A Los Angeles federal judge threw out an indictment Friday charging a dive boat captain with manslaughter in the deaths of 34 people in a 2019 fire aboard a vessel anchored off the Southern California coast. The ruling came on the third anniversary of one of the deadliest maritime disasters in recent U.S. history as the Conception went down in flames Sept. 2, 2019, near an island off the coast of Santa Barbara. All 33 passengers and a crew member who were trapped in a bunk room below deck died.

Council candidates start picking-up endorsements

Captain Jerry Boylan, 68, failed to follow safety rules, federal prosecutors said. In Santa Monica, heatwaves are often synonymous with traffic and tourists, but as scientists begin seeing the real-time effects of climate change along the California coast, periods of abnormally high heat also prove insight into changing ocean dynamics that could become the “new normal” if rising temperature trends continue.

“Algae sits on the surface of the water, so that’s where you get these bigger blooms. You have more sunshine and more heat, so it can replicate faster,” Rink said. “Warming up the upper layers also prevents mixing of the water because it’s colder water that sinks. So, you’re going to have less mixing of the ocean, which then causes, again, more blooms and more issues with potentially harmful toxins in the water.”Those issues are currently on display farther north along the coast in the Bay Area. On Thursday afternoon, the California Department of Fish and Wildlife tweeted reports of data from what it called “citizen scientists” reporting about 10,000 yellowfin goby deaths, along with hundreds of striped bass and white sturgeon, due to an algal bloom in the San Francisco Bay — although the department acknowledged it believed current numbers could be an undercount of trueSanmortality.Francisco Bay Regional Water Quality Control Board Executive Officer Eileen White told the Associated Press on Wednesday that a triple-digit heat wave forecast for the holiday weekend may help the Bay Area’s die-off grow even more. In San Francisco’s South Bay, concentrations of chlorophyll — an indicator of algae density —measured on Aug. 10 were the highest observed in more than 40 years, White told the AP. Blooms are also self-perpetuating, according to data from the Environmental Protection Agency, or EPA: “Algal blooms absorb sunlight, making water even warmer and promoting more blooms.” Here in Southern California, Rink said algal blooms have sickened sea lions that have been found stranded at increased rates in recent “Actually,weeks.I just heard about increased strandings and issues with sea lions in Southern California, along the coast,” Rink said. “The algae produces this toxin that is eaten by certain species of fish that then the lions eat, and it is a neurotoxin that affects their brain activity and behaviors and can cause a lot of issues with those specific mammals. Not to mention, it’s not good for humans to consume any of the marine life that takes in this toxin.”

“A lot of species breed in warm waters, especially elasmobranchs — sharks and rays,” Rink said. “So, as our waters warm up further along our coasts, we’re going to start seeing breeding grounds move as well, which will populate the species in areas that are normally not in or normally not in as high of numbers. So, it could very much change the dynamics and encounters with species like sharks.”

“A couple years ago, we had a big migration of pelagic red crabs that came up the coast,” Rink said. “They are typically a much more southern, Baja California species, and they came all the way up into our waters, which is unusual. The same thing happened for warm water species like seahorses, that come up. So you start seeing these different migrations that we don’t normally see.”

Aside from algal blooms, higher water temperatures can damage kelp forests (which Rink called “the rainforests of the ocean”) and cause migration patterns for some species to shift — some heading into the Santa Monica area from the south and others moving up north to beat the heat.

Speaking to the Daily Press on Thursday, Heal the Bay Associate Director of Operations Laura Rink said heatwaves work like a window into what the future could hold for marine species in the Santa Monica area. “When we have these warming events, and we see the effects of them, it can be a sobering reminder that if the warming effects continue to happen more frequently, or over longer periods, because of climate change, it is really going to drastically affect all the different trophic levels of life and animals within our ocean,” Rink said. “So, it should be a reminder that if humans don’t make changes that it’s just going to continue happening and we can have concerns for both human and animal health.”Rink, who holds a degree in aquatic biology, has worked in aquariums for about 15 years. Currently, she oversees exhibit operations and care for all the animals at the Heal the Bay Aquarium, a nonprofit science center located beneath the Santa Monica Pier. Although ocean water temperatures are by and large not as volatile as air temperatures, heatwaves do have a direct effect on the temperature of the sea, especially the water temperature near the surface, where algae lives.“Heat … affects tiny organisms first,” Rink said, “and then works its way through different trophic levels in our ecosystems.” That means, during times of especially high water temperature, algae is among the first species to react, often creating algal blooms. Although Rink was quick to point out that not all algal blooms are harmful, some release toxins that travel up the food chain and can affect numerous species including humans.

