Wage increase for EBH employees Madelaine Laubscher

After a months negotiations Elgin Brown and Hamer (EBH) Namibia has successfully concluded its annual wage negotiations with the company’s bargaining unit. A signing ceremony was held on Thursday to mark this milestone. The wage negotiations have been concluded in a conciliatory manner on 21 August. Mr Patrick Chizabulyo, the Human Resources (HR) manager at EBH Namibia, along with the Interim Workers Representative Committee, led by Mr Paulus Awala, held a signing ceremony at the EBHN offices yesterday where the wage increase agreement was concluded. “We are enormously pleased to have reached such an amicable wage agreement. It is a testament to our commitment to increased levels of mutual understanding and tolerance within the organisation, with a view to enhance the ongoing reconciliation process

going forward,” Chizabulyo said. The subsequent wage agreement in which differential wage increases of between 7% and 11% were granted across the board, resulting in an overall increase of 11% to the company`s monthly wage bill. The wage increase applies to (Paterson) job grades A1-C5, up to foreman level. According to Chizabulyo, management has always aimed to be competitive in the national labour market, which is one of the reasons for their reputation as a preferred employer-of-choice in Namibia. He wanted to place an emphasis on local job creation and skills de-

velopment which they believe has helped to create a stable workforce of motivated individuals. “Our capacity has been increased to contribute to both local and national economies,” he added. Man injured in Paragliding Sharlien Tjambari accident On Friday, a man was involved in a paragliding accident along the Jakkalsputz beach area near Henties Bay.

According to emergency service personnel who attended to the scene, the accident took place about 14:00. According to the source, the paraglide was tied to a bakkie, which was either blown over by a strong gust of wind or overturned on the beach while pulling the paraglide along. The paraglider, who has been identified as Mr Jan Janse van Rensburg (40) fell and slammed into the ground

when the bakkie overturned and landed on his legs, which resulted in serious injuries. He broke his right leg in two places and was due to go into surgery on Monday. He was taken to Cottage hospital from Jakkalsputz by Eagle Christian Ambulance services. Paragliding is a recreational and competitive adventure sport of flying a paraglide, also known as parachuting.

Date and olive plantation first for Erongo Dorcas Mhungu The Erongo Regional Council, in partnership with the Namsov Fishing Enterprises Trust, has embarked on agricultural projects that will green the traditionally arid Erongo Region when the date and olive plantation projects take off. Erongo Region Governor, Cleophas Mutjavikua, officially launched the project last Friday at Okambahe. A greenhouse vegetable project will also be established at Samatab South Post, an area also known as Naman Post. The project partners, the regional council and Namsov each contributed N$500 000 and N$1 million was announced by the governor at the launch event. Because of failures of most community projects, Mutjavikua opted for the establishment of commercially run projects that will contribute towards food security,

alleviate poverty and create the much needed jobs. The projects, when fully operational will create job opportunities for 300 people. The governor urged the community members and stakeholders to work together because the success of the project will depend on combined efforts of the people and other stakeholders. Mutjavikua said because the Daures constituency is not rich in minerals, ideal agricultural projects is the only way to make the area productive. "There are no mines in the Daures constituency that offer jobs for our

people. Projects like these will make it possible for our people in the rural areas to feed themselves and at the same time create their own wealth," Mutjavikua said. The county imports more than 80 percent of the horticultural produce needed for consumption. Mutjavikua told the delegates who attended the launch that agriculture will play a critical role in the future of the country's economy. Minors kidnapped and assaulted Madelaine Laubscher

Three boys were allegedly kidnapped on Thursday by four Walvis Bay residents and had to endure six hours of physical assault in a suspect’s garage, which led to the arrest of three men and one woman, who was charged with kidnapping and assault. The newspaper contacted Nampol Deputy Commissioner Kashuupulwa about the incident. She confirmed yesterday that three boys (age 12, 14 and 14) were kidnapped and assaulted by four locals. “It is alleged that the boys went to visit their uncle in Meersig

on Thursday and that while they were on their way to his house, they saw a house with a lot of dogs. They must have stopped to look at the dogs but it is not sure what caused the four suspects, namely Mr Logan Pretorius (25), Miss Sandra Riobo (18), Mr Ashley Andre Januarie (20)

and Mr Nathan Vries (21) to come out of the house. The boys ran away and then the four suspects got into two cars and chased them. They caught them and locked them inside the garage at the house where the boys saw the dogs. The boys were beaten up, forced to drink a

mixture of peri-peri and salt to make them vomit, they were assaulted with a panga and a spade and the dogs were also prompted to bite the children,” Commisioner Kashuupulwa said. According to Kashuupulwa the boys were kept inside the garage from 17:00 until 23:00.

