president' s message Overcoming "Guilty Vacation Syndrome"

Whether you are an advocate, rainmaker, litigator, or corporate lawyer, you may experience “Guilty Vacation Syndrome,” the urge to cancel or delay a vacation due to guilt. Why is this? Perhaps we see others who are always out of the office and question their work ethic or commitment. Maybe we are concerned about others handling our work or clients in our absence, or burdening others with our work. Or perhaps our planned vacation coincides with a busy time in our Karen King practice, and the thought of the work that will await us is stress inducing. Additionally, the guilt of being away from the office may have increased because of the pandemic’s effect on business.

executive director' s message More In-Person Events are Coming Your Way!

As Covid restrictions lift, and things return to a more normal pace, each month sees a few more events come back to life and more engagement with our members. Our LBA committee and section chairs have been working hard on CLEs and in-person events and we are grateful for their efforts. Thank you to our LBA section representatives who contributed to Well-Being Week in Law for our social media takeover days and to our members who came for by for Drive-Thru Healthy Breakfast. It was great seeing members in person, even if just for a couple of minutes. The Family Law Section recently installed their new officers for the upcoming year. Taking over as President is Dyan Schnaars with Mandi Bucher serving as Vice President, Claire Edwards as Secretary, Lesley Beam, Treasurer, At-Large members Geralyn Siefker, Lana Duhon, and Immediate Past President, Taylor Fontenot. Thank you to Taylor for his leadership and for keeping the section on track during the past year. We have always known that our LBA members make a difference and several of them have recently been recognized for their contributions to the legal profession. During the recent LSBA Young Lawyers Conference, the LBA YLS was well represented. Congratulations to Young Lawyer section member Roya Boustany on receiving the coveted Hon. Michaelle Pitard Wynne Professionalism Award. Chris Ortte was named a finalist of the LSBA YLD Pro Bono Award, Stuart Breaux was named a finalist of the LSBA YLD Oustanding Young Lawyer Award, and the LBA Young Lawyers Section was recognized as a finalist of the LSBA YLD Outstanding Local Affiliate Award.

The LSBA recently announced the 2021 Pro Bono Publico and Children’s Law Awards and again, LBA members made us proud for their recognitions. Lindsay Meador Young was named 2021 LSBA Friend of Pro Bono Award Winner and Jonathan Jarrett was honored as the 2021 LSBA Pro Bono Publico Award Winner.

Thank you to all of our volunteer attorneys for your continued commitment to the Association Pam Landaiche as well as your dedication to providing volunteer services through the Foundation. The 10 Commandments. Everyone has heard of them. In my mind, they conjure images in the 1956 movie of the same name of Charlton Heston as Moses descending from Mount Sinai with the stone tablets. But have you ever heard of the Paradoxical Commandments? Probably not. I first heard about them during a commencement address at my oldest daughter’s graduation. They are aspirational goals that we all should strive to achieve. They are based on the premise of doing things anyway despite what people may say or think. St. Teresa of Calcutta is often credited as the author of the Paradoxical Commandments. She would be a good guess as having written them because she posted them on the walls in many of her schools especially in India. But a lawyer from Hawaii actually wrote them. His name is Kent Keith. He wrote them in 1968 when he was a 19 year old sophomore at Harvard. Since then they have published thousands of times around the world. Here they are: 1. People are illogical, unreasonable, and self-centered. Love them anyway. 2. If you do good, people will accuse you of selfish ulterior motives. Do good anyway. 3. If you are successful, you will win false friends and true enemies. Succeed anyway. 4. The good you do today will be forgotten tomorrow. Do good anyway. 5. Honesty and frankness make you vulnerable. Be honest and frank anyway. 6. The biggest men and women with the biggest ideas can be shut down by the smallest men and women with the smallest minds. Think big anyway. 7. People favor underdogs but follow only top dogs. Fight for a few underdogs anyway. 8. What you spend years building may be destroyed overnight. Build anyway. 9. People really need help but may attack you if you do help them. Help people anyway. 10. Give the world the best you have and you will get kicked in the teeth. Give the world the best you have anyway. A paradox is defined as a statement that is seemingly contradictory or opposed to common sense and yet is perhaps true. That is what the Paradoxical Commandments are all about. They can apply to everyone in all walks of life, but I believe they are especially well suited for us as lawyers. Often we are called upon to take unpopular or contrary positions but we do it anyway. Likewise we represent people who are not are not well liked in the community. But we do it anyway. This is particularly true when a criminal defense lawyer represents someone that may be charged with a heinous crime. We do it anyway because that person is entitled to a presumption of innocence and has a constitutional right to counsel. AN UPDATE FROM PRESIDENT

