Jennifer Martinez is a homeowner for the first time in her life. And she loves it. Under the Neighborhood Stabilization Program, part of the federal Housing and Economic Recovery Act of 2008, the Martinez family — Jennifer, Juan and their three young children — recently purchased a home from Central Oklahoma Habitat for Humanity. It was the first home built and sold in Oklahoma City under the program. “Just seeing my children’s faces every day, they’re excited to wake up in their new home,” Martinez said. “They’ve lived in an apartment for all their life, so they don’t really know the feeling of having a backyard and being able to scream at the top of their lungs without getting in trouble.” The Neighborhood Stabilization Program was introduced to redevelop communities through the purchase and renovation of foreclosed and abandoned residential properties. Oklahoma City has received more than $13.25 million in grants under the initiative, said Matt Gabrielson in the Oklahoma City Planning Department. Following federal guidelines, Oklahoma City has established a geographical target zone for application of the funds — bounded on the north and west by Interstate 44, on the east by Interstate 35 and to the south by Interstate 240. The city is allocating its funding through a partnership with Central Oklahoma Habitat for Humanity and Neighborhood Housing Services of Oklahoma City Inc., a nonprofit organization designed to help people become homeowners. By law, one quarter of Neighborhood Stabilization Program funds must benefit individuals and families earning below 50 percent of the area median income, or just over $20,000. Gabrielson said the city was pleased to partner with Habitat for Humanity, which has a “special expertise in that income bracket.” But, Gabrielson emphasized, the program also contains provisions allowing homebuyers earning up to 120 percent of the area median income to qualify for asSEE HOME, PAGE 2F

Finding close-knit neighborhood may take work Many people believe buying a home in a highincome neighborhood will automatically ensure they live in a warm, welcoming place. But Peter Lovenheim, an author who has written extensively about finding community in contemporary America, says sociological studies show no link between a neighborhood’s economic level and the friendliness of its residents. “It’s counterintuitive but true that there’s no income correlation with friendliness,” said Lovenheim, author of “In the Neighborhood,” which chronicles his quest to make connections in the suburban neighborhood where he’s long resided. By the same token, Lovenheim said there’s no correlation between the type of habitat and the de-

gree of social connection among its residents. “Community can be found on the 20th floor of a high-rise or on a suburban street,” he said. Lovenheim contends it’s harder than in past eras for homebuyers to find friendly, close-knit neighborhoods. One major reason is that people are busier than before, given that many families have two wage earners. “In most neighborhoods, there are fewer adults at home during the day. Also, people now spend more time on the

Internet and watching TV,” he said. Moreover, Lovenheim believes Americans now sense more “stranger danger” than in previous decades, though he questions whether there’s truly more risk in most residential communities than in the past. Though some people prefer to live fairly anonymously — with little or no neighbor contact — most find life more pleasant in a community where they know others and interact on good terms. “Neighborhoods are meant to be a fundamental building block of society. There’s a basic need to feel a common humanity with the people who live closest to us,” Lovenheim said. Here are pointers for homebuyers who want to live in a friendly community:

Seek a neighborhood with strong public schools. “Strong schools are the epicenters of a strong community. Children of all ages bring people together,” said Mark Nash, a real estate broker and author of “1001 Tips for Buying and Selling a Home.” Nash encourages prospective residents, including those with no school-age children, to visit a neighborhood’s schools before deciding to buy a home there. Visit the neighborhood at several times of the day. Nash suggests that those with a strong interest in a community visit the area at varied hours to look for patterns of activity. Also consider visiting on a weekday as well as the weekend. Realize that residents of a newly built subdivi-

sion can be very approachable. “In a new community, everyone is looking to bond. They’re all starting out from the same point,” Nash said, noting that there’s no established friendship structure or social hierarchy into which new arrivals must break in. Don’t forget that friendship is a two-way street. Those with a support structure near their home have many advantages. Not only can you borrow two eggs to finish that batch of brownies you’re baking, but you also could find neighbors who will watch your house while you’re traveling. Most important, you’re likely to find help in an emergency situation.

