Battle over land } Jabulani Dlamini

THE battle for control of the Oppermansgronde land worth R110 million is at the centre of a march planned for Saturday (25/04) in Koffiefontein, about 200 km south-west of Bloemfontein. According to financial statements prepared by PJ Vorster Accountants of Kimberley in 2013, the 38 000 ha prime real estate was worth about R111 940 331 in May 2013. The land, handed back to the community in April 2003, can be utilised for crops and game, as well as animal farming. According to the applicants of the march, the march is essentially to lodge grievances against the chairperson of the Oppermansgronde Communal Property Association (CPA), Louis Barnes, and the South African Police Service (SAPS). Barnes was arrested on Saturday (18/04) at Oppermansgronde after allegedly assaulting and pointing a firearm at Peter August, a claimant. “He (Barnes) came here on Saturday at about 11:00 with his son and four of his workers

and kicked down my door and also pointed a gun in my face. That man must get off our land, he is not a rightful beneficiary of this land,” August told Express. Const. Masilela Langa, police spokesperson, confirmed that Barnes had been arrested on Saturday and appeared in the Koffiefontein Magistrate’s Court on Monday (20/04) and was remanded in custody. He will appear on Wednesday (22/04) for a formal bail application. The marchers also want the Free State chapter of the Rural Development and Land Reform Department, which is listed as the third respondent in a copy of the application to march, to intervene in the potentially deadly feud among the CPA members. Julian Topkin, spokesperson for the marchers, said they essentially wanted the committee of the CPA to be disbanded. “There is complete mismanagement and financial statements are not made available to other members, so we would like the department to suspend the committee and allow for the re-election of a new committee,” Topkin said. Asked about allegations that Barnes was not a rightful claimant of the Oppermansgronde land, Topkin said they had been speaking to the Rural Development Department for a long time about this, but nothing had happened thus far. “There are contradictions between the court papers filed by Barnes and what his

birth certificates says regarding who his parents are,” Topkin said. In an opposing affidavit filed in the Land Claims court in 2014 and signed by Barnes on 23 October 2013, Barnes said he was born out of a marriage between a descendant (Augusta) of the land’s original owner Frederik Salomo Opperman and his father Charles Barnes. Express is in possession of a copy of Barnes’s birth certificate which lists his mother as Cathleen Elizabeth Palm in contradiction to his claim in the affidavit. Serame Mzizi, director of corporate services for the Rural Development Department, said although Rural Development and Land Reform minister, Gugile Nkwinti, would be in Qwaqwa on Saturday and most officials would be there, someone from the department would receive the marchers’ memorandum. ) Repeated attempts for comment from committee members were unsuccessful, with Phillip Barnes’s phone, as well as that of his deputy, Artie de Koker, ringing unanswered. The phone of the CPA’s secretary, Dawie Cornellisen, was answered by a woman who said she was his domestic worker and he was not there. She could not say when he would be back. The cellphone number of Henry Jacquier, the CPA’s bookkeeper, was answered by a woman who did not identify herself, but said he was not available.

CRICKET SOUTH AFRICA (CSA) on Tuesday (21/04) launched the 16-team Africa T20 Cup which will be the African curtain-raiser to the 2015-’16 season. Zimbabwe, Kenya and Namibia have accepted invitations to compete in the event, with the other participants being the 12 CSA affiliates, as well as associate member KZN Inland. The tournament will be a world cup-style competition, consisting of four pools of four teams each with the winners of each pool advancing to the semi-finals and eventually to the final. Easterns (Sahara Willowmoore Park), North-West (Senwes Park), Griquas (Diamond Oval) and Free State (Mangaung Oval) will be the venues for the four pool matches and some of these venues will also host the semi-finals and final depending on which teams advance and based on an assessment of the quality of venue hosting during the pool stages. The tournament will run from 4 September to 4 October. All franchise players will play for the province at which they are contracted, although a limit of four has been placed on the number to be fielded at the same time. This limit will not include the contracted Protea players, who are restricted to one in the starting XI. In addition, all teams will be required to field at least two u.21 players. Transformation targets will be the same as that which applies for the CSA semi-professional competitions (six players of colour and three black Africans). “This tournament is an exciting new concept for our cricket,” commented CSA chief executive, Haroon Lorgat. “It should provide impetus at the start of a season with exciting and competitive playing opportunities plus revenue generating potential for each team. “We are keen to lead the way in developing an Africa-wide competition. “With international Twenty20 matches to follow against England and Australia later in the season, this tournament will provide an early start for players to stake a claim in next year’s ICC World Twenty20 squad. “A key differentiator is for each team to include two u.21 players which will give rising stars the chance to play with our fully-fledged professionals. “It is an important factor in developing talent that emerging players can learn from the best. “I am delighted that SuperSport will be providing live and full coverage of ten playing days, including the semi-finals and final, and thank them once again for their fantastic support of South African cricket,” concluded Lorgat. Girl (13), family need help 13-YEAR-OLD Thandeka Jolingana needs help. The girl whose name means “loveable”, has never been to school and plays alone most of the time. Thandeka’s mother, Ntombizodwa, says she was told by doctors that her daughter’s brain is basically not growing. “She has to wear a helmet at all times as she sometimes just suddenly falls and can get seriously injured if not protected,” the 52-year-old mother told Express. Thandeka lives with her bubbly mother in a modest shack in the fast-growing area of Khotsong Mafora, south of Bloemfontein.

