VARIANCE REQUESTS ARCHITECTURAL NEWS FISHING CLUB November 2012

Variance Requests The following usage variance requests were made during an Oct. 9 HBTS board of directors meeting. • 2004 Iris Lane: Owner requested his daughter be allowed access to the recreation center. It’s a three-bedroom home, with three users on the account.The owner is in good standing.The owner’s daughter had moved back home to care for her father. Board member Brook Goldberg motioned to deny the request. Board president Pete Peterzen said that adding the daughter to the account would exceed the criteria for an owner or renter per covenants absent medical certification.The request was denied. • 7625 Larkspur: Resident requested her common-law husband be allowed access to the recreation center. Board member Pat Traynor said it’s a clear violation of covenants because the covenants state“married.”Peterzen replied that the covenants allow the board members to give waivers for hardship. It was approved 4-1 with Traynor voting no. • 6693 Indian Street: Owner requested his girlfriend be allowed access to the recreation center. Owner is in good standing. It’s a fourbedroom home.A motion was made to approve the request. Traynor stated they weren’t married. Peterzen replied that is why they are asking for a waiver.The request was approved 41 with Traynor voting no. • 7355 Broadmoor: Owner requested usage for tenants comprised of a husband and wife and three children. Request was unanimously approved. • 6623 Bryant Street: Owner requested variance on behalf of tenants comprised of a husband and wife with three children. Request was unanimously approved.

Noah Merritt celebrates his seventh birthday at the Third Annual Take a Kid Fishing event held Oct. 6 at the Navarre Beach Fishing Pier.

Hi, Billy! Noah had a really great time last Saturday at the Take a Kid Fishing event y’all put on. He caught his first fish (which he told us was about a foot longer than it actually was- and the fish tales begin...), and LOVES, LOVES, LOVES his fishing pole. I’m so glad Melissa thought of us and included us.Thank you very much for a great event and for letting him be a part of it. The picture my dad, Don, took of Noah with his“prize catch”is attached. Since this is an annual event, we’d love to be a part if you could use a couple extra pairs of volunteer hands. Thank you, again! Ashley Rupp

HBTS wakes up to community yard sale

Architectural matters discussed

Variance requests and violations were discussed during an Oct. 9 Holley by the Sea board of directors meeting.The first to be addressed was a double variance request for a fence and a boat concrete pad at 7737 Seaward Street. The owner submitted a bid he received to the HBTS architectural committee for the boat concrete pad. He was requesting the variance before having the company he selected complete the project.The issue discussed was whether the owner had designed the boat pad in such a way as to have appropriate drainage. Pete Peterzen, HBTS board president, asked if the owner had discussed the boat pad with his neighbors. The owner stated he had and that the design of the boat pad would ensure water did not run off into his neighbor’s yard. “I have a drainage easement in front and it’s angled toward my garage and leans toward the front of the property,”said the owner. In addition, he would install underground drainage. Peterzen asked him about the elevation of the property. “It’s pretty even,”said the owner.“For me to angle the pad toward my house would be beneficial for my neighbor, but to me also.” The board unanimously approved the fence and the boat pad variance requests. The next architectural issues discussed focused on enforcement. The residents of 7095 Jasper Street have had problems dating back to

2010, according to Robert Loy, chairman of the Architectural Committee. Loy said he originally requested the matter over noncompliance be sent to legal, but prior to the board meeting the owner remedied the violation. No further action was taken. The next home located on 1950 Aurora Street has had a series of complaints over yard noncompliance.The ACC sent several letters informing the owner he was out of compliance and photographs were taken showing the yard with no grass. The owner indicated to the ACC that he was grandfathered and didn’t need to have sod or sprinklers installed. The ACC reviewed the covenants and the section dealing with lawn maintenance is clear that homes should have sod and sprinklers. When the ACC finally received a response from the owner, his answer was“he is going to sue for $2.2 million, own the recreation center and fire everybody who is employed,”according to Loy. Peterzen said that legal may have to discuss grandfathering the sprinklers, but the owner must keep the property in good repair. Board member PatTraynor asked Loy if the covenants were being applied equally to all homeowners. “My problem with most ACC problems, to me, is selective enforcement,” said Traynor. Peterzen replied that“selective enforcement is being aware and not forcing; it’s not, not being aware.” The board approved 4-1 to send the matter to legal withTraynor opposing. The next violation, 2554 Elkhart Street, also dealt with an unkempt

yard. Loy told the board members that several letters of violation were sent and that the owners refused to sign for the last violation letter. The issue dates back to May. The owner is refusing to remedy the violation, mainly removing trash and refuse in the yard. “It’s more than waiting for the next trash pick up,”commented Peterzen. The board unanimously approved sending the matter to legal and suspended the owner’s usage privileges. Loy then asked the board members to approve John Resch as a new ACC member.The request was unanimously approved.

The Holley by the Sea Fishing Club is seeking a drummer, a bass player and a vocalist to complete a band. “We’re just old dudes that rock,”said Jim Strickland, HBTS fishing club treasurer. “I like southern rock, a little bit of county, classic rock, I’m open to anything.” Strickland said that he just wants to make some music and have fun. He plays guitar and has another guitar player, but what he really needs is a vocalist, drummer and bass player to round out the band. Living in HBTS or being a fishing club member is not required to join the band, said Strickland. The goals of the band will be determined by how good the band members are. “(If) we’re good enough to do something special, we would,”said Strickland.“We could play at HBTS gatherings… that type of thing.” But really, he just wants to make some music. “It’s not about me,” he explained.“It’s about what the singer can do and the rest falls into place.
