A $12.3 billion transportation proposal introduced by the Washington State Senate Coalition last weekend would effectively eliminate the need to toll I-90.

The sidewalk was still slippery on the corner facing the Mercer Island Dentistry Building last week. The building was the end point of a high speed chase that began in the eastbound express lanes in the I-90 tunnel just before midnight on Friday, Nov. 8.

The speeding luxury sport vehicle hit the building after it exited I-90 onto Island Crest Way. It then caught fire.

A few days later, the sidewalk in front of the building was still coated with a fine sheen of oil and a wide swath of yellow fire retardant was evident in the street. Sharp metal pieces of the car were still scattered about.

A large piece of plywood covered the building from the corner, placed there after a call to a business via 1-800-Boardup.

The Porsche caught fire, but Kern and his female passenger, a 36-year-old Issaquah woman, were able to get out. They had minor injuries. They remained on scene, according to WSP, and were taken to Overlake Medical Center.

The state trooper and Mercer Island Fire Department kept the fire from spreading to the building with the assistance of firefighters from Bellevue.

Kern is facing DUI, reckless driving and vehicular assault charges, which Trooper Chris Webb said is due to the injuries sustained by the passenger.

The Bellevue man is the confirmed owner of the luxury car which Webb said are marketed at $75,000 to $175,000.

• The definition of plastic bags include any carryout bag made from plastic or any material marketed or labeled as “biodegradable or “compostable” that is neither intended nor suitable for continuous reuse or that is less than 2.25 mils (0.00225 inches) thick.

• Several uses of bags are exempt due to the definition of “carryout bag,” including, bags used inside stores to package or wrap bulk items, meat or fish, produce, and baked goods.

• Pass-through charge

for recyclable paper bags are included.

• Retail establishments may provide recyclable paper bags as long as a minimum fivecent “passt h rou g h” charge is charged for each bag.

Retailers will collect and keep the funds to offset the cost of paper bags.

• Retailers cannot collect the charge from customers on public assistance programs.

• Enforcement. A violation of any provision of the ordinance constitutes a class I civil infraction.

Under current state law, the maximum penalty

for a class I civil infraction is two hundred fifty dollars ($250).

Each day of continued noncompliance constitutes a separate civil infraction.

• Food banks and food assistance programs are exempt.

• Effective date. The ordinance takes effect on April 22, 2014, Earth Day.

If approved, Mercer Island’s plastic bag ban will take effect on Earth Day 2014.

“Mercer Islanders care about the environment and this is a small step we can take to reduce our environmental impact and raise awareness around these issues, Bassett said.

If the ordinance is formally adopted, staff will launch an outreach campaign to explain the details to retailers and an accompanying public education campaign to explain the new rule to the public.

The Porsche was already at the East end of the floating bridge when the trooper activated his emergency lights.

The trooper did not match the speed of the Porsche, Webb said. “Our patrol cars have governors, which are devices that won’t allow the vehicle to go beyond a certain speed.”

It appeared that the trooper briefly lost sight of the Porsche in the Lid but then observed the vehicle exit onto Island Crest Way. It appeared that the Porsche did not slow down until entering the curve in the Lid. WSP is in the process of preparing a speed estimate but that will be in the final report, Webb said.

“Fortunately, the traffic was light,” Webb said. He believed that the trooper only passed one other vehicle before exiting to Island Crest Way. The trooper followed the car, onto Island Crest Way then came upon the crash scene.

The vehicle was smoldering when the trooper arrived, just seconds after the collision. After getting the passenger and driver away from the vehicle, the trooper got out the fire extinguisher from his own car to tamp down the flames. He was soon joined

by Battalion Chief Les Kenworthy from Station 91.

However, a few minutes later the fire erupted and the car was engulfed in flames coming from the engine compartment. But by that time fire trucks from both Mercer Island and Bellevue had arrived.

