Editor’s Note Can you believe we are nearing the end of 2023 and just a month away from a new year? As the year winds down, I hope you and your family can find time for a little rest and reflection on what you are thankful for. Here at the Tipton Lakes Community Association, we are thankful for the new members that we have met, a fun-filled Marina season, the volunteer support, and the members who continue to make Tipton Lakes a great place to live. The feature story on page 18 is an interesting account of two residents who are most certainly thankful for each other. I hope you can take the time to read it. Also note that we are always looking for stories like this one to highlight the members of this community. As we have said before, our work here would not be possible without the cooperation of our members who continue to share great stories with our community. 2024 Assessments Watch your mail in early December for a detailed letter regarding our 2024 budgets and assessments. All budgets are prepared by the finance committee and association staff; and adopted by the board of directors. Cluster committee and board committee members are consulted for recommendations, upcoming projects, and changes from year to year. All 2024 budget information will be included with your first quarter 2024 invoice. A copy of the 2024 general budget and applicable cluster budget will also be included for your information. If, at any time, you have questions regarding your budget or quarterly assessment, please contact the Association Office. The Importance of Assessment Collection October 7, 2019

Assessments and assessment collection are essential to the financial health of any community association. Every community, regardless of type, has expenses that range from maintenance, repair and replacement of common areas to insurance and operational costs. Assessments are the lifeblood of the association and allow the association to function properly. The primary financial planning tool for any community association is the annual budget. A proper budget should cover all projected expenses of the association for the upcoming year, including maintenance of common areas, operation of recreational facilities, landscaping, insurance, management costs, legal costs, snow removal, and other necessary expenses that are vital to operation of the association and preservation of the community’s curb appeal. Depending on the community’s governing documents, the annual budget may be subject to approval by the owners. This will vary from community to community. Once expenses are estimated, the board will determine the amount of the assessment to be paid by the homeowners. Depending upon the association and its governing documents, assessments can be imposed annually, semi-annually, quarterly or monthly. The association’s governing documents typically make payment of assessments the personal obligation of the homeowner. This obligation to pay assessments is independent from any obligations of the association. Meaning, the homeowner’s obligation to pay assessments is nonnegotiable. Under Indiana law, a homeowner cannot withhold assessments due to an actual or perceived grievance with the association or based upon allegations of mismanagement. Placing assessments in escrow is not an option either. That option is common in landlord/tenant situations, but not in a community association setting. Pursuing neighbors to collect unpaid assessments can be an awkward and uncomfortable task. However, it is a vital task nonetheless. Failure to systematically and consistently collect assessments can have a disastrous impact on the community. If assessments are not collected, it can result in a shortfall in the community’s budget. This translates to increased assessments for those members who ARE paying their assessments, just so the association can pay its

budgeted expenses. Long-term nonpayment can also translate to shallow reserve funds and deferred maintenance. Roofs are not replaced, streets are not repaired, common-area maintenance work is delayed, and, in some cases, special assessments become necessary to pay for important capital repairs and replacements. Deferred maintenance, low reserves and frequent special assessments will ultimately cause property values to decline. Assessment collection has a ripple effect. It may seem like giving your neighbors a break is the “neighborly” thing to do. The downside, however, is that if assessment collection is not proactively pursued, the rest of the neighbors are the ones to suffer by way of increased assessments, deferred maintenance, declining community curb appeal and lost property value. Consistent and fair collection policies are essential to the financial health of the association. A set collections policy can remove the guess work and provide a systematic, unemotional way for the board to make decisions. Love Story

Love stories aren’t typically catalyzed by a lung transplant, but such is the case with Blackhawk residents Melissa and Mike Smith. It’s a story that involves some television actors, a support base extending as far as Connecticut and lots of good-natured ribbing among people who care deeply for one another. Melissa is an Indianapolis native. She was born with cystic fibrosis, which in most cases is a sentence to a short life fraught with mounting lung issues. “I was a Riley kid,” she said, referring to the children hospital in the Indiana University Health system. 18

She surmounted it well for a number of years, working in the real estate development field, marrying and having a son. There were challenges, even on the familyfront. Her son, Brendon, had autism, epilepsy and cerebral palsy. Also, her marriage began to fail. However, she found a lot of satisfaction in working for Davis Homes, a building company, where she was one of the youngest salespeople. She became good friends with her supervisor, and they would kid each other on Facebook about their particular quirks. Melissa teased him about his pictures showing how buff he was, “all oiled up,” as Melissa puts it. A mutual


friend named Mike Smith joined in the teasing. “I thought, I like this guy.”, he said.

Mike and Melissa became Facebook friends as a result. Mike was a Beech Grove native, and they took to ribbing each other about their respective high schools’ sports teams. But as she said, “I was in the middle of a divorce, and I was getting sicker. I’d wind up in the hospital, and get out and try to be the single mom trying to catch up on life and wind up right back there.” In 2010, she was evaluated for a lung transplant, but told she “wasn’t sick enough.” Her lung function got progressively worse, and in 2012, she enrolled in the IU Methodist adult cystic fibrosis program.

