US, EU vow to work with Duterte

MANILA, May 11 (Mabuhay) – United States Ambassador to the Philippines Philip Goldberg has congratulated Filipinos over the conduct of the recently concluded national and local elections.

In a tweet posted Tuesday, Goldberg said: “I congratulate the Filipinos on their exercise of democracy. It reminds the world that PH is such an open & healthy democratic system.”

The US envoy said he will congratulate the new leaders who will be at the country’s helm once their victories have been declared official.

“Looking forward to congratulating the next leaders of the Philippines once the official election results are in,” he tweeted.

The unofficial count of election results indicate Davao City Rodrigo Duterte is the apparent winner in the presidential race. Two of his rivals, administration standard bearer Manuel “Mar” Roxas II and Senator Grace Poe, have already conceded

defeat.

A Reuters report quoted a US official as saying Monday that Washington is ready to work with presumptive President Duterte despite allegations of human rights abuses in the city he led for over two decades.

“Washington respects the choice of the Philippine people. We gladly work with the leaders they’ve selected,” State Department spokeswoman Elizabeth Trudeau said when asked about the elections in Manila.

Cayetano concedes to Robredo MANILA, May 12 (Mabuhay) –Sen. Alan Peter Cayetano has conceded to leading vice presidential candidate Camarines Sur Rep. Leni Robredo.

In a press statement issued Thursday, Cayetano, running mate of presumptive president Davao City Mayor Rodrigo Duterte, said Robredo is not only leading the race but “already won it with majority of the votes tallied.”

“It is often said that the voice of the people is the voice of God. In this regard, I humbly concede my vice presidential bid to Rep. Leni Robredo, who, by all accounts and with 96% of the votes already tallied, is our country’s presumptive Vice President-elect. Rep. Leni is not only leading the race, she has clearly won it,” he said.

Cayetano said that while losing an election hurts, nothing is more painful than the sight of a divided country.

“Thus, I call on all the other candidates to respect the people’s will and rally behind presumptive President-elect Rodrigo “Rody” Duterte and his presumptive Vice President-elect Leni Robredo. Let us begin the journey toward healing and unification,” he said.

Duterte to visit pope, apologize for ‘whore’ insult: aide DAVAO, May 12 (Mabuhay) – Philippine president-elect Rodrigo Duterte is planning to visit the Vatican to make a personal apology to the pope for calling him a “son of a whore”, the politician’s spokesman said on Thursday.

“The mayor repeatedly said he wants to visit the Vatican, win or lose, not only to pay homage to the pope but he really needs to explain to the pope and ask for forgiveness,” Peter Lavina told reporters in the southern city of Davao.

Duterte, the longtime mayor of Davao, surged to a landslide election win on Monday following an incendiary campaign in which he gleefully used foul language to disrespect authority figures.

In a rambling speech to announce his presidential run, Duterte lashed out at Pope Francis for causing traffic jams in Manila when he visited the mainly Catholic nation last year.

Discharging student loans or taxes in bankruptcy For cases filed after October 7, 1998, Student Loans are only dischargeable if: 1. You can prove that having to repay it would impose an â&#x20AC;&#x153;undue hardshipâ&#x20AC;? on you (as defined below), OR, For cases filed PRIOR TO October 17, 2005, 2.

If the PROGRAM under which your student loan is issued, insured, administered is a FOR-profit, PRIVATE (non-government) entity, it may be dischargeable. (However, if the program itself, such as LAL, GSL, etc. receives nonprofit funding by participation of nonprofit entities, the loan is not dischargeable in bankruptcy).

To obtain a discharge based on undue hardship you must prove all of the following: 1. that you cannot maintain, based on current income and expenses, a â&#x20AC;&#x2DC;minimalâ&#x20AC;&#x2122; standard of living for yourself and your dependents if forced to repay the loans; 2. that additional circumstances exist indicating that this state of financial affairs is likely to persist for a significant portion of the repayment period of the student loans; and, 3. that you made good faith effort to repay the loans, for example, by past payments for several years, etc. Making payments is not always required if you didnâ&#x20AC;&#x2122;t ever have the money to pay the loans. Forbearances may be sufficient.

NEW: The Ninth Circuit recently ruled (in April 2003) that courts have the authority to issue partial discharges of student loans, in cases where the debtor shows the ability to repay some, but not all, of the loans. This is a huge improvement in the ability to possibly discharge some of these debts, because before the rule was if you could afford to repay any of the loans, you had to repay it all.

HEAL Loans are subject to a higher standard of scrutiny and are much harder to discharge.

Section 525 of the Bankruptcy Code prohibits discriminatory treatment by any governmental or other student loan program on the basis of filing a bankruptcy. In other words, a student loan agency cannot deny your loan application based on the filing, by you or anyone you know, of a bankruptcy.

Discharging taxes and removing tax liens Certain types of tax obligations, such as income taxes, may be discharged under specific circumstances. Many required factors must be met before any tax can be discharged under Chapter 7 or Chapter 13. In Chapter 7, the minimum requirements for discharging federal or state income taxes are: (1) it has been over 3 years since the returns were last DUE (including extensions), (2) the returns were timely filed or it has been at least 2 years since the returns were filed, (3) there was no fraud involved or attempts to evade the tax, AND, (4) the taxes were not assessed within the last 240 days.

If it has been over 3 years since your returns were last due and they have not been assessed in the last 240 days, BUT you have not yet filed the returns or there was some kind of fraud involved in filing them, then they may be dischargeable in a Chapter 13.

Again, discharging taxes is an extremely complicated area, and you should definitely consult with a knowledgeable attorney before deciding whether to file based on dischargeability of your taxes and before you take any further steps with your taxes (such as filing past due returns) Sometimes filing a late return can

work against you as far as being able to discharge those taxes in a Ch. 13, so definitely speak to an attorney before doing anything.

Tax Liens that have attached to property will survive a bankruptcy.

What does that mean? It means that the lien will stay against your property regardless of your discharge of the underlying debt. So, when you ultimately sell that property, if there is extra money available, the lien will be paid first from those proceeds unless you have the lien removed.

Discharging fraudulent debts or fraud debt judgements Debts that you incurred which were the results of an intentional or even negligent misrepresentation on your part are not dischargeable in a Chapter 7. Examples of these might be if you misstated your income on a credit card application, made false statements in order to induce someone to give you a loan, ran up your credit card debt shortly prior to filing bankruptcy, used your credit card or obtained a loan without any intent to repay it, or if someone has obtained a court judgment against you based on fraud. However, the news isnâ&#x20AC;&#x2122;t all-bad. These types of debts may be discharged in a Chapter 13.

Retirement accounts and pension plans Whether or not you can exempt amounts held in a retirement account depends on numerous factors, including which set of exemptions you choose to use (you need to discuss this with your attorney â&#x20AC;&#x201C; in California, there are two sets of exemptions). According to the United States Supreme Court, if your retirement plans is ERISA approved, meaning that it contains a trust â&#x20AC;&#x153;anti-alienationâ&#x20AC;? provision making it impossible to transfer or withdraw the funds prematurely, and it is automatically exempt.

Individual Retirement Accounts may be exempted only up to the amount reasonably necessary for the debtorâ&#x20AC;&#x2122;s support and maintenance, taking into account all other anticipated and existing sources of income and expenses.

Obviously, exempting retirement funds is very tricky and requires the expertise of an experienced bankruptcy attorney.

Getting rid of liens, abstracts of judments and trust deeds against your property The bankruptcy code enables a broad range of powers, which can enable you to avoid liens that were placed against your personal property or real property (like a house). It is too complicated an analysis to deal with here, but if you has liens against your property; make sure to discuss this with your attorney.

Types of liens you may be able to get rid of include judgment liens recorded against your home or specific personal property. Also, in a Chapter 13 junior trust deeds against your home may be able to be removed under certain specific circumstances. This is not an option in a Chapter 7, so make sure to discuss this with your attorney.

