Schaber Health Law Scholar at the McGeorge School of Law, among the panelists. n March 3, the McGeorge Global Center and The University of the Pacific Law Review co-sponsored a symposium on the topic of marijuana that delved into the health, business, environmental and international aspects of advancing regulations. Distinguished Professor of Law Michael Vitiello organized the all-day symposium and gave opening remarks. [News Briefs] McGeorge Ranked High The National Jurist magazine once again included McGeorge in its 2017 honor roll for practical training, ranking the school No. 18 in the nation with an A grade. McGeorge appeared in the top 25 with an A- grade when the list debuted two years ago. The 2018 U.S. News & World Report Best Graduate Schools guide ranked the trial advocacy program as No. 10 in the nation (up from No. 12 last year). McGeorge rose in the overall rankings to 142, the international program was ranked No. 24 (from No. 25 last year), and the part-time program was ranked No. 34 (up from No. 38 last year).

Michael Hunter Schwartz Named New Dean

A

fter a national search, Michael Hunter Schwartz was appointed McGeorge’s 10th dean and will begin his role on July 1, 2017. Schwartz has served as dean and professor of law in the William H. Bowen School of Law, University of Arkansas at Little Rock, since 2013. Previously, he served on the faculties at Washburn University School of Law in Topeka, Kansas; Charleston School of Law in Charleston, South Carolina; and Western State University College of Law in Fullerton, California. Schwartz will succeed Dean Francis J. Mootz III. When Dean Mootz concludes his five-year contract in June, he will have a sabbatical leave in the fall and then return to the faculty in the spring. Schwartz has steadily climbed the National Jurist’s list of the 25 Most Influential People in Legal Education since 2015; this year he was ranked ninth by the magazine.

Competition Teams garner big wins

McGeorge’s trial and appellate advocacy teams have a banner year

Heather Phillips and Nicole Low, traveled to Los Angeles to compete in the National Civil Trial Competition and made an impressive showing in the semifinal round. Professor Bricker attributes the success of the mock trial teams and their recent No. 10 ranking in trial advocacy in U.S. News & World Report, to the commitment of the students and the invaluable coaching from highly experienced trial attorneys in the greater Sacramento region. The coaches this year included Keith Hill, ’96; Thien Ho, ’98; Jason Schaff, ’06; Alan Donato, ’09; Jeff Schaff, ’09; Jesse Saucedo, ’11; David Norton, ’13; Teal Ericson, ’13; and Courtney Martin, ’13. In spring McGeorge participated in several competitions, including the American Association for Justice (AAJ) Regional in which McGeorge advanced to the Nationals in Cleveland. McGeorge also hosted its 11th National Ethics Trial Competition (NETC) in March. The NETC

Mock Trial Team: Strong Season The McGeorge mock trial teams sprinted out of the gate in the fall semester with all three traveling teams earning national recognition, including championship round appearances and best advocate awards. Professor Cary Bricker, program director, stated that this is one of the strongest fall tournament showings for the McGeorge mock trial program in over 10 years. In October, Michelle Ahronovitz, Brittany Berzin, Alex Smith and Nia Traylor advanced to the championship round of the California Attorneys for Criminal Justice Trial Advocacy Competition in San Francisco. Traylor received the Best Advocate Award. Mike Jones, Gage Marchini, Albert Mendoza and Leslie Shergil advanced to the championship round at the Buffalo Niagara Competition, out of an original group of 36 teams from around the country. was established in 2006 by Professor Thomas Leach to promote ethical and civility awareness through the mock trial competition format. It is a one-of-a-kind event where students are assessed both on their trial skills and their professionalism in the courtroom. Moot Court Team: Best in California The fall season began with the Thomas Tang Western Regional, where KC Souza-Jenkins and Melissa Bocanegra won second-best brief. The strong season continued when students Andia Farzaneh, Melissa Currier and Lilliana Udang advanced to sixth place in the New York National Moot Court Final Rounds. McGeorge has sent a team to the NY final competition for four of the past six years. “We finished ahead of all the other California teams,” says Professor Ed Telfeyan, director of the Moot Court Program, “strengthening our claim to have the best moot court program in the state.” Two McGeorge teams competed in the American Bar Association’s National Appellate Advocacy Competition finals in April. One team was Udang, Anna Curry and Rainey Jacobson. The other team was Rosemary Deck and Michael Taney. Udang was named the Top Oralist of the regional competition. This is the second straight year—and

