The ImportanceOF CURB APPEAL This is probably one of the most important aspects in staging and selling a home. You must draw that person out of the car, onto the sidewalk and up to the front door. Color, landscaping, walkway, driveway and neighbors all give a feel to the home. In order to show the home to a global buyer, it must look pristine from the street to the doorknob. If a home is taking longer to sell than average, there may be a good reason. What is the first thing you notice when you drive up to the home? How does the home make you feel? Do you want to get out and see it? How does it look compared to the other homes in the neighborhood? These are questions you need to ask yourself when preparing your home for sale. Well, you can't change the neighborhood, and you probably didn't budget for a complete front yard makeover. So what can you do?

HERE IS A START: Walk across the street or as far away as you can. View your home by at least three angles such as the right and left sides, front and center. Now take a really good look at it. #1. Can you see it? This sounds funny but if you can’t see your home, you can’t sell it. Trees and shrubs are great and should be trimmed so that the house is the star. We usually suggest trimming trees up to the rain gutter line or the top of the highest window. Shrubs should follow the same line as the bottom of a window trim. If a lot of trimming needs to be done, do it several weeks before so that the plants have a chance to recover.

#2. How is the paint? Is it a neutral color? Does it flow with the rest of the homes on the street? Painting your house bright blue will attract attention for sure, but not when you are selling. Remember, with global buyers neutral is key. Start with the trim if you can't paint the whole house, especially around the front door and front porch. It can be as simple as painting the front door a different color. That can be a quick and easy fix. #3. How is the driveway? Are there cracks, oil stains, garbage cans? The driveway is the largest hard area near the home; the material and look of the driveway and garage have a huge impact on curb appeal. Clean it up and clear everything off. #4. Is your walkway to the front door defined? Does it lead buyers to the front door or

front entry? Make sure people know where your front door is, and then work on drawing people toward it. If the front entry area has a patio, create an outdoor sitting area. #5. How is the landscaping? Make sure that the grass is well-watered, edged and mowed. Flowers, flowers and more flowers. These little pops of color make us happy and cheerful. Add some pots near the garage and plant away. Curb appeal is really part of the whole package, which means the small details are as important as the big picture. A manicured front yard means a manicured home in a buyer’s eyes. Finally, don’t forget to tidy up. Remove the garbage cans, hide the hose, pick up the paper, etc. Curb appeal means a place that looks neat and clean, the kind of place you’d like to live.

7 REASONS TO OWN YOUR OWN HOME 1. FREEDOM. The home is yours. You can decorate any way you want and be able to benefit from your investment for as long as you own the home. 2. EQUITY. Money paid for the rent is money that you’ll never see again, but mortgage payments let you build equity ownership interest in your home. 3. SAVINGS. Building equity in your home is a ready-made savings plan. And when you sell, you can generally take up to $250,000 ($500,000 for married couples) as gain without owing any federal income tax. 4. PREDICTABILITY. Unlike rent, fixed mortgage payments don’t go up over the years, so your housing costs may actually decline as you own the home longer. (Note: Adjustable mortgages may change if there is a change in the interest rates.) However, keep in mind that property taxes and insurance costs may rise. 6

5. TAX BREAKS. The U.S. Tax Code lets you deduct the interest you pay on your mortgage, property taxes you pay and some of the costs involved in buying your home. 6. GAINS. Since 1989, national home prices have increased 5.5 percent annually. And while there’s no guarantee of appreciation, it is estimated that, through price gains and reducing mortgages through payment of principle, a typical homeowner has $144,000 in equity in a home, based on data from the Federal Reserve1. 7. STABILITY. Note: Private mortgage insurance is usually required if you make less than a 20 percent down payment, but most lenders will let you discontinue the policy when you’ve acquired a certain amount of equity by paying down the loan.

Who will service the loan? Your bank or another company?

6.

What escrow requirements do you have?

How long is your loan lock-in period (the time that the quoted interest rate will be honored)? Will I be able to obtain a lower rate if they drop during this period?

How long will the loan approval process take?