Paying taxes with your credit card Debts incurred on your credit cards to pay taxes to the IRS will usually NOT be dischargeable in chapter 7 but may be dischargeable under Ch. 13.

Joma Sison hopes to end exile under Duterte admin MANILA, May 12 (Mabuhay) – Philippine communist rebel leader Jose Maria Sison has expressed hopes of ending nearly three decades in exile under the new presidency of Rodrigo Duterte.

Sison, 77, fled to Europe soon after peace talks failed in 1987 and has stayed abroad since, while one of Asia’s longest-running insurgencies continued to claim thousands of lives.

“I will return to the Philippines if Duterte fulfils his promise to visit me,” the Netherlands-based Communist Party of the Philippines (CPP) founder said in comments posted on his Facebook page late Wednesday.

“The prospects (for peace talks) seem to be bright at the moment.”

Sison, a political science professor, established the party in December 1968 and it launched a guerrilla campaign three months later.

The rebellion has left at least 30,000 people dead, by official account.

The New People’s Army is believed to have fewer than 4,000 soldiers, down from a peak of 26,000 in the 1980s, according to the military.

However, it retains support among the deeply poor in the rural Philippines.

President Benigno Aquino III shelved peace talks in 2013, accusing the rebels of insincerity in efforts to achieve a political settlement.

The talks got bogged down after the communists demanded the release of all of their jailed comrades, which the Aquino government rejected.

Duterte, who was Sison’s student at a Manila university in the 1960s, is the longtime mayor of the south-

ern city of Davao. Some of the communists strongholds today are near Davao, and Duterte has maintained relations with them.

Last week, local television station ABS-CBN released footage of Duterte chatting with Sison via Skype on his laptop.

“I’m a socialist,” said Duterte, who leads the partial and unofficial tally of election results.

The network said the chat took place shortly after communist rebels freed five police hostages last month in Davao.

Duterte signalled after Monday’s vote that he was ready to release some jailed rebels and restart peace negotiations.

Sison said in the comments posted on Facebook he had congratulated Duterte via an intermediary on his win and called for the resumption of peace talks, a ceasefire, the release of political prisoners, and the “arrest and trial of Aquino.”

Sison’s comments were a transcript of an interview he gave to Dubai’s Khaleej Times newspaper.

Sison said he hoped to return home after Duterte was sworn into office on June 30, but the communist leader added the new government must first take steps to ensure his personal safety.

“I will not dive into any situation in which the Duterte government is still unsettled and there are unwieldy elements... who violently oppose my homecoming,” he added.

Senator Antonio Trillanes IV, a Duterte critic and former military rebel, warned last week that Duterte could face a coup if he shut down Congress.

Leni’s social media basher apologizes for ‘vicious’ comment MANILA, May 12 (Mabuhay) – The 16-year-old social media basher of Vice Presidential candidate and Camarines Sur Rep. Leni Robredo apologized for her post against the lawmaker.

In a social media post, the student basher said she wished Robredo had died in a plane crash so she can join her late husband, former Interior Secretary Jesse Robredo.

Jesse died in a plane crash in 2012 when he was on his way home in Naga City after attending a public function in Cebu City. In an interview, Leni accepted the young woman’s apology.

“Wala tayong kasalanan.

Palalampasin na lang natin ito.

Wala pa silang ginagawa, pinapatawad ko na sila,” she said.

Based to the unofficial and partial count, Leni has maintained a slim lead over Senator Ferdinand “Bongbong” Marcos in the vice presidential race.

Leni pulled ahead of Marcos after several hours into the partial unofficial comelec tally.

“Nangunguna na si Marcos. Parang nadala lang po ako kasi pagkagising ko, sa survey nanonood ako ng balita lumamang po si Leni. Yun na impression ko. Yun pumasok sa isip ko. Twineet ko agad,“ the student said.

Pia Cayetano joins Duterte transition team DAVAO CITY, May 12 (Mabuhay) – Outgoing Senator Pia Cayetano has joined the transition team of presumptive President Rodrigo Duterte to ensure a “gender-balanced” government.

Cayetano is in the city to meet with the six-man transition team.

The members of the transition team include Duterte’s executive assistant Christopher Go, Leoncio Evasco, Duterte’s national campaign manager; Peter Laviña, Duterte’s spokesperson; businessman Carlos Dominguez, the campaign finance chief; and lawyers Salvador Medialdea and Lorieto Ata, who served as legal team head and deputy, respectively.

Laviña said that it was not too late to correct what he called “unfortunate” fact that the transition team was composed of men. The team started meeting in a hotel here on Wednesday.

Cayetano said she was invited to join the group to make sure that women would have a voice in the new administration.

But she said women’s participation should not be measured in the actual number of women in the Cabinet or in key government positions.

“At the end of the day, whether it is a man or a woman occupying that top-level position, we want to be sure that that person is gender-sensitive,” she said.

She said they would have to make sure that every Cabinet cluster “will have the voice of women there.”

“We want to see the voice of women in the economic cluster, the infrastructure cluster,” she added.

The existing bureaucracy has “so many in-grown talents that are waiting to be discovered, and a lot of them happen to be women,” according to Cayetano. “We have to give them that opportunity,” she said.

The senator also cited the “living examples” of policies and programs in Davao City.

She was referring to the city’s Women Development Code, the creation of Children’s and Women’s Desk in police stations, and the appointment of lawyers to assist victims

PDP-Laban receiving feelers from those who want to jump ship: Koko Pimentel MANILA, May 12 (Mabuhay) – The PDP-Laban is now receiving feelers from those who want to join the party as Davao City Rodrigo Duterte seems on his way to winning the May 9 presidential election.

“Too many to keep track,” Sen. Aquilino Pimentel III, president of Partido Demokratiko Pilipino-Lakas ng Bayan, said when asked if there were personalities or groups already wanting to be part of their party and how many they were.

“I’ve delegated it to partymates to process,” Pimentel added.

However, he said they won’t be accepting any new members for now.

“Freeze hiring po kami ngayon until the leadership can meet,” he said.

Pimentel added that PDP-Laban prefers to enter into alliances with parties with an ideology or a vision for the country.

“We abhor personality-based decision making since that is not going to lead to any change,” he said.

“PDP-Laban is a party with an ideology. The (presumptive) President says he is a socialist hence someone with an ideology too,” he added.

Asked how many members does PDP-Laban have, Pimentel said their “inventory (is) ongoing.”

Duterte received 15,896,015 votes while his closest rival, former Interior secretary Mar Roxas, only received 9,668,069, as of 10:45 am Thursday.

GPH-MILF peace process supports fight against organized crime and terrorism: Ferrer BANGKOK, Thailand, May 12 (PNA) – Government of the Philippines (GPH) Chief Negotiator for Talks with the Moro Islamic Liberation Front (MILF) Prof. Miriam Coronel-Ferrer underscored the importance of peace negotiations as a tool in curbing organized crime and terrorism that are threats to the security and development of the country.

“There is unprecedented opportunity to quell terrorism and crime with the success of a political process with a major player, as in the case of the GPH-MILF peace negotiations. Without this flank, the job would be much more difficult and deadly,” Ferrer said in an international forum held in the Thai capital today, organized by the United Nations Interregional Crime and Justice Research Institute (UNICRI) and the Thailand Institute of Justice.

“Spatial, family, cultural, ideological affinity make borders porous but distinctions among groups should be made nonetheless,” emphasized Ferrer. “Efforts to draw in the rank-and-file toward the peace process must continue, with the peace partner also as the most effective ally to serve as buffer if not counterforce to the seamless operations of criminal and terrorist groups,” she added.

The GPH chief negotiator also pointed out that the MILF has taken decisive steps to cut off their ties with international terrorist groups like Al Qaeda and Jemaah Islamiyah, and criminal groups in the Philippines like the Al Kobar Gang and the Pentagon Gang.

Meanwhile, Moro National Liberation Front (MNLF) integrees in the Armed Forces of the Philippines have actively participated in military campaigns against groups like the Abu Sayyaf Group (ASG).