the fourth year of the past seven—that McGeorge has placed both of its teams in the national finals. The team of students Daniel Pickolick and Kyle Owen won the National Cultural Heritage Moot Court Competition. A second team of Bocanegra and Tania Dominguez advanced to the quarter-final rounds. The second Best Oralist award was given to Bocanegra. This is the second year in a row that a McGeorge team won the competition. The McGeorge team won the 2017 Roger J. Traynor California Appellate Moot Court Competition for the second straight year, and fourth in the last six. This year’s competition was hosted by McGeorge in April. Students José Parra, Conor Harkins and Souza-Jenkins won the overall competition and received the Witkin Award for Excellence in Appellate Advocacy. Alumni coaches this season included Brad Coutinho, ’12; Gil Vega, ’10; Leo Moniz, ’12; Etan Zaitsu, ’11; Andrea Moon, ’13; and Corrie Erickson Manning, ’11.

Professors in Law Journals Distinguished Professor Emeritus Brian K. Landsberg authored the lead article in Volume 12, Number 1 of the Duke Journal of Constitutional Law and Public Policy, “Lee v. Macon County Board of Education: The Possibilities of Federal Enforcement of Equal Educational Opportunity.” Distinguished Professor of Law John G. Sprankling’s article “Property and the Roberts Court” was published in January as the lead article in Volume 65 of the Kansas Law Review. Orientation Welcomed Students to New Programs McGeorge welcomed 228 new students at the fall orientation program in August and held a winter orientation for the first time in January 2017 for 30 new students. In the fall the school welcomed 134 day division J.D. students and 33 evening division J.D. students. The fall class also included 20 Master of Laws (LL.M.) students, 13 Master of Science in Law (M.S.L.) students, two J.S.D. students and seven J.D. exchange students. Additionally, the inaugural group of four Master of Public Policy (M.P.P.) and 14 Master of Public Administration (M.P.A.) students was welcomed to those new degree programs. In January, 11 M.P.A., two M.P.P., five LL.M. and 12 M.S.L. students started their degree programs.

Professor Stephen McCaffrey

istinguished Professor Stephen McCaffrey was named 2017 Stockholm Water Prize Laureate for his unparalleled contribution to the evolution and progressive realization of international water law. On the McGeorge faculty since 1977, he is the single most respected authority on international water law, and his work continues to influence scholars, legal practitioners and policymakers and contribute to the sustainable and peaceful management of shared waters. The announcement was made on March 22 at the annual UN-Water official World Water Day event in Durban, South Africa. King Carl XVI Gustaf of Sweden, who is the patron of the Stockholm Water Prize, will present the prize to McCaffrey at a Royal Award Ceremony on Aug. 30, during the 2017 World Water Week in Stockholm.

Professor Karrigan Börk’s new course, California Environmental Cases and Places, took a group of J.D., M.S.L. and LL.M students on a four-day camping trip to visit places that were the basis of important environmental law cases. Locations included Marshall Gold Discovery State Park, Mono Lake, Owen’s Valley, Death Valley, Ash Meadows and Yosemite National Park.

The McGeorge Water and Environmental Law Program hosted a March 11 symposium titled “The State Water Resources Control Board Turns 50 (1967–2017): Integrating Water Quality & Quantity in the Golden State.” Alumnus Justice Ronald B. Robie, ’67, Third District Court of Appeal, was a keynote speaker. Justice Robie was appointed to the State Water Resources Control Board in 1969 as its seventh member. From 1969 to 1975, he served as attorney member and vice chair, until his appointment as director of the California Department of Water Resources in 1975.