Calls had already gone to for regional fire and emergency assistance. According to Mercer Island Deputy Fire Chief, Steve Heitman, both Station 91 on the

North-End of the Island and Station 92 on the SouthEnd, were out responding to calls about flooding.

At the same time, Battalion Chief Kenworthy, still on duty at Station 91 and took the command vehicle and drove to the crash, took out a fire extinguisher to help the trooper put out the flames.

Units from Bellevue were automatically dispatched to assist. Station 92 immediately changed their status and arrived at the scene at 11:41 within four minutes of the initial call. A unit from Bellevue was on the scene by 12:03 a.m.

Heitman said that he does not doubt that the initial actions of the trooper and Kenworthy kept the car fire from spreading to the building.

A video from the WSP vehicle shows that the driver had an obvious leg or ankle injury as he was limping significantly. The passenger appeared shaken but fine; as it turned-out she had more significant injuries, Webb said.

The trooper was eventually contacted by at least three other troopers and a supervisor who arrived at the crash site. It took several hours of investigation before they were all clear of the scene.

David Omli, who owns a restoration and construction business in Seattle received a call from the Mercer Island Fire Department at 2 a.m., via 1-800-Boardup. Omli sent out a crew who secured the building and placed the board over the damage.

Omli said that the damage to the exterior wall, windows, interior finishes and minor structural damage is estimated at $10,000.

The suspect admitted to drinking alcohol and the trooper’s observations confirmed that the driver was likely DUI. He was booked into KC Jail. Dan Donohoe of the King County Prosecutor’s office, said that charges are still pending.

There is power in numbers

kay folks, this is it.

We have been trying to tell Washington State Department of Transportation (WSDOT), the Federal Highways Commission and anyone that would listen, that tolling I-90 would be grossly unfair to Islanders.

Aside from parsing whether or not tolling is legal or appropriate, here is the way we can show how tolling would affect us.

Finally, we have some control.

Here we can put numbers behind how the imposition of tolls will affect us.

There are both direct and more subtle effects. The first effect is monetary. We will have to pay more because of where we live. And a second, less easily quantified is the impact of how many trips might be skipped or changed. Every time we turn the key in the ignition — when we must get to the doctor, drive a child to school, pick up someone at the airport, get to work, ferry a team to sporting events or drive to care for a loved one or an ill or injured person at the hospita — we must consider delaying our trip or skipping it entirely. Those behaviors, a.k.a. impacts, will also be important to planners.

The data from this survey

will be placed into an Environmental Impact Statement - which when approved, becomes a legal document.

An EIS is the repository of data and analysis that provides a measurement of the impact of a proposed action, an action that will change our “environment.” The impact here is on how much people will be affected by paying to use the interstate. There will be loss of income, the loss of good teachers and a loss to businesses who subsidize tolls for workers.

By the time you read this, we will be into our fourth day of the survey sent to all Islanders on how often we use I-90. This is likely the most important thing we can do all week, as it promises a direct reporting of what tolling will mean for us not only on a daily or weekly basis, but will be used to forecast into the future regarding impacts to business and employers who might lose good employees or customers and who may subsidize those who commute and impact their bottom line.

Yes, the information sent out in the promotional materials that preceded the survey mailing were wrong.

We were impressed. And WSDOT responded promptly to complaints, answered at least one personal message from an Islander about the error and promptly sent out a postcard to all to explain the error and apologize.

Two Islanders wrote letters expressing their disbelief and associated disgust regarding the error. Yet both withdrew those letters after the quick response.

Let’s not focus on the sample error. Let’s just make sure we fill out our own surveys properly and get them back to WSDOT on time. The surveys are due no later than Nov. 26.

The more of us who complete this task, the more clout we will have. There is power in numbers.

And, speaking of numbers, alert and loyal readers will note that the Reporter wrote a story last week (Nov. 13 issue) on the number of Island voters who returned their ballots in the General Election.

Just under half of all Islander voters returned their ballots — an amount much better than most jurisdictions — but still not enough.

