As we quickly approach the summer season and the school year comes to a close, our Cultural and Community Services Department is gearing up for Summer Camp. Registration is now open for children ages 5 to 15 to join in the adventure, with activities ranging from field trips to games, and much more. Who Owns The Common Areas In Your Building Or Community?

Trick question. The answer depends on whether you are in a Florida Condominium Association or a Homeowners Association. These two types of Residential Owners Associations are regulated and function very differently, and each one is treated separately in Florida Statutes, with Chapter 718 covering Condominium Associations and Chapter 720 applying to Homeowners Associations.

(This article is part of my Back-To-Basics series for Condos and HOAs. Last published about a year ago, here it is updated for the many new owners and residents in Florida Condominium buildings and HOA communities.)

Last week the City of Hollywood celebrated the grand opening of the newly expanded pickleball courts at Stan Goldman Park.

Pickleball, a quirky-sounding name for a sport that’s sweeping across the globe, is a delightful blend of Tennis, Badminton, and Ping Pong. With its origins dating back to the mid-20th century, this fast-paced game has captured the hearts of people of all ages and fitness levels.

As we get started, it is interesting to note that Florida’s Condominium Act uses the term common elements, while the Homeowners Association Act refers to common areas. This difference in language is an important part of this week’s topic. Today’s discussion refers to residential Owners Associations in which membership is included and/or mandatory when buying property in the building or community.

• In Condominium Associations, each individual unit owner owns an undivided share of the common elements.

This distinction may not seem like much at first, though it directly influences:

• Voting procedures and proxies

• Board of Directors authority and responsibility

• How financial reserves are handled

• Maintenance and repair responsibility

• How changes can be made to the shared property areas.

Common element/area ownership is one of the main reasons why Condominium and Homeowners Associations are regulated differently in Florida.

From its humble beginnings in a backyard on Bainbridge Island, Pickleball quickly gained popularity among friends and neighbors. Within a few years, it spread to other parts of the United States and eventually across the globe. Today, Pickleball is played in community centers, retirement communities, schools, and parks worldwide.

Here Are The Rules

Pickleball is played on a Badmintonsized court with a modified Tennis Net.

The rules are relatively simple, making it accessible to players of all skill levels. Here’s a brief overview of how the game is played:

Equipment

Pickleball is played with a paddle made of wood, graphite, or composite materials and a plastic ball with holes, similar to a Wiffle Ball.

Court

The court is 20 feet wide and 44 feet long, with a net height of 36 inches at the sidelines and 34 inches at the center. It’s divided into two halves by a centerline and further divided into service courts by a non-volley zone or “kitchen” area.

Serve

The game begins with an underhand serve diagonally across the net. The server must keep one foot behind the baseline and serve the ball into the opposing service court.

Volleys Players cannot volley (hit the ball without it bouncing) while standing in the nonvolley zone, also known as the kitchen. This rule prevents players from dominating the game with aggressive net play.

Scoring Pickleball is typically played to 11 points, and the winning team must win by at least two points. Points can only be scored by the serving team.

Faults Common faults include hitting the ball out of bounds, stepping into the non-volley zone while volleying, or serving into the net.

No Great Shakes (At Last)

Most of what Bob Carlton saw of Vietnam during his two wartime tours of duty was seen from the cockpit of an A-1 Skydiver, which means he played a significant role in saving the lives of hundreds, if not thousands, of soldiers and civilians. Bob ran 162 missions across the five years he served as a naval aviator. He also ran a couple of missions that didn’t go quite as planned. Both resulted in crashes that Bob says he’s fortunate to have lived through.

