Sale of inherited lake house can be forced

EAR EDITH: Six siblings inherited a lake house in 1986. It has been enjoyed by all families for years. However, now there is a need for extensive improvements. No one wants to put the money into it, but no one wants EDITH to see it go for taxes. LANK Four of the six want to sell the house and get their inheritance. One wants to buy it and give everyone her share; she would do all improvements and then allow it to be used by the others for vacations. But one sibling won’t agree to sell his share. He verbally agreed to sell last September. Now he says he never said that. Do you know what the options would be? Have you ever seen a situation where one sibling could be forced to sell? Everyone wants to see this resolved, and soon, as this has been going on for a couple of years. — X. ANSWER: When it comes to the sale of real estate, verbal agreements are not enforceable. Any co-owner of real property has the right to go to court and request a forced sale. One lawyer told me, “It’s like foreclosing on yourself.” The property is sold at an all-cash public auction, which is not likely to yield full value. Doing that won’t do much for family harmony. In any event, it’s time to consult a lawyer. Perhaps a letter from a lawyer mentioning the possibility would persuade your holdout to reconsider. Or, in the interest of a more peaceful solution, you might contact a professional mediator.

Timeshare Again

MS. LANK: In 1985, my wife and I were wooed by an Orlando timeshare developer. He said his company was opening its latest timeshare only 15 minutes from the new Disney World. It would be a sure moneymaker; it could be easily rented and sold; and the company was opening a resale department. Years later, my wife and I divorced. We shared the timeshare costs and vacation weeks. This worked reasonably well until now. We are getting up in age and don’t travel anymore, and the costs are getting more difficult to pay each year. Plus, thinking ahead, we don’t want this millstone to pass to our children. (We have asked, and neither of them want it). I see units offered for $1 on eBay and Craigslist, and even those aren’t moving.

I asked whether I could just deed it back to the developer and was told, “We’ll get back to you” (they haven’t). Online I found a place to take it, but they want approximately $4,000 upfront. What is your advice? If we just stop paying, I suspect that will lead to a lawsuit. If we do nothing, this obligation will pass down to our children, a continued expense to them. There must be some escape here. Do we add “timeshares” to “death and taxes”? — R. W. ANSWER: First off, your heirs have the right to refuse an inheritance. Every state has its own paperwork for the process. I’m not sure what would become of the timeshare in that event, but for what it’s worth, they would have that right. A timeshare should be bought for enjoyment, which you had, not as an investment. If you live in a different state, consult your lawyer about what’s likely to happen if you were to just stop paying the costs. If you live in Florida, talk with your lawyer anyhow. You may want to take a look at the Timeshare Users Group website to see whether it has any advice.

DEAR MS. LANK: I thought it unfortunate that a reader’s “last word” on the subject of secondhand smoke was a suggestion that the dwellers simply change apartments with the first-floor smokers. Any nonsmoker knows that the smokers’ apartment will be deeply saturated with the odor. Floors, walls, cabinets — everything! Friends of ours bought a house a couple years ago from longtime smokers, and after intense remediation the smell remained, albeit greatly reduced, for a good two years. — M. B. But I do not agree with you and the reader who suggested that the dwellers swap condos. You called it the “simplest solution yet,” but it wouldn’t work. What do I need to know about contractor liens? ‌I f you intend to hire a contractor for repairs or home improvements, it’s important to brush up on the lesser-known contract option known as a contractor lien waiver. Liens are a powerful tool contractors can use to enforce their debts. While no contractor wants to resort to using a lien, sometimes they’re a necPAUL essary outcome. Contractors F. P. have an interest in your home POGUE until they’re paid – especially suppliers and subcontractors. Since they can’t repossess bricks or other products once they’ve been installed, they need this legal avenue to recover their investment if they’re not paid. Though particulars vary by state, mechanics’ liens give a supplier, subcontractor or contractor a partial legal claim to the property for unpaid work or materials. A lien can wreak havoc on a project by tying up bank loans, clouding title ownership and scaring away potential contractors — it can even force the property’s sale. A lien may seem the most unfair when you’ve already paid the general contractor, but the contractor failed to pay suppliers or subcontractors. Those additional sources can file a lien on your home, and in that case, you may have to pay twice to clear it. In that event, you have standing to sue the general contractor, but the process will likely be long and difficult. Fortunately, you can take steps ahead of time to protect yourself.

