The undersigned affiant, being duly sworn, deposes and says: 1. That I, Detective Richard Baxter am a regular member of the Waterbury Police Department having over 13 years of training and experience. I am currently assigned to the Criminal Investigations Bureau and have investigated numerous crimes that have led to both arrests and convictions.

3. That, on May 03,2009 at approximately 01 :54hrs Officer Kevin Switz was dispatched to 694 Lakewood Road at Swizzle Stix's Cafe on the report of a weapons complaint. On his arrival Officer Switz located a victim, later identified as Lawrence Mates, DOB:07/14/81 lying face down in the parking lot. Mates was bleeding from his head and was unresponsive. Officer Switz then spoke with a witness who was attending to Mates. This witness, identified as Carlos Suarez, 008:04/20/64 stated he works at Swizzle Stix's and was just leaving work when he heard two (2) gunshots. He went outside and saw the victim lying on the ground and later recognized him as Mates. Campion Ambulance arrived on scene and transported Mates to st. Mary's Hospital for further treatment.

4. That, Officer Switz then spoke with several other witnesses who were at the scene. These witnesses were identified as Shannon Doucette, DOB:11/07fi7 and Karen Askew, 008:05/03/58.

Doucette stated that Mates is her fiance and that she was in the parking lot with him when she heard a gunshot and saw Mates col/apse to the ground. Both Doucette and Askew voluntarily agreed to go to the Detective Bureau to further speak with Detectives.

The undersigned affiant, being duly sworn, deposes and says:

5. That, on May 03,2009 at 02:22hrs. Dr. Michael Ajenian from St. Mary's Hospital staff pronounced Mates dead. Dr. Ajenian stated it appears Mates had sustained a gunshot wound to his head and this lead to his death.

6. That, Shannon Doucette provided a sworn statement about the incident. In this statement

Shannon stated in relevant part the following;

"Lawrence works as a bouncer or security for Swizzle Stix's on Lakewood Road. Lawrence has been working there for about 2 years. I go to work with Lawrence on Saturday nights at the club. work at the door and collect the money as the people are coming in. Lawrence and I both went to work at Swizzle Stix's at 9:00pm tonight. My brother, Kyle Doucette, was having a birthday party at the club tonight and he invited a bunch of his friends to come down. Kyle came to the club at about 10:30pm. Kyle was with my sister Shawndell Askew, my mom Karen Askew and Kyle's girlfriend Bonita. I don't know Bonita's last name, but she lives in Meriden.

Once they were at the club, my mom and sister hung out with me for a little while, but then went into' the club because they were cold. Kyle and Bonita went right into the club. At about 11 :30pm some of Kyle's friends and some of their friends starting showing up at the club. I know some of his friends, but not all by name. I know this guy Swizzy, Trevoy, this white kid Alan. There were a bunch more that I recognized all these guys from Meriden, but I just don't remember all of them.

During the night the white kid got drunk and he was starting to cause problems in the club.

Lawrence went over to him and told him he had to leave. Alan kept coming to the door and we would tell him he couldn't come back in. This happened 4 times. This started at about 1 :OOam. Just before closing time Alan somehow snuck in through the back door and was back in the club. Lawrence went over to him and told him he had to leave and picked him up and carried him to the side door and brought him outside. I went over to Alan and told him he needed to calm down, that he couldn't come back in. I did this because he was a friend of Kyle's and I was trying to calm him down. I told Alan who I was. but he just kept saying nobody can tell me I can't come in. Lawrence came over to him again and told Alan that I was his wife and he couldn't go back in the club. By that time a Jot of people are starting to gather around us. I had my back to Lawrence and I was telling the Meriden people that I recognized that Lawrence was my fiancee and that Alan couldn't go back in the club. could hear Alan going crazy and he was arguing with Lawrence. I just started turning around to look at Lawrence when I heard a gunshot go off. I turned all the way around and I saw Lawrence drop to the ground. I don't know for sure. but I may have heard 2 shots. I heard people yelling "he shot him, he shot him." I saw a guy with medium colored brown skin wearing a white baseball cap running away. I don't know if this is the guy who shot Lawrence or not. I looked at Lawrence and I saw blood . and meat coming from the side of his head. He was out and he wasn't breathing or nothing. AFFIDAVIT The undersigned affiant, being duly sworn, deposes and says:

7. That. through the investigation it was determined that the street name of "Fleet" was Andre West, 00B:05/29/90 and he lives in Meriden Connecticut. A photograph of West was obtained and placed into a photo array containing eight (8) similar looking males. These photos were placed in various positions prior to being shown to the witnesses.