In search of justice

The parents of the boys laid charges the following day and the suspects were arrested and charged with kidnapping and assault. They appeared in court Monday. Kashuupulwa could however not confirm whether they were released on bail or kept in custody.

Dante Alighieri These lines above are from Dante's famous 14th century poem, Inferno, which describes his epic journey to the lowest reaches of hell. He depicted these words as posted above the gates of hell. This warning might very well hang over the entrance to our courts. "Why?" you ask. Well, I've come to the conclusion that there cannot be any meaningful or substantive equality before the law when only the very rich can afford legal services and advice (and even then the cost may often lead to their complete bankruptcy), so I must therefore wonder whether the very idea of 'equality before the law' is a fact or mere fiction. The learned men and women of the legal profession no doubt feel entitled to charge as high fees as they can get away with on account of the fact that they have specialised knowledge of the law and spent many years at university to learn the obscure technical details of the law and to read a dead language, Latin, in which the secrets of our legal code are still locked. Mercenaries in court Despite protestations from his colleagues, who reported him to the Law Society for it, I suspect that the wellknown attorney Richard Metcalfe was perfectly right when he said point-blank: "An attorney is like a mercenary. We work for money and not loyalty." According to the schedule of legal fees, an attorney can charge N$1 256 per every half hour for consultations, for appearing in court and for drafting or perusing documents, or N$2 512 per hour. Taking instructions will cost the client a further N$1 256 per half hour. But first they may have to pay a hefty deposit just to be able to speak to a lawyer. So if after consultation, your attorney calls you for 10

minutes and sends you a five-page letter, your family might have to go on an immediate diet, or risk facing a lawsuit for non-payment, unless of course your dad owns a brewery, because a mere telephone from 'your lawyer' will cost N$126 for every five minutes or less, while a letter can cost N$75 per page. You may also have to pay N$201 for every folio page that the attorney says he looked at, as well as N$419 for every half hour of travel. Barriers to justice All I am saying is these costs present a considerable barrier to justice for the ordinary person, in a country where the vast majority earn less than N$2 000 a month, where one quarter of the children are chronically malnourished. I have seen people go bankrupt trying to defend themselves and their loved ones before court. I've seen defendants submit to false allegations because they cannot afford a lawyer to bring the evidence that will prove them innocent before court. To the man in the street the legal profession seems insulated and closed off from public scrutiny, a private circle where lawyers are allowed to set their own fees, without oversight. From the standpoint of Joe Public, lawyers are seen as milking the legal system and its victims for every penny they're worth. You can hardly find a lawyer in this country, who is not very wealthy. When clients can no longer pay, not only will their case be discarded (despite the merits and prospects of success), but 'your lawyer' will also drag you before court for unpaid (in some cases unpayable)

debts, and so trap their clients into the payment debt plus interest, thus long-term debt slavery. Legal code rooted in slavery Roman-Dutch law arose out of the needs of slave-owning society no less. Many lawyers are commonly regarded, not as the defenders of the weak and the vulnerable, not as champions of justice, but as blackcloaked vultures profiting from the ignorance of the common man, ready to pick bare the bones of any fool that comes in search of help. Have you ever wondered why key legal concepts have to be communicated in a dead language that very few people can understand? Even fairly educated people, proficient in English and logic, will struggle to decipher the meaning of our laws. Roman-Dutch law is obscure, complex and convoluted; the procedures of the courts so highly technical that the common man can barely make sense of what to do when confronted with a summons. There is a reason for this: it is so that you are obliged to seek out a lawyer (and pay) for legal help, but the skyhigh legal fees present a considerable barrier to justice. These cost factors render the legal system impenetrable and inaccessible to the average citizen and thus reinforce the unassailable position of the legal eagles. It seems obvious that many people simply cannot afford to defend themselves before the courts, particularly in civil cases, because the legal costs in this country do not correspond to the reality of

