Engaging Colleagues, Clients, Adversaries and Courtrooms: Getting Results with Everything You Say The best lawyers agree that without skilled delivery, the soundest arguments fail. This session illuminates the secrets of presenting complex material with the ease of a conversation. To engage a colleague, client, court personnel, opponent or jury, a successful advocate identifies the essentials, says it directly and leaves out the smokescreens. Learn how to use vocal inflection and body language to tell the story. With concepts drawn from performance and years of public speaking, David Mann will show how to present engaging presentations for prospective client interviews, mediations and arbitrations, depositions, witness preparation, openings, witness interrogation, closings, and oral arguments.

Facilitator: David C. Mann David C. Mann is an accomplished speaker and trainer on the subjects of communication and change who shares the secrets he learned during his 25 years as a theatre actor and director. David has worked for General Mills, Hartford Life, Boston Scientific, Merrill Lynch, HealthPartners, Mayo Health System, and Volt Workforce Solutions, among others. He has been a featured speaker on communication for numerous associations and has created and presented customized keynote performances. David received a bachelor’s degree in speech from Northwestern University and a classical acting diploma from the London Academy of Music and Dramatic Art. He has been a high school theatre teacher and created a writing and performance program for the Guthrie Theater’s education department. David lives in St. Anthony, MN, with his wife and two sons.

Influencing with Integrity: Winning People Over vs. Winning Over People In business and personal relationships, strongly felt differences can result in conflicts that turn into a desire to win, even at the expense of others. These differences don’t go away as we work our way down the road from confrontation to agreement. So to “win” the cooperation of others when there is strong disagreement you have to master negotiating principles which are supported by both research and experience. Ultimately, if people are critical to your success, you must know and master the means to win their hearts as well as their minds. Successfully guiding your client and/or opposing counsel to an agreement will come when you can clearly, convincingly and persuasively show them the benefits of winning “them over,” not winning “over them.”

Facilitator: Ed Hatch Ed Hatch has influenced others from his work counseling at-risk teenagers in a suburban Washington, D.C. public school system to his work as a top producing salesperson. He also has had a job managing more than 100 employees, worked as senior vice president of sales at Fred L. Mckee Realty and was the co-owner of a real estate firm. For the past 20 years, he has been a speaker/ trainer for associations, institutes, 5-star hotels and corporate executives throughout North and South America, Europe, Asia and Africa. Ed’s message of the applied dynamics of human communication has particular application to the work of trial lawyers or transactional attorneys, where communication comes first in preparing cases and influencing outcomes.

The Changing Faces of Medicare and Medicaid This program offers insights from three professionals: Amanda Buzo will give an update on Medicare. Bonnie Kantor-Burman will discuss modernizing Medicaid reimbursement in Ohio, implications for long-term services and supports, prioritizing funding for home-and community-based services, creating a unified long-term care system in Ohio, nursing facility reimbursement reform and development of a Medicare Medicaid integrated-care delivery system. Janet L. Lowder will discuss Medicaid for children and the disabled and provide, among other topics, an overview of Healthy Start/Healthy Families, Medicaid for the disabled and home and community-based waivers.

Facilitators: Amanda Buzo focuses her practice on estate planning, with a concentration on issues affecting the elderly and special-needs families. She also practices in the area of probate, including guardianship,

special-needs

trusts,

wrongful

death, minor and incompetent settlements, and decedents’ estates. She was recognized as a 2010 Rising Star by Ohio Super Lawyers and frequently writes and speaks on the elderly and people with disabilities. Amanda received a Bachelor of Science degree from Ohio State University and a law degree from the University of Akron School of Law.

