RESERVE PRICES – All reserve prices MUST be submitted on a fully completed form with a complete and identifiable description of the lot with the Auctioneers prior to the day of sale. All reserves must be clearly stated on this form. Faxed reserves will be at the Vendors risk. No liability will be taken by the Auctioneers should these not be applied to the lot. The same will apply to reserves e-mailed. Verbal reserves will not be accepted under any circumstances if not accompanied by a fully completed form. HIRE PURCHASE – The Auctioneers must be notified on the Entry form of any items to be offered for sale that is the subject of any Hire Purchase Agreement. LIABILITY – Both the Auctioneers and the Landlords cannot be held responsible for any accident, loss or damage from any cause whatsoever which may occur whilst any item is on the sale ground. All Lots are at the Vendor’s risk until sold and the Purchaser’s risk immediately at the fall of the Auctioneer’s hammer. Please also refer to the Health & Safety Statement in the Office. The Vendor must deliver the item(s), (and if unsold collect) on suitable and safe vehicles to the sale yard. No unloading by the vendor using other equipment than that provided by the auctioneers unless it is a properly certificated lorry crane (including chains and slings) operated by a qualified user – be aware of safety to all persons at all times when operating on the sale site. It is your responsibility to attend at your own risk. If you are in doubt, ask. No persons whatsoever shall use any Forklifts or Loaders of any type on the sale premises, Car Parks or any other area connected with the Sale. The only machines for loading or unloading are those designated by the Auctioneers, operated by their appointed operators. No persons shall use or interfere with any Slings, Chains, Lifting equipment or any other equipment the Auctioneers use for Loading. All persons must at all times keep clear of the Loading or Unloading operations being undertaken by the Auctioneers or their Agents. INSURANCE - Vendors and Buyers Please Note: The responsibility to insure any lot Pre Sale or Post sale on a “not sold lot” falls with the vendor (seller) and any existing insurance must be maintained until the fall of the hammer. Once the hammer has fallen or the sale agreed post auction (in the case of lots sold “subject”) the responsibility to insure the lot falls with the buyer who should inform his Insurance Company immediately. Messrs Brightwells (The Auctioneers) will take no responsibility for the insurance of any lot whether pre or post auction – whether delivered prior to the date of sale, on the date of sale or post sale. FAULTS & MISDESCRIPTIONS – Every Lot must be taken to with all faults and misdescriptions (if any). Until sold, each Lot shall be at the Vendor’s risk and it shall be his duty to preserve the same. After the fall of the hammer such risk and duty shall devolve upon the Purchaser. The Auctioneers, on behalf of themselves and the Vendor, shall have a lien on each Lot for the purchase money thereof until actual payment. No Lot shall be removed from the place of sale until the sale has been concluded and a PASS obtained from the Auctioneers, or the Clerk. Notwithstanding such lien and the right of place of possession aforesaid, the Auctioneers will not undertake any risk as regards any Lot, nor any liability whatever, as to preservation or delivery therefore. SECURITY – Items left on the sale ground both before, during and after the sale remain the responsibility of the owner. VEHICLE DOCUMENTS – Entries of vehicles, which by law must be licensed for use on the Public Highway, and may not be Licenced or plated for the use on the Public Highway when sold should be accompanied by the relevant logbook, certificate for MOT plating and ownership transfer. Vendors are reminded that any provenance of this type is useful for marketing purposes and may be of use in describing the lot for sale. BANKING ARRANGEMENTS – Prospective Purchasers unknown to the Auctioneers should make the necessary arrangements with both their Bank and the Auctioneers at least 48 hours prior to the sale. LATE ENTRIES – Entries WILL NOT be accepted after 12noon on the day of the sale. ORDER OF SALE – Late entries will automatically be placed at the end of the sale and under no circumstances positioned in vacant Lots. Items found to be in an unauthorised position will not be offered for sale. SITE CLEARANCE – Lots either sold or unsold which are not removed in a reasonable time may attract storage charges. VALUE ADDED TAX – Where the Vendor is VAT registered the Vendor’s VAT number MUST accompany all entries. CONDITIONS OF SALE – All Entrants will be deemed to have read and agree to abide by both the Auctioneer’s Conditions of Sale (reprinted in the Catalogue and available for inspection in the Sale Ground Office) and the Supplementary Conditions set out, applicable to Machinery Sales. STOLEN LOTS – If any lot is or appears to be stolen the Auctioneers may hold the lot while the situation as to title is resolved. If event of any lot being paid out and subsequently proven to be stolen the Vendor will immediately repay all sums to the Auctioneer and being informed that the lot is or likely to be have been stolen, on demand. The Vendor in this case once the lot has proven to be stolen must pay to the Auctioneers such expenses and charges so demanded by the Auctioneers within seven days in addition to the sale monies. Any Vendor submitting a lot to sale MUST make sure that Keys, Starting Handles and Starting equipment is removed from the lot and handed to the Auctioneers. Especially important with any Engine equipment and of course with all Electrical items such as Generators which are a health hazard to persons, are entirely the Vendors responsibility to insure that all lots are in a safe position, on a starting mode when delivered. No lot should be started by any other means on the sale site other than that designated by the manufacturer of such lot. All other starting and towing, starting methods other than those designed particularly to start the machine are strictly forbidden. SALE PROCEEDS - Clients' monies paid to us will be held in Brightwells Ltd Clients' Auction Sales Account at Barclays Bank plc, Hereford Branch. Clients will not be entitled to any interest on balances in this account. Standard rates of Commission - For Machinery, Vehicles and the Utilities section we charge the vendor commission at 7.5%, and for items in the sundries section we charge 15 %. PLEASE NOTE DELIVERY AND COLLECTION OF ITEMS – Please confirm your time of arrival with the auctioneers on 07813 644303 (Chris Davies). H M CUSTOMS & EXCISE RULES Would all Vendors please note that we (Brightwells) will raise a self-billing tax invoice for the proceeds of any goods in this and any other sale held by us. It is a Customs & Excise requirement that this is the only tax invoice raised for those items. We must have your VAT registration number (where appropriate) together with your name and address for inclusion in any self-billing tax invoice raised by ourselves. You must notify us immediately if your VAT registration number is cancelled or if you are issued with a new VAT registration number. Any Vendor not agreeing to this system of self-billing tax invoice being raised by us must notify us prior to commencement of the sale. Regrettably, we can only operate with a self-billing system in place and, therefore, will not sell the goods of any Vendor who is unable to accept this system. NOTICE TO ALL VENDORS THE LOW VOLTAGE ELECTRICAL EQUIPMENT (SAFETY) REGULATIONS 1989 The Electrical Equipment (Safety) Regulations 1994. The supply of electrical equipment that is in need of reconditioning or repair to someone who carries on a business of repairing and reconditioning electrical equipment is excluded from the 1994 Regulations by virtue of the Act. Similarly the sale of articles as scrap is also excluded. The charge for this compulsory testing will be £3 + VAT per item whether sold or unsold. A qualified Electrician will be on site on the morning of the sale prior to the commencement of the sale.
