Nicola Dudley on important private client law updates

y the time you read this Budget Day will have passed and no doubt you have been considering how the proposals will affect you. There have also been some recent changes in the area of private client law, which it may be useful to know. Lasting Powers of Attorney (LPA) At the beginning of the year the Office of the Public Guardian stopped accepting the old style LPA and will only register the old style LPAs signed before 1st January 2016. The new forms are in a simpler format and incorporate a registration section, which means that there is no need for additional registration forms. There is also now no need to notify anyone that you are putting an LPA in place and therefore only one Certificate Provider is required. If you are not familiar with LPAs or already have one in place this may not be of any interest to you but if you have been considering LPAs it does mean that the new process is simpler and therefore less expensive to implement. There have been some difficulties with banks and fund managers not accepting a Property & Financial Affairs LPA when acting on a discretionary basis. It is necessary to include specific instructions within the LPA and if this is not included your Attorney may not be able to give instructions on your behalf to a discretionary fund manager. Residential Nil Rate Band Clarification has been received from HMRC confirming that it is not necessary to advise them if you downsize in order to claim the additional tax relief. This can be done by your Executors following your death as part of completing the Inland Revenue account for Inheritance Tax. It is, however, advisable that you keep a record of the sale/

disposal details when downsizing so that it is available to your Executors. Stamp Duty Land Tax (SDLT) Although the 31st March 2016 deadline for the additional 3% SDLT on the purchase of second properties has passed the general consensus is that the increased SDLT will be due on the purchase of property by Trustees of all trusts, including discretionary trusts. It may be that property purchased by Trustees for the occupation of a beneficiary who does not own other property will not attract the increased SDLT but if that beneficiary then purchases a subsequent property in their own right they will have to pay the additional SDLT on their purchase. Personal trainer Jade Parsons explains why you need to limit or exclude alcohol from a calorie-controlled diet.

t doesn’t matter how sugary, fatty or processed a food is, how many enumbers and preservatives it contains, or what the GI is, if you’re not overconsuming calories, you won’t put on an ounce of fat. I actually encourage my clients to eat some junk food every so often just like I do, as I feel that by including this it teaches moderation and self-control, while helping cravings. We do need to ensure you’re getting a decent balance, including plenty of varying food sources, the right vitamins, minerals and fibre intake. But after that, as long as you are managing your intake and hit goals, you should be able to add what you want to you diet. There is one exception. Something I think people should try to ban from their fat loss diet is alcohol. While you may be sticking to a healthier plan on most days, certain occasions call for a bit of relaxation; often this is in the form of alcohol. While alcohol is fat-free and low in carbs, it's important to remember that it's the calories that count when it comes to weight management. Alcohol has 7 calories per gram, which means it’s less calorically dense than fat, but you wouldn’t take out having good fats from your diet, as this would be detrimental to your health.

Alcohol calories add up very quickly. Add alcohol to daily intake and things can quickly go wrong! The other really damaging thing is that as few as two standard alcoholic drinks can slow down your body’s fat-burning process. In the UK, 18% of men admit to consuming above the recommendations, while 13% of women also do the same. Even in moderation most people tend to be bad when it comes to alcohol. Alcohol doesn’t fill you up and has has completely the opposite effect. Usually it causes increased cravings meaning you over-eat. I feel that most people should eliminate alcohol when dieting. It’s not only the alcohol it’s the sugar. Sugar can be “addictive” but there’s far more evidence relating to the addictive nature of alcohol. So it’s just not good because of well being and health but you’re more likely to over-eat, get hungry, and come off plan. Also I would like to add alcohol has a dehydrating effect on the body and you will need to replenish any water that is lost when drinking. Drinking water can also help you drink less alcohol, which results in fewer calories being consumed. It’s an easy habit to pick up! One drink per night turns into more at least some of the time. International concert organist to give recital at Betchworth

M

argaret Phillips, the International Concert Organist, will give a recital on the new Kenneth Tickell pipe organ in Betchworth Parish Church on Saturday 21 May at 4.00pm. This is Margaret’s first recital on the new instrument, which she is particularly looking forward to since this was the last organ personally completed by Kenneth Tickell before his untimely death in 2014. Margaret finds playing in smaller churches such as Betchworth is often more enjoyable than playing in large venues such as concert halls or cathedrals. Commenting on this, Margaret said “Organ recitals can often be rather disembodied occasions, with the performer far away in an organ loft, so one hopes that this type of concert in a smaller venue will attract some people who might not otherwise think of going to an organ recital.”

Handel March at the end of the ‘Occasional Oratorio’ and also the tune from ‘Messiah’ which Alexandre Guilmant uses in his March. Margaret has included in her programme a piece by Lionel Rogg, the eminent Swiss organist and composer whose 80th birthday falls on 21st April. The piece is a kind of Spanish dance, and Margaret will also play two other short contemporary dances with Spanish connections, one by Rogg's ellow Swiss organist Guy Bovet, and one by the Swedish composer Fredrik Sixten. Tickets are priced at £15 (under 14s: £10) to include a glass of wine/soft drink. The concert will be projected onto video screens allowing the audience to view the player directly.
