A District Court commissioner has ordered that jet noise critic Michael Monson stay away from Realtor Joe Mosolino. The order for protection from harassment was requested June 6 but was made final this past Friday. Court Commissioner Linda Kipling ordered Monson to

refrain from contacting Mosolino, a Realtor with Windermere Real Estate on South Whidbey. Monson must stay 300 feet from Mosolino’s residence and 30 feet from his person at all times, according to court documents. Monson has been a vocal critic of Mosolino for leaking what he considered confidential information on the Whidbey News-

Times website in January. An increasingly vocal opponent of the Navy’s touch-and-go operations at Outlying Field Coupeville, Monson claims that his brokerage, Windermere, did not offer him a noise disclosure to sign when he purchased his home near the field. A rape suspect who was caught hiding on North Whidbey June 14 after a brief manhunt has been charged in Island County Superior Court. Prosecutors charged Douglas L. Blackburn, 50, in Island County Superior Court Wednesday with third-degree rape and unlawful imprisonment with sexual motivation. Both were charged as domestic-violence-related crimes. If convicted of the charges, Blackburn could face up to a year and eight months in prison, plus an additional year for the “sexual motivation enhancement.” Blackburn is being held in jail on $150,000 bail. Deputies were first alerted to the alleged rape and kidnapping by a 911 hang-up call from a Moran Road residence. Blackburn is accused of holding his ex-girlfriend against her will inside a travel trailer in a secluded North Whidbey area for nearly a week; the 42-year-old woman claimed he raped her repeatedly, according to the report by a detective with the Island County Sheriff’s

Petty officer will attempt world pullup record A petty officer stationed at Whidbey Island Naval Air Station will attempt to break the Guinness World Record for “Most Pullups in 24 hours” on July 26. Mike McCastle said he is performing the feat to raise awareness and funds to assist service members who have been injured in the line of duty. All proceeds from the event will be donated to the nonprofit organization Wounded Warrior Project, and will support a full range of programs and services for this generation of injured veterans and their families. “It’s not about the record,” said

McCastle in his new release. “It’s not about the war. It’s about the warrior. Twenty-four hours of discomfort does not compare to the sacrifice our wounded service members and their families make every day.” The event will be held at Fort Nugent Park in Oak Harbor at 6 a.m. when McCastle will begin performing pullups for 24 hours straight in an attempt to break the current world record which, according to Guinness, is 4,030 set by Navy SEAL David Goggins. The event will host live music, vendors, a raffle and other activities to help

raise awareness and donations in support of the Wounded Warrior Project. More than 47,000 servicemen and women have been injured in the recent military conflicts, according to a news release from McCastle. In addition to the physical wounds, it is estimated as many as 400,000 service members live with the invisible wounds of war including combatrelated stress, major depression, and post-traumatic stress disorder. Another 320,000 are believed to have experienced a traumatic brain injury while on deployment.

A motley crew of Oak Harbor residents spent Saturday afternoon covered in mud, erecting a wall that will protect a new community garden from northern winds this winter. “This is the fun part,” said Michael Zylinsky, one of the garden’s creators. The Imagine Permaculture Food Forest, a self-sustaining urban garden on Bayshore Drive, started in January and has bloomed into a cornucopia of flowers, vegetables and other sustainable plants. Its purpose is to provide a place

where anyone on the island can find fresh food. Volunteers began building a straw-bale cob windbreak Saturday and will continue the project this coming Saturday. Navy wives Brandy Moore and Danielle Hogan heard about the project through the SPIN Cafe where they hold their couponing group. “It sounded like fun,” Moore said. Michael Lemas brought his two sons, Levi, 3, and Dylan, 11, after he heard about the project by “word of mouth.” “We just wanted to come and help out,” Lemas said.

