Budget chief Diokno: No US manipulation of PHL peso MANILA, Sept 28 (Mabuhay) – Budget Secretary Benjamin Diokno on Wednesday contradicted the statement of President Rodrigo Duterte that the Americans are supposedly “undermining” and “manipulating” the depreciation of the Philippine peso. “Rational behavior lang ‘yan eh. Credit after bankruptcy – Yes you can! After a debtor receives a discharge in bankruptcy, creditors whose debts are discharged are required to report that the account has a zero balance. The fact of the filing itself can remain on the credit report for 10 years from the date it was filed. A debtor interested in re-establishing credit after bankruptcy should obtain credit reports from the 3 largest credit reporting agencies, (Experian, Equifax, and Trans Union) and ensure that the account balances have all been zeroed out. If not, the debtor should contact the credit reporting agencies and ask that the record be corrected Methods of Re-Establishing Credit A debtor seeking to re-establish credit should consider applying for a secured card, usually a Visa or Master Card. This is a credit card issued by a bank to a customer who is required to establish a savings account at the bank, which is used as security or collateral for the card. Typically, the limit on the card is based on the amount of collateral put up in the form of the savings account. Often, the bank will have an annual fee. The benefit of the secured card is that banks will issue them to persons with poor credit reports in the past, but who have the ability to pay the deposit to secure the account. Major store cards are also a good addition to building credit. Once you have a major credit card, even a secured card, it’s usually all that’s required to open an account at a major store, such as JCP, Kohls, etc. Other methods include buying a car from a local car dealer who advertises that it specializes in making car loans to persons with bad credit or recent bankruptcies. Also, a debtor with a personal relationship with someone at a local bank should not hesitate to seek assistance from that source. There are also financial institutions that target recent bankruptcy people seeking credit. This also includes mortgage companies. Several major companies will consider a mortgage within 1 to 2 years from the bankruptcy discharge. The reason these companies are interested in bankruptcy discharge consumers, is because they cannot file a bankruptcy again for 8 years, do not owe money, have a good debt to income ratio (Income from employment, all debts discharged in bankruptcy), and finally, they get to charge more than regular financial institutions. Bottom line – it’s a business, and a good business at that. Caution in Rebuilding Credit Ultimately, however, debtors emerging from bankruptcy should use their experience to avoid getting into the same financial traps, which snared them before. All too often, this was the easy availability of unsecured credit in the form of unsolicited, pre-approved, credit cards. Debtors should take steps to budget properly, not spend beyond their means, and resist the temptation to incur debt beyond their reasonable ability to repay just for the purpose of re-establishing credit. Debtors should avoid being enticed by so-called “credit repair� agencies. These are often simply unregulated rip-offs, who prey on the financially-distressed, and who do nothing more than what debtors themselves can do by exercising their legal right to have their reports properly list their outstanding obligations. Income Taxes in Bankruptcy As a general proposition, older

income taxes (more than 3 years old) can be wiped out in bankruptcy; newer income taxes (less than 3 years old) cannot. A debtor/employer can wipe out the employer’s portion of older, but not newer, payroll taxes. The discharge ability of state and local, such as sales and use taxes, will depend upon their true nature, i.e., whether they are excise or withholding taxes. The trust fund portion of payroll taxes is generally not dischargeable. Prior to filing bankruptcy, the debtor should have his own particular tax situation assessed. Test for Wiping Out Income Taxes The Test for wiping out income taxes in bankruptcy include: • The tax return was due more than 3 years prior to the filing • The tax return was filed at least 2 years prior to the filing • The tax has been assessed for at least 240 days prior to the filing • The tax is not based on a fraudulent return • There was no willful tax evasion by the debtor. In Chapter 13, income taxes can be wiped out if the return was due more than 3 years prior to the filing, and was assessed at least 240 days prior to the filing. In some cases, the tax may be dischargeable even if not assessed prior to the filing. Income Tax Liability Under the Internal Revenue Code, as a general rule, forgiveness of indebtedness constitutes income to the debtor. However, there is an exception where the debtor receives a discharge in bankruptcy. Can Utility Debts Be Discharged in bankruptcy? Public utilities, such as the gas and electric company, are not permitted to discontinue service because of a bankruptcy filing. However, if the utility bill is included in the bankruptcy and not paid, then the utility has the right to demand that the debtor pay a deposit within 20 days to ensure the continuation of service. Sometimes, the requested deposit is several times the amount of the bill, so it often makes sense for a cash-strapped debtor to simply pay the bill. Utility bills for service arising after the bankruptcy filing is not included in the bankruptcy, and must be paid. Does the Bankruptcy Code prohibit discrimination based on a bankruptcy filing? The Bankruptcy Code contains an “anti-discriminationâ€? provision, stating that government units and private employers may not discriminate against a person solely because that person has filed bankruptcy or was insolvent. Also, if a debtor has lost his driver’s license solely because of his inability to pay damages resulting from an accident, then a bankruptcy discharge will allow the debtor to get his license back. Trillanes, De Lima seek probe into supposed Bilibid riot By Azer N. Parrocha