Ferrer recalled that two MNLF integrees in the AFP were among the 19 soldiers killed in Basilan last April 9, in an intense battle against the ASG. Also with her in Bangkok is Lt. Col. Abdurasad Sirajan, the Government Panel’s action officer for Western Mindanao, a former MNLF combatant who was integrated in the AFP as part of the Final Peace Agreement with the MNLF. Retired Major Carlos Sol Jr., the head of the GPH ceasefire secretariat based in Cotabato City, also accompanied Ferrer in representing the Philippine government in the experts’ meeting.

Young seniors seek to discharge $100k credit cards Client seeks chapter 20 to handle $65k student loans; Hillary could make student loans dischargeable Clients are spouses who are 60 and 59. In my book, they are young seniors. I know that if you are a young person between 20 and 50, you probably may look at a person who is 60 as â&#x20AC;&#x153;grampsâ&#x20AC;? or â&#x20AC;&#x153;grandma,â&#x20AC;? but Iâ&#x20AC;&#x2122;ve been 20 and 50 before. I thought that when you hit 60, one might feel a little differently. But actually, unless you have some kind of illness that makes you feel and look older and as long as you keep yourself in shape by exercise and healthy foods, you wonâ&#x20AC;&#x2122;t feel â&#x20AC;&#x153;oldâ&#x20AC;?, or look â&#x20AC;&#x153;oldâ&#x20AC;?. When they say 60 is the new 40, I actually understand what that means. Of course, there is a difference in energy level because a young man of 20 can keep on going day and night, sleep for a couple of hours and be still good the next day, and for the next couple of days. Now, when youâ&#x20AC;&#x2122;re 60, you just canâ&#x20AC;&#x2122;t keep on going like the energizer bunny, but you can still be very productive, except that you have to pause and rest when you have to, then you can go again. With stem cell technology improving at a faster clip nowadays, Iâ&#x20AC;&#x2122;ve heard of people who have gone to Mexico for stem cell therapy using stem cells manufactured in the United States which should have no moral or ethical issues compared to stem cells from a fetus. I actually know someone whose father went to Mexico to get fetus stem cells to treat his throat cancer. 3 months of treatment cost $250K. It worked. He showed me the before and after pictures of his father. He now looks

so much younger than his 72 years.

Believe it or not, he looks about 50.

His mother who was also stricken with throat cancer would not use fetus stem cells for ethical reasons.

She used her own adult stem cells. It did not work. She died of cancer. The collateral damage is that the other children, my friendâ&#x20AC;&#x2122;s brothers and sisters are mad at him now because their father wants to get married again to a young bimbo just after their mother died.

Apparently, the clinic in Mexico is run by a group of German doctors where my friendâ&#x20AC;&#x2122;s father went. The other clinic that uses stem cells manufactured in San Diego, I believe that clinic is run by Americans in Mexico.

I think they charge $15K per half an hour treatment and two treatments will be effective to repair damage caused by a major stroke. I understand that a well-known hockey player known here as the â&#x20AC;&#x153;father of hockeyâ&#x20AC;? suffered a major stroke at the age of 87 and could not walk. With 20 minutes of therapy where stem cells manufactured in San Diego were infused into his spinal column, and after 8 hours of lying down on the surgical table waiting for the stem cells to travel to his brain, he got up and walked to the bathroom on his own. He said he felt great and could walk again. This medical technology seems to be promising for everyone in the future. Treatment costs could get cheaper in 5 or 10 years. So if

you start fresh now by getting rid of all your credit card debt, by the time you need stem cell therapy, your credit will be perfect again, and you can use a ton of credit cards to pay for you stem cell therapy ten years from now when there is no longer any record of your Chapter 7 fresh start now. Think of repairing your kidneys damaged by diabetes. You avoid dialysis completely! Or, repairing you heart attack battered heart and make it work like new!

Getting back to our young seniors.

Husband owes $60K of credit cards, and wife owes $40K. Together, they owe $100K of credit cards. Thatâ&#x20AC;&#x2122;s a heavy burden. They pay $3K a month to keep $100K of credit cards current every month. Letâ&#x20AC;&#x2122;s not even compute how much they have paid out in minimum credit card payments so far. Just two months is $6K. Thatâ&#x20AC;&#x2122;s more than a mortgage payment on a $500K trust deed, and a lot more than clientsâ&#x20AC;&#x2122; rent. Itâ&#x20AC;&#x2122;s a statement of the obvious that these young seniors must get a fresh start in life by wiping out all of $100K of credit card debt now. Husband still has a good job that pays him $6K a month.

Spouse is a housewife. She doesnâ&#x20AC;&#x2122;t work and doesnâ&#x20AC;&#x2122;t get any pension or social security yet.

The household nets $5K a month and they have one car payment of $400. Their children are all adults and have jobs. They are now empty nesters. Obviously, the correct move for them now is a Chapter 7 to wipe out $100K of credit cards. I mean, who wants to pay $3K a month to maintain $100K of credit cards. Sure, $3K a month to pay for a mortgage, at least for $3K you can live in a house.

But you canâ&#x20AC;&#x2122;t live in a house of cards can you?

Second client is 51. He wants to do a Chapter 20. Chapter 20 is when you first do a Chapter 7, which he did last

year to wipe out $40K of credit cards; then you do a Chapter 13 to handle something that was not discharged in Chapter 7. In clientâ&#x20AC;&#x2122;s case, he had $60K of student loans. These are not dischargeable in bankruptcy. Hilary Clinton has already said that she wants to offer free college tuition to anyone in the future. The flip side of that I think would mean that she would probably make student loans dischargeable. Client wants to use Chapter 13 to pay off his $60K of student loans over 5 years. What is the advantage? The advantage is that he can pay of the entire $60K over 5 years through a Chapter 13 plan without incurring any interest.

He can pay off the principal only and after that, nothing is left.

Vote for Hilary. A vote of Hilary means free college tuition for everyone and maybe student loans will become dischargeable in bankruptcy. â&#x20AC;&#x153;OUR CITIZENSHIP IS IN HEAVEN. Caregivers must be paid overtime compensation Under California law most caregivers must be paid overtime compensation when working 24-hour shifts.

With the increase in Californiaâ&#x20AC;&#x2122;s minimum wage to $10 an hour on January 1, 2016, that means a 24hour caregiver must be paid $315 a day to comply with the current law.

Many caregivers are working under a day rate or monthly salary. A day rate or monthly salary does not compensate for the overtime hours worked and results in a substantial unpaid overtime claim for the employee.

Oftentimes, employers attempt to avoid liability by claiming the caregiver is an â&#x20AC;&#x153;independent contractor.â&#x20AC;?

In most circumstances, this argument will fail as typically employers maintain significant control over the caregiver such that that California law will find the caregiver to be an employee. This change in the overtime rules for caregivers became effective on January 1, 2014, when the Domestic Worker Bill of Rights (DWBR) became law in the State of California.

Previously, employees who qualified as â&#x20AC;&#x153;personal attendants,â&#x20AC;? including caregivers, nannies and babysitters who worked in private households, were exempt from overtime.

The DWBR eliminated the overtime exemption for personal attendants and provides that personal attendants, â&#x20AC;&#x153;shall not be employed more than nine hours in any workday or more than 45 hours in any workweek unless the employee receives one and one-half times the employeeâ&#x20AC;&#x2122;s regular

rate of pay for all hours worked over nine hours in any workday and for all hours worked more than 45 hours in the workweek.â&#x20AC;?

So now caregivers, nannies and babysitters (with limited exceptions) must be paid overtime compensation.

Under Labor Code § 1194, domestic workers are not only able to recover their unpaid overtime in a civil action, but they also may recover reasonable attorneyâ&#x20AC;&#x2122;s fees and costs.

California law also provides interest and penalties for workers who are not properly paid overtime compensation.