Law at the Local Level For the past two years, Capital Lawyering student Aoibheann Cline has clerked for the cities of Roseville, Sacramento and, currently, Elk Grove, all while maintaining a full course load and a 20-hour-a-week job at a private law firm. She is active in the Government Affairs Student Association and current president of the McGeorge chapter of the Federal Bar Association. Adjunct professor Chris Micheli, ’92, teaches Introduction to Capital Lawyering and Lawmaking in California, with California’s legislative counsel, Diane Boyer-Vine.

“What drew me to municipal law is that something new comes across your desk every day,” says Cline, “and it has a direct impact in the community.” She also has a municipal-law role model in the family: her father, Bruce Cline, is city attorney for Folsom. Cline clerks alongside alumni. “One of the unique things about

McGeorge [is] how supportive the legal community is,” she says.

Capital Lawyering students experience real-work learning through government and nonprofit externships, and clinics where they train and serve as administrative law judges, or draft bills and lobby them through the California Legislature. In the past five years, Legislative and Public Policy Clinic students have researched and drafted some 20 pieces of legislation, the majority of which the governor has signed into law. Both McGeorge’s excellence in government law career preparation and the clinic have been recognized and ranked in recent editions of National Jurist’s PreLaw Magazine. “What has really amazed me is how much good work smart students can get done with a lot of effort and some solid strategic thinking,” says Rex Frazier, the clinic’s creator and supervising attorney. The clinic’s value can’t be overstated, agrees Tom Nussbaum, the former chancellor of the California community college system, who created and teaches Introduction to Capital Lawyering. “I don’t think you’re going to find very many law schools with a clinic where students are not only dreaming up the proposals, but drafting them and advocating for them. I think that’s very forward-looking.” Capital Lawyering expertise also powers the Capital Center Advisory Board, more than 50 high-profile McGeorge alumni—lobbyists, legislative staffers, private-practice and public-service attorneys—who offer advice on Center activities and outreach and serve as resources to students.

Alumni Spotlight Brandon Bjerke, ’16, grew up in a politically

involved family. His father was a Bay Area planning commissioner and city council member. As an undergrad at Saint Mary’s College of California, Bjerke interned with several state legislators and Sen. Dianne Feinstein, and completed a double major in politics and history. As Bjerke began researching law schools, the Capital Center for Law & Policy and its J.D. Capital Lawyering Concentration emerged as a no-brainer choice. “Very few other programs focus on public policy, and none has the proximity to the Capitol that McGeorge has,” he says. The Legislative and Public Policy Clinic was a capstone experience during Bjerke’s third year, he says, and led to his first post-graduate job in “The Building”—the state Capitol—as a legislative aide to Assemblymember Jacqui Irwin (D-Thousand Oaks). Bjerke’s clinic project also led to passage of a statewide powdered alcohol ban, AB 1554, carried by Irwin and signed into law by Gov. Jerry Brown on Sept. 28, 2016. “We saw that it was a worthwhile issue and a huge public safety concern,” Bjerke explains. “It was such an interesting bill that we got two offers. While some of our classmates were struggling to find one author, we were trying to figure out which author to choose.”

hen Andrew Walker, ’04, visited the McGeorge campus, something “clicked” and he knew he had found his law school home. “I visited McGeorge and saw professors eating lunch with students. It made my decision easy.” As a McGeorge student, Walker came to law school ready to work hard and make contacts. He cites the internships and externships that he had as a student as vital to earning a staff position at the Institute for Administrative Justice on the McGeorge campus. “I immediately started managing several attorneys and realized that I was not only prepared for trial,” he says, “but also prepared to manage a law office, which was extremely important.” At first, he worked with other attorneys to protect the legal rights of parolees. Several years later, he advanced to director of the Institute and managed over 100 attorneys. In 2012, Walker helped to launch Focused Decisions where attorneys and students offer mock juries, focus groups and other litigation consultation services. “The cases that run through Focused Decisions are multimilliondollar cases that students would not otherwise experience until well into their career. The advocacy skills students learn in civil trials really stand out on a resume.” As for his future plans, Walker states, “The more I am at McGeorge, the more I want to stay. I want to keep bringing students innovative programs and opportunities that make a difference in their lives and careers. I am excited to see what we can build together next.”

