elcome to 2021’s first edition of On Premise.
Although 2020 was one of the hardest years I can remember in this industry, it has been my honor to serve all 5,000 members of the TLW over the past few years. It has been tough for our members — from our 10-stool mom-andpop bars all the way up to our huge resorts. Through all of the chaos, however, we at the TLW have worked day and night to make sure that our members have been informed on the issues facing them. We have fought the good fight on our members’ behalf at every turn. We will keep on looking out for you as this new year progresses as we know we are not out of the woods yet. That’s why membership dues to this organization are the best investment anyone in this industry can make. The TLW is an organization that I believe in. I think being a member is a necessity for anyone working in the beverage alcohol industry. I am very proud of this association and what we do. I strongly believe that, without the TLW having our backs, the Wisconsin hospitality industry would not exist and prosper as it does today. Over the years, this organization has made great advances in helping to shape and pass legislation that improves the lives of the independent mom-and-pop business owner, and we will continue to fight for the welfare of our members in the years to come. Those who would propose and pass laws that can harm your business and make it harder for you to be successful will not rest, and neither will the TLW. We are determined to do our best for you — our members. We will continue to monitor and fight against detrimental influences to your business, and promote legislation that will add value to your business and bottom line. WHERE YOUR DUES GO The TLW receives $125 of your annual dues, whereas the remainder stays with your local league. The amount of dues that local leagues charge varies from $0 to $50 annually. The breakdown of the $125 that goes to the TLW is as follows: $67.50 stays with the TLW to pay for: • A headquarters office building in Madison. • A toll-free 800 number to keep you in contact with the Madison office staff and our lobbyist. • A monthly TLW newsletter to keep you abreast of legislative issues facing our industry, details of events and activities going on within the organization, as well as a calendar of events. •

MISSION STATEMENT & CODE OF ETHICS OUR MISSION The TLW is a 5,000-member, non-profit trade association dedicated to serving the needs of the retail beverage alcohol segment of the hospitality industry in the state of Wisconsin. The league exists to provide services to members that are not available to them as individuals and to use the collective strength of its membership to accomplish, as a group, goals that cannot be accomplished alone. The league provides its members with services, such as legislative and governmental relations, legal information and educational services, and promotes the industry on behalf of its membership.

INDUSTRY EDUCATION GETTING AN EDUCATION BARTENDER COURSES Online Bartending Training – TIPS Training The TIPS on-premise training course is an online program designed to teach those who sell and serve alcohol ways to prevent intoxication, drunk driving and underage drinking. This two- to three-hour online course addresses concerns specific to restaurants, hotels, bars, nightclubs, banquets, private parties and other on-premise liquor license holders where alcohol is served by the drink. eTIPS certification is valid for three years. Online Bartender Course – 360 Training With 360training.com, you can take your Bartending Certification training and exam anytime and anywhere you have an internet connection. The Wisconsin Responsible Beverage Server Training is a four-hour interactive e-learning course that teaches students how to responsibly sell and serve alcoholic beverages in the state of Wisconsin. This certification is good for three years. For more information about both courses, visit tlw.org/education/bartenders.
RESTAURANT MANAGERS CERTIFICATION The National Registry of Food Safety Professionals, approved by the Health and Family Services (HFS) Department, approves our instructors and provides the TLW with state-approved examinations for our classes. We provide certification and education classes that are available at several locations throughout the state. Our classes are valid for five years. For more information, see Page 35 about the Food Manager Certification Class and the Small Operators Training Permit offered by the TLW, or visit tlw.org/education/restaurant-managers-certification-class.
ONLINE FOOD MANAGER COURSES The Tavern League promotes food manager training through the TAP Series. These are online courses that are required to receive the Food Safety Manager’s License or the Small Operator Permit. Once you complete the training for the Food Safety Manager’s License, you must register to take an exam. You can schedule one by visiting tlwstore.org or calling (800) 445-9221. To qualify for the Small Operator Permit online course, you must not be expired on your current license. Once you complete the Small Operator Class online, you must print out the permit of completion to post at your establishment. LOCAL LEAGUE BUILDING BLOCKS Creating a framework for how to properly organize and manage league functions is essential to building a strong local league. Grant/Iowa County Tavern League created a model to follow with guidelines for conducting league meetings, implementing state bylaws, following rules pertaining to league officers, strategizing for committee assignments, handling audits and reimbursements, determining a workable calendar for your league, as well as other operational policies. AMERICAN BEVERAGE INSTITUTE (ABI) HOTLINE A beverage licensee is an individual or entity that has been issued a license from a state authority for the purposes of selling beer, wine and/or spirits to consumers of legal drinking age. ABI is one of the leading organizations dedicated to the protection of responsible on-premise consumption of adult beverages and it’s leading the fight against lowering the blood-alcohol arrest level for driving to 0.05. AMERICAN BEVERAGE LICENSEES (ABL) As a TLW member, you are also a member of ABL, the preeminent national trade association for retail beverage alcohol license holders across the United States. Within the three-tier system of producers, distributors and retailers, beverage licensees are the last to handle beverage alcohol products before they reach the consumer and reflect a lasting image of the industry to the public. FOOD MANAGER CERTIFICATION
T
he Wisconsin Department of Health has mandated that at least one person in each establishment must be certified by the state within 90 days of opening a new or existing restaurant. The only exceptions are Portage and Kenosha Counties, where certification must occur before opening for business. Certification is accomplished by passing an exam on safe food handling practices. The TLW is one of a few groups to offer instructional classes. Our experienced instructors have taught over 37,000 hospitality employees over the last 27 years. They are people from the industry who know what to teach and how to teach it. The information covered allows food handlers to learn the proper techniques for handling food in a safe and convenient manner. Certified food managers must take the written exam every five years after initial completion of the program. Establishments that have five or fewer cooks or food handlers across the entire staff may qualify for the small operator’s permit under Wisconsin licensure of Food Safety Training for Small Operators. Due to a change in 2019, certified food managers no longer have a 30-day grace period after the expiration of their license or certificate. It is the responsibility of the license holder to get the proper certification in the mandated time. Again, our instructors not only review the important elements of food handling, but also all the changes to the Food Code. With constant changes in the food industry, it is vital that food handlers be kept up to date. When the certified person is not on premise, the person in charge must demonstrate this same knowledge. For the protection of your customers and your business, the Tavern League is proud to offer this certification. The TLW offers over 100 classes a year throughout the state. LEGISLATIVE AND LEAGUE LEADERS DAY ANNUAL LEGISLATIVE DAY Each year, the TLW is proud to host its Legislative Day in Madison. This important event offers the opportunity for our members to participate in a truly grassroots lobbying effort. The 2020 event marked the 36th year the TLW gathered in Madison to learn about legislative issues facing our industry. Scott Stenger, our government affairs director, had a comprehensive agenda covering topics of interest to all members. Guest speakers from the Senate and Assembly were on hand to share their views on pending legislation. Members were also invited to the Capitol to visit with their legislators and discuss issues. The next day, the Senate Committee voted in favor of a SafeRide increase. Thank you to our members and sponsors who attended! As always, this is an important day for the association,

GLOSSARY OF TERMS Below is a glossary of commonly used terms you may see in Tavern League publications or hear at meetings, but not fully understand. Hopefully, the explanations below give you a better understanding. ABI – American Beverage Institute represents major chains, distilleries, breweries and wineries, and includes the TLW.
NHSTA – National Highway Safety Transportation Administration
ABL – American Beverage Licensees is an association representing on- and off-premise licensees across America.
NRA – National Restaurant Association
ABLPAC – American Beverage Licensees Political Action Committee ASCAP/BMI/SESAC - ASCAP stands for the American Society of Composers, Authors and Publishers; BMI stands for Broadcast Music Inc.; and SESAC stands for Society of European Stage Authors and Composers. They represent songwriters, composers and publishers worldwide, collecting and distributing public performance royalties. CORE – Children of Restaurant Employees Direct Givers Fund (Conduit) – The fund is comprised of voluntary personal contributions to be held in escrow for a later contribution to a candidate’s campaign account with the consent of the donor. DISCUS – Distilled Spirits Council of the United States is a national trade association representing producers and marketers of distilled spirits.
NTSB – National Transportation Safety Board TIPAC – Tavern Industry Political Action Committee is a fund that individuals may donate personal, not business, monies to. This money is then contributed on behalf of the Tavern League to candidates supportive of our industry. TLW Foundation – TLW charity arm WAMO – Wisconsin Amusement & Music Operators consists of vendors of pool tables, juke boxes, darts, etc. WBDA – Wisconsin Beer Distributors Association is comprised of most of the beer wholesalers in Wisconsin. WISTAVPAC – Wisconsin Tavern Political Action Committee is similar to TIPAC, however, monies are used to support candidates on the federal level. WRA – Wisconsin Restaurant Association WWSI – Wisconsin Wine & Spirit Institute is an association comprised of several liquor wholesalers in Wisconsin.

