President’s Message At this time of transition in MABA, the Board of Directors has voted to take a step forward! You may have heard that the MidWisconsin Builders Association dissolved at the end of 2012. After careful evaluation, MABA has asked the NAHB to acquire some of this territory. Pending approval of NAHB at their summer meeting, MABA’s territory will expand to include Iowa, Sauk, Columbia Abe Degnan Degnan Design and Marquette counties! We know that many companies in this Builders, Inc. area already do business in Dane County, and that the Madison media market dominates these counties. Those of you who are in the Parade or Home Products Show probably recognize that many consumers from those counties come to visit you here! We hope you’ll reach out to the former MidWisconsin members, welcome them to MABA if they are transferring in, and recruit those companies who are not MABA members. You’ve heard by now that MABA is seeking a new executive director. The Board of Directors had delegated the planning process to the Executive Committee, who will bring back recommendations to the Board. We want this process to be productive and as transparent as possible, and so in this message I’ll explain the actions we’ve taken as of my mid-April writing today. The Executive Committee met earlier in April to begin our process. We’ve taken input from people who expressed interest and people we requested to talk to us – both about the process and about the management structure of MABA. If you have input, please get in touch with me or another member of the Executive Committee. Through our network of members and word of mouth, we’ve already collected a lot of resumes. We have decided to start our hiring process by reviewing these resumes to see if the right candidates have already approached us — people who are already known to our membership network. Hopefully this avoids a long, costly, time-consuming search. If that works out, then by the time of publication, we hope that we may have narrowed down resumes and even possibly conducted some interviews. If we don’t believe we’ve found the right candidate through this process, we’ll re-group and decide upon an alternate course of action. Our loose goal at this point is to hire a new Executive Director within about 60 days, that is about the time of the Parade of Homes™ so that she or he can experience that event, which is a huge part of our year. There are three other staffing things that members will want to know. On April 1st, Sandi Kegebein started as our new Member Services Director. Sandi comes from Gerhard’s First Supply and also has a background in media and graphic design. We welcome her! Another well-known face you’ll see around the office is Chuck Elliott. While Chuck has volunteered several weeks, part-time in March and April, we have asked Chuck to provide some additional paid consulting focused on the Parade of Homes™. You probably know that Chuck is a long-time Parade builder as well as a former Parade chair, so he’s well qualified to help Andrew and Sandi with this event. We thank Chuck for his volunteer time as well as for being willing to step up and spend more time to make this happen. Finally, Alise Wasserburger is occasionally consulting to assist in Sandi’s training. In this time of transition, please stay engaged and stay active to help keep MABA and our businesses strong!

Madison area lakes are the emerald jewels of our region’s quality of life. A key challenge to protecting and enhancing our lakes is better management of stormwater runoff. Runoff causes soil erosion and can contain contaminants that are harmful to waterways. The building community can play an important role in improving our lakes by implementing best practices in erosion control, landscape conservation and storm water management. While builders must comply with the erosion control plan required for building permits by the local municipality, the Green Built Home Checklist provides many more strategies to reduce or avoid runoff from construction sites. For example: • Use of redundant straw bale and silt fencing in areas with steep slopes (greater than 12% grade) or areas of concentrated runoff flow. • Protect on-site storm sewer inlets with straw bales, silt fencing or equivalent measures. • Trees and natural features on site protected during construction. • Chip and reuse site-cleared wood and brush as mulch. • Wash out concrete trucks in slab or pavement sub-base areas. • Balance cut and fill to eliminate earth removal from site. • Replant or donate live trees from the site. • Site disturbance limited to within 20 feet of structures and paved areas. • Permeable materials such as brick pavers, flagstones, porous paving or limestone fines for at least 40% of all walkways, patios and driveways. • Grass that uses less water such as blue gamma, fescue or ‘no-mow’ minimum 75% of turf areas. • Use native landscape plantings for non-paved areas • Rainwater recovery from roof for watering, minimum 50 gallon storage capacity. • Provide infiltration system for rooftop runoff (e.g. rain gardens, drain tile, bioswales, ponds, etc.). • Edible landscape planting/plan for food garden. • Provide a list of native, non-invasive plants to homeowners. • Limit turf grass other than ‘no mow’ mixes or prairies in landscaped area. • Provide information to homeowners on how to minimize fertilizer and pesticide use. • Installed irrigation system includes a soil moisture or rain sensor or is a drip type system. • Restore damaged ecosystem such as existing prairies or wetlands. TURNING LEAD INTO GOLD Responding to concerns from NAHB about the Environmental Protection Agency’s Lead: Renovation, Repair and Painting Rule (RRP) that is needlessly costing remodelers and home buyers money without contributing to safety, Sen. James Inhofe (R-Okla.) on March 6 introduced legislation to make this rule much more reasonable and cost-effective. “I am pleased to reintroduce this important bill that reduces the regulatory burdens placed on home builders and remodelers by the EPA,” said Inhofe, who unveiled similar legislation in the previous Congress. “It is important that we take appropriate actions to protect vulnerable populations from the harmful effects of lead exposure, but it is imperative that these regulations are not unnecessarily burdensome and costly.” The bill has already gained several co-sponsors.

