Langley considers rate hike to cover $200K ‘shortfall’ By BEN WATANABE South Whidbey Record The Langley City Council unanimously agreed on one thing Monday night: implementing state required sewer and water regulations is a lot less burdensome for counties than for cities.

Hal Seligson Maria Cablao, Langley’s Public Works director, presented a glum estimate of her department’s finances in the sewer and stormwater funds. Langley’s sewer fund is expected to face a $200,000 shortfall in the coming year between its expenses, estimated around $470,000, and its revenue of about $270,000. “This revenue has been less than the expenses for not just this year, and it’s going even further south,” Cablao said. The shortfall is due to increased regulations and restrictions, which has translated to greater expense, and because the 1992-built treatment plant was designed for 1,600 SEE RATES, A24

Hospital bond is passing First count shows Gianni, Gordon, Hezel ahead By JUSTIN BURNETT South Whidbey Record Based on a first tally of November general election ballots, Whidbey General Hospital’s $50 million expansion proposal appears to be passing. The Island County Elections Office released it’s first count Tuesday evening and according to the results, the hospital measure is succeeding with 61.75 percent of the vote. The bond needs a supermajority of 60 percent to pass. “Never underestimate what a small group of dedicated people can do,” said Joe Mosolino, paraphrasing a quote from Margaret Mead. “They can change the world.” Mosolino is chairman of Friends of Whidbey General, a citizen advocacy group that’s worked to promote the bond proposal. The hospital ran a similar measure several years ago but it was defeated and the group has been concentrating its efforts for months in areas where it failed, mostly areas of North Whidbey. Tuesday’s results show the effort paid off, Mosolino said. Tuesday’s election count also shows Rocco Gianni to be leading the race for South Whidbey School Board Position 5. Gianni captured 54.64 percent of the vote compared to challenger Betty Bond’s 45.36 percent of the vote. “I’m pretty excited, I’m pretty happy,” Gianni said. “I’ll be able to help the kids. That’s the bottom line.” The results also show incumbent Curt Gordon with a commanding lead over Ed Jenkins for Position 3 of the Port of South Whidbey’s Board of Commissioners. So far, Gordon has received

Last but not least, Bob Hezel also has a hefty lead over Captn Blynd for Position 3 of the South

Whidbey Parks and Recreation District. He claimed 78.13 percent of the vote to Blynd’s 21.87 percent. “Thanks for your support and I’ll do my best to exceed your expectations,” said Hezel, in a message to voters. Finally, Initiative 502 appears to be failing. County voters have reject-

ed the proposal with 52.9 percent voting against the measure, and statewide it’s failing by 53.44 percent of the vote. According to the elections office, there are 3,500 ballots left to be counted of 18,584 and the next batch of results will be released today at 5 p.m.

Tempers flared at a Monday Island County public hearing as several residents made clear their dislike of a proposed sixmonth moratorium on new marijuana distribution and production businesses. As a result, Island County commissioners voted to table the action until today’s work session. Several local business owners, some already producing medical marijuana, felt that the proposed moratorium on new businesses would put Island County behind the rest of the state, causing them to miss out on key application deadlines. It was the intention of the board to follow suit with the City of Oak Harbor who passed its own six-month moratorium in September with no opposition. Both moratoriums are in response to the passage of Initiative 502 last year, which legalized recreational marijuana and comes with many restrictions. How those rules translate at a local level, however, remains unclear. Residents who spoke at the meeting said the moratorium would block their ability to start or expand their businesses. Many said they would lose licensing opportunities to neighboring counties who are moving forward more quickly. COUNTY Land use up for review A request concerning Greenbank Farm will be the subject of a special session of the Island County Planning Commission this month. The commission will convene at 9 a.m. Tuesday, Nov. 19, in the Commissioners Hearing Room in Coupeville to consider the Port of Coupeville’s request to amend the land-use map within the Greenbank Farm Master Plan, and the regulations for the Greenbank Farm Special Review District. The proposal would readjust the sub-zone boundaries in the Special Review District along Wonn Road and in the commercial sub-zone. It would also allow a park-nride as a permitted use in the sub-zone adjacent to Wonn Road. The planning commission is an advisory group that makes recommendations on land-use and development rules to the Island County Board of Commissioners.