TLW BYLAWS ARTICLE I SECTION 1 - MEMBERSHIP A. REGULAR MEMBERSHIP Any business, located in any municipality within the state of Wisconsin that is licensed to sell alcoholic beverages for either on- or off-premise consumption, shall be entitled to membership in this corporation. B. DIRECT MEMBERSHIP 1. Any licensee who meets membership requirements under Section 1A who does not have a chapter or who does not belong to a local chapter shall be entitled to membership in this corporation. 2. Direct members shall enjoy all the privileges of regular members except for office holding and voting rights. C. ASSOCIATE MEMBERSHIP 1. Any member in good standing who, after enactment of this section, becomes ineligible for regular membership in this corporation may become an associate member by applying and paying the requisite fees. 2. Associate members shall enjoy all the privileges of regular members except for office holding and voting rights. D. AFFILIATE MEMBERSHIP 1. Any business that provides goods or services to members may apply for affiliate membership in this corporation. 2. Affiliate members shall enjoy all the privileges of regular members except for office holding and voting rights. E. EMPLOYEE BENEFIT MEMBER 1. An employee of any member in good standing, upon payment of required employee member dues, shall become an employee benefit member. 2. Employee benefit members shall have voice but no vote.
SECTION 2 - CHARTERS OF LOCAL ORGANIZATION Charters may be issued to any regularly organized corporation of alcohol beverage retailers in any municipality or county of the state of Wisconsin, upon receiving a charter fee by the Secretary, in the sum of $10. The fee shall be deposited in advance with the Secretary before the prospective organization is balloted upon for initiation in said Tavern League of Wisconsin Inc. by a majority vote of the Board of Directors.

SECTION 4 - DUES The annual dues for all membership classifications under Section 1 to be paid for membership in the Tavern League of Wisconsin Inc. shall be determined by a two-thirds vote of the Board of Directors.
SECTION 5 - MEETINGS The members of the corporation shall meet at least twice annually. A. SPRING CONFERENCE A general membership meeting shall be held in the spring, the date or dates for which shall be established by the Board of Directors. The location of the Spring Conference shall be determined by the majority vote of the Board of Directors at the Spring Conference. B. FALL CONVENTION The annual meeting of the membership shall be held in the fall, the date or dates for which shall be established by the Board of Directors. The location of the Fall Convention shall be determined by a majority vote of the Board of Directors. C. SPECIAL MEETINGS Special meetings of the members may be held whenever called by the Secretary upon direction of the President or upon the written direction of a majority of the Officers and Directors of the corporation, or upon written direction of not less than 20% of the members of the corporation. It shall be the duty of the Secretary to give 10 days’ notice of such meeting, to each member by mail or email, said notice to state purpose of said meeting and the time and place where said meeting will be held.
SECTION 6 - QUORUM When 5% of the members of this association in good standing are present, it shall be deemed capable of transacting any business thereof except when otherwise specifically provided by law or by the articles of the organization of this corporation, but if at any meeting of the members there is less than a quorum, the meeting may be adjourned from time to time without notice other than by announcement at the meeting, until the required number of members are present. At any adjourned meeting, at which a quorum is present, any business may be transacted that might have been transacted at the meeting as originally notified.
SECTION 3 - EXPULSION Any organized chapter of the Tavern League of Wisconsin Inc., which has been chartered by said organization, or any individual members, may be expelled for just cause by a twothirds vote of a meeting of the Board of Directors of the Tavern League of Wisconsin Inc., upon charges submitted in writing www.tlw.org

TLW BYLAWS SECTION 7 - ORGANIZATION The President and in their absence, the Senior Vice President, and in their absence, a Zone Vice President or in their absence, any member chosen by the members present, shall call the meeting to order, and shall act as chairperson of such meeting, and the Secretary of the corporation shall act as Secretary of all meetings of the members, but in the absence of the Secretary, the presiding official may appoint any member to act as Secretary of the meeting.
SECTION 8 - CONDUCT OF MEETINGS A. GENERAL BUSINESS SESSIONS General business sessions at the Spring Conference and Fall Convention shall be conducted in accordance with the following rules: 1. Every member association of the Tavern League of Wisconsin shall be entitled to the number of delegates hereinafter specified based upon the paid membership for the second quarter of the fiscal year in which the Spring Conference is held and the fourth quarter of the fiscal year preceding the year in which the Fall Convention is held. Every member association is entitled to a minimum of five delegates. Additional delegates may be elected by local leagues in accordance with the following table:

2. Every member association shall be entitled to five votes based upon the paid membership as set out in Section 1A and shall have such additional votes in accordance with the additional members as specified in the table above, provided that said duly accredited delegates are actually on the floor at the time the vote is taken. No member association may at any time cast more votes than the number of delegates qualified and present to vote at the time a vote is taken on the floor or at the election. 3. Any delegate desiring the floor for the purpose of addressing the meeting shall rise, state his or her name, and the name of his or her member association before he or she is recognized by the presiding Officer. 4. All members and persons other than delegates desiring to address the meeting other than invited speakers shall rise, state their name and the name of their member association. 5. All voting other than the election of Officers and Directors, Spring Conference and Fall Convention sites, resolutions and amendments to the articles of organization and bylaws shall

