The B eat Goes On After Cam paign Close

T

he Bold Ambitions campaign is fast receding into history. As you know, that campaign broke all Penn Law records. But once it ended, it was natural to temper expectations. How could we maintain that pace? I thought it would be impossible. And I was right.

We didn’t; we exceeded it. In fiscal year 2012-13, we raised $25.9 million — the best fundraising year in Penn Law history. I can’t even begin to fathom the magnitude of that number. All Paul and I can say is

thank you! The past fiscal year was a microcosm of the larger campaign. We capped off a remarkable round of building improvements; observed an uptick in financial aid; and announced a major new center whose work will reverberate through the Law School, the University, and society itself. Our record-setting year, which included $2.9 million in annual giving, is a testament to our alumni, who continue to value the institution and the education they received here. Your generosity was evident from the time we opened our doors for the new school year. During the last fiscal year, we held ribbon-cutting ceremonies to celebrate eight new spaces, an extraordinary amount of activity that reflected your unprecedented support. For a while it seemed like we were celebrating a dedication every few weeks. We dedicated new study and seminar rooms, new classrooms, new lecture halls, and opened Golkin Hall’s Davis Student Union,

which promises to become as central to student life as The Goat and The Clock. We also received incredible support in an area of great need: scholarships. Your support gives us the resources to recruit and enroll the most talented students from all walks of life. It is this diversity of thought and background that makes Penn Law such a rewarding environment and the envy of our peers. In addition, this past year we received one of the largest gifts in Penn Law history — a gift that is appropriate to the scale of the undertaking. Penn alumni Frank Quattrone W’77 and Denise Federaro SAMP’78 provided $15 million in initial funding to establish the Quattrone Center for the Fair Administration of Justice. From its base in the Law School, the Quattrone Center will bring together scholars from across Penn and the country, as well as practitioners, to analyze and provide evidence-based solutions to extant problems in the criminal justice system. No other law school in the country approaches this program, or, for that matter, our best-of-class programs in law and technology and management training, or our three-year JD/MBA degree, to name just a few ways in which we are crossing boundaries and staking out new ground in legal education. At the recent Benefactors Dinner, we acknowledged a number of individuals for their contributions. But we could have just as easily celebrated the collective efforts of all of our alumni, for your continual support has proven to be the linchpin of our success and transformation. We are setting new standards in legal education, and we could not do so without you. For that, I want to once again express my deep appreciation. Thank you!

LEADERSHIP DONORS IN PROFILE

In grateful recognition of major gifts made to the University of Pennsylvania Law School in Academic Year 2012-2013.

The Fran k and Denise Quattrone Foundation contributed $15 million – one of the largest gifts in Penn Law history - to establish the Quattrone Center for the Fair Administration of Justice. This is the first such center in the nation focused explicitly on interdisciplinary, data-driven research and policy recommendations designed to catalyze long-term structural improvements to the U.S. criminal justice system. The initial funding comes from Penn trustees Frank Quattrone W’77 and Denise Foderaro SAMP’78. The Center will be a clearinghouse for independent, unbiased research and programs conducted and evaluated by academics, members of the judiciary, law enforcement officials, defense attorneys, prosecutors, forensic and social scientists, and media. Housed at the Law School, the Center will draw on Penn’s unrivaled interdisciplinary strengths, involving in its work scholars from related disciplines across the Penn campus, including Business, Communications, Criminology, Engineering, Medicine and Public Health, and Social Sciences. The Center will host conferences, symposia, workshops, roundtables and other scholarly activities to generate knowledge, debate and policy proposals about major issues confronting the justice system. Student involvement in the Center’s research and programming will help to cultivate a future generation of policymakers and professionals. Potential areas of investigation include: the frequency and causes of, as well as policy proposals to reduce or eliminate wrongful convictions; redress for victims of institutional misconduct; critical evaluation of the science underlying current forensic practices and developing new breakthroughs; incentives and accountability for prosecutors; and the roles of politics, economics, and the media on justice system fairness. The Frank and Denise Quattrone Foundation was established in 2002 by Frank Quattrone and Denise Foderaro to improve the human condition through technological, social and artistic innovation. The Foundation provides grants for educational scholarships, medical research, science and technology, social justice, a healthy environment and the arts. The Foundation has long supported Penn and is educational mission, most recently contributing a major gift to the new Singh Center for Nanotechnology Center in Penn’s Engineering School. Mr. Quattrone is co-founder and CEO of Qatalyst Group, a global independent investment bank that advises technology companies on mergers & acquisitions. He is chair emeritus and a member of the board of The Tech Museum of Innovation in San Jose, and chair emeritus of the advisory board of the Northern California Innocence Project. Ms. Foderaro, an occupational therapist, is an advocate for many social justice organizations including the Innocence Project, and is a research assistant for the National Registry of Exonerations. She was co-chair of the Major Gift Committee of Penn’s recent Making History Campaign.