If you are working as a caregiver who is not paid overtime when working more than nine hours a day or 45 hours a week, you should consult with an attorney to discuss your rights under this law. With all the penalties, interest and attorneys fees allowed, claims often exceed $100,000 for 24-hour employees working just over 1 year.

The highly-attended “Cinco De Mayo” opening of CAR PROS KIA’s expanded dealership facility in the City of Carson was indeed a GRAND opening. The new dealership facility prides itself of its contemporary, sleek architecture, which is conveniently located at the crossroads of three Freeways: the 110, 405 and 91.

The celebration began on a warm, sunny early afternoon, attended by celebrities and government officials. One of the celebrities who attended was former Laker’s basketball player James Worthy, who came in and graciously autographed his giveaway photos. Radio station Power 106 FM had their deejays (Bryan Ramirez and William Ormes) played their hip-hop background sounds, while a large photo booth was a sensation to numerous guests who were photo or selfie enthusiasts.

There were free-flowing wine, beverage and a wide selection of Asian-inspired delectable food such as: Thai barbecue, Vietnamese Chicken wrap, Chinese Shumai and Egg Rolls, catered by the DoubleTree Hotel in the City of Carson.

General Manager Juan Alarcon introduced Ken Phillips, President and owner of Kia Motors, Carson, who welcomed everyone and introduced his family, followed by a remarkable speech by Justin Sohn, President & CEO of KIA Motors America, who flew in from their headquarters in Korea.

In his speech, the youthful-looking Mr. Sohn was enthusiastic in attending the grand opening of CAR PROS KIA’s new facility in Carson, as he emphasized KIA MOTORS’s “customer satisfaction” policy, making them a topnotched dealership that has survived the competitive automotive market through time.

Various government officials in attendance commended CAR PROS KIA and President Ken Phillips with “Outstanding Community & Service Award,” for their

exemplary community support.

One of the awards was from the City of Carson, presented to Mr. Phillips by Lula Davis-Holmes, Mayor Pro-Tem, signed by her, Albert Robles, City of Carson Mayor, and its three councilmembers: Elito Santarina, Janane Hilton and Cedric Hicks.

In 2009, Ken Phillips, President and owner of Car Pros Kia Auto Group, was featured on the cover of the Fall edition of “The Puget Sound Dealer,” the official publication of the Puget Sound Dealer Association. According to Mark Cutshall who wrote the article, Ken Phillips always said that “he’s a self-made businessman, though there’s nothing random or spontaneous about how he has built his dealerships.”

Richard Gomez, new Ormoc mayor Actor-politician Richard Gomez was proclaimed mayor of Ormoc City in Leyte by the board of canvassers after he defeated Liberal Party candidate Ondo Codilla.

Gomez won the mayoralty race with 53,234 votes against Codilla’s 44,453, according to data transmitted by the Commission on Elections.

This is Gomez’s first win in several tries for an elective post.

Well wishes for the new administration to achieve a ‘Better Philippines” CONGRATULATIONS to all the official winners in the recently-concluded elections, particularly to Mayor Rodrigo Duterte who will now lead our country as the new President of the Philippines.

Now that election is over, all we can do is to only hope that the new administration looks at an overview of the tremendous problems our country is facing.

On my recent visit back home,I have noticed the slow progress of major companies’ financial stability, mainly because it takes working people at least three hours to go from one place to another.

I think the first thing they should look at, is how to curb the transportation problem within the hub of the business district in the City of Metro Manila, to enable businesses and employees to become more productive during work hours. I think it is time for the PHL Transportation Authority to be transparent on how they monitor the “coding system” which was supposedly the reason why they implemented such a system in the first place.

Then, there ‘s the communication system which is currently ruled by Globe and Smart Telecommunications Companies. Back in the day, PLDT was the only phone system used. Now, balikbayans like us who go home are unaware that telephone charges vary depending on which service or type of phone is used. Communications, again is of vital importance in maximizing the country’s daily productivity.

Though there’s a daily influx of Pinoy balikbayans going home to visit the country, foreign tourists are discouraged to go and visit back home, due to the ongoing rampant atrocities being done by militant groups such as the Abu Sayyaf bandits, who recently beheaded

Will a domestic violence finding affect my claim for sole or joint custody of our children?

An action under the DVPA (Domestic Violence Protection Act) seeking a restraining order often is necessary to protect parties from abuse or domestic violence perpetrated by the other spouse or significant other. At times, it is effective in preventing harm to one of the parties. At the same time, this process is sometimes abused by family law litigants as a strategy for obtaining an advantage in a child custody case.

The basis for this is the presumption against sole or joint custody under California family code section 3044.

California Family Code Section 3044 (a) provides “Upon a finding by the court that a party seeking custody of a child has perpetrated domestic violence against the other party seeking custody of the child or against the child or the child’s siblings within the previous five years, there is a rebuttable presumption that an award of sole or joint physical or legal custody of a child to a person who has perpetrated domestic violence is detrimental to the best interest of the child, pursuant to Section 3011. This presumption may only be rebutted by a preponderance of the evidence.

In determining whether the presumption in family code 3044(a) has been overcome, the court shall consider all of the following factors:(1) Whether the perpetrator of domestic violence has demonstrated that giving sole or joint physical or legal custody of a child to the perpetrator is in the best interest of the child. In determining the best interest of the child, the preference for frequent and continuing contact with both parents, as set forth in subdivision (b) of Section 3020, or with the noncustodial parent, as set forth in paragraph (1) of subdivision (a) of Section 3040, may not be used torebut the presumption, in whole or in part.(2) Whether the

perpetrator has successfully completed a batterer’s treatment program that meets the criteria outlined in subdivision (c) of Section 1203.097 of the Penal Code.

(3) Whether the perpetrator has successfully completed a program of alcohol or drug abuse counseling if the court determines that counseling is appropriate.

(4) Whether the perpetrator has successfully completed a parenting class if the court determines the class to be appropriate. (5) Whether the perpetrator is on probation or parole, and whether he or she has complied with the terms and conditions of probation or parole.

(6) Whether the perpetrator is restrained by a protective order or restraining order, and whether he or she has complied with its terms and conditions. (7) Whether the perpetrator of domestic violence has committed any further acts of domestic violence.

A person has “perpetrated domestic violence” when he or she is found by the court to have intentionally or recklessly caused or attempted to cause bodily injury, or sexual assault, or to have placed a person in reasonable apprehension of imminent serious bodily injury to that person or to another, or to have engaged in any behavior involving, but not limited to, threatening, striking, harassing, destroying personal property or disturbing the peace of another, for which a court may issue an ex parte order pursuant to Section 6320 to pro-

tect the other party seeking custody of the child or to protect the child and the child’s siblings.The requirement of a finding by the court shall be satisfied by, among other things, and not limited to, evidence that a party seeking custody has been convicted within the previous five years, after a trial or a plea of guilty or no contest, of any crime against the other party that comes within the definition of domestic violence contained in Section 6211 and of abuse contained in Section 6203, including, but not limited to, a crime described in subdivision (e) of Section 243 of, or Section 261,262, 273.5, 422, or 646.9 of, the Penal Code.

The requirement of a finding by the court shall also be satisfied if any court, whether that court hears or has heard the child custody proceedings or not, has made a finding pursuant to subdivision (a) based on conduct occurring within the previous five years.

In Christina L v. Chauncey B, 229 Cal. App 4th 731 (2014),the Court of appeal held that because a Domestic Violence restraining order must be based on a finding that the party being restrained committed one or more acts of domestic abuse, a finding of domestic abuse sufficient to support a DVPA restraining order necessarily triggers the rebuttable statutory presumption that an award of sole or joint physical or legal custody of a child to a person who has perpetrated domestic violence is detrimental to the best interest of the child. Cal. Fam. Code §§ 3044.

The presumption that an award of sole or joint physical or legal custody of a child to a person who has perpetrated domestic violence is detrimental to the best interest of the child changes the burden of persuasion, but may be overcome by a preponderance of the evidence showing that it is in the child’s best interest to grant joint or sole cus-

tody to the offending parent. Cal. Fam. Code § 3044. In that case, the father had a history of perpetrating domestic violence against the mother.