The Cascade Centennial Chapter of the Washington State Sons of the American Revolution announced that the celebration of “Wreaths Across America,” conducted annually at cemeteries across the country, will be commemorated on the Eastside at Sunset Hills Memorial Park Cemetery beginning at 10 a.m. on Saturday, December 14, 2013. On that date, wreaths will be placed on the graves of many of our veterans, honoring their long and faithful service, and lives sacrificed to safeguard our liberty.

Wreaths Across America was formed in 1992 in Harrington, Maine, then grew to include Arlington National Cemetery.

Now, 450,000 wreaths each year are distributed across the nation.

The Mercer Island Schools Foundation began its annual fall Phon-AThon fundraiser Tuesday, Nov. 12, with volunteers calling for donations to support Mercer Island Schools.

"Our Phon-A-Thon is our one-time event when we can reach out to all of our donors," said MISF executive director Penny Yantis.

The Phon-A-Thon focuses on funding classroom priorities such as new curriculum and text materials, school improvement plans, professional development for teachers and student enrichment and development. It does not fund technology, which comes from the school levy. Of this year's targeted goal to raise $440,800, Yantis estimated $300,000 has already been received. Last year, more

than $520,000 was raised to support Mercer Island Schools, which accounted for 32 percent of revenue for MISF. Yantis said there are 125 volunteers over two nights to make phone calls.

Volunteers include board members, parents, community leaders, school teachers, administrators and students.

"We're seeing more participation by community members, which is greatly appreciated," Yantis said.

"The big change we're seeing now is the awareness of the pure fact that people are busy and don't answer their phones, which is frustrating to volunteers.

We stress that voice mails are important."

Since it began in 1981, when the Phon-A-Thon drew $3,000, MISF has raised over $16 million for Mercer Island Schools.

"Part of reason people live here is because Mercer Island schools are great

and parents want their kids to have that education," Yantis said. "It is a community-wide event.

We couldn't do what we do without the Mercer Island community."

The Phon-A-Thon is one of two fundraising campaigns by the MISF. The second campaign, the Community & Business Leaders Breakfast in April, focuses on teacher retention and the class size initiative, or trying to make class size as low as possible.

Police Sunday | 10 MINOR INTOXICATION: A 16-year-old Mercer Island boy was cared for by the Mercer Island Fire Department. When they arrived at the scene, he was slipping in and out of consciousness and was confirmed to have both alcohol and marijuana in his system. His father later transported him to the hospital.

Tuesday | 12 MALICIOUS MISCHIEF: A Mercer Island Police Department speed trailer was damaged with beer bottles, resulting in about $350 in damages. A set of fingerprints were taken as evidence.

VEHICLE PROWL: Two vehicles parked next to each other at a dentist’s office in the 2700 block of 144th Ave S.E. were prowled during an appointment.

Both vehicles were initially locked and found their front windows broken out, though only one had items stolen. An overnight bag full of clothes and personal items were among those taken sometime between the hours of 7 a.m. and 1 p.m.

VEHICLE PROWL: A vehicle was broken into at Mercerwood Shoreclub, along the south-side of the building. Up to ten miscellaneous CDs were stolen, a backpack, car phone charger and a couple of clothing items.

It was not until after leaving, that the owner noticed the missing items.

A few questions for attorney Bill Chapman der of the 1700 block of 92nd Ave N.E. and found the passenger-side window shattered. A makeup bag was missing from the passenger seat.

VEHICLE PROWL: A gym bag and its belongings, amountinwwg to about $100 was stolen from a vehicle parked in the 4800 block of 90th Ave S.E. The rear driver-side window had been shattered. The crime took place sometime between 9:30 and 10:30 a.m.

VEHICLE PROWL: In the 20 minutes one woman and her daughter were inside the library, the frontpassenger window of her vehicle was smashed in and a purse taken from the passenger seat. The crime took place sometime between 12 and 12:20 p.m. and the items stolen included $5 in cash, a credit card, debit card and a new iPhone.