HOW TO AVOID LIENS

The most important tool available to you is a subcontractor/supplier lien waiver, sometimes known as a lien release. This document is an important step for larger projects that involve working relationships with contractors, subcontractors, material providers, equipment lessors and anyone else involved. Any reliable general contractor will have no problem offering these documents. To get a lien release and avoid unexpected fees, homeowners should first ensure that they’re working with contractors who are licensed, bonded and insured. Consider always including a lien waiver or subcontractor lien waiver clause in your project’s contract. Make sure to include the names of subcontractors and suppliers in your contract as well. Stay in touch with them and make sure they’re paid on time. With a lien waiver, when the project is successfully completed, both parties sign

Repair toilets yourself to save water, money D

EAR JAMES: We have three toilets in our house, and each one seems to have a different problem. It costs a fortune to hire a plumber, so I want to try to fix them myself. What are the most common toilet problems? — TRACY L. DEAR TRACY: Experienced plumbers are highly skilled and generally worth the high fees they charge, but many toilet JAMES problems can be repaired DULLEY by the typical homeowner. Most toilet repair parts and kits include detailed instructions. You will just need some tools and some free time. It helps to understand how a toilet works before you attempt to diagnose problems. Toilets flush by a suction created when the water from the tank runs down inside the base of the toilet. Only a small portion of the water used actually goes into the bowl. This water is used to wash down the sides of the bowl and fill it for the next flush. When someone pushes the flush handle, a flush jet at the bottom of the bowl fills the water passage so the suction is connected to the bowl. Simultaneously, water comes out of the many holes under the rim and flows down the sides of the bowl. The most common problem is a toilet that does not flush well and sometimes requires double flushing. This wastes water and time. This can be caused by a partial clog in the drain line. Run a hand auger down through the drain in the bottom of the bowl to clear any clogs. It may be difficult to get it started, but you will eventually get it in there. If this does not solve the problem, the flush jet may be clogged. If this happens, the toilet will seem to flush properly. Because the suction force is not getting connected to the bowl, the wastes will not be sucked out. The flush jet on most toilets — but not all of them — can be seen at the bottom of the bowl. Inspect it carefully. You may find it is closed or nearly closed from hard water deposits. These can be scraped away so the jet is open. Pour some white vinegar in the

empty bowl and let it stand until any remaining hard water deposits are dissolved. Also pour some white vinegar down the overflow tube inside the tank. This will dissolve any deposits that are up in the passages inside the toilet. Another common problem is a noisy toilet that whistles just before the tank is totally full. This happens most often on old toilets with an old ballcock valve design. As the valve is just beginning to shut off the water, it will whistle through the valve. Replace the valve with a newer design that quickly goes from full flow to totally off when the tank is full. Self-flushing can be annoying at night and also wastes water. The most common cause of this is a leaky flapper valve in the bottom of the toilet tank. Water slowly leaks out down the back of the toilet. Once the tank level drops enough, the ballcock valve opens to fill the tank again. Although it does not actually flush, it sounds as if it has. Install a new flapper valve to stop the leak. UESTION: I have been thinking about putting in a rain garden. Do you have any advice on building one? What kind of plants can be planted in the flooded soil? ANSWER: A rain garden is similar to other perennial flower beds you might build: It just holds water for JEFF longer. Rather than build a RUGG raised flower bed by adding organic matter to get better drainage, a rain garden is a flower bed built slightly lower so that water accumulates. Rain gardens provide several benefits to your landscape. These gardens trap water, which will slowly soak into the soil. This helps your landscape because more water is available for a longer period of time, deeper underground. The water your

