Lyman took the stand and reiterated that McGrievey should have remitted excise tax in the amount of $200, not the $100 received by the County Treasurer. The defense called its only witness, George S. Donnell, Chief of Census Division, of the Department of the Interior, who was called to testify, “that the paper hereto attached is a statement as nearly correct as can be ascertained from the population schedules of the population according to the census of 1890 of the towns and villages named therein.” The paper thereto attached stated the population of the village of Waterford to be 4,251. The plaintiff thereupon caused a notice of a lien for $100 to be filed with the clerk of the town of Waterford upon the property of the defendant in the premises where he carried on his liquor traffic, assuming to act under section 12, and then commenced this action to foreclose the lien. McGreivey hired Waterford Attorney Thomas O’Connor to represent his interests in this case.

John has complied with this edict by filing with the Saratoga County Treasurer the sum of $100. The amount of the tax assessed upon the business of trafficking in liquors in the village of Waterford, Saratoga county, under class 1, subdivision 1, § 11, of the act, which established the amount for villages with a population between 1,200 and 5,000. This was duly paid, as prescribed, to the Saratoga County Treasurer.

John Crowe McGrievey, in the tavern business since 1872, was an outspoken critic of this 1896 legislation. He was not alone in his criticism, and many tavern owners pledged to resist this tax levy. Lyman has pledged to target the collection of excise taxes on bars and taverns, so conflict was inevitable. McGreivey had become a case in point. But, at the outset, he played along. The law stated that; the sale of Intoxicating Liquor shall be taxed by the population. Laws 1896, c. 112, § 11, assessed excise taxes upon the business of trafficking in liquors, based on population numbers. It further provides that all taxes assessed upon the business of trafficking in liquors, except taxes assessed in counties containing a city of over 1,500,000 people, and on a business conducted on a railroad, steamboat, or other vessels, which taxes were to be collected by and paid to the state excise commissioner or his deputies, shall be paid to the county

The Verdict: The trial court properly excluded the certificate, and properly held that resort could not be had to any other evidence than one or the other census to show the population of the village. The defendant paid the tax that the statute assessed, and no larger sum could be lawfully required of him. The judgment was affirmed, with costs. All concur.

GREENFIELD CENTER — George Lorenz Muller left this earth very peacefully at home and his spirit was brought up to the heavens, just as he wanted, on September 6, 2022. He was 85 yearsGeorgeold. was born in Brooklyn, NY. Later, in 1945 his family moved to Greenfield Center. During his early years, he remembered living with his beloved grandmother Inga (Mormor), whom he thought of as an “Angel of God ” and the “most caring person he knew;” and his caring grandfather, Arthur (Betta). He attended Saratoga City Schools, graduating in 1954. George enlisted in the United States Air Force after graduation, proudly serving for 4 years learning to be a dental hygienist. Upon the honorable completion of his service, he then worked for Norton Star Company in Syracuse, followed by Sullivan-Schein in Saratoga

as a dental equipment repair technician for many years. George enjoyed traveling to many different dental offices and was well known and sought out for his ability to repair dental equipment. He always talked very fondly about his work partners, Al and Lloyd and their workGeorgeadventures.wasan avid flight enthusiast and obtained his pilot license in 1969. He loved to go to the airport, especially with his children and grandchildren to watch planes take off and land. He thoroughly enjoyed his job repairing dental equipment. George’s main avocation, especially during his retirement, was to answer the call of his children to come and fix (anything). He always displayed sheer determination and a laser focus to solve whatever mechanical problem was presented to him.

Amsterdam, pleaded guilty in Saratoga County Court to attempted assault in the first-degree, a felony, in connection with a Dec. 5, 2021 shooting on Jersey Hill Road in the town of Galway. Morsellino admitted to being an accomplice with codefendant Michael Kennedy in an attempted assault of a homeowner/ victim following an early morning dispute, according to Saratoga County District Attorney Karen Heggen. Sentencing on Dec. 2 when it is anticipated Morsellino will be sentenced to 6-1/2 years in state prison, Heggen added.

