What year is it?:

Jun. 12 “The bond interest rate in the late 1930s declined to a record low – despite the fact that the Treasury was going heavily into debt through New Deal deficit spending. Then came World War II with its incredible expansion of the Federal debt... Nevertheless, instead of rising, the bond interest rate fell further during this period. These unorthodox results are generally attributed to modern artificial controls of the money market by government agencies... The longer-term trend is toward inflation.... This carries a strong argument for the inclusion of a substantial proportion of common stocks in the investment portfolio.

percent. Stocks did better than inflation, though they had a volatile ride. This history parallels today’s “war on savers. Investors today should remember those who clung to the per-

ceived safety of bonds paid a heavy price and lost much of their purchasing power. Or is today more like 1974? Let’s examine the years leading up to this second comparison

point. In the late 1960s and early 70s, the U.S. government was reeling from big deficits (albeit puny by today’s levels) from the | CONTINUED ON PAGE 11

s managers of a private investment partnership, my business partner and I are often asked to share our perspectives on financial markets and the economy. During the throes of the 2008-2009 financial crisis and recession, opinion polls indicated that 6 out of 10 Americans believed we were in another Great Depression like the early 1930s. Stock prices had fallen by 50 percent and unemployment was soaring. However, our analysis indicated that the massive bank bailouts, while distasteful, would forestall a deflationary collapse. Concluding that it was time to be greedy when others were fearful, we scooped up many fantastic bargains. Our insight that 2008 was not 1932 turned out to be very lucrative for our partners. Four years later, let us reflect on other moments in history to find analogies with today’s conditions. Three periods stand out for us: 1945, 1974 and 1982. Is today like 1945? Well, there are many intriguing similarities. America had incurred massive debts fighting the Great Depression and World War II. The country’s debt to GDP ratio,

Jonathon FITE | the size of the national debt relative to the size of the economy, had gone over 120 percent (even higher than today). Massive wartime spending “stimulus was ending and many economists feared another recession as millions of veterans returned home. As Benjamin Graham, the father of value investing, indicated in the quotation above, the US government and Federal Reserve embarked on a strategy of rigging artificially low interest rates and inflating their way out of the debt burden. Our government succeeded in bringing the debt to GDP ratio down from 120 percent in 1945 to 60 percent by 1960 through a combination of inflation and economic growth. But savers who plowed into bonds with puny 2 percent yields were decimated along the way by inflation as high as 18

Chamber on way to reaching goals

e’re pleased to report that we’re well on our way to achieving most of the first-year priorities from our new strategic plan that were designated by our board in early February. In the Government Relations area, we brought back our local candidates questionnaire, plus, the board conducted an informal discussion with six of the eight announced City Council candidates during its regular April meeting. We have reposted the responses of the original local candidates’ questionnaire that are presently involved in the run-off election. Their answers are now on the chamber website. Early voting began Monday, June 11. Letters have been sent to 28 incumbent Denton area public office holders, including the Denton County Commissioners Court, Denton City Council and Denton ISD board of trustees, as well as our state legislative

Chuck CARPENTER | delegation, inviting them to attend our annual Elected Officials Reception on Tuesday evening, June 26. This particular event is a wellattended, long-standing collaboration between our sister organizations, the Denton Black and Hispanic chambers of commerce. Last year we had legal quorums in attendance from the county commissioners court, city council and school board. These included the individual attendance of our county judge, both county party chairs and state Representative Myra Crownover.

Our strategic plan embraces the direct correlation and importance of reasonable government regulation in its impact to successfully run a business. Our Government Relations Division officer Mark Burroughs is currently guiding the concept of a standing communication link with the city of Denton. The basic concept is to make suggestions and trouble-shoot certain development code issues. Our hope is to roll out an initial phase of the “suggestion box idea by the September membership luncheon. We want to thank Mark for shepherding this particular project, as well as all of the Government Relations initiatives contained in the firstyear priorities of the chamber’s strategic plan. CHUCK CARPENTER is president of the Denton Chamber of Commerce. He can be reached at 940-382-9693 or via email at dcoc@dentonchamber.org.