There was one witness to the crime.

VEHICLE PROWL: An unlocked car was prowled in a church parking lot sometime between the hours of 12:30 and 2:30 p.m. The vehicle was ransacked and a checkbook taken.

Fingerprints were collected from the scene.

A Q&A with Bill Chapman of K&L Gates on the process to stop I-90 tolling Islander Bill Chapman and his firm are representing the City of Mercer Island in the fight to stop tolling on I-90. We talked with Chapman about his role and the on-going discussions with WSDOT. Q. In layman’s terms, how is K&L Gates working with the city of Mercer Island on stopping the proposed tolling of I-90?

A. Well, in the usual way. Our law firm has an expertise in matters involving environmental processes. We were last year voted the number one law firm in environ-

mental law. We have a local reputation as well, and the city asked if we can help in that matter.

When conversations began in February the state transportation agency was not going to do a full Environmental Impact Statement (EIS) and one of our initial goals was to persuade the state that the appropriate process was to do an EIS, allowing for a fuller exploration of the alternatives, which is key to any EIS. It’s required by law to lay out alternative ways of achieving the same goal.

It’s also to acknowledge that there are significant impacts from [tolling].

Former Mercer Island resident Alan Will Ruesch, 58, passed away on October 25, 2013. He was born in New Brunswick, New Jersey, March 10th, 1955 to Ada and the late Melvin Ruesch.

Alan graduated from Metuchen High School in 1973, where he starred as King Leontes in his senior play, “A Winter’s Tale.” He graduated from Rutgers University in 1977 and received a bachelors’ degree in Education. He went on to receive a Masters’ of Business at the University of Washington in 1985. After dancing and romancing Diane Kastern at Seattle’s annual Folk Life Festival, they married in 1990 and raised their family on Mercer Island.

On Labor Day of 1977, Alan found himself in Seattle and decided to stick around. It was here where he began his life’s adventures. He parlayed his degree into a substitute teaching job with the Seattle School District. He then continued his adventure on the sea when he took employment as a bookkeeper on a fish processing ship in Dutch Harbor, Alaska.

During his free time he explored the Alaskan wildernesss, where he fine tuned his appetite for salmon and all things Pacific Northwestern. With an itch for knowledge, Alan then set off on his next pursuit: higher education. This came in the form of an M.B.A. degree from the University of Washington’s Foster School of Business.

After two years of living the corporate lifestyle working for Diebold, Alan decided to follow his true passion: building homes. In 1988, he bought and remodeled his first home on Phinney Ridge in self-taught fashion for he was the original “D.I.Y.” guy. An avid Monopoly player, Alan went on to bring those skills to real life when he began purchasing properties and building homes on them.

A history buff, Alan’s other hobbies included reading, sailing, playing “hearts,” kayaking, hiking, snowshoeing at Scottish Lakes, and enjoying the rain.

Alan is survived by his wife Diane; his daughters Samantha and Lark, his mother Ada, brother David and sisters Beth Steucek and Jill Ruesch-Lane and many nieces and nephews and friends. Alan drafted architectural plans and built or remodeled dozens of homes in the Puget Sound area. Alan leaves a legacy of craftsmanship and beauty to all those who reside in them, now and for generations to come.

A memorial service to commemorate Alan’s life will be held at 11 a.m. on Saturday, November 23 at the University Unitarian Church in Seattle, WA. 925332

Q. What type of legal avenues is the city pursuing?

A. The avenues for a successful result involved communication with decision-makers. Decision-makers in this case are the Federal Highway Administration, the EPA, WSDOT and the legislators and governor’s office, other elected leaders, mayors and county leaders. The approach is to communicate with everyone. It’s to knock on every door, talk with everyone who will listen and persuade everyone to understand how the process is supposed to work.

Q. You are yourself a Mercer Island resident.

How does that influence your work on this?