ordinary people's earnings. No protection for the poor As a result, most people rarely have recourse to justice and protection under the law (even when they have suffered damages and are entitled to it) because they simply cannot afford the service of a lawyer. Whether you suffered damages and violation of your rights, at work or home, a fair hearing has effectively been priced out of range of the ordinary person. Even if a rich man brings a poor man before the civil courts and makes serious claims against him, demanding everything the defendant owns, including that he pay the costs of the lawsuit, that poor man, though he might be innocent of all the allegations against him, will find himself in a tight spot. Unless he can immediately afford a lawyer to reply to the summons within a set time (usually 3 to 10 days), he will be at a loss, as the courts will issue a judgment in favour of the plaintiff, by default. This suggests that although we have a functioning legal system, in essence we do not have a justice system. We have a legal system designed by default to benefit the wealthy few. Our legal system and its tariffs, with rare exceptions, serve to preserve power and wealth among the elites and effectively deny the common man protection. This is done simply by pricing poorer people out of the market, in the same sense that you can exclude poorer people from a residential area, or an upmarket restaurant by simply pricing the product beyond their

reach. You might call it a form of 'economic apartheid', by which the poor are filtered out and excluded though prohibitive pricing mechanisms. Defunct divorce laws In divorce cases, which often tend to be very traumatic for families, the caprice of the legal fraternity is most clearly on display, as they tend to financially drain the affected families to the point of penury, despite adverse impact on the well-being of children, parents and the wider society. The social consequences of the the legal fees are never brought into question. The only reason I can see for dragging broken families before the High Court is to preserve the revenue stream of elite attorneys, who alone are familiar with the arcane language and mystifying procedures of the High Court. Family matters should be heard by a family court, where attorneys are not needed. A question of oversight Who sets the legal tariffs? The Law Society of Namibia, a self-governing body composed of lawyers and attorneys. OK, in which other professions are people allowed to set their own salaries? "Politicians", you say, but even in parliament there is some democratic oversight. But who oversees the lawyers, or are they a law unto themselves? I'm still waiting for a response from the Law Society to the questions I put to them. Until recently, British law required that barristers and judges must declare whether they are freemasons or belong to secret associations,

Mr Ambrosius Kandjii Following the reported assault on a female journalist by a leading member of the Swapo Party, the Namibian chapter of the Media Institute of Southern Africa (MISA) came out with all guns blazing to condemn the attack. The director of MISA Namibia, Ms Natasha Tibinyane, said the assault on a senior producer for Radio at the Namibian Broadcasting Corporation (NBC) by Swapo councilor Ambrosius Kandjii took place in the NBC's radio studio, after he entered the studio while she was live on air. The incident happened just before 08:00 on 13 August, when Kandjii allegedly asked the reporter about coverage for a public meeting to be addressed by Prime Minister Hage Geingob on the controversial Third Constitutional Amendment Bill later that day. The reporter, who did not want to be named for fear of further reprisals against her family, "informed him that she had no knowledge of the meeting as she has not received any notification in that regard. He called her a liar and accused her of promoting the official opposition party Rally for Democracy and Progress (RDP). He also told her that it was a “SWAPO studio”, and not the public's. An argument ensued and she had to call security to have him removed from the studio." The reporter had to receive medical attention for an injury she sustained when he threw a chair at her. The journalist did not lay criminal charges against Kandjii, because she fears for her life: “He may not be happy to go to court and get thugs to hurt me,” she said. MISA called upon NBC Director General Albertus Aochamub to investigate how Kandjii gained access to the studio: "We also call upon you to ban Kandjii from entering the premises of the NBC in future... by allowing him back in, you would be sending the message that assaulting journalists is acceptable. You would also be telling the country that the life and safety of a journalist is less important than the opinion of a politician. We also call upon you to publicly condemn the attack." Tibinyane says the journalist now lives in fear for her life when at work, because she does not know how Kandjii gained access to the studio: “Only two access cards can open that studio, mine and my colleague's. So, I'm worried about my safety at my workplace too, because someone gave him an access card to get in, and I don't know who.” MISA said President Hifikepunye Pohamba should hold Kandjii accountable and publicly condemn his deplorable actions.