The city of Saratoga Springs, New York has begun the process of identifying and naming an outstanding poet as its inaugural Poet Laureate. This honorary designation will celebrate a local poet who can engage new audiences, create new opportunities for poetry to be shared, and encourage the creation of poetry and other literary works. The Poet Laureate will serve a term beginning Jan. 1, 2023.

Customer Assistance Customers having difficulty with affording their energy bills are encouraged to contact National Grid as soon as possible. There are several assistance programs for income-eligible customers. These are some of them:

For electricity, National Grid’s winter bill forecast shows that eastern New York residential cus tomers will pay about $116 or 22% more compared to last sea son. Higher wholesale electricity prices are contributing to $105 of the increase, with the remaining amount associated with a regu latory-approved delivery price increase and other bill surcharges. The forecast is based on average electricity use of 600 kilowatt-hour per month. National Grid defines “eastern New York” as everyplace east of Little Falls and encompass ing all of Saratoga County, said regional spokesman Patrick Stella.

• New York state’s one-time Electric & Gas Bill Relief credit program, which eliminates unpaid utility bills accrued through May 1, 2022, for eligible customers. Customers can qualify for the arrears relief program until Dec. 31, 2022.•The federal Home Energy Assistance Program provides eligi ble customers with financial grants that assist in paying home heating bill. These grants do not need to be repaid. The program is admin istered by county departments of social service and typically runs from November through March, but the timeframe may be length ened or shortened based on fed eral funding availability. • National Grid’s Energy Affordability Program, which pro vides automatic monthly gas and electricity bill credits for HEAPeligible customers or customers who participate in other qualify ing programs. To learn more about EAP, call the Energy Affordability Team at 1-866-305-1915.

The convention business began in the 1830s. Political conventions, professional meetings of dentists and teachers, reformers, and religious conferences were among the large events that found Saratoga Springs a perfect meeting place. The American Bar Association and American Bankers Association were both founded in City Hall. Without it, Saratoga would not have the substantial convention business that has strengthened the city’s economy. Saratogians worked for more than 18 years to make the new facility a reality, ever since the city’s historic Convention Hall was destroyed by fire in 1965.

The massive building with its twin towers rose on South Broadway where the Park Place condominiums now stand. The hall seated 5,000 in its auditorium and balcony and was key to attracting convention business, which began to boom.

As the 20th century went on, the mix of events attracted to Convention Hall changed. The hall provided space for pro, semi-pro, industrial league, and high school basketball competitions – repeatedly hosting the Harlem Globetrotters – as well as wrestling matches and Skidmore College commencements. Enrico Caruso and John McCormack sang there; Paul Whiteman’s and Fred Waring’s orchestras, the Kingston Trio, and Peter, Paul and Mary performed there in concert. But the stock of hotel rooms declined dramatically

Its zenith was almost certainly in September 1907 when 40,000 Civil War veterans descended on Saratoga Springs for the “encampment” of the Grand Army of the Republic.

Another Convention Center to replace the one that burned was proposed at the present city arts council site. But before a final decision was made, catastrophic fire destroyed the old hall. The building was insured, and Commissioner of Public Safety John T. Roohan insisted that the $800,000 payout be deposited in a ded icated account. The Chamber of Commerce urged the City Council to take “immediate” action and a plan ner was soon hired, but no decisions were made, in part due to the insurance fund’s inadequate size. Years fol lowed without decisive action by successive city coun cils. Fifteen years passed before newly elected Mayor Ellsworth Jones joined forces with the Chamber of Commerce to identify completion of a new City Center as top priority.

Through convention business, Saratoga Springs had permanently broken its old reputation of “The August Place to Be.” It is now “The Year-Round Place to Be.

