As one of the best-regulated property markets in the world, France offers buyers excellent protection The process of buying and selling real estate in France is well supported by consumer protection laws: It is structured and very strictly defined by French law, with a series of checks and balances designed to ensure a fair and legal transaction takes place. F

rom a legal standpoint, the key benefit to buying property in France is buyer protection. Numerous aspects of the buying process are biased in the purchaser’s favour. Issues such as title deeds and planning permissions are very strictly controlled and monitored, making it very rare for property transactions to go awry. Regulations governing the sale and purchase of property in France are long established and strictly governed and enforced by the notaire assigned to the contract. A notaire is a government official, responsible for receiving the deeds. The notaire is under the authority of the French Department of Justice and is appointed by decree. This profession has a monopoly in matters relating to purchases, sales, exchanges, co-ownerships of real estate, leases, mortgages, etc. Thus, transfer deeds must be prepared by a notaire, whose role consists of authenticating the parties’ signatures. Notaires do not represent the interest of either party in the transaction. Nevertheless, many people believe having their own independent legal advisor is necessary. There are mandatory precedent conditions for the sale contract, which make completion subject to the buyer’s ability to obtain the financing of the property in question. The seller is legally bound to assume a guarantee to the property’s precise surface and is under a legal obligation to disclose certain defects (specifically termites, asbestos and lead). Buyers are protected by a 7-day cooling-off period, during which time they may withdraw from the contract and receive a full refund of their deposit.

All conditions must be fulfilled

An initial agreement sets the sale’s terms and conditions. There is a provisional contract

while the notaire prepares the Title Deeds. The preliminary contract is legally binding upon both the buyer and the vendor: the two parties agree – one to sell, the other to buy – subject to specific conditions called “conditions suspensives”, and only if all these conditions are complied with. The property transfer only becomes effective once all the conditions are fulfilled. Precedent conditions may, for example, include obtaining a loan, clearance from a structural survey or obtaining a planning permission. Prospective buyers should carefully review the contract’s terms and ask questions of their own advisor. In the same way, buyers should not hesitate to negotiate the clauses of the contract. Do not make any payment before signing. Buyers are expected to pay the notary or the estate agent a deposit, but should never pay anything to the vendor or the developer directly. One of the main advantages of the French two-stage conveyance process lies in the fact that, once the initial contract has been signed, sellers cannot pull out and sell the property to someone else. Gazumping, the practice of sellers pulling out of a sale at the last minute without penalty, is non-existent in France. Where a seller decides to pull out, a court may order him to sell or pay the buyer high damages as compensation. In French law, there are limited situations where gazumping can take place. A pre-emption (preference) right may arise in favour of one or several local authorities. Also, all purchases made by joint owners can be subject to the pre-emption right of the other joint owner. Once the initial agreement or ”compromis” has been signed by both buyer and seller, there is still a 7-day cooling-off period. During this time, the buyer may withdraw from the sale without penalty, but the vendor cannot. In

order to exercise this right, a registered letter must be received by the notaire before the seven days have elapsed. Property transfer takes place only at the time of the signature of the Title Deeds (Acte Authentique) at the notaire’s office. The notaire will have previously carried out the relevant planning checks and Land Registry searches and ensured all precedent and legal conditions are met. The purchaser is given a provisional ownership certificate whilst the title deed is being registered. The notaire pays the vendor the balance of the price and hands over the keys to the purchaser. Pre-sale surveys also bring purchasers a fair degree of protection. The “dossier de diagnostics techniques” includes all the mandatory reports that must be provided to protect both the vendor and purchaser. These are increasing regularly in number and are all provided at the vendor’s expense. The tests required vary depending on the region and property. Since 2002, a survey mentioning the presence or absence of building materials containing asbestos (walls, posts, beams, floors, etc.) must be carried out before the sale of those buildings whose planning permission was delivered before September 1, 1997. For dwellings built before 1948 and located in designated areas, another survey must be carried out by a qualified technician in order to establish the risks of lead poisoning. In other designated areas, a further compulsory survey reveals whether the property is infested with termites. The surveyor’s report must be less than three months old at the time of completion and is attached to the title deeds. The price stipulated in the contract is deemed to take account of any financial consequences arising from the condition of the property, such as with regard to termites, asbestos, lead poisoning, energy performance and major natural and technological risks. 34