The cleanup project was required after tests showed that the soil and groundwater on the property was contaminated by petroleum following several fuel line releases in 1989. As part of a 1993 agreement with the state, Milton Woods, Dundee’s father, replaced fuel lines and an underground tank. The state would handle the cleanup once funding became available, which happened last year. As part of the project, a new steel seawall was installed to replace the aging, deteriorating bulkhead. The Department of Ecology was concerned that the old seawall would fail, allowing contaminated soil to

enter Cornet Bay. To get at the contaminated soil, Glacier Environmental Services, the general contractor hired for the project, had to lift the general store off its foundation and temporarily move it. During that process, it was revealed that the store’s wooden floor had deteriorated beyond repair, so it was replaced. Truckloads of soil were hauled off the property. The plan was to remove an estimated 8,400 cubic yards of soil. Once the dust settled, the result exceeded Woods’ expectations. His mother, Tuulikki Woods, who works at the store on Wednesdays, was busy Monday, watering plants while a fire burned in an outdoor pit and an American flag waved on a

new 40-foot pole built by a friend using a log found floating near Hope Island. “It’s exciting,” she said. “It feels good that there’s new soil in the ground.” Dundee Woods said he estimated that there was new dirt at a depth of 15 feet underneath him, with a 6-inch cap of gravel. The only blemishes from the project are subjects of amusement. A dog’s paw prints can be seen in the concrete walkway, and the walls of the refurbished bathrooms seem to be lacking insulation, which became more noticeable when the office and was moved to that side of the building. More insulation is coming, Woods said. “It’s a fun place to work,” Tuulikki Woods said.

John Vanderzicht Memorial Pool in Oak Harbor normally shuts down for about two weeks in August for general maintenance. But this year is different. Recently, a pump for the pool broke and needed replacing. North Whidbey Park and Recreation officials shut down the pool for a couple weeks while they waited for the replacement pump to arrive. During that time, all the maintenance scheduled for the summer was completed, according to Gino Wolfe, the director of North Whidbey Parks and Recreation, and the pool will no longer need to shut down in August. “We just had a closure, had something come up, had to shut down, so we took advantage of it,” Wolfe said. During the regularly scheduled closure, the district performed general, overall maintenance, according to Wolfe. At June’s monthly board meeting on Thursday, June

19, a report from maintenance supervisor Matt Morris states that during the 14-day shutdown, the maintenance performed included draining the pools, washing the pools, decks, diving board, walls, drain holes and entryway, replacing the showers in the women’s locker room, replacing two pool valves and, of course, replacing the big pool’s pump. According to Wolfe, the work included all the maintenance that needs to be done on a yearly basis. He said that the early shutdown does not necessarily mean that next year’s regularly scheduled shutdown will be sooner than August. He also said that summer swim classes will “most likely” continue during the two weeks in August that the pool would normally be closed but that the board is still “working on getting stuff together.” The pool’s summer schedule, which starts June 30, is now available online at www.oakharborpool.com, but there may still be tweaks made to the schedule, according to Wolfe.

Garage sale of the ages The 35th annual Coupeville Lions Garage Sale, which features thousands of donated items collected throughout the year, is Saturday, June 28 and Sunday, June 29 at Coupeville Elementary School. The club fundraiser, which raised more than $40,000 last year, is a widely-anticipated central Whidbey Island event. A preview is 1-6 p.m. Friday, June 27. The sale runs from 9 a.m. to 4 p.m. Saturday, June 28 and 9 a.m. to 1 p.m. Sunday, June 29.

Cleanup work completed at Cornet Bay As Dundee Woods marvels at the freshly paved walkways, new stainless steel railings and modern bathroom fixtures at the Deception Pass Marina, he sometimes forgets that the most significant change is right under his feet. “I am so impressed by the facility. I forget that I’m walking on new, unspoiled soil,” Woods said. “I’m not walking on contaminated soil anymore. Sometimes, I lose sight of that.” Woods gushes with praise over how the state Department of Ecology and Glacier Environmental Services handled the soil removal and groundwater cleanup project on his family’s marina property at Cornet Bay. The immense project, estimated at a cost of more than $1 million, took six months and caused the Woods’ fuel pumps for boats and general store to be shut down. With the fences that surrounded the property taken down last week, Woods wants to reopen the Deception Pass Marina store by the Fourth of July and is planning a soft opening for July 1. Giving Help House a fresh look By MICHELLE BEAHM Staff reporter

A

crew from Oak Harbor Windermere Real Estate leapt to action this past week to lend a helping hand to North Whidbey Help House. The volunteer crew arrived Friday to paint, do yard work and just “freshen up” the place, according to Annie Cash, the Windermere employee who organized the event. The annual community service day, held the third Friday of June, started in 1984. Cash, a real estate agent with Windermere for seven years, said she called local nonprofits to find out which of them most needed work done. She said Help House qualified and needed help. “We try to find someplace that wants our services, and we come out and spend the afternoon doing whatever they need,” said Debbie Merritt, a real estate agent with Windermere. “Help House wanted paint and some yard work done, and that’s what we’re doing.”