Greenbank Farm septic woes raise stink with state By NATHAN WHALEN Staff reporter Pr oblems with Greenbank Farm’s septic system have prompted state involvement and could leave the Port of Coupeville with a pricey fix. The state Department of Health recently attached a string of conditions to a permit for the farm’s large, onsite sewer system, and tasked the port commissioners with hiring an engineer to come up with modifications that will ensure the system is not a threat to public health or the environment. The system was originally installed by the farm’s previous owner, Chateau Ste. Michelle, with the hopes of transforming the farm into a public event facility, said Port of Coupeville Executive Director Jim Patton. The system was designed for a peak capacity of 5,000 gallons of waste per day. Activities at the farm have changed over the years, however, and the system isn’t capable of handling the different kinds of waste, including oil and grease, that come from a restaurant and a pie-production facility, officials say. “The system was not built to digest all of those things,” Patton said. Staff over the past four years have been “bandaiding” the system while reporting the situation to the state Department of Health, Patton said.. Patton said grease traps were installed at the restaurant and kitchen, and staff faithfully cleaned those traps. Nonetheless, grease found its way into the septic system. Patton reported the situation to state regulators and

has worked to find a permanent fix. The state health department has improved monitoring efforts of large, onsite sewer systems, or LOSS — Island County currently has 52, according to agency officials. “The concern is they aren’t being properly maintained,” said Denise Lahmann, LOSS program manager for the state Health Department. Until three years ago, the state agency didn’t have the staff to perform such work. After statutory changes were made in 2009 and rules written in 2011, staff were able to start looking for septic systems, Lahmann said. Now staff are looking at permits in greater detail and are trying to keep tabs on about 600 such sewer systems across the state. “We believe we need to hold system holders and operators accountable,” Lahmann said. If problems arise with a system, she said, the Health Department will work with the owner to come up with logical, financially feasible solutions. In the case of Greenbank Farm, she said the first thing is to learn more about its septic system. State health department officials have asked for water quality monitoring data from the Greenbank Farm. There’s concern that the large amount of fats and oils will coat pipes and fill the pores that lead into the soil. It’s likely additional treatment will be needed for the

The Port of Coupeville is taking steps to address the problem but the system may need replacement. high-strength waste that is going on the farm’s sewer system, Lahmann said. She added that she is pleased with the level of cooperation from port officials. To meet conditions of the state permit, port staff must clean the pump, siphon chamber, drain and inspection ports. They must also develop a cleaning plan. Documentation must also be submitted to the health department by the end of the year. Finally, the port is being required to hire a licensed engineer by April 2014. That engineer will evaluate the system and design any modifications to ensure the farm’s system protects public health and the environment.

Approved modifications must be completed by April 2015 and installed within one year. Patton said he is confident the port has enough money to hire the engineer and complete the design work. But to change the septic system, said Patton, the port will need to seek grant funding. The port is seeking $70,000 from the Rural County Economic Development Fund. Money for that fund comes from a .09 percent sales tax rebate from the state. Patton said application for the fund opens in April 2014. “We will be working on a request,” Patton said.