plants don’t use will eventually reach the groundwater that, in many communities, supplies the wells that are slowly going dry. Any water that doesn’t immediately wash into the storm drains reduces the amount of local flooding and shoreline erosion in retention ponds and rivers. In the long run, the water that has soaked into the ground also helps to keep an adequate flow of water in streams during droughts. Shorelines, marshes, bogs, wetlands and swamps all have plants that tolerate or require water over its roots and will grow in a rain garden. full sun, but there are also many that will grow in shade. Choose rain garden plants that are the right height for your landscape. There are a variety of bloom times, color choices and flower fragrances. Shoreline plants in nurseries may be labeled as “marginal plants.” A marginal is a plant growing on the margin between two habitats, such as pond and woodland habitats. Other shoreline plants may be labeled as “emergent plants.” An emergent plant has underwater roots, and it emerges above the water with the stems and leaves, such as a cattail. Moist prairie, mesic plants grow well in wet soil, so they will also work in a rain garden. Just like in the rest of the garden, some shoreline, day and in the Sioux City Journal, marginal, emergent mesic plants are annuals, and some are perennials. Like any perennial flower bed, the plants will need to be watered if it doesn’t rain after they are planted. Once established, they won’t need to be watered very often. These hardy plants require less care and fertilizer than a lawn. As the plants bloom, they attract birds and butterflies. The construction is easy. Measure the area the water will be coming from. If the water is coming from the roof gutters, measure how many square feet of roof area there is. If the rain garden is receiving water from a large, sloped, grassy area, measure the square footage of the lawn. The rain garden should be about one-third as big as the area that supplies the water. Pick a low flat area in full sun that is not over a septic system and at least 10 feet from the house. Dig a level-bottomed hole from 2 to 6 inches deep, with sides that slope down to the flat bottom. A deeper water garden will hold more water for longer. Channel the water to the rain garden with a downspout, polyvinyl chloride pipe or shallow trench. Depending on the lay of the land, it may be necessary to build rain gardens in both the front yard and back. In heavy rains, the rain garden may overflow, so make sure the water drains away from the house. Mosquitoes should not be a problem, as the rain garden is not supposed to have visible water left standing in it for more than a few hours. Even if it rains every day or two, there should not be standing water long enough for mosquitoes to become adults. Victorian side chair serves as family treasure ‌Q

UESTION: I inherited the upholstered chair seen in this photo from my parents years ago. It is in perfect condition and has the original finish. I would like to know who the maker was, it’s vintage and value. ANSWER: You have a factory-made Victorian balloon back side ANNE chair. The balloon-shaped MCCOLLAM back forms an unbroken continuous circle with a medallion in the center. The flared upholstered seat with a serpentine-front form and turned legs are typical of mid-Victorian design. It can be impossible to identify the manufacturer. Many similar chairs were made of walnut or rosewood. These were usually sold as pairs or part of a parlor set. Your chair was made between 1850 and 1870. Its value might be $275 to $375. Q: This mark is on the bottom of a porcelain container I have. It stands about 9 inches tall and is 7 inches in diameter. It is decorated with pastel roses, and it has gold handles and no lid. It was my mother’s, and I have no information about its history. It always sat in her china cupboard in the dining room. Also, marked on the bottom is a circle with the words: “M. Redon—Limoges.” The pot is a family treasure, and I

would never part with it but would like to know more about it for insurance purposes. Can you tell me anything about when it was made, the maker and if it is worth anything? A: You have a hand-painted cachepot that was made by Martial Redon Porcelain Co. The firm began as Gibus & Redon in Limoges, France, in 1850. In 1882, Redon took over the business. In 1890, he died; his son continued to operate the factory until 1896. The company produced white ware, tableware, decorative ware and art objects. Pieces that were double marked were decorated by their design artists. Cachepot is a French word for a planter that has no opening for drainage and is intended to be used indoors. I would never recommend using it as a planter. Your cachepot was made in the late 1800s and would probably be worth $150 to $250. One was offered for sale on the internet at $399, plus shipping. Let there be light