WHICH FITS YOUR NEEDS BEST? What are your preferences? Do you like modern styles? Do you like antiques, collectibles and vintage architecture, or are you fond of chrome, glass and no clutter? Believe it or not, your tastes may change as you live with one style and develop into another. There are plenty of ways to evolve from one style to another and that is by situating yourself and your family—economically, socially, culturally and geographically. If you have a family with children, you can buy a home in a neighborhood known for its emphasis on schools and recreational opportunities so your kids can grow up with playmates, teammates and lots of activities. Or, if you’re in an adult household, you may prefer a more urban lifestyle that is focused on activities and interests for singles, couples and nontraditional families of all ages. In other words, do you want to be closer to playgrounds or nightlife? Or both? The star of residential housing is the single-family home because it combines the ownership of land with a structure. Single-family means there are no shared walls and the home is situated on a lot with a yard surrounding the home. Multifamily homes share walls, even if there is a firewall between the sheetrock panels. The housing structure is built in units for rental or purchase. Examples of multifamily homes include:

• TOWNHOMES OR ROW HOUSES. These homes are street-entry homes that are bought like single-family homes. Owners may or may not belong to a homeowners association that oversees community painting, fence repair, landscape maintenance and so on.

• CONDOMINIUMS. Condominiums or apartment owners own the air space (square footage) of their unit, which is calculated into the total square footage and value of the total property.

• CO-OPS. You’re basically buying a piece of the association’s ownership of the total property so that you own part of the common areas as well as part of the building.

UnderstandingREPRESENTATION

It is important to understand what legal responsibilities your Realtor® has to you and to other parties in the transaction. Ask your Realtor® to explain what type of agency relationships are available to you if you elect to work with them and with the brokerage company.

AUTHORIZED BROKERAGE RELATIONSHIPS A real estate licensee in the State of Florida may enter into a brokerage relationship as either a single agent or as a transaction broker with potential buyers and sellers. A real estate licensee may not operate as a disclosed or nondisclosed dual agent. As used here, the term “dual agent” means a broker who represents as a fiduciary both the prospective buyer and the prospective seller in a real estate transaction. Once a brokerage relationship is established, this part does not prevent a licensee from changing from one brokerage relationship to the other as long as the buyer or the seller, or both, gives written consent before the change and the appropriate disclosure of duties, as provided in this part is made to the buyer or seller. This part does not require a customer to enter into a brokerage relationship with any real estate licensee.

DISCLOSURE REQUIREMENTS Disclosure requirements and duties must be fully described and disclosed in writing to a buyer or seller either as a separate and distinct disclosure document or included as part of another document such as a listing agreement or agreement for representation. The disclosure must be made before, or at the time of, entering 8

into a listing agreement or an agreement for representation or before the showing of property, whichever occurs first. When incorporated into other documents, the required notice must be of the same size type, or larger, as other provisions of the document and must be conspicuous in its placement so as to advise customers of the duties of limited representation, except that the first sentence of the information must be printed in uppercase and bold type.

TRANSACTION BROKER NOTICE FLORIDA LAW REQUIRES THAT REAL ESTATE LICENSEES OPERATING AS TRANSACTION BROKERS DISCLOSE TO BUYERS AND SELLERS THEIR ROLE AND DUTIES IN PROVIDING A LIMITED FORM OF REPRESENTATION.

As a transaction broker, the real estate firm and its associates provide to you a limited form of representation that includes the following duties: 1. Dealing honestly and fairly 2. Accounting for all funds 3. Using skill, care and diligence in the transaction 4. Disclosing all known facts that materially affect the value of residential real property and are not readily observable to the buyer 5. Presenting all offers and counteroffers in a timely manner, unless a party has previously directed the licensee otherwise in writing 6. Limited confidentiality, unless waived in writing by a party. This limited confidentiality will prevent disclosure that the seller will accept a price less than the asking or listed price, that the buyer will pay a price greater than the price submitted in a written offer, of the motivation of any party for selling or buying property, that a seller or buyer will agree to financing terms other than those offered, or of any other information requested by a party to remain confidential 7. Any additional duties that are entered into by this or by separate written agreement. Limited representation means that a buyer or seller is not responsible for the acts of the licensee. Additionally, parties are giving up their rights to the undivided loyalty of the licensee. This aspect of limited representation allows a licensee to facilitate a real estate transaction by assisting both the buyer and the seller, but a licensee will not work to represent one party to the detriment of the other party when acting as a transaction broker to both parties.

To Rent or to Buy WHICH IS RIGHT FOR YOU

W-2 forms or business tax return forms if you’re self-employed for the last two or three years for every person signing the loan.

Copies of at least one pay stub for every person signing the loan.

Copies of two to four months of bank or credit union statements for both checking and savings accounts.

4.