MANILA, Sept. 28 (PNA) – Senator Antonio “Sonny” Trillanes IV and Senator Leila de Lima on Wednesday filed a resolution seeking a probe into the alleged riot that erupted inside the New Bilibid Prison (NBP) earlier in the day, involving high-profile inmates. The resolution directs the proper Senate Committee to conduct an inquiry on the apparent mismanagement and/or incompetence of the national Bilibid Prisons by the

Bureau of Corrections and the Philippine National Police (PNP) leading to a brawl. It also said that the probe will be done in aid of legislation and will have the end in view of enacting remedial legislation that would prevent the recurrence of similar incidents. Justice Secretary Vitaliano Aguirre II earlier confirmed the death of inmate Tony Co in the riot that started at 7:45 a.m. Meanwhile, inmates Peter Co, Jaybee Sebastian

and Vicente Sy were injured. This after a fellow inmate named Clarence Dongail reprimanded the three Chinese inmates -- the two Cos and Sy -- after he allegedly caught them in the act of sniffing ‘methamphetamine hydrochloride’ or shabu. Tony Co, a few minutes later, reportedly attacked Dongail who happened to be inside the cell of convicted drug lord Jaybee Sebastian, with an ice pick. The three were brought to the Muntinlupa Medical Center for treatment.

Speaker Alvarez: ‘Forces’ who don’t want Sebastian to testify could be behind attack MANILA, Sept 28 (Mabuhay) – House Speaker Pantaleon Alvarez on Wednesday said he thinks certain “forces” are behind the attack on Bilibid inmates, including Jaybee Sebastian, so they won’t be able to testify on the illegal drug trade inside the national penitentiary. Alvarez said the timing of the attack was suspect, especially since the House committee on justice has already summoned Sebastian to its drug-related inquiry next week. “That [attack] is sad. Apparently, there are forces na ayaw na mag-testify iyong Jaybee Sebastian and tingnan natin ang motibo kung sino ang ayaw na malaman siguro ang katotohanan,” said Alvarez. “Bakit ngayon lang sila magpapatayan, targeted pa ang intended resource person ng committee on justice,” the House leader said, adding

that there is “always that possibility” that the attack is connected to the ongoing House probe. Several of Sebastian’s fellow inmates at the New Bilibid Prison earlier pointed to him as the one responsible for mobilizing drug lords to come up with money for then-Justice Secretary Leila de Lima’s senatorial campaign. De Lima has since denied the allegation. At a press briefing at the Senate, De Lima doubted whether the incident was indeed a riot as announced by authorities, but could be another way of persuading Bilibid inmates of testifying against her. “Absent [of] any other available and reliable information, I’m not discounting the fact that [this] is another way of persuading the Bilibid 19 to testify against me,” De Lima told reporters. “This is Malacañang’s way of sending

its message to prisoners who refuses to implicate me as part of [Justice Sec. Vitaliano] Aguirre’s teleserye drama projecting me as Bilibid queen,” she added. Alvarez said he would understand if Sebastian would be unable to attend the resumption of the House probe due to his injuries, saying there are other witnesses lined up to testify. The Speaker said they would also be studying the possibility of also extending immunity to Sebastian. “[Pero] iyong immunity naman hindi magiging solusyon para maging safe ang buhay niya sa loob.” Justice Secretary Vitaliano Aguirre II earlier said the stabbing incident happened around 7:40 a.m. Apart from Sebastian, other inmates who figured in the stabbing incident were Peter Co, Tony Co and Vicente Sy.

PSG denies De Lima’s claim that Sanchez was forced to sign affidavit LA, Sept. 28 (PNA) – The Presidential Security Group refuted on Wednesday Senator Leila de Lima’s claim that her former security aide Philippine Air Force (PAF) Sgt. Jonel Sanchez was forced to sign an affidavit against the lady senator. ”This is to refute her statement about Sgt. Jonel Sanchez PAF. To date, he has not signed any affidavit to that effect,” PSG spokesperson Lt. Col. Michael Aquino said in a press statement. Aquino said Sanchez, who has been confined to barracks while he was being investigated for allegation that he was De Lima’s bagman, has signified to have a counsel “preferably of his own choice.” ”But up to now he has not presented one. Since we fully respect his right to counsel, we have given him enough leverage to produce one. Therefore, the text message sent to Sen. De Lima has no basis,” Aquino said. In a press conference at the Senate on Wednesday, De Lima claimed that she received a text message from her asset that her former security aide was being forced to sign an affidavit. Aquino assured that the PSG will abide by the rule of law in handling the case of Sanchez. The PSG reportedly said it would allow Sanchez to appear in the House of Representatives inquiry into the alleged proliferation of illegal drugs at the New Bilibid Prison (NBP) under De Lima’s watch as former Justice secretary. In previous House probe, several witnesses from the national penitentiary, have accused De Lima of receiving millions of funds from convicted drug lords to finance her senatorial election campaign.