be by voice vote of the delegates unless proper motions are made and adopted calling for a roll call vote of the delegates, or a division of the delegates on any question. 6. All resolutions other than bylaw changes shall be submitted in writing to the league office in Madison at least 45 days prior to the opening of the Spring Conference or Fall Convention. 7. Each member association or individual member submitting a resolution shall, in addition to forwarding the written text of said resolution, submit a written explanation of what the resolution is intended to do and shall also submit written reasons for its adoption. Copies of the above shall be distributed by the Madison office to the President and Secretary of each member association 30 days prior to the scheduled meeting. 8. All resolutions that have been submitted in the manner herein provided shall be turned over to the Resolutions Committee for consideration. The Resolutions Committee shall have full authority to make whatever recommendation they deem proper on all resolutions that have been submitted for final action at the business session. 9. (A) Nominations for Directors and Officers shall be made at the Spring Conference or Fall Convention, and except for the circumstances itemized in (B), no further nominations shall be made or accepted. (B) In the event of the death of a candidate, or if for any other reason a candidate is unable or unwilling to stand for election and there is no other candidate for the position, a caucus of the district or districts involved shall be held in the district’s designated seating area immediately following adjournment of the general business session on the first day of the Fall Convention or Spring Conference for the purpose of nominating candidates for the position. (C) In the event that the meeting site facilities selected become unavailable for any reason, the Officers and Directors of the Tavern League of Wisconsin shall have the authority and are empowered to replace the subject site. 10. Every nominee for Director or Officer of the Tavern League of Wisconsin shall be introduced from the rostrum at the Spring Conference and Fall Convention at which he or she is a candidate. 11. The candidates shall have a maximum of two minutes each to present themselves, their qualifications, a resume of their experience and any ideas or proposals they have, if elected, to further the interests of the Tavern League of Wisconsin. B. NOMINATING CAUCUSES District caucuses for the purpose of nominating Directors, District Vice Presidents and Zone Vice Presidents, and transacting other business brought before the caucuses shall be conducted in accordance with the following rules: www.tlw.org
TLW BYLAWS 1. Caucuses for the purpose of nominating candidates for Directors for each district and District Vice Presidents and Zone Vice Presidents for each Zone area shall be held on Wednesday of the Fall Convention. 2. The President shall designate the location of each district Caucus and the delegates shall promptly meet when the recess for the purpose of nominating candidates for District Director, District Vice President and Zone Vice President positions is declared. 3. The delegates in each district shall choose one of the members to act as chairperson for the purpose of conducting the caucus and one of their members as secretary to record the action, votes and nominations made for Directors, District Vice Presidents and Zone Vice President in each caucus. 4. Each delegate shall be entitled to nominate a candidate for Director, District Vice President and Zone Vice President at each annual caucus. 5. Whether present at the nominating caucus or not, any consenting member in good standing of this association, qualified as such under Section I1A of these bylaws, shall be eligible for nomination as candidate for Director of the District in which the member association of which he or she is also member in good standing is located. 6. The chairperson or secretary of each caucus shall give a report of the names of the persons placed in nomination to the Nominating Committee, which shall present the nomination to the members from the podium when the conference or convention is reconvened and the presiding officer calls for nominations. 7. All candidates nominated by the caucuses in accordance with the sections above shall be placed on the ballot to be voted on by the delegates within the respective district and zone areas at the annual election. 8. Districts, whose membership exceeds 500, shall be eligible to elect an additional Director, and one additional Director for each 250 members in excess of 750. No nominations for additional directors may be made unless warranted on the basis of per-capita-dues-paid memberships in the second quarter of the current fiscal year, and no candidate nominated may be elected unless warranted by dues-paid membership in the fourth quarter of the preceding fiscal year. 9. Except for Officers, only one Director may be elected from any one member association. Nominations will not be accepted for Director if the election would result in two directors from any one-member association serving at the same time. 10. In the event that there is no contest for Directors or Officers following the report of the nominations at the Fall Convention, a motion may be made that the rules be suspended, and the Secretary instructed to cast a unanimous ballot for the election of the sole nominee for Director or Officer whose term shall begin at the regular time for taking office. www.tlw.org
C. NOMINATIONS OF OFFICERS 1. Any consenting member in good standing under Section 1A of any member association who has served at least one year on the Board of Directors or been an active member for 10 consecutive years of any member association prior to the date of office may be nominated and elected to serve as a General Officer (Senior Vice President, Zone Vice President, District Vice President, Secretary or Treasurer) of this association. To be nominated and elected to the office of President, you must have served at least one year on the Board of Directors. 2. Any member in good standing under Section 1A may submit the name of any other qualified member for any office of this association from the floor during the general business session meeting on Thursday of the Spring Conference and Fall Convention. Nominations for Zone Vice President, District Vice President or Director in addition to those made in nominating caucuses, as provided in paragraph B6, may only be made by a member of the respective Zone or District. 3. Nominations of Officers shall be conducted by the Chair of the Nominating Committee. Said committee shall record the names of persons nominated for each office, verify their qualifications and consent, and report to the general membership the names of qualified nominees for Officers prior to the close of the Spring Conference. D. RULES FOR CONDUCTING ELECTIONS The following rules apply for conducting all elections. 1. The annual election, including the distribution of the ballots and the supervision of the election, shall be conducted by members of the Rules Committee under the rules herein prescribed. 2. No member who is a candidate for any office shall be a member of the Rules Committee. 3. Printed ballots shall be prepared and used giving names of the individuals who have been nominated for Directors and Officers. 4. All ballots shall be initialed by the chairperson of the Rules Committee and Executive Director so only ballots initialed in advance of the casting by delegates shall be counted in the results of the election. 5. Voting shall be on Thursday of the Fall Convention or Spring Conference at the polls provided for this purpose in a room designated by the Rules Committee. Voting shall be confined to only delegates duly certified by their leagues or their duly accredited alternates where proper substitution of said alternates is made for the delegate. Delegates or accredited alternates must be a representative of the league for which they are voting. Alternates can only be brought forward from the individual accredited delegate list that was submitted within the proper time frame; no additions or changes will be permitted. No other person shall be entitled to receive a ballot and vote other than as provided in this section. Delegate JANUARY/FEBRUARY 2021

TLW BYLAWS lists with alternates must be received and stamped in the state office no later than 10 days prior to the start of the Spring Conference or Fall Convention. 6. Each delegate, before receiving a ballot to vote, shall have on his or her person his or her proper registration badge and shall be checked off by the tellers from the list of delegates certified by the secretary of each local league or by the chairperson of the Rules Committee identifying him or her as a delegate where substitution has been under the rules of the Convention. Any changes to the delegate list must be submitted to the Rules Committee chairperson by the date and time designated by the Rules Committee chairperson. All decisions made by the Rules Committee are final. 7. A list of inactive leagues will be designated by the state office based on the lack of a designated President and Secretary for that league. Delegate lists for these counties will not be accepted for voting purposes. 8. No delegate shall be permitted to vote more than once regardless of whether he or she is a member of one or more leagues and is a delegate from more than one league. 9. Only one voting delegate shall be permitted per license. 10. There shall be no absentee ballot voting and all delegates shall present themselves personally at the polls on Thursday morning of the Fall Convention or Spring Conference. All those not presenting themselves during the polling hours shall be barred from voting. 11. Votes for any candidate not placed in nomination in accordance with these bylaws shall not be recognized or counted at the annual election. Ballots will be counted by the Rules chair, the vice chair chosen by the Rules Committee and one staff person. 12. The candidate receiving the highest vote shall be declared elected as Director, District Vice President or Zone Vice President for the specified term unless he or she was elected to fill an unexpired term. 13. In the event of a tie vote for any office, delegates in the district affected shall be re-polled by secret ballot at a time and place determined by the Rules Committee and the vote count shall be announced on the floor prior to the close of the convention or conference. 14. In the event of two consecutive tie votes for the same office or sites, the winner shall be decided by a flip of a coin.
ARTICLE II SECTION 1 - BOARD OF DIRECTORS A. COMPOSITION OF BOARD The Board of Directors shall be comprised as follows: Two Directors from each of nine districts in the state of Wisconsin,

