PROFILE

Karen Larson, Sydney, Diane Miksch, Erin Seibert

Diane Miksch, CPA Some long-time beach residents may remember a woman-owned CPA office that used to sit at the top of the stairs in the courtyard at Dolphin Village Shopping Center with a cockatoo named ‘Baby’ as a mascot. A graduate, with a masters degree in accounting from USF, Diane Miksch was a volunteer of the year for the Tampa Bay Beaches Chamber of Commerce back in those days. When she was expecting her now 13-year-old son Dylan, she changed her primary focus to motherhood. In 2009, Diane decided to move her office to her home, and pay for an addition instead of the increasing rent in the retail center. “I have had quite a number of individual and corporate clients for the 22 years I’ve owned this business. Some followed me from other firms, and stayed with me and referred me to their friends and neighbors. One of the reasons people have been so loyal is I try to never overcharge them as some accountants do. I have also been a networker and referral source for my clients. Some are now retiring or passing on, so it is time to become visible again,” said Diane. A CPA for almost 30 years, Diane’s firm has a concentration in small business accounting, offering monthly, quarterly or annual bookkeeping. Additional expertise in Business Start-ups, Business Consulting, Tax Planning, Loan Amortization, Estate Planning and Trustee work as well as IRS audits makes her invaluable to her clients. Miksch & Company CPA’s home office conveys a friendly, relatable, and comfortable environment. “Hello!” and dancing and Sammy, (a contestant for the Guinness Book of World Records oldest cockatiel) keeps them all company. The all woman-operated business prides itself on supportive client service, providing prompt turn around on tax returns with a focus on finding ways to keep taxes as low as possible. “Our rates are often surprisingly low to new clients, with tax return fees often less than rates people have paid elsewhere, even to preparers like H & R Block. If you can get your work done by a CPA for the same price as an uncertified tax preparer, it makes it an easy decision where to go. Eliminating the cost of a fancy office helps us keep our rates low.” Diane continued. Originally from the Chicago area, Diane has been living in Florida since 1981. When it is not tax season, Diane and Dylan love to travel. They have visited each of the 50 states and many foreign destinations. Diane and her support staff are looking for new businesses to work with and are particularly looking forward to helping more woman-owned businesses with their financial challenges. “Running a woman-owned business myself, I am aware of special challenges women face, especially when they are new to the business world. While I have been serving couples and male-owned businesses for decades, I feel I am also well suited to help women address these challenges.” If you are looking for a financial consultant, bookkeeper or tax preparer, do yourself a favor and check out Diane Miksch, CPA PA. Letters This is beautiful, the page you did for us to help promote our 2nd Annual Bay Life Art Exhibit! You do so much for us, we can't thank you and Peter enough :) I hope you'll be able to join us for the preview on Feb 20th. Thanks again! Michelle Tampa BayWatch Everything you do is not only “acceptable”, but so appreciated and always the most professional it can’t possibly be just “acceptable”. It brings me to a good amount of emotions to think about all you do for the Pass-a-Grille Woman’s Club. You have not only been a friend and real sister to the Club, but to our family and especially my and Michele’s Dad over so many years. You will never know how grateful we are for that alone. Thank you truly and I really can’t wait to see the next Paradise News. What a legacy you two have. I truly hope not only the Gulf Beaches Museum recognizes and keeps all the publications (and especially the Covers) but I hope the Florida Archives and the Florida Museum will really validate and keep the same. I am ever so grateful, personally, for this springboard to our Home Tour and please know that when each member of our Club realizes what you do for us, they will feel what I do for the two of you. My very best, Judy B Not Just Another War Story is currently # 850 in all books through Amazon and the Book-Author was named "Best Selling Author" at Amazon. We still have a long way to go and book signings have and are being scheduled...fun and work!! Thought that you might like to know that the book is being accepted well and that the reviews are positive... some good 5 Star ratings. waynemacdowell.com is the website. Thanks and Take Care, Wayne McDowell Peter brought the February issues of Paradise News to our weekly Chamber referral group today and I hugged his neck and just want you to know that I can't half thank you both for that sensational "FULL PAGE" Color, Informative, Creative ad in your special glossy "Magazine-quality" pages up front!!!!! You are two very special people and it has been just a joy knowing you all these years and having our mutual appreciation and love of the Woman's Club. Thank you. My very best, Judy Brett I know, I know, I'm shocking myself! I'm NOT LATE in getting the Madeira Beach library update to you.

You know, five years ago I thought no one would need to use our public computers any more all the tourists would have their own laptops. We are seeing a lot more laptops and other devices, but it seems like no one knows how to use them. It feels as if technology is invented to deliberately confuse the elderly. I know it's confusing me. Travis Ann Sherman, Youth Services Librarian Gulf Beaches Public Library This is Janet & Mike Jezdan. We own The Beach House Cabanas in Treasure Island. THANK YOU so much for mentioning us in your "Progress on the Beaches" article. We were so honored & happy to be acknowledged! Guess it was a typo in your article.... We are NOW The Beach House Cabanas, FORMERLY- Beach House Motel, which is still across the street from us. Mike & Janet Beach House Cabanas I got your gorgeous magazine this month. It has the perfect picture award on the cover. AGAIN, Thank you for all you do for our community. Your both such caring people. The Municipal Elections article was awesome. What a great surprise. Thank you for that. Mel Lenehan The Gulf Beaches Historical Museum appreciats the businesses that supported with, contributions of food for the Museums fund raisers of Theatre Nite & the Souper Supper. They are: Hurricane, Sea Critters, Compass Grille, Nori Thai, St Pete Yacht Club at PAG, Jackies, Brass Monkey, Paradise Sweets, Shells, Cafe' Soleil, Silas Dents, Rum Fish, Skidders and Lowe's at Don Ce Sar. Over $3,500 was raised. This will allow the museum to install a large 55" LED TV for exhibit of early photos: aerials, bldgs, homes, etc and for continuous Digitalization of Museum. Thank you, Spencer Lucas, President Friends of the GBHM To Dale Schueneman, G. M. Reef Resort Condo. Assoc. Inc. Dale - My apologies for the confusion that my article in the February issue caused some of your members. We should have been more specific in noting the former Coral Reef Hotel as the TradeWinds recent acquisition. We should have made it clear that the beachfront timeshare facility that shares the site was unaffected by the ownership changes of the hotel property. I have sent your letter to our editor and publisher Pete and Renee Roos and they will be in touch for a resolution of your concerns. Regards, Steve Traiman for Paradise News