“One of the crashes occurred when the catapult on the aircraft carrier failed,” Bob remembers. “That plane went straight into the water. Never even got airborne. The second was the result of an engine fire, so I’m quite lucky to be here.” Luck indeed, but a couple of years

ago, Bob began to feel like his luck was running out. A battle with essential tremor, a nervous system disorder that mostly causes involuntary twitching in the hands, was the reason. “For me, the problem started about 30 years ago,” says Bob, now over 70. It started with occasional little shakes in my left hand. Over time it got worse, a lot worse. It moved into both hands and got so bad it was hard to do almost anything. Just about anything you do with your hands, I couldn’t do. I couldn’t hold a fork or spoon or control a toothbrush, so eating and brushing my teeth were very difficult. The problem also made it very difficult to do one of my favorite hobbies, woodworking. Eventually, Bob grew tired of adapting. The shaking in his hands

became so bad that after years of trying to control the problem through medication, he finally accepted his neurologist’s advice to try an advanced treatment option for the disorder.

Life-Changing Procedure

That treatment is called deep brain stimulation, or DBS. It is an FDA approved procedure in which the patient is implanted with a small pacemaker sized device that delivers electrical impulses to the specified areas of the brain. Studies show that within a year of being implanted with a DBS Device, Parkinson’s Disease and essential tremor patients experience a 90 percent improvement in motor function and a 30 percent decrease in medications. His shul was in the flea markets, soccer fields of the JCC & in people’s homes. His Sunday afternoon would be spent in a teenager’s living room with a pair of Tefillin and a group of friends. Rabbi Bryn was a Chabad rabbi and a Shliach emissary of The Rebbe to North Dade, Florida, whose life was tragically cut short at age 40 by Marfan syndrome, a condition that affects the body’s connective tissue. For over a quarter of a

century, Rabbi Bryn – the son of Holocaust survivors - courageously battled the fatal disease that decimated his heart, yet managed to minister to, counsel and save tens of thousands of Jews and non-Jews alike.

Rabbi Bryn fed the hungry and poor, counseled the sick and the troubled - all with great courage, fortitude and selfsacrifice. He arranged marriages, taught Torah and ethics to thousands, bridged the interfaith gap by working closely with people and clergymen of all faiths… he was the living embodiment of kindness and bravery. Some might be troubled by the precariousness of constantly living on the edge of existence, but the beloved rabbi’s overflowing concern for others left no room for worry over his own well-being. He lived the equivalent of 120 years of good in a third of the time.

HOA communities usually include single-family homes and townhouses/villas with no shared ownership of the common areas. Property owners own individual parcels/ lots and residences, not any part of the common areas. This is a major difference between HOAs and COAs in Florida.

Common areas in HOAs can include: Streets and sidewalks, Clubhouses and maintenance buildings, Landscaping in common areas and along streets, Guardhouses and Gates, Community Swimming Pools, and other Recreational Facilities and Amenities.

Unlike condo ownership, exterior maintenance and repair of each residence in an HOA is usually the responsibility of the property owner, not the Association.

You might be thinking that if the HOA corporation owns a community’s common areas, and property owners are part of the corporation, all owners get to vote on how those common areas are maintained, improved, and managed. Not exactly.

Just about all Florida Condominium and Homeowners Associations are organized as Not-For-Profit Corporations under Florida Statutes Chapter 617. This is so they can engage in the legal and financial activities that contribute to proper Association operation. The elected Board of Directors runs the corporation in similar fashion as the Boards of major US for-profit corporations. Elected Board members are also officers in the Association’s corporation. The Association holds all shares of the corporation. Individual owners are members rather than shareholders.

Not all matters regarding COA or HOA common elements/areas are open to having all the owners vote on them. Since a Board of Directors is elected to manage the Association’s business in compliance with either the Florida Condominium Act (FS 718) or Homeowners Association Act (FS 720) and an Association’s own Governing Documents, Board members are able to make some decisions without a vote by all owners.

Example - If you own a few shares of Microsoft, Amazon or any other public company, you don’t get to vote on every decision that comes before the corporation’s Board of Directors. Florida Statutes Chapters 718 or 720 and the building or community’s own Governing Documents provide the rules about which decisions a Board can make on its own, and which require an owner/ member vote.

• Because condominium unit owners also jointly own the common elements, they have more input and voting rights on how those parts of the property are managed and maintained, especially when it comes to spending Association money.