High-end property at the lowest possible price

French off-plan real-estate purchases offer investors the ability to acquire high-end property at the lowest possible price and achieve maximum potential return on investment. Some investors are concerned about buying off-plan as they have heard frightening stories from other markets where developers have disappeared with their money without completing the work. Buying off-plan in France is, however, very formalised and the buyer of new-build properties is highly protected. The French construction industry is highly regulated and developers by law must meet rigorous government standards. All new properties must meet the new building regulations and energy efficiency measures. Contracts for the sale of new off-plan properties provide for payment of a deposit (up to 5%) and subsequent stage payments and precedent conditions. The initial security deposit is paid into a client escrow account and is fully refundable should the transaction not be completed. The reservation contract is a comprehensive document that must contain a full description and plans for the proposed dwelling and its precise location. It must also include a technical description of the materials and equipment used in the construction, and list the communal facilities and their conditions of use. This document is called the “notice descriptive” and is contractually binding on the builder. The deed of sale is signed before the building work is complete, usually once the foundations have been laid, and purchasers acquire ownership of the land and whatever buildings have been built upon it at the time the deed of sale is signed. Buyers automatically acquire ownership of the rest of the building as building progresses. French builders and developers are required

by statute to obtain a completion certificate in place to ensure that the property is being completed. It is advisable to insist on such a certificate being provided by a third party, such as an independent architect.

France’s off-plan record excellent

These statutory safeguards throughout the conveyance process are a huge advantage for off-plan property buyers. There are welldocumented problems regarding off-plan purchases in Spain and several other counties. However, the good news is that France has a very good record in this respect. For example, the process guarantees that beyond a certain stage of the development and payments, whatever may happen to the developer (e.g. if the developer goes bankrupt) the property officially belongs to the buyer and will be completed to the agreed standard by another builder appointed by the guarantor, usually a bank or an insurance company. The guarantee of completion is mandatory. It ensures the purchaser that the developer will be able to continue construction until completion of the building. In practice, the backup guarantee rarely proves necessary, but it means that if the builder goes bankrupt, the project will still be finished. This is a particularly salient point when compared to the situation in Eastern European countries such as Bulgaria, or in Spain, where this safety net does not exist. Buyers cannot lose their investment, nor can the price be raised. Another safeguard lies in the 10-year building guarantee rule. The property is guaranteed to be free from structural building defects for 10 years by the builder and his insurers. Several other mandatory guarantees apply, such as a 2-year guarantee for non-structural defects. French off-plan purchase agreements set fixed delivery dates, but most contracts include a waiver in case of force majeure, such as an act of God. Very bad weather over a long period of time, for example, may be regarded as an

act of God. In any event, delays in completion of new off-plan developments are rare and usually are for no more than a couple of weeks. Where delays are unreasonable and substantial, off-plan property buyers may cancel the agreement and receive full reimbursement. What can amount to unreasonable delays is a matter for judges to decide, depending on the circumstances of each case. Buyers may be awarded compensation where they suffer damage as a result of the delay, but in order to also obtain penalties, a suitable clause must be included in the reservation contract. Another example of French consumer protection laws that offer good security lies with the fact that buyers are entitled to pull out and get a full refund if the property upon completion differs from what is set out in the reservation contract, and these differences reduce the value of the property by 10% or more. These laws are strictly enforced but given the differences in language, culture, law and ethics, it remains advisable to obtain a qualified French lawyer to proceed through the purchase or sale process. Investors should exercise due diligence and choose wisely, making sure that the builder and developer have a track record of building high-quality real estate and that their property will be situated in the right location. While visa requirements and other rules and regulations often limit the options, there are a number of countries that grant automatic residency to property buyers. By buying a new home, it may be possible to kill two birds with one stone – in a very big way. Here is a guide featuring some of the best places in the world in which buying property grants automatic residency to the country.