This year, in addition to captivating beach scenes on subways, buses (video), office tower elevator screens and coffee cup sleeves blanketing both cities, VSPC initiated a second campaign featuring snowmen, snow stencils and magnets touting a sole “WinterBlows.com” call to action. The mystery campaign was featured on ABC 7 in Chicago and Fox 5 in NYC in addition to garnering headlines across Florida. So far, the campaign has generated more than 1 million impressions across Twitter and Instagram. Visitation Numbers Outpace State’s Record-Setting Growth In Florida’s best tourism year ever, the St. Pete/Clearwater area outpaced state averages in a number of key metrics, including percentage growth in international visitation and the significant barometer of average daily room rate (ADR). visitation compared to a 2.6% increase statewide. Similarly, ADR averaged 5.7% growth around the state, but rose by 7.4% locally. Rounding out the record year was the single-highest December Tourist Development Tax total in Pinellas County history, a 17% increase over last year, pulling in more than $2.4 million. That total helped push the calendar year 2014 collections to a record $35,823,246.00 re-qualifying Pinellas as one of Florida’s high-impact tourism counties a title originally received in 2013. New Responsive Design Website Goes Live - Visitors to VisitStPeteClearwater.com will experience an all-new website this month, after a year-long process of moving from a traditional website to a responsive design website. After a planned roll-out of the new site, Miles Media, VSPC’s tech vendor, started funneling a portion of web traffic to the new site last December, allowing designers a chance to see how visitors interacted with the site to make appropriate changes before this month’s complete unveil. Responsive design tailors content to the device one is using to access the site and follows best practices based on web research, which shows that more than 50% of VSPC’s web traffic will stem from mobile phones and tablets this year. As with all digital initiatives the site is not a finished product, instead it will be modified as necessary based on industry

From Publishers... Many years ago when we were young and anxious to be old enough to do something we couldn’t yet, we were advised not to wish to be older, as soon enough, we would be. In fact many of us were told, the “older you get, the faster time will pass”. It probably felt like crazy talk at the time, but now, years later, looking back, it seems sage.… The shortest month of the year is when I feel time passing most rapidly. The four short weeks in February passed like a speeding freight train. Perhaps it was the series of ‘cold fronts’ passing with their occasional cloudy and rainy days that interrupted our ‘chamber of commerce’ weather this winter, but it seems like more than that. The exciting news is that March is more than 10% longer than February, so plan now how to take advantage of all that extra time.… Many of our readers have discovered our website, www.paradisenewsfl.com, where they can read Paradise NEWS online and have access to an amazing amount of additional local information. Some readers have lamented that by the time they get their issue in the mail, some of the events they were interested in have passed. We used to overlap our activities and events from month to month so this didn’t happen, and will try to do that again, starting this issue, so this month will have activities at least through the first week of April. A growing number are signing up for our ‘e-newsletter’, a brief email that arrives most Thursdays with our pick of the ‘top 5 things to do this weekend’. Just enter your email on the right side of our home page, and do not worry, we will not share your address with anyone else. We will also send a link on the first of the month so you can get an electronic copy of our new issue before it is even in print. There is no charge for this service. Last month we did a story about transportation on the beaches and mentioned that we were not aware whether the “Free Beach Rides” had adequate insurance in case riders were injured. We have been assured by all concerned that each of them are required by city license to carry a minimum of $300,000 in liability insurance, so ride in confidence. We are excited to report that it appears a negotiated compromise has been reached on the City of St. Pete Beach’s new comprehensive plan. Mayor Maria Lowe campaigned a year ago on promises to try to solve the city’s poop, potholes and partisanship issues. In the meantime the city has a new commission a new city attorney, a new city manager, new pumps in all the problematic pump stations and plans for rebuilding the most troublesome streets in the city. A more detailed report of the state of the city is expected in our April issue. As always we ask you to patronize our advertisers who allow us to publish this magazine for you. Please tell them you found them through Paradise NEWS and “Thank them” for their support. Peter, Renee and the Gang that bring you the news from Paradise. National Invasive Species Awareness Pinellas County recognized National Invasive Species Awareness Week through Feb. 28. A movement to bring attention to non-native plants, animals and pathogens, which can cause harm to humans and the environment, affecting the survival of native plants and animals. Invasive species are found throughout Pinellas County, in water and on land; including, resident’s yards and gardens. Invasive species are the second greatest threat to biodiversity and cost the nation billions of dollars every year to prevent, monitor and control. Invasive weeds can cause skin irritation, trigger allergies and poison pets and livestock. They can also clog waterways, kill native trees and shade out crops, ornamentals and native flora. During National Invasive Species Awareness Week, citizens attended a series of online educational webinars that taught them how to manage invasive species in the area. Webinars and additional information on managing invasive species is available at www.nisaw.org. Learn more about the invasive wildlife of Pinellas County on Saturday, April, 25, 10:30 am to noon, at a free educational class at Brooker Creek Preserve Environmental Education Center, 3940 Keystone Road in Tarpon Springs. Participants will learn about what animals to watch out for from a UF/IFAS Extension agent, who will also showcase an online tool which can be used to report sightings. Registration required. Sign up online www.brookercreekpreserve.org. UF/IFAS Extension Pinellas Co. is a partnership between Pinellas County government & University of Florida Institute of Food and Agricultural Sciences as part of a nationwide network of land grant universities. The University of Florida is an equal-access/equal-opportunity institution. The mission of Pinellas County Extension is to provide research-based knowledge and education programs enabling people to make practical

decisions to improve their quality of life and the world around them. Education focuses on sustainable living, lawn and garden, families and consumers, and 4-H youth development. Pinellas County Extension offers programming at the Extension office, 12520 Ulmerton Road, Largo, (727) 582-2100. The Largo office is open Monday to Friday, 8 a.m. to 5 p.m. Extension also offers programming at the Weedon Island Preserve Cultural and Natural History Center, 1800 Weedon Dr. NE, St. Petersburg, (727) 453-6500. For more information, visit www.pinellascountyextension.org & find Pinellas Extension on Facebook, Twitter and YouTube. UF/IFAS Extension – An Equal Opportunity Institution.