ADVERTISER FOCUS: KOONSFULLER

Grandparents’ Rights: What happens when the water gets muddy? Historically, grandparents have played a vital role in the development, nurturing, and care-giving of their grandchildren. It is hoped they always will. Questions tend to arise, however, when the grandchild’s parents split-up, divorce, pass away, become incarcerated, or are found to be otherwise unfit. When those questions arise and the water gets muddy, what are a grandparent’s rights? Oftentimes, grandparents are found in primary care-giving roles for their grandchild on a full-time basis when the grandchild’s parents are unable to provide for the child, or in cases of emergency or tragedy. Again, it is often a grandparent who acts as the child’s parent. On the other hand, there are times when grandparents find themselves excluded from having possession or access to their grandchild by one or both of the parents. “It can be a battle for grandparents who want to maintain relationships with their grandchildren, when something happens to the parents or when grandparents become estranged from the parents,” says Charla Bradshaw, Managing Partner of the Denton office of KoonsFuller, P.C., a law firm exclusively limited to the practice of family law. She notes that in 2000, the U.S. Supreme Court issued a decision in Troxel v. Granville that severely limited grandparents’ rights. The U.S. Supreme Court in Troxel held, “The Fourteenth Amendment protects the fundamental right of parents to make decisions concerning the care, custody, and control of their children.” Ms. Bradshaw contends “Grandparents must overcome the presumption that parents are acting in their child’s best interests as they make decisions related to their care, custody and control [as it relates to the grandparents].” She points out “The presumption is a rebuttable presumption, and grandparents that can make their case may very well prevail in their pursuit for conservatorship or possession and access.”

There are two types of suits grandparents can attempt to pursue, those being: (1) a suit for conservatorship (custody) or (2) a suit for possession and access of a child. First and foremost, grandparents must establish that they have “standing” (the right) to bring the suit for conservatorship or possession and access of a child. The threshold associated with each respective suit differs and must be met in order to proceed for conservatorship or possession and access by a grandparent.

Charla Bradshaw is managing partner of the Denton office of KoonsFuller, the largest Southwest-based family law firm. To contact her, call (940) 442-6677.

If grandparents have standing, the courts must then consider the “best interests” of the child when making decisions regarding grandparent rights. Courts throughout the state of Texas have looked at a multitude of factors in conjunction with the “best interests” standard and the Troxel decision, which should be considered in a grandparent suit for conservatorship or possession and access, including some of the following – • Whether or not the denial of possession or access would significantly impair the child’s physical health or emotional well-being. • The parent’s care, custody and control of the child. • The safety and welfare of the child. • The capability of the parents and/or grandparents to meet the child’s needs. • The strength of the relationship and bond between the grandparent(s) and grandchild. • The length of time that the child has been with the grandparent(s). • Evidence of abuse or neglect by the parent(s) or grandparent(s). • Evidence of substance abuse by the parent(s) or grandparent(s). • The ability of the parent(s) or grandparent(s) to provide love, affection, and contact with the child. • The physical distance between the child and the parent(s) or grandparent(s).

Bradshaw believes that if grandparents have a better understanding of grandparent rights, they can help ensure that their relationship with their grandchildren does not end when something happens to the parents or within the family unit. “Every case involves a unique set of facts,” she says. “Grandparents who suddenly find themselves cut off from their grandchildren should consult a lawyer with experience in this field to discuss the appropriate course of action.”

The waters do not have to stay muddy. KoonsFuller attorneys deal with a wide array of resources that help you filter the waters and address questions and issues related to conservatorship, possession and access, and agreements benefitting grandparents and grandchildren. To learn more about the rights of grandparents in custody and visitation disputes and other family law matters, contact Charla Bradshaw at 940-442-6677.