The Changing Faces of Medicare and Medicaid

Bonnie Kantor-Burman, the director of the Ohio Department of Aging, is working to reform the quality and efficiency of our health care system and to strengthen and widen long-term care options that give elders more health-care choices. She believes in the concept of preventive gerontology, a wellness and behavioral driven model of life and care across the lifespan. Before joining the department in January 2011, Kantor-Burman was executive director of the Pioneer Network, a national center for the development of long-term care delivery systems. She also has worked as director of the Office of Geriatrics and Gerontology at The Ohio State University. She earned her doctorate in health policy and management from Johns Hopkins Bloomberg School of Public Health. Janet L. Lowder is an authority on Medicaid issues and estate planning for families with special needs. She has represented individuals; handled local and statewide litigation and has represented agencies and county programs serving the elderly and the disabled. Janet is president of the Special Needs Alliance, an invitation-only national network of lawyers dedicated to disability and public-benefits law and special-needs planning, and is co-chair of an American Bar Association committee on long-term care and Medicaid. She received the Cuyahoga County Board of MR/DD’s 2000 Top Hat Award and the 2009 President’s Award from the Cleveland Trial Lawyers Association. Janet, who received her law degree from Cleveland Marshall College of Law, is consistently chosen as an Ohio Super Lawyer and is included in Best Lawyers in America for elder law and estate planning.

Conflict Management in the Arab Uprisings How should the United States engage in conflict management in light of the Arab uprisings, given our own recent history coupled with the region’s contemporary realities? What are the take-aways for the legal profession, in particular regarding engagement in an international setting? Colonel Philip J. Dermer shares his insights and lessons learned from his career in the military, and thoughts on relevance to the legal practice. Participants will consider several critical questions impacting the international arena, including how should the U.S. engage in conflict management regarding the Arab uprisings? What can be learned from the past? What are the relevancies and appropriate lessons for the legal field?

Facilitator: Colonel Philip J. Dermer, Ret. Colonel Dermer, whose career spans 30 years, is one of the Army’s foremost Middle East regional experts. His service in military and civilian arenas is spread over challenging spectrums, including national levels of the U.S. government and vital international venues. He has extensive coalitionbuilding experience working with international counterparts to foster the Middle East Peace Process as well as the rebuilding of Iraq’s critical national security institutions. He has advised, mentored and written extensively for the nation’s senior military and civilian leadership. He is a graduate of the National Defense University, Ft. McNair, Washington D.C., Georgetown University and the University of Montana.

Good People, Bad Choices and Life Lessons From the White House In 1971, 31-year-old White House Deputy Counsel Krogh was tasked with finding and stopping White House leaks and became head of the Special Investigations Unit. Through prison, disbarment and reinstatement, he learned there are drastic consequences when noble aspirations, internal loyalties, external pressures and ethical codes collide. The rules of professional conduct often say what not to do, but rarely explain what to do. It’s easy to turn down a capital murder case if you know you’re not competent to defend the person charged, but what do you do when your practice group leader or your most lucrative client compels you to do something you’re just not sure of? Krogh will give you the questions you must answer before taking on such projects and tell you of the positive consequences of saying no.

Facilitator: Egil “Bud” Krogh Bud Krogh was White House deputy counsel when he was told to find and stop security leaks. He became head of the Special Investigations Unit that later became known as the “White House Plumbers” and the rest is history. Of the various White House conspirators, Krogh alone pled guilty and refused to trade inside information for a reduced sentence. He was disbarred and went to prison. In 1980, Krogh successfully petitioned to be readmitted to the bar and has since practiced law. In January 2009, Krogh joined the Center for the Study of the Presidency and Congress as a senior fellow on leadership, ethics and integrity where he is developing initiatives to promote civility, character and inclusive public leadership.

Why Employers Get Sued and Using Your Hiring Programs as Risk Avoidance Tools This high-energy session will explain the hiring process and how to avoid risks and liabilities. Key mistakes and short comings that lead to the majority of employee and former employee lawsuits will be analyzed. Employment agreements, independent contractor agreements, policy manuals, performance evaluations, workplace investigations and administrating discipline discharge decisions will be covered. The session’s second part will show you how to design your hiring processes and use them to avoid risks and liabilities. Time will be spent creating a hiring program to identify the best candidate and implement the most effective proactive and remedial measures to avoid claims, liability and other business loss.

Facilitator: Richard Hooker Richard Hooker has significant experience in traditional labor relations, state/federal agency work,

employment

litigation,

union

election

campaigns, unemployment insurance taxation matters and arbitration of employment disputes. He is a mediator for the U.S. District Court, Western District of Michigan, and the Michigan courts, and he is an arbitrator and mediator with National Arbitration and Mediation, Inc., American Settlement Centers and the National Arbitration Forum. A lawyer with Varnum, a Michigan law firm, Hooker received his Bachelor of Arts degree from Denison University and his law degree from Washington & Lee University School of Law.