wherein there is at least one bona fide licensed retail beverage association affiliated and in good standing in the Tavern League of Wisconsin Inc., and in addition thereto the President, Senior Vice President, all Zone Vice Presidents, Secretary and Treasurer, elected by the members in accordance with the provisions of Article I, Section 8C, and the immediate Past President. There will also be a full-time director position representing off-premise licensees. This position will be appointed by the President and will serve a one-year term. All duties, responsibilities and privileges will be the same as other board members. Districts whose total paid-up membership for the second and fourth quarters as defined in Article I, Section 8A1 and A2 exceeds 500 members shall be entitled to nominate and elect one additional director, plus one additional director for every 250 members in excess of 750 members. For any zone, if the districts involved have a combined total of 1,000 or more members, they would be allowed another Vice President from a different district within that zone. This would be a one-year term based on the membership paid in the second quarter of the current fiscal year and the paid membership of the fourth quarter of the preceding year in which conference is held. At the following Spring Conference, the District Vice President would be elected by the delegates from the district(s) that do not have the Zone Vice President (i.e., members from the district with the two-year Vice President would not participate in the election). In alternate years where both Vice President terms expire at the same time, the voting delegates from the district(s) whose candidate did not win the two-year term would caucus on Thursday afternoon at the close of the Spring Conference to elect the District Vice President for the one-year term. B. TERMS OF OFFICE 1. The President, Senior Vice President, Zone Vice Presidents, Secretary and Treasurer shall be nominated and elected in accordance with Article I, Section 8C and D, and shall serve two-year terms. All Officers and Directors shall be eligible to succeed themselves for consecutive additional terms. The term of the immediate Past President’s membership on the Board of Directors shall be concurrent with and shall not exceed the term of office of the succeeding President. If the immediate Past President is no longer a regular member under Section 1A of these bylaws, or does not wish to serve as Past President, then the office of Past President shall be vacant. 2. All Officers and members of the Board of Directors elected in accordance with these bylaws shall serve until their respective successors have been chosen. C. CONFLICT OF INTEREST No person may serve as an Officer or Director who is directly or indirectly employed by the corporation. The reimbursement of mileage or expenses or the payment of per diem to Officers or Directors for activities that are not directly related to their duties as Officers or Directors shall not be considered employment under this section. www.tlw.org
TLW BYLAWS D. ALTERNATE DIRECTORS In the event of an excused absence of a Director, an alternate director may be designated with full voting rights. An alternate director will be designated by the district and must be a member in good standing.
SECTION 2 - GENERAL POWERS The property, affairs and business of this corporation shall be under the name and managed by the Executive Officers of this corporation and the Board of Directors.
Board of Directors who are in good standing. Cause includes non-membership under Article 1, Section 1A of these bylaws. Any member of the Board of Directors who fails to attend two consecutive meetings of said Board of Directors may be removed from said Board of Directors by the affirmative vote of a majority of said Board of Directors, and the office of said Director shall be declared vacant unless such member of the Board of Directors had been excused from attending the meetings of the Board, in advance, by the President of the corporation.
A. The Board of Directors shall have the power to purchase or otherwise acquire, lease, sell, convey, assign or otherwise transfer for the corporation any property, rights, or privileges which the corporation is authorized to acquire, real, personal or mixed, at such prices and on such terms and conditions for such consideration as it may see fit, and may at its discretion pay for any property or rights acquired by the corporation, either wholly or partially in money or bonds or other evidence of indebtedness, and carry on the business of this corporation in such a manner to effectuate its purpose for which this corporation is organized and in accordance with the provisions set forth in the articles of organization, subject, however, to the provisions of Chapter 181 of Wisconsin Statutes, or any corresponding section of any future state law governing nonstock corporations.
SECTION 5 - VACANCIES
B. The Board of Directors shall by a majority vote thereof have the power to elect or appoint assistants to the general Officers of the corporation and such other Officers, agents and servants as it may from time to time deem necessary, define their duties and obligations, fix their compensation and fill vacancies therein, and the Board of Directors by majority vote thereof have the power to remove and suspend permanently or temporarily the Officers, the assistant Officers, agents and servants appointed by it, and to delegate any Officer of the corporation by resolution adopted by majority vote thereof all or any of the powers stated in this section, with such restrictions as it deems expedient.
SECTION 7 - REGULAR MEETINGS
C. The Board of Directors shall have the power to authorize its general Officers to borrow money for corporate purposes and to execute in the corporate name, bills, notes or other evidence of indebtedness, but no mortgage shall be given to this corporation on any of its property, whether real or personal, to secure the payment of its debts, or to borrow money for the purposes of the corporation without the consent of a majority of the Board of Directors.
SECTION 3 - RESIGNATION A Director may resign at any time by filing his or her written resignation with the Executive Director.
SECTION 4 - REMOVAL Any Director may be removed at any time for cause at a special meeting of the members of the corporation Board of Directors, called for such purpose by the affirmative vote of a majority two-thirds of the members of the corporation www.tlw.org
I n case of a vacancy in the Board of Directors through death, removal, resignation or other cause, the vacancy may be temporarily filled until the next annual election by a caucus of the district or districts affected. In case of vacancy in the office of President, the Senior Vice President shall become President. In case of vacancy in the office of Senior Vice President, Secretary or Treasurer, that vacancy may be temporarily filled until the next election by a majority vote of the Board of Directors present and voting at a meeting of the Board of Directors.
SECTION 6 - PLACE OF MEETINGS All meetings of the Board of Directors shall be held at some suitable place designated by the President. Regular meetings of the Board of Directors shall be held immediately preceding the Annual Meeting of the members and at such other times as the Board of Directors may, by resolution, determine. No notice of the regular meeting of the Board of Directors is necessary.
SECTION 8 - SPECIAL MEETINGS Special meetings of the Board of Directors shall be held whenever called upon the direction of the President, or upon the written request of any seven Officers or Directors. It shall be the duty of the Executive Director to give sufficient notice of such meetings, in person or by mail, email or telephone, to enable the Directors so notified to attend such meetings.
SECTION 9 - MEETING BY CONSENT Meetings of the Board of Directors may be held at any time or place where a majority of the Directors are present and consent to the holding of such meeting.
SECTION 10 - QUORUM Two-thirds of the Directors convened according to these bylaws shall constitute a quorum for the transaction of business, but if at any meeting of the Board there shall be less than a quorum present, a majority of those present may adjourn the meeting from time to time.
SECTION 11 - ORGANIZATION The President and in their absence, the Senior Vice President, and in their absence, one of the Zone Vice Presidents chosen by the Directors present, or in the absence of all of the JANUARY/FEBRUARY 2021

TLW BYLAWS aforementioned, any Director chosen by the Directors present, shall call the meeting of the Board of Directors to order, and shall act as chairperson of such meeting, and the Secretary of the corporation shall act as the Secretary at all meetings of the Board of Directors, but in the absence of the Secretary, the presiding Officer may appoint any Director to act as Secretary of such meeting.
SECTION 12 - ORDER OF BUSINESS The order of business at all meetings of the Board of Directors shall be as follows:

ARTICLE III SECTION 1 - COMPOSITION OF EXECUTIVE COMMITTEE The Executive Committee shall be comprised of the President, Senior Vice President, Zone Vice Presidents, District Vice Presidents, Secretary, Treasurer and the immediate Past President.
SECTION 2 - MEETINGS The Executive Committee shall meet at the call of the President, or in the event that the office of President is vacant, at the call of the Senior Vice President. The call shall specify the location of the meeting.
SECTION 3 - QUORUM One more than half of the members of the Executive Committee shall constitute a quorum for the transaction of business, but if at any meeting of the Executive Committee there shall be less than a quorum present, a majority of those present may adjourn the meeting from time to time.
SECTION 4 - POWERS OF THE EXECUTIVE COMMITTEE The Executive Committee shall have the power to conduct all affairs and business of this corporation between meetings of the Board of Directors, except as limited by these bylaws, by contract or by action of the Board of Directors.
ARTICLE IV SECTION 1 - ELECTION OF GENERAL OFFICERS A. The general Officers of said corporation shall be a President, a Senior Vice President, Zone Vice Presidents and District Vice Presidents, the number determined by the rules set in Article II, Section 1A, a Secretary and a Treasurer, said Officers to hold office for the term of two years, with the exception of the second Zone Vice President