Nine Ways You Can Help • Learn about invasive species, especially those found in your region. Your county extension office and the National Invasive Species Information Center are both trusted resources. • Clean hiking boots, waders, boats and trailers, off-road vehicles and other gear to stop invasive species from hitching a ride to a new location. Learn more at PlayCleanGo.org • Avoid dumping aquariums or live bait into waterways. Learn more at Habitattitude.org •Don’t move firewood - instead, buy it where you’ll burn it, or gather on site when permitted. Learn more at DontMoveFirewood.org • Use forage, hay, mulch and soil that are certified as “weed free.” • Plant only non-invasive plants in your garden and remove any known invaders. • Report new or expanded invasive species outbreaks to authorities. • Volunteer to help remove invasive species from public lands and natural areas. • Ask your political representatives at the state, local and national level to support invasive species control efforts.

FWC raises awareness on lionfish issue with creation of ‘Removal’ day. Florida Fish and Wildlife Conservation Commission (FWC) adopted a resolution to help raise awareness about the invasive-lionfish issue. Saturday after Mother’s Day each year will be Lionfish Removal and Awareness Day. On this day, through education and outreach, the FWC will encourage extra effort from the public to remove lionfish from Florida waters. Lionfish are a non-native, invasive species that have a negative impact on Florida’s native wildlife and habitat. Consistent lionfish removal can reduce the negative impacts lionfish have on the reef community. The FWC has several activities planned for the weekend of the first annual Lionfish Removal and Awareness Day, which is May 16th. On the 16th and 17th, divers across the state will be encouraged to see how many lionfish can be removed from Florida waters in one weekend. Divers are asked to post results via the Report Florida Lionfish app or online at MyFWC.com/Lionfish. To supplement this effort, several local sponsors across the state are scheduling lionfish derbies in conjunction with the weekend. A festival and derby will be hosted by the FWC, Guy Harvey Ocean Foundation and the Gulf Coast Lionfish Coalition in Pensacola. The FWC is also excited to roll out its new Reef Rangers Lionfish Control Program the weekend of May 16 & 17, asking members of the public to select a reef and pledge to remove lionfish from that area several times a year. For further information, including upcoming events and how to fillet your catch so you can enjoy it for dinner, visit MyFWC.com/Lionfish.

UNDER ALL IS THE LAND…LET’S BUILD ON IT

Build your dream home where you now live. Most homes on our barrier islands are old, tired and subject to unacceptable insurance increases beginning April 1st. By way of example, remodeling an old house is like “putting perfume on a pig. It smells good but it’s still a pig”. Many floor plans don’t work anymore. Salt water damages structures and equity decreases with age. Maybe it’s time to build your dream home where you now live. How about a net-zero energy, storm and wind protected brand new home with affordable payments? It can be a great investment which builds equity for retirement or moving up or moving down or moving around. Over two-thirds of our barrier island single family homes are flood prone. The other third are worth more because they are less likely to flood and have much lower flood insurance premiums. Eventually the old/deficient structures will be replaced. Experts tell me that it’s

less expensive to build new rather than build up or remodel. The lots on our islands are worth far more than mainland Pinellas County lots. Your island home site can be used as equity to secure a construction loan for a new home. The entire process of replacing an old home can be accomplished in less than 6 months and it’s being done right now in Madeira Beach. To see some examples of net-zero energy, storm resistant beach homes go to www.planetgreenergy.com (scroll to eco-villages of Madeira Beach I and II). Contact me or a member of my “property wizard team” to see if some of these ideas could apply to your personal situation. My goal is to increase the value of our 16 island towns just like has happened on Long Boat Key and Naples beaches. As long as the U.S. economy keeps getting better, beach prices will increase faster than inland prices. When our economy recedes again people will still prefer beach living.

Under all is the land. If you own some, make it better and if you don’t own then buy some. As a real estate broker, former developer and owner of homes and businesses on our barrier islands, I am keenly interested in improving our quality of life with controlled growth. This will benefit all of us. In my opinion, there is no better overall value in our country than Florida Beach real estate. Let’s work together to make it the best it can be….NOW. Looking to Buy or Sell a Business? GET REAL ABOUT PROPERTY Travels Through Real Estate Law BY THOMAS A. BRODERSEN, ESQ.

Are You Sure You Want a Transaction Broker? When I started training real estate agents in the mid 1980’s, they represented either Buyers or Sellers, sometimes both, but never neither. It was a little complicated, because the real estate schools didn’t do that good a job of teaching agents who they represented in various situations, and what their legal duties were as a result. It wasn’t their fault, there just wasn’t enough hours of instruction in the pre-licensing courses to cover that (or contract law) that well. So, I made sure the agents I trained mastered all of those things, because I could, by doing it myself. Then the real estate profession, led by the Florida Real Estate Commission (FREC), decided to just “dumb it down,” to make it easier for agents to know what their duties were, through this “transaction broker” thing. A transaction broker, they say, doesn’t represent the Seller or the Buyer, they “represent the deal.” I always thought that was a bad idea for the profession, because they charged the same, but offered the public less. A transaction broker won’t tell you what he knows about the bargaining position of the

other side, such as that the Seller will take less or the Buyer will pay more. However, if you’re a firsttime homebuyer in Florida, you need all the help you can get. I think you should insist on a Buyers’ Broker when buying, and a Sellers’ broker when selling. But if you don’t ask, that’s not what you will get. I always urge Buyers (as well as Sellers) to talk to a real estate lawyer before they choose their Realtor®, and a real estate lawyer will undoubtedly hook them up with someone who will agree to represent THEM. It’s also important to know that everything in real estate is negotiable, including commissions, and when you should, and when you shouldn’t worry about negotiating them. Realtors® will also try to steer you to a title agency that is affiliated with their broker. That, too, is negotiable, but you will seldom hear anyone ask you what you would like in that regard. A good real estate lawyer serves as the head of your real estate team, and will save you money. ‘Nuff said.