July 7, 1977, Wieman said. Wieman said Help House feeds about 587 families each month. The food bank is open Monday through Friday, and people can come twice a week for food. Help House receives food donations from the commissary on Whidbey Island Naval Air Station, Safeway, Albertson’s and other sources. “My favorite thing to say to people is, ‘Everybody remembers who we are during the holidays, but people are hungry 365 days a year,’” said Wieman. Windermere’s community service day is “huge” for Help House because the

agency relies so much on volunteers, she said. Help House has a staff of four, one of which is a part-time employee, so volunteers take on much of the work there. “I have a core group of about 10 volunteers who show up every week, have a regular shift to work here,” Wieman said. “So to get something of this magnitude done is incredible.” The best part about the community service day is “giving back to the community … doing something to help our community,” Merritt said. “It makes you feel good to volunteer.”

BUSINESS CHATTER When Jessie Tamayo was looking to relocate her Asian fusion-style restaurant to a different city, she kept coming back to Oak Harbor. She and her son will open Tamayo’s restaurant July 2 on Pioneer Way, filling the space vacated by Kakies Bakery, which closed in the spring. Tamayo has visited Oak Harbor over the past eight years, and when she decided she wanted to open a new restaurant, she began researching the waterfront city. “There were too many things,” she said, emphasizing the nice, helpful people she encountered. Tamayo, who recently closed her Saffron Deli & Pho restaurant in Issaquah, can’t wait for Whidbey Islanders to try her Southeast Asian fusion-style cuisine from her own recipes. She calls the dishes a blend of Lao, Vietnamese and Thai cuisine. She’ll be open for lunch and dinner from 11 a.m.8:30 p.m. seven days a week. Tamayo’s is located at 800 S.E. Pioneer Way. “I want so bad to let people try my food,” she said. Tamayo’s will be the second restaurant along Pioneer Way to open in a 10-day stretch. Hot Rock Pizza opened Monday in the spot formerly occupied by Cameron’s Cafe at 830 S.E. Pioneer Way. The pizza restaurant is open from 11 a.m.-8 p.m. seven days per week.

‘Voice’ star performing Saturday A fundraising concert featuring singer Austin Jenckes will be performed Saturday night at the Roller Barn in Oak Harbor. Jenckes, who recently was featured on the NBC TV singing competition, “The Voice,” will perform the solo concert at 7:30 p.m. The 25-year-old singer and songwriter from Duvall is described as a folk-rock power singer. Jenckes made it all the way to the “live rounds.” The concert is a fundraiser for the Oak Harbor Music Festival, which takes place Aug. 29-31. This will be the third year of the music festival, which takes place on Pioneer Way in downtown Oak Harbor. The festival was originally known as the Oak Harbor Music and Jazz Festival, but the name was shortened. More than 20 bands from across the nation per-

So it’s no surprise that when we think about domestic violence interventions we think about police, courts, and hospitals. But what about the role each of us can play? Many of us have either experienced abuse in our own relationships or know someone who has. And often we don’t know what to do about it. Fortunately, in this community, and in every community across Washington State, there is a local domestic violence program: a place where anyone can call—privately and at no cost—to talk with someone about concerns, options, and safety. But what if we didn’t have to wait until things were awful to intervene? What if we could stop this violence before it started? Ethics Board looks at fine line around lobbyist meetings THE PETRI DISH

By JERRY CORNFIELD Amid the dialectic contours in Olympia, they are trying to figure out if influence can be peddled with a few bags of Doritos or a $12 meal. A panel empowered to guide elected leaders along a righteous path is struggling to draw clear ethical boundaries for lawmakers when dining and drinking with lobbyists. State lawmakers are allowed to “accept gifts in the form of free food and beverage on infrequent occasions” if it’s related to their official duties. But existing law doesn’t define “infrequent.” Pressure to come up with a definition arose following revelations that a handful of legislators regularly dined on lobbyists’ dime during the 2013 session. Several of them may have done so while collecting taxpayer-funded per-diem payments, according to research compiled by reporters for a public radio station and Associated Press. The Legislative Ethics Board, a panel of lawmakers and legal minds, is trying to provide clarity on the rules, but members are thus far unable to agree on whether “infrequent” should be defined in terms of a specific number of meals. Also, they are wrestling with what exactly constitutes a meal and at what point must lawmakers report them. Right now, legislators must report whenever they are treated to meal worth more than $50. That brings us back to a recent meeting of the Ethics Board and a confession from Rep. Drew Hansen, D-Bainbridge Island, that a bag of Doritos can be a meal for him. He wanted to know how many bags of Doritos a lawmaker can accept from a lobbyist before it becomes a meal that must be reported as a gift. The answer he got from the board counsel was that it’s not crystal clear, but if he gets $50 worth all at once, it likely needs to be declared. That didn’t sound like a problem to Hansen, who endorsed limiting lawmakers to an average of one free meal per week and to report those exceeding $5 in value. Lack of awareness is Democrats’ downfall