David Cohen L’81 and R honda Cohen L’80 made a substantial gift to establish the Cohen Law Scholarship. Mr. Cohen, chairman of Penn’s Board of Trustees, has been one of the most significant civic leaders in Philadelphia since the early 1990s, when he was the top aide to Mayor Ed Rendell. Today he is executive vice president of the Comcast Corporation, a Fortune 100 company and owner of NBCUniversal. In addition to serving as senior counselor to CEO Brian Roberts, Mr. Cohen is responsible for a broad portfolio, including corporate communications, government and regulatory affairs, public affairs, legal affairs, corporate administration and community investment. A transplanted Philadelphian, his career began at Ballard Spahr, where he became a partner at age 33 and later returned to lead the firm as chairman. As chief of staff to Philadelphia Mayor Ed Rendell from 1992 to 1997, he played a central role in new collective bargaining agreements and budget management that helped save the city from impending bankruptcy. He also contributed to the economic development of downtown Philadelphia. Mr. Cohen is chair of the University of Pennsylvania board of trustees and a member of the executive committee of Penn Medicine. Rhonda Cohen is a former partner at Ballard Spahr. where she was an expert on securities law, mergers, acquisitions, corporate transactions, and executive compensation plans. An exceptional advocate for the cause of higher education, she was a longtime member of the board of the Community College of Philadelphia, serving as chair from 2000 to 2006. She is also a member of the board of managers of Swarthmore College, from which she and her husband graduated; former member of the board of managers of Penn’s Law Alumni Society; treasurer of the board of directors of Delaware Valley Friends School; and vice president of the board of trustees of The Christopher Ludwick Foundation, which provides grants for the education of underprivileged children in Philadelphia. In addition, she was co-chair of the Higher Education Transition Committee for Governor Rendell’s transition. Aside from her work in higher education, Ms. Cohen is a director of the board of Glenmede Investment & Wealth Management.

Scott Mead L’82 has made a major gift. Mr. Mead has had a distinguished career as an investment banker. A former managing director of Goldman Sachs in London, Mr. Mead went on to become a senior adviser at British private equity firm Apax Partners before launching a merchant bank, Richmond Park Partners LLP. Mr. Mead is also founder and chairman of the Mead Family Foundation, a philanthropic organization that supports institutions, individuals and initiatives throughout the world. In recent years Mr. Mead has returned to his earlier interest in photography. His work has been featured in exhibitions in England and the United States.

F. Joseph S ensenbrenner, J r. L’73, wi fe Mary E llyn, and son Joseph S ensenbrenner L’06 have established the Sensenbrenner Family Scholarship Fund (Classes of ’73 and ’06). The scholarship supports students with an interest in public service careers, whether in public policy, administration or elective office. The elder Sensenbrenner spent several years as a public official, first as deputy attorney general of Wisconsin and then as the three-term mayor of Madison. He now runs Sensenbrenner Associates, a consulting firm that advises state and local governments and public agencies on ways to improve the quality of their services. His son, Joe, served as deputy attorney general in Delaware before becoming director and counsel at Philadelphia Financial, which provides insurance and investment services to private banks, family offices, and wealth management advisers.

