was reminded the other day of the saying “the cobbler’s children have no shoesâ€?. I was both the cobbler and the shoeless child.

I immediately booked another appointment with the client so he could show me their binding capabilities and I could catch up with the latest industry offerings. Stand up and take it Accountability is the bottom line

A

ge is a double-edged sword. For PH WKH DGGHG years bring wisdom that comes from experience. That experience comes mostly from doing something erroneously and then learning from that. Wisdom comes through the school of knocks. Possibly one of the most important things that I’ve become aware of is accountability and my need to step into it.

For me, being accountable means that I take ownership of the things that I say and do, both good and bad. It’s easy to shoulder the winning decisions and actions, but it can be embarrassing to take the weight of those that are poor and result in a bad case of regret. Accountability seeps into every part of our lives and there is little that is

untouched by it. How often have you experienced people avoiding being accountable in your work environment? There is always someone who ducks and GLYHV WKH ´DYRLG WDNLQJ UHVSRQVLELOLW\ DW all costsâ€? individual that just won’t step up. How do you feel about them? Do you trust or respect them? Think about your feelings toward that person the next time you duck and dive. If you don’t trust or respect someone who lives their lives without accountability, how will people feel about you when you do the same? The peculiar thing is that we like people who take responsibility for what they say and do. We feel like we could hit the trenches with them. It’s natural. They won’t leave you standing when the music stops, will they? You’ve also met the person that stands up and admits that they made the wrong call and takes the resulting heat. The one that comes into the meeting late and doesn’t make excuses – they simply apologise and get on with it. Being accountable involves a couple of simple steps that you can follow at

any time. Let’s say you promised to do VRPHWKLQJ VXFK DV VHQG DQ H PDLO WR people on a project team, and you didn’t. Here are the steps to take: • What did I say I would do? • Did I do it? • What did I choose to do instead? • What impact did this have on me? • What impact did this have on those I made the promise to? • What can I do to remind myself not to do that again? You will be astounded at the response from people if you do this out loud in front of them. Pick the right time and place to try it out though, otherwise you may have people staring at you as if you have lost your mind. , KDYH EHQHÀ WHG DV KDYH WKRVH DURXQG me, from my steps towards taking accountability in all aspects of my life. If I GR ZURQJ WKHQ HLJKW WLPHV RXW RI \RX will hear me stand up and be accountable for it. Why? Because that’s a way of showing respect for myself, and for you.

W

hat can be learnt from Barry Roux and Gerrie 1HO WKH WZR advocates battling it out in the murder trial of Oscar Pistorius?

You could be forgiven for wondering why these often hostile and confrontational men are people to be admired. They challenge everything said by witnesses, are aggressive to anyone that challenges them, and their behaviour borders on downright rudeness. , ZLOO EH WKH À UVW WR VXSSRUW WKH DUJXPHQW WKDW \RX DOZD\V JHW PRUH FR RSHUDWLRQ E\ charming people and being nice to them. What I truly admire about both of these advocates is the fact that they have done their job of representing their clients in an impeccable manner. They have fought tirelessly for their cause, using every available tool in their toolbox, WR SUHVHQW D FDVH WR WKH MXGJH WKDW ZLOO À QG the accused guilty or innocent. They have HYHQ JRQH WR ULGLFXORXV OHQJWKV WR GR WKLV for example, Roux suggested that dogs can sound like cats when stressed. As I watch snippets of the trial, and read what others have written, it strikes me that , ZRXOG ORYH WR KDYH HLWKHU *HUULH 1HO RU

There are, naturally, a few exceptions. 2QH RI P\ IDYRXULWH SHRSOH LV :D\QH 'XYHQDJH SDVW &(2 RI $YLV 6$ ,¡YH QHYHU met him, nor have I spoken to him, but , NQRZ WKDW KH Ă€ JKWV IRU WKH JRRG RI KLV fellow citizens, because he is the driving IRUFH EHKLQG WKH 2SSRVLWLRQ WR 8UEDQ 7ROOLQJ $OOLDQFH 287$ +H KDV IRXJKW fearlessly and ceaselessly to get the government to change their policy on tolling Johannesburg’s roads. , KDYH QHYHU VHHQ DQ\ RI WKH &(2V RI EDQNV RU LQVXUDQFH FRPSDQLHV Ă€ JKWLQJ against FICA, which inconveniences millions of customers every year. I didn’t hear one executive from any mobile phone company Ă€ JKWLQJ WKH JRYHUQPHQW DJDLQVW 5,&$ another inconvenience. No manager from the petrol companies has fought tirelessly to get the government to reduce the tax burden on every litre of fuel. None of the &(2V DQG H[HFXWLYHV RI WKH PDMRULW\ RI P\ suppliers – medical aid, airlines, retailers, ,7 Ă€ UPV PRWRU FDU UHWDLOHUV SXEOLVKHUV entertainment companies, construction companies, event planners and conference YHQXHV DUH Ă€ JKWLQJ LQ P\ FRUQHU DQG