Despite having served on the YLS board since 2013, I had no idea what to expect at the beginning of my term as President. From not knowing whether it would be possible to hold any in-person events, to setting a record for attendance at the second Golf Tournament held in the same year, it has been a constant state of adjustment. The fact that we have been able to hold all of the events I’ve reported on here is a true testament to the commitment of our members. Most particularly, I want to recognize our Bar Association staff, who have truly gone above and beyond in making our plans a reality. I am most proud of the fact that our organization has found ways to adapt to the challenges presented over the past fourteen months, and to continue to provide opportunities for engagement and enrichment to our members and the public. In furtherance of that goal, YLS is making a donation of $2,000 to Downtown Lafayette Unlimited toward funding an all-inclusive playground in Park Sans Souci. YLS has been busy this spring. On April 8, the section hosted a “Diversity, Equity and Inclusion” CLE. Thanks to presenter Dwazendra Smith for initiating a lively and informative discussion, and to CLE Committee chair Quincy Mouton for organizing an engaging event. On April 21st, the YLS hosted its Spring Social outdoors at the Wurst Biergarten, where members were able to take advantage of some exceptional spring weather. Thanks to our sponsor, Broussard & David, and also to our Social Committee chair, Kenny Hebert, for organizing another great event. The YLS Health & Wellness Committee, led by chair David Kobetz, also started a run/walk group, which meets after work on the first and

third Tuesday of every month. Meeting times and locations can be found on the LBA website, and we hope you will join us!

Family Law Section News PRESIDENT DYAN SCHNAARS INCOMING PRESIDENT'S MESSAGE

I am honored to serve as your incoming President of the Paula K. Woodruff Section of the Lafayette Bar Association during the first part of our 25th Anniversary term! It is my goal this year to reacquaint our distinguished membership and brand-new practitioners with all our section has to offer, and collaborate on meeting the 2021 post-COVID modified practices of our membership. Our section was established in 1997. The mission of the section is threefold: to foster civility, professionalism, and legal competency among its membership; to improve the legal system in general and increase the system's sensitivity to the special needs of families and children in particular; and to promote a system of specialized family courts in the Fifteenth Judicial District and in the State of Louisiana. I sincerely believe that our profession as family law practitioners is more than a career choice. It is a calling. Our opportunity to positively impact families and children during a time of emotional conflict is unprecedented. Our compassion and competency will have rippling effects on many of their future decisions and their future relational attachments. I am humbled to serve families in this time of critical need. I challenge each of us to peremptorily research, thoroughly

prepare, and competently deliver our best to each client as we walk them through these difficult transitions. To provide our best service, we must be our best selves. We have so many fantastic resources at our disposal in the Section. The Paula K. Woodruff Family Law Section is the largest and most active family law section in the State. Currently, our Section has approximately 100 members from Lafayette, Vermilion, Acadia, Iberia and St. Landry Parishes. With the indispensable assistance of our highly efficacious bar staff, the Section sponsors various continuing education and enriching activities for its members throughout the year. This past year, the section began a round table collaborative consortium with local mental health professionals and counselors to focus our collective intellect on efficient and innovative ways to better serve families going through divorce and custody modifications. Additionally, we provide wellness activities to address the physical and mental wellbeing of our members to keep them at full strength to serve. The Section also provides opportunities to connect and network with your fellow family law practitioners in an informal setting. Come join us at a Family Law Section Meeting the second Monday of every month at the Louisiana Bar Foundation Office. We will be here to provide the camaraderie, continuing education, networking and peer support you need to succeed in your practice. I look forward to serving you this year.

SUMMER VACATION

CHALLENGE

This year, what about a series of vacations? Groups can be assembled for kayaking/canoeing trips. Families can be gathered for hiking trips. Individuals can have a moment of peace with nature. Here are some local opportunities, and here is a bucket list of other local hiking trips to get out of town and breathe some fresh air.