The Wendy and Dere k Pew Foundation made a generous gift in support of state-of-the-art technology in Golkin Hall. Mr. Pew L’93, a member of the Penn Law Board of Overseers, was articles editor of the Law Review. Mr. Pew is the chief executive officer of MediaCast Holdings, LLC d/b/a SpectiCast, an event cinema digital distribution company serving nearly 2,000 traditional and non-traditional exhibition venues around the world. He was formerly chairman of Boathouse Communications Partners, LLC, which created, invested in and developed companies in the broadband and next generation network industries. He also served as the chief executive officer, co-chairman and primary strategic and technological consultant to Wireless Philadelphia and advised city officials worldwide on wireless networks. He began his career as an investment banker with Bankers Trust Company before joining Morgan, Lewis & Bockius LLP. Wendy Pew is a judge on the Municipal Court of Philadelphia. She served as a law clerk for the U.S. District Court for the Eastern District of Pennsylvania before joining Cozen O’Connor. She later became senior associate counsel for Independence Blue Cross. She was appointed to the bench in 2000 by Pennsylvania Gov. Tom Ridge.

Allan N. Rauch C’80, L’83 and his wife Elizabeth made a generous gift to establish the Rauch Family Endowed Scholarship. The gift was made in recognition of the scholarship support he received while he was in law school. Mr. Rauch is vice president-legal and general counsel of Bed Bath & Beyond Inc., a leader in the home furnishings retail business. Mr. Rauch joined Bed Bath & Beyond in 1994. He has been a key executive in the company’s expansion from 54 to 1,500 stores.

Lou Feldman L’92 is chair of the Benjamin Franklin Society. Mr. Feldman serves as family general counsel for the Heyman Family of New York and as chief tax counsel for the family’s various individual and corporate interests, including 40 North Industries, a registered investment adviser; GAF, North America’s leading manufacturer of roofing materials; and Specialty Granules, a maker of building products. Mr. Feldman oversees all tax planning, structuring and reporting for these businesses. Mr. Feldman has broad experience in the areas of taxation and corporations, having served as managing director at Barclays Capital and Credit Suisse, and as vice president at Zurich Capital Markets. He began his career as a tax associate at Wachtell, Lipton, Rosen & Katz after serving as a law clerk to Supreme Court Justice Antonin Scalia and Chief Judge J. Clifford Wallace of the U.S. Court of Appeals for the Ninth Circuit.

LAW AND ECONOMICS ILE Investors 2012–2013

T

he Institute for Law & Economics (ILE) at the University of Pennsylvania was founded in 1980 as a collaboration of the Law School, the Wharton School, and the Department of Economics in Penn’s School of Arts and Sciences. Cross-disciplinary research, the cornerstone of ILE, seeks to influence the national policy debate by analyzing the impact of law on the global economy, spotlighting the significant role that economics plays in fashioning legal policy. In the current environment, with the interface between law and business assuming critical importance, ILE’s work has been at the forefront, both in scholarship and in pragmatic discussions of the central issues involved in corporate governance. Through its roundtables and other conferences, ILE assembles a unique mix of academics, business and government leaders, and prominent members of the legal profession and the judiciary, who analyze and help to shape business policy and the laws and regulations that support it. ILE has an extraordinarily distinguished cadre of board members and sponsors who are willing to give of their time and expertise to make its programming a success. Mr. Hertz is president and chief executive officer of Sealy Mattress Company of New Jersey, which has approximately 250 employees and services New Jersey, Delaware, eastern Pennsylvania and parts of the New York metropolitan market. Sealy Mattress Company of New Jersey is a licensee of Sealy, Inc. Before joining Sealy 23 years ago, he was a litigation associate at Fulbright & Jaworski. Mrs. Hertz was an attorney with Rosenman & Colin in New York City, where she worked in mergers and acquisitions and equipment finance. G ITTIS CLINIC The Law School is grateful to the following donors who generously gave $110,369 in gifts and pledges in support of the The Gittis Center for Clinical Legal Studies in the academic year 2012–2013. The Gittis Center for Clinical Legal Education continues to set new heights in providing students with challenging and innovative interdisciplinary experiential learning opportunities that are unmatched nationally. Here is a snapshot of some of the work being done.