MANILA, Sept. 30 (PNA) -The Department of Health (DOH) said on Friday that the United States Centers for Disease Control and Prevention (CDC) advisory for travelers, especially pregnant women, to postpone non-essential travels to 11 Southeast Asian countries, including the Philippines, is applicable only for pregnant women travelers who are US citizens and not for

Gold Processing & Refining, Strongbuilt Mining Dev’t. Corp., AAMPhil Natural Res. Explo & Development Corp., Adnama Mining Res. Failure to respond will result in suspension, he said. “If violations we cited carry penal provisions, these will be applied as well to firms concerned,” he said. Should the firms’ explanations be adequate and satisfactory, Jasareno said Department of Environment and Natural Resources (DENR) will allow these to continue operating. “We’ll issue the suspension order if there’s strong basis to do so,” he clarified. Jasareno further said suspended firms must address environmental degradation arising from non-compliance with laws and regulations before DENR allows these to operate again.

The CDC earlier issued an advisory warning travelers, especially pregnant women, coming to several Southeast Asian countries, including the Philippines, to postpone non-essential travels due to the Zika virus. The CDC said the Zika virus has been present in areas of Southeast Asia for many years, with several countries reporting occasional cases of the infection. The other Southeast Asian

U.S. Fed chief says appropriate to raise interest rate this year WASHINGTON, Sept. 29 (PNA/Xinhua) – U.S. Federal Reserve chairwoman Janet Yellen said on Wednesday that most of her colleagues see it appropriate to raise interest rate this year if the economy continues on current path. “Many of my colleagues indicated in their recent projections, the majority that they would see it as appropriate to make a move to take a step in that direction (removing monetary accommodation) this year if things continue on the current path and no significant new risks arise,” Yellen said before the U.S. House financial services committee on Wednesday. She said that she has been “pleasantly surprised” to see unemployment rate did not fall further along with the robust job growth. The job creation has been at a pace of about 180,000 per month this year, while the unemployment rate remained around 4.9 percent, little changed this year. With the accommodative monetary policy, “continued job creation at that pace would cause the economy to overheat and would push the unemployment rate down to lower level for now,” said Yellen. She warned of the risk of allowing the economy to overheat which could force the Fed to raise interest rates more rapidly and jeopardize the central bank’s efforts to promote maximum employment and price stability. The U.S. Fed kept the interest rate unchanged last week and said it will need more evidence that the inflation and job market continue to improve before raising rates. Yellen said on Wednesday that there was no significant upward pressure on inflation and the unemployment rate has not fallen further. ‘King’ Arthur steals thunder from Nietes, Magsayo the longest reigning Filipino world champion, will continue his reign as the WBO Intercontinental flyweight champion. The 34-year-old fighter from Bacolod City, outclassed ex-world champion Edgar Sosa. “Bandang Round 5 medyo nabasa ko na ang kalaban,” Nietes said after the bout. Nietes was in control of every round during the fight, methodically throwing punch combinations in the body and head of Sosa; and effectively throwing counter punches whenever Sosa was playing his offenses. A 1-2 combination in the last seconds of the 10th round staggered Sosa, but Nietes failed to end the match. Nietes would later tell the media that he was not in a hurry to knock out Sosa because he was still testing his power at the 112 lbs division. Credit was due Mark Magsayo (15-0) but as well as to his Mexican opponent Ramiro Robles, a last-minute replacement to the original match up, who showed toughness and courage to carry the fight to the end of its 12-round schedule. Playing De Lima ‘sex video’ is illegal, Gabriela warns House MANILA, Sept 29 (Mabuhay) – The plan of some administration allies to show a purported sex video of Senator Leila de Lima at a congressional inquiry into the alleged Bilibid drug trade would be a violation of the law, a party-list group dedicated to upholding women’s rights said Thursday. Justice Secretary Vitaliano Aguirre II argued Wednesday that the video will establish De Lima’s alleged affair with her former driver, Ronnie Dayan, who allegedly extracted drug-tainted money from convicted crime lords when the senator was still justice secretary. Leila de Lima has anything to do with the stabbing incident inside the New Bilibid Prison earlier in the day, which wounded convict Jaybee Sebastian. Sebastian, who was earlier accused by fellow inmates to be behind collecting money for De Lima’s campaign kitty, was stabbed along with Chinese drug convicts Peter and Tony Co, as well as high-profile inmate Vicente Sy. “There are forces that would want to prevent Jaybee Sebastian from testifying from Congress to look into whether Leila de Lima is involved in the affairs in Muntinlupa,� said Kabayan Rep. Harry Roque Jr. in a news conference at the House of Representatives. ‘Jubilee!’ a 25th anniversary celebration of St. Lorenzo Ruiz Catholic Church A surprise invitation was extended by this author’s cousin, Odette Ricasa for me and media colleague, Lydia Solis to grace the “Jubilee!” concert at St. Lorenzo Ruiz Catholic Church in commemoration of its 25th anniversary celebration, last Saturday, September 24th. As Lydia and I were ushered in to our seats at the fully packed church by Honchee Natividad (a good friend from this author’s West Covina days), we were both amazed to watch the video presentation of how the modern and highly aesthetically-looking architecture of the church was built and developed during the late 80’s. In its silver jubilee leaflet, the church’s Pastor, Father Tony Astudillo said: “everyday, I marvel at our sprawling gardens, our church of stone and the entire expanse of our church grounds...everywhere I look at almost anytime of the day, there is something going on in this dynamic parish of ours...and I could not help but say’, “what a beautiful thing WE have been graced with!” Indeed, we have been blessed. This place is God’s love and mercy for all of us. We have the privilege and opportunity to keep it, nurture it and strengthen it.” The 50-member St. Lorenzo Ruiz Jubilee Choir, presented an evening of angelic songs, through the dynamic and impressive musical direction of UP Conservatory of Music graduate, Paul Concepcion, whose conducting prowess reminded us of a young Pinoy version of Venezuelan-born LA Phil Conductor, Gustavo Dudamel and the voices of his choir truly mesmerized us, along with the superb accompaniment of the young musicians of the Diamond Bar High School Symphony Orchestra. The concert was divided in three parts: the first part was called “ Jubilee,” where the choir rendered songs about love, mercy, grace, forgiveness, solidarity and peace and its initial processional song, was “The Angelus.” The next songs were: “Every Move I Make; “ “Sapagka’t Ang Diyos Ay Pag-Ibig,” with soloists: Jason Laurel and Royce Bolante; “Who Am I,” sang by soloist, Brian Roberts; and the choir belted out other songs such as: “Shout to the Lord; “ “Joshua Feel the Battle of Jericho” and “Lord, I Lift Your Name on High .” The church’s Hispanic Choir, headed by Antonio Fernatt, of the church’s Hispanic Ministry, presented their upbeat song called “Santa Maria Dela Esperanza,” which reminded of my mother’s favorite Spanish songs such as “Malaguena.” To end the first part of the concert, a trio of “Jubilee” songs were rendered by soloists: Bjshop Oscar Solis, Fr. Tony Astudillo (Church Pastor) and Bryan Pulido. The second part of the concert were songs about St. Lorenzo’s martyrdom, courage, faith and hope. some of the songs were: “One Faith, One Hope, One Lord; “ “ Soon I Will Be Done” and medley songs such as” Courageous,” by soloist, Brian Roberts, a “Martyr” song,” by soloists: Alfred Quinto, Virgencita Cortes, Robert and Emma Yumul; “May Bukas Pa” and “When You Believe,” sang by soloists: Bess Valenzuela, Jordan Jimenez, Devon and Jada Roberts; “Maria,” sang by special guest, Mat Ranillo and “Sa Iyo, San Lorenzo Ruiz,’ sang by two clergies: Fr. Timoteo Jose Ofrasio, S.J. and Fr. Eduardo Hontiveros, S.J. The third and final part of the

concert, called “The Holy Family Welcome Home,” included Father Tony Astudillo’s special Jubillee message, where he emphasized that the concert was not a fundraiser, but rather a celebration of the church’s 25th anniversary, and it was an opportune time for him to acknowledge the hardworking parishioners who put this concert together, such as: Arcel Punsalang, Event Chairman, Paul Concepcion, Music Director and the two doctors who extended their financial generosity, to meet the church’s financial responsibility of becoming debt-free. Highlight of the evening was the solo song of Bishop Oscar Solis, who sang the “Magnificat/Holy Is His Name,” followed by the choir’s song of “Make His Praise Glorious,” and a final solo song by Fr. Martin Madero called “”Joseph’s Song.” Lydia and I were