Copies of personal tax forms for the last two to three years.

5.

Copies of brokerage account statements for two to four months, as well as a list of any other major assets of value, i.e. a boat, RV or stocks or bonds not held in a brokerage account.

6.

Copies of your most recent 401(k) or other retirement account statement.

7.

Documentation to verify additional income, such as child support or a pension.

8.

Account numbers of all your credit cards and the amounts of any outstanding balances.

9.

Lender, loan number and amount owed on other installment loans, such as student loans and car loans.

10. Addresses where you have lived for the last five to seven years, with names of landlords if appropriate.

Should you sign another lease or take the plunge and buy a place of your own? Nearly, 3 million Americans ask themselves that question everyday. To make a wise decision consumers should consider a few factors, such as their lifestyle and financial situation. There is no right or wrong answer when trying to make a decision to rent or buy. A good decision is one that is right for you. However, there are advantages and disadvantages to both. Although most Americans own their homes, homeownership is not for everyone. If you move around frequently, have credit problems or if you cannot afford the home you want or simply do not want the responsibility of owning a home, you could be better off renting. Usually when renting, the landlord or owner of the property pays for the cost of any work or repairs that are done to the property. And, there is generally less up-front cash needed to move in. However, when you are renting a property, you are waving good-bye to your money each month. Renting a home does not provide tax advantages to the renter. Any and all tax advantages go to the landlord or property owner. Also, monthly payments for renters can be unpredictable, depending on the lease. Owning a home is a responsibility. Not only does it mean paying a mortgage each month, but it also involves other

costs associated with the home, such as the cost of insurance, taxes, repairs and general maintenance. First-time homebuyers are often startled by the investment associated with purchasing a house. The down payment required can be as much as 20 percent. You also have to consider other fees, such as lawyer’s fees, points, escrow costs, appraisals and credit checks. In spite of the risks and responsibilities, 67 percent of Americans enjoy the rewards of home ownership. Purchasing a home is a sound investment. As you pay down your home loan, you are building equity. A home usually increases in value over time. Home ownership does offer tax advantages. The mortgage interest and real estate taxes are tax deductible, which allows you to subtract part of your housing-related expenses from your income, thereby reducing your tax liability. There is not much doubt that for most people owning a home is better over the long term than renting. When you have made the decision to buy, know how large a mortgage you can afford. If possible, get “pre-qualified” for a loan. When you find a home you and your REALTOR® like, carefully give it your own personal inspection. Enlist the services of a REALTOR® to help with the buying process!

WHAT ARE THE MAJOR RISKS OF SPECIALTY MORTGAGES?

Understanding Specialty Mortgages The traditional fixed-rate mortgage and standard adjustable-rate mortgage may not be the best options for everyone. A growing number of homebuyers are deciding to use one of several new types of specialty mortgages that let them “stretch” their income so they can qualify for a larger loan. But, before you choose one of these mortgages, make sure you understand the risks and how they work. Specialty mortgages often begin with a low introductory interest rate or payment plan—a “teaser” —but the monthly mortgage payments are likely to increase a lot in the future. Some are “low documentation” mortgages that come with easier standards for qualifying, but also higher interest rates or higher fees. Some lenders will lend you 100 percent or more of the home’s value, but these mortgages also present a big financial risk if the value of the house goes down. It’s in your best interest to learn the ins and outs of these packages before deciding if the loan you’re considering is right for you.

Here are a few examples: Interest-Only Mortgages: Your monthly mortgage payment only covers the interest you owe on the loan for the first five to 10 years of the loan, and you pay nothing to reduce the total amount you borrowed (this is called the “principal”). After the interest-only period, you start paying higher monthly payments that cover both the interest and principal that must be repaid over the remaining term of the loan. Negative Amortization Mortgages: Your monthly payment is less than the amount of interest you owe on the loan. The unpaid interest gets added to the loan’s principal amount, causing the total amount you owe to increase each month instead of decrease. Option Payment ARM Mortgages: You have the option to make different types of monthly payments with this mortgage. For example, you can: • A minimum payment that is less than the amount needed to cover the interest and increases the total amount of your loan • An interest-only payment • Payments calculated to pay off the loan over 30 or 15 years 40-Year Mortgages: You pay off your loan over 40 years, instead of the usual 30 years. While this reduces your monthly payment and helps you qualify to buy a home, you pay off the balance of your loan much more slowly and pay much more interest. This is only a short list of specialty mortgages. Today’s marketplace includes many variations on these types.