Vietnam War and social spending programs, and facing tough foreign trade competition. Then in 1971, President Nixon broke the tie between the U.S. dollar and gold. By finally abandoning the vestiges of the gold standard, the government could expand the supply of money virtually at will. A decade of economic stagnation and terrible inflation followed. The U.S. dollar fell 80 percent against other major currencies. The price of gold rose more than twenty-fold. The currency and oil shocks during this period triggered a stock market crash in 1974. After stocks had been cut nearly in half, Warren Buffett remarked that he felt like an “oversexed guy in a harem” and quipped “now is the time to invest and get rich.” His remarks turned out to be spot on, as the market rallied spectacularly soon afterwards. Yet many did not heed Mr. Buffett’s advice. This was a terrible period for bonds and many stocks, but investors who bought stocks of companies with “hard assets” such as oil, commodities and real estate or world-dominating franchises with pricing power did very well. Or is today more like 1982? In terms of investor sentiment, there are stunning similarities. After more than a decade of dismal performance, stocks were the last thing on most investors’ minds by the early ’80s, much like the situation today. Business Week actually published a cover article that proclaimed “The Death of Equities” and lamented that stocks would probably never come back, as millions of investors had thrown in the towel on stocks permanently. Today, the mainstream media similarly bemoans the demise of stocks. A front page USA Today article from May 8 headlined “Invest In Stocks? FORGET ABOUT IT.” This feature spotlighted the extreme | CONTINUED ON PAGE 15

Clipping costs H

olly Melton’s husband has been laid off three times in the last three years and what’s kept them afloat is using coupons to buy groceries. “It’s been rough,” Melton said. “But we’re hanging in there.” She uses CouponMom.com, which helps her organize her coupons. And then she keeps a small accordion folder of the coupons she’s clipped from the newspaper. The website makes it easy to go to one place and find out what each of the chain stores is offering in savings, she said. Melton can organize the list however she wants. But she organizes it by the amount of savings. “I’m not going to look at anything that’s less than 50 percent [savings],” she said. By using the online tool, she only has to clip the coupons she will use because it tells which insert from which day has that particular coupon. “I couldn’t have done this 10 years ago,” she said, adding that most of the work is already done for her. The websites and blogs that track the coupons and the deals are what help more people coupon now than ever. THIS IS NOT “EXTREME COUPONING” Melton started couponing before TLC’s Extreme Couponing made using coupons a craze. Many coupon users who are trying to be ethical about it agree the show hurt how people see them. Jasmine Idley, blogger with Help My Budget, said TLC’s show doesn’t show ethical couponing and it caused stores to tighten their coupon policies. “It seems that being savvy with your money is the cool

thing, which is great,” she said. “That’s the good that came out of it.” Angie Dean, a local coupon user, said that on the show people were using the wrong coupon for the wrong item. “It kind of hurt us all,” Dean said.

Dean started using coupons a few years ago when she became a stay-at-home mom. Her husband heard about a woman at work using them, and he encouraged her to try it. She refused at first, tried it for a month and then she was hooked, she said.

“There’re coupons for everything, basically,” Dean said. Laura Thornquist, blogger with My DFW Mommy, agrees there are normal ways to use coupons and there are extreme ways. The key is to be savvy when purchasing items, she said.

“It doesn’t take a lot of work,” Thornquist said. “It’s about being a savvier shopper. Quit buying on impulse.” Blogs like My DFW Mommy and others do the work for people, Thornquist said. She started her blog three years ago.