Will incorporating a separate property business during marriage make it community property? You own a successful business, as a sole proprietor, prior to marriage. You later meet the love of your life and decide to marry her. Years into the marriage, you decide to incorporate the business. A common question when the couple later divorces becomes 1) did your separate property business become community property by virtue of incorporating it during the marriage? 2) Was your separate property business “transmuted” to community property by incorporating it during the marriage? No Community Property Presumption Family Code §760 defines “Community property” as “Except as otherwise provided by statute, all property, real or personal, wherever situated, acquired by a married person

during the marriage while domiciled in this state is community property. However under Marriage of Koester, the Court held that the community does not “acquire” a separate property business simply because the business is incorporated during the marriage. The mere incorporation of a business operated by spouse is not a change in its character, for purposes of division of community estate following divorce. In Koester, the Court stated that he incorporation simply effects a change

in the legal form under which the business is conducted and property does not change its character merely because of a change in form or identity. Marriage of Koester (1999) 73 CA4th 1032, 1035, 1038, 87 CR2d 76, 79, 81. The Court in Koester also stated that “In contrast with the way title is taken when a married couple own residential property, the incorporation of a sole proprietorship business is typically done for reasons extrinsic to the marital relationship. To say ... that an asset was ‘acquired’ by the community ... because some aspect of corporate formation took place during the marriage is to elevate semantics over substance” No Transmutation Incorporation of a sole proprietorship business during the marriage can trigger a family code § 2640 tracing right of reimbursement only when it is also accompanied by an unambiguous express written transmutation of the business to community property as required by Family Code § 852. Marriage of Koester, supra, 73 CA4th at 1036–1037, 87 CR2d at 79–80 & fn. 5. Under Family Code §852, a transmutation of real or personal property is not valid unless made in writing by an express declaration that is made, joined in, consented to, or accepted by the spouse whose interest in the property is adversely affected. In Koester, the act of changing the legal form under which a business is conducted does not meet the requirements of family code § 852 for a valid transmutation. Marriage of Koester (1999) 73 CA4th 1032, 1037, 87 CR2d 76, 80 & fn. 5. Incorporation of a sole proprietorship business is typically done for reasons extrinsic to the marital relationship. Although the mere act of incorpo-

rating a separate business during the marriage does not change the character of the business to community property, the community may still acquire an apportionment interest if the value of the business substantially appreciated during the marriage due to the labor and hard work of the managing spouse during the marriage. The apportionment calculation is done using the formula in the Pereira or Van Camp case where the contributions of effort and return on capital are separated from the value of the business. Clients choose chapter 13 to avoid risk of losing house to chapter 7 trustee on steriods The first case involves clients who are still young. By young, I mean less than fifty, late forties. They have teenage children, one son, and two daughters. Their household income is about $75K a year. Husband used to work two jobs as a technician, while wife used to own a retail business, now defunct. She still makes some money but hardly enough to pay for her $68K of credit card debt. She racked up this debt when she used these cards to support a failing business, just to keep the business afloat for two more years. Husband owes only $20K of credit cards. Together, clients owe about $90K of credit cards. Minimum monthly payments are almost $3k a month. Needless to say, wife’s cards are now all past due, while husband’s cards are still current, as a last ditch effort to hold the fort, the same thing that Gen. Custer did. Thinking he could protect the fort, the Indians won and Custer died. Three Indian tribes, the Lakota, Cheyenne and Arapaho decimated the 7th cavalry of Gen. Custer, which had 700 men. Custer and his two brothers died in the battle of ‘Little Big Horn� in 1876. So, I’m not so sure if it’s a good idea to take a last stand to try to pay $90K of credit card debt when clients’ household income, although decent at $75K a year, because there is no way mathematically for clients’ to pay $90K of credit card debt with minimum payments. These cards will never get paid in clients’ lifetime, unless they win the power ball lottery. Dream on. The chance of winning power ball is 1 in 292 million. You have a better chance of getting hit by lightning, twice, than winning power ball. After a little probing, I determine that clients want a Chapter 7 to wipe out all of the $90K credit cards. The problem is that their residence has about $130K of equity. It has a cur-

rent fair market value of $450K and they owe about $320K on it. It this was four years ago, they could easily sail through a Chapter 7 without the risk of losing their house to an aggressive Chapter 7 trustee. Of course, their homestead exemption is $100K plus about $25K for cost of sale of the house, so there is no viable equity for the trustee to take, so there is minimal risk to the house. But there is a five percent chance that the trustee that gets assigned to clients’ case is the most aggressive Chapter 7 trustee when it comes to non exempt assets, particularly houses. If this misfortune should befall clients, this is just the worst thing that can happen to a Chapter 7 debtor with “borderline� exempt equity in the house, having to deal with a Chapter 7 trustee on steroids who is hell bent on selling your house for $1 of non-exempt equity. And even though debtors have the right to convert to Chapter 13 anytime, to escape the clutches of a Chapter 7 trustee who wants to sell their house, the right to convert is not absolute. This trustee will certainly oppose the conversion to Chapter 13. His trustee and legal fees to fight the conversion to Chapter 13 can easily reach $25K, and all of that $25K must be paid in full the Chapter 13 as priority Chapter 7 administrative fees. So even the trustee loses on the opposition, he still wins, because he still gets paid $25K in the Chapter 13 case. It doesn’t pass the smell test for fairness, but in reality, that’s the