Anthony Portantino, who sponsored the bill, said backers were sure they had the necessary votes until retiring Assemblyman Patrick O’Donnell, a fellow Democrat, defected and voted against it. “That was the killer,” Portantino told The Associated Press over the phone as he waited to board a flight home to Southern California. “I think we had 54 votes — right up until one wentO’Donnellsouth.” responded that Portantino was to blame. He said the senator’s staff “couldn’t answer basic questions about the bill.” “I’m not going to pass something, even on my last day in the Legislature, that may not be constitutional,” O’Donnell said. O’Donnell was one of seven Democrats who joined Republicans in either voting against the bill or withholding their votes. They included Adam Gray and Rudy Salas, both of whom are running for Congress in swing Central Valley districts where a vote for gun control could hurt them.

The affiliated gun control advocacy groups Moms Demand Action and Students Demand Action, both part of Everytown for Gun Safety, asked Newsom to call lawmakers back for a special legislative session to pass the law. But the governor’s office said a similar bill should be the next Legislature’s “first order of business” and Newsom “looks forward to signing an urgency measure as soon as possible.”Portantino said he plans to bring the bill back when a new Legislature is sworn in.

Gun-control advocates could have had another victory in their very successful California legislative session that ended Thursday if not for a risky move supported by Gov. Gavin Newsom that backfired on a bill to impose new limits on carrying concealed weapons after the U.S. Supreme Court struck down old rules. The Legislature passed more than a dozen significant bills on gun limits during the session. But the concealed weapons measure failed Thursday after Newsom, Attorney General Rob Bonta and the bill’s other Democratic backers pushed for a two-thirds supermajority required so the new rules could take effect this month, instead of opting for the simple majority that would have made the new law effective in January. The measure fell just one vote short of the 54 it needed in the 80-member Assembly. And by the time the bill’s backers realized they were short, legislative safeguards enacted by voters meant it was too late to pass the bill with the 41 “aye” votes that were easily in hand.Sen.

Microsoft’s plan to buy Santa Monica based video game giant Activision Blizzard for $68.7 billion could have major effects on the gaming industry, transforming the Xbox maker into something like a Netflix for video games by giving it control of many more popular titles. But to get to the next level, Microsoft must first survive a barrage of government inquiries from New Zealand to Brazil, and from U.S. regulators emboldened by President Joe Biden to strengthen their enforcement of antitrust laws. In the United Kingdom, regulators on Thursday threatened to escalate their investigation unless both companies come up with proposals within five days to ease competition concerns. More than seven months after Microsoft announced the deal, only Saudi Arabia has approved it. “A growing number of countries are subjecting major global transactions to deeper scrutiny,” said William Kovacic, a former chairman of the five-member U.S. Federal Trade Commission. “Many of the jurisdictions that are exercising that scrutiny are significant economies and can’t be brushed off.” Microsoft has faced antitrust scrutiny before, mostly notably more than two decades ago when a federal judge ordered its breakup following the company’s anticompetitive actions related to its dominant Windows software. That verdict was overturned on appeal, although the court imposed other, less drastic, penalties on the company. In recent years, however, Microsoft has largely escaped the more intense regulatory backlash its Big Tech rivals such as Amazon, Google and Facebook’s parent company Meta have endured. But the sheer size of the Activision Blizzard merger has drawn global attention.Theall-cash deal is set to be the largest in the history of the tech industry. The possibility of Microsoft gaining control of Call of Duty has been particularly worrisome to Sony, maker of the PlayStation console that competes with Microsoft’s Xbox. In a letter to Brazilian regulators, Sony emphasized Call of Duty as an “essential” game — a blockbuster so popular and ingrained that it would be impossible for a competitor to develop a rival product even if they had the budget to do so.