Detkin IP and Technology Legal Clinic Update Students in the Detkin Clinic will spend the semester exploring the business, legal and technological issues surrounding the commercialization of innovation. Students will take primary responsibility for servicing the IP needs of real clients, under the supervision of Practice Associate Professor Cynthia Dahl, an IP practitioner for twelve years. Clients will offer the students a breadth of experience, and range from medical labs represented by Penn’s Center for Technology Transfer, to entrepreneurial ventures launched through the University City Science Center and Wharton, to individual community artists. Students will tackle the range of IP issues, including patents, trademarks, copyrights, trade secrets, privacy rights and data protection. A unique aspect of this clinical course is the opportunity it provides for cross-disciplinary experience. Students in the Detkin Clinic will team up with students from Penn’s Engineering School (SEAS) on a two week simulation, both to develop and practice skills essential to being a successful IP attorney, and to give the law students a chance to work collaboratively with professionals with other viewpoints and complementary strengths. Students will also to work with a class from Wharton and a class from the Medical School later in the semester, to offer additional perspectives.

Entrepreneurship Legal Clinic Update The Entrepreneurship Legal Clinic (ELC) continues to expose students to sophisticated transactional representations that challenge students to inhabit the role of lawyer in its full richness and complexity, while supporting economically and socially impactful community ventures. Sustainable Food: This year, the ELC has represented the operator of an urban fish farm (Philadelphia’s first) and aquaponic indoor urban farm, as well as an outdoor urban farm venture with one of the City’s fasting growing CSAs (Community Shared Agriculture). These ventures are creating new sustainable and affordable food sources for Philadelphians across the income spectrum and for food providers and restaurants alike. Organizing for Change: Food and “food justice” has become a theme for ELC clients highlighted most prominently by the ELC’s representation of the Philadelphia Mobile Food Association. The PMFA is a trade association for Philadelphia’s rich tapestry of food carts and trucks encompassing both long-time purveyors with stationary carts and fixed hours of operation, and a new generation of culinary school educated chefs with new business models built

on the advantages of mobility and social media. ELC students are charged with forging an organizational structure to harness productively the energy of a diverse group of cart and truck owners, and creating a strategy to combat antiquated regulation and barriers to entry while eliciting support for change from City Council and City agencies.

Mediation Clinic Update Our Mediation Clinic, which was the first mediation clinic in the nation, continues to distinguish itself nationally and serve as a model for other clinics. For example: Penn’s mediation Clinic was selected by the U.S. State Department to run a pilot project in mediating disputes stemming from the international abduction of children. This semester, clinic students, using cutting edge video technology, successfully mediated the re-establishment of a relationship between a four year-old boy and the mother he had not seen in over two years; This semester, the clinic’s sophisticated fieldwork was expanded to include the mediation of the dissolution of a real estate development partnership, several difficult employment discrimination matters, and a number of high conflict appellate disputes; The course text (written by the clinic’s director and widely incorporating video case studies based on Penn’s clinic mediations) is being used in approximately 90 law schools in the U.S. and abroad.

TRANSNATIONAL LEGAL CLINIC UPDATE This clinic continues to deepen its relationships in Philadelphia, across the United States and internationally, in ways that are creating rich and exciting real world advocacy opportunities across cultural, linguistic, and geographic boundaries. Students have traveled with Practice Associate Professor Sarah Paoletti to Haiti on three separate occasions to engage in capacity building human rights training with a local human rights law office and its grassroots partners. The ongoing work in Haiti forms just one part of the TLC’s human rights docket, which continues to diversify and deepen. One team of students is completing a report on how the UN High Commissioner on Human Rights and the international community should adapt their programming to meet the needs of refugees in protracted situations, building on a case study of the Buduburam Refugee Settlement in Ghana which the TLC has visited twice, to be published by The Advocates for Human Rights.