• On the other hand, since HOA individual property owners do NOT jointly own the common areas, the Board of Directors has the authority to make more decisions on its own regarding maintenance, repairs, upgrades, and additions to common areas and structures within the community.

No matter how an Association’s common elements/ areas are owned, the Board is still fully responsible for making sure they are properly maintained. This includes monitoring common property physical condition and ensuring there is enough money available when maintenance or repairs are needed.

Every owner (especially newer ones) in a Florida condominium building or HOA-governed community has the responsibility to understand how their Owners Association is organized and how it functions. If you are not as familiar with your Association as you may like to be, use this article as a starting point, then look through your Governing Documents for specific guidance.

The keys to owning and living in an Associationgoverned building or community in Florida are education and participation. The more you learn about how your Association functions, the more comfortable you will be living in your building or community.

Residency Requirements - In order to ensure that priority is given to verified residents for space and discounted pricing, the City implements strict guidelines for proof of residency. Residents must have a Valid CityIssued SIB Resident ID Card in order to register during the priority period and to receive the discounted rates.

The registration fee for camp is a one-time, nonrefundable fee ($35 for Residents, $55 for NonResidents). Only one Registration Fee may be applied for the summer, regardless of how many different camps you

register for. This fee includes: two t-shirts, participant insurance, and administrative processing fees. The Registration Form, the Non-Refundable Registration Fee, a copy of the Child’s Birth Certificate and a 50%, Half Deposit of Camp Fees are required for Camp Enrollment.

Florida Attorney General Fights To Protect Women And Girls

Attorney General Ashley Moody today led a coalition challenging the Biden Administration’s newly announced Title IX rule. Biden’s Department of Education recently unveiled new changes to Title IX seeking in part to redefine “sex” to include “gender identity” and “sexual orientation” despite decades of legal precedent stating otherwise.

“We will not comply, and we will fight back. We are not going to let Joe Biden try to inject men into women’s activities. We are not going to let Joe Biden undermine the rights of parents and we are not going to let Joe Biden abuse his constitutional authority to try to impose these policies on us here in Florida,” vowed Gov. Ron DeSantis last week.

Attorney General Ashley Moody said, “Biden’s new Title IX rules shred protections for women—that so many fought for over decades. The idea that young girls can now legally be forced to undress in the same room with males in what is supposed to be a safe space like a locker room, that a young woman could be randomly assigned a roommate that is a bio-

logical male with little to no say over the matter, or that biological men would be eligible for women’s scholarships is ludicrous. To ensure safety and fairness, Florida will aggressively fight Biden who refuses to think through the real-world consequences before overhauling regulations.” Enacted in 1972, Title IX states,

“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.” As Attorney General Moody and the coalition referenced in the complaint, “At the time of enactment, no one doubted that the law’s use of ‘sex’ referred to biological sex. And all relevant indicators confirmed what everyone understood: ‘sex,’ as used in Title IX, means biological sex and does not include gender identity or sexual orientation.” The new rule references “limited circumstances” where sex discrimination is allowed. Noticeably absent from the list of

“limited circumstances” is the regulation on separate bathrooms and locker rooms stated in 34 C.F.R. §106.33. The rules could also force female college students to share dorm rooms with biological males.

The coalition, in reference to this absence, states, “Though the rule doesn’t expressly rescind §106.33, the Department says that its regulation is null and void. That regulation is not backed by a ‘statutory exception,’ the Department claims, and the Department ‘declines to adopt the Eleventh Circuit’s reasoning in Adams that the statutory carve out for living facilities’ justifies it… In other words, the rule declares §106.33 invalid without formally rescinding it and proclaims that excluding transgender or nonbinary students from using the bathroom or locker room of the opposite sex is illegal…”

The coalition concludes in part by stating, “The challenged rule’s redefinition of ‘sex’ under 20 U.S.C. §1681 to include ‘gender identity’ and ‘sexual orientation’ is

illegal. Courts must interpret a statute’s ‘words consistent with their ordinary meaning at the time Congress enacted the statute.’ There is no evidence from the time of Title IX’s enactment - and the Department offers none - to indicate that ‘sex’ referred to anything other than biological differences between males and females.”

