The tips and tricks below will help keep your taps nice and shiny To keep the taps free of limescale, different cleaning methods apply for different finishes:

1. Minimum effort, maximum effect

Taps remain limescale-free for longer if they are dried with a soft cloth or towel after use Make this a habit after showering It’s a small task that has a big effect and avoids a ton of cleaning

2. Prevention is better than cure

Just like with a car, sharp objects can cause scratches on taps Taps are covered with a very high-quality finish, but just like with cars, this is vulnerable to scratching Prevent scratches by refraining from using scouring sponges or agents or microfiber cloths Also beware of scratches caused by jewellery

3. Remove limescale from your shower head nozzles

When streams of water no longer flow smoothly downwards from the shower head but instead in other directions, this means the nozzles are blocked with limescale It’s nothing serious, this limescale is easily removed by rubbing your hand over the nozzles

Follow the cleaning instructions below to prevent damage and issues, both when using and cleaning taps and showers. Damage caused by careless use or cleaning is not included in the terms of our warranty.

Plated: Chrome (CR) and Brushed nickel (GN)

Use the Hotbath sanitary cleaner for maintaining chrome or brushed nickel taps Always apply the Hotbath spray with a soft cloth or sponge, never spray directly onto the tap itself Allow the spray to work in for no longer than 1-2 minutes Rinse everything thoroughly after cleaning the taps, so that no sanitary cleaner remains on the product and wipe the taps dry after cleaning Hotbath gives a 5-year guarantee on chrome and brushed nickel when the Hotbath sanitary cleaner is used

Varnished: Matt black (BL) and Matt white (WH)

Taps in matt black and matt white have varnished fittings For this finish, use the Hotbath sanitary clear to keep the taps free of limescale To provide the taps with an extra layer of protection, wax can be applied Car wax prevents dirt and limescale from corroding the taps Dirt cannot cling to the surface so easily and there is less risk of damage to the finish

Living Colours: NB, BB, BC, AB en NI

All Hotbath Living Colours are finished without surface protection, which provides a beautiful and vibrant result This pure metal finish is coloured naturally through external influences Patina is a result of oxidation and is formed on the surface of the tap It is created through exposure to air and damp, for example, but also whenever the tap is touched by human hands The naturally formed patina on the various NB, BB, BC, and NI finishes can be polished using silver or copper polish, if necessary These finishes cannot be cleaned using a sanitary cleaning agent, but only with water and a soft cloth

Please note: The AB finish has an industrially-applied irreversibly-aged patina which cannot be polished AB can ONLY be cleaned using water and a soft cloth

Colour Plated: AI, RG en BK

Nobody wants to spend ages on their hands and knees cleaning off limescale build-up in the bathroom. Luckily, you won’t need to - follow our advice to keep your bathroom shiny and clean! The tips and tricks below will help keep your taps looking amazing. 2

IX: Stainless Steel 316

The use of the Hotbath sanitary cleaner leaves an invisible protective layer which also prevents limescale build-up on the tap Hotbath advises against the use of stainless steel cleaning agents based on alcohol, chlorine, thinner and similar, as these could cause differences in colour on the surface The use of chlorine cleaning agents can cause surface corrosion (rust)

PVD: NBP, BBP, BCP, BGP en GNP

Taps in Cobber PVD can be maintained using Hotbath sanitary cleaner Always apply the Hotbath spray with a soft cloth or sponge, never spray directly onto the tap itself Allow the spray to work in for no longer than 1-2 minutes Rinse everything thoroughly after cleaning the taps, so that no sanitary cleaner remains on the product and wipe the taps dry after cleaning Hotbath gives a 10-year guarantee on polished brass PVD when the Hotbath sanitary cleaner is used.

Hotbath does not recommend:

• Using a cleaning agent that contains hydrochloric acid, vinegar or any other aggressive acid or chlorine;

• Using an (industrial) cleaning agent that contains phosphorus;

• Mixing different cleaning agents;

• Using aggressive cleaning agents, scouring sponges and microfiber cloths;

• Using agents that contain fluoride or hydrogen peroxide;

Skin and hair care products such as shampoo, colour rinses, shower gels and liquid soap can cause damage When such products are used, taps must be thoroughly rinsed with water afterwards Using a soft cloth on taps and showers after showering/bathing keeps the products free from limescale for longer

Important advice when using a water softener

When using a water softener, you must take into consideration the adjustment as per the advice from your supplier. Improperly installed water softeners can cause irreversible damage to metal surfaces that come into contact with drying shower or bath water. This damage is easily recognised by what is known as the pineapple effect on gloss finishes or irremovable stains on brushed finishes. Hotbath fittings corroded this way are not covered by any warranty.

PVD stands for Physical Vapour Deposition and is extremely durable. This coating also ensures a perfect shine, a wear-resistant finish and excellent resistance to scratches. Finishes with a PVD coating do not discolour and keep their original shade.

