his year’s Tribute’s Committee set a new standard for the annual gala that brings together our industry leaders. More than 1,200 people joined the AMA for this awards dinner to celebrate the contributions and achievements of the best teams from around the State of Arizona. Seeing the profiles of each finalist, you have a chance to see how our members’ teams lead in their communities and ensure that our industry remains strong. The inspiring stories behind these managers, leasing staff, housekeepers and maintenance personnel give us an appreciation for the commitment these outstanding employees have to residents and their companies.

Honored to recognize Michael Trailor One of the evening’s highlights was our Industry Champion Award given to Michael Trailor, the director of Arizona’s Department of Housing. Trailor’s leadership on behalf of the deaf and hard of hearing communities in Arizona deserved our recognition and gratitude for his fortitude in the face of federal challenges on one signature housing development in Tempe. Apache Trails, an American Sign Language assisted living community in Tempe, offers individuals and families who are deaf or hard of hearing a new, specialized housing opportunity that was designed by a renowned architect who is also deaf. The multifamily community received HUD financing, but was challenged on the funding because they marketed the community to the

Trailor supported the Apache Trails community and its residents and was successful in retaining the HUD financing. On behalf of the multifamily industry, we were proud to recognize his tireless advocacy on behalf of the deaf and hard of hearing community and for fair housing for Arizona’s families.

St. Mary’s wins national award for AMA partnership Last summer, the Arizona Multihousing Association partnered with St. Mary’s Food Bank Alliance to support the Kids Cafe program that provides children with meals in the summer months, when school is out of session. The program was honored by the U.S Department of Agriculture as the recipient for the 2013 Western Region Summer Sunshine Award for Innovative Strategies to Attract More Participants. To grow their reach into the community, St. Mary’s worked with the AMA to recruit 22 apartment communities as location to distribute meals. They were able to increase the number of meals for kids from 2,300 a day to 4,800 daily meals.

HB2115: Unemployed; severance pay; definition — Defines severance pay as any sum of money an employer pays to an employee due to the employee’s retirement, participation in an exit incentive program or due to the termination of employment. Excludes any sum of money that an employer pays an employee pursuant to an employee benefit plan from the definition of severance pay. HB2389: Transaction privilege tax changes — Makes changes to statutes governing transaction privilege tax (TPT) in order to implement last year’s sweeping TPT changes chaptered as Laws 2013, Chapter 255. HB2389 amends provisions so that the state administers all TPT licensing processes instead of each individual municipality. Starting January 1, 2015, the Arizona Department of Revenue (ADOR) will administer all TPT licenses and all businesses and property owners will remit their TPT to the ADOR. HB2528: Municipalities; regulation; sign walkers — Prohibits municipalities from restricting a sign walker from using a public sidewalk, walkway or pedestrian thoroughfare. SB1482: Homeowners’ associations amendments; omnibus — Makes sweeping changes to the laws governing homeowners associations (HOAs). Prohibits an HOA from: >> Assessing or levying any other fee or fine, except for permitted fees or fees related to the use of recreational facilities, or otherwise impose a requirement on a rental property that is different than on an owner-occupied unit or property in the association. >> Requiring a unit or property owner to provide them with a copy of a rental application, credit report, lease agreement, rental contract or any other personal information.

Tempe cracking down on wild parties Over the past several years there have been numerous reports of wild, out-of-control parties that have been widely reported in the local media. The loud parties have created a groundswell of complaints from neighborhood and community groups. In an effort to control the parties, the city of Tempe, with the AMA’s involvement, revised its nuisance party ordinance last year. The ordinance allows police officers to cite party-goers on the first response to a nuisance party and allows officers to post a citation on the door of the residence if the resident refuses to answer the door. This past April, Tempe also passed a new security plan ordinance for multi-family communities. Initially the ordinance would have required all apartment communities in the city to submit a security plan to the police department every two years. After discussing the issue with the city staff and the council, it was agreed that the issue that the city was attempting to address was attributed to several specific properties in or around campus and was not a citywide concern. The AMA was ultimately able to reach agreement on the ordinance and essentially the ordinance will only apply to multi-family properties that have, through repeated offenses, shown a disregard for public safety. The new security plan ordinance took effect May 10.

Remember to Vote for AMAPAC Endorsed Candidates The Arizona Multihousing Association Political Action Committee (AMAPAC) has officially endorsed candidates seeking election in the Arizona Legislature and various cities. AMAPAC made the endorsements based upon the candidates’ track record in office. The Arizona Multihousing Association urges all AMA members consider AMAPAC endorsed candidates when heading to the polls on August 26, and November 4, 2014. Please note, AMAPAC will announce additional endorsements for candidates seeking election in any open seats and will communicate those endorsements prior to the Primary Election.