Domestic Violence restraining orders has been issued multiple times over the years including within the last 5 years.

The trial court ignored both the existing restraining order, the legal effect of such a judicial finding, and failed to apply the family code 3044 presumption and instead awarded joint custody to father. Why you should not refinance your home mortgage Caller: I currently have an offer by my lender to refinance my home mortgage to a 4.25% fixed rate for 30 years. My currently loan was modified a few years ago and is due to amortize for 20 years paying down my principal balance. Therefore it will bring my principal and interest loan to about $2,000.00 per month on a ARM loan. The offer also had a $6500.00 closing cost and a PMI included due to my home value exceeding the 80% ltv( loan to value) threshold. My wife would like us to refinance because she is worried about the ARM ( Adjustable Rate Mortgage) going up and not being stable. What is your advice?

Ken Go: First of all, I don’t like that fact that you have to increase your loan balance by a minimum

of $6,500.00 plus taxes, interest and insurance which will be about $9,000.00 total. Your equity is already less than 10% of your value and if you add those fees, you will have less value. Our real estate value seem to be peaking already in some areas and if your intention is to continue to stay at your home, then your purpose should be to lower your balance. The new loan payment for 20 years amortized loan would be a little over $2,200.00 with no PMI ( private mortgage insurance ) on a ARM loan, but your principal reduction will be more than $1,000.00 a month. Since you are fortunate that your income is very descent about 1/3 of your mortgage payment. I am suggesting for you to continue the revised loan for 20 years and start paying down the principal balance.

I would not worry about the interest shooting up quickly, remember your ARM loan will have limits on maximum adjustments. In the future once, your equity builds up and your credit improves, you can always refinance to a better terms with minimal to no fees. Your getting hit with fees and PMI due to lack of equity in your home, so work on that for now.

Caller: We are almost retiring and carry a large sum of equity in our home, we would like to refinance our 3.5% rate to take money out to invest in another home for income.

Our soon to be retirement income will be around $5,000.00 a month and we have some credit card debts and a car payment that will be paid off in about two years. What is your suggestion on where we can buy a rental property and how much should we take out to buy it?

Ken Go: The caller is very fortunate to have a 3.5% rate that they started paying about 4 years ago on their $200,000.00 loan balance, the estimated value of the property is about $400,000.00. I love the idea of using your equity to build more equity by investing in more real estate.

However, you are a retiring couple that had never managed a home. To be fair, let’s do the math first. Now you are paying $1400.00 for your home mortgage with taxes and insurance, if you were to take $100K out you will have a new mortgage pmt of $ 2,000.00 a month. Therefore you will most likely buy a home around $420,000 which is like the medium housing price in CA. With 20% down $84K plus closing cost and minor repair you most like will be able to rent that house out for $2500.00/mo with a mortgage payment of $ 2,150.00 netting $350.00 minus minor repairs and maintenance of 8% per annum which will give you a 3.2% return on your money. Assuming no major problems with the property and no vacancy factor. But your currently mortgage payment will increase by $600.00. With the market sort of peaking and rents at its all time high, I am seeing a correction in a couple of years and you don’t want to be caught in that mess while you are retired?

I am suggesting that you take an equity line of credit out on your house as an emergency funds, enjoy your

3.5% rate @ $1,400.00 monthly mortgage and your retirement income and just vacation a few times a year. If you are buying today at the bottom of the real estate market then that would be fine but we for sure are nowhere near the bottom of the real estate market. If you have to sell the rental in a few years not knowing where the market would go, after paying commission and closing fees that for sure will eat up all the rental gains. So, my suggestion is to stay put and not refinance to cash out.

Comments: Refinancing to a better rate is not always feasible, please consider all the factors in getting a new loan and never only look at your minimal payment to a mortgage.

There is always a big picture that should be considered. Sometimes it’s a very simple answer but not all the time. Please call me for further evaluation of your current situation and I will try my best to offer my best advice.

Duterte will act like a statesman

DAVAO CITY, May 10 (Mabuhay) – Presumptive president Davao City Mayor Rodrigo Duterte is ready to be a statesman, contrary to public expectations.

His common-law wife Honeylet Avanceña said Duterte’s tough-talking image is just something he donned for the vicious campaign period.

“The character that he projected during the campaign was the character very appropriate for the campaign period kasi awayan iyan eh. Presidency, are you still going to don such character when you should act like a statesman?” she said early Tuesday morning.

Describing the campaign as a battle between lions and tigers, Avanceña said Duterte needed to put on his tough hat to survive.

“Pero ano siya, he respects the position. Presidente na siya ng Republika ng Pilipinas. Lawyer siya eh. Alam niya iyong pinasok niya. Alam niya iyong panghahawakan niyang position,” she said.

During a program aired on Pastor Apollo Quiboloy’s broadcasting arm Sonshine Media on Monday night up to early Tuesday, Duterte also said that he will behave well if he begins to serve as President of the Philippines.

Although Duterte was leading by a large margin when the interview was conducted, Avanceña remained unassuming, saying that nothing is final yet until Duterte is proclaimed president.

When that time comes, she said Duterte will even need more prayers to perform his job.

“We will continue to pray kasi umpisa pa lang ng hard work niya eh. Iyong campaign was not really the hard work. Iyong hard work niya is iyong pag-upo niya. The hard part is iyong pag-upo niya. Doon magtatrabaho siya,” she added.

Avanceña also revealed that she tried to convince Duterte not to run for president, often enumerating the setbacks if he will hold office in Malacañang.

“Ayokong i-fire up ang desire niya. I am always on the negative. Weeks before siya nag-ano, away kami nang away kasi I always tell him about the negative side. ‘You know what, if you run for president, babatikusin ka. You cannot sleep in your house, in your bed.

Doon ka sa Malacañang. Then they have to wake you up early,’” she recalled.

A confessed spiritual person, Avanceña said she submitted herself to God and prayed.

“And I even asked for signs. I don’t want to tell you about the signs. Basta he just showed me. Minsan nasha-shock na lang ako, may sign,” the former nurse based in the United States said. (MNS)

Poe: No regret turning down Roxas ‘unity’ bid MANILA, May 10 (Mabuhay) – Senator Grace Poe said she did not regret her decision not to withdraw from the presidential race in favor of administration bet, former Interior Secretary Mar Roxas, saying there was no guarantee that her votes would go to him.

Three days before the May 9 elections, Roxas called on Poe to meet with him to thwart a “looming dictatorship.” While she said she was open to meeting to the administration bet, the senator made it clear that she would not withdraw from the race.

“Walang garantiya na kahit na umatras ako ay mapupunta sa kanya ang boto,” Poe said in a press conference Monday midnight when she accepted defeat to leading presidential bet, Davao City Mayor Rodrigo Duterte.

“At isa pa, parang winala naman natin ang karapatan ng ating mga kababayan na mamili. Tapos, kung bibilangin mo rin naman ‘yung boto ngayon, malinaw na malinaw ang laki ng agwat.”

“Kahit na pinagsama mo pa kami, na hindi naman talaga malinaw na talagang mapapagsama mo ‘yung boto na ‘yon. Kaya ako wala akong pagsisisi sa desisyon na ‘yan dahil, unang-una, hindi dapat iilan lamang ang nagdedesisyon para sa ating mga kababayan,” Poe added.

Looking back, however, the senator said, she should have focused more on explaining her platforms to the people, rather than spent time answering all allegations hurled at her .

She particularly cited the disqualification cases filed against her because of citizenship and residency issues.

“Bagamat ang mga tanong ninyo ay tungkol sa aking kaso sa Korte Suprema, dapat siguro ay hindi ko na rin masyadong

sinagot ‘yon at ibinigay ko lang ang aking mga plataporma, kasi naging sentro ‘yon ng pag-uusap at hindi ‘yung mismong nais kong plano sa bayan.”