Home sweet home in Freeland editor’s column

It’s Wednesday, the dust has settled and the South Whidbey Record has successfully moved — again. To anyone counting, this was our third relocation in nearly as many years. No, we’re not playing musical chairs for fun, and yes, we are planning to set down permanent roots in our new Freeland home. To shed some light on our light feet, the past few years have been something of an experiment in viable newspaper economics. In 2010, our industry was seeing financial upheaval once unimaginable. Longtime daily publications, massive organizations once considered unsinkable, were turning belly up left and right. Small community newspapers have better weathered the revenue storms ravaging our daily counterparts, for a variety of reasons that I won’t bore you with here, but we were not immune and Sound Publishing made the tough call to leave South Whidbey and set up shop on Central Whidbey. The idea was simple: shack up with our sister paper, the Whidbey News-Times, split the bills and produce newspapers that were more financially stable. Well, in The Record’s case, the financial savings simply didn’t add up. The price of being separated from our community was just too high. So we packed up our computers and hightailed it back to where it all began, Langley, the beautiful and charming Village by the Sea. We spent a lovely year in a space tucked into the back of Langley Village, thanks largely to the generosity of city business leader Janet Ploof. Knowing we had just pennies to come home, she put us up for a pittance in the hopes that we could stay — if only it had been in the stars. Thank you, Janet, The Record owes you much. But again, financial matters dictated a change and now we’re in Freeland and we have no complaints. Moving again so quickly wasn’t what we’d planned but the office, located in suite 204 above the Freeland Chamber of Commerce at 5575 Harbor Ave., is awesome and will suit our needs perfectly. It’s been nice too that Freeland, an ever-growing and busy community, has welcomed us with open arms. Recording its history in greater detail will be our honor. That said, coverage of Langley and Clinton won’t change. Langley remains South Whidbey’s only incorporated city and Clinton, well Clinton is trying hard and we’ll be there to tell the story, whatever it is. Thank you South Whidbey for your patience and please stop by for a visit at our new digs. As always, our door, wherever it happens to be that year, is open.

There is more to a dictator than letter writer wrote Editor, Dr. Westergaard’s recent Letter to the Editor, Oct. 26, warned of the possibility of a dictatorship arising from “a minority in our congress and their supporters” who “would risk a global depression to advance their personal ideology” — presumably he’s referring to the Tea Party here — so I thought I’d list some additional characteristics of dictatorial abuse the good doctor may want to be on the outlook for as well. A dictator: • Never wastes the opportunity to use a crisis, real or imagined, to amass more power. • Is unaccountable for his failures, someone else is always to blame. • Rules by edict, decree or executive order. • Ignores laws he doesn’t like.

• Uses otherwise apolitical government bureaucracies to attack his opponents. • Uses the state security apparatus to spy on citizens at home and allies abroad. • Has a dishonest and complicit “media” to act as his propaganda machine. While I applaud Dr. Westergaard’s knowledge of history, he might want to open his eyes to what’s going on around himself as well. Michael Zink langley

I’m sick and tired of media pundits lamenting how broken our government is and how embarrassing the past month has been, how we’ve lost stature on the world stage. Baloney. The rest of the world should be in awe and, frankly, I think our founding fathers would have been cheering from the balcony of Congress to see the results of what they set in motion some 237 years ago. What we’ve just witnessed is democracy within a republic at work. Was it pretty? No. But at many times throughout our history it hasn’t been pretty. At the start, while trying to negotiate a new constitution, or pick many other times throughout our history, it’s not been pretty. making sausage. It’s not something you want to watch, but it looks good at the end. It’s also been said that democracy may not be the best form of government, but there’s certainly no better alternative. This past month China and Russia both criticized us for the spectacle they were observing. But could China or Russia have ever gone through something like this without a shot being fired? No. From Egypt to Thailand to countless other Third World countries, by now the military would have stepped in and dissolved Parliament or worse. Think about it. In this great nation we can cuss and discuss. Every four years we have an extremely tumultuous and vitriolic election.

It’s ugly. Every time. Yet we fight, debate, vote, accept the results, and then proceed with a very orderly transition of government — every time, without a shot being fired. That’s what makes us uniquely American. Yes, I’m extremely proud. Dr. Westergaard and all Americans should be too, and yes the rest of the world should be in awe. DENNIS HUNSINGER, Langley

Atheists, religious are both heroic Editor, I am an atheist. I’m not the only atheist on Whidbey Island, though I am probably the noisiest, most assertive one. As peculiar as it may seem — upsetting both believers and atheists I know personally — I consider atheism to be my religious belief.