8. That, another witness was identified as Christopher Petty, 00B:10/20/81. In a sworn statement Petty stated in relevant part the following; " When I got outside I saw Lawrence was in the parking and was surrounded by like 14 or 15 people. The crowd around Lawrence seemed to be all black males. There was some kind of a verbal argument going between Lawrence and some males in the croWd. I began to try to get into the crowd in an attempt to get near Lawrence because he was surrounded by the males. I didn't know any of the males in the crowd. When I got up close to Lawrence I see this small black male, like somewhere around 5'7" tall, pull out a grey pistol and points it at Lawrence's back. This male didn't say a thing and immediately shot Lawrence three times in the back of the head. Lawrence fell face down to the ground and never moved. The black male that shot Lawrence was not one of the males that Lawrence was arguing with, it seemed to me that the shooter must have been with the guys that were arguing with Lawrence and decided to end the argument with the pistol. I didn't see the shooters face fully, only a side view. but I would describe the shooter as a black male, about early 20's in age, about 5'7", short black hair, slim build, dark complexion, wearing a black baseball cap with a white team Hke logo on it, and a black short sleeve tee shirt. The pistol that shooter had was grey in color and looked like a semi auto pistoL" 9. That, in a sworn statement Askew stated in relevant part the following; " Earlier tonight, I was at the Swizzle Styx Bar on Lakewood Road in Waterbury, CT. I was there with my two daught~rs Shannon and Shawndell. I was there because Shannon's boyfriend, Lawrence Mates, works at the Swizzle Styx as a bouncer. Lawrence is known as Superman, and everyone calls him Supe for short. Shannon also works at Swizzle Styx. She collects the money at the door. She's been doing this for almost a year now. I go to the bar on Saturday night's to be with my family.

Tonight Shawndell and I got to the bar at about 11 :00 pm. While we were at the bar, there was a white kid, whom I know as Allen, acting up like crazy. Allen was quite drunk. Allen was trying to provoke people to into fighting him by getting in people's face, being confrontational. People in the bar were ignoring him because he was drunk and just being stupid. I know Allen because he hangs out with my son, Kyle Doucette.

AFFIDAVIT The undersigned affiant, being duly sworn, deposes and says:

Supe saw that Allen was being a problem in the bar and told him to leave. Supe escorted Allen out of the club. Supe kicked Allen out at about midnight. Allen somehow snuck back in the club. Supe escorted Allen out the door again. This happened about three times. I think Allen kept on sneaking back into the club by the side door near the pool tables. Supe was professional about removing Allen. He never tried to hurt him. The last time Supe escorted Allen out of the door, he had to physically grab Allen underneath his armpits, pick him up, and put him out. This was close to closing time.

When Supe did this, Allen's friends came over to him. Allen friends were yelling at him to stop it.

People inside the bar saw the commotion outside. They started to come outside of the bar and gather around to see what was going on. Shannon also went outside. She was standing close to Supe. When I got outside, I could see that the situation was starting to escalate. I saw Supe restrain Allen by putting his arm around him. Supe is a big guy and was holding him, to try and calm him down. Allen was out of control. He was trying to show off for his friends who gathered around him.

Supe did nothing to hurt that kid Allen, he could have hurt him but he held back. Supe has been a bouncer for a long time and he knows how to handle people calmly, he hardly ever has problems with the drunks.

As Supe was holding Allen, a black male came right up to him with his hand in his right pocket. I then saw the black male pullout a small gun from his right pocket. He then pointed the small gun at Supe's head, and pulled the trigger. This kid looked like he put the gun right to Supes head and shot.

Supe fell to the ground. The black guy shot him one more time while he was on the ground. I was standing so close that I saw the flash of the gun. I was no more than three or four feet away from Supe when this happened. The black male who shot Supe was about 5'08, slim build, and was wearing a fitted baseball cap. He was wearing blue jeans and black hoodie. Supe did absolutely nothing to this black kid who shot him. Supe never saw it coming and had no chance to defend himself. This kid executed Supe.

When he shot Supe, I was stunned. I yelled for someone to grab the black male who shot Supe. He ran towards the far exit of the parking lot. No one stopped him. Everything happened so fast. I tried to help Supe. Supe was bleeding from his head and was unresponsive. I knew that Supe was dead.

I tried to comfort my daughter, Shanon, who was crying uncontrollably."

Askew was provided a witness identification form, which she read and signed. Askew was then

shown a photo array containing a photograph of West in the number seven (7) position. Askew

immediately identified the person in photograph number seven (7) as the person she saw shoot

'Mates. Askew circled the photograph and signed the photo array.

10. That, several other witnesses were located and voluntarily agreed to come to the Detective Bureau to be interviewed about the incident. One witness, identified as Duane Snow, 00B:02/26/57.

