Local, state laws taking effect in 2016 BY JENNIFER MAAS Daily Press Staff Writer

With the first month of 2016 behind us, several new laws have already taken effect in the state of California, and right here in Santa Monica, that will change how we go about our day-to-day lives. And there are more to come. On the state level, starting this year it will be illegal to wear earbuds or headsets in both ears while driving a vehicle or riding a bicycle. Electric skateboard riders must now be 16 years or older, wear helmets and stick to roads with a speed limit of 35 mph or less; it will also be against the law to ride an electric skateboard while under the influence of drugs or alcohol.

California’s emergency alert system, mostly used for Amber Alerts in child-abduction cases, will now also be used to broadcast a “Yellow Alert” to find hit-andrun drivers in incidents that result in death and/or major injuries. A one-year extension will be granted to a pilot project in L.A. County, which hopes to limit drunk driving through the use of ignition interlock devices that test the sobriety of drivers. Drivers are required to blow into the devices in order to start their vehicles; and if their blood-alcohol content exceeds a certain level, their cars won’t start. When Cloe Lane thinks back on her childhood, she has vivid memories of a particular puffy, sugary confection. Whether she was at Santa Monica Pier, Dodger Stadium or Disneyland, she often found herself clamoring for a stick of cotton candy. “It’s always been my favorite treat,” she said. “I was surprised no one had really thought to put a modern spin on how people enjoy it.” That’s where Bon Puf comes in. Lane, a 22year-old Santa Monica native who graduated from Pacifica Christian High School, now runs her own artisanal cotton candy business using natural and organic ingredients. Bon Puf has made slow but steady progress since it launched a few years ago, and it came full circle last month when Lane returned to

her alma mater to discuss her experiences as an entrepreneur and serve her product to current students. Lane turns out flavors like mango with chile salt topping, caramel dusted with sea salt, coconut and watermelon featuring a coconut chip crumble, and vanilla with a crushed candy cane topping. She sells her cotton candy from a cart at public and private events, and she’s working to develop pre-made cotton candy to expand her business in the coming months. It’s all part of an evolving journey for Lane, a daughter of graphic designers who was homeschooled until she enrolled at Pacifica. The idea of a cotton candy business, which she bounced around as a senior at the Santa Monica private school, gained momentum during her gap semester after graduation. She SEE CANDY PAGE 9

SMMUSD Board of Education recommits to policy on board meeting procedures, restructures format The seven-member Santa MonicaMalibu Unified School District Board of Education approved a recommendation at the Jan. 21 regular board meeting to restructure the board meeting format. The new structure will be initiated at the Feb. 4 meeting to be held in Malibu. The board reviewed Board Bylaw 9323 at a special meeting held on Sept. 18, 2015, and the board approval last week signals a recommitment to following this policy with regards to public participation and the objective to end meetings by 10:30 p.m., as recommended in the bylaws. Board meetings will now be labeled as Meeting A, Meeting B or Hybrid. The board will once again review this format in June to determine if it should be continued for the 201617 school year. Signalization gaffes Editor:

The bottom line is that in Santa Monica the current mode of signalization discriminates against, and makes the lives of pedestrians, particularly the elderly, and the handicapped more dangerous and stressful! The Promenade, an ostensibly pedestrian friendly venue, for example, gives more green light time at Arizona for cars than pedestrians, [I] recently had to wait for a whole minute for the walk sign to come on, despite the fact there was only a single car in that time. Similar signalization gaffes occur throughout the city! Fact that the city has ignored the rights of pedestrians for so many years gives lie to any notion that we are a green city! Observed at Stewart and Kansas 10 out of 10 cars failed to stop for the Boulevard stop sign! Stephen Hawking for all his brilliance wouldn’t be able to catch a walk sign at most intersections in Santa Monica because he can’t push a button, same intersections have detected cars for decades, for shame!