The U.K. watchdog’s preliminary inquiry raised similar worries. It said Microsoft’s control of popular Activision Blizzard games raised concerns that the deal would hurt rivals in multi-game subscription services and the cloud gaming market. One solution could be a settlement in which Microsoft agrees to ensure that consolemaking rivals such as Sony or Nintendo won’t be cut off from popular Activision Blizzard games. Microsoft has already publicly signaled its openness to that concept.

The other major elements of Newsom’s plan are Increaseto: reuse of urban wastewater, a relatively uncontroversial idea that could add a substantial 1.8 million acre-feet to California’s annual water supply; Conserve another 500,000 acre-feet by persuading city dwellers to rip out lawns, fix leaks and take shorter showers; Double the supply of desalinated ocean water and salty groundwater by adding capacity for another 84,000 acre-feet a year. But despite examples of large-scale desalination working all over the world, environmentalist opposition guarantees that desalination will never add more than a small fraction of the water California needs.Newsom’s call for Californians to move away from a scarcity mindset is a welcome new message. If he can move all these projects forward, it will be a major accomplishment.

At first glance, Gov. Gavin Newsom’s new water supply strategy might suggest the projects he is proposing will create about 7 million acre-feet of new water, but a closer reading shows that’s not quite true. If every proposed storage facility is built, and the proposed water recycling and desalination projects are also eventually completed, Newsom’s water supply strategy will add about half that much. Even so, his plan is timely and much needed, but making it happen will require unprecedented compromises from California’s powerful environmentalist lobby.Over the past decade, total water diversions for cities, farms and to maintain ecosystems totaled 75 million acre-feet per year, according to the California Department of Water Resources. Such diversions cannot continue at this volume without new water, because the worsening droughts have imperiled every major source — groundwater, water imported from the Colorado River, and water stored in reservoirs.“Somuch of the water conversation in this state has been about conservation, a scarcity mindset,” Newsom said as he introduced the plan on Aug. 11. “That’s a relatively small component of the overall strategy we are introducing here today. Now, we are focusing on creating more water.”The biggest part of Newsom’s strategy is capture. He has proposed to “expand storage above and below ground.” This accounts for 4 million of the 7 million acrefoot target, but that figure is misleading because it refers to storage capacity rather than annual yield. The “yield” of reservoirs and aquifers is, at best, only about onethird of Reservoirscapacity. are never completely emptied, and — especially in the case of in-stream reservoirs — they are rarely filled to capacity. As for below-ground storage, aquifers can only fill slowly, through large, spreading basins that capture floodwater in rural areas or via percolation ponds in urban areas. This means water can only be withdrawn at the rate at which water can be injected into them. These storage projects, therefore, are more likely to add around 1.5 million acrefeet of new water a year – not 4 million acre-feet.Newsom’s plan commits to finally building the storage projects approved by voters in 2014. The biggest part of that plan — the proposed Sites Reservoir in Colusa County — has endured relentless attacks by environmentalists. In an attempt to compromise with them, the design has already been downsized from 2 million acre-feet of capacity to 1.5 million acre-feet. Opposition to Sites is typical. Environmentalists have consistently opposed new reservoirs in California, even off-stream reservoirs that don’t block the natural flow of a river, as well as expansions of existing reservoirs. They have litigated most proposals to a standstill. Earlier this year, they also prevented construction of a large-scale desalination plant in Southern California.Newsom, to his credit, made mention of this, expressing exasperation that environmental regulations have prevented as many good projects from getting built as bad ones. “The time to get these dam projects completed is ridiculous. Permits take years. One of the principles of this plan is to change our permitting, address the regulatory thickets to fast-track these projects, and move things forward.”