FISHING REPORT H ’ M : UBBARD S

ARINA

WRITTEN BY

CAPTAIN MARK & DYLAN HUBBARD

-Salty Sol Fleishman Inshore- Captain Anthony Belmonte and first mate Monkey were fishing from our dock while waiting for the gel coat to dry on the Hub. They were using oysters with 2ot hooks catching fat sheepshead near the pilings. The same fish can be caught easily on Don’s Dock or underneath the Johns Pass bridge. We sell clams in our shop if you don’t want to collect your own oysters. If you don’t mind going through the motions bring a flat shovel and a bucket to scrape pilings and collect the falling oysters. Then use an oyster knife to open the oysters and then you’re ready to go! Don’s dock reports tons of redfish, black drum, and sheepshead being caught on and around their dock. They report the beginning of the slack tide as being the premium tide to target these fish! Near shore- the hogfish are biting well in the near shore waters. On the half day we’re averaging 2-5 and on our ten hour all day were averaging 5-12. The hogfish are biting best on live shrimp. However, we did catch some large hogfish using small crabs. Red grouper are biting well on live pinfish and long strips of squid. The bite is especially strong when the pressure cooperates either right before a front or a few days following it. The grey snapper have been big and plentiful on our 5 hour half day trips as well and they are even bigger and better on the 10 hour since we get twice as far for twice as long!

A Bayway Bridge re-dedication ceremony is being arranged by the City of St. Pete Beach with co-operation of the Florida Department of Transportation (FDOT) to kick off the day. Beginning at 9 am at the east end of the new Bayway Bridge, the structure will be re-dedicated to medal of honor recipient, Master Sergeant Gary Lee Littrell, a St. Pete Beach resident. A military flyover and marines rappelling off the bridge to boats below are expected, weather permitting. This will be followed by a parade across the bridge featuring a troop of recruits who will be inducted at around 11:30 am in Pass-a-Grille. Also featured will be several antique fire engines which will be on display in Pass-a-Grille along with a selection of military vehicles. VSPC organizers promise a day of fun for the whole family.

Activities include: • 10am - 4pm: Competition Car Show. • 11am - 5pm: Military Street Fair with Sponsor Exhibits, Kid’s Fishing Rodeo, Food Vendors including Bar-B-Q, Seafood tent, Pizza & Italian, among others; and a Silent Auction and 50-50 Donation Raffle. • 11:30am Opening Ceremonies & Military Induction Ceremony. St Pete Beach’s BRIGHTER FUTURE Story by STEVE TRAIMAN Flag Photo by Kathleen Finnerty • Aerial Photo by Spencer Lucas A proposed settlement over development regulations drew an attentive audience as the City Commission unanimously approved the Resolution and Ordinance at its first reading at its February 24 Commission meeting at City Hall.

The meeting had an extremely cordial atmosphere with virtually all comments very positive. Once the final vote was taken, Mayor Marie Lowe said, “If there was any time for an exception to our ‘no applause “rule, this is it!” — and the room broke into wild applause. Final approval at the March 9 meeting of the Resolution and Ordinance hopefully will end the court battles from 2004-2014 that have cost the city and its resident and business taxpayers more than, $2.439 million in legal fees. As noted in the February 6 Tampa Bay Times, the proposed settlement calls for remedial changes to the City’s comprehensive plan including completion of infrastructure studies that will determine the amount of redevelopment. Among major issues addressed: Reduce the height for hotel development from 146 to 116 feet; set new limits for front, side and rear setbacks; restrict development next to existing residential areas; and require a series of infrastructure studies to be completed before major redevelopment can occur. Both sides approved one change related to future easements for public access to the beach for new projects.

For language of the proposed resolution and ordinance, see accompanying article. City Manager Wayne Saunders told Paradise News, “Although we have another public hearing to go through, I am optimistic that a resolution is in sight. Everyone worked very hard to have open and honest discussions on the issues and cooperated in finding compromises that would address the issues while retaining the integrity of the plan and allow the City to move forward. After the proposed settlement was announced February 5, Mayor Lowe told the Tampa Bay Times she was “cautiously optimistic” that a solution had been found. She added, “The agreement gives the hoteliers much of what they wanted in the comprehensive plan. Height and density provisions have more than doubled.” Tim Bogott, TradeWinds Island Resorts CEO, told Paradise News, “TradeWinds is supportive of the compromise plan because it at least moves the City in the right direction. We hope that it will stimulate new hotel development and tax revenues for the City. However, the reduction in height and setbacks from the original plan may not have the desired result since it will not allow the full density needed to MARCH 2015

stimulate hotel development versus residential condominiums, which may now be more economically viable.” Attorney Ken Weiss, who with Tim Weber represented the key litigation clients, said, “Many people may ask why the settlement took 10 years? The simple answer is that before the current Mayor and commission were elected, former commissioners refused even to discuss settlement. Not only that, but after rejecting our settlement offers in secret shade meetings, the former commissioners actually told the residents that they weren’t interested in settlement. More importantly, former commissioners were found by the courts to have submitted deceptive and misleading ballot language to the voters and to have violated the Sunshine Law in their effort to thwart any resolution to the City’s comprehensive plan litigation. That being said, the settlement agreement provides a solid foundation upon which the City can begin redevelopment. The citizens involved in this and other litigation were simply advocating responsible growth. Under the proposed settlement agreement, I believe the City recognizes, and the agreement requires, that redevelopment proceeds responsibly and lawfully.