Samohi and SMMUSD celebrate student who earned ‘perfect’ scores on Advanced Placement Exams Santa Monica High School and Santa Monica-Malibu Unified School District celebrates student Carlos Bustos for earning perfect scores on his Advanced Placement Exam in spring 2015. Carlos was one of only 55 students in the world to earn every point possible on the AP Spanish Language Exam. Looking across approximately 4.5 million AP Exams taken by 2.5 million U.S. public high school students in 2015, only 322 students earned every point possible on an AP Exam, a rare accomplishment. “I am thrilled with Carlos’ accomplishment!” Samohi principal, Eva Mayoral, said, “Carlos Bustos is the very definition of phenomenal. Throughout the six years I have known him he has never been driven solely by grades; he has earned straight A grades in every of the most rigorous courses we have to offer here at Samohi and John Adams Middle School because he is invested in mastery. This is a proud day, not only for Carlos and his mom, but for our entire Spanish Immersion Pathway. Today we celebrate Carlos’ achievement as a full SMMUSD accomplishment.” Carlos’ AP Spanish language teacher, and Samohi immersion chair, Claudia Bautista said. “I am beaming with pride! Carlos is one of the hardest working, and most eloquent writers I have ever had the pleasure of working with in class. The same year, Carlos helped get 20 scholarships for low-income students who could

not pay for their AP Exams through the AP Pals Club. I can’t wait to see his contribution to our society in the future!” AP Exams are based and reported on a 5-point scale, where 5 is equivalent to a grade of A in the corresponding college course. Carlos received the top score of 5. Scores of 3, 4 or 5 earn college credit. Samohi had 2,984 students last year with 876 students taking a total of 1,783 AP exams in 21 subjects. 75-percent, or 1,330 exams, were passed with a score of 3, 4 or 5. “We congratulate all our students who earned college credit and took on the rigor of AP exams,” Mayoral said. “AP courses and exams are collegelevel, and require hard work and focus on the part of students and their teachers,” Trevor Packer, senior vice president of AP and instruction at the College Board, said. “On behalf of the College Board, we congratulate the students and community members who make challenging coursework and focused practice a priority, and who motivate and encourage all students to capture their academic potential.” The College Board is committed to ensuring that students have access to the opportunities they have earned. Students who succeed in AP are not only more likely to succeed in college, but have the chance to save a significant amount of time and money by earning college credit or placement. Keeping 4th/Pico open GAINING NEW OPEN GREEN SPACE IS A

DEVELOPMENT ISSUES

major priority for our community. At the corner of 4th/Pico Bl., we have a historic opportunity to do just that. Since the 1993 version of the Civic Center Specific Plan (CCSP), the corner of 4th/Pico Bl. has been envisioned to be open, green space, converted from the large surface parking lot there today. Shown as open and green in all subsequent CCSP iterations - and explicitly containing a sports field since the 2005 CCSP discussion of 4th/Pico nevertheless was reopened in 2013, when the City Council appointed and tasked the Civic Working Group (CWG) with drafting a vision for “the future cultural and community use of the Civic Auditorium as the hub of a cultural campus.” Questions in the community immediately arose - “Would there be development recommended at 4th/Pico to partially fund costs to rehabilitate and operate the Civic Auditorium (and an associated cultural campus)? What amount of open space would remain and what uses would it be directed towards? What would happen to the sports field in the 2005 CCSP?” These questions were a running sub-text to the CWG process and are part of Tuesday night’s City Council discussion on the future of the Civic Auditorium. The Council avoided directly confronting these questions in 2013, when its direction to the CWG also included exploring “an appropriate mix of compatible adjacent [to the Civic Auditorium] uses, from open space to additional facilities” - but without making a concurrent Council statement about its commitment to open space square footage and/or the sports field. This left the door open, at least theoretically, for some or most of 4th/Pico to be cannibalized with new development, in order to fund the significant costs to rehabilitate the Civic Auditorium, and to potentially integrate the entire corner into a new cultural campus. That schizophrenia needs to be addressed Tuesday night.