Editor, The Democratic Party is completely out of step with the people of America. But, I prefer Democrat. After eight years of George W. Bush, and now six years of President Barack Obama, our nation is still involved in war, still torturing innocent people, still favoring Wall Street, still without a public option for health care and still ignoring polluters. The real problem is clearly Democrats’ inability to listen to their critics. Instead, they call people names. Name calling, like “birther” or “truther,” does not address the questions that 30 percent of Americans are raising about their nation. Now, with the war machine ramping up yet again, many Democrats are silent on the deadly noise and air pollution that is in our skies over Whidbey. The Seattle Times reported that 27 million marine mammals will be killed by the Navy/Air Force testing in the Puget Sound, yet our Democratic leaders are silent on this issue. Legalization of recreational use of

marijuana passed 16 months ago, but still no dispensaries have been licensed. That is a potential loss of $500 million in state revenue. The Democratically led Washington legislators have amassed a $90 billion state debt. That is a $75 billion waste over five years of overspending. Need I continue? When I complained at Democratic meetings about the War in Iraq, I was told to “Shut up.” They then ratified the war. When I questioned excessive spending about road work like railing along Deception Pass State Park costing $1,000 per linear foot, I was told to “Get a life.” This Democratic Party is completely unresponsive. So it does not surprise me that they will not endorse my candidacy for State House of Representatives. Now it is up to the voters to say, “Enough is enough.” I will gladly represent their concerns in Olympia. As an independent, I can work both sides of the isle and find compromises. The incumbent just knows how to spend, spend, spend. We never needed another overpriced ferry at Keystone. We need accountability from government waste. We never needed a septic inspection on homes — there is no proven science

behind it. Ninety percent of homeowners are not complying. It is a tax that no one voted on. I will work to repeal it. I assure you, I am not the person people are describing in the press. I am not a racist. I am a man who supports our Bill of Rights. Until people realize how far off track our nation is, we will never restore our nation to fairness and solvency. Transportation is an essential GUEST COLUMN

All too often, our network of highways, pipelines, railroads, barges, ship terminals and airports goes unnoticed unless there is an accident. For example, we don’t notice the trains delivering the chlorine that purifies our drinking water. We pay little attention to the trucks transporting gasoline for our cars and propane tanks for backyard barbecues. The fact is without trucks, trains, pipelines, barges, ships and airplanes, we couldn’t survive. They transport everything we use every day, and some products are potentially dangerous. Thankfully, shippers must abide by hundreds of federal, state and local safety regulations. Enforcement of those rules helps protect us, and well-trained first responders save us. Each year, the U.S. Dept. of Transportation publishes information on shipments across America. In 2012, that network moved about 54 million tons of freight each day, worth nearly $48 billion. Half of these goods are moved close to home, transported less than 100 miles. Trucks are the workhorses in our system. Short-haul truckers move 84 percent of goods transported less than 100 miles and long-haul

truckers carry 34 percent of freight transported more than 2,000 miles. Railroads dominate mid-range shipments, from 750 to 2,000 miles. For Washington, a viable transportation network is crucial because our economy depends on international trade. In fact, our state has the highest per-capita trade-related income of all 50 states. So what’s the problem? We need to upgrade our state’s highways and roads. We have traditionally relied on the gas tax to fund this work, but as cars become more fuel-efficient and electric cars become more popular, drivers are buying less gasoline. As a consequence, the gas tax is no longer producing enough revenue to fund the highway system. Building and maintaining highways, bridges and transit systems is extremely expensive. Lawmakers are wrestling with a variety of funding options, including tolls, taxes, fees and regulatory reforms. Unfortunately, it does not appear Congress or our state legislature will pass a transportation funding package this year, or even next. Contrast that uncertainty to the Burlington-Northern Santa Fe Railroad, which has invested $42 billion since 2000 to improve infrastructure, equipment, technology and emergency response training, including a record $4 billion last year. BNSF plans to invest a record $5 billion in 2014. BNSF understands that its future depends on upgrading its transportation network and operations. The same is true for our state and our roads. Unfortunately, waning revenues