for each district whose term is one year, and until their successors are elected and qualify. The President, Senior Vice President, Secretary and Treasurer shall be elected from the state at large. Zone Vice Presidents and District Vice Presidents shall be elected by the delegates of the member associations in the districts in their zone area. B. All Directors and Zone Vice Presidents will be elected at the Spring Conference and all other officers at Fall Convention. The offices of Senior Vice President, State Secretary and State Treasurer will be elected on evennumbered years. The office of State President will be elected on odd-numbered years.
SECTION 2 - QUALIFICATIONS Only members under Section 1A of this corporation shall be eligible to be general Officers of this corporation, and the resignation or removal of a general Officer from the corporation shall operate as a resignation of his or her office.
SECTION 3 - DUTIES The principal duties of the several general Officers respectively are as follows: A. The President shall preside at all meetings of the members of the Board of Directors. He or she shall be the Chief Executive Officer of the corporation, and shall give the general supervision, direction and active management of the property, affairs and business of the corporation, subject to the Board of Directors. He or she shall see that all orders and resolutions of the Board of Directors are carried into effect. He or she may execute all deeds, leases, conveyances, contracts and agreements when authorized to do so by the Board of Directors. He or she shall submit a complete and detailed report of the corporation for the fiscal year and of its financial condition to the Board of Directors at its first regular meeting in each year, and to the members at their Annual Meeting and shall, from time to time, report to the Board of Directors all matters within his or her knowledge which the interests of the corporation may require to be brought to its notice. He or she shall perform such additional duties as may be prescribed from time to time by the bylaws. B. The Senior Vice President shall discharge the duties of the President in the event of absence or disability for any cause whatever. The Vice President shall perform such additional duties as may be prescribed from time to time by the bylaws. C. The Zone Vice Presidents and District Vice Presidents shall upon election by a majority vote of the Board of Directors discharge the duties of the President in the event of absence or disability for any cause whatever of the President and Vice President. They shall perform additional duties as may be delegated and assigned by the President. www.tlw.org
TLW BYLAWS D. The Secretary shall keep a correct and complete record of all proceedings of said corporation, including such as relate to the election of its Officers. He or she shall, in general, perform all the duties, which are incident to the office of Secretary of a corporation subject to the Board of Directors. He or she shall perform such additional duties as may be prescribed from time to time by the Board of Directors, or as may be prescribed from time to time by the bylaws. E. The Treasurer shall keep an account for all moneys, credits and property of the corporation that shall come into his or her hands, and keep an accurate account of all moneys received and disbursed. He or she shall make such statements, as corporations are required to make by the law of Wisconsin. He or she shall have the custody of all funds and securities of the corporation. Whenever necessary and proper, he or she shall endorse on behalf of the corporation all checks, notes, or other obligations and evidences of payment of money payable to the corporation or coming into his or her possession, and shall deposit the funds arising therefrom, together with all other funds of the corporation coming into his or her possession in such banks as may be selected as the depositories of the corporation, or properly care for them in such other manner as the Board of Directors may direct. He or she shall sign all checks and other instruments drawn on or payable out of the funds of the corporation, and all bills, notes, and other evidences of indebtedness of the corporation. Whenever required by the Board of Directors to do so, he or she shall exhibit a true and complete statement of his or her cash account and of the securities and other funds in his or her possession, custody and control. He or she shall at all reasonable times within business hours exhibit his or her books and accounts to any Director. He or she shall, in general, perform all of the duties, which are incidental to the office of the Treasurer of a corporation, subject to the Board of Directors. If the Board of Directors shall so require it, he or she shall give bond in such sum and with such surety as the Board of Directors may direct for the faithful performance of his or her duties and for the safe custody of the funds and property coming into his or her possession. He or she shall perform such additional duties as may be prescribed from time to time by the bylaws. F. All such books and records pertinent to the offices of the above shall be kept at the corporation’s headquarters office.
SECTION 4 - DELEGATION OF DUTIES In the case of the absence or inability to act of any Officer of the corporation, the Board of Directors may delegate for the time being the duties of such Officer to any other Officer or to any other Director.
ARTICLE V SECTION 1 - PLACE OF BOOKS AND RECORDS The general and principal books of account of this corporation shall be kept in the custody of the Secretary and Treasurer of this corporation at the corporation’s headquarters office.
SECTION 2 - RIGHTS OF MEMBERS TO EXAMINE T he books of this corporation, containing the accounts and records of the corporation, shall at all reasonable times be open to the inspection of the members of this corporation.
ARTICLE VI SECTION 1 - FISCAL YEAR The fiscal year of this corporation shall begin on the first of July and terminate on the 30th day of June of each year.
SECTION 2 - WAIVER OF NOTICE A ny member or Officer may, in writing, waive the giving and mailing of any notice required to be given or mailed either by the Statutes of Wisconsin, the articles of organization or the bylaws of this corporation.
ARTICLE VII SECTION 1 -
AMENDMENTS
All resolutions proposing changes in the bylaws of the corporation undertaken by any member association or the Board of Directors shall be submitted in writing to the office of the corporation at least 45 days prior to the opening of the Fall Convention of the members of the corporation; and further, if two-thirds of the Board of Directors favor the introduction of a resolution pertaining to the bylaws of the corporation after the 45-day period that the same be permitted up to 30 days before the convention. B ylaws may be adopted, amended or repealed at any meeting of the members where said resolutions have been proposed in conformity with this section by a vote of a majority of the members represented by delegate vote. WISCONSIN ALCOHOL BEVERAGE LAWS FOR RETAILERS IMPORTANT CHANGES See notice concerning the requirement that sales of alcohol beverages must occur at a licensed premises on Page 72. I. INTRODUCTION This publication provides information about state alcohol beverage and tobacco laws that affect you as a retailer. Most of the laws outlined in this publication are found in Chapter 125 and sections 134.65 and 134.66 of the Wisconsin Statutes. Municipalities also may enact additional regulations affecting your business. You should contact your local municipal clerk if you have questions about local ordinances. Laws enacted after this date, administrative rules and court decisions may change the interpretations in this publication. • The examples and type of sales and purchases provided in this publication are not all-inclusive. They merely set forth common examples. II. DEFINITIONS Adult – A person who is 18 years of age or older. Minor – A person who is under 18 years of age. Legal Drinking Age – 21 years of age. Underage Person – A person who is not of legal drinking age. Beer – A fermented malt beverage containing 0.5% or more of alcohol by volume. Intoxicating Liquor (or Liquor) – All alcohol beverages (other than beer) containing 0.5% or more alcohol by volume and all wines. Alcohol Beverages – A statutory term that includes beer, wine and liquor. Provisional Retail License 1. A municipal governing body that issues licenses shall issue provisional retail licenses. The governing body may by ordinance establish standards under which the licenses shall be issued and shall by ordinance designate the municipal official having the authority to issue the provisional license. 2. The provisional retail license may be issued only to a person applying for a “Class A” beer, “Class B” beer, “Class A” liquor, “Class B” liquor or “Class C” wine. 3. The fee shall be determined locally but may not exceed $15. 4. The license will expire 60 days after issuance or when the person has been issued a license as listed under 2. The official who issued the provisional retail license may revoke the www.tlw.org
license if he or she discovers the holder made a false statement on the application. 5. A municipality may not issue a provisional “Class B” liquor license if the municipality’s quota is filled. 6. No person may hold more than one provisional retail license for each type of license applied for by the holder per year. “Class A” Fermented Malt Beverage License – Authorizes the retail sale of beer and beer-based coolers, in the original sealed container, for consumption off the licensed premises.
1. No sales to other licensees for resale. 2. May sell in any quantity to the public. 3. No beer sales between midnight and 6 a.m. 4. Local ordinances may further restrict these hours. 5. May furnish customers with two 3-fluid-ounce taste samples of beer between 11 a.m. – 7 p.m.
“Class A” Liquor License – Authorizes the retail sale of liquor and wine, in the original sealed container, for consumption off the licensed premises. 1. No sales to other licensees for resale. 2. May sell in any quantity to the public. 3. May not sell intoxicating liquor and wine between 9 p.m. and 6 a.m. 4. Local ordinances may further restrict these hours. 5. May furnish customers with two 3-fluid-ounce taste samples of wine between 11 a.m. and 7 p.m. “ Class B” Fermented Malt Beverage License – Authorizes the retail sale of beer and beer-based coolers for consumption on the licensed premises and for consumption off the licensed premises. 1. No sales to other licensees for resale. 2. May sell in any quantity to the public. 3. Must be closed between the following hours: a) Monday - Friday – 2 a.m. – 6 a.m. b) Saturday - Sunday – 2:30 a.m. – 6 a.m. c) Second Sunday in March – 3:30 a.m. – 6 a.m. d) New Year’s Eve – no closing required. e) Local municipalities may NOT further restrict the closing hours. 4. No off-premises sales between midnight and 6 a.m. Local ordinances may further restrict these sales hours. “Class B” Liquor License – Authorizes the retail sale of liquor by the drink for consumption on the licensed premises and (if allowed by local ordinance) in the original sealed container for off-premises consumption. A single, open bottle of wine may be taken off premise if ordered with a meal and re-corked prior to being taken off premise. 1. No sales to other licensees for resale. 2. Off-premises sales of liquor, when permitted by local ordinance, limited to 4 liters or less. 3. Wine may be sold in the original package, in any quantity, for on- and off-premises consumption. A winery that has a “Class B” License (wine only) issued under s. 125.51(3) (am) must close between 9 p.m. and 8 a.m. “Class C” Wine License – Authorizes the retail sale of wine by the glass or in an opened original container for consumption on premises only. A single, open bottle of wine may be taken off premise if ordered with a meal and re-corked prior to being taken off premises. 1. No sales to other licensees for resale. 2. Closing hours the same as “Class B” License. Notice: With limited exceptions, all retailers of alcohol beverages may only sell to consumers who are physically at the licensed premises. FOR EXAMPLE: 1. A customer phones in an order to a local pizza parlor (that holds a “Class B” Beer License) to have a pizza and a six pack of beer delivered to his home — this sale is prohibited, as the sale was not made face-to-face to the consumer at the licensed premises. 2. A group of college students call their local liquor store and ask that six half barrels of beer be delivered to their house for a party — this sale is prohibited, as the sale was not made face-to-face to the consumers at the licensed premises. III. ALCOHOL BEVERAGE LAW A. Closing Hours Customers must leave the premises by the closing hour; internal business operations (counting cash, cleaning, repairs, etc.) may be done after hours but licensees must be able to prove that anyone on the premises after hours is there for these purposes. Hotels and restaurants whose “principal business” is furnishing lodging and food to customers, bowling centers, indoor horseshoe pitching facilities, golf courses and curling clubs may remain open after hours to conduct their regular business. They may not permit consumption of or sell alcohol beverages after hours. “Principal business” means the primary activity as determined by analyzing the amount of capital, labor, time, attention and floor space devoted to each business activity and by analyzing the sources of net income and gross income. The name, appearance and advertising of the entity may also be taken into consideration if they are given less weight. B. Daylight Saving Time Section 175.095(2), Wis. Stats. states that daylight saving time begins at 2 a.m. the second Sunday in March and ends at 2 a.m. the first Sunday in November. As such, clocks are set ahead one hour at 2 a.m. the second Sunday in March. Thus taverns would close at 3:30 a.m. daylight saving time on this date. On the first Sunday in November, the clocks are set back an hour at 2 a.m.; bars gain an extra hour and must close at 2:30 a.m. regular Central Standard Time.