Be safe in the sun Plan to prevent heat stress among outdoor workers

N

ow is the time to review strategies for reducing the potential risk of heat stress, especially for those employees who perform jobs and activities outdoors. Heat stress can happen when people working in hot environments experience an inability to properly maintain a safe internal body temperature, according to the U.S. Occupational Safety and Health Administration (OSHA). Although workers usually sweat to cool off, working in high temperatures or working near radiant heat sources may cause employees to lose this ability.

Recognize dangers Symptoms of heat stress may not only reduce productivity but also may result in dangerous health effects and even death. Now, before the triple digits arrive, is a great time to acclimate yourself to higher temperatures. Get into the habit of performing the most taxing outdoor work in the cooler morning or later

These are some of the most common signs of the condition, but symptoms may become worse if workers do not replenish their body fluids. Eventually, rashes and cramps may lead to heat exhaustion and the potentially lethal stage of heat stress known as heat stroke. Heat stroke can result in

death and requires immediate medical attention, according to OSHA. Exposure to heat can also increase the risk of injuries because of sweaty palms, fogged-up safety glasses, dizziness, and burns from hot surfaces or steam.

The Centers for Disease Control and Prevention (CDC) offers a list of Frequently Asked Questions about extreme heat. Workers should beware of overexertion during strenuous activities in hot, humid environments. To prevent the risk of heatrelated illnesses, check out the heat index table to gauge your heat illness risk at high temperatures.

or one evening a year, the multifamily industry gathers together from around the state to celebrate the achievements of individuals, teams and properties at the annual AMA Tribute Awards. For the second consecutive year, a sold out crowd of more than 1200 watched as colleagues were honored with special awards. Tribute Chair Christine Shipley led a dedicated team of AMA volunteers to host this gala, the highlight of the Association’s season. Industry leaders Each year, the AMA also honors leadership in our industry with awards for individual contributions. This year’s honorees have chaired numerous committees and found unique ways to give back to the apartment industry and to our local communities. Their involvement with the association through Big Hearts for Little Hands, Project SAFE has improved not only their properties, but also the greater neighborhood. Adam Greco’s continued leadership with the AMC and with the Board was

Bright stars These winners were judged in a competitive process and this year’s 23 winners were selected from the more than 400 statewide nominations. This year, the AMA added one new category, Affordable Property of the Year. In addition, two categories added from last year were featured including one for best renovated property and the Outside the Valley categories. “As the apartment industry continues to grow in Arizona, we are seeing large investments in renovations and

in affordable housing for workers,” says Tom Simplot, president and chief executive officer of the Arizona Multihousing Association. “It’s important for our industry to recognize these new housing options and the influence these communities have on the greater community.”

Investments pay off New affordable developments, primarily around key transportation corridors, provided accessible housing options and these new communities have earned special recognition. Allison-Shelton’s Escala Central City took home this first prize. Newer categories honoring renovated communities has also become very competitive as more companies have purchased aging properties and made major investments. Camden’s San Marcos property stands as a shining example of how their singular touch can improve the look and operations of a community. Liv Avenida’s award for best community of this past year recognized the unique location and positioning of IPA Management’s new community.

he Trade Show was a huge hit with the theme of “Wild, Wild West... Blazing New Trails With the AMA!” We had cowboys and cowgirls, saloons, shooting galleries and more! This show featured an attendance of more than 1,000 people and 162 vendors on the floor. The Education Conference speakers brought together hundreds of attendees for additional training. Wednesday’s keynote, ‘Trainer Don’ Sanders, interacted with the audience and managed to get a particular song stuck in everybody’s head! The show’s Thursday keynote, Anthony Robles, shared his extremely moving and uplifting story, which brought tears to the eyes of his audience. Q &A

A conversation with Glendale Councilman Gary Sherwood Q: What changes have you seen over the past few years in Glendale as a result of the boom in multifamily? With the Great Recession, asking rent per unit dropped severely, from $696 in the first quarter of 2009 to $650 by the third quarter 2009, according to Costar. Over the next few years, rates held fairly steady. Since 2011 rates have been on the rise with a large increase coming from mid-2013 to now. For example, in 2nd Quarter 2013 asking rates was $659 on average; as of this quarter to date the rates were $690, right at pre-recession rents. Vacancy rates have declined dramatically over the last five years. They peaked at just about 15% in 2009 but currently sit just over 6%. The last time they were this low was 3rd quarter of 2006. This mirrors the overall greater Phoenix market, which peaked at 13% in 2009 and now sits at 6 percent. Currently, there are not a significant number of multifamily units under construction in Glendale. We do expect PB Bell to break ground shortly on Aspera in northern Glendale. There has been much recent interest around Camelback Ranch, the spring training facility and as the 303 opens up along with the Northern Parkway. We are seeing expanded interest in MF developments especially of late.

