint when a student presents an immediate danger to self or others. Violent action that is destructive of property may necessitate the use of an emergency safety intervention. “Seclusion” requires all three of the following conditions to be met: (1) the student is placed in an enclosed area by school personnel; (2) the student is purposefully isolated from adults and peers; and (3) the student is prevented from leaving, or reasonably believes that the student will be prevented from leaving, the enclosed area. “Chemical Restraint” means the use of medication to control a student’s violent physical behavior or restrict a student’s freedom of movement. “Mechanical Restraint” means any device or object used to limit a student’s movement. “Physical Restraint” means bodily force used to substantially limit a student’s movement. “Physical Escort” means the temporary touching or holding the hand, wrist, arm, shoulder, or back of a student who is acting out for the purpose of inducing the student to walk to a safe location.


“Time-out” means a behavioral intervention in which a student is temporarily removed from a learning activity without being confined. GAAF

Prohibited Types of Restraint All staff members are prohibited from engaging in the following actions with all students: •

Using face-down (prone) physical restraint;

Using face-up (supine) physical restraint;

Using physical restraint that obstructs the student’s airway;

Using physical restraint that impacts a student’s primary mode of communication;

Using chemical restraint, except as prescribed by a licensed healthcare professional for treatment of a medical or psychiatric condition; and

Use of mechanical restraint, except: o

Protective or stabilizing devices required by law or used in accordance with an order from a licensed healthcare professional;

o

Any device used by law enforcement officers to carry out law enforcement duties; or

o

Seatbelts and other safety equipment used to secure students during transportation.

Training All staff members shall be trained regarding the use of positive behavioral intervention strategies, de-escalation techniques, and prevention techniques. Such training shall be consistent with nationally recognized training programs on the use of emergency safety interventions. The intensity of the training provided will depend upon the employee’s position. Administrators, licensed staff members, and other staff deemed most likely to need to restrain a student will be provided more intense training than classified staff who do not work directly with students in the classroom.

Each school building shall maintain documentation regarding the training that was provided and a list of participants.

Documentation The principal or designee shall provide written notification to the student’s parents any time that ESI is used with a student. Such notification must be provided within two (2) school days. In addition, each building shall maintain documentation any time ESI is used with a student. Such documentation must include all of the following: •

Date and time of the intervention,

Type of intervention,

Length of time the intervention was used, and

School personnel who participated in or supervised the intervention.

All such documentation shall be provided to the building principal, who shall be responsible for providing copies of such documentation to the superintendent on at least a biannual basis. At least once per school year, each building principal or designee shall review the documentation of ESI incidents with appropriate staff members to consider the appropriateness of the use of ESI in those instances. Reporting Data District administration shall report ESI data to the state department of education as required. Local Dispute Resolution Process The board of education encourages parents to attempt to resolve issues relating to the use of ESI informally with the building principal and/or the superintendent before filing a formal complaint with the board. In the event that the complaint is resolved informally, the administrator must provide a written report of the informal resolution to the superintendent and the parents and retain a copy of the report at


the school. The superintendent will share the informal resolution with the board of education and provide a copy to the state department of education.

If the issues are not resolved informally with the building principal and/or the superintendent, the parents may submit a formal written complaint to the board of education by providing a copy of the complaint to the clerk of the board and the superintendent. Upon receipt of a formal written complaint, the board president shall assign an investigator to review the complaint and report findings to the board as a whole. Such investigator may be a board member, a school administrator selected by the board, or a board attorney. Such investigator shall be informed of the obligation to maintain confidentiality of student records and shall report the findings and recommended action to the board in executive session. Any such investigation must be completed within thirty (30) days of receipt of the formal written complaint by the board clerk and superintendent. On or before the 30th day after receipt of the written complaint, the board shall adopt a report containing written findings of fact and, if necessary, appropriate corrective action. A copy of the report adopted by the board shall be provided to the parents, the school, and the state board of education.