Predictably, the lawyers fought back and in 2010 the UK government scrapped the requirement that officers of the court declare freemason allegiances. That ques-tion has never even been raised in our legal debates. In conclusion My contention is this: that given the unwieldy fee structure, which acts

as a high barbed wire fence by preventing people from accessing the courts, and due to complexity of the legal code, the contemporary administration of civil law has little or no resemblance to justice. It appears to have everything to do with milking the common man and women and draining their financial resources to the point of bankruptcy. Meanwhile, a source at the Law Society told me that legal fees are set to increase again next month.

Credentials of Walvis Bay ‘lawyer’ who weds gay couples disputed Staff Reporter

Many grew excited over recent news reports that gay marriages can now be legally recognised under Namibian law, but their excitement was soon dispelled by a statement from the Law Society of Namibia. It is common knowledge that gay people are still subject to various forms of discrimination and that their unions are not recognised under Namibian law, but the bubble of excitement created by reports that a “lawyer” at Walvis Bay discovered a ‘loophole’ in the law enabling her to marry gay people was punctured this week, when the Law Society of Namibia (LSN) issued a statement to say that Heidi Rossouw has not been admitted as a legal practitioner in Namibia. Responding to reports that a legal firm at the coast is able to facilitate gay marriage, the LSN said there is no record of ‘Heidi Rossouw Legal Office’ registered with the Law Society. Director of the LSN, Ms Retha Steinmann, noted that “In recent articles... Heidi Rossouw is described as a ‘Walvis Bay lawyer - who legally weds coastal gay couples’... According to the records of membership of the Law Society Heidi Rossouw is not admitted as a legal practitioner in Namibia, nor is there a firm ‘Heidi Rossouw Legal Office’ registered with the Law Society of Namibia.” The LSN cited the Legal Practitioners Act and said the Law Society is duty-bound to monitor any transgressions and to investigate contraventions of the Legal Practitioners Act for the protection of the public and lay criminal charges against such persons, if the facts warrant such criminal charges.” She said “non-legal prac-

titioners” are to take note of the Act and warned that the LSN “will be obliged to take the appropriate action to ensure compliance”. According to Father Kapena, the renovation of the tower commenced about two months ago. If enough funds are available after restoring the tower, they hope to be able to fix the bells as well. “If enough funds are available, there is an 80% chance that the bells will chime again, as many people have asked whether they will hear these bells again. Hopefully, they will. The last time the Walvis Bay community heard the bells chime was in 1993, but hopefully it would not be the last time. “The dome also needs attention. The dome is historical and very dear to us, but when it rains, it creates an inconvenience for us as the water runs through the dome into the church. The dome's deteriorating and needs restoration,” he concluded.

New translations for Oshikwanyama and Oshindonga bibles are underway! The Bible Society of Namibia held a meeting on Monday 4 August to discuss the need for new translations of the Bible in both Oshikwanyama and Oshindonga. The meeting was held in the North of Namibia with church leaders and representatives from various churches, such as the ELCIN and Roman Catholic churches amongst others. The attendees from the various churches realised the limitations of the current literal (word-byword) translations in Oshikwanyama and Oshindonga and confirmed the need of new translations. Three independent studies were conducted over a number of years (1999, 2011 and 2013) to determine whether or not

such new translations are needed. All of the studies showed that a definite need (especially under the youth) does exist for meaning-based translations which will be easier to understand in today’s context. The three studies were conducted by Dr Gerrit van Steenbergen, a translations consultant from the United Bible Societies (1999), a Church leaders’ workshop held in Okahandja (2011) and by Linda Jordan, a linguist from Wycliffe Bible Translators (2013). The Bible Society of Na-

mibia will only start with a new Bible translation if a formal request is received from the churches involved. Depending on the churches’ decision and the availability of funding the translation project may start as soon as 2017. It is estimated to cost around N$25 million and will take roughly 14 years to complete. The Bible Society of Namibia, the Bible Society of Angola and Wycliffe Bible Translators will partner together with churches and various sponsors to make these translations a reality.