Want to Work? We all know that there are some parts of the world where the economy is performing better than the rest of the world, where unemployment is not such a problem. There are even such places that grant residency to property buyers.

Malaysia Automatic Residency Foreigners are automatically granted residency in Malaysia when they buy a property, no clauses, no catches, plain and simple. Chance of Capital Appreciation: Excellent Malaysia has always been one of the favourite Asian property markets. During the boom it never overheated, with growth remaining steady at around 10% per year. Now, after

a short recession (about four months), it has fallen into the same trap as many Asian markets that survived the crunch unscathed and has overheated. However, the government is already acting to slow growth to bring the market to a soft landing, from where steady growth can resume. Malaysian property is therefore a safe bet for capital appreciation over long-term ownership. Few Restrictions on Foreign Ownership Because Malaysia is formerly a part of the British Empire, it has many laws left over from that time. One is a very relaxed system on foreign property purchases. Foreigners may buy any property, anywhere in Malaysia, as long as it costs more than RM500,000 (€124,500), although they are currently trying to make it RM1million (€249,000).

First Language is English Malaysia is a fantastic place to move to and work, especially for those from Englishspeaking countries or who are fluent in English. This is because English has been the first language ever since it was part of the British Empire. This also makes it easier to buy property because all contracts are in English as well. Foreigners May Obtain Financing Foreigners may easily obtain mortgages in Malaysia, both from Malaysian banks like Maybank and from international banks operating in the country, including HSBC. Relaxed Tax Regime While it is about average on things like income tax, Malaysia has a very relaxed tax regime including no annual wealth taxes, no estate duties, no gift taxes, no accumulated earnings tax, no federal (as opposed to national) income tax, no controlled foreign company legislation, no thin capitalization rules (yet) and no transfer pricing rule. After being abolished, capital gains tax was recently reinstated on property sales to curb speculation. Currently, gains from the sale of property are taxed on a sliding scale: from 10% if a property is sold in Year 1, to 0% if it is held for more than five years. Income tax for non-residents is a flat 26%, payable on Malaysian-sourced income. However, permanent residents are classed as resident, and resident individuals are taxed on chargeable income at graduated rates from 2% to 30%, after the deduction of tax relief. First-Class Healthcare Another remnant of its being a British colony is a world-class healthcare system. In fact it is so good that medical tourism is taking off. Growing Economy After one of the shortest recessions of the financial crisis, the Malaysian economy has been growing strongly since 2010. According 204

to the CIA World Factbook, Malaysian GDP rebounded from a 1.7% contraction in 2009 and grew 7.2% in 2010, then 5.2% last year. What’s more, reports indicate great growth in job opportunities for skilled foreigners as the country develops. Outside Natural Disaster Danger Zone Malaysia is outside the Pacific Ring of Fire so there is little risk of earthquakes, tornadoes and tsunamis. Cheap Property While prices have grown rapidly of late, Malaysian property prices are still low compared to many developed nations. For example, it is possible to pick up an attractive 2-storey, 4-bedroom townhouse in Bukit Bandaraya, Jalan Medang Serai or Kuala Lumpur for just 1.35m Malaysian Ringitt, which is over the foreign ownership limit, and currently converts to £274,000. Possible Drawbacks Disease, in particular tuberculosis, is epidemic. Of course, most developed nations immunise against TB in childhood, but this is certainly worth consideration. AIDS is also a big problem in Malaysia.