Ntombizodwa explains that she used to work as a domestic worker, but gave up her job eight years ago to look after her daughter on a full-time basis. “Apart from a new helmet (the one she is currently using is badly cracked from the constant falling), Thandeka also needs a wheelchair urgently as well as adult nappies, because she is unable to control her bowel movements,” says David September, a Gospel artist who brought Thandeka’s plight to Express’s attention. Although Express could not establish the exact condition Thandeka suffers from, Ntombizodwa says in addition to epilepsy, which is characterised by violent fits and convulsions, Thandeka also just falls and it is then that she normally gets injured.

During Express’ visit to the family, September took Thandeka for a walk and although she is able to walk, she does so with great difficulty and often falls in the process. “We have had several offers of help, but very few have really materialised with many of those who offer to help simply not coming back after committing to helping my daughter,” Ntombizodwa says. The family survives on Thandeka’s disability grant.

} Thomas Hartleb EFF LEADER Julius Malema said in most cases xenophobic attacks are spontaneous, but someone using a knife had the intention to commit a crime. Referring to the attack on Mozambican Emmanuel Sithole, Malema who visited the Johannesburg township of Alexandra on a door-to-door campaign against xenophobia on Monday, said: “In most cases the xenophobic attacks are spontaneous and people use bricks and those types of things. But a knife? You left your house with the intention to commit a crime. “We have a weak government; we have a weak state. We have a self-serving leadership which has neglected the masses,” he said when asked if the attack would not have happened with a stronger government in place. Earlier an EFF member was shot and wounded shortly before the party leader arrived in the area to call for an end to xenophobic violence. The man was shot in the knee, apparently by a man firing into the crowd.

Following the shooting, Malema said: “Today our fighter was shot. No amount of intimidation will stop us from protecting our fellow Africans.” Referring to the perpetrators of the violence, he said: “Let us put pressure on these people. “We know them. Let us take responsibility and make this place a beautiful place.” Malema told journalists that Sithole’s killing was not xenophobia-related. Sithole was stabbed to death on Arkwright Avenue in Alexandra on Saturday morning, not far from where Malema was speaking. Earlier Malema addressed a cheering crowd from the back of a double-cab bakkie saying he was ashamed of the violence that had so far claimed seven lives. He called for South Africans to respect their fellow Africans. “We are all Africans,” was a line Malema repeated throughout his speech. Malema defended Zulu King Goodwill Zwelithini, saying his remarks in Pongola, KwaZuluNatal, last month, which had been blamed for starting the xenophobic violence, were not a call to kill foreigners.

XENOPHOBIA is symptomatic of several crises South Africa is suffering from, Zwelinzima Vavi, expelled Cosatu general secretary, said on Monday (20/04). Speaking to reporters ahead of Thursday’s (23/04) People’s March Against Xenophobia in Johannesburg, Vavi said a report that he had said the xenophobic attacks in South Africa could have been prevented if millions had not been spent on Pres. Jacob Zuma’s Nkandla homestead, was not accurate. “I do not write the headlines of newspapers. The newspaper, The Citizen, wrote that Vavi blames Nkandla for xenophobia,” Vavi said. “No, that is not a reflection of my (speech) that I was making yesterday (Sunday).” He said crime was an expression of a social and economic crisis facing society, with violence, racism and xenophobia being expressions of fear, insecurity and hopelessness. “There are four crises facing South Africa today, which we have summed up in the previous period . . . to say they represent a ticking time bomb.” The biggest crisis was unemployment, where a country with an employment rate of 35% should see itself as being in a state of emergency, according to Vavi. He stated that among middle-income countries, South Africa was in the worst position when it came to this. “The second crisis is poverty.” If you have around 12 million people, out of 53 to 54 million, sleeping in a place where they are unable to put food on the table, then you are faced by a crisis. “The third is we are the most unequal society in the world today . . . after 21 years (of democracy) we are now occupying a very unfamiliar position of number one . . . We don’t call it a challenge, we call it a crisis.