During the public hearing portion of the meeting, one lawmaker argued those kinds of changes would undermine the ability of citizen legislators to serve. State Rep. Matt Manweller, R-Ellensburg, told the panel that dining with a lobbyist may be the only time someone of his limited financial means can learn nuances of bills. He said he was offended at the notion he could be “influenced by a $12 hamburger” and worried the ethics panel would “cre-

ate a system where rich people sit down with other rich people” to dictate legislation. and legislative wrangling aren’t the only problems affecting our transportation network. Some fossil fuel opponents are attacking anything and everything related to the production and delivery of fossil fuel. As part of that agenda, they want to stop rail shipments of oil and coal, block construction of export terminals and stop expansion of the Keystone Pipeline. The activists’ most recent target in Washington is the trains that would carry low-sulfur coal from Wyoming to proposed export terminals on the Washington coast. They claim that rail traffic is unsafe. Not true. The truth is that rail transportation is the safest, most cost-efficient and environmentally sound way — by far — to move freight. It is approximately four times more fuel-efficient to move freight by rail than by truck, and moving hazardous material by rail is 16 times safer than moving it on the roads. Ironically, if the activists get their way, they will be pushing tons of hazardous freight onto our overcrowded highways. How will that make us safer? While we need to ensure that goods are moved safely, the point is that everything we eat, wear and use must move from where it’s produced to where it’s sold. tained that their inability to collect fares from their riders, in any way, shape or form other than via local sales taxes, is absolute. Island Transit incessantly drummed that theme each of the three times they came to the voters asking for 3/10th of 1 percent sales tax to fund their maintenance and operations, until they maxed out at 9/10th of 1 percent local sales-tax funding. Therefore, when I read in the online comments section of the newspaper ignorant statements like: “I think it’s shameful Island Transit does not charge one cent for a ride,” “Users of the bus service should pay for the service,” “Free ride is over” or “Pay the full cost through your ticket purchase,” it’s apparently past time to remind folks how the current “fare-free” structure came to be and how adamantly Martha Rose has always maintained that Island Transit can never collect fares from its ridership. We should ensure she is held to her word, forever. We should now endeavor to ensure Island Transit remains “fare-free” ad infinitum. If, for some reason, ongoing, perennial “fare-free” ridership is not possible with 9/10th of 1 percent local sales-tax funding, Island Transit’s business model is a failure; it can cease operations and local sales can be decreased by 9/10th of 1 percent. Howard “Al” Alan Parker

Howard “Al” Alan Parker, 63, of Coupeville, Wash., passed away June 10, 2014 in Bellingham, Wash., due to multiple organ failure. Al was born July 10, 1950 in Cleveland, Ohio, to Howard and Jean Parker. He and his wife, Melissa, were married in 1989. Al lived in Arizona, California, Washington, Ohio and Pennsylvania. He has an associate degree in business from Skagit Valley College, and served in the Army for three years, one year in the Air National Guard, 19 years in the Navy Reserve as a TAR during Vietnam, and the Gulf War.

He was a project manager for Libby-Owens-Ford, Huntington Banks and a retired Naval Chief. Al was a member of the Central Whidbey Sportsman Club and the NRA. He had several hobbies, such as making tapes WBBOK. He loved music of the ‘40s and ‘50s and enjoyed old movies and trivia. He loved to entertain at home and loved ‘50s Westerns. Al is survived by his wife Melissa; step-daughters Sarah (Mike) Duncan of Lancaster, Ohio, and Katie (Josh) Hornik of Hilliard, Ohio; three grandchildren, Nora Duncan, Levi Hornik and Rozlyn Hornik; sister Marlene Hoffman of Ravenna, Ohio; mother-inlaw Nancy Morehart; sistersin-law Sue (Paul) Peck and Rebecca (Kevin) Hawkins; and many nieces, nephews and cousins. Al is preceded in death by his parents, Howard and Jean Parker; father-in-law Calvin Morehart; and brother-in-law Arlan Hoffman. Joyce loved gardening and beach walks on Guemes Island, travel and socializing with her friends. She was involved in many community activities and had a radiant smile that could light up a room. She is survived by her children, Jayne Mardesich of Anacortes and Jay Webber of Bellevue; and brother Richard Kilgore of Mandeville, La. She is also survived by five grandchildren, Brendan, Matthew and Nikolas Mardesich and Jamie and Catelyn Webber, all of whom live in the area and brought great joy to her later years. Babe Ruth team dives into district tournament By JIM WALLER Sports editor