Maximum height has been reduced more than 20%. Equally important, the City has agreed to study the costs of redevelopment and to reevaluate the impact fees to be assessed to developers so that residents don’t pay for the costs of redevelopment. The settlement is a compromise that was the result of many days of meetings involving City officials, along with Tim Weber’s and my clients, and was negotiated in public. Everyone involved recognizes that the terms may not be acceptable to all concerned. Neither our clients, nor the City nor the hotels achieved every objective. In our opinion, the agreement provides a vehicle to insure that the City complies with its side of the bargain. For the first time in 10 years, and after many requests by our clients, the Mayor and commissioners agreed, finally, to sit down with the residents to arrive at this compromise. If citizens want to know why it took 10 years, perhaps they should talk to their former elected officials. The lesson is this: be sure to remember who those officials were and who supported them, because it could happen again.”

Resolution & Ordinance for SPB Development Settlement Summary of Resolution No 2015-02 First result of the proposed settlement came shortly after the agreement was announced. The Postcard Inn on Gulf Boulevard in SPB was sold to a new owner. Mayor Lowe told the Tampa Bay Times, “I am quite thrilled they have invested in the Postcard Inn. The attorney for the new owner told me they want to be good neighbors, good stewards of the beaches and work with the City on redevelopment.” She hopes this is the first of many redevelopment projects that will occur as a result of the proposed settlement. Once the agreement is finally approved with the required second reading at the March 9 Commission meeting (one day earlier due to City election), it must be submitted to the state for review. At that point, hoteliers and affected residents have 15 days to comment and/or seek further changes. Once the amended comprehensive plan is in place, the City hopes it will no longer have to warn developers that the plan is under any legal challenge. [Editor’s Note: Special thanks for their insightful comments to SPB Mayor Maria Lowe, City Manager Wayne Saunders and City Attorney Andrew Dickman; TradeWinds Island Resorts CEO Tim Bogott; and Attorney Ken Weiss.] [Steve Traiman is President of Creative Copy by Steve Traiman in St. Pete Beach, offering freelance business writing services. This Resolution authorizes the Mayor to execute a “compliance agreement” between the above named petitioners, who have challenged the City’s adoption of Ordinance 2013-13 and the associated comprehensive plan. Florida statutes provides for negotiation of settlements in cases filed in the Florida Division of Administrative Hearings. The case has been abated for several months while the parties negotiated a settlement. These negotiation meetings were all noticed and open to the public. On February 10, 2015, the city commission authorized the city attorney and city manager to seek finalization of a settlement between the parties. On February 11, 2015, a settlement was reached and the petitioners have signed the attached compliance agreement. Compliance agreement incorporates two exhibits:

1) the amended petition filed against the city and containing petitioners’ allegations that the city’s comprehensive plan is not in compliance with state law, and 2) a list of “Remedial Actions” that, if accomplished, will resolve the petitioners’ allegations. Remedial Actions has two sets of commitments:

1) studies that must be completed by the city, and 2) comprehensive plan amendments (“remedial amendments”) that the city must adopt. The companion Ordinance No. 2015-05 adopts those remedial plan amendments. Once the remedial plan amendments are adopted and the appeal period passes, the petitioners will dismiss their case against the city, at which time the city will have an effective comprehensive plan governing development in the city. Summary of Ordinance No 2015-05 This Ordinance provides for the approval of remedial plan amendments to Part I, Citizen Input on Community Redevelopment and Part II, Future Land Use Element of the City of St. Pete Beach Comprehensive Plan as specified by the Compliance Agreement referenced in Resolution 2015-02 resolving Division of Administrative Hearings Case No. 13- 003401-GM. Remedial plan amendments formulated through the settlement negotiations relate to following areas:

1) Clarifying and strengthening current policy provisions related to the City’s capital improvements and concurrency management program requirements to ensure adequate public infrastructure and facilities are, or will be, sufficiently in place to accom

modate existing and anticipated growth and redevelopment during the planning period in accordance with the City’s adopted level of service standards including solid waste and stormwater. 2) Providing for public review and design consideration of development projects in the Community Redevelopment District that exceed 30 temporary lodging units per acre or 50 feet in building height through the conditional use permitting process with quasi-judicial hearings before the Planning Board and City Commission. Also, setting forth the standards of review by which the potential impacts are to be evaluated. 3) Removing requirement that new construction exceed 67% of the combined aggregate floor area of new and existing principal buildings and accessory structures that constitute the entire unified development scheme on the buildable site from the definition of Scenario 2, Large-scale Development. 4) Adding setback standards for new buildings or building additions to the Large Resort District plan designation and amending building height limitations. 5) Establishing “edge” condition policies for the Large Resort District and adjoining residential properties outside the district relative to building height, setbacks, and buffering. 6) Adding side yard landscape buffer requirement for temporary lodging use buildings over 50’ in height with additional requirements when adjoining an existing residential use outside the Large Resort district. 7) Eliminating provision for affordable housing density bonus of five temporary lodging units per acre in the Large Resort District. 8) Eliminating references to Community Improvement Fund and other incentive programs that have not yet been implemented. 9) Eliminating references to a beach boardwalk or trail and instead requiring an easement for unimproved public access landward of the mean high water line prior to any building permit being issued for a large scale development or redevelopment projects in the Large Resort District. The City may require the same in the Boutique Hotel/Condo District. 10)Other clarifying or support language to existing policies necessary to resolve Plaintiff’s issues and concerns. L to R : Vice Admiral Joe Maguire; CEO Titus Herman; St. Petersburg Mayor Rick Kriseman; Gary Tibbets of U.S. Rep. Vern Buchanan’s office and veteran Michael Jernigan honoring Southeastern Guide Dog Brittani at her official retirement event.

