When you travel, do you like renting private flats and houses as holiday accommodation? Are you the owner of property in the Valencia Region that you rent out as short-stay holiday accommodation? Are you aware that other autonomous regions have placed restrictions on the freedom of individuals to rent out their property by imposing clauses that are detrimental to users and owners. Given this situation, both the Ombudsman and the National Competition Commission (CNMC) have expressed their doubts as to the legality of the restrictive legislation imposed in several autonomous regions, because restricting this activity exclusively to companies is a restriction on the rights of property owners to rent their homes out as holiday accommodation. The “LET'S SAVE HOLIDAY RENTALS� platform consists of users and owners of tourist rental properties who want the Valencia Region to pass a regulation that permits unrestricted rentals by any means and for any term that complies with the law. REASONS FOR SUPPORTING THIS PETITION: BENEFITS TO SOCIETY Holiday home rentals: 1. Holiday home rentals mean that visitors have access to more varied types of holiday accommodation at the destination. 2. Holiday rentals boost the collaborative economy and efficient use of resources; are they are a source of income which is sometimes essential to the family economy. 3. Holiday rentals have positive repercussions on tourism and trade in destinations because: (1) Holidaymakers opt to stay for longer, (2) they attract users wanting a different type of accommodation who would otherwise not visit the destination and (3) they boost business for related sectors such as restaurants and retail.


FALSEHOODS about holiday rentals: 1. Holiday rentals do not meet minimum quality standards. This is untrue, because rental platforms allow the sector to self-regulate. The users themselves rate the properties and certify their quality. 2. Owners of rental properties do not pay taxes: This is untrue, because income received from owners is subject to tax in the same way as any other economic activity or to IRPF personal income tax. 3. Homes rented out as holiday accommodation cause a nuisance to neighbours. This is untrue, because according to the most recent survey conducted by Home Away, 99% of users of these types of accommodation have never had issues with their neighbours, which is similar and even somewhat lower to the situation reported by hotel clients. THREATS OF REGULATION IN OTHER AUTONOMOUS REGIONS.  

 

Although the measures to be taken in the Valencia Region have not yet been specified, it is known that similar regulations are planned as those implemented in other communities. In other Regions rental of single family flats and semi-detached houses is forbidden by law and a new tourism decree is on the cards that will include an obligation by owners to ask for their neighbours’ permission before renting their properties as holiday accommodation. In other Regions the Council has stopped granting licences to tourism lets in some of the city's most popular areas. In other Regions the owners of holiday accommodation must ensure that the use of the property as holiday accommodation is not prohibited in the Articles of Association of the community of property owners in buildings subject to the Horizontal Property Scheme. In other Regions holiday accommodation in private properties cannot be rented for less than five days, when most people want to rent this type of accommodation for two or three nights. In other Regions the accommodation must be offered for at least the months of July, August and September. This means that owners are not allowed to rent the property during the other months of the year if they do not let it out during the summer season. In other Regions the tourism regulation does not include rentals of a single property for holiday accommodation and applies only when the owner has two or more homes to let to tourists.


The ““LET'S SAVE HOLIDAY RENTALS”” platform is fighting for a fair regulation, which will not restrict the rights of property owners and users, which is why we are requesting the following: 1. That the future Tourism Law to be clear, simple, accurate and with the sole purpose of make it easier to the owners to perform it. 2. To not increase the requirements for the property rentals with touristic or vacation purposes, by natural or legal persons, by any means of communication, as long as the services are offered by the hospitality industry. Consequently, we defend from the platform, these requirements to be compulsory for this type of rentals:  Registration in the Public Registry of the capacity of the dwelling and consent to disclose this information to the Tax Authorities.  A requirement to include the registration number in all advertising.  The property must have an occupation licence or the document that replaces it.  The property must be covered by public liability insurance.  There must be a floor plan showing evacuation routes alongside the door of the property.  The property must provide a list of emergency telephone numbers and a tourist customer services number.  The police must be notified of the arrival-departure of visitors. 3. The government must provide control mechanisms to facilitate compliance with tax requirements applicable to income generated by this activity. 4. The law must include measures for evicting occupants who behave unacceptably and/or disturb the neighbours.