The coalition is asking for the following relief: A declaration that the rule violates the Administrative Procedure Act; vacatur; a stay of the rule’s effective date; a preliminary and permanent injunction barring enforcement of the rule in the plaintiff states; and any other relief that the court deems just and proper.

The State of Hallandale Beach

This is the time of year I deliver my State of the City Address. It was held at Gulfstream Park and hosted by the Hallandale Beach Chamber. The following article is Part I. I have left it in speech form and will be sharing the other parts the next few weeks. I hope you enjoy it.

I must note this does not encompass every issue we are addressing. Please know that I along with the Commission and our entire Staff have been working hard to ensure our City is providing the vital services you depend on. I hope you continue reading my articles which are focused on important Commission actions that impact your daily lives.

You all are part of a tradition that started back in the 1600 hundreds in Marseille, France and was brought to the U.S. in 1915.

So how is the State of our City? Just look at some recent headlines.

Today, I am here to share; where we were, where we are and our plans for the future.

So, I figure I will be here for a few hours.

Our City has been extremely busy! Municipal government must provide services that are vital to the quality of life of our residents. We do not get to choose. We are not based on profit but on uniting human capital and resources to deliver life sustaining services to our residents.

My duty as Mayor is to be a spokesperson for our City. As the Chair of our Board of Directors, our Commission is responsible for providing the vision and oversight to ensure these services are delivered efficiently and effectively.

While we do not run day-to-day operations we certainly will be and are held accountable for everything that happens in these four-square miles.

I often get asked why you do what you do. The short answer is I genuinely enjoy helping people. I also enjoy learning from

On Saturday, May 18th and Sunday, May 19th, from 8 a.m. to 12 noon each day, the City of Hollywood is hosting a Household Hazardous Waste (HHW) recycling event at the Public Works facility located at: 1600 S. Park Road. This event offers Hollywood residents an opportunity to dispose of hazardous materials safely. Public Works staff, along with authorized vendors specializing in hazardous material handling, will set up convenient drop-off stations exclusively for Hollywood residents. Businesses and contractors are not eligible. Residents should bring valid identification that clearly indicates a Hollywood address. Resident verification will take place upon entering the event site. Let’s prepare for the upcoming hurricane season by clearing hazardous materials from our homes. the everyday problem solving for our residents and stakeholders I serve. Frankly, I would not want it any other way. In short, I am the head of the customer’s complaint department.

Let’s face it, nothing goes as planned. But we are the government, and we are here to help. And I am not joking.

While we can study plans and execute them there are many things that can impact the outcome. Even when things go as planned, great leaders know that we need to continue to reevaluate. How can we do it even better, faster and with less cost?

I am grateful for the hard work, experience and integrity of our City Manager Dr. Jeremey Earle and our entire Staff whose efforts are showing dividends.

Five years ago, some of you may recall our budget was in critical condition.

Without aggressive austerity measures we would have been faced with fiscal insolvency.

I want to start with what I called the “new beginning” when I can honestly say there was and remains civility within the commission. In today’s political climate it is a rare thing.

In August 2020, Dr. Earle agreed to be

acting City Manager. In hindsight his plan was very strategic. While he had a knowledge of the City and CRA he did not know just how bad things were -- or did he? In the scheme of things, the budget that year would be the budget he adopted after years of dysfunction. Down 20 police officers, All departments had vacancies. There was not one large scale capital project done. The GO Bond Parks were delayed.

The Major Southwest Flooding Project has still not been completed. A $6-MillionDollar Water Plant Expansion had been funded but never started. The ship was sinking and was being plugged in with one-time fixes. Dr. Earle was tasked with righting the ship. He could have bailed but instead he started bailing. He charted a way forward. I hope you continue to follow my speech in next week’s column.
