Do You Use ADP for Payroll? Important Update!

It has come to the FDA's attention that ADP is telling dentists who use their services that a recent change to Florida law requires you to implement several things in your office on sexual harassment, including sexual harassment training.

Phone Call Scam!

The Florida Department of Health (DOH) is issuing an alert to all Florida-licensed medical practitioners about a scam where individuals who claim to be with the Florida Board of Dentistry say the practitioner’s license has been suspended due to drug charges. However, the practitioner is told to call a number not associated with the DOH (804.293.0309).

They’re then offering you a service, for a fee each pay period, that will help you comply with the law. This is false! There is no Florida law that requires private employers to provide sexual harassment training.

While the FDA strongly encourages you to have a sexual harassment policy and provide training to your employees as a best practice, there is no Florida law or rule that mandates it.

Funding Needed for FDA Priorities

During the 2019 Legislative Session, the Florida Dental Association’s (FDA) legislative priority issues wereapproved in HB 843 by Rep. Ana Maria Rodriguez (RDoral), which included policy on the Dental Student Loan Repayment Program and the Donated Dental Services (DDS) program. Both programs are focused on increasing access to dental care and treatment, specifically to those who are not receiving routine dental care.

The Dental Student Loan Repayment Program incentivizes dentists to treat individuals who receive services through the Medicaid program, while the DDS program captures those who make too much to qualify for the Medicaid program, but not enough to purchase private dental insurance.

Dental Therapy Legislation Filed

Legislation has been filed again to create a new dental licensed provider called a dental therapist.

Sen. Jeff Brandes (R-St. Petersburg) has filed SB 152. At this time, no House bill has been filed. The FDA does not support creating a new licensed dental provider. Although similar legislation supporting dental therapy has passed in several states, dental therapists are only licensed and practicing in Minnesota. Alaska has dental health aide therapists (DHAT) practicing in that state; however, the educational standards and requirements are substantially less than the educational requirements in Minnesota. Washington has dental therapists designated to practice in limited health settings for Indian tribal communities, and Oregon has a pilot project for DHATs that has been suspended because DHATs participating in the pilot were practicing outside of their scope, among other deficiencies cited.

A budget analysis during the 2019 Session projected approximately $772,670 of state funds would be needed to implement both programs for the first year and $1.2 million for the second year.

This week, the House and Senate Appropriations Committees met in Tallahassee and received a budget forecasting presentation from the Office of Economic and Demographic Research, outlining scenarios and events that could impact the state’s budget either negatively or positively. This information is what the Legislature will use to prepare the state’s budget for the next fiscal year.

In addition to funding for the Dental Student Loan Repayment Program and the DDS program, the FDA will continue to support state funding for community water fluoridation. The following states have passed a version of dental therapy legislation, but have not implemented the program in their state because there are no Commission on Dental Accreditation (CODA) dental therapy programs approved in any state:  Maine (passed in 2014)  Vermont (passed in 2016)  Arizona (passed in 2018)  Michigan (passed in 2018)  Idaho (passed in 2019)  New Mexico (passed in 2019)  Nevada (passed in 2019)  Connecticut (passed in 2019)

Florida does not need to add a new licensed provider to the dental workforce. With more than 14,000 dentists licensed in Florida, the focus should be on incentivizing and encouraging dentists to practice in rural and underserved areas around the state. The Legislative Contact Dentist (LCD) network represents a strong political force behind organized dentistry. It is comprised of Florida Dental Association (FDA) member dentists who are actively involved in building and strengthening their relationships with state legislators and other policy-makers. The LCD program's goal is for dentists to deliver a unified message to legislators on the dental profession’s behalf. Constituent dentists best influence the legislative and regulatory branches about issues impacting their professional lives. Organized dentistry’s political success depends directly on the leadership and strength of LCD teams statewide.

Currently, not all legislators in the state have an LCD and we need at least one for each legislator. As Florida's advocate for oral health, the FDA wants to ensure that each legislator is educated on the priorities of the dental profession - and we need your help to do it!