sistance. “That brings about 60 percent of the population into play” for homebuyer assistance under the program, “including up to $6,000 in down-payment assistance,” he said. Since federal guidelines require that allocated funds be committed by the end of September of this year, the city has been “very hands on” in acquiring distressed properties to rehabilitate under the program. “We’re out there inspecting and bidding” on homes in foreclosure, Gabrielson said, and looking for listings “from local Realtors, on the open market.” However, the city does make it a policy to “defer to individual homeowners” in the bidding process, Gabrielson said, by underbidding a private party seeking to renovate and take possession of a home. “But we do compete very actively with investors,” he said. The couple’s zero-interest mortgage is carried by Habitat, which reinvests proceeds into more affordable housing for limited-income families in central Oklahoma. Martinez said she will work to spread the word about the assistance offered by Habitat. “It’s a wonderful program,” she said. “It gave us the opportunity to own our own home when we thought it was impossible. Major milestones in our life will take place in this house,” she said. Lenders see growing risk of defaults from buyers with good credit scores WASHINGTON — With tougher mortgage underwriting rules a virtual certainty under Congress’ new financial reform legislation, lenders have begun confronting another vexing issue: Can homebuyers who have high credit scores really be trusted not to pull the plug — strategically default — when the economy hits a rough patch and home values tank? New research based on data from 25 million active consumer credit files suggests the answer might be no. Though people with the highest-ranking credit scores are less likely to default on their mortgage compared with people with lower scores, when they do default, they are much more likely to do it strategically: simply stop paying with little or no warning in advance. In a study released June 28, researchers from credit bureau giant Experian and the Oliver Wyman consulting firm found that borrowers with “super prime” credit scores accounted for 30 percent of all mortgages outstanding in mid-2009 but produced just 5 percent of all serious mortgage delinquencies. However, 28 percent of

those elite scorers’ defaults were calculated and strategic, versus 18 percent for the overall population of borrowers in the sample. This pattern, in turn, is forcing lenders and the credit industry to seek new ways to evaluate risk beyond traditional credit scores. Charles Chung, Experian’s general manager of decision sciences, said in an interview that “lenders not only are looking at credit worthiness,” as measured by traditional credit scoring models, but also at applicants’ likely “ability to pay” under scenarios in which real estate values drop. In the future, lenders may need to adjust underwriting and risk-rating rules — such as higher minimum down payments, higher interest rates — to deal with loan applicants who fit the profile for walkaways in a de-

preciating real estate market. The latest study, which follows up on earlier research involving credit files where consumers’ personal identifiers had been removed, tracked strategic defaulters in 2009. By examining payment patterns in individual credit files, Experian and Oliver Wyman estimate that about 19 percent of all mortgage defaults last year involved intentional, strategic walkaways. Though there was some evidence that total defaults may have peaked at the end of 2008, the walkaway issue remains a costly and controversial one for the mortgage industry. Fannie Mae announced in late June that strategic defaults have become such a problem that it is toughening its policy and will pursue walkaways for unpaid balances and penalties wherever permitted by state law. The Experian-Oliver Wyman study confirmed that geography plays a significant role in the strategic default phenomenon. Homeowners in volatile boom-and-bust states such as California and Florida have been especially prone to walk away

from deeply negative equity situations. A separate study by three researchers at the Federal Reserve found that not only is geography crucial, but state law treatment of unpaid mortgage debt balances following a walkaway may play major roles as well. The Fed study examined 133,281 loan histories from Arizona, California, Florida and Nevada where borrowers were underwater on loans. According to the researchers, in California and Arizona, where state law imposes restrictions on lenders’ abilities to collect post-foreclosure deficiencies on principal residence mortgages, borrowers were more prone to walk away from their houses at lower levels of negative equity compared with borrowers in states such as Florida and Nevada, where lenders face fewer restrictions. “This result suggests,” said the Fed study, “that borrowers may factor into the costs of default the potential legal liabilities resulting from a foreclosure.” E-mail Ken Harney at kenharney@earthlink.net. Contractor should repair uneven living room floor DEAR BARRY: We recently hired a contractor to enlarge our living room. But there is a dip in the wood flooring where the addition meets the original construction. When the work was still in progress, we noticed that the old and new floor surfaces were uneven, but the contractor told us it would not be noticeable once the wood

flooring was installed. Now that the work is finished, it is very noticeable, and the contractor refuses

to take responsibility and fix it. What recourse do we have since we have already paid him for the completed work? Amber DEAR AMBER: The contractor’s refusal to correct the problem is entirely unreasonable because you pointed out the unevenness before the hardwood was installed. At that time, it

Appliances top carport when flipping a house Q. I have two questions about fix-and-flip remodels. On a 1963, 1,300square-foot tri-level brick, is it worth it to build a carport? Some homes in the neighborhood have carports and others have garages or nothing at all. This home also has no appliances. Is it best to buy appliances so it shows better? A. Two good questions, although both are a little hard to answer because they depend so much on the specifics of your exact neighborhood location. As to the carport, my suspicion is that you might not recover your entire investment on that one. I would ask your real estate agent for sales figures of comparable houses in your area (or go online and get them). Look at the selling price (not the original listing price), and compare what homes with carports sold for compared to ones