When the City Council approved the 1993 CCSP, most of the land west of Main St. was owned by the RAND corporation. At the time, RAND successfully sought entitlements to redevelop its aging headquarters, and to develop the rest of the land with commercial office space and a mix of market rate and affordable housing. With so much private development under consideration, and only a sliver of green space planned to the north of the proposed new RAND headquarters across from City Hall, it was easy to argue that 4th/Pico needed to be open and green in the CCSP. In 1999, the City purchased approximately 11.3-acres of land owned by RAND, with the goal of providing more public open space and affordable housing within the Civic Center (a historic purchase for which I played an initiating role as a councilmember). Now that the City was in direct control of more development choices within the Civic Center, the thinking included how to more appropriately transition from downtown to Ocean Park. In an extremely positive cooperation by/with RAND, the 1999 purchase led to a revised 2000 CCSP that allowed for the new RAND headquarters to be built on the southern end of the Civic Center at 56-feet high, instead of across from City Hall at 84feet high, leading to the beautiful open space we know today as Tongva Park. Rather than developing 4th/Pico, the thinking was that the housing density (instead of commercial office space) and heights we were going to build along Ocean Avenue, would now be balanced by a substantially increased amount of open space within the Civic Center overall. One thing that did not change from the 1993 to the 2000 CCSP - and is still in the plan today - is the idea of making a major pedestrian linkage from Palisades Park to Ocean Park through the Civic Center, via what is now Tongva Park, ultimately to Ocean Park at 3rd and 4th/Pico. If we are truly serious about making Santa Monica a walkable city, retaining a truly inviting and sizable open-space entrance from Ocean Park into the Civic Center (and ultimately to downtown and points beyond) is critical. By contrast, any major development at 4th/Pico would be a betrayal of the historic land use compromise between various issue constituencies that led to using $53 million of public money to buy the RAND land in the first place; and a de facto bait-and-switch that first allowed Ocean Avenue to be up-zoned and developed, with the promise that 4th/Pico be kept open, and then a “camel’s-nose-under-thetent” breaking of that promise later.

WHAT KIND OF OPEN SPACE?

To be fair, CWG members have not argued for eliminating all open space on the site. But the reality is a large fenced-in sports field is not compatible with an expanded cultural campus that goes much beyond renovation or replacement of the Civic Center’s East Wing. If there is to be an enlarged cultural campus, what would make the most sense is a multi-purpose open (and substantially green) park space at 4th/Pico that functions for events, and serves as an openspace gateway to Ocean Park. If - and that is a big if - the City were to go in that direction, many CWG members expressed the concern that the Civic Auditorium restoration process not be encumbered by the costs of finding new land for a sports field, as it would make that process more expensive and less predictable for an investor/operator. But the field people don’t want to give up their promised field on that side of town, just because someday the City may create playing field space elsewhere, especially since we’ll still have an overall deficit citywide, and a deficit in that part of town.

FIELD OF DREAMS

The answer is not to pit the arts/cultural vs. the sports/open space vs. the slow-growth communities (many of us are in all three!), but to think big picture and find a way to make everything happen. On Tuesday night, City Staff is rightfully suggesting a pause from addressing the entire area considered by the CWG, and is recommending for now issuing a Request for Qualifications/Request for Proposals for SEE 4TH/PICO PAGE 7

auditorium events (when there were events) at night and on weekends. Two Samohi PTA moms, Jaleh Mamita and Ann Hoover, have been making the rounds asking for community support to finally undertake a “regulation-sized” field that can be used by some “1,000 students involved in athletics at Samohi,” such as football, soccer, baseball, softball, lacrosse, track and field and marching band. All need practice space, as Samohi has been critically short of athletic space on or near the main campus for years, they say. They claim a field was promised to the community by the City Council in 2005 as part of the Civic Center Specific Plan. THE CIVIC CENTER IS NOT THE RIGHT PLACE FOR A 2.8-ACRE SPORTS FIELD. HERE ARE THE ISSUES AS I SEE THEM:

■ A regulation sports field would have to be enclosed by a 20-foot high security fence, making the facility out-of-bounds except for sanctioned school or recreation and parks events. Also, one field is not going to serve the needs of all sports as each activity has its own unique and incompatible physical requirements. ■ No revenue would be generated. Current parking would have to be moved underground at a cost of millions of dollars for a subterranean garage large enough to meet the area’s various parking demands. ■ What is the goal for the remaining open area in the Civic Center? Arts, entertainment and culture? Child care? Housing and/or hotels? Expanded athletic facilities? A sports field would pretty much add to the mish-mosh and nullify any other opportunity for the area while serving mostly young athletes. The rest of us will be outside the fence, looking in. And, no tennis courts? According to many postings on Santa Monica’s various politically oriented, social media websites (like Facebook), there’s a growing backlash against Santa Monica College’s (SMC) 110 student, Early Childhood Education Center (ECEC) scheduled to start construction early next year on 1.8 acres of valuable, publicly owned, Civic Center space. The land is worth millions. SMC is paying only a buck a year for the next 55 years plus options for this endeavor which is a part of the college’s child-care curriculum but operated by an outside for-profit. transportation planner with the Planning and Community Development Division previewed the City’s new Pedestrian Action Plan (PAP) in front of about 70 folks at the Wilshire/Montana (Wilmont) Neighborhood Coalition meeting last Tuesday night at the Montana Avenue Branch Library. I mentioned in last week’s “My Write” that I thought it would be a great opportunity to ask tough questions; being that traffic, congestion and parking are the top community concerns and have gotten progressively worse over the years. But, it seems the assembly wasn’t in the mood for hardball, preferring to ask about street lighting, stop signs and crosswalks. I knew Rolandson’s presentation was off to a rocky start when she stated, “We are good social scientists.” I wouldn’t agree with that, however, one thing is for certain, they’re lousy traffic engineers. Rolandson’s view of her roll in the City bureaucracy cuts to the core of the problems as demonstrated by the way the City has, and is, dealing with traffic, parking and transportation issues. For example, there was some mumbo-jumbo about how more pedestrian crosswalks may help those with high blood pressure. Most important for me is feeling and being safe while on foot. I’d like to know that some motorist turning at an intersection isn’t going to cut me off in a crosswalk because he/she can’t see past parked cars down the street. I’d like to walk past subterranean office parking garages and know that some motorist shooting up an access ramp isn’t going to take me out like a pin in a bowling alley. And, I feel much safer (while keeping my blood pressure low) when some bozo on a bicycle doesn’t race by me on a sidewalk. As I’ve written before, most of the negatives of being a pedestrian in Santa Monica have to do with rude, dangerous and illegal behavior by motorists and bicyclists. Without enforcement, this condition will continue and escalate. All the wide sidewalks, lovely planters, distracting medians, slower speed limits, curb extensions and social engineering in the world won’t make a dangerous situation safe, let alone pleasant. A Santa Monica Police Department Motor Officer with a new cite book will do a world of good when it comes to behavior modification. I’d appreciate it if Rolandson and her staff did the job they were hired to do: traffic planning without the social engineering and over-intellectualization. And, adopt a goal of keeping Santa Monica moving, not gridlocking it. Another issue that came up at Wilmont’s monthly meeting concerned the use of a parking lot next to the Civic Auditorium. A number of friends and neighbors are advocating for a 2.8-acre sports field directly across Fourth Street from Santa Monica High School on what is a 1,100 car surface parking lot used by City Hall and the L.A. Courthouse employees on weekdays and for

Apple and outsourcing Dear EarthTalk: Is it true that Apple gets around U.S. labor standards and laws by outsourcing production to China?

APPLE ISN’T THE ONLY TECH GIANT

outsourcing much of its production to Chinese manufacturers nowadays, but the sheer popularity of the California-based company’s products makes it an especially easy target for activists concerned about worker health and safety. China Labor Watch and other groups have exposed inhumane conditions at huge Chinese factories of suppliers like Foxconn and Pegatron that support many U.S.-based tech firms. Workers at these facilities, many who are underage, are often required to work 18-hour shifts and are routinely exposed to toxic chemicals-but still can barely make ends meet. The problem came to a head in 2010 when journalists got word that 14 workers had committed suicide at Foxconn’s massive iPhone-assembly manufacturing facility in China. Another issue dogging Apple’s Chinese partners is worker exposure to toxic chemicals and a higher than average incidence of leukemia among employees. Apple agreed to discontinue using two of the worst offenders, benzene and n-hexane, after the nonprofit groups China Labor Watch and Green America collected upwards of 40,000 signatures from consumers demanding action from the company. But China still allows its manufacturing sector to use several other carcinogenic chemicals long outlawed in the U.S. and Europe. Repeated exposure to these substances is another threat Chinese workers have to contend with when working on the assembly line making smartphones and other tech gadgets. Despite knowledge of the dangerous con-

reuse of the Civic Auditorium only. Market conditions have changed since the last time the City looked in that direction, and there are nearby planning processes that could shed light on an ultimate resolution. Taking advantage of that “pause,” the Council should give direction to City Staff Tuesday night to work with the School District on joint planning between the Santa Monica High School improvement planning process (resulting from Measure BB funds approved by voters in 2006) and the Gateway Area Master Plan (GAMP), in order to site one or more new fields north of Samohi. THE WORLD ACCORDING TO GAMP

The City is looking at comprehensively planning the area between Ocean Avenue and 5th Street, and between Colorado Avenue and covering the I-10 freeway; as well as realigning the 4th Street west bound off-ramp to link directly with Olympic Boulevard and then extending the useable area south of the Expo rail stop at 4th/Colorado with the space gained. That planning process is what is called the GAMP. The school district has stayed out of the crossfire over what should happen at 4th/Pico, but has indicated its willingness to