Q: What has been the impact of new development in Glendale on housing options? There have been many new office, industrial, retail and healthcare projects expanding/locating to Glendale recently offering a couple thousand new jobs and multi-millions of dollars in new on and on-going revenues for the City. This will begin to drive the need for additional housing options in Glendale and in fact has with the info shared above. Additionally, Stone Haven, a 340 acre, Fulton Homes residential community is the planning process and is slated to accommodate 1,500 new homes.

Meet Councilmember Gary Sherwood Councilmember Gary Sherwood was elected in November 2012 to represent Glendale’s Sahuaro District. Sherwood is currently a member of Glendale’s Sustainability Committee; serves on the Board of Directors of the Valley Metro Regional Public Transportation Authority and serves on the National League of Cities Transportation Infrastructure and Services Policy

and Advocacy Committee. Councilmember Sherwood’s previous volunteerism with the City of Glendale includes serving as chair of the Personnel Board, and as chair of the Planning Commission; as an evaluator for From the Heart; a member of Glendale’s Water & Sewer Task Force; and a graduate of both Glendale University and the Glendale Citizens Police Academy.

Councilmember Sherwood currently is employed as a marketing director for a restoration/renovation general contractor serving both residential and commercial customers with a focus on the multifamily segment. He serves on many committees for the AMA in varying capacities. Sherwood is a native of Michigan, and has lived in Glendale since 1979.

Q: What do you think employers and potential employers are looking for when they look at Glendale for relocation? Sites suitable for the employer must exist. Most prospect companies are looking for “shovel ready” sites at minimum, if not existing buildings. Employers are also looking to make sure they can attract a quality workforce at a reasonable cost. Lastly, the company is looking for affordable operating costs. Without these factors, it is very difficult for a company to be successful.

Q: As the Valley’s market continues to recover, where do you see the development coming next in Glendale? Future development will likely be around

the Sports and Entertainment District in Glendale where there is 1 million square feet of commercial under construction or just opening and another million plus square feet in plan review currently. Another area that will see new development is in North Glendale, in the Arrowhead area, as the Aspera project is developed. This new project at the corner of 75th Ave and Loop 101 will contain multifamily units in addition to the commercial and medical office developments in the area.

Q: What’s your vision for the future development of housing in Glendale? A strong market should contain a balance between single family and multifamily

options, as well as availability at different price points. The growth of development in the Sports and Entertainment district and shortly out along the Loop 303 will continue to drive new residents to these areas of the City in particular. Personally, what I hear often is that during the downturn when many homeowners were forced out of their homes and into multifamily communities, they became accustomed to not being a “slave to their homes”. They had all of this free time, amenities which they didn’t have in their homes, and their overall living expenses decreased by a significant amount. Owning a home these days is not the American dream it was once thought to be!

Five questions with Mark Mitchell, Tempe Mayor

Q: What changes have you seen over the past few years in Tempe as a result of the boom in multifamily? Tempe is a 42-square-mile, landlocked community and we have had to concentrate on smart growth. We have to carefully plan our residential growth, and it is most important to have a balance of housing options. Tempe has a great mix of residential, from apartments and condominiums to single-family neighborhoods and even properties large enough to

accommodate horses. Transportation options such as light rail, bus and our Orbit neighborhood circulators are highly used in Tempe, in part because of the increase in residents living in multifamily developments. In moving forward, we’re going to have to focus on redeveloping where appropriate and growing carefully.

Q: What has been the impact of light rail on housing options? We have seen substantial development along Tempe’s

portion of the METRO light rail line, particularly around downtown and along Apache Boulevard. It is clear that consumers want to live closer to where they work, and light rail makes that possible for our residents.

Q: What do you think employers and potential employers are looking for when they look at Tempe for relocation? When a community invests in itself and its residents, it will attract economic

success. Tempe has a long commitment to bettering our community. There are a number of attributes that make Tempe attractive to business, including our central location in the Valley, proximity to Phoenix Sky Harbor International Airport, freeway access, a vibrant downtown and Tempe Town Lake, special events, transportation options, great neighborhoods and a public park every square mile. In other words, a tenant on a month-to-month tenancy must make sure that they give a thirty (30) day notice, and that the 30-day notice is received prior to the rental due date, which is normally the first of the month. The notice requirements of A.R.S. § 33-1313(B) remain in effect and require the 30-day notice to be hand-delivered or sent certified or registered mail. : There is no requirement that a landlord have maintenance on staff 24 hours per day. The landlord’s only obligation is to maintain the premises and make any and all necessary repairs. If you were to have a repair issue that arose during the time that the maintenance personnel were not on duty, as a tenant you would have the right to take steps so that you, or the premises, do not suffer any damages. Under certain circumstances, this could include calling out your own vendor after putting the landlord on notice and giving them the opportunity to make the repairs. The vendor you hire should be a licensed and bonded contractor. You would have to check with that particular city to see if an actual handicap metal sign was needed to be erected or if the painting was sufficient. You could also give the landlord a 10-day non-compliance notice to correct the problem if this is considered a breach of your lease agreement. —Andy M. Hull