C. Training Requirements for Completion of the Responsible Beverage Server Training Course (Required as a Condition of Licensing) Applicants must successfully complete an approved training course, such as courses offered by the Wisconsin Technical College System, or similar approved courses (see “Training” on the department’s website at revenue.wi.gov) unless: 1. The person is renewing a retail or an operator’s (bartender’s/ sales clerk’s) license. 2. The person was the agent (within the last two years) for a corporation that held a “Class A” Beer, “Class B” Beer, “Class A” Liquor, “Class B” Liquor or “Class C” Wine License. 3. The person held a retail license or an operator’s or manager’s license during the past two years. 4. The person completed such a course within the past two years. IV. LICENSING A license is a privilege granted by local authorities to a particular person, partnership or corporation to run a particular place for the time period specified. Just as one’s driver’s license can’t be used by another, an alcohol beverage license can’t be used by someone other than the licensee to sell alcohol beverages. The license or permit of a person who violates this shall be revoked. The governing body of every city, village and town may, but is not required to, issue local retail liquor and beer licenses. The municipality may refuse to issue licenses as long as it uses good judgment and does not discriminate between applicants. V. SALE OF ALCOHOL BEVERAGES The term “sale,” “sold” or “sell” includes the transfer, gift, barter, trade, exchange or any shift, device, scheme or transaction whatever, whereby alcohol beverages may be obtained. Giving away alcohol beverages or using any other device to evade the law relating to its sale is an unlawful sale. The following are some examples of illegal transactions at unlicensed premises: 1. A “free” drink with a meal; 2. A cover charge, whereby mix is furnished at a price, with “no charge” for liquor; 3. A “free” bottle of liquor tied into the sale of some other item. Penalty: Fine of not more than $10,000 or imprisonment for not more than nine months, or both. VI. SELLER’S PERMIT A. Every individual, partnership, corporation or other organization selling tangible personal property in Wisconsin must have a seller’s permit. B. A licensee may not conduct business without a seller’s permit, which must be issued in the same name as the licensee. If the retail liquor license is issued to a partnership or corporation, the seller’s permit must be, too, not to the agent, officer or individual. FEDERAL TAX STAMP Every retail licensee must file a federal Special Occupational Tax return before beginning business and before July 1 each year, after that. The Special Occupational Tax return (TTB Form 5630.5) is available from the National Revenue Center, (800) 937-8864. VIII. LICENSES FRAMED AND POSTED All liquor and beer licenses must be framed and posted in the room where the business is carried on. Everyone visiting the business must be able to easily see the licenses in that room. Any related permits and licenses should be posted with the alcohol beverage license. IX. R EQUIRED ON-SITE SUPERVISION OF LICENSED PREMISES A. Except in “Class A” Beer premises between midnight and 6 a.m. (or any time when the sale of fermented malt beverages is prohibited by municipal ordinance), one of the following must be present on all licensed premises during all business hours: 1. The licensee or; 2. An adult member of the licensee’s immediate family (actually living in the licensee’s household) or; 3. The corporation agent (the agent’s immediate family members must have an operators’ license, if they supervise the premises in the agent’s absence) or; 4. The holder of a provisional operator’s license (issued to persons enrolled in the responsible beverage server training course pending approval of an operator’s license by the municipal governing body) or; 5. The holder of an operator’s or manager’s license. B. An adult working under the immediate supervision of any of the above does not need an operator’s license. NOTE: “Immediate supervision” means that the licensed person must be able to watch and supervise each unlicensed person’s actions. This means that the licensed person must be in the same room or area as the unlicensed person, near enough to see and talk to him or her, and to be able to actually supervise the unlicensed person. C. An operator’s license is good in any premises in the municipality where it has been issued, but it may be used only in that municipality. Licensees may be prosecuted for not having the required supervision on their premises. X. SALE TO INTOXICATED PERSONS It is illegal to furnish alcohol beverages to an intoxicated person. The penalty for this violation is a $100 to $500 fine, imprisonment for not more than 60 days or both. www.tlw.org
XI. REFILLED LIQUOR BOTTLES A. It is illegal to refill any liquor bottle; you may not pour any substance into a liquor bottle, even the same brand of liquor. B. When a bottle is empty, deface its label and break the bottle. If the bottle has a Wisconsin tax stamp, deface this, too. C. You don’t have to break bottles saved for recycling; however, the labels must be defaced. Bottles saved for recycling must be placed in boxes marked “For Recycling Only.” D. You do not have to break empty ceramic decanters, but you must deface the tax stamp, if any. XII. IDENTIFICATION REGISTER A. The Department of Revenue recommends that every licensee keep an ID register book. The ID register may be used to record the identity of a person who alleges he or she is of legal drinking age. The book may also be used to record the identity of a person who alleges that he or she is an underage person’s parent, guardian or spouse and that he or she has attained the legal drinking age. Record the date of purchase, the type of ID used and the address of the purchaser, then have the purchaser sign the register. Check the signature in the book against the signature on the ID to see that they match. B. The “Proof of Age Register” or “Identification Register Book” may be purchased, at a small fee, from: 1. PRESERVATION OF RECORDS Alcohol beverage (and cigarette and tobacco products) retailers must purchase these products only from Wisconsin wholesalers. They may not be transferred between retail accounts, except that alcohol beverages may be as specified in “Transfer of Alcohol Beverage Stock” below. Keep invoices for all purchases of liquor and beer (and cigarettes and tobacco products) on the licensed premises for two years from the date of the invoice. Keep them in sequence and in chronological order. They must be available for inspection during business hours. XIV. TRANSFER OF ALCOHOL BEVERAGE STOCK If you sell your business, you may transfer your sealed liquor, wine and beer stock to another retail licensee in this state. List your entire sealed stock on an inventory Form AT-900 available at the Department of Revenue’s website at revenue.wi.gov. Complete this form in duplicate, sign it and have it signed by the buyer. Give one copy to the buyer, to be kept as an invoice on the licensed premises, and keep one copy for your own records. Cigarettes and tobacco products may not be transferred.