Southeastern Guide Dog Hero Retires With Special Honors “Because of beautiful Brittani, I am free again,” says wounded warrior Cpl. Michael Jernigan, USMC (Ret.), the first U.S. serviceman to lose both of his eyes during the War on Terror, and Palmetto-based Southeastern Guide Dogs’ first Paws for Patriots™ recipient. After faithfully serving as Jernigan’s eyes for eight years, Brittani, 10, a yellow, female, Labrador-golden retriever mix, retired with honors at a unique, tail-wagging luncheon held at the St. Petersburg Yacht Club February 17. Jernigan is a St. Petersburg native who lost his vision while suffering severe bodily wounds and traumatic brain injury in a roadside bomb explosion in Iraq in 2004. The Marine co-founded the Southeastern Guide Dogs’ Paws for Patriots™ program in 2006 and was paired with guide dog Brittani on March 25, 2007. Special guests at Brittani’s retirement included Vice Admiral Joseph Maguire, who spoke of the life-changing service that Southeastern Guide Dogs such as Brittani provide to veterans and others; St. Petersburg Mayor Rick Kriseman, who proclaimed February 17 as “Southeastern Guide Dog Brittani Day”; and Gary Tibbets, aide to U.S.

Rep. Vern Buchanan, who presented Brittani with a commemorative flag that flew over the U.S. Capitol. Hand picked for her confidence, calmness and ability to help her handler overcome his vision loss and Post Traumatic Stress Disorder (PTSD), 75-pound Brittani has brought Jernigan unconditional love, confidence, independence and dignity, and enabled him to graduate college and build a successful career helping other veterans. Together, they have made 66 cross-country flights and shared messages of hope and opportunity to the world. Jernigan, who credits his ability to survive and thrive in the aftermath of his injuries to the patience, intelligence and devotion of Brittani, will be paired with a successor dog in the near future. Southeastern Guide Dogs’ Paws for Patriots™ program is celebrated for providing more than 100 dogs such as Brittani to deserving veterans like Jernigan, including guide dogs for the visually impaired; service dogs for veterans with PTSD; and facility therapy dogs for military hospitals around the country. In his remarks about Brittani’s service, Southeastern Guide Dogs’ CEO Titus Herman quoted the Marine motto “Semper

Fi”—from the Latin phrase meaning “always faithful” or “always loyal”. “During her career, Brittani had one mission, one purpose, and one pursuit,” Herman said, “to be faithful and loyal to Michael. To be by his side, leading the way. As his guide, companion, and friend, she helped him become the success he is today.” Now that she is retired, Brittani will enjoy the rest of her days as the adopted pet of a Jernigan family friend and continue to live in the St. Petersburg area. Southeastern Guide Dogs is internationally accredited and named as Tampa Bay Business Journal’s 2014 Non-profit of the Year. Founded in 1982, the organization employs the latest in canine development and behavior research to create and nurture partnerships between visually impaired individuals and extraordinary guide dogs. It serves more than 400 graduates across the U.S. and continues to place more than 100 dogs each year into careers benefiting people with visual impairments and veterans. The charity provides all of its services free of charge and receives no government funding. Visit www.guidedogs.org for more information.

You Think You Know Teens Here is a great feel good story, going on in our neighborhood. by Lisa Dower Recently, I had an opportunity to sit down and talk with some local St. Pete Beach teens and was struck by their good will and attentiveness. Not exactly the designation we give teenagers today. As I struggle to steal a minute of uninterrupted conversation with my own children, one particular comment resonated with me. “It so nice that we don’t bring electronics, no one is talking on the phone or chatting to other friends; we are always talking with each other.” Cheyce Bachelor was referring to the time she spends at her Sunday youth program and during their summer mission trips. I have to think this group, which operates out of Pass-A-Grille, UCC Community Church and are known locally as WAVE, is doing something right. While the kids gather each week to have some fun and explore their faith, youth leaders say the idea behind the program is to give teens a safe, welcoming, loving environment to gather. These leaders hope to nurture each youth so they understand that they are all invaluable and irreplaceable. Cheyce points out that the group is very diverse, with most going to different schools and living in other communities, “but at youth, we all get together and hang out and it’s nice to open up your friend group.” Along with the groups weekly gatherings, each year the 50 plus kids leave their friends, jobs, family and the creature comforts of home to help those in need. Taking time out of their summer, they travel to some part of the United States or the world. The work is hard, the hours are long and the pay according to the youth is in smiles, but each year they chose to go back again, try harder and usually with an even bigger group, as they continue to recruit friends to join their program. She says, “I really like getting close with my group - the people you volunteer with and the people you volunteer to help - you get to immerse yourself in the work with no distractions and I like that. Normally, you have your friends and keep putting off helping people, but these kinds of trips give you that opportunity.”

Another one of the teens, Kristin Smith remembers Pocahontas, Virginia, as her favorite stop. While she was there, her group helped build a wheel chair ramp for an elderly lady. When I asked the teens about the work, they say it is always hard, but you are “surrounded by friends and nice people so you don’t think about the work, you are always having fun while you do it.” This year, the kids voted to do a labor intensive building project. Jeanne Haemmelmann, Associate Minister for Youth and Young Adults and Leader of the WAVE group, says she is alway amazed at how the group responds to the choices. Each year she gives the high school seniors in the group three options for the following year’s mission. “ I try to give them a variety from the very difficult, hands on with long days, to the easy, more hands off, short days.” Haemmelmann says, the kids always pick the hard ones that have the most work and the least play. They will travel to a river village in the Amazon to work with indigenous people in the jungles of Peru. Working with Life Tree Adventures, an arm of Group Works, the teens will build a church and parsonage in two weeks. According to Caleb Renault, one of the groups’ seniors, “we wanted the project that would accomplish the most in the time we had.” Group leaders say the area they are travelling to is very remote with little or no resources, so they are responsible for bringing their own supplies, including tools, building materials, food and housing. These 14-18 year olds will leave behind iPods, iPhones and wifi, along with air conditioning and a comfortable bed to deliver 2000 pounds of lumber up a 100 foot embankment to a small Amazonian village of 100. There will be mud, bugs and sore muscles, but they say they can’t wait. In order to be self sufficient and not a burden to the local people, the group will travel by boat with everything they need, spending their days working in the village and evenings sleeping on the boat, some in hammocks. The accommodations sound anything but luxurious, and are absent of electricity and of course any kind of computer access.