The plan was to increase sales tax by one percent for three to five years, raising $4 million, and the City Council adopted it in August 1981.

Planners estimated that the new facility would lose $150,000 to $200,000 a year, so it was clear it would require a subsidy. Under the chairmanship of Charles Wait of the Adirondack Trust Company, a planning committee began in December 1981 to assemble a cre ative and complex financing plan: the plan called for the city to build the new $4 million Convention Center, and sell it to an investment group. The city would then lease the facility from the investment group for fifteen years. At the conclusion of the fifteen year lease the city would purchase the center at a price agreed upon to at the initial sale. Due to the interest rate differentials, the city would then own the building it had maintained and still have over $3 million of the original $4 million in the bank. The operating deficit would be paid by a hotel built adjacent to the City Center through a “payment in lieu of taxes.” This assured that the anticipated City Center deficit would be covered by the privately owned hotel complex and not by the existing property tax base. Meanwhile, planners recognized that the City Center would not be successful unless its operations were independent of political forces. In July 1982, a bill creating a seven-member Saratoga Springs City Center Authority, sponsored by State Senator Joseph Bruno, was enacted into law.

In 1999, the city bought back the facility. Ten years later, the timing was right for a major expansion. The City Center board, headed by Michael Toohey, led the plan ning process.

Duca holds a bachelor’s degree in History Education from Western New England University, a master’s degree in Education from Salem State University and received an Administrative Certification from Massachusetts College of Liberal Arts. In December of 2019, he received his Doctorate Degree from the Sage Colleges, Esteves School of Education.

Mr. Duca, who has been with the district since 2015, served as an Assistant Principal and Interim Principal before being appointed Principal in July 2018. The school currently has over 1,200 students enrolled in the 9th-12th grades. Prior to his service at Ballston Spa, he held Social Studies teaching positions at South Colonie High School and Medford High School (MA). Dr. Duca currently resides with his family in Waterford, NY.

At Old Tavern Farm in Saratoga Springs, Walt Borisenok and his staff work tirelessly at succession planting native plants, starting seeds in winter. This continual planting of flowers ensures that seasonal blooms are consistent for their bouquets.

At the Saratoga Farmers’ Market, flowers and mixed flower arrangements of brilliant sunflower faces, elegant snapdragons, dahlias, and lisianthus, just to name a few, adorn tables in buckets and vases every Wednesday and Saturday. Their petals and colors summon the attention of “Imarket-goers.amsuperpassionate about flowers, and I enjoy talking with customers and educating them about different varieties we grow,” says Amy Hoge, owner of Bark Hill Farm in Hebron.

Ryan Holub of Scotch Ridge Flower Farm in Duanesburg shares another key aspect of locally-grown flowers. “We cut our flowers a day before the farmers’ market, so they are truly fresh and long-lasting. They have no carbon footprint.”

If you’re wondering what’s so special about seasonal flowers, it’s important to understand that locally grown flowers often can’t be found elsewhere.

It’s also important to note that some flowers have a longer vase life than others. For example, according to Ryan Holub of Scotch Ridge, lisianthus and marigolds live longer than Anotherdahlias.

Bark Hill is one of several farms offering fresh-cut flowers at the farmers’ market this season. “I am trying to have flowers available as long as possible, seeding flowers in January and over-wintering flowers so that they begin growing even earlier,” explains Hoge.

Other local flower farmers echo the “freshly cut” fact, and there are also tips to extending the vase-life of flower bouquets. Walt Borisenok of Old Tavern Farm recommends changing the water daily and trimming the stem bottoms with clean scissors or pruning shears.

Aside from purchasing fresh-cut flowers at the Saratoga Farmers’ Market, many local farms provide flowers for weddings, baby showers, funerals, and special events. To place a custom flower order, please contact farms directly.