WISCONSIN ALCOHOL BEVERAGE LAWS FOR RETAILERS XV. CORKAGE FEES Wisconsin alcohol beverage law does not allow “corkage fees” — fees charged by restaurant owners to allow patrons to carry in their own alcohol beverages to be consumed on the premises. If the restaurant does have an alcohol beverage license, the only alcohol beverages allowed on the premises are those which the retailer has purchased from a licensed Wisconsin wholesaler; the retailer is required to have invoices from the wholesaler showing what product the retailer has purchased from the wholesaler. If the restaurant does not have an alcohol beverage license, allowing consumption of alcohol beverages is prohibited and the restaurant owner can be charged for allowing its illegal consumption. XVI. CREDIT LAWS A licensee may only buy liquor or beer for cash or on credit terms for a period not to exceed 30 days (liquor) or 15 days (beer). Licensees may not buy liquor if they are in debt to any liquor wholesaler for more than 30 days or beer if they are in debt to any beer wholesaler for more than 15 days. A person may not be issued a license if he or she exceeds these limits. XVII. INSPECTION OF LICENSED PREMISES A. Licensed premises may be inspected by law enforcement officers during all reasonable hours, including all business hours. All rooms connected to the barroom, sales room or storage area may be inspected as part of the licensed premise. Refusing to permit an inspection is grounds for revocation or suspension of the license. B. Liquor, beer, cigarettes and personal property kept in violation of the statutes may be seized. XVIII. U NDERAGE PERSONS ENTERING LICENSED PREMISES A. An underage person accompanied by his or her parent, guardian, or spouse of legal drinking age may be on any licensed premises. B. An unaccompanied underage person may enter a “Class A” alcohol beverage licensed premises to buy items other than alcohol beverages. The underage person may not stay on the premises after the purchase. C. An unaccompanied underage person may also enter a licensed premises if: 1. He or she is an employee, resident, lodger or boarder on the premises or; 2. He or she enters to do business other than amusement or the purchase or consumption of food and beverages (see exception B above) or; 3. He or she enters to buy food in a restaurant whose “principal business” is serving food or; 4. The premises is a hotel, drug store, grocery, bowling center, service station, indoor golf simulator facility, vessel, private tennis or soccer club, ski chalet, golf course or clubhouse, racetrack licensed under Ch. 562, indoor or outdoor volleyball court, curling club, billiards center having 12 or