After a sluggish start, the Oak Harbor Babe Ruth baseball team is hitting its stride at the right time. Oak Harbor, which began the season by losing six of its first eight games, recently rattled off six straight wins to up its record to 8-6 heading into the district tournament at Burlington’s Rotary Fields. It opens district play at 5:30 p.m. Wednesday, June 25, against Burlington. Oak Harbor enters as the fourth seed; Burlington is seeded third. The second round of the fiveteam, double elimination tournament is at 5:30 p.m. Thursday, June 26. The Oak Harbor Babe Ruth program was started 20 years ago to develop players for the high school team, and first-year coach Pete Richter is following that philosophy: “Ultimately, we strive to prepare players for success at the high school level.” The makeup of the Babe Ruth league changes each year, but usually features teams from area cities such as Anacortes, Stanwood and Burlington and offers a level of competition above intra-city leagues. Richter is looking to increase participation. We hope to spark a desire in younger players, 9 to 12, to be on this team. Once the roster was filled out, Richter said, the goal changed to improving play: “Now, we expect the kids to perform better than when we first got them; even minor improvements every day is what we strive for.” Richter’s coaching philosophy is centered on fundamentals, “coaching proper technique and readiness to execute on the field.” He and his staff, assistants Shawn Trisler and Jake Neumiller, emphasize understanding the game and knowing what to do before the pitch is delivered. It took some time for the players to learn a new system and for the younger players to adjust to playing on a full-sized diamond. “The team got better with more practices and time together,” Richter said. “They soon learned that they had the talent to compete at this level.” Once the fundamentals and confidence were in place, the team went on its winning streak. The team includes 14 players; five are from Coupeville. The 14-year-olds are James Besaw, Will Danielson, Drew Eaton, Josh Margraf, Kamren Mebane, Mackenzie Nuanez, Hunter Smith and Chris Trisler. Thirteen-year-olds Thomas Anderson, Gabe Eck, Ty Eck, Caleb Fitzgerald, Joey Lippo and Jake Pease round out the roster. Smith, Lippo, Pease and the Ecks are from Coupeville. The Coupeville kids “have been great,” Richter said. “They need a Babe Ruth team to play on and we need the numbers, so it was beneficial for all. I think that it helps because the kids get to make friends with players that they would normally not get the opportunity to know.”

GOWDEY PLEA CONTINUED FROM A1 about what to tell investigators are completely fabricated. Moreover, he said he will “sue the living piss out of everyone involved” in the criminal investigation against him. And then he hopes to go back into law enforcement — and may be able to — even though he’s been dogged by trouble for much of his career. He was investigated for domestic violence allegations twice before and was the subject of internal investigations at least four times, according to documents the Whidbey News-Times obtained through public records requests. He’s always vigorously defended himself and come up on top, for the most part. GOWDEY WAS set to go to trial in Island County Superior Court on felony charges of unlawful imprisonment and witness tampering Tuesday, but instead pleaded guilty Monday to a gross misdemeanor charge of disorderly conduct for a separate incident. He spent a day in jail but won’t have to do any more time under the deferred sentence. “I am agreeing to this recommendation from the state as a way to end this injustice towards myself,” he said in an interview after court. “I am in no way agreeing that I committed any crimes that the state contends that I did on the evening of April 3, 2007 on Madrona Way.” UNDER THE plea agreement, Gowdey admits that he swore at the woman during an argument in the Coupeville Town Hall parking lot that preceded the