The assembly line system gives each person a repetitive, simple job that can be taught in an hour. For its part, Apple continues to claim they are investigating the situation and doing everything they can to ensure satisfactory working conditions. In 2010, the company revamped its supplier responsibility standards and threatened it would terminate relations with Chinese manufacturers that refuse to toe the line, and also called for new audits on all of its “final assembly” facilities in China. Two years later, Apple became the first technology company admitted to the Fair Labor Association, a non-profit that conducts independent monitoring and verification to ensure acceptable workplace standards. While this affiliation doesn’t mean Foxconn, Pegatron and other Chinese high tech suppliers are beholden to standards as stringent as U.S. labor laws, activists consider it a step in the right direction and continue to keep an eye on the situation. Of course, whether or not Apple steps up on the issue may depend more on if consumers are willing to forego the company’s products due to worker exploitation issues. And that’s not likely to happen anytime soon, as Americans and others continue to buy iPhones, iPads and Macs as fast as Apple and its Chinese partners can produce them.

work with the City once the City is more clear about its plans there. Now is the time for the two agencies to partner to explore how a new field(s) could be added north of Samohi as part of the GAMP. It makes great sense for a new field(s) to be located next to Samohi and near the Expo light rail stop. In 2003, at the instigation of then Councilmember Herb Katz and myself, the Council asked City Staff to explore the feasibility of a new field over the I-10 freeway, east of 4th Street. As a stand-alone project it was prohibitively expense. Now with the GAMP, new possibilities for covering capital costs exist. Not only could this process help facilitate Samohi’s improvement and possible northward expansion, but if a bond measure to help fund the Civic Auditorium restoration is ever going to pass the voters - passage which would also lessen the need to overdevelop the site to help fund the restoration the sports/open space community must feel its needs weren’t precluded by it, otherwise the blowback will kill the bond. Adding one or more new fields between Samohi and the new Expo light rail station could be a win-win for our community. vaccination laws in the country will take effect. The bill, sponsored by Democratic Sens. Richard Pan of Sacramento and Ben Allen of Santa Monica, will allow only children with serious health problems to opt out of school-mandated vaccinations. Schoolaged children who still remain unvaccinated will need to be home-schooled. One bill will allow female employees to allege pay discrimination based on the wages a company pays to other employees who do markedly similar work. The Reproductive FACT Act, now requires pregnancy clinics to hand out, or plainly post information about where women can acquire low-cost contraceptives, prenatal care and abortions. And the law requiring slow-moving passenger vehicles to pull over carefully to let traffic pass has been revised to apply to all vehicles. ON THE HOME FRONT

ON JAN. 25 AT APPROXIMATELY 2:45 P.M. A man was sitting at a computer desk in the lobby at Step Up on Second (1619 Santa Monica Blvd) and started listening to some music. Shortly afterward, a woman in the lobby started complaining about how loud the music was and told the man to turn the volume down. The man however did not, so the woman became belligerent and walked over to the man to confront him. After some name calling, the woman’s boyfriend, who was also in the lobby, got up and punched the man in the face. At about that same time, the woman grabbed a metal fold-up chair and also struck the man’s face with it. As the man fell to the ground, both the woman and her boyfriend began kicking his head and face repeatedly. When the man tried to protect himself by rolling over onto his stomach, the woman picked up a chair again and struck the back of his head several times. Both suspects then ran out the back door of the location. Two days later, on Jan. 27, a Santa Monica police officer responded to another Step Up facility at the 3400 block of Ocean Park Boulevard to assist the staff there as they placed a woman on a psychiatric hold. When the officer arrived, he realized the woman was the suspect in the assault and noticed her boyfriend was with her. Both suspects were then taken into custody and booked at the Santa Monica jail. Brittany Therlene Washington, 23, of Santa Monica, had bail set at $60,000. Gage Allen Brown, 19, of Santa Monica, had bail set at $30,000.

Let’s be honest, The Most Interesting Man in the World is a beer commercial. But we all know some interesting people. Imagine cramming them all into one room and talking to them. Now imagine doing it on stage. Comedian James Bewely must have done that because his alter ego — aspiring entertainer and podcaster Dale Seever — is bringing some interesting people to the Hammer Museum in West LA for “Deep Night With Dale Seever”. Everyone’s invited and it’s free.

Just like a televised talk show, Bewley will perform a quick monologue, interview the guests and schmooze with the audience. But this will be live and in-person, so expect plenty of craziness.