PACK & PADDLE Pack & Paddle, the outdoor retailer located on Pinhook at Evangeline Thruway, offers kayaking trips that I’ve attended in the past. One year I kayaked down the Teche, and another year I paddled Nezpique. Pack & Paddle’s staff is so knowledgeable about nature and offers identification of plants and birds along the paddle. Further, it’s not too strenuous (I was 5 months pregnant on one of the trips), and it’s completely relaxing. Another opportunity for kayaking is to DIY. I’ve successfully strapped a kayak to the top of a Tahoe, the top of a Carolla, and the back of a Sierra, all on different occasions. I’ve kayaked without a tour guide down in Cocodrie (which I highly recommend, it’s so beautifulit’s obvious why people who like to fish will spend entire weekends there). I’ve also kayaked off Exit 121 of I-10, where there is Lake Bigeaux and Lake Pelba. This was a safe put-in and safe return with very easy access and minimal current, a very still paddle close to nature. A few years ago, I put-in on the Vermilion River at W. University and landed at my in-law’s house. Of course a great option on the Vermilion is to put-in at the W. University access point and “paddle” the Vermilion with your ice chest of beverages until you reached Ruffino’s four hours later. As per their website, their current offering is the Atchafalaya Sunset Kayaking at Henderson- Sundays from 2:30pm-5:30pm, Solo Kayak $35, 2-person Kayak $45, Canoe $45.

TUNICA HILLS HIKE I grew up calling this park “Tunica Hills” but it’s also called “Clark Creek State Park.” I’ve been hiking here numerous times as a child/teenager and a few times as an adult for a daytime getaway. Anyone who has hiked Tunica Hills agrees that it’s straight downhill for getting to the waterfalls and creek trail, and it’s straight uphill to get back to your car. There are stairs available, but this is one I may have to sit out with a three year old because I expect he will need to be carried out. As per the Clark Creek State Park website, a day use entry fee of $2.00 per person is charged for use of the park. Five years of age and under are free. LAFAYETTE NATURE PARK

I take my ten month old and three year old to hike these trails every weekend! Some are on the ground and some are on raised boardwalk. The boardwalk is wonderful because it makes the experience stroller-accessible or, if needed, wheelchair accessible. The entire park feels tucked away, and there are different water features- a winding creek that rises and falls depending on rainfall and a bayou that has consistent depth and is on a very sunny path.

MOST UNUSUAL PLACES TO VISIT IN THE U.S. 1. THE QUEEN MARY

Stay on board The Queen Mary, once a world-class ocean liner, and now a luxurious floating hotel in Long Beach, CA. World-renowned as one of the greatest luxury liners to have sailed the seas, the RMS Queen Mary’s last voyage set out in December 1967 and now functions as a unique floating hotel with three award-winning restaurants.

2. JULES' UNDERSEA LODGE The Nature Station’s mission is to reacclimate humans to nature and encourage personal responsibility in conserving our native plants, animals and habitats. Address: Acadiana Nature Station, 1205 East Alexander Street, Lafayette, LA.

CHICOT STATE PARK The trails are challenging, and the views are worth the hike. This park is around an hour outside of Lafayette and it is certainly worth the drive. There are a few play areas for children with big toys including slides and swings. Canoes can be rented on site and can be taken out on the lake (I’ve done it! It’s fun!). Address: 3469 Chicot Park Road, Ville Platte, LA 70586

LAKE MARTIN This area is surprisingly close to Lafayette. The trails are very rustic, in that they are not overtrodden and I was able to pick boysenberries when I hiked last April. There are definitely alligator sightings available! I would advise making a game out of capturing pictures of alligators on your phone and posting them to social media to show off how many pics you can get in a day hiking Lake Martin. Further wildlife at Lake Martin include blue herons, egrets, and spoonbills. I believe there are kayaking/canoeing opportunities for on-site rentals so no one has to drive a kayak- just hop in and paddle around! Address: 1001 Rookery Rd, Breaux Bridge, LA 70517

Jules' Undersea Lodge is the world's first underwater hotel. Located at the bottom of the lagoon at Key Largo Undersea Park, Jules' offers overnight stays in the underwater abode, as well as scuba diving courses and underwater adventures.

3. HECETA HEAD LIGHTHOUSE

Spend the night in a working lighthouse. The Heceta Head Lighthouse and Light Keeper’s house were built around 1894 and remain in working condition today.

