Legal Matters

Solicitor Nicola Dudley explains important changes to intestacy laws t is not often that major changes occur in the area of private client law but the Inheritance and Trustees Powers Act 2014 was given Royal assent in May this year and came into force on 1st October 2014. The Act makes changes to the distribution of estates where there is no Will (“intestacy”) and changes a number of statutory provisions which are considered no longer fit for purpose in the modern world or have caused difficulties in the past. For deaths prior to 1st October 2014 only if the deceased had no issue (ie. children or grandchildren etc) and no parents, brothers or sisters (or half siblings) would the surviving spouse or civil partner inherit the entire estate absolutely. If there are issue, then before the Act came into force the surviving spouse would only inherit the deceased’s personal belongings, a fixed sum and an interest for their lifetime in half of the remaining estate. The other half of the estate would go to the issue absolutely when they reached the age of 18 years. That fact that the surviving spouse did not inherit half of the remainder of the estate absolutely often caused problems as it meant that some of the deceased’s assets would be held on trust and the surviving spouse would not be able to deal with that part of the estate as they wished. After the Act, instead of only having the right to benefit from half of the remaining estate for their lifetimes the surviving spouse will inherit that half absolutely. The remaining half will pass to the issue at 18 as before. If there are no issue, but there are parents or siblings who survive the deceased then before the Act the parents would inherit one half of the estate and the surviving spouse would receive the personal belongings, a fixed sum and the other half of the estate. This would mean that the

surviving spouse would have to pay their parents-in-law (or their deceased spouse’s siblings if the parents had predeceased) half of the remainder of the estate, which could result in their home having to be sold for example. For deaths after the Act, the gift to any surviving parent or sibling has been removed and the surviving spouse will inherit the entire estate absolutely. The Act also contains other useful amendments but does not include provisions for cohabitees. This may be a lost opportunity as the number of cohabiting relationships is predicted to rise from around 4.7 million in 2008 to just under 7.6 million by 2033. Watch this space!

Personal trainer Jade Parsons explains how to get the perfect stomach

hen it comes to your stomach its all about food. Food plays the biggest role. Low-carb eating patterns have proven to be effective for a nice stomach but they aren't necessarily the answer to all of your problems. Strict low-carb diets reduce your ability to replenish muscle glycogen (the fuel stored inside muscle cells) this can make building and maintaining muscle a challenge. Just think healthy! Lower abdominal fat is often caused by cortisol, (also known as ‘the love handles’) can be a sign that you could be resistant to the hormone insulin. The pancreas produces insulin. It is responsible for shuttling glucose (sugar) from your blood cells into the muscles. When your muscle cells are 'full up', the insulin needs to take the sugar out of your blood. It then it stores it in a fat cell which is very often resides in your love handles and abdomen. Try reducing sugary and processed carbs you consume. Add some green vegetables to your day, as they have a high nutrient content. Also more dairy so you are getting enough calcium. Adding good carbohydrates to your diet that attract fluid and then stays in your stomach longer than insoluble fibre (like vegetables). Soluble fibre is thought to reduce blood cholesterol by binding with digestive acids made from cholesterol and sending them out of your body. Now once you eat right try some

workouts for the area. Abdominal and core workouts should be simple, quick, and effective. A big problem people have when training abs and core, is their breathing. You need to inhale deeply before executing the movement and then as you crunch or leg raise, blow all of your air out. This forces your abdominal muscles to contract. Its not easy for everyone to do this rhythm, but try to think about pulling in every muscle in your stomach. You should then contract your pelvic floor and you will soon get there. Exercises where you bring your pelvic girdle towards your torso whilst remembering your breathing, are simple and effective. These are types of leg raises. You can do these in lots of ways, so be creative. Try hanging from a bar, lying down or even holding your self up on bars from a bar. Keep your legs straight or bent if this is to hard and then form an L shape with your body in the contracted position. When repeating exercises like this remember to think about your repetitions, as 10 should actually be enough if you do them with perfect technique. To do a movement for mainly the upper abdominals is to perform a sit-up or crunch. You can do this on the floor or on a bench, standing or also holding weight. anstead Rotary Club is preparing for the charity collections in December 2014. Rotary gives everything to charity and we have raised thousands of pounds over the years, with none of our members taking a penny for themselves. We are also careful to see that the money we raise goes to the people who need it. The money from our Christmas collections goes to local charities, and we also do fundraising for the third world throughout the year e.g. sending Shelter Boxes to places like the Philippines after disasters, so peoples’ lives will be changed for the better.If you want to give money to charity you can be sure if you do it via Rotary none of the money goes into members’ pockets and we pass every penny raised to local charities. We try to ensure that the money gets to people who really need it! We will start our charity collections in Banstead and Nork on 3 December with Father Christmas touring the area on his sleigh. We begin the round in Beacon Way and finish in Woodgavil. On 4 December we move to

Banstead Garretts Lane.Our next visit to the district will be on 8 December in Rose Bushes starting in Harkness Close and finsishing in Shelley Close. On 9 December we begin in Buff Avenue and tour the area to finish in Winkworth Road. On Wednesday 10 December our route takes us through Nork High Beeches from Blue Cedars to Warren Road. On 11 December we move back to Banstead and travel from Bolters Lane to Wilmot Way. On Monday 15 December we travel round the Preston Hall Estate driving from Acres Gardens to St Leonards Road. Wednesday 17 December will see us in Tadworth Shelvers Way starting in Copley Way and finishing in Wessels. 18 December we will focus on the The Tattenhams and we will finish on 19 December touring around Tattenham Corner.