United Arab Emirates Automatic Residency Foreign buyers of property in United Arab Emirates are automatically granted a 3-year residency permit, which can be easily renewed. Chance of Capital Appreciation: Fair/Good As it is such a wealthy region, it is easy to say that chances for positive capital appreciation are good. However, many investors are nervous about the UAE. Currently it looks as though Dubai might be clambering back to its feet, but at the same time, the UAE is looking increasingly desperate as it constantly shifts the goalposts to keep up the appearance that authorities are control-

ling the slowdown. That said, with all that wealth and because it is such a great place to do business in, it will take some pretty spectacular crashes to stop property prices from growing over the long term. This makes it a question of whether they can learn from the mistakes of the recent past with regards to over-building, rampant speculation and, most of all, over-ambitious plans. Excellent Business Environment The United Arab Emirates is one of the best places in the world to start a business, from the favourable tax regime, to the trade tariffs and central location. Benefits of starting a business in UAE include: No foreign exchange controls No trade barriers or quotas Competitive import duties (4% with many exemptions) Competitive energy costs Competitive real estate costs Competitive financing costs and high levels of liquidity No taxes (except for oil companies and some foreign banks). On top of that, the UAE is a liberal and very wealthy Arab state, very friendly to foreign investment and as such, the regime invites foreigners to start businesses. Foreigners May Obtain Financing Foreigners may obtain mortgages relatively easily in the UAE, not least because international banks are very active in the country. Relaxed Tax Regime United Arab Emirates has a very friendly tax regime and individuals are not taxed. Inheritance and estate taxes are, in the absence of a will, dealt with in accordance with Islamic Sharia principles. Real Property Tax: A transfer charge of 2% is levied on the transfer of the real property, with

the seller paying 0.5% and the buyer paying 1.5% on the sale value of the property. Net Wealth/Net Worth Tax: Does not exist Capital Acquisitions Tax: Does not exist. The UAE is an oil-rich country, which is why it can afford to have such a comparatively lax taxation system. Possible Drawbacks Language barriers: While the expat population is large and English fairly widely spoken, unlike Malaysia, the first language is not English, and foreigners will find it difficult to communicate at times. Emiratisation: Companies are being encouraged to hire more local residents for whitecollar jobs, and a quota system is in place for the insurance, banking and trade sectors. The number of Emiratis employed has gone up by as much as 300% in some sectors as a result of Emiratisation. Arab country, Islamic law, Islamic way of life: The legal system in Muslim countries is far different from most non-Muslim states, including jail sentences for defaulting on debt. Dress and behaviour should be modest, buying and consuming alcohol requires a licence, and living together without being married, adultery and homosexuality are all illegal.

Its beaches are home to beach bars where food and drink may be ordered to enjoy under the shade of the palm trees that line the beaches. The azure blue waters of the oceans that lap these places of paradise are not only bearable, but as warm or warmer than most indoor pools. But this is also a part of the culture. Everything but the temperature is chilled on St. Kitts and Nevis – people are laid-back. This means you can be/ do the same. It is a slower pace of life and this is what many of us desire. Possible Drawbacks Little chance of working: In order to work in St. Kitts, you need a work permit and these are hard to get. You will need to find an employer who is willing to sponsor your application and prove to the labour ministry that you have a unique skill and/or there are no locals who could fill the position. Even if it can be proven that no local could fill the position, there is no guarantee that the permit will be granted. If you are granted a permit it is good for one year, and then there is equal doubt as to whether it will be renewed. Unfortunately, the residency-by-investment program does not affect the work permit application. Technically, you may not live or work on the island while the work permit is being processed, but some applicants do remain as non-working visitors. Tropical Lifestyle: According to people who have moved to St. Kitts and Nevis, you really have to love the tropical lifestyle, because apart from the beaches and the activities that go with it (diving, snorkelling, boat trips, etc.) there is not a lot else to entertain you. There is very little in the way of culture, art galleries, museums, etc. Not that St. Kitts does not have a rich history or culture – it does – it just lacks places where it is displayed. There is the National Museum, which opened in the last few years, as well as the carnival at Christmas