This should give you a pretty good idea of what the difference is in selling prices (assuming the homes are comparable in size, etc.) You can then look at the cost of the carport or garage and hopefully get a better idea as to whether or not it will be worth it. I’m not the biggest fan of carports in general. Unless they are well designed and constructed, I think they detract from the overall look of the home rather than add to it. I much prefer the appearance and functionality of a

garage, but of course that’s a more expensive undertaking. As far as the appliances go, my opinion would be to put them in. I think they add greatly to a home’s appeal, and they make it easier for a potential buyer to visualize living there. It’s the same reason that I’m a fan of staging homes with furniture to make them more appealing. If you decide to go with appliances, make sure that they are of a style and value that’s consistent with the house. New appliances are definitely preferable to used ones, and don’t go overly cheap or overly extravagant — again, match them to the house. He gave you false assurances, and now he should stand by his word. If he refuses your fair request to correct the problem, he should receive a strongly worded letter from

a construction defect attorney. A consumer complaint should be filed with the state agency that licenses contractors, if there is one. NEW YORK — The number of buyers who signed contracts to buy homes tumbled in May, a sign the housing recovery can’t survive without government incentives. The National Association of Realtors said its seasonally adjusted index of sales agreements for previously occupied homes dropped 30 percent in May from April. The index fell to 77.6 from 110.9. May’s reading was the lowest dating back to 2001. The index also was down 15.9 percent from the same month a year earlier. The reading provides an early measurement of sales activity because there is usually a one- to two-month lag between a sales contract and a completed deal. The sharp declines were widespread. Pending sales dropped by 33.3 percent in the South, by 32.1 percent in the Midwest, by 31.6 percent in the Northeast and by 20.9 percent in the West. Federal tax credits helped to boost home sales this spring. First-time homebuyers could get

worse than virtually anyone, including the housing bears — a group in which we find ourselves — envisioned.” There had been hints that the falloff could be worse than expected. New home sales for May dropped 33 percent to the slowest pace in the 47 years records have been kept. It was the largest monthly drop on record. Homebuyers did get a little more time to close on their homes and receive the tax credit. Congress extended the June 30 deadline to complete sales until the end of September. NEW YORK — Manhattan home prices edged up in the second quarter as sales surged from their lows last year. Reports show the Big Apple’s housing market in recovery, though headwinds such as high unemployment, tight credit and shadow inventory still linger. Low mortgage rates and relatively affordable prices helped to lift sales of condominiums and co-op units by as much as 81 percent from last year, depending on the report. Sales activity is now at levels averaged over the past decade. The median price for an apartment ranged from $800,000 to $899,000, an increase of 3 percent to 8 percent from last year, the reports showed. Prices were buoyed by more sales of larger apartments, said Jonathan Miller, president and chief executive of real estate appraisal and consulting firm Miller Samuel Inc., which

analyzed the data for Prudential Douglas Elliman. Sales of three-bedroom apartments made up 18 percent of all sales, compared with 12 percent a year ago, he said. New buyers came into the market and helped create bidding wars, said Pamela Liebman, president and CEO of The Corcoran Group. A survey of Corcoran agents showed that in two-thirds of bidding wars in the second quarter, the winning offer was at or above the listing price. Sellers received 96.6 percent of their asking price, up from 92.6 percent in the same quarter last year, according to the Brown Harris Stevens report. Fewer sellers offered price cuts this quarter and some even asked for more, according to StreetEasy.com’s report. The number of homes on the market fell from last year as did the amount of time an apartment spent on the market before being sold, the reports showed.

Beverly Hilton shines in the Hollywood spotlight Some destinations evoke memories of old Hollywood — places that remind us of Marilyn Monroe, Dean Martin, Sammy Davis Jr., Lucille Ball and others. In Los Angeles, Hollywood Boulevard and the Beverly Hills Hilton come to mind. The Beverly Hilton, once owned by Merv Griffin, is probably best known as the venue for the Golden Globe Awards. Recently, I traveled to Los Angeles to attend the 35th annual Gracie Awards, sponsored by the

Gov. Bill Richardson vowed to make New Mexico greener, and one of his last major efforts is new regulations requiring buildings — from houses to warehouses — to be more energy-efficient. The state Construction Industries Division has been holding hearings on an overhaul of state building codes that increase energy efficiency by 20 percent over the current regulations. It’s a key component of the governor’s broader goal of reducing per-capita energy use in New Mexico 20 percent from the 2005 level by 2020. But commercial developers say the proposed regulations, which are 10 percent stricter than new national model codes, would be among the most stringent in the nation and would make the state one of the most expensive in the region for building. “It’s a disincentive for economic development at a time we’re in a depressed economy and need new jobs to move in here,” said David Weber, a commercial banker and board chairman of the New Mexico chapter of the National Association of Industrial and Office Properties, a commercial real estate developers’ association. The residential construction industry says the timing couldn’t be worse. “It’s really tough out there now. It’s really hard,” said Jack Milarch of the New Mexico Home Builders Association. “The in-