With no empirical evidence for the existence or the nonexistence of the entity known as God, from a purely logical point of view, agnosticism may make the most sense. An atheist since the age of 10; now 69 and perhaps approaching the end of my life, my “unfaith,” for lack of a better term, is stronger than ever. Hometown Hero is an excellent series worthy of continuing in The Record, written with great skill and talent, and contributing to the pleasant life and culture most of us appreciate about Whidbey. I also consider the series to be a very clever, subtle, and imaginative way of pros-

elytizing for deism in general and Christianity in particular. I have no objection to the author using this strategy to support and spread her faith. When decent people believe they know of a wonderful truth of “good news,” it makes sense that they want to share it. However, as far as I can tell, there has never been an overt atheist profiled — I hasten to add that I am not nominating myself. I infer that one of the underlying themes of Hometown Hero is tolerance and acceptance, as far as such values can be reasonably applied. In terms of my own values, I would exclude murderers, torturers, rap-

On to state! Cross country runs on By BEN WATANABE South Whidbey Record For the first time in 10 years, South Whidbey’s boys and girls cross country teams will both compete at a state meet. Both the girls team, long ranked in the top 10 in 1A by a coaches’ poll, and the boys team finished in fifth place — the final qualifying team spot — at the tri-district tournament Saturday. Thanks to some pack running by the Falcons, especially with their third, fourth and fifth runners, South Whidbey will be represented among the top talent at Sun Willows Golf Course in Pasco this Saturday. The Falcon boys were boosted by quick 5,000-meter times from freshman Will Simms, sophomore Chris Anderson and junior Anders Bergquist. That South Whidbey trio placed 48th, 49th and 50th, respectively, and moved the Falcons from the eighthranked team at the meet to fifth place. Cole Zink, finally healthy and racing, placed 12th overall in 17:37.07. The junior returned to form as South Whidbey’s top team after some medical issues earlier this year and ran his secondfastest race of the season. Red Wolves nip Falcons’ Senior Night, final home game By BEN WATANABE South Whidbey Record For a game that started great for South Whidbey football, it ended in equally measured disappointment for the seniors, who fell 48-13 in their final home game at Waterman Field. South Whidbey opened its Cascade Conference finale against Cedarcrest with a sack and fumble recovery, followed by a quick score. Playing in a game of little consequence — South Whidbey already secured its 1A District 1 playoff game by beating Coupeville on Oct. 18 — the Falcons played without senior quarterback Nick French, senior receiver Nick Bennett and senior linebacker Jose Chavez. Parker Collins came in as the backup and threw the first score of the game to senior receiver Kale Reichersamer, a 13-yard strike after the sack by senior Beck Davis and fumble recovery by Nate Hanson.

Even though South Whidbey girls soccer lost more matches than it won in the 1A District 1 tournament, the Falcons will play again for a shot at the state tournament. South Whidbey lost 4-1 to Meridian on Friday and fell 2-0 to Lynden Christian on Saturday. Falcon senior Maia Sparkman scored the lone goal in the waning minutes of the loss to Meridian. Falcon head coach Ben Rusch said his squad made mistakes early against Meridian which led to some quick goals. Once behind, South Whidbey didn’t have the roster depth to scramble for a rally. Against Lynden Christian, Rusch said both goals were on corner kicks and credited his team’s defense for not allowing a “quality” shot on goal. South Whidbey had a couple of looks at Lynden Christian’s goal, but failed to put the ball into the net. Losing both matches thrust the Falcons into a

loser-out match against Seattle Christian on Tuesday, after The Record went to press. Seattle Christian (15-2 overall) was quite a force in the Nisqually Conference. The Warriors have yet to be shut out of a match and lost only two matches to one of the state’s best teams, Eatonville. The top six teams, out of 11 in the District 1/2/3 regional round, advance to the state 1A tournament. King’s already secured a berth in the state tournament by winning the District 1 tournament.