Reinstating the opt-out provision would save more that $500 million in compliance costs during the first year and $336 million annually thereafter.

Since the EPA instituted the rule on April 22, 2010, NAHB has led the charge in Congress and with regulators to seek sensible regulation of lead paint abatement and to keep it from needlessly costing home builders and remodelers time, money and customers. The rule requires renovation work that disturbs more than six square feet in a home built before 1978 to follow costly lead-safe work practices supervised by an EPAcertified renovator and performed by an EPA-certified renovation firm. Any company doing work in these homes must also keep detailed records. In 2010, the EPA removed an “opt-out” provision in the RRP rule that allowed remodelers working in a home built prior to 1978 to forego more expensive work practices according to the owner’s wish if no children under the age of six or pregnant women live there. By removing the optout provision, the EPA more than doubled the number of homes subject to the RRP and added millions of dollars in compliance costs nationwide without making young children any safer.

Just reinstating the opt-out provision — as NAHB advocates and the legislation stipulates — would save more than $500 million in compliance costs during the first year and $336 million annually thereafter. “S. 484 will not only make the EPA’s lead paint rule more workable, but it will continue to protect pregnant women and small children against lead hazards,” said NAHB Remodelers Chairman Bill Shaw, GMR, GMB, CGP, a remodeler from Houston. “We thank Sen. Inhofe and the other co-sponsors for supporting these common-sense improvements.” In addition to restoring the opt-out provision, the Lead Exposure Reductions Amendments Act of 2013 would: • Suspend the RRP rule if EPA does not approve a commercially available test kit for lead paint that meets the regulation’s requirements. • Reduce fines for remodelers if they correct paperwork errors found during an inspection. • Prohibit EPA from expanding the RRP rule to commercial and public buildings until at least one year after the agency conducts a study demonstrating the need for such an action. • Eliminate the “hands on” recertification training requirements that force some remodelers to travel long distances to training facilities to receive proper recertification. • Clarify the definition of “abatement” to specifically exclude remodeling and renovation activities. • Provide an exemption to the rule for emergency renovations. NAHB is calling on its members to contact their senators and urge them to co-sponsor the Inhofe bill. Consumers that haven’t already claimed the maximum allowed $500 in tax credits for certain energy efficiency improvements can still do so with their 2012 and 2013 federal tax returns. SPRING ELECTION RECAP Wisconsin’s annual nonpartisan spring elections were held on Tuesday, April 2, where local government bodies such as city councils, mayors and judges were all on the ballot. Four MABA supported candidates were victorious – Fitchburg Mayor Shawn Pfaff, Madison City Council members Paul Skidmore and Larry Palm, and Supreme Court Justice Pat Roggensack. Four other MABA-supported candidates ran positive, spirited campaigns but came up short in several closely-contested races around the county. In a new outreach effort, many MABA members spent time to hand-deliver campaign checks and endorsement letters to preferred candidates thereby personalizing the relationship the association has with local policymakers. A few bright spots on election day for MABA candidates were Pat Roggensack’s re-election to the State’s top court, where 2013 promises to be an active year with the court scheduled to rule on many controversial cases. Additionally, Shawn Pfaff, a friend of the building industry, was re-elected with a resounding 71% of the vote. With 2013 being an “off year” as far as state and federal elections, the next election on the docket will be the 2014 spring election.

1. Received a report from the Executive Committee that the Committee will begin evaluating resumes that it is has received for the vacant Executive Director position. After the candidates have been narrowed, the Committee will bring forward its recommendations to the full Board of Directors. 2. Directors continued to discuss the importance of identifying and mentoring fellow members with leadership skills and encouraging them to pursue further involvement with the Association. Approved 6 new Associate membership applications. 4. Approved a Government Affairs Committee proposal to reform CARPC by state law by forwarding the proposal to the WBA in order for it to be drafted into statutory language. 7. Directors noted that NAHB Board of Directors will take action at its June Board meeting on MABA’s request to increase its jurisdiction by adding four counties: Columbia, Iowa, Marquette and Sauk. 8. Approved the Public Relations Committee to request to utilize unsold garage spaces at the Parade of Homes™ to MABA’s community service partners and to allocate up to $1,000 to the Committee to create its own display of MABA’s community service.