A. For 23 years. I drive the commute that people are concerned about. It helps me understand.

Q. Even if this is resolved in the city’s favor, this doesn’t take tolling off the table in the future.

A. That’s absolutely true. No generation makes choices for the next. Everybody gets to choose. There might be a different approach ten or 20 years from now as

Myrn Kinnear Philbrick July 15, 1919 – October 24, 2013

Myrn Kinnear, born in Seattle, WA to Roy Kinnear and Zephorina Myrn Kinnear on July 15,1919 grew up on Queen Anne Hill in Seattle. Her family moved to Broadmoor when she was 12 years old and she attended St. Nicholas School, Garfield High School and the University of Washington.

Myrn passed away peacefully on Thursday, October 24th at Covenant Shores on Mercer Island. She was preceded in death by her husband Dick (Dr. Richard Clayton) Philbrick (2000), and their son, Rick Philbrick (1991). A longtime Mercer Islander, she was mother of Rick, Gary, and Rob (all MIHS graduates), an esteemed member of many organizations, a gourmet hostess, and a seasoned world traveler.

Always a good sport, Myrn joined her family in a lifetime of adventures: flying to Hawaii in DC6 4-engine prop planes during the early 1950’s, running the Rio Grijalva River of Mexico in rubber rafts in the 1960’s, building a sod-roofed home on Friday Island, sailing the far reaches of the Pacific Northwest coast aboard Sea Fever, and trailoring two boats, Kiyi and Wosoki, across the United States to explore the Great Lakes, the North American coasts, the Bahamas, and the Caribbean.

Myrn loved college dances at the Olympic Hotel, Friday Island weekends, family gatherings, new friendships, and displaying her collections of handcrafts and antiques from around the world. She enjoyed telling stories of her Grandfather Kinnear going bear hunting from Queen Anne Hill all the way to the dense forests of Madison Park. Her Grandfather Captain George Kinnear, a retired Civil War Captain, was tapped to protect the Chinese during Seattle riots of the late 1800’s. Her other Grandfather, Samuel Goodlove Cosgrove, was elected Governor of the State of Washington in 1909.

With her elegant presence, Myrn participated in her “Greenhorn” Arboretum Unit founded in 1946, her Dr. Charles B. Ford Guild of Seattle Children’s Hospital, the Seattle Yacht Club, the YWCA Board, the Sunset Club, the Garfield Golden Grads, and Emmanuel Episcopal Church on Mercer Island.

Most of all, though, she loved her family - Her oldest son Rick, his widow Christine, daughter Kelly (Leif), and son Rick (Sara); Her middle son Gary, his wife Theresa, son Ryan (Krista), daughter Morgan (Bray); Her youngest son Rob, his wife Margaret, daughter Sandy (Jason), daughter Carrie, and son Robbie, Jr.; and many great- grandchildren. Several members of her family continue to live on Mercer Island.

A Memorial Service will be held at Emmanuel Episcopal Church, 4400 86th Ave. S.E., Mercer Island on Friday, December 6, 2013 at 2:00pm. A donation in her name may be made to Emmanuel Episcopal Church Memorials or any organization of your choice.

At a City Council planning session in June, the Council set up a committee to study possible facility scenarios both in terms of sites and in terms of a business relationship between the City and YTN. The committee included Councilmember Jane Meyer Brahm, Councilmember Tana Senn, City Manager Rich Conrad and Youth Theatre Northwest Executive Director Manny Cawaling.

They were to evaluate six proposed sites and choose one, based on parking, traffic and access, land use and financial viability.

The committee’s recommendation was that the old recycling center site be studied for the future facility.

At the Aug. 12, meeting, Conrad also explained that committee’s recommendation assumes that YTN would serve as the primary tenant of the facility and that other public performances would be accommodated. YTN would undertake the design, construction, financing, and management of the future facility.

The City’s role will be confined to providing the land for the new facility plus access to parking spaces at the Mercer Island Thrift Shop and in the adjacent public rightsof-way.