By winning the first match against Mount Baker 3-0 on Saturday, South Whidbey volleyball punched its ticket to the tri-district tournament. The Falcons had a shot at securing the third seed, but fell 3-1 to Nooksack Valley in the final match of the 1A District 1 tournament. Facing the Mountaineers in the early game, the Falcons made quick work of the match, winning 25-20, 25-19, 25-18. Falcon junior hitter Anne Madsen recorded 16 kills and three aces, and senior setter Meagan

Longdon logged 31 assists and three aces. Madsen continued to score points against Nooksack Valley, recording 18 kills to accompany a stellar defensive performance with 19 digs. Hospital to sell properties By NathaN WhaleN South Whidbey Record Two Whidbey General Hospital properties that aren’t being used will soon be sold off. Hospital commissioners recently declared two resident properties surplus, one on Echo Loop in Oak Harbor and the other on Highway 525 in Freeland. The hospital has to go through a public process to sell each property. The South Whidbey property is a 1-acre lot located next to Skagit Farmers Supply. The structure used to serve as ambulance quarters until a new EMS facility was constructed around 2008. “The board doesn’t see a need to retain it,” said Hank Hanigan, the hospital’s chief operating officer. He described the structure as being in poor condi-

tion and has been vacant since 2008. The second property is an Oak Harbor home bequeathed to the hospital in 2010. Normally such a donation would go through the foundation. Hanigan said because the hospital was named in the will, the hospital has to go through the lengthy process to sell it. “We’re not in the business of residential real estate,” Hanigan said. “It’s a cumbersome process to go through,” said hospital board President Anne Tarrant, during a board meeting last month. The hospital has to go through several steps before selling the properties. Now that both lots have been declared surplus, officials have to hold a public hearing so residents can comment on the merits of the potential sale. Hanigan said that a date for the hearing hasn’t been set yet.

The meeting is being sponsored by the Citizens of Ebey’s Reserve and will run from 4:30 to 6:30 p.m. Tuesday, Nov. 19, at the Coupeville Recreation Hall, 901 N.W. Alexander St. According to a news release from the group, University of Washington experts will make presentations concerning the effect of jet noise on “children and human health in general.” “This free educational forum, specifically prepared for this event, is for anyone interested in scientific studies regarding the growing concern for how jet noise impacts our health,” according to the new release. The featured speakers include Karen Bowman, Dr. Catherine Karr and Nancy Beaudet. Bowman is a registered nurse, an

Whidbey Children’s Theater presents the inaugural performance in its new digs with Washington Irving’s “The Legend of Sleepy Hollow” at 7:30 p.m., Friday, Nov. 8, next to Langley Middle School. Langley actor Michael Morgen moves from the stage to the director’s seat for the first time with the play. He said he found directing different and a bit more stressful than acting. “It’s a double-edged sword. On the plus side, you get to create everything about it, but that’s also stressful — it’s that wonderful mix,” he said. Morgen updated the time period from 1790 in the original play to the 1950s. “We wanted to engage the kids more and give them an edge when approaching the material,” Morgen said. It can be hard for children to identify with characters from such a different time period, he added. This setting provides for leather jackets and poodle skirts; it was fun updating that, he said. Since 1984, the volunteer organization has repaired over 600 homes, helping homeowners who physically or financially are unable to do the work alone. The mission is neighbors helping neighbors to stay in their homes. Volunteers do whatever repairs and renovations possible within the scope of a one-day work party, including carpentry, plumbing, electrical work, painting, plastering, weatherization, heavy cleaning, roofing, yard cleanup and trash removal. Thick fog, like we’ve recently experienced, puts a real damper on birding. The birds hunker down and avoid flying, making them hard to see. Plus the dampness tends to keep me inside. So when the sun finally broke through around three o’clock a couple weeks ago, I grabbed a fleece jacket and set out for a walk. Within a half-mile I was engulfed in fog. A gray blanket settled around me, colors muted and the Clinton ferry horns sounded. Although I couldn’t see to the treetops and felt cocooned in stillness, I began to notice birds calling. A northern flicker shrieked from an unseen height, a spotted towhee

ground-loving birds vocalized. The forest section of my walk was virtually soundless. Of course two days doesn’t give enough data to warrant making any generalizations, yet I came away from these walks with a new awareness. Even though birds tend to hunker down and avoid flying in the fog, the birding can be interesting in other ways. And paying close attention to nature usually brings new insights. One sure-fire way to brighten your November with some sunny bird images is to attend the showing of Craig and Joy Johnson’s new film called “Birds, Backyard Habitat and Beyond.” It will be presented at noon and at 2 p.m. Sunday, Nov. 10, at the Clyde Theater in Langley. Admission is free. The film includes footage of the Cooper’s hawk in Craig’s photo illustrated here and many more Whidbey birds.