AMA Board Supports LeVinus and Sinema’s Team for Boston Marathon

T

his year’s Boston Marathon held special meaning for all Americans. AMA’s chief lobbyist Courtney LeVinus qualified for the race and ran with Arizona Congresswoman Kyrsten Sinema and her team, MR8. One year after the bombing at the annual race, many of the runners raised funds and awareness for special causes and for those who were injured. AMA board members contributed more than $4,000 to LeVinus and MR8. In total, they raised more than $40,000 to support three organizations — the National Multiple Sclerosis Society of Greater New England; the One Fund, which helps survivors of the marathon bombing; and the Martin W. Richard Charitable Foundation.

Lyceum Hits the Capitol

T

he inaugural Lyceum leadership class recently visited the State Capitol during session to learn more about the AMA’s work in advocacy and legislation. Courtney LeVinus and the Capitol Consulting team met with the cohort to discuss the development of the AMA’s legislative agenda and the importance of the work of the Political Action Committee (PAC). The class also heard from Tom Simplot, who also arranged a meeting with former Superintendent of Public Instruction Lisa Graham Keegan to discuss education reform and a panel of three former Governor Chiefs of Staff Keegan to discuss life in the Executive Tower.

The AMA’s Lyceum leadership class toured the Arizona State Legislature to gain an understanding of the importance of advocacy for the industry.

The Tucson Golf Committee takes a break from planning the annual tournament. Co-chairs Tim Furnas of Valley Protective Services and Cheryl Gaida-Vieux of Nicolosi & Fitch led the committee to success.

The shotgun start of the 2014 AMA Tucson Golf Tournament Golf in April in Tucson was one of the most memorable mornings of the year. More than 120 AMA members and guests played in the tournament at the El Conquistador Golf and Country Club. Special thanks to Title Sponsor, Valley Protective Services, and the Golf Committee who planned the event. Co-chairs Tim Furnas of Valley Protective Services and Cheryl Gaida-Vieux of Nicolosi & Fitch did an outstanding job on the event. Winners were honored at the awards luncheon and Katie Macias won for best Crazy Pants. Best Crazy Shirt went to Mike Ruske. Prizes were awarded for golf hole contest winners and the 1st Ruske, Carrol, Chatman & Lewallen, 2nd Meyer, Welsh, Reeves & Albright and 3rd Shetterly, Anderson, Cox & Peterson place teams.

AVENUE 25 HOSTS AMC MEETING By Adam Greco pril’s Associate Member Council meeting brought together more than 100 members for a gorgeous afternoon at the Allison-Shelton’s new Avenue 25. Our afternoon started by the resort-styled pool where our members were awed by the luxury cabanas lining the pool and the unique dog-shaped footstools near the seating. Because of the unseasonal heat of the day, Sharon Kuhlman, Avenue 25’s community manager, invited our group to move inside to feast on the hors d’oeurves, wine and cool drinks that they had for us. The Associate members enjoyed the opportunity to explore Allison Shelton’s newest luxury apartment community in the burgeoning North Phoenix corridor. The contemporary Italian style of the community complements the state of the art amenities here including poolside Wi-Fi, coffee bar, dog run, fitness center and so much more. Tom Shelton, one of the founders of AllisonShelton, spoke to our AMC group about their growing portfolio, their expansion into Florida, and into the single family rentals. Currently, they manage 82 communities, more than 16,000 units in four states. Allison-Shelton is building on their portfolio of conventional apartment community management by moving into HOA management. Over the past year to 18 months, they have supervised more than $13.5 million in

renovations. Luis Verger, the District Manager, shared more information about their local development plans. To cap off the evening, the Allison-Shelton team had a surprise for the AMC members in the form of raffle items ranging from wine and cheese baskets to t-shirts. Our group appreciated this extra touch and enjoyed seeing friends win prizes. Monica Chesley of Burns Pest Elimination, won the lunch with Pam and Tom Shelton and Vicki Allison, the principals of Allison-Shelton Real Estate Services. The Associate Member Council meets quarterly and meetings are hosted at Properties and Property Management Companies. Gerald Richard, Phoenix’s assistant chief of police, discussed the emerging issues around Medical Marijuana Lease Addendums and how they may affect a property’s Crime Free Status.