In a world where most youths are looking for their next hand out, these kids are looking to provide the next hand up and are already working hard to raise the funds required to ensure that no youth is left behind for financial reasons. To get there, they will need to raise money not only for their group’s travel and stay, but also for the wood and building supplies. Organizers are also ensuring that a couple of days on the end of the trip are dedicated to rest and fun. So, this year, the kids will be adding a hiking trip up to Machu Picchu. Haemmelmann tries hard to give the kids balance. After 20 years as a youth leader she recognizes the need to reward the kids for their efforts. “What the kids see and do is very challenging. We try hard to break it down for them and help them understand that they are making a difference in the world. They can’t expect to change everything, in one trip, but the important part is just to give back when you can.” As I spent time talking with this exceptional group of young people, I couldn’t help but see the difference in their attitude and the positive effects on them because of their volunteer work. Ironically, it is the work that they enjoy, remember and get excited talking about, its not the white water rafting or the amusement park that was their favorite. Some even went so far as to say they always make sure that the fun doesn’t interfere with getting the job completed. This group is a non-profit organization and is always happy to receive support and encourages involvement with the group from any teen who would like to be a part. Emergency Access Permits St. Pete Beach Every resident will be required to obtain a new tag prior to the beginning of the 2015 hurricane season (June 1, 2015). In an effort to prevent looting and burglary after a large-scale mandatory evacuation, the City of St. Pete Beach has joined the Pinellas County Sheriff’s Office to provide free Emergency Access Permits to all businesses and residents of the barrier islands. Once a mandatory evacuation order has been lifted, Emergency Access Permits will be required to re-enter an evacuated area. Access will be limited based on the closest entry point to your residence. Residents are asked to hang the permit from their vehicle’s rear view mirror upon evacuation. When the order is lifted, law enforcement officers posted at the entry points to the City will scan the barcode on the permit to verify your residence. The Sheriff’s Department re-entry tags will replace the old St Pete Beach re-entry tags. Tags will be issued at: • St Pete Beach City Hall, Monday - Friday 8 am - 4 pm • Fire station 23, or Fire station 22, 8 am to 4 pm daily (subject to calls, training & other essential activities which require your firefighters to be out of the station).

Re-entry tags are limited to two (2) per residential property and maximum of Ten (10) to commercial properties (depending on the commercial property size and needs). • Residents need to bring a driver’s license as proof of residency. Persons who do not have a St. Pete Beach address on their driver’s license, may bring in a utility bill or rental agreement showing the address of their residence.

________________________________

Madeira Beach

Additionally, the City will schedule one evening and one Saturday morning sign up in April or May. Further details will be announced at a later date. • Two permits per household only. • Renters will be issued one tag, and one tag for the landlord. • Businesses do not fall under the two tag maximum. • Please make sure you bring proof of residency (i.e. driver’s license, lease, current power bill). Businesses please bring copy of your business tax receipt.

Due to construction and the upcoming move of our offices, the City/Fire Department will begin issuing emergency access permits to all residents and businesses of Madeira Beach Monday, March 16, 2015.

If you have questions, please call Trish Eaton at (727) 391-3400 or email reentrytags@madeirabeachfl.gov

Join the Great American Cleanup! Land, shoreline & dive cleanup - Saturday, March 21 on Saturday, March 21, 8am-12pm. Kayakers, paddleboarders and data collectors are also needed to support the event. Email Volunteer@tampabaygreenconsortium.org to volunteer today!

Tampa Bay Watch, in partnership with Keep Pinellas Beautiful, Tampa Bay Green Consortium and Manatee County Parks and Natural Resources is recruiting volunteers for a land and sea based cleanup of Fort De Soto Park, Cunningham Key, the Sunshine Skyway and Coquina Beach on Saturday, March 21, 9:00 am – 12:00 pm. This event is family-friendly and open to all ages. TBW is partnering with Tampa Bay Green Consortium to implement a Dive Cleanup at Fort De Soto Park’s Bay Pier 40 | MARCH 2015 | ParadiseNewsFL.com

For more than 20 years, volunteers have improved Pinellas County during Keep America Beautiful’s Great American Cleanup. Tampa Bay Watch sees the cleanup as an important way to help clean up human-generated trash as well as marine debris that floats onto the shorelines from Tampa Bay and the Gulf of Mexico, also protecting wildlife from unnecessary injury or death. Since 2001, with the help of over 5,000 Tampa Bay Watch volunteers, more than 50,000 pounds of debris have been collected including items like Styrofoam cups, construction debris, car batteries and countless cigarette butts, party balloons and plastic bags. We are also recruiting kayakers to assist with these cleanup sites. Additionally, at the Sunshine Skyway location, there will be a smaller team of volunteers specifically working on the fishing piers to collect fishing line and debris from our monotubes. The fishing line that is collected will then be recycled. Learn more about monofilament recycling programs, visit TBW Email Rachel at rarndt@tampabaywatch.org Call (727) 867-8166 x233 for questions about project.

March 2015 March begins with a Full Crow Moon on the 5th in fact-finding Virgo; revealing details of current issues. Aspects support ease in modifications of situations. Communication planet Mercury is now at full speed and enters psychic, sensitive Pisces on the 12th. Listen to your intuition and allow time for dreaming, creating and the arts for the rest of this month, especially until the 18th. Saturn, planet of responsibility and rewards, career and ambition is now visiting Sagittarians. On the 14th it will station retrograde for the next three months. This planet also has to do with government and officials; in the sign that concerns foreign lands and its people. It will be interesting to see what reforms take place during this time; and what will inevitably be revealed to the public.