“meowed” from a nearby mound of blackberries, and a Pacific wren sounded its chip call. As I strode along, kinglets whispered from nearby shrubs and a blackcapped chickadee called from the alder trees. I’ve often walked this same stretch of county road in fall and barely heard a cheep. I began to wonder if the fog caused the birds to vocalize in order to keep track of each other. It certainly helped me become aware of their presence. When I returned to the house and the sunshine, my husband showed me a couple of photos he’d just snapped of a juvenile Cooper’s hawk that had perched on our deck about two feet outside the living room window. It seemed odd for that raptor to have alighted so close to the house. Was it enjoying the warmth and protection given the proximity to the house? Later we located the Cooper’s hawk on the south side of the house, sitting atop a fence post in a patch of bright sunlight. It appeared to snooze, keeping one eye closed. Crow-sized woodland raptors in the accipiter family, Cooper’s hawks prefer deciduous and mixed forests. They can be secretive and inconspicuous, so I set

Cablao proposed increases between 3 and 5 percent for the sewer rates and 3 percent for the stormwater fund. Last week, the proposal was for up to 6 percent for sewer rates, but it was reduced to just 5 percent in the draft budget presented Monday. Currently, a single family residence inside city limits pays a fixed, bi-monthly rate of $83.86 for up to 8,000 gallons for water. Sewer costs $53 per month, up to 3,750 gallons. ties for the average Langley resident. Water rates are not likely to rise, as Cablao did not recommend an increase. Sewer, with at most a 5 percent hike, would cost $55.65 on the bi-monthly bill. Stormwater, with the recommended 3 percent hike, would cost $49.44. For a single family residence, that’s an additional $34.54 per year. “I know that we have to be sensitive to our citizens and residents and the economic hardships that they’re under,” Cablao said. She noted that the sewer fund’s revenue stems from three “streams,” growth, connections and utilities rates. With little new construction in Langley, she said the city was limited in its options to cover the sewer fund’s revenue. “The only opportunity to address this challenge, this shortfall, is rate structure,” Cablao said. When Langley built its sewer treatment plant in 1992, the city was projected to have 1,600 homes hooked up to the sewer line. About 900 are on the line today, well short of the plant’s full capacity. Councilman Hal Seligson proposed enticing homes in Langley that use a septic tank to connect to the sewer line. It’s not a new idea, but it would behoove the city to look at the issue again, he said. “Not only is it good for the business end of running a sewer system, but also, ecologically, the responsible thing is to get people away from septic systems, especially in critical areas,” Seligson said. The city council widely grumbled about the disadvantages Langley has in its utilities rates compared to Island County. Because Langley is an incorporated area, it has to meet specific measurements for its utilities quality, such as daily testing of its water quality and other oversight. Langley’s leaders acknowledged that when rural county residents compare their rates to Langley residents, the differences seem stark. “As a municipality, we have a lot of rules and regulations that we have to abide by,” said Debbie Mahler, Langley’s treasurer and clerk. “We have the same regulations as Seattle.”

The Board of County Commissioners appoints Historic Preser vation Commission, or HPC, members for 3-year terms, which may be renewed by mutual agreement. Commission members work with the Town of Coupeville, Island County and Ebey’s Reserve Trust Board staff to process applications for Certificates of Appropriateness for properties located within Ebey’s Landing National Historical Reserve. Ebey’s Landing Historic Preservation Commission

consists of nine members, four members appointed by the Coupeville Town Council; four members appointed by Island County; and one member appointed jointly by Island County and the Town of Coupeville.