and the masquerade balls celebrating St. Kitts’ exotic fashions and dance. Expensive: St. Kitts and Nevis is a tax haven for millionaires from all over the world, and the tourists who visit the island are predominantly wealthy as well. As a result, some activities, bars and restaurants aimed at tourists and expats are on the expensive side, which can push up the overall cost of living. However, reports of high costs are usually associated with people living on local salaries. If you are going on an expat package, or running an international business, you will be able to live comfortably.

Bahamas Residency through Investment Buying a property costing USD500,000 or more will almost guarantee that your application for permanent residency in Bahamas will be accepted quickly, provided you can prove you are of good character, financially solvent, and say in writing that you wish to live permanently in Bahamas. Employees pay national insurance contributions, there is stamp duty on property and mortgage transactions, and a tax on real property. Seychelles Automatic Residency Permit to Property Buyers This is the simplest deal of its type: Quite simply anyone who buys a residential property in Seychelles is automatically granted a residency permit. The residency permit is valid for five years, after which it can be easily renewed by paying the application fee of approximately USD12,500. Chance of Capital Appreciation: Good For the same reasons as St. Kitts, Nevis and Bahamas, property in Seychelles has a good chance of capital appreciation because property is expensive and sought after. That said, the unspoilt nature of the islands leaves a lot of room to build and to increase supply, which is a controller of price growth. However, over a longer term, capital appreciation is a good bet.

Unspoilt Paradise Much of the land on the 115 islands that make up Seychelles is still unspoilt and untouched. While clean air and clear skies are big attractions to many people, others may see the great wilderness as being stuck in the middle of nowhere. Tropical Climate Temperatures in Seychelles rarely drop out of the 80s, making it very warm and humid, but residents report a near-constant breeze. As it lies in the Indian Ocean, there are some quite heavy rainstorms on the Islands, but expats report that the rain often falls on only one side at a time of a given island, at which point sunlovers simply move to the other side. Outside the Hurricane Belt Like St. Kitts and Nevis, Seychelles is outside the hurricane belt, so there is little risk of natural disaster affecting your paradise life on the islands.

Tax Regime Seychelles is not the offshore tax haven it once was, not least because buying shares and banking is no longer as anonymous as previously. However, there is no inheritance tax, no capital gains tax and no individual income tax. Also, if you have a business that is classified as non-resident and does not source its income from the islands, no taxes are payable. If income to the business is from within the islands, there is a tax of progressive rates ranging from 0-33%. Use of English While Creole is the main language spoken on the islands, English is used in the business world and in all contracts and legal proceedings. Possible Drawbacks Robinson Crusoe Syndrome: Some forums say that Seychelles is a great place to visit but you would not want to live there, because there is not enough to do.

Language Barrier: Creole is the most widely spoken language in Seychelles. As it lives from tourism, this will not be a huge problem most of the time, but when living there you will not only frequent touristic locations and could encounter a language barrier.

Mauritius Mauritius is located beside Seychelles in the Indian Ocean, so it shares the same turquoise waters, great white sandy beaches and warm, breezy climate. The PRS grants residency to foreigners who purchase up to 1.25 arpents (5,050m2) of residential property costing at least USD500,000. Foreigners may only purchase land at least 100 metres away from the sea. Under the IRS, foreigners may purchase luxury villas of up to 1.25 arpents each. As a property owner, a residency permit is also granted, which is extended to the investor’s family. SAPES is an incentive to encourage professionals to work in Mauritius and allows foreign professionals to acquire residential property.