Sosan Madanat, ’14, wants Californians to better understand state government By Joanna Corman

osan Madanat, ’14, is on a mission to teach Californians about how state government works. Madanat is executive director of the Foundation for Democracy and Justice, a Sacramento-based nonprofit that promotes awareness about democracy and government through education. The foundation, which launched in 2013, recognizes there is a need to better understand all three government branches, especially the judicial branch, says Madanat, who joined the organization in 2015. The foundation’s goal is to get more people to be active in state government. That means being an informed and active voter, understanding local and statewide current events, attending city council meetings, contacting elected representatives, and understanding how judges are elected and how the court system works. It also means that serving on a jury is both a responsibility and a privilege. At McGeorge, Madanat’s internship with then-state Sen. Noreen Evans set her up for a career in policy. During her internship with Evans, who then was chair of the Senate Judiciary Committee, Madanat researched the impact budget cuts were having on the courts and the ripple effects on Californians statewide. It’s why her mission is to educate people about the importance of the court system. “It was heartbreaking to hear some of the judges talking about the long lines people were facing to pay fines or to file for divorce,” she says. “A lot of self-help centers were closed. A lot of courthouses closed. People were having to drive unimaginable (distances) to try to resolve a dispute or problem, or file a temporary restraining order.”

J

acob Flesher, ’00, was encouraged to go to law school by his future wife—she sensed that he would be better suited at working in law than with his two hands on his grandfather’s farm. She was right. In 2000, he graduated from McGeorge with a Juris Doctor degree with an emphasis in advocacy. For his first job, he worked as a deputy district attorney for Ventura County. Flesher has immense gratitude for McGeorge’s trial advocacy program. “Because of McGeorge’s trial advocacy program, I got my first two jobs and have a network of terrific lawyers who are also lifelong friends.” In 2001, Flesher returned to Sacramento to join his McGeorge trial advocacy team coach, Bill Barry, at a civil trial firm. Now he serves as a civil trial lawyer at Flesher Schaff & Schroeder, Inc. Flesher has represented railroad companies, property owners, small businesses, professional athletes, nonprofits and insurance carriers. Much of his work has revolved around employment and accident lawsuits involving transportation companies and railways. Flesher and colleague Jeremy Schroeder achieved a winning verdict for their client Union Pacific Railroad Company in a wrongful death trial that concluded in February. The trial was featured on Lexis Nexis as its national document of the week. “I really enjoy trying cases. A former deputy district attorney and private practitioner, he served as a state administrative law judge for more than 20 years. Benjamin Diaz, ’66, died at the age of 83 on Nov. 28, 2016, in Sacramento. After an appointment to the Sacramento Municipal Court, he was elevated to the Superior Court, becoming the first Mexican-American to serve at that level in Northern California. Jim Lane, ’69, died at the age of 80 on Nov. 18, 2016, in Danville. He was a senior vice president of policy and planning for Kaiser Permanente in Oakland for many years and also active in the San Ramon Valley community.

Dennis Taplin, ’75, died at the age of 72 on Nov. 18, 2016, in Carmichael. A practicing attorney for nearly 20 years, he was also an active real estate investor and broker. Robert Schaldach, ’78, died of complications from Parkinson’s disease at the age of 72 on Oct. 28, 2016, in Carmichael. He was in private practice, primarily specializing in family law, for 37 years in the Sacramento area. Roberta Kierney, ‘79, died at the age of 75 on Sept. 7, 2016 in Seattle. A former Grass Valley family law attorney, she and her husband created the Kierney Family Scholarship, which benefits a continuing married student or a single parent raising a family. Patricia Hart Jorgensen, ’81, died of cancer on Dec. 2, 2016, in Sacramento. She worked for several state agencies, including the Office of Legislative Counsel, over 27 years in law.