Sharlien Tjambari Have you ever heard of DJ Cuzco, who recently performed at the Mi Casa show? A young and vibrant DJ… blessed with a talent many would adore. Jairzinho “DJ CUZCO” Subeb is a professional DJ, who describes himself as a Multi-Genre Mix-master and producer, signed with I.M.A Star records. DJ Cuzco is known for breaking all barriers and milestones. He is revived and busy plotting something of a phenomena for all his followers, who have been waiting patiently for any sort of music by the talented act, a.k.a. the Charismatic DJ. He recently performed at the Mi Casa show in Swakopmund and got his 30

minutes of fame. “DJ’s get one gig and think that they are professionals. It is good to have competition, because it allows me to become a better DJ and improve my mixing skills” he noted. Jairzinho hails from Tsumeb, a small town in northern Namibia with ±15 000 inhabitants. His career kicked off at the early age of 14 years, when he practiced his music mixing skills at various school functions, modelling competitions, shows and other events.

Since then he has worked shoulder-to-shoulder with the best DJ’s in Namibia, had over 100 events, and a collective attendance of over 10 000 fans for his events and shows. Cuzco also do mixes and get airtime on the coastal radio station, West Coast FM. Being versatile and fully focused on producing his own music, music videos and releasing music online, internationally, this young artist is certainly destined to go all the way to the top. The people he grew up with were his motivation

and encouraged him in becoming what he is today, an entertainer to be reckoned with. In 2005 he had the honour to meet Zola, a renowned South African Artist, who gave him inspiration in following his DJ aspirations, namib times was told. Having released his major debut single, titled track “U DON’ KNOW (feat. GIFT)”, he is looking forward to make his mark in the music industry as a pro-ducer and artist. The single was produced by Solly and the music

video is set to be shot soon. According to him it is a dance song, which everyone can relate to and it brings out a statement on the concern for alcohol abuse, adding “having sober habits can benefit you in becoming a better person. If you want to have a good time you don’t need to involve alcohol in your life”. His message to up-coming DJ’s is to venture into the different types of music genres, focus more on their music skills and always try and read the crowd.

Registrations open for Swakopmunder Musikwoche

Registration for the 2014 Swakopmunder Musikwoche, taking place between 12 and 21 December, has opened. The last day of registration will be on 20 November 2014. Registration can be done via their website or by requesting an entry form from the organisers. Thanks to the generous support of Bank Windhoek, the organisation will also be present at the Windhoek Show in September and participants are invited to come and meet some of the musicians and complete their entry forms at the stall. Unfortunately there will be no Stomp! Group for

young beginners this year, however, younger participants may still register for the Junior Orchestra, the Recorder Ensemble, the Jazz Band, the Concert Band, the Grand Orchestra or the Choir. Coast an eye-opener for Botswana students Marshallino Beukes

Regent Hill Primary School from Botswana is visiting the coastal town of Swakopmund for an educational tour. The newspaper caught up with them at the famous Alte Laundry, having their Saturday night dinner. According to the school’s vice principal, Mr Joseph Togara, this has been an for the 12eye-opener NAMIB TIMES kids, who never before saw the ocean, or have even been out of their country. He told the namib times that the town’s residents’ hospitality, the safety of the town and also the

cuisine are some of the reasons which made them felt “right at home”. Mr Tagara further mentioned that this tour was much more than an educational one, as the learners also got new life experiences and got acquainted with other cultures and traditions.

Botswana visitors: Namibia is great!

From the attractions the group visited were the aquarium, museum, Dune 7 and they also went on a boat cruise, a first for everyone. The vice-principal commented that they will definitely return to Namibia with a different group of kids. They are returning to Botswana today.

Shedding light on blood disorders

Madelaine Laubscher ErongoMed, in collaboration with the South African Haemophilia Foundation (SAHF), launched an awareness campaign on 27 August in Windhoek while the South African cyclist, Mr Eugene Brookes, was cycling through Namibia to create awareness about Haemophilia (a bleeding disorder). Brookes arrived in Walvis Bay on Sunday. Brookes, along with Mr Curt Warrin, took on a cycle expedition throughout Namibia, re-entering South Africa (SA) at the Noordoewer border to complete his campaign in the Western Cape area. Brookes was cycling while Warrin was driving the support vehicle. He travelled for a total of 17 days, covering 1 577 kilometres. On his route, he dropped off Haemophilia treatment guidelines at several hospitals and clinics. Brookes also did daily updates to his blog, speaking with South African radio stations and updated the SAHF website. He got involved, because he felt most people only hear about Haemophilia when around sufferers, and is passionate to improve access to care, especially for those not close to treatment centres. “This is the first time I travelled to Namibia. I am not a sufferer, but since I wanted to tour through Namibia, I decided to do it for a cause. The people are very hospitable in Namibia. We would like to see that the medical practitioners here would be more attentive to blood disorders and that is the main reason for this campaign, to raise awareness. The sad part is that Haemophilia does not have the same support and attention as some of the more spoken about medical conditions like HIV, Tu-