“Continuing to go forward with this kind of heavy-handed approach is simply bringing the day closer when those million acres of agriculture are fallowed, and literally thousands upon thousands of farm workers will be unemployed,” Assemblymember Jim Patterson, a Republican from Fresno, said in May. “The death knell of agriculture is but a few more votes like this away.” Assemblymember Adam Gray, a Democrat from Merced, said the bill would have “turned the process upside down and imposed a sweeping proclamation from Sacramento with zero consideration for local conditions.”

California lawmakers punted on a proposal to rein in agricultural groundwater pumping as drought continues to grip California and more than a thousand domestic wells have run dry. A bill by Assemblymember Steve Bennett, a Democrat from Santa Barbara, would have added hurdles to obtain a permit to drill an agricultural well. Though the bill cleared the Senate on Monday, Bennett elected to not bring it up for a final vote in the Assembly before the Legislative session timed out Wednesday night. He said California Gov. Gavin Newsom’s office told him the bill was no longer viable because of changes made. Bennett’s bill aimed to address a major groundwater disconnect between the local governments that grant drilling permits, and the local groundwater agencies tasked with managing aquifers. ApartmentMid-City fire on 17th Street On Thursday Sept. 1, at 9:48 p.m. Santa Monica Firefighters received multiple 9-1-1 calls reporting a structure fire in the 1400 block of 17th Street in the Mid-City neighborhood of Santa Monica. Upon arrival, Firefighters found a well-developed fire within one apartment unit and began an aggressive suppression effort and a rapid search for any potentially trapped occupants. Fortunately, all residents were able evacuate and there were no reported injuries. Firefighters extinguished the blaze quickly which kept the fire from spreading to adjacent apartments. Significant damage occurred to one apartment unit with only minor smoke damage to the unit above, forcing the displacement of two residents. Santa Monica Fire was assisted by Santa Monica Police, Santa Monica Building & Safety, and McCormick Ambulance. The cause of the fire is still under investigation. PATRICK

Bennett said he expects a run on permit applications if Newsom’s executive order expires before a bill is in place. “I’m really disappointed. And I’m very concerned that if something happens to the executive order, we will have a land rush on well permits,” he said. “But I’m not discouraged. We learned and we’re going to redouble our efforts.”

Environmental and environmental justice groups supported the bill, including the Natural Resources Defense Council, Sierra Club California and Community Water Center because groundwater depletion threatens drinking water supplies.

On the afternoon of August 27, 2022, Mary Margaret (Rogers) Hays, age 89, passed away with her family by her side due to a long illness. Mary Hays was born on September 9, 1932, and was raised in Michigan. She was the first child of Albert and Mabel Rogers. Mary went to nursing school right after high school to become a registered nurse

She had a deep love of family and her beloved Santa Monica community where she lived in the same house in Santa Monica for over 58 years. Her dedication to her job at Santa Monica Hospital as a registered nurse made her well known throughout the community and when she would go into town most people knew her and thanked her for caring for their loved ones over the years.

After becoming a registered nurse, Mary had the California dream, packed up all she owned and drove all the way from Michigan to California by herself in an old car to make that dream happen! She lived in an apartment above a business of what is known as the 3rd Street Promenade with some friends she knew back in Michigan who also shared her dream. She first worked as a nurse at the UCLA campus in Los Angeles, and then worked at the local Santa Monica Hospital for the remainder of her career. She received an award in the 1980’s for being in charge of their AIDS wing at Santa Monica Hospital, and was a very dedicated nurse for more than 40 years retiring in 2000.Shemet her husband, Donald F. Hays at St. Monica Catholic church, in the singles group called “The Damian Club” and they were married at the church on November 14, 1959. Their daughters both attended St. Monica Catholic School and were also married there, and Mary was a dedicated volunteer at St Monica’s, the favorite Girl Scout leader, and was always seen on hot lunch days, Pioneer Days and their annual Ice Cream Socials. Mary and Don kept in touch throughout their lives with all of their lifelong friends in Santa Monica. They also attended the reunions of “The Damian Club” until her husband’s death.

Thomas Ernestine Thomas passed on July 18, 2022 at Sun Ray Nursing Facility in Los Angeles. At the age of 15, Ernestine Thomas left Texarkana, Arkansas and established roots in Santa Monica.