That hospital had a rule that those on the wait list had to have a residence nearby, which necessitated her having two homes for a period, one there and one in Indiana. “I went out there on February 25, 2013, and they had me on the list by March 15.” She said she was “very blessed to have a lot of supportive people asking when they could start fundraising.” She stayed in touch with Mike Smith, an avid mountain biker and rock drummer, whose day job was driving for Federal Express. He also drove for Aldi. Smith was in a ZZ Top cover band and told Melissa he wanted to organize a benefit concert,

featuring several area bands, on her behalf. “I thought, wow, this guy hardly knows me,” she said. Word about fundraising was getting out on a national scale as well, “A group of people in Connecticut threw a spaghetti dinner.” More notably, she came to the attention of writer and actress Heather Summerhayes Cariou, whose parents had founded a cystic fibrosis foundation. Cariou’s husband is Len Cariou, who played a former police commissioner and family patriarch on the CBS television series “Blue Bloods.” Heather told Melissa she’d reach out to Donnie Wahlberg, who was also a cast member of “Blue Bloods”.

An April 2013 date was set for the concert. Of course, Melissa was in St. Louis at the time. Barnes-Jewish told her if she left for the weekend, she’d lose her place on the donor list. Meanwhile, her ex-husband was trying to get custody of their son. Also, she had to sign an agreement to accept lungs from a CMVpositive donor. CMV, or cytomegalovirus, rarely affects healthy people, but this made for an added element of risk for Melissa. It was a stressful time, to say the least. Melissa’s mom, to whom she was close, came to St. Louis to help. A few days before Melissa got the call that a donor had been found, she and her mom booked appointments at a styling salon. After getting thoroughly pampered, the salon told her that her husband, Mike, had already paid for their visits. Since her ex’s name was also Mike, there was a moment of panic, until she learned that Mike Smith had been the benefactor. When she woke up in recovery after her surgery, her mom said, “That guy who paid for our hair is here to see you.” Melissa conveyed that he was to be let in.

The new lungs, by the way, were CMV-negative. And back in Indianapolis, at the concert, it was announced that she’d had her transplant. Also, people from her church brought her son to see her. Mike Smith came out to St. Louis every couple of weeks to help Melissa’s mom during the recovery period, which lasted until July 20. He said, “I fell in love, but I was in denial about it. But about a week before she went to St. Louis, I texted her, asking, ‘What’s up, buttercup?’ She responded, ‘Am I your buttercup?’ I said, ‘Do you want to be?’” Melissa and Mike were married October 10, 2014, on the Outer Banks of North Carolina. For their first wedding anniversary, they decided to celebrate in central Indiana.

“We came to Columbus, and Ethnic Expo was going on,” said Melissa. “We rode bikes through Mill Race Park and down the People Trail, ate at Zaharako’s and started meeting people. We fell in love with the city.” When they started looking for a Columbus home, they gravitated to Tipton Lakes, which impressed Melissa due to her background in development. A house in Blackhawk came on the market, and they closed on it in October 2022. Melissa says they’ve bonded with several neighbors and feel at home. And Mike Smith and Brendon are good buddies. “My son thinks he’s the best,” said Melissa. So things have been breaking this family’s way for a while now. Melissa Smith is a testament to the possibility that second chapters can be sweet indeed.

Back by popular demand, the association will be hosting our Holiday Lights Contest. Participation is simple. Decorate your home in all the holiday splendor you desire, and neighborhood judges will be out in the community the third week of December to take a look. There is no sign up needed to participate. Don’t Find Yourself on Thin Ice

With winter weather approaching, ice will soon be forming on our lakes. When ice forms and repeatedly thaws, due to temperature variations, the remaining ice becomes very unsafe. In this part of the country, we seldom have sustained freezing temperatures that will form ice to a thickness that is safe to support people and animals. We kindly ask that you stay off the ice.

We Need to Know...

Do You Have Renters Living in Your Home?

The rules and regulations are designed to give guidance to many of the day-to-day functions of our association. The rules and regulations be found in Section 4: Leasing Procedures of your Green Book and states that owners are to provide a copy of the lease to the board of directors. Lease Approval Process and Requirements Prior to leasing or renewing a lease for a lot or living unit, the owner of the lot or living unit shall provide the following to the board of directors: (a) a copy of the proposed lease or lease renewal, with rental amounts omitted or redacted. (b) the name(s) of the lessee(s)/tenant(s) (c) the term of the lease or lease renewal.

Once a copy of the lease is received and approved, the renter is listed in our database and is considered a member of the association, along with the lot owner. In fact, lot owners and renters each receive one vote on all association issues. If you are an owner and an occupant, you are entitled to two votes regarding association issues. Annual meeting packets include two proxies: one vote for the owner (Class A) and one vote for the occupant (Class B).

What Does the Tipton Lakes Community Association Board Do for You? As a recognized homeowners association, our community has a board to help our HOA run smoothly. The board consists of volunteers who execute a wide variety of tasks you may not be aware of; however, their work affects every single resident. One of the most important things the board does is create and enforce the association rules. While some residents may not like being told what they can and can’t do, ultimately the board is looking out for the greater good. By enforcing the rules, the board is doing its best to keep property value up and conflicts down. Of course, the board wants to make sure the rules are beneficial for the majority—and hopefully all—residents. Another major responsibility of the board is to collect assessments from homeowners. Collecting this money is important for the stability of the association because the assessments pay for the common elements enjoyed by all residents. Assessments also help to replenish the reserve funds, which pay for any major repairs the association may need. The board is responsible for the association’s finances, and collecting assessments is how it ensures that the association remains solvent. Finally, the board acts on behalf of the association by hiring managers, attorneys, contractors, and other professionals who help better the association. Board members also help conceive and lead many of the projects that will improve the HOA. While it’s a big job, board members are happy to serve the residents and make the community a great place to call home. So why not learn more about what these volunteers do by talking to your board members, attending a board meeting, or even running for a seat on the board during our next election? The more people we have looking out for our association, the stronger it will be.