National Security Law Update: Drones, Detainees, and the Iranian Nuclear Program This session is an introduction of the domestic and international law bases for use of force (war powers, U.N. Charter, law of armed conflict). Discussion will be about the application of these legal bases to the ongoing issues of U.S. drone strikes in countries such as Pakistan and Yemen; the indefinite detention of so-called enemy combatants in the war against Al-Qaeda; and the potential conflict that may be looming due to Iran’s pursuit of a nuclear weapons program. The session also will show why these topics are relevant to private/commercial law attorneys.

Facilitator: Daniel G. Donovan Daniel G. Donovan, an international law specialist, is a supervisory attorneyadvisor in the Joint Staff Hampton Roads (Virginia) branch of the Office of the Legal Counsel to the Chairman of the Joint Chiefs of Staff. He provides legal advice and counsel to three Joint Staff Deputy Directorates and a Joint Staff Support Element. He previously served as principal deputy to the Joint Force Judge Advocate, United States Joint Forces Command, captain in the U.S. Navy’s Judge Advocate General’s Corps and was Deputy Assistant Judge Advocate General of the Navy for International and Operational Law. Daniel received the Defense Superior Service Medal, the Bronze Star Medal, and various theater and campaign ribbons. His Master of Law degree in international law is from Georgetown University Law Center and his law degree is from Case Western Reserve University School of Law.

Mastering the ‘Sales’ Process for Litigators and Transactional Lawyers™ This highly interactive workshop enhances attendees’ ability to communicate with clients and “pitch” prospective clients as effectively, ethically and professionally as possible. Six key steps of the client development sales process are studied and applied with the assistance of two lawyers. During the session, a reality-based practice pitch will be prepared and presented to the lawyers who will provide feedback on attendees’ method, approach and communication skills. Motto Julie Savarino has been an attorney for 25 years and is a nationally renowned expert in client and business development for lawyers, law firms and other professional services. He regularly partners with senior leadership and business managers to execute Online Resources’ strategic plan to expand its innovative internet banking, billing and e-payment products and solutions within key financial management, insurance, health care and utility market verticals. Mr. Ball also advises Online Resources’ CEO, CFO and Board in connection with acquisition, restructuring, financing and litigation matters, as well as associated governance, reporting and regulatory compliance issues. Mr. Ball also was instrumental in establishing and recently launching the company’s first offshore technology development and support operation, based in Bangalore, India. Patricia A. Motto is senior counsel in Intellectual Property at the American Greetings Corporation where she manages all aspects of its intellectual property counseling, transactions, and procurement. Prior to joining American Greetings, she was an associate attorney with the intellectual property practice group at Michael Best & Friedrich in Milwaukee, Wisconsin, where she represented numerous Fortune 500 companies and small entities based in jurisdictions around the world in a wide variety of intellectual property-related matters.

He is the author of 15 books and more than 30 articles on business-related issues. He has a Master of Business Administration degree from the Carlson School of Management at the University of Minnesota and a law degree from the University of Chicago Law School.

As the legal industry catches up on technology with the rest of the world, more and more lawyers are utilizing open source solutions in their practices. These resources tend to be cost effective (actually, free). The presentation will introduce the concept and background of open source. Many solutions exist that will be addressed to show how lawyers can advance their practices.

That said, like any use of technology or practice management tools, lawyers need to use their head and become informed. The presentation will explain the concept of cloud-based technology. Best practices will be addressed for selecting cloud-based tools and providers, along with ethics issues lawyers should identify.

Managing Change and Adoption of Technologies Ray Kurzweil stated, “An analysis of the history of technology shows that technological change is exponential, contrary to the common-sense ‘intuitive linear’ view. So we won’t experience 100 years of progress in the 21st century—it will be more like 20,000 years of progress (at today’s rate).” Accordingly managing change in a law office will be a major issue facing all lawyers in the near future. We will examine strategies for adapting how you now practice law to take maximum advantage of imaging technology. We will also propose best practices in moving your practice from an analogue (paper) orientation to a digital one.