Payment Shock. One major risk is that your monthly payment may increase by a large amount, resulting in “payment shock.” Even a change of 1 or 2 percent in interest rates can result in a very big jump in monthly mortgage payment. Higher Debt Over Time. Another risk that comes with specialty mortgages involves your “equity”—the amount your house is worth after you subtract the amount you still owe to the lender. Consumers who choose some types of specialty mortgages will build equity in their home much more slowly than with traditional loans. In fact, with some specialty mortgages, the amount you owe on your home could increase rather than decrease over time.

Specialty Mortgages Can: • Pose a greater risk that you won’t be able to afford the mortgage payment in the future, compared to fixed-rate mortgages and traditional adjustable-rate mortgages. • Have monthly payments that can increase by as much as 50 percent or more when the introductory period ends. • Cause your loan balance (the amount you still owe) to get larger each month instead of smaller.

Questions To Consider Before Choosing A Specialty Mortgage • How much can monthly payments increase and how soon can these increases happen? • Do I expect my income to increase or do I expect to move before my payments go up? • Will I be able to afford the mortgage when the payments increase? • Am I paying down my loan balance each month, or is it staying the same or even increasing? • Will I have to pay a penalty if I refinance my mortgage or sell my house? • What is my goal in buying this property? Am I considering a riskier mortgage to buy a more expensive house than I can realistically afford? Be sure you work with a REALTOR® and lender who are willing to discuss different options and address your questions and concerns!

Ask your REALTOR® for recommendations. Get at least three written estimates. Get references and call to check on the work. If possible, go by and visit earlier jobs. Check with the Better Business Bureau for complaints. Be sure that the contract states exactly what is to be done and how change orders will be handled. Make as small a downpayment as possible so you won’t lose a lot if the contractor fails to complete the job. Be sure that the contractor has the necessary permits, licenses and insurance. Be sure that the contract states when the work will be

completed and what recourse you have if it isn’t. Also remember that in many instances you can cancel a contract within three business days of signing it. Ask if the contractor’s workers will do the entire job or whether subcontractors will do parts. Get the contractor to indemnify you if work does not meet any local building codes or regulations. Be sure that the contract specifies the contractor will clean up after the job and be responsible for any damage. Guarantee that materials used meet your specifications. Don’t make the final payment until you’re satisfied with the work.

7 Ways to Save ON HOMEOWNERS INSURANCE To obtain insurance at a good rate:

As a result of the recent surge in financial crimes, the Federal Bureau of Investigation (FBI) is cracking down on mortgage fraud to curtail this growing problem. Predatory lending and mortgage fraud are among the most common types of financial crimes. Especially vulnerable to predatory lending are first-time and elderly buyers. Florida is one of 10 states on the FBI’s list of mortgage fraud hot spots. Mortgage fraud scams were also among the top 10 categories of complaints received by the Florida Attorney General’s Office recently, prompting Florida Attorney General Bill McCollum to issue a consumer advisory.

WHAT IS FRAUD? Fraud involves two parties: one makes a false statement of fact material to the business involved, and the other party relies on that statement to their detriment. Anyone involved can be held liable. Responsible parties can include buyers, sellers, real estate agents and brokers and mortgage brokers.

WHAT IS PREDATORY LENDING? Predatory lending usually involves consumers losing their homes and their investments because of predatory lenders, appraisers, mortgage brokers and home improvement contractors who: • Sell properties for much more than they are worth using false appraisals. • Encourage borrowers to lie about their income, expenses or cash available for downpayments in order to get a loan. • Knowingly lend more money than a borrower can afford to repay. • Charge high interest rates to borrowers based on their race or national origin and not on their credit history. The U.S. Department of Housing and Urban Development (HUD) has created a new brochure to educate consumers on predatory lending. 1. Review the Comprehensive Loss Underwriting Exchange (CLUE) report on the property you’re interested in. CLUE details the property’s claims history for the most recent five years, which insurers may use to deny coverage. Make the sale contingent on a home inspection to ensure that problems identified in the CLUE have been repaired. 2. Seek insurance coverage as soon as your offer is approved. You must obtain insurance to buy. And you don’t want to be told at closing that the insurer has denied your coverage. 3. Maintain good credit. Increasingly, insurers are using credit-based insurance scores to determine premiums. 4. Buy your homeowners and auto policies from the same company and you’ll usually qualify for savings. But make sure the discount really yields the lowest price. 5. Ask about other discounts. For example, retirees who are home more than working people may qualify for a discount on theft insurance. 6. Seek group discounts. If you belong to any groups, such as associations or alumni organizations, they may have deals on insurance coverage. 7. Investigate a government-backed insurance plan. In some high-risk areas, federal or state government may back plans to lower rates such as wind mitigation that could save you hundreds even thousands each year. Ask your agent. If you already have an insurance policy: • Get a wind mitigation report and save hundreds even thousands on your homeowners insurance. • Review your policy limits and the value of your possessions annually. Some items depreciate and may not need as much coverage. • Insure your house for replacement cost, not market value. Beware: Many insurance companies are eliminating guaranteed full-replacement costs for homes. • You can usually obtain discounts of at least 5 percent for a smoke detector, burglar alarm or dead-bolt locks. • Retrofit your house to protect against natural disasters common to your area. • Raise your deductible. Avoid making claims under $1,000.