Cover Story But she started clipping coupons when she moved to Dallas. She lost her job and took a huge price cut on selling her house, she said. She started couponing because she knew she could save what she used to make. Her family was “able to pay off all the debt through the savings and just being smart,” Thornquist said. On average she pays 60 percent at the grocery store. “Couponing isn’t just groceries anymore — that’s for sure,” she said. Idley used to think couponing was a waste of time. She would use them for restaurants but not the grocery store. Then she had to buy coffee for her boyfriend. She went online to find a coupon and got $2 off. She started doing research on how to use coupons and has been using them ever since. “Now I like to turn around and teach other people to do it,” Idley said. Like Melton, Idley usually saves 50 percent, she said. And that includes fresh produce. Using coupons doesn’t mean people are eating junk food, she said. Idley saves the most on health and beauty products. “I’m able to pick up namebrand products in the health and beauty department and get them for nothing,” she said. Items include nail polish, razors and toothpaste. Those are the items, she said, people often forget are eating into their grocery budget every month. IT’S PERSONAL Thornquist said even people with pricier tastes can save. For instance, there recently was a sale on flip-flops at Nordstrom’s. The shoes were originally $67 but Thornquist found a coupon for $13. If people prefer to shop at Dollar General, they can save over 70 percent, she said. “It’s so personal — the couponing and the savings,” she said, depending on why a person is doing it.

Thornquist sees herself as a personal example because she likes to shop, she said. “I like Nordstrom, but I don’t like Nordstrom prices,” she said. She was using coupons out of need for a couple of years but now she just likes to save. And she always looks for ways to save. “There are so many ways to save,” she said. But she said it’s OK to splurge sometimes. “All of us like to splurge,” she said. On her blog, she and the other bloggers offer 50 good deals of the day to appeal to the different shoppers. “You have to be selective and apply it to your life,” she said. There also are “freebie queens,” but she said that’s a topic for another article. “You can get so much for free,” Thornquist said. “It’s almost ridiculous.” At first, many people get sucked in and buy more than they might actually need. That’s why Thornquist suggest clipping coupons in moderation. “It’s almost playing a game with yourself,” she said. She suggests asking, “Do I really need this? Or do I just want that?” And what are you going to do with it when you buy it. Idley’s advice is: “You do what works for you.” Melton said to have fun with it. “Expect a learning curve,” she said. SOCIAL MEDIA Couponing has become popular on social media. If a person “likes” a restaurant or store on Facebook, he or she can save money. Melton was getting free movie tickets from Studio Movie Grill for a while because she liked the business on Facebook. She also uses Twitter a lot for deals. She finds coupons on the websites of her favorite brands, such as Kraft. Melton has a blog she uses to educate her family and friends who are curious about how to

Denton Business Chronicle

use coupons effectively, but she’s obtained other followers along the way. “It’s neat that it’s helped people,” she said of the blog she started six months ago. Thornquist said she doesn’t believe in paying full price at restaurants or movies. “I never pay full price when I go out to eat,” she said. Through social media or sites like Groupon, people can get free appetizers or discounts on their meals. And she said the restaurants are so used to it nowadays that it’s no big deal. ADVERTISING THAT MEANS SAVINGS Thornquist said the stores are still getting the money even when people use coupons because it’s built into the products. “They’re still making money,” she said. It’s an advertisement, Idley said. It’s in the advertisers’ budgeting market. “This advertisement is a $1 coupon and it gets the product in your house,” she said. Wes Richardson, store director of Brookshire’s in Denton, said his customers use coupons. “The coupon users are a select group,” Richardson said. He said coupon users tend to save between 60 and 80 percent. “I think it’s fantastic,” Richardson said. “Anything to save a buck.” But it can be frustrating for the cashier if the coupon users aren’t organized or if they grab an item that doesn’t match the coupon, he said. The store can’t substitute the item on the coupon because then it doesn’t get its money from the vendor, Richardson said. “The best thing to do, if possible, [is to] align coupons in the way the buggy is going to be checked out,” he said. “It will run a lot smoother.” Lines get backed up if people have to hunt for coupons, he said. But his store tries to work