Intervention due to crisis In Durban on Monday, Zwelithini said it was important for him to hold an urgent imbizo following the spate of attacks on foreign nationals in KwaZulu-Natal last week. He said he had made the decision to call the imbizo after meeting with Home Affairs Minister Malusi Gigaba and State Security Minister David Mahlobo. “It was important for me to intervene because this was a crisis,” he told a crowd at the Moses Mabhida Stadium in Durban. The king said the last two months reminded him of the Rwandan genocide. “This was the worst massacre in history . . . It showed the role played by the media and the political leaders in the killing. “In 2015, we woke up to the news of the Kenyan killings. We are heartbroken as the Zulu monarch. It was reported that 147 people were killed. “To bring it back home, we know that foreign nationals have been displaced in the last three weeks. “What’s shameful is that this is not the first time,” he said referring to the xenophobia attacks in 2008. He said the SAHRC needed to be given time to conduct an investigation thoroughly and without intimidation. “I’ve written two letters to the commission and have urged them to also investigate the media’s involvement in inciting violence. “I believe that the media must open itself up to being investigated if they have nothing to hide. “My speech in Pongola was addressed to the crime issues facing the country. Instead the nation has been told that I have said otherwise. This is funny. Even today, I’m still asking the media to write my entire speech. I want the media to write the entire speech from that day.” Zwelithini said the imbizo was not called because he had sparked the attacks, but because he knew that South Africa could beat this.

Bloem Show ready for take-off } Sidwell Guduka ELMARIE PRINSLOO, chief executive officer of the Bloem Show, has confirmed that this year’s edition of the event will not be affected by load shedding. The 10-day event, which was officially launched in the Bloemfontein Showgrounds’ Sunflower Hall last Wednesday (15/04), kicks off on Thursday (23/04), and it runs until 2 May. “In case of load shedding, Centlec in conjunction with Bloem Show organisers, have taken a decision to exempt the Bloemfontein Showgrounds from load shedding for the duration of the annual Bloem Show. “The decision was made to ensure the safety of more than 100 000 visitors from all over the country who are expected to flock to the event,” said Prinsloo. She added that in case of a total power failure due to unforeseen circumstances, the Bloem Show would use their own generators to generate power. “We really hope that nothing will happen that we cannot control. “We would also like to encourage visitors to and participants of the event to take notice of the load shedding schedules in the Mangaung area in order to ensure safe travelling around the city,” said the CEO.

Statues: Law must be obeyed PRIOR to the dawn of a democratic dispensation in 1994, South Africa’s heritage resources were managed and administered through the old legislation, called the National Monument Council Act (Act No. 21 of 1969). This act made provision for the establishment of the National Monument Council (NMC) that was appointed by the prime minister to ensure that monuments are retained as tokens of the past, so that they may serve as an inspiration for the future. To transform the country’s heritage landscape the new legislation, called the National Heritage Resources Act (Act No. 25 of 1999), was promulgated by the new democratic government as an integrated and interactive system for the management of the national heritage resources, to nurture and conserve our heritage resources so that they may be bequeathed to future generations. The preamble of the National Heritage Resources Act (NHRA) stipulates that “. . . our heritage celebrates our achievements and contributes to redressing past inequities. It educates, it deepens our understanding of society and encourages us to empathize with the experiences of others. It facilitates healing and material and symbolic restitution . . .” Legislative framework and protection of areas and structures older than 60 years The area or place upon which any structure, which is older

than 60 years, is located is protected in terms of Section 34 of the NHRA, and this includes statues, monuments, buildings and memorials. This section clearly stipulates that “No person may alter or demolish any structure or part of a structure that is older than 60 years without a permit issued by the relevant provincial heritage resources authority.” When statues and other structures of cultural significance are declared heritage sites in terms of Section 27 of the Act, we refer to this process as a formal protection. On the other hand, when the above-mentioned structures are not declared, but are older than 60 years, they automatically qualify for legal protection in a manner as declared structures of cultural significance. For instance, the Cecil John Rhodes statue is not listed or recorded in the national heritage register as a declared structure nor declared a heritage site, but it is legally protected by virtue of the fact that it is older than 60 years, and a permit must be obtained from the Provincial Heritage Resources Authority (PHRA) which resides within the Provincial Departments of Sport, Arts, Culture and Recreation, in conjunction with the local municipality. The PHRA is established by the MEC in terms of Section 23 of the Act as a corporate body capable of suing and being sued in its corporate name.