Moving doesn’t have to be a stressful experience, and choosing the right moving company is the best way to ensure an easy move.

5 STEPS TO FINDING A QUALITY MOVING COMPANY 1. Make sure your moving company is properly licensed. The Palm Beach County Consumer Affairs Division maintains a list of licensed movers in the county, which is available on their Web site, www.pbcgov.com/consumer or by calling (561) 712-6600. 2. Ask family and friends for recommendations. The Consumer Affairs Division also keeps a list of consumer dispute history and business information reports for local moving companies. 3. Decide who will do the packing of boxes. The cost of the move increases when the moving company packs your goods in boxes. Moving companies will not take responsibility for items broken in boxes they don’t pack. 4. Obtain written estimates from at least three licensed moving companies. Written estimates should include all the costs for packing and transporting your goods. 5. Don’t use price as the only factor. The lowest or highest estimates do not assure quality service.

NEED-TO-KNOW INFORMATION Valuation Coverage: Every moving company must provide minimum Valuation Coverage of 60 cents for every pound of every item damaged, destroyed or lost during transit.

Of course, this amount will not cover your losses on many of your goods if they are lost or damaged. Inquire about Additional Valuation Coverage from your moving company, and be sure that you understand and agree to the terms. Bill of Lading: Before doing any work, your moving company must provide you with a Bill of Lading and, if the move is within Palm Beach County, your mover must also provide you with a Palm Beach County (or Tri-county) Disclosure Form. Both must be signed by you and the moving company representative. Deposits: Deposits required by a moving company can not be more than 20 percent of the total estimate. If the move is cancelled by the consumer within 48 hours of the scheduled move, the moving company must return the deposit. Unloading: It is a felony criminal offense for a moving company to refuse to unload the household goods if the amount of the

estimate/Bill of Lading has been paid by the consumer. The moving company may legally refuse to unload your household goods if you do not pay the estimate/Bill of Lading amount. Damage: If your goods are lost or damaged in the move, you must give written notification to the moving company within 60 days after delivery. Your written notice should be very specific and clearly state that you wish to make a claim for compensation of lost or damaged goods.

Will Rogers the famous humorist once quipped "America is a land of opportunity and don't ever forget it." The quote takes on weight when you consider that he said that in the midst of the Great Depression of the 1930’s. There is truth and insight in those words. We are in what is arguably a very poor economy, but we must remember that where there is uncertainty, there is opportunity. Those who are stakeholders in the South Florida economy must remain open to changing some of the things we have grown accustomed to – and finding new ways of surviving and even prospering. There are some positive indicators for Palm Beach County. This area is expected to show moderate-to-low growth in some major indicators. Personal income is expected to grow 2.4 percent annually. Per capita income is still the highest in Florida. Average annual wage growth is projected to be 2.3 percent and the average annual wage level is still one of the highest in the state. Unemployment is expected to be 9.4% - a high number – yet it is one of the lowest in the state. Palm Beach County’s fastest growing sectors are expected to be in the Professional and Business Services, and Education and Health Services. The commercial real estate market is experiencing high vacancy rates in the industrial, office and retail sectors. With many of the major retailers downsizing, incentives are popping in all shapes and “$” sizes. The number of commercial property sale transactions in the county has dropped to less than 50 year to date, and many deals collapse due to inability to obtain financing. The bargains are out there, but it is a cash market. Many distressed properties will be appearing on the market in the next six months at steep discounts, like the “short sales’ in the residential market. Those represent a great opportunity for aggressive and smart