AN INTERVIEW WITH DANIEL LANDRY BY DANIEL PHILLIPS Many LBA members recognize Danny Landry from his service as an Assistant District Attorney for the 15th JDC. He is now in private practice full-time, but he is also an avid photographer and world traveler. We sat down with Danny to find out more about his travels and photography. Tell us about your journey into photography. I began when I was twelve years old, but I really got the bug when I took a picture of a fire at Lafayette High while I was a student there, and the Advertiser published it. I continued until I went to law school, but I got back into it about ten years ago. What do you enjoy most about photography? It stops time by forever capturing a moment. I love photojournalism, or taking candid shots like people dancing at festivals or crying at funerals. It captures raw emotion on a very human level. Where are some places that you have traveled for photography? My family and I just returned from the National Parks in Utah. I have also been to Los Angeles, Vancouver, California, Washington DC, and Cuba, to name a few. What is your next destination? Costa Rica to photograph the Arenal Volcano. That should be amazing. What is your favorite moment from your photography or travels? When I went to Cuba, I would photograph a family then give them the

photo. It was wonderful because many of them never had a picture of themselves. When we returned, a Cuban musician here for Festival saw them in my gallery. One was of his sister who he had not seen for years. He began crying when he saw her. That was the most amazing moment I have had as a photographer. What places are on your travel bucket list? Myanmar. My father went there during World War II to build the Ledo Road. He extensively photographed his time there. I planned a trip to recreate his photos, but I had to cancel due to political instability. That would be a very special trip. How has your legal career benefited from photography and traveling? Photography helps me to focus on surroundings without distraction, which helps me to be attune to the details of a case, client, or witness. It also allows me to refocus on the big picture, the beauty of nature, and the uniqueness of individuals, which helps me stay fresh and focused in my practice. Any advice for aspiring photographers? UL’s Gumbo U program offers great classes taught by experienced photographers. Also, hang around other photographers. We love to help each other and have fun. Claire Edwards interview with Brooke Kobetz- Part I of II: EXERCISE How much exercise is too much? I asked a professional, who told me that the answer is dependent on your baseline physical condition. Marathon runners, athletes, cross fitters, and other very active individuals will be capable of putting in more hours than someone just starting out. Having adequate rest days is extremely important, as too much exercise can lead to injury, inflammation, and chronically elevated cortisol (stress hormone) production which may impede weight loss, cause bone loss, and muscle breakdown. There are telltale symptoms that someone is overexercising, which include exhaustion, injuries, insomnia, slow recovery time, frequent sickness, anxiety, depression, irritability, and slow healing. Some of us are “weekend warriors”, but saving all exercise for the weekends can have drawbacks. There is an increased risk of injury. Also, most social events tend to be on weekends, which makes it more likely that work outs may be skipped. Balance is key and exercise can be done in smaller increments. Even a short walk on a lunch break or a jog before work will add up. The American Heart Association recommends 150 minutes per week of moderate intensity aerobic activity, or 75 minutes per week of vigorous aerobic activity, or a combination of both. A good exercise program is one that fits individual needs and is balanced. It should include strength, mobility/flexibility, and cardio

On Thursday, April 29, 2021, Justice James Gonevese of the Louisiana Supreme Court presented the CLE "Professionalism in the Age of Social Media, COVID, and Hurricanes." Following the CLE, Justice Genovese re-administered the oath that all attorneys take when they are sworn into the bar. Several members were present for the oath, and also received a commemorative LAB lapel pin for attending and participating in the event.

Brooke is a distance runner, and she told me that she puts in more cardio and interval workouts than anything else but also does at least 2-3 strength workouts a week using both heavy weights and body weight. She also does stretch and/or mobility exercises for approximately 20 minutes a day. Yoga and pilates programs also address stretching and mobility. Brooke identified the main benefits of different types of exercise: Strength training- Increased muscle mass, stronger bones, joint flexibility, balance, and weight control as muscle is more metabolically active than fat Cardio benefits- Weight control, brain and joint health, increased circulation, aids with sleep, lowers blood pressure, and helps to regulate blood sugar HiTT benefits- weight control due to high caloric burn in a short amount of time, improved blood flow, a metabolic rate that may stay increased for hours after exercise, fat loss, improved oxygen consumption, reduced blood pressure, and reduced blood sugar Mobility/flexibility benefits- improved posture, reduced stress, reduced lower back pain, more efficient movement with age, possible increased life span Finally, Brooke emphasized that any exercise is better than no exercise. Walking will absolutely make a difference, and the goal should be at least 30-60 minutes. After being postponed another week due to unfavorable weather conditions, the Spring Social was held at Wurst Biergarten on Wednesday, April 21, 2021.