The report also said “further public presentations and outreach will be necessary before the City Council can make an irreversible commitment of the public lands.”

You often see it go the other way, you hear about people who can’t talk to one another. The fervor against tolling is understandable and intense, but even in that setting the elected leaders have made great strides working to achieve the city’s goals.

How is that taking shape?

A. Mayor Bassett has been particularly effective at that, as well as Noel Treat and the former city manager. There’s a letter that 12 city mayors signed onto that asked for the

EIS study earlier this year in April or May. These conversations have helped also shape the state’s willingness to be more responsive to looking at the bigger picture.

The conversation has been civil and bipartisan and involved different cities and counties. I give credit to Rep. Clibborn and Litzow and Bassett, for having relationships that allow this to happen to the city’s advantage. These folks talk to other regional leaders.

Images capture dignity in aging dogs Beauty found in the faces of old friends

When most people see Nancy LeVine’s images of aging dogs—eyes cloudy with cataracts, ears bent and a sometimes crumbled posture—what strikes them is how human the creatures look.

“The photos really speak to them,” said LeVine.

“Dogs can be extremely expressive through their eyes, their facial expressions and their body language...It’s really sort of a collaboration between me and the dog. And the response I get mostly, is that these dogs have a presence. They feel so human to them.”

LeVine who calls Mercer Island home, but regularly works in New York, first began photographing the animals for assignment eight years ago. Her body of work includes an impressive array of projects ranging from fashion photography in New York City and Paris to a long work relationship with Seattle Children’s Hospital, and a jewelry side project called Luscious Lobe that specializes in simple but elegant studs for women with double piercings.

Girls volleyball wins first state title

Five straight for swim and dive

The Mercer Island High School volleyball team celebrated its first state championship Saturday, Nov. 16 at St. Martin’s University in Lacey, Wash.

They went undefeated in conference play, just like last year. They went into the state tournament with high hopes, just like last year.

And after the tournament was over, there were tears.

But those were different than last year’s.

The Mercer Island High School volleyball team won the 2013 3A state championship Saturday, Nov. 16, beating Holy Names Academy 3-2 at St. Martin’s University in Lacey, Wash.

It was the Islanders’ first state championship.

“This is the most incredible feeling,” coach Susan

McKay said. “I don’t think it has fully sunk in yet. [A state championship] was my dream as a player and I didn’t accomplish it, but accomplishing it as a coach is that much better.”

Water polo takes second

Islander teams recognized for high academic marks The Mercer Island High School boys varsity cross country team has been named 3A Academic State Champion for the 201314 fall season for highest grade-point average (GPA) in the sport. The 10-member team had an average GPA of 3.88.

The 61-member girls

swim and dive team, with a 3.71 GPA, and 58-member varsity football team, with a 3.36 GPA, were finalists in the statewide competition.

“Taking care of business in the classroom is our student’s number one job,” said MIHS Principal Vicki Puckett in a press release.

“I am so proud of these teams. It is outstanding to have such talented young athletes on the field and in the classroom.”

Girls varsity cross country and soccer and

boys tennis and water polo teams earned the Outstanding Team Award with a GPA between 3.5 and 4.0, while the varsity volleyball and boys varsity golf team earned the Distinguished Team Award with a GPA between 3.0 and 3.49.

The Dairy Farmers of Washington/Les Schwab Tires Scholastic Award program is to recognize and reward those teams or groups that maintain a high collective academic standard.

“Every point was meaningful,” Lindquist said.

“There’s no point in having doubt and no point in playing with fear. It’s just about finishing no matter how long the match is, staying composed and staying tough and staying disci-

plined. We did that, and I couldn’t be more proud of this team.”

Heading into the championships, McKay said there was a sense of a second chance after last year’s first-round loss. “To be able to do it this year is unbelievable. I love this team, I am so proud of them. Every single person was part of why we won.”

The Islanders finished the season undefeated in KingCo play, with a 14-0 conference record and a 22-2 record overall.
