Payroll tax fight far from over By Ellen Daley In our July 2009 Business Viewpoint, the feature article, “MTA = Most Treacherous Assessment,” decried the state legislature’s approval of a payroll tax to bail the Metropolitan Transportation Authority out of a $1.5 billion budget shortfall.

‘More determined than ever’ Two full years later, we’re still fighting the payroll tax battle. No one in the business community has forgotten the “egregious, offensive, mind-numbing, unconstitutional” legislation that forces businesses and organizations in the MTA’s 12-county service territory to pay 34 cents for every $100 of payroll. “If anything,” says Chamber President Dr. John D’Ambrosio, “we’re more determined than ever to do something about this staggeringly unfair assessment.” Last November, Assemblyman Joel Miller took action by sponsoring legislation that would have had the tax end or “sunset” on December 31, 2010. While Miller’s bill was unsuccessful, it was one of the first attempts to introduce legislation that would do something about the infamous tax and this Chamber fully supported the effort. At Viewpoint press time, the NYS Legislature was in its final week before summer recess. Writing in the Times Herald-Record on June 15,

They’ve been behind the business community as we formed coalitions of chambers of commerce

and other groups to oppose the tax.

Chamber takes action For several months, the Chamber has been part of a lawsuit challenging the constitutionality of the payroll tax. resenting Chamber and the other clients in this effort. A few months ago, the Chamber began a campaign to get signatures on a petition calling for a forensic audit of the MTA. To date, more than 600 signed petitions have been returned and they’re still coming in. Assemblywoman Annie Rabbitt conducted her own petition drive, as did the Dutchess County Regional Chamber of Commerce and others. Anyone who has not yet signed a petition can find it on the Chamber website (www.orangeny.com). All the petitions will be presented to our state legislators in the near future. As was noted in our July 2009 article, New York State already has one of the nation’s most oppressive tax burdens, with property taxes 78% above the national average. Business pays more than $14 billion in property taxes, making it the single largest tax on business in the state. “This situation has been a tremendous eye-opener,” said Dr. D’Ambrosio at the time. “We all know that New York State is not particularly business-friendly, but the enormity of this turn of events has hit us all over the head. But rather than knocking us out, it’s put us on high alert to not let it happen again.” Two years has only served to up the ante.

Chairman’s Message It seems evident that we will have to become masterful at the art of change if we are going to achieve desired accomplishment with the least amount of stress. The ability to adapt to changes and transitions is crucial. Change is something that happens Johnson abruptly, like the loss of one’s job or a major client. On the other hand, a transition is when you go through a substantial change as a result of moving from one thing to another, such as going from one company or position to another. Both change and transitions cause stress due to the uncertainty of being in a new or different situation. To complicate the matter, we have to learn to deal with many new uncertainties in order for us to be productive since there are many outcomes or changes are still unknown, such as the impact of healthcare. Whether your company or you are undergoing change, transitions,

Orange County’s looking for you The County of Orange purchases about $233 million in goods and services every year. In a brand new program just launched by the Chamber and Orange County’s Department of Purchasing, Chamber members have a direct line to be able to bid on some of that business.