But I can also tell you without hesitation that whenever I have had one of those rare great experiences, it has always been by underpaid front line staff or small business owners who have gone out of their way to make me feel good about my purchases and support. These include a receptionist from *DOODJKHU (VWDWH &RQIHUHQFH &HQWUH ZKR upon discovering that I split my pants from front to back ten minutes before a presentation, managed to sew them back together so that nobody noticed. 2U WKH ZDLWHU DW WKH 6KDQJUL /D +RWHO LQ Kuala Lumpur who, after asking his boss’ permission, walked me to the optometrist’s shop because I had broken my glasses and he was worried that I wouldn’t be able to Ă€ QG P\ ZD\ 2U WKH KRWHO UHFHSWLRQLVW IURP the Crystal Towers Hotel in Cape Town who JRW LQWR KHU FDU DW SP RQH QLJKW WR FRPH and fetch me from the local garage because I had become hopelessly lost. We all occasionally have people in our lives that help us when we need it most. I salute you, Mr Nel and Mr Roux, and while I hope that I will never need your services, I admire you for your utter devotion to your clients.

Inadequate arbitration

Arbitrators can have their decisions set aside should a judge find cause for misconduct

A

rbitrator misconduct occurs in many different IRUPV including: bias; interrogation of witnesses; failure to keep records; ignoring evidence; refusal to allow a party the right to question witnesses or bring evidence; failure to apply the mind; misconstruing of evidence; overstepping authority; and failure to consider statutory provisions.

Bias In the case of Mutual and Federal Insurance Company versus CCMA and RWKHUV %//5 /& WKH court held that proof of actual bias was not necessary. The applicant for the review only needed to prove that the arbitrator’s conduct indeed gave rise to a reasonable suspicion or perception of bias. It is important to note that it would not be enough for a party to have believed there was bias. They will have to prove that the actions of the arbitrator would have given any reasonable person a clear impression of bias. For example, in the case of Best Boland Motors versus Dispute Resolution Centre and others (Contemporary Labour Law 9RO 1R SDJH WKH /DERXU Appeal court found that the conduct of the arbitrator suggested bias. In that case the arbitrator and the applicant employee left WKH SURFHHGLQJV IRU WR PLQXWHV ERWK before and after the arbitration hearing and entered into discussions between

themselves. As they had no acceptable reason for this the court found that the arbitrator’s conduct led the respondent to a reasonable apprehension of bias. Bias can show itself in other ways too. For example, the arbitrator might assist RQH SDUW\ DQG QRW WKH RWKHU DJJUHVVLYHO\ interrogate witnesses rather than ask TXHVWLRQV IRU FODULW\ RU LJQRUH PDWHULDO evidence. Aggressive interrogation In County Fair Foods versus Theron 12 DQG RWKHUV %//5 /& the court found the aggressive manner in ZKLFK WKH DUELWUDWRU TXHVWLRQHG ZLWQHVVHV to be unacceptable and therefore set the arbitrator’s decision aside. Failure to keep a record ,Q 8(( 'DQWH[ ([SORVLYHV YHUVXV 0DVHNR DQG RWKHUV %//5 /& WKH FRXUW JUDQWHG D UHYLHZ EHFDXVH the arbitrator had failed to provide a record of the arbitration proceedings. Ignoring of evidence An arbitrator cannot make a fair decision if they fail to take into account all of the material evidence placed before them. In the case of Sasko versus %XWKHOH]L DQG RWKHUV %//5 /& WKH DUELWUDWRU IDLOHG WR WDNH into account that the applicant employee had refused a promotion to a post in another town. Therefore, in arriving at the decision that the employer had unfairly failed to promote the employee, the arbitrator had not taken into account material evidence. The Labour Court found this to be a breach of the arbitrator’s duty and set the decision aside.

Misconstruing evidence In the case of Crown Chickens versus .DSS DQG RWKHUV %//5 /$& the arbitrator found that an employee had not used a racial slur to refer to a colleague. However, the Labour Appeal Court found that the arbitrator had, without good reason, rejected the evidence of two witnesses whose evidence indicated that the employee had used a racial slur. The court found that this, and the commissioner’s failure to construe the probabilities of the case correctly, amounted to a gross irregularity. The court therefore overturned the decision of the arbitrator, found the employee’s dismissal to have been fair, and ordered the employee to pay the employer’s legal costs. Failure to consider statutory provisions ,Q 0ODED YHUVXV 0DVRQLWH $IULFD DQG RWKHUV %//5 /& WKH arbitrator’s award was set aside because they had failed to consider the provisions RI WKH %DVLF &RQGLWLRQV RI (PSOR\PHQW $FW in arriving at the award. Thus there are numerous reasons for legitimately overturning the award or ruling of an arbitrator. Parties therefore need not give up if they truly believe that, based on WKH IDFWV WKH\ ZHUH VKRUW FKDQJHG GXH WR irregular conduct on the arbitrator’s behalf. However, even if the aggrieved party has evidence of arbitrator misconduct, it is GLIÀ FXOW WR SHUVXDGH D FRXUW MXGJH WKDW WKLV evidence amounts to solid proof meriting the overturning of the award.