Poe admitted that the black propaganda against her had affected her candidacy as well as her family.

That was why the senator hopes that the next elections would be issued-based and focused on the credibility of candidates and the problems of the country.

“Ang mahirap lang ‘yung mga black ops, mga imbentong kuwento, ‘yon ang mahirap.

Pero kung meron namang basehan sa tunay na buhay ng isang kandidato na dapat sagutin ay siguro naman ‘yon ay isang obligasyon din ng mga kandidato,” she said.

Poe, an independent candidate, also recognized that their lack of resources and machinery had also made it difficult for their campaign.

“Pero nais kong sabihin nga sa inyo, sa tingin ko ‘yung ating kampo ay naging talagang maayos sa ating pagtakbo. Palagi na lang nating sinasabi kulang tayo sa mga bumabanat pero nanatili tayong tapat sa ating mga kababayan, na ipinaglaban lang natin talaga kung ano ang ating paniniwalang makakatulong sa ating kapwa—‘yung kakulangan sa trabaho, ‘yung mga batang nagugutom, ‘yung patuloy nating problema sa mga may sakit.”

She said she still hopes to continue her dreams for the Filipinos and the country even if she did not make it to Malacanang.

Asked if by a reporter if she would still consider running for president again in 2022, Poe said: “Sabi mo nga, mahirap nga ‘yung pinagdaanan e, so parang ngayon sa tingin ko hindi na yata.”(MNS)

‘Plan B’ too extreme, cheating through VCM impossible: poll lawyer MANILA, May 11 (Mabuhay) – The alleged Plan B of the administration being floated by the camp of Sen. Bongbong Marcos, which involves the impeachment of presumptive president Rodrigo Duterte, is too “extreme” at this point, an election lawyer said Wednesday.

Lawyer Romulo Macalintal also said cheating by programming vote counting machines (VCMs) to favor one candidate is impossible.

Macalintal said it is still too premature to talk about impeachment as Duterte, incumbent mayor of Davao City who won by landslide in the May 9 presidential race, has yet to be proclaimed.

“Yan yung masyadong extreme. Iniisip kaagad nila, hindi pa nga napo-proclaim na pangulo itong si Mr. Duterte ay impeachment agad ang pag-uusapan,” he said.

Marcos, a vice presidential candidate who is neck-and-neck with administration bet Camarines Sur Rep. Leni Robredo based on latest unofficial tally, has accused the administration of plotting to oust Duterte to install Robredo as president.

Macalintal said the accusation was nothing but a “political statement” since Marcos did not specify the grounds on which Duterte could possibly be impeached. He also warned that the statement would only sow dissent among Filipinos.

“Hintayin natin kung magkakaroon ng appropritate grounds for impeachment. Yang sinasabi na Mr. Marcos ay political statement lamang na hindi makakatulong sa stability

ng ating bansa na katatapos pa lang ng halalan,” he said.

“Yung nanalo nga humihingi na ng unity, bakit ganoon naman ang sasabihin ni Mr. Marcos? Hintayin muna natin kung ano talaga magiging resulta [ng bilangan],” Macalintal added.

Presidential and vice presidential candidates, including Duterte’s rivals Mar Roxas, Senators Grace Poe, Francis Escudero, and Gringo Honasan, have already urged Filipinos to unite behind Duterte.

“Dapat ang mga kandidato ang magbibigay ng kapayapaan sa ating mamamayan at hindi sila ang mag-create ng anumang situation na maglalagay sa alanganin nanaman sa ating halalan,” Macalintal said.

Meanwhile, Macalintal noted that programming the VCMs to favor only one candidate is impossible since the votes for president, vice president, and other national and local candidates are fed to only one SD card.

Macalintal questioned why the votes for Robredo would be wrong while the votes for Duterte were correct when the votes of the two came from only one VCM per clustered precinct. “Kung saan nanggagaling ang boto ng pangulo, doon din nangagagaling ang boto ng vice president and other candidates.

Hindi puwedeng sabihin na may daya yung kay Leni na SD card at walang daya yung kay Duterte,” Macalintal said.

“Kung may daya kay Duterte, may daya kay Leni. Kung malinis yung kay Duterte ay malinis din yung kay Leni at ganoon din sa other candidates,” he added.

Duterte win breaks Mindanao ‘curse’ MANILA, May 10 (Mabuhay) – For the first time in history, a candidate from the southern Philippines is set to break the “Mindanao curse” and take over the highest post in the land.

Davao City Mayor Rodrigo Duterte, the firebrand politician who fashioned a controversial campaign on an anti-crime message, is poised to win the 2016 presidential race after establishing a commanding six-million-vote lead over closest rival Mar Roxas a day after polls closed.

Political analyst Prospero de Vera said Duterte’s phenomenal rise to the presidency upends traditional wisdom that only candidates from Luzon or the Visayas can win the presidency. Twelve out of the country’s 15 presidents are from Luzon.

Only three are from the Visayas: Sergio Osmeña, Manuel Roxas, Carlos Garcia.

“The more important phenomenon is that, finally, someone from Mindanao has taken out the Mindanao curse. From Vice-President Emmanuel Pelaez to [former Senator] Nene Pimentel and the others, all those who tried from Mindanao couldn’t capture national office because their votes were just from Mindanao.

What makes Duterte phenomenal is that he won Metro Manila... imperial Manila. That is historic in a sense,” he said.

De Vera said the Duterte candidacy tapped into the frustration of many Filipinos who felt that the promises of President Aquino’s “Daang Matuwid” governance have fallen short.

“That comes with a price because Mindanao has been so deprived all of these years and now the expectation [that] something dramatic must happen in Mindanao now rests on the shoulders of Duterte. Now, he has to rise to that challenge...,” he said.

For his part, Prof. Edmund Tayao said Duterte does not have the same base of supporters as his predecessor, President Benigno Aquino III. Aquino also won a plurality in the 2010 presidential election.

Tayao said the Duterte campaign

tapped into a cross section of society and gathered support quite differently compared to the Aquino campaign in 2010.

“This guy literally started from scratch, so in other words, I am not about to compare the base of President Noynoy and Mayor Duterte. In fact, I would rather say that this is really spontaneous support on the part of the electorate,” he said.

The analyst said that he expected Duterte to be a good presidential candidate but thought that the mayor’s controversial remarks would turn off voters.

During the campaign, Duterte came under fire for various remarks such as cursing the Pope, his wish to have been first to rape an Australian missionary, and promising to shut down Congress if he faces impeachment. He also called out his rivals, describing Vice President Jejomar Binay as corrupt and ex-DILG chief Mar Roxas as weak and pretentious.

Tayao, however, said Duterte is now showing a different side to his personality by being the first to offer an olive branch after a vicious campaign. “After the election, you see an entirely different Duterte. I didn’t expect to see such a presidential-like, honest, humble personality in a president-elect or presumptive president like him.

The way he speaks now is significantly different from the way he spoke during the campaign,” he said.

De Vera said President Aquino has an opportunity to “go out in a blaze of glory” by accepting the Duterte presidency on behalf of the Liberal Party.

This, after President Aquino drew parallels between the rise of Nazi leader Adolf Hitler in Germany and what could happen under a Duterte presidency.

He said Aquino accepting Duterte’s victory is important to ensure a smooth transfer of power and could even define Aquino’s leadership.

“Do it on behalf of Mar because Mar is hurting...He lost. If PNoy does it for the party, things will change,” he said.

Duterte win is public’s answer to elitist gov’t The election of Mayor Rody Duterte to the presidency is a clear repudiation of the failed leadership of the Aquino administration who has done nothing, or very little, to improve the lives of millions of destitute Filipinos.

Filipinos all over the country are expecting President-elect Duterte to effect a meaningful and radical change in leadership and how to rid the government of corrupt public officials.

The People also expect Duterte not to renege on his campaign vows that he will restore law and order to curb criminality and eradicate the illegal drug syndicates that have corrupted law enforcers in the country.