way it works. I have one case now and we are fighting to keep debtor’s house in Chapter 7 (no conversion to Chapter 13) because debtor owes more than $1.0M of unsecured debt. We are fighting the trustee in an adversary case because this house doesn’t even have non-exempt equity but the trustee is making it appear that debtor lied under oath and now asks for denial of discharge to debtor. I just can’t believe what is going on in this case. But we are fighting it 100%, and in this case, we are the Indians. To avoid this kind of scenario altogether, it is safer for clients to choose Chapter 13. In Chapter 13, they can pay a small amount, maybe $300 a month for sixty months. After having paid $18,000 in sixty months with no interest, the difference between $90K and $18K, $72K will be discharged with the last payment on the 60th payment. This means that clients will pay 20% of their $90K credit cards over 5 years with no interest, the court will discharge 80% of $72K on the 60th payment. In Chapter 13, there is no risk of clients’ losing their house to the trustee because Chapter 13 trustees do not have the power to sell houses. On the other hand, Chapter 7 trustees have the power to sell your house if there is viable non-exempt equity. To avoid the hassle of dealing with an over aggressive Chapter 7 trustee and risk losing their house, clients chose to file Chapter 13 and pay 20% of their credit card debt. And may I add, this is the right choice because there is no risk to the house which they want to keep, and $300 plan payment is certainly a lot less than $3K a month for minimum payments that never end, with a bright light at the end of the 60th payment when $72K is discharged by the court! In 5 years, clients will owe zero unsecured debt, and they will still have their house, which may then have

$200K of equity if Hillary Clinton becomes president. I’m with her. We are stronger together. Second client is a young senior. She is only 55. Divorced ten years ago. Now lives by herself. She used to be a happy camper with a $40K yearly salary. But she lost that job last year. She is stuck with $22K of credit card debt. She pays $900 a month for these cards to keep them current. But her savings are quickly diminishing. When it’s a choice between paying $900 of rent which lets her have a roof over her head for a month, or $900 to mastercard and visa, given the fact that she now has no income, it’s really a no brainer. The $22K of credit cards has to be discharged. She chooses Chapter 7 to achieve this goal. \ Her credit score will go up pretty fast since she still pays for a car. In two years her credit score will be about 620. Within a couple of months of getting her discharge, she will get new credit cards mailed to her. Some credit cards specialize in giving credit to people who have come out of Chapter 7. Miss Universe organizers arrive in PHL for ocular inspections By Josephine Grace Aguilo

MANILA, Sept. 28 (PNA) – Miss Universe Organization officials are currently in the Philippines to conduct ocular inspections in Manila and other destinations to be visited by the candidates, Tourism Undersecretary Katherine de Castro confirmed on Wednesday. US Citizenship & immigration Services presents ‘Outstanding American By Choice’ Awards The “Outstanding American By Choice Award� was presented by the US Citizenship & Immigration Services to Mrs. Antonia Hernandez, President & CEO of the California Community Foundation, in a ceremony at the exclusive Tom Bradley Room of the Los Angeles City Hall on Thursday, September 29, 2016. For the past ten years, this citizenship recognition initiative is celebrated annually. The award is “bestowed to naturalized citizens who have made significant contributions to their community and their adopted country, through civic participation, professional achievement and responsible citizenship.� Opening remarks during the event was the honorable Vilma Martinez, President of the Los Angeles Board of Harbor Commissioners (Port of LA) and former U.S. Ambassador to Argentina. Ms. Martinez was grateful to have been invited to introduce the honorable Alejandro Mayorkas, Deputy Secretary, U.S. Department of Homeland Security, who likewise presented the award of “Outstanding American By Choice� to Mrs. Antonia Hernandez. During his speech, Cuban-born Mr. Mayorkas, also said that he was also inspired to become a US citizen to avail of its priveleges, while at the same time “not losing his Cuban identity.� He was relentles in pursuing a higher education which enabled him the path to a government position. He has known Mrs. Antonia Hernandez’s advocacy for “social change,� and he believes that the award honoring her has long been overdue. The humble and unassuming Mrs. Antonia Hernandez was quite emotional during her speech. She said that “she