buyers to put the properties back into operation at realistic lease rates. This realignment will also represent a boon to those wanting space, since it will become affordable once again after the ruinously high rates of the last five years. All of that is good news; however, taxes and municipal burdens must decline to match the market. No sector of the economy can remain off the table when it comes to this economic realignment. If county and municipal governments are smart, they will aggressively encourage vacant space absorption by loosening zoning and use restrictions and allowing landlords to book tenants in spaces they are now locked out of by use restrictions or slow and cumbersome approval processes. Property taxes must come down, or the expense burden will continue to crush leasing markets. Where are we heading and what’s the forecast? With the Health, Education and Bioscience industry showing positive signs of growth in our area, Palm Beach County could continue to enjoy some influx of companies in those fields, but only if regulatory barriers are eased and incentives offered by our local governments. The EB-5, Investor Visa program, has identified Palm Beach County as a target market for potential foreign investors. In conjunction with tourism, conventions & expos, and cultural promotions this Visa program could help boost interest among national and international investors. Palm Beach County remains as one of the Hottest “Spots” in the globe for business and quality of life.

What You Shoul d Know ABOUT LEASING COMMERCIAL REAL ESTATE Are you getting ready to start looking for a new lease space? If so, here are a few things to think about. First, make a wish list—what would be the perfect site, location and amenities for the space you want to lease. You probably won’t get everything you want, but it gives you a place to start. Next, how much space do you need? You should look at what your company’s growth has been over the last five years and what you expect it to be over the next three to five years. Why? Whether you are expanding or contracting you will still want to lease enough space for minor expansion. Moving is always an expensive proposition; satellite locations are expensive and inefficient. Once you determine how much space you need, the next thing to look at is location. Make a geographical box of the area where you want to be and go a little further out of that box; sometimes there might be a better deal just outside the area where you want to locate. Is it more important to consider how far you and your key employees have to travel, or the accessibility of your clients and customers? Are you better to be located near Interstate 95 or Florida’s Turnpike? If you get a lot of deliveries or your business requires deliveries to your customers, then you need to factor in fuel costs and time it takes you to get to the highway from your new location. Now you have found a space that you like, you need to ask some important questions to the owner or the owner’s leasing agent. How much is the base rental rate and how much is the common area maintenance (CAM) or operating expenses of the building? Does the owner use a gross lease or a Net Net Net (NNN) lease? Depending on the motivation of the owner,

the base rental rate might be negotiable, but not always. Due to financing, the owner may not have the ability to reduce the base rent, however, they might be able to give an abatement of base rent (usually the owner will not abate CAM or operating expenses). The owner will probably ask that the prospective tenant fill out a rental application and credit application. Prospects have said, “No! They are not going to give that information!” Property owners who don’t ask for financial information usually are owners who might not take pride in their property and/or their tenants. Yes, there are problem owners! You want an owner who cares about their property, and keep in mind that most people spend more time at their place of business than they do at home. In all multistoried office buildings there is what is referred to as the common area loss factor. This is the pro-rata share percentage of the common areas equated to your lease space. For instance, your rentable square footage of the space is 1,000 square feet with a loss factor of 15 percent. With the loss factor the usable square footage, the space that you actually get to use, is 850 square feet. However, you will be paying the owner base on the rentable number, 1,000 square feet. The CAM or operating expenses should include real estate taxes, property insurance, water/sewer, common area electric, landscape maintenance, trash removal, property management, repair and replacement of major components on the property including parking lots and roof repair and replacement. Many of these items are considered uncontrollable and the owners have very little control over the costs. A good property owner will have the

expenses of the property as low as he can get them. Also most tenants don’t know this, but landlords are accountable to the tenants for the operating expenses. A tenant has the right to review the operating expenses every year; all one has to do is ask the property owner to provide back-up data to justify the costs. Remember as the tenant you’re the one paying the bill. When considering a space don’t be afraid to ask questions that are geared directly toward the operating expenses, i.e. how old is the roof and how often is it maintained, how many parking spaces are allotted for my unit, do I have access to my space 24/7, is the property you are leasing zoned properly for your business and does the owner have a maintenance agreement for the air conditioner and heating system (HVAC). (If an HVAC system is old it can be very costly to run. Get a licensed AC contractor to inspect the system in the space you’re going to lease. Is it still under warranty?