I am hoping, like the rest of you, that a Duterte presidency will bring hope and a bright future for millions of Filipinos who were disappointed with the failed and weak leadership of President Benigno Aquino and also of his predecessors.

• I admire Duterte’s for being magnanimous after his victory in the polls. He immediately offered a hand of reconciliation to all his political opponents and told them to begin a national healing to foster unity among Filipinos, regardless of their political affiliations.

Despite all the black propaganda orchestrated by the Aquino administration against Duterte, from being a killer, womanizer and plunderer, with millions of pesos deposited in several banks, the feisty mayor’s supporters never wavered in their conviction to elect him as their new president.

Duterte dominated all surveys as the campaign was winding down during the homestretch that prompted the President to make a desperate plea to all presidential candidates to unite against a possible “Digong” presidency to no avail. The President later admitted that he brokered the proposed alliance of all of Duterte’s presidential rivals to thwart a “Digong” presidency who he said is a threat to democracy.

Fortunately, no one, except Roxas, heeded his desperate call for unity.

Senator Grace Poe Llamanzares, the Malacañang Palace “secret” candidate, even labeled the President’s call for unity as “too late” and suspicious.

• The large margin of Duterte over

Roxas in the early tabulation of votes made it very difficult for the Aquino administration to manipulate the results. But they may succeeded in manipulating the election results between Senator Bongbong Marcos and Congresswoman Leni Robredo for the vice presidential derby.

The President has been campaigning hard all over the country to prevent “Bongbong” to be elected as vice president. His disdain for the young Marcos was very evident.

Investigations are reportedly underway regarding a reported breach in the transparency server of the Comelec done by Smartmatic officials to ensure a Leni Robredo victory in the VP race.

An accredited observer of then poll watchdog Parish Pastortal Council for Responsible Voting (PPCRV) came out in the open and claimed that he has in possession an evidence that will show that Smartmatic officials may have rigged the results of the elections.

This is not good for Congresswoman Robredo who has been advocating for transparency and honesty as a pre-requisite for candidates to have in running for public office. Robredo, who has been lagging behind in the VP surveys up to last few days of the campaign leading to May 9, suddenly bolted to number one and erased the one million margin of Marcos votes late Monday evening.

This will be interesting to watch. In the event Marcos decides to lodge a protest, he can be assured of a fair treatment since Duterte will be sworn in as the new president in less than seven weeks.

Filipino voters had their day in another ‘Peoples’ Power’ As the election fever in the Philippines slowly simmers down and the votes are tallied “unofficially” that fuels the fire of divisiveness, one glittering reality emerged from an electorate that had the opportunity to express their wrath without fear of the consequences.

The long harangued and neglected many in a thunderous proclamation of disgust pinned their hopes to an individual leading in the polls whose confusing platform of governance will keep their fingers crossed for at least six months for some miracles really to happen.

Describing the tasks ahead for the apparent political leadership of different persuasions as awesome will be an understatement as they have to reckon with the harsh reality in a society that had been broken into so many pieces by many years of neglect and suffering.

Used to bloodless revolution, the nation once more engaged itself in bloodless exercise where they wielded a divine weapon to extract revenge to those that had made their live miserable for many years.

Casting their votes in the sole company of their consciences enabled them to enjoy that rare moment of being treated equally in selecting the people who would lead the country.

There was no right or wrong answer in the political exercise as events affect people in many dif-

ferent ways. They could be right or they could be wrong but what is important for the moment that they made a choice and the consequences of their collective decision would perhaps matter differently in a society where disappointments are common occurrences.

Decades of disappointments from many shades of political leadership had produced a nation forever hopeful of finding the right combination of political leadership that would be caring enough and deeply committed to close the yawning gap between economic classes.

Meanwhile, some interesting figures emerged from the recent political exercise in terms of voter participation, in the Philippines and abroad.

The Commission on Elections (Comelec) estimated that more than 40 million Filipinos were able to cast their votes on May 9 which is about 81 percent of total number of voters.

The figures surpassed the voter turnout in the 2010 presidential election.

On the overseas absentee voting front, turnouts went up by a high 300

percent in spite of the fact that only 28 percent exercised their right to vote. They were not as enthusiastic as their homebound counter parts.

Not even half of the registered Filipino voters working and residing abroad exercised their right to suffrage.

Of the more than 1,376,067 registered overseas Filipino voters, only 390,000 cast their respective ballots.

Only 68,157 of the 275,729 registered Filipino voters in the Americas, or 24.72 percent, participated in the month-long overseas voting.

The voting tally was higher in the Asia Pacific with 38.22 percent of the 344,848 registered voters showing up at 19 embassies, 9 consulates and three representative offices through-

out the region to choose the country’s next government officials.

Europe and America have the same percentage of voter participation. In Europe where there are 18 embassies, one mission and one consulate, a total of 39,978 Filipinos cast their ballots for this year’s polls out of 161,718 registered Filipino voters.

In the Middle East and Africa, just a slight of a quarter of the 593,703 registered voters participated in the overseas voting.

What about in the U.S. elections?

The U.S. voters’ turnout in 2012 was 53.6%, based on 129.1 million votes cast for president with an estimated voted with an estimated voting-age population of just under 241 million people.

Fil-Ams to hold centennial celebration for NVM Gonzalez Rancho Palos Verdes, CA – Friends, colleagues and former students of Nestor Vicente Madali Gonzalez, better known as NVM Gonzalez will remember him at a Centennial Celebration on Saturday, May 21, 2016. The event will be held at the Echo Park Branch Library located at 1410 W Temple Street, Los Angeles from 2-5 p.m.

NVM was born in Romblon, Philippines on September 8, 1915 and he grew up in Mindoro. He passed away on November 28, 1999 at the age of 84 in Manila. He was a novelist, short story writer, essayist and poet. He wrote five novels, eight short fiction and two essays. His books have been published in English and Filipino, as well as in Chinese, German, Russian and Indonesian. In 1997, he was declared as one of the Philippines’ National Artists for Literature.

He was on the Board of Advisers of Likhaan, the University of the Philippines (UP) Creative Writing Center, Founding Editor of The Diliman Review and first president of the Philippine Writers’ Association.

He attended creative writing classes under Wallace Stegner and Katherine Anne Porter at Stanford University.

While in the Philippines, he taught at UST, PWU and UP. He also taught in the US at UC-Santa Barbara, CSU-Hayward, the University of Washington, UCLA and UC-Berkeley. Many well-known Filipino and Filipino American writers today have been mentored by NVM. The following will share their memories of NVM: Dr Paulino Lim, Jr., Cecilia Manguerra Brainard, Dr Barbara Gaerlan, Mr. Allan G. Aquino and Cecilia Ochoa. Dr Paulino Lim, Jr. is a Professor Emeritus of English at California State, Long Beach.

He is the author of a quartet of political novels set during the Marcos dictatorship, and three short story collections. His latest Sabong, Etc. includes the Twitter story “Deus ex Vulcanus.”

On March 3, 2016, the University of Santo Tomas in Manila conferred on him a Lifetime Literary Award for his contributions to Philippine Literature. Cecilia Manguerra Brainard is

the author and editor of 19 books. She has been the recipient of a California Arts Council Fellowship in Fiction, a Brody Arts Fund Award, a Special Recognition Award for her work dealing with Asian American youths, as well as a Certificate of Recognition from the California State Senate, 21st District.

She also received the prestigious Filipinas Magazine Arts Award, and the Outstanding Individual Award from her birth city, Cebu. is grateful to him for his enthusiasm for life, culture, and for Philippine Literature.

In the fall of 1998, Allan G. Aquino was NVM Gonzalez’s very last student in the United States. As a poet and Asian American Studies scholar, Allan credits NVM with profoundly influencing his ways of seeing and writing about the world. As per NVM’s ideals, Allan continues to contemplate the “rhizomatous” nature of Filipino genius by way of pedagogy, community organizing, and the arts. USCIS to begin parole program to reunite family of WWII Fil-Am vets On May 9, 2016, the Department of Homeland Security (DHS) formally announced that it will be begin the much deserved “Filipino World War II Veterans Parole” (FWVP) policy on June 8, 2016.