This past week both my wife and I celebrated our birthdays (having a birthday one day apart from each other was one of the many reasons I married her!). My birthday also reminds me of my mother who I lost years ago. I think about her every day. Back to school time brings back memories of my childhood and the chaos of getting five children to do their homework, eat dinner, brush their teeth, and get to bed every school night. I often reminisce about the work my mother had in raising three boys and two girls. The family dinner was a very important mealtime during my childhood. Especially with going back to school, my mother was insistent that we were home and ate as a family during that time. Often, she had to explain why she chose a particular meal choice or why she wanted us to wash our face and hands before dinner.

I know it’s maybe not popular but if I was asked what’s important for the American family, I believe it’s sitting down and having that meal together every night. “I had a stroke a year-and-ahalf-ago. It was a completely lifechanging experience, but, oh well - we take each day as it comes. Health-wise, I think I’m doing OK. I can walk and talk, and depending on the time of day, better than at other times of the day. I can take that as a bonus,” Eck says. “Every day is different, but playing music and writing songs are really good therapy for me. It does a lot more for me spiritually even than it does physically. And my family has been incredibly supportive. I’m feeling pretty lucky.”

But to think that Eck’s 40th anniversary in live music is strictly nostalgia is to be misguided. The celebration gig at Caffe Lena will mix old favorites and previously unheard new tunes, as well as serve as the release party for his new album, “Your Turn To Shine.”

“The great thing about Caffe Lena is that as much as people think of it as a historic place, and it is – it’s always been about the future. What’s going to happen years in the future is happening at Caffe Lena now, and I think that’s terribly exciting,” Eck says.

“Your Turn To Shine” features 12 new songs, - three of which were written a handful of years ago, he explains, and the other nine written in this new era: during a once-in-a-lifetime pandemic, and for Eck personally, following a stroke.

“My spirituality comes from a belief in humanity. And a belief in the power of the arts,” Eck says. “I think we can find – to use that term ‘spirituality’ – in whatever we look to or choose to find that. And for me it’s in people,

Using the power of grassroots fundraising and help from local businesses, the organization has raised over $70,000 for the new skatepark – covering half of the unforeseen expenses. On June 7, 2022, the city approved the new expenses, and the project was seemingly green-lit, that is, at least on paper. In reality, though, nothing has changed at the park.

and other action sports, we are frustrated about this hold up. We would like public transparency from the City of Saratoga or the school district about why the building contractor has not been signed, nor a construction date determined,” said Gleeksman.

“Every time this project gets delayed our costs rise. We were told by the recreation department to raise money to help with the effort – so far, we have raised over $70,000 dollars for the project and want to move forward,” Gleeksman told Saratoga TODAY.

The charge to have the skatepark upgraded is being led by ON DECK Saratoga, a nonprofit 501(c)(3) organization under the umbrella of the Saratoga Institute. Benj Gleeksman, co-founder of ON DECK, has been outspoken about this whole process, releasing a recent statement saying, “this decision [to not upgrade the skatepark] seems like a way for the skatepark to not be recognized as important as the rest of the facilities in the complex… The Great Outdoors Project was a New York State grant, not a fundraising initiative for particular interests. For a skatepark that is used daily, and almost year-round, a significant investment is warranted.” ON DECK has been lobbying the city for an upgrade since 2012, and this year it finally seemed like a go – but unfortunately the plans of

SARATOGA — Built in 1989, the East Side Recreation skatepark is the oldest municipal skatepark in New York state. Now, more than three decades later, with rusted ramps and decaying metal, skatepark goers think it’s time for a proper upgrade. And many thought that was coming a few years ago during the Saratoga Great Outdoors Project, when the LA Group partnered with Mosaic Associates and the school district to improve recreation spaces across the city – projects that totaled $15.6 million dollars. For the East Side Rec, this meant new basketball courts with lights, 10 new pickleball courts, a new fieldhouse with concessions and bathrooms, a new synthetic turf baseball field with lights, expanded irrigation and more. Unfortunately for those that skateboard, the skatepark was left