The Honorable Harold Berger EE’48, L’51 is the chair of the Friends of Biddle Law Library. Judge Berger is a senior partner and managing principal of Berger and Montague P.C. He formerly served as judge of the Court of Common Pleas of Philadelphia and is the immediate past president of the Federal Bar Association’s Eastern District Chapter. He is the author of numerous law review articles, has lectured extensively before bar associations and at universities, and has served as chair of the International Conferences on Global Interdependence held at Princeton University. Judge Berger has served as chair of the Aerospace Law Committees of the American, Federal and Inter-American Bar Associations and, in recognition of the importance and impact of his scholarly work, was elected to the International Academy of Astronautics in Paris. As his biographies in Who’s Who in America, Who’s Who in American Law, and Who’s Who in the World outline, he is the recipient of numerous awards, including the Special Service Award of the Pennsylvania Conference of State Trial Judges and a Special American Bar Association Presidential Program Award. Judge Berger is a permanent member of the Judicial Conference of the United States Court of Appeals for the Third Circuit and is the recipient of the Federal Bar Association’s National Service Award for distinguished service to the Federal and State Judiciary. He has participated in many national litigation matters of complex nature including In Re: Three Mile Island litigation where he served as liaison counsel and the Exxon Valdez oil Spill litigation where he served on the case management team and as co-chair of the National Discovery Committee. He is a member of the Board of Overseers of the University of Pennsylvania’s School of Engineering & Applied Sciences and has made major gifts to create the Harold and Renee Berger Auditorium and Lobby in Penn’s new Bio-Engineering building and the Berger Seminar Room in Penn Law School.

W

henever I meet alumni at a Penn Law event, I am often asked, “You still have a library? You must have seen a lot of changes.” I quickly try to explain that while libraries have changed, our main purpose continues to be to support the faculty and students at Penn Law. As the saying goes, “The more things change, the more they stay the same.” Biddle Law Library’s goal has always been to provide access to information for our students and faculty. In the past that access was provided through case reporters and printed state codes among other materials. We researched questions for faculty with print resources, taught students how to use print digests, and showed them how to update their research with print citators (a citation index of legal resources). Today, electronic resources have replaced print for most of this work. The number of databases we subscribe to for both U.S. and foreign law grows every week. E-books are added to the collection on a regular basis, and plans are underway to have Kindles available for students to check out for their course reserves. The significance of these changes became more visible this summer when we sent thousands of volumes of print resources to a shared off-site repository. Our collaboration with 60 other academic law libraries across the country will help preserve the print materials for posterity as well as make room in Biddle for new materials not available online. While our work in acquiring materials shifts from print to electronic, our work preparing our students for the workplace has actually expanded. Enrollment in our various advanced research classes and numerous workshops continues to increase each semester. These classes themselves have evolved, and the number of databases students must learn to use increases each year. Just as our doctrinal classes are cross-disciplinary, our research classes incorporate business and social science materials to broaden our students’ abilities and skills. On a day-to-day basis, the changes have become routine. Still, we must admit that they have been significant, and we believe Biddle has led the way in adopting the new systems. The scope of the collections is richer than ever, and our services continue to expand. Through all these changes, though, we remain thankful for the constant support and generosity of our alumni and friends which we hope will never change.

Rick D’Avino W’77, L’80 has been vice president and senior tax counsel, General Electric Company, since 2005. He has been with GE since 1991, having been the tax director at GE Capital from 1991 until 2005. Rick graduated from the University of Pennsylvania’s Wharton School Summa Cum Laude and its Law School, Cum Laude. Following law school, he clerked for Judge Alvin B. Rubin on the U.S. Court of Appeals for the Fifth Circuit and was an associate at Cohen & Uretz in Washington, D.C. He also served as an attorney-advisor and deputy tax legislative counsel in the U.S. Treasury Department. Prior to joining GE, Rick was a partner at King & Spalding in Washington, D.C. Rick has been a member of the Internal Revenue Service Advisory Council, the Executive Committee of the New York State Bar Association’s Tax Section, and the Washington, D.C. Bar. Before coming to GE, Rick served as an adjunct professor at Georgetown University Law Center. While at Penn Law, Rick was an Arthur Littleton Legal Writing Instructor, an editor of the University of Pennsylvania Law Review, President of the Class of 1980, a member of the Order of the Coif and was awarded the Bernard A. Chertcoff Prize for Taxation. He is currently President of the Board of Managers of the Law Alumni Society.