The FWVP program help expedite the reunification of certain family members of Filipino WWII Veterans.

The parole program recognizes the “extraordinary contributions and sacrifices of Filipino veterans who fought for the United States during World War II.” Of the more than 260,000 Filipinos who fought for the US during WWII, there remains an estimated 2,000 to 6,000 Filipino American WWII veterans still alive in the US today. Many of these heroes, however, remain separated from their family members, who are unable to obtain visas to join them in the US due to the excessive visa backlogs. The program will allow certain family members to expeditiously obtain a temporary visa known as parole, which will “enhance the ability of such elderly veterans and their spouses to obtain care and support from their family members abroad.”

To submit an application for parole under the FWVP policy, an individual must fulfill the following requirements: 1) is a Beneficiary of an approved Form I-130 Petition for Alien Relative (or is the spouse or unmarried child under age 21 of the Beneficiary); 2) the qualifying relationship with the petitioning relative must have existed on or before May 9, 2016; 3) the petitioning relative is residing in the US (or, if deceased, was residing in the US at the time of death); 4) the priority date on the approved Form I-130 Petition for Alien Relative is not yet current; and 5) establish that the

petitioning relative is either a Filipino WWII veteran or the surviving spouse of a Filipino WWII veteran.

Those who are considered to be a Filipino WWII veteran under the FWVP policy include those who served honorably in an active duty status with either the Philippine Army; a recognized guerilla unit; or within the Philippine Scouts or within any other component of the US Armed Forces in the Far East at any time during the period beginning September 1, 1939 to December 31, 1946.

As noted, individuals may still be eligible to apply for parole under the FWVP policy even if the Petitioner on the Form I-130 Petition for Alien Relative has already passed away. However, before an individual can apply for parole, the policy requires that the Form I-130 Petition for Alien Relative first be approved for reinstatement under the humanitarian reinstatement process.

The DHS will begin accepting applications for parole from individuals who meet these criteria beginning June 8, 2016.

The application process will require submission of an Affidavit of Support for the applicant, as well as an interview at the US Embassy and possible biometrics.

If the parole is granted, it will allow the individual to enter the US to join their family member. Although not yet

entirely clear, it appears that individuals entering the US under the FWVP program may be eligible to obtain work authorization after entering the US. Individuals will need to seek extensions of their parole to remain in the US, or apply for their green cards through either the adjustment of status process or at the US Embassy overseas once they become eligible.

The DHS announcement strongly encourages all qualified applicants to seek parole within five years of June 8, 2016.

The DHS will evaluate the program after four years to determine whether to continue the program or phase it out after the five year period of time. The parole program is a significant recognition by the US government of the great contri-

butions that Filipino WWII veterans and their families have provided.

2016 overseas voting ends with weekend rush at PHL Consulate Los Angeles, May 9, 2016 – Overseas Voting for the 2016 General Elections at the Philippine Consulate General in Los Angeles with “personal voting” ending at 2:00 am on the early hours. As authorized by the COMELEC, Office of Overseas Voting, taking into consideration that there is no mail delivery on Saturdays and Sundays. Acceptance of mailed ballots from Southern California, Southern Nevada, Arizona and Texas was extended to 12:00 noon of today for batch feeding on the supplied vote counting machines (VCM).

Voting spiked during the last weekend of overseas voting as many Filipinos made their way to the Philippine Consulate in Koreatown of Los Angeles. According to Consulate officials, the number of voters personally appearing at the Consulate appear to have doubled in number during the last couple of days and that Los Angeles has the most number of Filipinos that personally came to vote.

“It matters not whether my candidate wins or not, the essence of overseas voting is to ensure that the voice of the Filipinos worldwide is heard and that we proudly show our commitment to democracy wherever we are,” according to LA resident Dr. Arnel Joaquin.”

Consul General Herrera-Lim thanked all the Consulate staff who performed their duties to ensure the success of overseas voting. The Consulate opened from 8 a.m. of May 8 and was expected to remain open until the evening of May, or over 30 hours. He said, “I am proud of all of them. For over four weeks, the Consulate staff delivered exemplary service to ensure the success of the voting exercise.

Many of them sacrificed their weekends and/or evenings so that they can do both their consular work and election duties.

In fact, many voters told me that they admired the patience and diligence of the LA overseas voting team.”

“Everyone is expecting for a better car but they are not willing to put their reservations aside and consider getting a car that may be pricey, but with exceptional benefits that far outweigh its cost.”

This was Nash Jimenez’s first statement. He is the Fleet Sales Manager of Penske Mercedes-Benz in West Covina.

“I have been selling cars half my life. I started in 1993 but it still feels like yesterday. Mercedez-Benz is a different breed altogether since it is a luxury car but that it is worth the price. Unfortunately, everybody has misconceptions about owning a luxury car. And that is where I come in,” says Nash.

As a car enthusiast, Nash considers his job at Penske Mercedez-Benz as a challenge. He says dealing with family cars has been a fruitful experience for his clients as his customer service never waned, but his transition to a luxury line (of cars) would be like proving to himself that he can still arrange great deals regardless of the type of car.

According to Nash, he wants to offer the same level of expertise and customer service in making great deals for his clients to get them – this time – a luxury car. He said, “It’s like giving back to my customers by changing their impression about luxury cars. You will be paying almost the same for a top-of-the-line car of another make, but getting the most advanced technology. I want my loyal clients to experience that. They deserve to know the truth about owning a luxury car.”

It was an eye-opener for this author as I get a crash course on luxury cars from an empathetic car expert who’s been highly recognized in car sales and dealership.

His reputation in arranging the best car deals and converting a “car window-shopper” into a car owner is his legacy. When asked, “what makes him good a salesman”, he said: “Selling is easy. It is serving your customers that makes a lasting impression.

I take it upon me to educate them and make their buying experience a memorable one.”

Mitsubishi Motors North America, Inc. (MMNA) has reported April 2016 sales of 9,674 up 17.7 percent from April of last year and is the best April sales since 2007. The Mitsubishi Outlander and Outlander Sport CUVs once again posted strong sales numbers with combined sales of 5,343 up 36 percent over April 2015.

Outlander sales of 2,729 are up 118 percent over the previous April.

Mirage continued to post solid sales numbers again in April with total sales of 3,302 up 37.2 percent over the same period last year. Mirage was the volume sales leader for the month.

“Coming off the heels of a strong first quarter for the brand, the first month of the second quarter continued the momentum with April sales that we haven’t seen since 2007,” stated Don Swearingen, Chief Operating Officer, MMNA. “Our CUVs continue to be the sales workhorse for the lineup while the subcompact Mirage demonstrates the need for affordable, reliable, and economical, transportation.”

“What makes the Mitsubishi Outlander PHEV so special is that

it offers the best of both worlds with a balance of electric efficiency and long-range practicality,” said Don Swearingen, executive vice president, MMNA. “Mitsubishi put its engineering prowess and knowledge to work to create a vehicle that meets the demand of a growing number of consumers who need a car that is capable and environmentally friendly. The Outlander PHEV will offer a high electric range and combined miles per gallon (MPG).”

The Outlander PHEV is highlighted by the full-time, twin-electric motor 4WD system that provides quick and optimized torque distribution.

The motors are mounted separately at the front and rear axles to deliver

precise, responsive 4WD performance with the S-AWC system ensuring excellent driving stability and intuitive, linear handling. The battery that supplies the electricity for the motors is a high-capacity 12kWh lithium-ion battery pack.

Three drive modes are available: EV (full electric mode), series hybrid (electric power with generator operation) and parallel hybrid (engine power and electric motor assistance).

The PHEV system automatically selects the most efficient drive mode given the road conditions and other factors. The system also features a regenerative braking mode, where electricity is captured under braking.