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

"On 05/0212009 at about 11 :30 Pm I went to Swizzle Stix Club on Lakewood Road. My nephew­ Lawrence Mates was working there as bouncer and throughout the night I would hang out with Lawrence for short periods of time. On 05/03/2009 at about 1:30 AM I saw that Lawrence was dealing with some white guy that was drunk. The white guy was acting up. The white guy could just barely stand so I saw Lawrence pick the white guy up by the arm pits and carry the white guy outside. The white guy was yelling and making a fool out of himself. Lawrence set the white guy down on outside wall and told him the boss doesn't want him back in the club. A bunch of people were watching this but nothing else happened. Just before the club was closing the white guy must have came back into club. I then saw Lawrence again carry the white guy outside through the alley door. I noticed that the a crowd of people in the club was going out this same door, following Lawrence. I went out the front door to check on Lawrence. Lawrence was in the parking lot and had a crowd of black males surrounding him. I could hear Lawrence telling one of the males that he was just trying to get the guy set down right because the guy couldn't come back inside. Lawrence was telling the crowd to just back up. Right then I saw this black male come up from behind Lawrence's left shoulder. I didn't see where the black male came from, it was like he just popped up behind Lawrence. The black male immediately put his extended arm up and pointed a chrome colored handgun at Lawrence's head. It looked like a semi auto type handgun. Lawrence never even seen the black male with the handgun.

The black male, without even saying anything. just started shooting Lawrence in the left side of Lawrence's face. I saw two flashes come out of the barrel of the black male's gun and heard the two pop sounds that I knew were gun shots. At the same time I seen the bullets hit Lawrence in the head.

I could see the skin on Lawrence's head just pop open and blood splash out. Lawrence just dropped face down to the pavement. I kept my eye on the black male with the handgun and saw that he began to walk towards the larger part of the parking lot. I kept watching this black male and got into my car, which was parked right next to where Lawrence lay face down. I followed this black male in my car but when he saw that I was following him he started running. I chased this black male until he ran into the wooded area on the left side of the building. The male threw a bottle at my car and hit my car with the bottle before running in to the wooded area. I lost sight of this male and returned back to where my nephew, Lawrence, lay.

When this black male with the handgun shot Lawrence I was an arms reach away so I got a real good look.at him. I saw his face as clear as day. I would describe the black male that shot Lawrence as medium complexion, about 18 to 19 years old, with short black hair, wearing a black hat with. some silver decorations on it, a black short sleeve tee shirt, and dark pants. The shooter was about 5'8" tall and had a slim build. I know that I will be able to identify the shooter if I ever see him again. I can't believe this black male would just shoot Lawrence for no reason, it was senseless. This black male was not even arguing with Lawrence and for no reason just shot Lawrence in cold blood. I don't know how anyone could do this."

Snow then read and signed a witness identification form. Snow was then shown a photo array containing a photograph of West in the number three (3) position. Snow immediately identified the person in photograph number three (3) as the person he saw shot Mates in the head. Snow circled the photograph and signed the photo array.

That, Kyle Doucette, DOB:04/30/87 provided a sworn statement in which he stated in relevant part the following; "Yesterday was my birthday so me, my mother Karen Askew, my sister Shawndell Askew and my girlfriend, Baughnite Leary went to Swizzle Stix for a little party. We arrived at Swizzle Stix around 11 :00 pm last night. Most of my friends got there between 11 :30 and midnight. During the night one of my friends named Allen got kicked out of the bar. Allen was drunk but I'm not sure why he got kicked out. I continued to hang out and party with my girl. Towards the' end of the night my sister, Shannon came up to me and said that Allen was outside acting up and told me to get him out. I walked outside with my girl and saw most of the crowd outside in the parking lot. Superman was outside trying to calm everyone down and get people to leave. I saw a bunch of people trying to get Allen away from the crowd. I then saw this kid that I know named Andre West who we call" Flea" come up from behind the crowd and walk towards Superman. I thought at first he was going to help break up the fight. Andre walked up to Superman from his side and all of a sudden I saw Andre's raise his arm up to Superman's head and then I heard a gunshot. Andre was about a foot away from Superman when he shot him in the head. I then heard a second shot and Superman fell to the ground. I don't know where the second shot hit Superman. Superman didn't even see Andre coming. I saw blood coming from Superman's head and there was a puddle of blood on the ground around his head. I then saw Andre running through the parking lot towards the back of the building. Andre was wearing a dark colored baseball hat and a white tee-shirt with a dark hoodie sweatshirt over it. I don't know where Shannon came from but she ran up to Superman and started crying. Everyone started running and leaving the parking lot in their cars. I stayed in the parking lot until the police and ambulance got there. I have known Andre for about ten years. We grow up in Meriden and played basketball together at the Boys Club. Andre was at my party tonight and he came up to me and said, " Happy Birthday and shook my hand. I don't have any idea why Andre shot Superman."

Kyle was given a witness identification form which he read and signed. Kyle was then shown a photo array containing a photograph of West in the number five (5) position. Kyle immediately recognized the person in photograph number five (5) as the person he knows as Andre West.