On the 17th love and money goddess Venus makes its yearly visit to sensual Taurus. This supports practical decisions when it comes to matters of the heart and pocket book. But watch out for materialism and stubbornness, too. The New Moon Solar Eclipse in Pisces occurs on March 20th. The eclipse itself brings attention to natives of this sign, especially health matters. But for all of us, now is the time to let go of habits, addictions and excuses. The same day our life giving Sun enters bold, pioneering Aries; bringing a focus and strength to the self that supports success. Mercury visits Aries March 30th putting our minds in high gear! And last but not least action planet Mars slows down a bit in Taurus on the 31st allowing us to concentrate our efforts with patience and determination.

PISCES: Your own new year begins with a surge in creative expression and realization of new possibilities! Partners take the spotlight and reflect the changes you want to manifest! Leave the past behind, start right now. ARIES: You are full of energy charm everyone! Work and wellness has your full attention; get away for much needed quiet time before your birthday. New focus is on breaking through self, undoing habits to surge forward. TAURUS: Social events and romantic interest is on center stage for you! Take some quiet time together; dream and create the future. New energy lets you focus on health, habits and a fresh new look! Get ready to rock! GEMINI: You have home and family matters to attend to as the month begins. Much activity in career prompts you to steal some quiet time. The new energy cycle will finish old and begin new with goals and future plans. CANCER: Conversations with partners can be revealing. Career; energized and pleasant, with added responsibilities. Mid month, social time takes the spotlight. You are restless as ideas and beliefs unite to reveal new direction.

VIRGO: You take center stage; focus on vitality, wellness. Changes in resources are necessary. Talk things over with partners. Let go of old worn out ways and ideas; enjoy learning and transforming. A new path lies ahead. LIBRA: Full moon brings health and healing into the spotlight. Partners, both biz and personal are helpful; resourceful. New cycle ends old patterns, habits and confusion over current health and work issues; solutions revealed. SCORPIO: Social activities and groups are stages for you to express yourself. Work and home issues keep you busy. A new cycle clears out past creations; you have a new canvas. Romance is likely; partners agreeable. SAGITTARIUS: Career shines brightly and added income may result! The work place is pleasant; everyday life is busy. Clarity comes to home and family concerns. Let it be the opening of new doors; talk over the options. CAPRICORN: Legal and learning area is illuminated; you can affect the outcome yourself. Communication channels become clear. The new moon cycle ends confusion over family matters; home situations. Take a chance!

LEO: Income, values and earning potential take the full moon spotlight; career is favored. Travel and learning to move forward takes priority. Legal matters and resources are cleared of confusion resulting in a new direction.

AQUARIUS: Full Moon beams shine into financial matters; resources. You can communicate effectively now. It’s a pleasant time for family and home life. Release old values, possessions; see what is most important now.

FINAL Word by Julian Fant LORIDA'S BEST KEPT SECRET When my wife, Millie and I first became high school sweethearts in old St. Augustine, the state was a decidedly different place. Interstate highways did not exist and two-lane highways were the norm. My future wife had relatives living in Orlando, which was then a relatively small town in the farming and cattle country of central Florida. After my employment as manager of the Chamber of Commerce in Treasure Island, our frequent commutes found us passing sedate and quiet Orlando, stopping for coffee at a lone Stucky's west of the town. When I was later employed by a St. Petersburg firm which financed major projects with public offerings

of municipal bonds, the president of our firm informed us of our offering of bonds to finance the "Reedy Creek Improvement District" near Orlando and that details were very limited. We struggled with the sale of the bonds and finally sold our allotment. Imagine our surprise to later learn that a secret group of real estate firms had quietly bought up thousands of acres of undeveloped scrub and pine woodlands in central Florida....later to become amazing and life-changing Disney World, an event which changed Orlando (and Florida) forever! (the former lone Stucky's is now the site of most of the major hotels which are a part of this huge complex.) Hard to imagine that these events began over 50 years ago!

WOODY’S SELLS U.S. MADE ALL WOOD CABINETS!

by Peter A. Roos We recently wrote about the Karndean Luxury Vinyl Tile Flooring that you can see in person at Woody’s Kitchens and More’s conveniently located showroom. Flooring is only one of the renovation challenges that Woody’s owner, John Gerelus, is solving for his customers. Another is cabinets. Woody’s is an approved dealer for Waypoint® cabinetry. These cabinets are 100% made in the U.S. Woody’s everyday discount is 50% and the factory has frequent “specials” which can lower the cost even more. With Waypoint® cabinetry you receive a full limited lifetime warranty for added peace of mind. With the Waypoint® cabinetry carried by Woody’s, beauty is more than skin deep. Real beauty in cabinetry is not only about the way it looks, but also about the way it lasts. Waypoint® cabinetry is built to last. Every Waypoint® cabinet is made with American pride and craftsmanship using the finest materials available.

All construction meets or exceeds the rigorous standards set by the American National Standards Institute (ANSI) and by the Kitchen Cabinet Manufacturers Association (KCMA). There’s a KCMA seal to confirm it and a limited lifetime warranty to guarantee it. Waypoint® offers a large selection of styles and colors. Woody’s has displays, sample doors and catalogs to help you decide from amongst the many options available for cabinet sizes, door styles and color. The cabinets are delivered direct from the factory into your home, fully assembled, in foam-wrapped cartons, ready for Woody’s to install. All shipments arrive in 28 days or less. Woody’s can also help you choose your Quartz or Granite countertops to finish your kitchen and/or bath remodel. “Granite is very popular, but Quartz is another great alternative and you do not have to buy a whole slab”, says John. Woody’s Kitchens & More, 4737 34th St S. (US19). Call John at 727-864-4819, or visit the website www.woodyskitchens.com Tell them Paradise NEWS sent you.