berculosis, Diabetes. Yet it is a very treatable condition. Thus Bradley [Rayner] and I crafted an awareness campaign around our passions for Haemophilia and cycling,” Brookes said. Their goal is to raise awareness about how easy it is to treat blood related disorders with the correct knowledge and medication. Bradley Rayner, the National Chairman of the SAHF said, “I am a patient who suffers from the condition. I am also a volunteer and National Chairperson to the South African organisation. Mr Brookes travelled through Namibia based on a scheduled route. No person born with a bleeding disorder should have to live with pain, disability or the prospect of early death as excellent treatment is available. However it still occurs, because of lack of knowledge or misdiagnoses, distance to treatment centres or financial discrimination resulting in lack of treatment,” said Rayner. It was hoped that the awareness campaign reached healthcare policy makers, informing them of the need to improve diagnosis and treatment of people with these disorders. According to Rayner he would like to see trained health care professionals and access to factor concentrates at the state hospitals and treatment improved in Namibia. The campaign will include training Namibian healthcare workers by an SAHF health

care worker at hospitals in Windhoek. The World Federation of Haemophilia (WFH) research shows that government and society benefits from an investment in children’s health when, as adults, they are able to work, contribute to the community and raise a healthy family. Therefore, the WFH promotes a global effort to secure appropriate care and treatment products for everyone with a bleeding disorder, no matter their circumstances or where they live. Without treatment, haemophilia sufferers bleed with continual pain, disability, isolation, and resultant premature death. People with haemophilia use treatment products to improve blood clotting to stop or prevent a bleeding episode and have higher quality of life today than ever before. Treatment for all means all people with bleeding disorders, including inhibitor patients should have access to safe and effective treatment until there is a cure. Meanwhile, safe products, proper diagnosis, management, and care by specialists should be available. All of this is possible and SA has the expertise to assist Namibia,” said Rayner. According to a Marketing Representative of ErongoMed, Mrs Jolandie Hayward, one in 1 000 people has a bleeding disorder and 75% of them are unaware of it, receiving little or no treatment. The SAHF has been

Haemophilia, von Willebrand disease, inherited platelet disorders, and other factor deficiencies such as Anaemia are lifelong bleeding disorders that prevent blood from clotting properly. People with bleeding disorders do not have enough of a particular clotting factor. The severity of a person’s bleeding disorder usually depends on the amount of clotting fac-

tor that is missing or not functioning. People can experience uncontrolled bleeding that can result from a seemingly minor injury. Bleeding into joints and muscles causes severe pain, joint destruction and disability while bleeding into major organs, such as the brain, can cause death. Quality of life and mortality of people with haemophilia (PWH) has not improved as significantly in the developing world as in high income countries due to inadequate management of the disorder.

Swakop Open changes NTTA rankings

Desert Raceway’s debut Despite hot and windy weather conditions spectators flocked to the debut event of the Desert Raceway Dirt oval racing on Saturday. Petrol heads were spoilt for choice with quad bikes, V8s and midget vehicles racing for their respective titles. Henties starting block for Head over Heels 30-year old Emma Timmis, from Cheshire, UK, started her Head over Heels 2014 charity run through Southern Africa in Henties Bay on Sunday.

The Walvis Bay Yacht Club and the rest of the Namibian sailing community are gearing up to participate in a global sailing event called Bart’s Bash on 21 September. Named after the Olympic medallist and America’s Cup sailor Andrew ‘Bart’ Simpson, the idea of the race is to break a Guinness record by having the greatest number of boats participate in the same race around the world.

The event is open to any class of boat. Participating clubs have been given a twelve hour window in which to complete the race, accommodating different time zones and other requirements to qualify for the world record.