Clinton Higbe, ’70, died at the age of 84 on Nov. 24, 2016, in Sacramento. He practiced estate planning and real estate law for more than 40 years.

John Garcia, ’84, died suddenly at the age of 60 on Dec. 27, 2016, in Carmichael. He practiced real estate law in the Sierra foothill area for 30 years.

Michael Specchio, ’70, died at the age of 74 on Dec. 31, 2016, in Reno. A former Washoe County public defender, he served as a juvenile master after moving into private practice. He was a Sparks Justice Court pro tem judge in retirement.

Jim Prichason, ’84, died of cancer at the age of 69 on Oct. 5, 2016, in San Francisco. An insurance law practitioner, he operated the Law Office of James S. Prichason for many years in the Bay Area.

Dana Anderson, ’71, died at the age of 71 on Oct. 6, 2016, in Fresno. He was a general practitioner for a quarter-century in the Central Valley. Chris Beecroft, ’74, died at the age of 67 on Dec. 26, 2016, in Las Vegas. He was the longtime ADR commissioner of Clark County’s Eighth Judicial District Court and its short trial program administrator. Roger Bennett, ’74, died at the age of 72 on Aug. 22, 2016, in Fair Oaks. The Pennsylvania native was a prominent tax attorney who broadcast his own radio tax-advice program for a number of years in the Sacramento area.

Jack Laufenberg, ’93, died at the age of 60 on Nov. 2, 2016, in Sacramento. He practiced family and criminal law for more than two decades and served as a president of the Sacramento County Bar Association. Carolyn Miller Cooper, LL.M., ’94, died at the age of 51 on Dec. 30, 2016, in Louisville, Kentucky. The executive director of the Louisville Metro Human Relations Commission, she was inducted into the Kentucky Civil Rights Hall of Fame in 2014. Diane Strickland, LL.M., ’95, died at the age of 57 on Nov. 5, 2016, in Palm City, Florida. She practiced tax law and estate planning in Monterey and continued to provide elder law services after moving to the East Coast.

[The Last Word] The Art of Arbitration

Noted insurance executive and arbitrator Paul Dassenko, ’82, discusses the value of legal education today

W

hen Paul Dassenko, ’82, passed the bar exam, he already had years in the insurance industry on his resume. His legal degree gave him a better understanding of the business environment and led to the creation of Azure Advisors, Inc., an international commercial arbitration and mediation firm Dassenko established to pursue his varied interests. Throughout his career (including stints as CEO and president of Risk Transfer Underwriting, Inc. and Converium Reinsurance), Dassenko has benefited immensely from the legal education he received at McGeorge. In thanks, he has provided financial support to the school and served on the search committee that recommended the appointment of Michael Hunter Schwartz as the new dean of McGeorge. Dassenko was the 2017 McGeorge Commencement keynote speaker. What stands out as a highlight in your career? The cases we hear as international commercial arbitrators can have a tremendous amount at stake. One that stands out had $8.5 billion at stake and involved 75 lawyers. It was complex, challenging and absolutely fascinating.

Why is it important to you to support legal education? It seems to me that some of the contentiousness we see in political discourse in this country shows a lack of understanding for the rule of law in our society. We need to do everything we can to have our citizens understand that the rule of law is why we can live and work together as a country and hold deeply divergent views at the same time. That’s one of the reasons I have an abiding interest in McGeorge and legal education in general. How can a legal education be helpful outside of traditional applications? There are extremely exciting ways to use your legal education in nontraditional areas. For example, medical care is a huge growth industry; there must be four or five departments in any hospital or hospital management company today that need to use lawyers. That can be translated into almost any industry experiencing greater regulation or more complex legal issues in the way they operate. You will always have an advantage if you understand how the law works and applies. What’s something people might be surprised to learn about you? I play the cello. I was lucky to be raised in a musical family. I’ve played in amateur symphonies, but my sister is the talented one; she’s the concertmaster for the San Luis Obispo Symphony.