More in the Way of Culture The main island of Mauritius is much more heavily populated than the smaller islands of Seychelles, although it still has its unspoilt areas with pristine beaches, jungles and national parks. With a bigger and denser population comes a better experience in terms of culture and a wider choice of restaurants, bars and shopping. Languedoc-Roussillon takes its place among France’s most coveted real estate markets

As passenger volumes hit record highs, Nice Côte d’Azur airport has announced plans for a third terminal. With total passenger numbers nearing 10.5 million in 2011, officials hope the construction of Terminal 3, slated to begin in 2016 and be ready for opening in 2019, will reduce aircraft turnaround time to approx. 25 minutes. This would allow low-cost airlines to increase the number of flights they operate. It is expected Terminal 3 will have the capacity to handle four million passengers a year. Passenger volumes hit record highs at Nice – numbers went up by 8.5% in 2011 – and airport authorities say they expect a further 20% increase by 2016, which would bring total numbers up to 12.5 million. Nice Côte d’Azur airport – France’s second biggest - boasts 105 direct destinations and 59 scheduled airlines at present. It is the only regional airport in France to provide a daily service to New York and Dubai. Situated at the hub of the French Riviera, Nice’s second-home property market continues to attract strong interest from real estate investors, with its culture, Mediterranean climate, internationally acclaimed events, shopping and beaches. The new “Barbados Residential Insight Report” reviews the performance of the market in the past 12 months, with a close look at who is buying, where they are buying and what they are buying. Prices are reported to have fallen between 5-10% in 2011. This year, the property market seems to be picking up pace as buyers are reacting to price corrections and supply remains limited. The report predicts that prices will quickly stabilize, noting that the island’s tax-friendly regime for those of high net worth, as well as the quality of stock on offer, will help to stem the fall that began last year. In fact the report predicts that prices will begin to rise again in the most desirable districts of the island. Most buyers are said to be looking for longterm investments in lifestyle properties that they plan to use as second homes. Others are attracted by the tax regime to make Barbados their permanent home. Barbados stands out from its neighbours in the Caribbean for its modern infrastructure, excellent beaches, easy access – more than 20 international fights a day, including two from the UK – and enticing lifestyle. Tourist demand will drive Phuket’s strong property market Incredible beaches, beautiful islands in the sun, reefs for snorkelling, Phuket epitomizes the ultimate tropical paradise. Foreign buyers see Paris as a safe property haven The most visited city in the world is seeing increased real estate buying activity from Russia, the Middle East and Asia, research from Knight Frank shows. The study indicates that while British, Italian and German buyers continue to lead the way in 2011, clients from those developing markets are now showing a high degree of interest in Paris’ real estate market, too. Buyers are increasingly looking for a safe haven from volatile stock markets, underperforming securities and low savings rates. Of particular interest to the international buyers are the 6th, 7th and 8th arrondissements, where most of the most exclusive neighbourhoods are located. “Wealth preservation is now a priority for buyers rather than short-term capital appreciation,” said the report, particularly when lifestyle benefits are attached. Prices were strong, with apartment rates up 14.8% year-over-year, to €8,390 per square metre by the end of 2011, according to Notaires - INSEE. Yet the price of prime real estate is still 20% to 30% less than in central London. Apart from a paradisiacal lifestyle, some of the attractions of buying property in the Seychelles are a beneficial tax regime and generous purchasing regulations. Foreign buyers are allowed, for example to own 100% of a property and to repatriate all of their capital and profits. As well there is no wealth tax, no property tax, plus no capital gains or property tax.

Brazil overtakes the UK as the world’s sixth-largest economy Brazil has overtaken Britain and is closing in on France and Germany on the world list of economic output leaders. As the world’s next economic superpower, the South American giant saw an increase of 2.7% last year in economic output, compared to just 0.8% in the UK, and the country claimed the world’s sixthlargest economy with a total economic output valued at £1.56 trillion. The international leaders continue to be the United States, China and Japan. In the past decade, however, Brazil has fortified its position in agriculture, adding economic depth beyond its huge oil reserves off the Atlantic coast, and has seen an immense increase in foreign investment. The national minimum wage rose by 10% in 2011, domestic

tourism and domestic consumption are increasing in a robust fashion. Brazil’s property market is also performing strongly due to the domestic economy, which seems to experience very little exposure to global economic fluctuations. Indeed, Brazil is fast becoming a sound property investment choice thanks to its affordable cost of living, a salubrious climate and strong capital appreciation. On the back of strong economic growth and big demand drivers, Brazilian real estate ranks as a top choice of most global property investors in 2012.