} Sidwell Guduka THE Central University of Technology (CUT), Free State, says it condemms the xenophobic attacks that were taking place in the country. “We are shocked by the acts of brutality and violence that are being committed by South Africans against our fellow African brothers and sisters around the country. As a university that is home to many nationalities from Africa and beyond, we unconditionally condemn these shameful and deplorable acts of violence. “We are in support of the statement issued by Higher Education South Africa (Hesa) on behalf of the higher education community, which states that such incidents ‘are inconsistent with the values expressed in, and the founding provisions of, our Constitution’,” the CUT said in a statement. Public participation becomes a platform to engage and determine facts for and against the proposed removal or retention of a particular structure under discussion. Public participation also affords members of the public the opportunity to unpack and unravel the historical background of what a particular structure means and stands for so that everyone is better positioned to make inputs and arrive at an informed decision. National Estate All declared and undeclared structures of cultural significance which are older than 60 years are regarded as National Estate and they must enjoy the protection of the law. Section 3(1) stipulates that “. . . . those heritage resources of South Africa which are of cultural significance or other special value for the present

community and for future generations must be considered part of National Estate and fall within the sphere of operations of heritage resources authorities . . .” All structures that were declared before 1994 under the old legislation as National Monuments are now regarded as Provincial Heritage Sites under the new Act pending the completion of a re-grading process by the South African Heritage Resources Agency (SAHRA) to determine whether they qualify to be national, provincial or local heritage sites in terms of the three-tier system as provided for in Section 8(1) of the legislation. Penalties and legal implications for violation of the legislation According to the law of application, there is no excuse for ignorance, hence it becomes the responsibility of heritage practitioners to educate our communities that heritage related matters must be handled within the parameters and ambit of the law. Following and adhering to our heritage legislation is tantamount to observing the progressive Constitution of the Republic of South Africa and this will assist to prevent perplexity and anarchy. It must also be borne in mind that our legislation is not in any way against the removal of statues, monuments and memori-

als, but encourages us to execute all these in a legal manner by applying for a permit from heritage resources authorities. In terms of Section 27(18), no person may destroy, damage, deface, excavate, alter, remove from its original position, subdivide or change the planning status of any heritage site without a permit issued by the heritage resources authority responsible for the protection of such a site. In terms of Section 5(1) (a) anyone who contravenes the above-mentioned section of the act is guilty of an offence and liable to a fine or imprisonment or both such fine and imprisonment as set out in Item 1 of the Schedule, which is a fine or imprisonment for a period not exceeding five years or both such fine and imprisonment. Any team struggling to reach the 30 points that supposedly ensures safety, faces a few tough final games that are destined to end in tears for some supporters. Clubs such as Free State Stars, Amazulu and Moroka Swallows are facing the danger of possible relegation. With only four matches left before the season ends, the three sides are sitting 14th, 15th and 16th on the log, respectively. Ea Lla Koto, who had a game in hand before their match against Ajax Cape Town last night, has collected 25 points X while Usuthu and The Dube Birds have amassed 23 points apiece. In all likelihood, one of the oldest Premier Soccer League sides, Swallows, are the best bet to be relegated on Saturday, 9 May. Swallows continued to flirt with relegation when they failed to beat SuperSport United on Saturday night. STRUCTURES such as the Copa Coca-Cola Football Tournament are essential to the development of the next generation of stars for our national teams. This is according to Molefi Ntseki, South African u.17 coach. This Free State-born is one of the leading African experts on football development. With the competition having kicked off last month, Ntseki will more than likely be attending some of the regional matches across the country. “We have identified the creation of development programmes as a crucial focus for the coming years, and each and every one has an important role to play in helping us unearth those players with national team potential,” said the former coach of Harmony Academy and Bloemfontein Celtic. “We need to get them into the right structures to continue their development. There is a lot of talent out there,” added the man who had qualified Amajimbos for the 2015 Fifa u.17 World Cup in Chile. The 18-team tournament will be played from 17 October to 8 November. Sharon Keith, Marketing Director of Coca-Cola South Africa, said they introduced a new campaign element to this year’s Copa tournament called “What role will you play”. “The campaign is a call to action for all South Africans to support and celebrate teenagers getting active and healthy. It connects to the heart of Copa which aims to inspire young people to be active and healthy through their shared passion for the sport of football,” explained Keith.
