Okay I will be honest. I have been unemployed since September so money has been very tight and i havent been able to afford my car insurance. I tried to get there early enough (6-25-09) but i missed him and no one was home so I placed the key under the plant and left I told the police officer that I had made a call to him after dropping the key but the phone number to reach him was on my moms cell phone. I thought I did I couldn't remember because I came back a day later for the car. After I walked home I thought id leave it there a day so he could find the problem, since he gets home at 7pm. When I got there on 6-26-09 my car wasn't there and they said they never saw it there so i called the police to see if it was towed it wasn't and the key wasn't there either, police came over and took my statement but on the report he stated that the car was stolen on 6-26-09 and the phone number I used to call to tell them I was leaving the car there was written down wrong. The insurance company said that the inconsistencies where that I did not use my cell to make a phone call on the 6-24-09 or 6-25-09 I told them that i used my mothers cell phone in the oath recorded meeting they recorded my statement a week after i reported my car stolen and i failed to tell them i used my mothers cell phone but they didn't ask and I also told them I called when I placed the key under the plant but I was confused because I had called my cousin twice on 6-24-09. So, my brother got into a car accident about 3 years ago. He was driving his car and a motorcyclist ran into him doing around 90 mph, causing the bike to flip and the guy on the bike to dismount and skid across the freeway. The motorcyclist was lucky he didn't get run over or killed. It was deemed by both the insurance companies that it was the motorcyclists fault and when the motorcyclist tried to sue our insurance company, we got a letter from our attorney that the case had been dismissed and no further action was needed. Today, we got a call out of the blue from Mercury saying my brother couldn't be on the insurance anymore because they had settled with the motorcyclist for $100,000 and basically, if we didn't get him off the insurance, my whole family would be removed. We didn't receive any notification that Mercury was planning on paying this guy out or that our rates would be altered. We called the attorney's office but he wasn't in and we explained the situation and the receptionist said they might of just settled anyway without letting us know even though this whole thing wasn't even my brother's fault. I had neck pain, shoulder pain, back pain and terrible pain in my knee. I had MRI on back, knee and neck because those were the worst. That total was about $1800. I was told by the doctor that the mri on my back said I have two herniated disks and I should do therapy. I listened to him and went four times per week for four months. The Mri on my neck came back good. But my knee showed a tear in mcl. I had surgery on that and had to see the surgeon in his office twice plus hospital bills which equals a bill of $14,500. I then needed 2 months of therapy on my knee. Also all the pain meds ive been taking through out the whole process is around $600. I had a ekg for my nerves to test if they were good and that cost $800. So after doing my research I find websites that say the settlement amount s should be all bills multiplied by 3 depending on the persons insurance carrier and coverage. Well this person has $200,000/$200,000. So far all my bills have been paid through my insurance. When I do the math for what all the bills are is comes to roughly $28350. I didn't include the four days per week for therapy and seeing the doctors. That has to be a big chunk also. My lawyer called me and said he was made an offer of $42,000. He gets a 1/3 of that. I think they low balled me soooo bad on this. If i use the X3 multiplier method then it should have been somewhere around $85,000 offer. Remember I didn't even include all the visits to the therapy. Is this a good offer or should I decline and wait for second offer?