Malta emerges as a property hotspot The tiny island nation of Malta now stands above most of its Mediterranean neighbours as a bright light in the world of economics, having bucked the recessionary illness that has swept from Spain in the west to Greece in the east. Following a short and shallow recession, Malta chalked up a 2.7% GDP growth rate in 2011, which was driven largely by manufacturing exports and tourism. Meanwhile, the Maltese banks emerged nearly unscathed in the international banking crises and did not seek any direct financial backing from the government. In fact on a recent list of 142 nations mentioned in the World Economic Forum’s “Global Competitiveness Report”, Malta’s banking system was listed as the 12th soundest. Although Malta is the smallest member state of the EU in terms of both size and population, most sectors of the island’s economy are performing exceptionally well during a time of doom and gloom among other Mediterranean countries. While construction was somewhat down, real estate grew in the past 18 months as investors sought out quality properties.

The country enjoys one of the world’s finest climates, along with good educational institutions and health care. Add to that the widespread use of English and Malta has the perfect formula for making progress in these troubled times. Bloomberg Markets Magazine adds: “Malta is also attracting a wave of hedge-fund executives lured by an appealing tax structure, a highly educated and relatively inexpensive professional workforce and a coveted and very highly regulated address inside the European Union.” By the end of 2011, there were more than 500 funds with €8 billion under management in Malta, compared with 165 funds with less than €5 billion Euros under management in 2006, according to the Malta Financial Services Authority. Ryanair will introduce new routes to Malta this year with planned flights from Bournemouth, Kaunas, London Stansted, Malmö, Oslo Rygge, Turin and Wroclaw. Such new links are expected to boost traffic to Malta to more than 1 million a year. The growth of low-cost flights to Malta has been a major factor in boosting both tourism and sales of properties to overseas buyers from the UK and across Europe. Property prices also remain competitive compared to rival holiday homes destinations, such as Cyprus and Portugal. Where to eat Best Brunch Zuni Café San Francisco is known for its culinary scene, boasting many of the best restaurants in the country. Best Dinner with Atmosphere Gitane Named after the French word for gypsy, this spot is tucked away in a quiet downtown alley and known for its fearless and unpretentious interiors by Mr. Important. Imagine red crocodile wallpaper, giant sensual tapestries, an oxblood vinyl ceiling with enormous chandeliers surrounded by medallions made from moss-covered rocks, and bright-coloured striped velvet banquettes, to name just a few details. But Gitane is of course also worth a visit for its unique artisan cocktails and always pleasing flavours from the Iberian Peninsula, France and Morocco, which are expertly crafted by chef Bridget Batson. The dark interior with its open kitchen is small and simple, and seating is

Where to drink Best Café Mavelous Coffee & Wine Bar San Francisco is not only known as a food mecca, but in recent years it has also become a destination for coffee aficionados. Barista Philip Ma, owner of Mavelous, is very serious about coffee. So as to appreciate the various nuances of beans and roasts, he serves only the very best boutique varieties. Best Day Trip Napa Valley The Wine Country north of San Francisco is well worth a visit, but too vast to explore in one day. Ranging from Sonoma to Mendocino to Napa, the region is covered in countless vineyards, beautiful forests and rivers, and dotted by charming towns. If you only have a day, I recommend visiting Yountville and St. Helena. Both towns have much to offer when it comes to culinary delights, shopping and wine. Yountville is home to the world-renowned and Michelin star-rated French Laundry restaurant, which requires