more billiards tables, privately owned fishing business that is open to the public for a fee, car operated on a railroad, a regularly established athletic field or a county or municipally owned public facility as defined in sec. 125.51(5)(b), Wis. Stats., of the statutes, or a center for visual or performing arts, or; 5. The premises is in a state park or forest or a park owned by an agricultural society receiving state aid. 6. The premises has a “Class B” Beer or “Class B” Liquor License and the underage person is there to do business at an auction or flea market. In this case, the underage person may not enter any room where alcohol beverages are sold, furnished or possessed. 7. The premises has a “Class B” Beer or “Class B” Liquor License and the underage person is in a room where no alcohol beverages are sold, furnished, served or consumed by anyone when the underage person is present. This applies only if the municipality adopts an ordinance allowing it. The local law enforcement agency must authorize, in writing, the presence of underage persons on the date of the authorization. A separate authorization is necessary for each date on which underage persons will be on the premises. (Sec. 125.07(3)(a) (8), Wis. Stats.) 8. The underage person is on “Class B” or “Class B” licensed premises, on a date specified by the license, when no alcohol beverages are consumed, sold or given away. The licensee, the agent named on the license (if a corporation) or a person with an operator’s license must be on the premises unless all alcohol beverages are in locked storage. The licensee must notify the local law enforcement agency, in advance, of when underage persons will be on the premises. (Sec. 125.07(3)(a) (10), Wis. Stats.) 9. The underage person enters and remains in a dance hall, or banquet or hospitality room attached to a“Class B” licensed premises, for the purpose of attending a banquet, reception, dance or other similar event. 10. The underage person is at least 18 years old, and is working under a contract with a licensee, permittee or corporate agent to provide entertainment for customers on the premises. 11. The premises is issued a temporary “Class B” Beer License (picnic) and the licensee is authorized to permit underage persons on the premises by the official or body of the municipality that issued the license. Note: When the purpose of the above exemptions (that is, bowling, dining, recreation, etc.) can be accomplished without the underage person being in the barroom or other areas where alcohol beverages are sold or consumed, the underage person may not enter or remain in such areas (State vs. Ludwig Lanes, 31 Wis. 2nd 690). D. No retail licensee may permit an underage person, not accompanied by a parent, guardian or spouse of legal drinking age, to enter any part of the licensed premises for any purpose except those stated here. E. You should demand proof of age of anyone entering the premises who appears to be under the legal drinking age. Wisconsin residents may prove age with either a valid Wisconsin ID card or a pictured Wisconsin driver’s license. www.tlw.org
WISCONSIN ALCOHOL BEVERAGE LAWS FOR RETAILERS You or your employee should require anyone who has shown proof of legal drinking age to sign an ID register book, if the person’s age is in question. Record the date of purchase, the ID used, the address and the signature of the purchaser in the book. The book should be kept on the premises and available for inspection by any peace officer. (Sec. 125.07(7), Wis. Stats.) XIX. SALES AND SERVICE OF ALCOHOL BEVERAGES TO UNDERAGE PERSONS An underage person accompanied by a parent, guardian or spouse of legal drinking age may be sold or served alcohol beverages in any licensed premises. (Sec. 125.07(1), Wis. Stats.) XX. P OSSESSION OF ALCOHOL BEVERAGES BY UNDERAGE PERSONS An underage person may not possess alcohol beverages anywhere unless accompanied by a parent, guardian or spouse of legal drinking age (sec. 125.07(4)(b). This does not apply to underage persons employed by the following types of licensees or permittees, in the course of this employment: (sec. 125.07(4)(bm), Wis. Stats.) A. Brewers B. Beer wholesalers C. Liquor wholesalers D. Facilities for the production of alcohol fuel E. Retail licensees or permittees, under the provisions of secs. 125.32(2) and 125.68(2), Wis. Stats. (laws covering operator’s licenses), or for delivery of unopened containers to the home or vehicle of a customer. F. Campuses, if the underage person is at least 18 years of age and is under the immediate supervision of a person of legal drinking age. XXI. NON-ALCOHOL “BEER” Section 125.02, Wis. Stats., classifies “alcohol beverages” as those beverages containing 0.5% or more alcohol by volume. Beverages that contain less than 0.5% alcohol by volume are not classified as “alcohol beverages.” Thus, these “nonalcohol” beverages are not regulated by Chapter 125; they are to be treated the same as other noncarbonated waters and sodas, and may be sold to anyone, regardless of age. These beverages should not be confused with those labeled “low alcohol,” which generally contain 3.2% alcohol, and are regulated by Chapter 125 as being alcohol beverages. XXII. EMPLOYMENT OF MINORS A. Minors under 14 years of age may not be employed where alcohol beverages are sold except that minors as young as 12 may be employed at such establishments if their parents own the business. B. Minors 14 and older may be employed where alcohol beverages are stored, sold or served if they are not serving, selling, dispensing or giving away alcohol beverages. This www.tlw.org
applies to all places licensed to sell alcohol beverages, including stores, service stations, bars and restaurants. C. Minors may not be employed or appear as musicians, singers, performers or dancers at roadhouses, dance halls, night clubs, taverns or similar places, except: 1. Minors 16 or 17 years of age may be employed or appear as musicians in a hall on Friday, Saturday, or any other day not followed by a school day, or before midnight on Sunday, if the hall was rented to celebrate a special event such as a wedding, holiday, birthday or anniversary. 2. Minors may be so employed or appear at dances held solely for minors, conducted by private clubs or civic organizations, where admission is limited to the club membership or by club invitation, and the general public is excluded. (Sec. 103.78, Wis. Stats.). (Sec. 103.78(1)(d), Wis. Stats., and Wis. Adm. Code DWD 270.) XXIII. O THER LAWS RELATING TO UNDERAGE PERSONS A. No one may falsely represent that he or she is of legal drinking age to ask for or obtain alcohol beverages in any licensed premises. (Sec. 125.07(4), Wis. Stats.) B. No one may possess or consume alcohol beverages in a public, parochial or private school, through 12th grade, or in a vehicle owned by, rented, or consigned to a school or while participating in a school activity, without the express, written permission of the school administrator (sec. 125.09(2), Wis. Stats.) Permission may not be given to underage persons. XXIV. PENALTIES FOR VIOLATIONS A. Alcohol beverage licensees permitting unaccompanied underage persons to unlawfully enter the premises are subject to a forfeiture of not more than $500. (Sec. 125.07(3), Wis. Stats.) B. An unaccompanied underage person unlawfully entering a licensed premises is subject to a forfeiture of not less than $250 nor more than $500, suspension of his or her motor vehicle operating privilege as provided under sec. 343.30(6) (b)1, Wis. Stats., participation in a supervised work program or a combination of these penalties. C. A person selling or furnishing alcohol beverages to an unaccompanied underage person is subject to a forfeiture of not more than $500 if the person has not committed a previous violation within 30 months of the violation nor more than $500 or imprisoned not more than 30 days or both for a subsequent offense within 30 months of the violation. (Sec. 125.07(1), Wis. Stats.) D. An underage person misrepresenting his or her age to obtain alcohol beverages is subject to the same penalties described in B above. E. Anyone unlawfully possessing or consuming alcohol beverages on a school premises, in a school vehicle, or while participating in a school activity is subject to a forfeiture of not more than $200 (sec. 125.09(2)(d), Wis. The alcohol beverage license of any person committing a violation of sec. 125.07(1), Wis. Stats. shall be suspended for: 1. Not more than three days if a second violation is committed within 12 months of a previous violation. 2. Not less than three days nor more than 10 days if a third violation is committed within 12 months of two previous violations. 3. Not less than 15 days nor more than 30 days if a fourth violation is committed within 12 months after committing three other violations. XXV. FALSE ID CARD PENALTIES A. Anyone other than a person authorized by sec. 25.085, Wis. Stats., or sec. 343.50, Wis. Stats., who makes, alters or duplicates an official ID card, provides an official ID card to an underage person, or knowingly provides other documentation to an underage person claiming that the underage person is of legal drinking age may be fined not less than $300 nor more than $1,250 or imprisoned not less than 10 days nor more than 30 days, or both. B. Any underage person who does any of the following may be penalized. For a first violation, a forfeiture of $300 to $1,250, suspension of the person’s driving privilege, participation in a supervised work program or any combination of these penalties 1. Intentionally carries an official ID card not legally issued to him or her, an official ID card obtained under false pretenses or an official ID card that has been duplicated to give false information. 2. Makes, alters or duplicates an official ID card. 3. Gives false information in applying for an official ID card. 4. Intentionally carries an ID card or other documentation showing that he or she is of legal drinking age, knowing that the documentation is false. 5. Provides to another underage person an official ID card or other documentation claiming that the other underage person is of legal drinking age, knowing that the documentation is false. C. Any person who violates A, for money or other consideration, is guilty of a Class I felony. XXVI. ID/DL CHECKING GUIDE A. False ID/DL Checking Guide • Ask pertinent questions about the ID presented. For example, if an ID card is presented as proof of age, ask how the driving was on the way to the establishment. If the person was driving, ask to see his or her DL. • Check the card’s expiration date. If the DL has expired, maybe it really does not belong to the holder, but to an older sibling who has already got a replacement for it. How did he or she get to the establishment using an expired DL? • Watch for stamp of “duplicate” on the card. If they have a duplicate, maybe someone else has the original, and one of them is lying.

• People with false IDs rarely carry backup documentation, whereas most people have several forms. When confronted with a possible false ID, ask for further documentation. • Question the carrier as to some basic information on the card, such as address, exact birth date, middle initial or spelling of last name. If they don’t answer to your satisfaction, refuse service and request that they immediately leave. B. Look for: • Glue lines. • Bumpy surfaces by the picture or birth date. Any surface area inconsistent with the rest of the ID usually indicates tampering. • Overlay of reprinted numbers (and a shadowy or cloudy image). ID card may have been opened to alter numbers. • Missing spots on the state logo. ID alterers often forget to pay attention to one of the most obvious clues on the card. • Letters and numbers, size of lettering and format of the card when compared to a legitimate DL or ID. How may digits for expiration and date of birth? C. Also: • Use a blacklight and magnifying glass to check for secu- rity features such as ultraviolet/microprinting on the DL or ID. • Check reverse side lettering. Oftentimes counterfeiters will spend great amounts of time on reproducing an authenticlooking photoboard, but will merely photocopy the reverse side. These are often blurred, a sure sign of photocopying. • Bend the card, feel it. How does it feel compared to the authentic card? • What is the color of card? • Check the size of the DL. How does it compare to a genuine one? • Check the color/thickness and clarity of lettering. • Check thickness of the card. • Check the corners of the card. Are they well-rounded and smooth or uneven and jagged? This is one of the best methods for detecting counterfeit cards. • Is there shading or glare on the picture or redness in eyes? Most driver licensing stations have their cameras set to avoid these problems. • Use an ID Checking Guide, especially in areas where there is a heavy out-of-state population. There are several commercial companies that publish these guides, which picture all of the states’ driver’s licenses. • Always check the reverse side. • Compare questionable documents to your own driver’s license. Check letters and numbers, both for size and consistency against the authentic card. • Check the laminate. How does it compare to the authentic? Is it clear or cloudy? XXVII. CIVIL LIABILITY FOR RETAINING ID Civil Liability for retaining proofs of age (Sec. 125.039, Wis. Stats.) No person who holds a license or permit and no employee of such a person is civilly liable for retaining a document presented as proof of age for a reasonable length of time in a good faith effort to determine whether the person who presented the document is an underage person or to notify law enforcement of a suspected violation of carrying a false ID. www.tlw.org