couldn’t believe that an eight year-old girl who came to the US but was born in a rural communal community in Torreon, Mexico, who grew up in the East Los Angeles neighborhood, pursued her degree in Law at UCLA and while working as a volunteer legal assistant in an immersion clinic, she found out she was not an American citizen, so she pursued to become an American citizen and proud to have its priveleges. For her, aside for the right and privelege of becoming a US citizen, comes “responsibility to enable immigrants of all race,and gender to exsercise their constitutional rights. Further on, she specialized in Civil Rights and continued her advocacy for social change, along with civil rights leader Cesar Chavez, where she said she emphasized the ideals of the Bill of Rights and the Constitution. In 2004, she joined the California Community Foundation as President and CEO. Finally, the honorable Carlos Eugenio Garcia de Alba Zepeda, Consul General of to the United States from Mexico, recognized the importance of the California Community Foundation in its effort in promoting the advantages of becoming US citizens. Further, he said that according to recent statistics, Mexicans paid a total of $90 billion dollars in taxes. He also announced that by March 28, 2017, dual citizenship will be available to all those who wish to avail of the priveleges of both being a US Citizen as well as being a Mexican national. The event ended up with the great hope that immigrants here in Los Angeles will take advantage of the US citizenship drive for “ endless possibilities,� to enable them to take advantage of their right to vote this coming election.

Huge win for patients as Gov. Brown signs landmark bill to protect patients

In a huge victory for patients subject to lesser protections in some hospital settings, and economic sticker shock when then transferred to a nursing home, California Gov. Jerry Brown signed legislation Tuesday afternoon to substantially reform the use of “observation status� by California hospitals. SB 1076, introduced by Sen. Ed Hernandez of West Covina on behalf of the California Nurses Association/National Nurses United, extends to patients placed in “observation� beds in hospitals the same safeguards, including safer nurse staffing, provided to other hospital patients. “This is a great day for California patients. We’ve seen ‘observation’ patients held on gurneys in hallways or even placed in what they think is a regular hospital bed, without the same protections available to other patients, and without even being told they are subject to a lesser standard,� said CNA co-president Malinda Markowitz, RN “Then to add economic injury to the pain of hospitalization, they can get hit with a massive extra costs, both in the hospital and when transferred to a nursing home to complete their recovery. Nepomuceno MANILA, Sept. 29 (PNA) – Extreme poverty, injustices and corruption in the government must be addressed decisively so that genuine and lasting peace may reign in the country. This was stressed by Government Republic of the Philippines (GRP) chief negotiator and Labor Secretary Silvestre “Bebot” Bello III in a statement Thursday. He added these issues are the root causes of armed conflicts and needed to be solved immediately. “The signing of the agreements is not the peace itself nor the assurance of lasting peace. In order to achieve peace in our country, we should not be signing peace agreements alone but, we should be addressing the root causes of conflict,” Bello said. He added that the Comprehensive Agreement on Socio-Economic Reforms (CASER) with the National Democratic Front (NDF) seeks to address these concerns. CASER, which is the “heart and soul of the GRPNDF peace process”—is one of the remaining substantive agenda on the talks, aside from the political and constitutional reforms and the end of hostilities and disposition of forces. As embodied in the Joint Statement signed last Aug. 26, both panels agreed to finish the CASER within a period of six months. CASER and the two remaining substantive agenda are set to be tackled during the next round of peace negotiations in Oslo, Norway on October 6 to 10. Aside from resolving the root causes of conflicts, Bello also shared the current initiatives of both panels to come up with a joint, bilateral ceasefire leading to permanently ending the hostilities on the ground. In the said statement, the GRP and NDF panels decided to reconcile their respective unilateral ceasefire declarations into a single, unified, and bilateral document within 60 days. Prior to the first round of talks last August, President Rodrigo R. Duterte issued an indefinite ceasefire declaration with the communist rebels. The NDF reciprocated the President’s pronouncement by also extending indefinitely their week-long unilateral ceasefire declaration that only covered the duration of the talks. “In 60 days, the respective unilateral indefinite ceasefire will become a joint, bilateral, and permanent ceasefire that will eventually lead to the end of hostilities and disposition of forces,” Bello explained. With these developments, Bello said that he is optimistic that negotiations with the NDF will be concluded within a nine to 12-month time frame.

She became a symbol for incorruptibility, honest government service and constitutional law. In 1988, she was the recipient of the prestigious Ramon Magsaysay Award for government service with a citation “bold and moral leadership in cleaning up a graft ridden government agency.” Fed up with corruption in government and the deteriorating peace and order situation, Santiago ran in the 1992 presidential elections but was defeated by former Defense Secretary Fidel Ramos.