alleged incident on Madrona Way the same night. He was on duty and in uniform at the time. Gowdey said in an interview that he did meet the woman on Madrona Way, but denies that he handcuffed her or dented her car. Gowdey claims Detective Sgt. Teri Gardner, who was since promoted to captain of the Oak Harbor Police Department, lied in her report when she wrote that Gowdey admitted he may have dented the woman’s car and that he couldn’t remember whether he handcuffed her. He denies that he coached her on what to tell investigators. “She is a jealous ex that exploited her relationship with Detective Gardner to make up this story to cause harm to myself and family,” he said, adding that his exgirlfriend and Gardner are friends. CHIEF CRIMINAL Deputy Prosecutor Eric Ohme said in court that the felony charges against Gowdey would be “extremely difficult to prove” given that the judge ruled that the defendant’s statements in an interview inadmissible. Detectives tricked Gowdey into making comments through a fake internal investigation; Judge Alan Hancock ruled that the tactic was inappropriately coercive and his statement could not be used against Gowdey. Ohme said prosecutors didn’t even know about the police department’s internal investigative ruse until Skinner interviewed witnesses. Due to the suppression of Gowdey’s statements, he

said, “the state was left without its main corroborating evidence.” IN ADDITION, the victim was “ecstatic” with the resolution, Ohme said. “The victim did not want the case to go forward,” he said. “She did not want Mr. Gowdey to be convicted of a felony and she did not want him to serve any jail time.” In her victim impact statement, the woman was very critical of the Oak Harbor police for pursuing the investigation against Gowdey, claiming they were “motivated by ego, not justice.” She wrote that what Gowdey did was “frightening, intimidating and wrong,” but that she has forgiven him. Judge Hancock agreed with the recommendation. He sentenced Gowdey to 90 days in jail with 89 days deferred and credit for a day in jail; he won’t have to serve the additional time as long as he pays court costs, doesn’t break any laws and has no contact with the victim for the next year. “Mr. Gowdey abused his office, it’s fair to say,” Hancock said. HANCOCK OPINED that the case may spell the end to Gowdey’s career in law enforcement, but Gowdey said he hopes that is not the case. It will be up to the Washington State Criminal Justice Training Commission to decide whether his peace officer certification will be revoked. He won’t be a cop in Coupeville anymore. The case against Gowdey started because the Island County Sheriff’s Office took over the Coupeville Marshal’s Office; Gowdey was guaranteed a job with the sheriff’s office if he passed the background check. tigation into the incident in which Gowdey swore at the woman; Gowdey had admitted acting inappropriately and had been disciplined. But the woman, who has since broken up with Gowdey, told Mauck there was more to the story; she now claimed Gowdey had handcuffed her on the side of the dark road and later asked her not tell investigators about it, according to the police report. The Oak Harbor police initially investigated the criminal allegations that Mauck uncovered, even though the woman worked at the police department. The case was later forwarded to a Snohomish County detective. As a result of background investigation, the sheriff denied Gowdey a job in the department. THE CASE marks the third time that Gowdey faced criminal investigation for domestic violence, according to court records and documents the Whidbey NewsTimes received from the Town of Coupeville and the Island County Prosecutor’s Office through public records requests. Gowdey vigorously defended himself each time and has never been convicted of domestic violence. He was tried and acquitted of domestic violence 15 years ago in Issaquah in a case involving his ex-wife. Gowdey was investigated for an alleged sexual and physical assault in late 2012, but the Island County Prosecutor’s Office declined to file charges for “seconddegree assault with sexual motivation, domestic violence,” because of insufficient evidence, according to documents. A neighbor of Gowdey’s girlfriend reported that he had been shouting, swearing and using “demeaning language” toward the woman, according to a report written by former Marshal Lance

The woman’s son later reported that Gowdey assaulted him and his mother; he claimed his mother told him that Gowdey had assaulted her in a sexual manner, according to a report by a detective with the Island County Sheriff’s Office. Gowdey and the woman both denied the allegations. IN ADDITION, Gowdey was the subject of several internal investigations over the years. A detective from the Jefferson County Sheriff’s Office also conducted an internal investigation of the boy’s allegations that Gowdey had assaulted him and his mother. As with the criminal investigation, the detective reported that the woman denied “the attempted rape” and denied any domestic violence; she wrote that the boy was not a reliable witness. “My experience and knowledge tells me (the woman) and Gowdey are engaged in a domestic violence relationship,” the detective wrote, “but without the assistance of the victim, law enforcement cannot become involved.” Gowdey told the detective that he may have argued with his girlfriend, but that he never assaulted the woman or her son, the report states. Former Marshal Lance Davenport found that allegations were either unfounded or not sustained. In addition, Gowdey testified during an evidentiary hearing that he worked as an officer in Oroville for two years, but lost his job for lying to his boss. Gowdey worked in the City of Snoqualmie for six months before coming to Coupeville, where he worked for nearly 14 years. FORMER MARSHAL Lenny Marlborough disciplined Gowdey for the 2007 incident in the Town Hall parking lot. Gowdey