ighting often plays a critical role in enhancing spaces and molding moods, whether the environment is one for relaxation, sleep or work. From decorative to ambient and task lighting, many homeowners may ask: Does my home have enough light? A CATHY general rule of thumb is to try to HOBBS use as much natural light as you can, whether it means adding windows or doors to a room, or making solid surfaces more transparent. Here are other nuances and lighting rules to follow to keep your space properly illuminated. 1. Decide what mood you wish to create and illuminate a room accordingly. In spaces such as bedrooms, a table lamp or a simple reading lamp may suffice. 2. Create multiple light sources in larger spaces. A large space may require a table lamp, floor lamp and a ceiling pendant. 3. Use task lighting, especially in areas such as kitchens. 4. Consider placing some of your light fixtures on dimmers. This will allow you to moderate light levels depending on the time of day. 5. Purchase fixtures that require multiple bulbs. Choosing a fixture that requires two, three or perhaps more bulbs will automatically increase the output. 6. Purchase high wattage bulbs. Not all fixtures will allow it, but when possible choose bulbs in which the output is 75 or 100 wattage. 7. Don’t overdo it. Avoid a space cluttered with too many floor or table lamps. 8. When possible, add recessed lighting. This is always easier when building or renovating a home, but it can go a long way in creating a space that is evenly lit. 9. Opt for energy-efficient bulbs. 10. Try to illuminate hallways, pathways and stairwells with sufficient light for safety. Is your decorating depressing you? ‌F

rom time to time, at a cocktail party or when visiting a friend, someone will corner me and confess to me that they are depressed. As if I were a member of the clergy, they whisper in sotto voce that they believe their decorating is making them JOSEPH sick. I sometimes want PUBILLONES to chuckle, but as I listen closer, they tell me that their interiors are not to their liking because of the choices made by their spouse or designer or their own misguided attempts at decorating. Is it possible for their environment to make them feel sick? As I think about it more and more, yes, it is possible for design to alter moods. In the mid-1950s, Norbett Mintz, a researcher at Brandeis University, and his mentor, the renowned psychologist Abraham Maslow, decided to conduct research about the effects of “beauty” on behavior. Mintz had already conducted experiments about the effects of color on human behavior and concluded that color selection has a palpable effect on personal behavior. In their experiment about beauty, they designed three rooms. The first was the ugly room, replete with clashing colors and patterns, disorganization and too much furniture for the size of the space. The second was the average room, arranged with a monochromatic scheme, basic furniture pieces and subtly colored nondescript art. The third was the beautiful room, decorated with quality casegoods and fashionable fabrics and colors. Overwhelmingly, the test group rejected the ugly room. The average room and the beautiful room were tied as the preferred room. When asked to describe the rooms, the test group was best able to describe the beautiful room. As a designer, this is not news to me. There are rooms, especially those that I like, that I can describe with remarkable detail. Although our notion of beauty itself cannot be quantified because what is beautiful varies from person to person, it can be said that beautiful design is more memorable. In that instance, we can deduce that each person prefers the beautiful. From the time we are born, there are foods that are preferred — some love sweets, and others prefer more savory flavors. Over time, our taste buds evolve, and what was once a favorite food can come to nauseate you. The same stands

true for interior design. Over time, everyone develops preferences in what we eat, how we dress and what makes us feel comfortable and at home. When I hear that someone’s home is making them depressed, I am most concerned, because home should be a place of comfort and respite from the world’s

chaos. I usually suggest they take action immediately and change what bothers them the most. A feeling of discomfort at home for a prolonged time can have health consequences. If it is a wall color, well, a painting party is overdue. If what bothers them is furniture, I ask them to consider slipcovers or new upholstery.