Holly Melton shows some of the coupons she uses to save money. with coupon users to make everything run smoothly, Richardson said. Dean hasn’t always found stores friendly when using coupons. “We got hassled a lot by some of the managers,” she said. But she said other managers were friendly. GIVING BACK Melton, Thornquist, Idley and Dean all admit they bought more than they needed or wanted when they first started using coupons. “You can get sucked into it,” Thornquist said. “But you can get sucked into eating a bag of chips. Do everything in moderation.” She goes by the rule of four. Only buying four of each item because she knows that will last her until the next time the item goes on sale. Any extra she passes on to charity. That’s what all the ladies do — they pass their extra items on to charity. “Even if it’s free it doesn’t mean you need it,” Idley said. But if she ended up with extra or unwanted items, she’d donate them to charity. “Obviously we’re not into the extreme couponing,” she said. Idley stresses that she only uses one cart at the grocery store. She buys three or four of

something unless she knows she will use it more often. Then she purchases 10 of the item. “I’ve always been really careful about how much I buy,” she said. Dean bought items she didn’t need when she first started, she said. “You get addicted to the high you get at the grocery store when you go to the checkout,” Dean said. “You’re paying $5 for $200 worth of groceries.” If it’s free and she doesn’t need it, she’ll still buy it and give it to charity. But she quit using coupons about a year ago because she started going to school. “I’ve devoted all my extra time to homework and family,” she said. “I felt guilty couponing because I was taking away from my homework time and my family time.” Dean also quit because, after the popularity of the show Extreme Couponing, more people started using coupons and clearing the shelves. She plans to start using coupons again this summer but not to the extreme she did in the past. “Over the past year I’ve spent so much money on groceries,” Dean said. Thornquist said using coupons is becoming a habit for a lot of people. “People are just becoming smarter, savvier shoppers all around,” she said.

assignment with five German equine magazines, spent a few days in May in Denton as the Denton CVB’s guest touring the North Texas Horse Country. Articles are forthcoming, but we may have to get them interpreted. David Wann, with Mother Earth News magazine — print and online versions — is working on a story for October 2012 about Denton as one of 2012’s “Nine Great Places” special editorial feature section. Travel and Leisure magazine recently listed Denton as a “Great AllAmerican Main Street City.” “Driving across America, it’s all too easy to lose your mooring amid the commercial thicket of the same old fast-food outlets and big-box stores. “But push on a mile or two beyond the interstate exit, and you may discover a town that’s anchored by a distinctive Main Street — one with grand architecture, eclectic small businesses, and community-oriented features like a park or theater. Often it thrives thanks to locals who have made a conscientious effort to fight the general decline of Main Street.” “The work of such activists and preservationists is acknowledged each year by the National Trust for Historic Preservation’s Great American Main Streets Awards and by the American Planning Association’s Great Places in America: Streets. We scoured their recent designations to select the most vibrant, distinctive downtowns worth the trip. You’ll find these great Main Streets across the U.S., and it’s well worth driving the extra few miles to see what Main Street is up ahead. Let us point you in the right direction.” (http://travel.yahoo.com/ideas/1 0-great-all-american-mainstreets.html ) We all know that Denton is a great city; it’s gratifying that other people are discovering that, too. aversion of today’s general public towards investing in stocks. Indeed, investors have pulled out hundreds of billions out of stock funds in the past three years. Back in 1982, a precious few contrarians, notably Buffett and other great value investors such as David Dreman, disagreed with the conventional view and actively bought stocks at that time because they had become so cheap. They turned out to be spectacularly right, and the early ’80s actually marked the beginning of the greatest stock market boom ever seen. Given many of the bargains in the market today, we expect that savvy, long-term investors can do very well in the coming years. It’s not 1945, ’74 or ’82...it is 2012. Yet, there are many investing lessons to be drawn from each of these noteworthy periods in financial history. 1945 reminds us of the perils of investing in low-yielding bonds

in the face of a government waging a war on savers. 1974 teaches us to emphasize inflation-resistant hard assets and world-dominating franchises in an era of currency devaluation. 1982 presents perhaps the most enduring lesson for value investors: to achieve superior investing results, we need to be contrarian and avoid the trap of conventional thinking. For those willing to learn from these lessons, this may be the year of the value investor.