reservations months ahead. But luckily the town is blessed with a number of other great restaurants, including award-winning chef Michael Chiarello’s Bottega. A unique concept was created by Ma(i)sonry, a winery collective and art gallery. It offers tastings in a historic 19th-century stone house and a landscaped sculpture garden, complete with seating around a fire pit, my personal favourite spot to enjoy an amazing glass of wine. St. Helena, just 10 miles north, is a popular destination for shoppers, foodies and wine-lovers alike. Favourite shopping spots are the Martin Showroom by fearless interior designer Erin Martin, the gourmet food emporium Dean & Deluca, and Prager Winery for amazing ports. For nourishment visit the casual eatery Cindy’s Backstreet Kitchen by top chef and restaurateur Cyndy Pawlcyn, or the romantic hillside Auberge du Soleil in nearby Rutherford for a sunset view. Plus, of course, all the wineries in between. INGREDIENTS 200g 1 tin 5cl 200g 200g 200g 200g 0.5 ltr

smoked pancetta, chopped into small cubes (6 dozen) Escargot de Bourgogne, rinsed and strained cognac onion, chopped into small cubes carrot, chopped into small cubes celeriac, chopped into small cubes butter Chablis

1 bunch of curly parsley 8 cloves of garlic 5cl pastis Wonton square sheets (Chinese thin pastry) 1 egg beaten Method In a large pan fry the pancetta until crispy, add the snails cook for 2-3 min. Deglaze the pan with the cognac and reserve the pancetta & snails. In the same pan, sautée the onion, carrot and celeriac with 50g of butter for 6-7 min, add the pancetta & snails deglaze with the 0.2l Chablis. Then reduce until all the wine has evaporated. Blend ¾ of the parsley, 7 garlic cloves and 0.3l of Chablis. Add the paste to the pan with 100gr butter, bring to a boil and reduce on a medium heat for around 15 minutes until the sauce thickens. Check the seasoning, add the pastis and leave to cool in the fridge for 1 hour. When cool, divide the snail mixture into 24 small balls Lay 6 wonton sheets down and brush with egg. Place the snail mixture in the middle, put on top a second sheet of wonton and press gently to remove any pockets of air then place on a lightly floured tray and cover with a tea towel. Cook the ravioli for 3 min in large pan of boiling water and drain. In a small pan heat 50gr butter, 1 crushed garlic clove and the rest of the parsley (finely chopped). Plate the snail ravioli (3 per person) and pour over the garlic and parsley butter. For 8 people, 3 each 250

INGREDIENTS Frozen ganache centre 200g cream 110g Valrhona 70% chocolate 50g unsalted butter Sponge 110g 64% Cocoa Barry milk chocolate* 110g butter chopped 35g cocoa powder** 30 g potato flour 3 eggs, separated 120g caster sugar

Milk sorbet 2ltr milk 160g sugar * available from specialist supplier or good quality milk chocolate ** 21% Cocoa Barry, pure bitter chocolate

METHOD Ganache Bring cream to boil Remove from the heat and mix in large pieces of chocolate and butter Whisk until cold, then chill Once chilled freeze into desired shape (ideally a small sausage shape) Sponge mixture Melt chocolate and butter in bain marie Stir in cocoa and potato flour Whip the egg whites and yolks separately and incorporate half of the sugar in each of them Fold the eggs into chocolate

To cook Heat oven to 200°C/ Gas Mark 4 Line small deep metal ring tins 7cm in diameter, with greaseproof paper Fill each with sponge mixture Place the frozen ganache in the centre then cover with more sponge Cook for 12-14 minutes Milk sorbet On the hob, reduce milk with sugar until it’s 800g in weight Once cold, pour into an ice cream maker Serve whilst the chocolate sponge is still warm with the ice cream next to it Serves: 4