Registered nurses who are “suspended� from participation in the Medi-Cal program are in for very difficult times. They are typically fired from their current jobs, and have great difficulty landing jobs in careers utilizing their skills and license. But what is involved when a registered nurse is “suspended� from the Medi-Care program? Medicare is a federal system of health insurance for people over 65 years of age and for certain younger people with disabilities. The California Medical Assistance Program (Medi-Cal or MediCal) is the name of the California Medicaid welfare program serving low-income individuals, including but not limited to: families, seniors, persons with disabilities, children in foster care, pregnant women, and childless adults with incomes below 138% of federal poverty level. Medi-Cal is financed equally by the State and the federal government. The California Department of

It’s a scary thing to a lot of people and most never imagine that it could ever happen to them. But like everything else in life, fear often comes from a lack of understanding. Most people have heard negative things about bankruptcy so they try to stay away from it the best they can- until one day they realize that it’s the only option they have left. Understanding that bankruptcy is not the end of the world and that it is simply a chance for you to start over can be helpful if you ever find yourself in such. Under what circumstances is bankruptcy advisable? Well, cases vary, but let me mention a few examples.

The individual or organization is then suspended from Medi-Cal, and the name is included in a list called Medi-Cal Suspended and Ineligible Provider List. This list is published in the Internet site http://files.medi-cal.ca.gov. The problem occurs when registered nurses, who are not enrolled as “providers� in the Medi-Care program, are “suspended� by DHCS. Their names appear in the Internet list of suspended and ineligible providers. These “suspended� nurses

have great difficulty finding and holding on to nursing jobs. Hospitals and facilities typically refuse to employ registered nurses whose name appear on the list because they run the risk of being suspended themselves, and losing their own eligibility. Being suspended by the DHCS from Medi-Cal participation creates really serious problems for the registered nurse, who is unable to get a job in her profession. Among the clients who came to my office recently is a nurse who was “suspended� by DHCS, and whose name was among those in the List of Suspended and Ineligible Providers. Based on the most common practice of the California Department of Health Care and Services, a nurse who is among those listed as excluded can request for the removal of her name after a year. If her request is denied, she will have to wait for another year to make another request.

1. When There Is No Other Way Out of Debt- Some people are so buried in debt that unless they file bankruptcy, they will simply remain in debt until hell freezes over. Once they have a judgment, they can enforce the judgment by several ways- going to your employer to garnish your wages, levy your bank account or place a lien on your

home or other real property. Unless you can work out a reasonable settlement with creditors to avoid the above, you may be forced to file bankruptcy in order to protect yourself and your assets. Filing for bankruptcy protection immediately stops all legal proceedings against you and your property. Even the IRS (a government agency that you don’t want to mess with), who has more powers than ordinary creditors, cannot continue to collect from you once you are in bankruptcy. Unpaid tax liabilities can either be discharged in bankruptcy or be paid back with no interest and additional penalties. 3. If Your Home or Other Property Is In Foreclosure- Bankruptcy immediately halts foreclosure proceedings. If a Notice of Default or a Notice of Trustee Sale has been filed by your lender, you have very limited time to protect your property so you must act quickly. Chapter 13 may be an option for you if you have regular income and you can afford to continue making mortgage payments. All back mortgage payments are combined with other debts and can be paid back under a 5-year plan. In certain cases, you may even be able to wipe out debt owed under a second mortgage (lien stripping) or significantly reduce the amount owed. If mortgage payments are too high, modifying the first mortgage and then “stripping off� the second mortgage may be your best strategy in making your home more affordable. Bankruptcy can be a tool for financial recovery. The process is not as complicated as most people think and it could be the only way for you to put your finances back in order. Federal jury convicts man who took over $1.5-M from distressed homeowners in bogus loan modification scheme

SANTA ANA, California – An Orange County man who deceived distressed homeowners with false promises that he could help them avoid foreclosure by obtaining modifications to their mortgages – or even completely eliminating their loans – was convicted today on federal fraud charges. Antonio Marquette, who went by “Alan Le” and “Anthony Le,” 56, of Midway City, was convicted this afternoon in United States District Court in Santa Ana of nine counts of mail fraud, one count of wire fraud, and one count of money laundering. Marquette was taken into custody after the verdicts were taken, and United States District Judge Andrew J. Guilford set the sentencing hearing for January 30, 2017, at which time Marquette will face a statutory maximum sentence of 220 years. According to evidence at trial, Marquette operated Bolsa Marketing Group in Garden Grove in 2010 and 2011 and charged homeowners up to $100,000 in cash for services that the homeowners did not receive. Through Bolsa Marketing, Marquette ran a scheme that targeted distressed homeowners, most of whom were members of Vietnamese communities in Southern California, the Bay Area and Houston, and induced them to pay large up-front fees to obtain mortgage relief services.