lost some vacation and was required to get anger-management counseling, personnel records show. In 2011, former Marshal Dave Penrod had an Anacortes police detective complete an internal investigation of Gowdey on four issues of misconduct, all of which were sustained. In the first one, Gowdey was away from his radio and wasn’t reachable by cell phone for an extended period in December of 2010, prompting two sheriff’s deputies to “run code” to come to his aid. They found him walking back to his patrol car, which was parked near the apartment of a woman he was in a relationship with. In the second issue, radio logs and GPS records “appeared to indicate” that he spent a significant amount of time parked near his girlfriend’s apartment while he was on duty, “thereby establishing a significant pattern of non-productive work time,” Penrod wrote. The third issue was that Gowdey left Coupeville while on duty on a number of occasions to go to his home in Oak Harbor without notifying the dispatch center. He said he was taking his allowed breaks at home. The fourth issue, the documents show, was that Gowdey drove from Oak Harbor to Coupeville in excess of 120 mph for “a non-emergent call.” The Anacortes detective called the speed excessive, documents show. Penrod initially imposed significant discipline for the findings of misconduct, but Gowdey filed a grievance. Coupeville Mayor Nancy Conard revised the discipline to include a warning letter for two of the incidents and withdrew discipline altogether for two of the issues, the records show.

Art galleries foster a cooperative spirit Membership with cooperative galleries has its privileges, if you can make cut By RON NEWBERRY Staff reporter

Jeanne Valdez laughs when she thinks back to the frantic days leading up to Garry Oak Gallery’s opening. Valdez wanted to open a cooperative art gallery in Oak Harbor, and an opportunity arose when a visible space became vacant in historic downtown. “We had a month to put it together,” Valdez said. Over the next four chaotic weeks, Valdez, Margaret Livermore and Joan Brosnahan got the word out about the Oak Harbor gallery, assembled a group of artists and went to work getting the space ready for customers to view. On Oct. 1, 2008, Gary Oak Gallery opened its doors on Pioneer Way with 27 artists. The effort was collaboration at its best, embracing the spirit of what a cooperative art gallery is supposed to be about. Nearly six years later, the gallery operates the same way with each of its artists equally invested in the gallery’s success. Now numbering 22, Gary Oak Gallery artists share the rent, labor and their time to keep the gallery’s doors open. Garry Oak is one of four cooperative galleries on Whidbey Island, joining Penn Cove Gallery in Coupeville, Artworks Gallery in Greenbank and the Whidbey Art Gallery in Langley. “I love the gallery,” said Sue Swapp, a pastel artist from Anacortes who has been a member of Gary Oak Gallery for two years. “I found it to be a very classic looking gallery. It’s a good cooperative group. It works well.” Swapp spends about two days a month tending the gallery in Oak Harbor. Each artist is assigned specific days to staff the gallery and

To join a cooperative art gallery, a candidate must go through a juried process where they are interviewed by a committee and their art is judged by their peers. At Garry Oak, certain artistic qualifications must be met. “It’s kind of like applying for a job,” Valdez said. Once accepted, the advantages can be many. Chiefly, artists are able to sell their art without having to be onsite except for once or twice a month. Artists pay monthly dues and are charged a commission on sales, with proceeds going back into the gallery. “In this economic time, cooperatives are the way to go,” said stained-glass artist

The disclosure form signed by Monson was a one-paragraph document intended for building projects not real estate transactions, and did not include language required by the county’s noise disclosure. Monson is president of the Citizens of Ebey’s Reserve, or COER, a group that sued the Navy last year over jet noise and is demanding the closure of OLF Coupeville. “As a leader of the COER group, and the self-purported honest man he is, we should see a retraction of his statements and a correction on his website any moment now,” Mosolino posted on the Whidbey News-Times website in January. In return, on the COER website, Monson accused Mosolino of attempting to “smear” his reputation. Mosolino filed for the harassment order after Monson followed him around at a June 3 campaign reelection event for Congressman Rick Larsen in Coupeville. Mosolino wrote in his court filing that Monson approached him at the event, grabbed his hand and began to “shake my hand vigorously and would not release my hand.” Monson then said, “How did you slither in here?”