Cleaning and maintenance advice

The tips and tricks below will help keep your taps nice and shiny. To keep the taps free of limescale, different cleaning methods apply for different finishes:

1. Minimum effort, maximum effect

Taps remain limescale-free for longer if they are dried with a soft cloth or towel after use. Make this a habit after showering. It’s a small task that has a big effect and avoids a ton of cleaning.

2. Prevention is better than cure

Just like with a car, sharp objects can cause scratches on taps. Taps are covered with a very high-quality finish, but just like with cars, this is vulnerable to scratching. Prevent scratches by refraining from using scouring sponges or agents or microfiber cloths. Also beware of scratches caused by jewellery.

3. Remove limescale from your shower head nozzles

When streams of water no longer flow smoothly downwards from the shower head but instead in other directions, this means the nozzles are blocked with limescale. It’s nothing serious, this limescale is easily removed by rubbing your hand over the nozzles. Follow the cleaning instructions below to prevent damage and issues, both when using and cleaning taps and showers. Damage caused by careless use or cleaning is not included in the terms of our warranty.

Plated: Chrome (CR) and Brushed nickel (GN)

Use the Hotbath sanitary cleaner for maintaining chrome or brushed nickel taps. Always apply the Hotbath spray with a soft cloth or sponge, never spray directly onto the tap itself. Allow the spray to work in for no longer than 1-2 minutes. Rinse everything thoroughly after cleaning the taps, so that no sanitary cleaner remains on the product and wipe the taps dry after cleaning. Hotbath gives a 10-year guarantee on chrome and brushed nickel when the Hotbath sanitary cleaner is used.

Varnished: Matt black (BL) and Matt white (WH)

Taps in matt black and matt white have varnished fittings. For this finish, use the Hotbath sanitary clear to keep the taps free of limescale. To provide the taps with an extra layer of protection, wax can be applied. Car wax prevents dirt and limescale from corroding the taps. Dirt cannot cling to the surface so easily and there is less risk of damage to the finish.

Living Colours: NB, BB, BC, AB and NI

All Hotbath Living Colours are finished without surface protection, which provides a beautiful and vibrant result. This pure metal finish is coloured naturally through external influences. Patina is a result of oxidation and is formed on the surface of the tap. It is created through exposure to air and damp, for example, but also whenever the tap is touched by human hands. The naturally formed patina on the various NB, BB, BC, and NI finishes can be polished using silver or copper polish, if necessary. These finishes cannot be cleaned using a sanitary cleaning agent, but only with water and a soft cloth.

Please note: The AB finish has an industrially-applied irreversibly-aged patina which cannot be polished. AB can ONLY be cleaned using water and a soft cloth.

Colour Plated: AI, RG en BK

Nobody wants to spend ages on their hands and knees cleaning off limescale build-up in the bathroom. Luckily, you won’t need tofollow our advice to keep your bathroom shiny and clean! The tips and tricks below will help keep your taps looking amazing. 2

Use the Hotbath sanitary cleaner for cleaning the taps in one of the colour-plated finishes. Always apply the Hotbath spray with a soft cloth or sponge, never spray directly onto the tap itself. Allow the spray to work in for no longer than 1-2 minutes. Rinse everything thoroughly after cleaning the taps, so that no sanitary cleaner remains on the product and wipe the taps dry after cleaning. Hotbath gives a 5-year guarantee on colour-plated finishes when the Hotbath sanitary cleaner is used

Please note: different cleaning instructions apply for the Rose gold finish. To clean the Rose gold taps, use a gentle liquid soap and not the Hotbath sanitary cleaning agent.

IX: Stainless Steel 316

The use of the Hotbath sanitary cleaner leaves an invisible protective layer which also prevents limescale build-up on the tap. Hotbath advises against the use of stainless steel cleaning agents based on alcohol, chlorine, thinner and similar, as these could cause differences in colour on the surface. The use of chlorine cleaning agents can cause surface corrosion (rust).

PVD: NBP, BBP, BCP, BGP en GNP

Taps in Cobber PVD can be maintained using Hotbath sanitary cleaner. Always apply the Hotbath spray with a soft cloth or sponge, never spray directly onto the tap itself. Allow the spray to work in for no longer than 1-2 minutes. Rinse everything thoroughly after cleaning the taps, so that no sanitary cleaner remains on the product and wipe the taps dry after cleaning. Hotbath gives a 10-year guarantee on polished brass PVD when the Hotbath sanitary cleaner is used.

Hotbath does not recommend:

• Using a cleaning agent that contains hydrochloric acid, vinegar or any other aggressive acid or chlorine;

• Using an (industrial) cleaning agent that contains phosphorus;

• Mixing different cleaning agents;

• Using aggressive cleaning agents, scouring sponges and microfiber cloths;

• Using agents that contain fluoride or hydrogen peroxide;

Skin and hair care products such as shampoo, colour rinses, shower gels and liquid soap can cause damage. When such products are used, taps must be thoroughly rinsed with water afterwards. Using a soft cloth on taps and showers after showering/bathing keeps the products free from limescale for longer.

Important advice when using a water softener

When using a water softener, you must take into consideration the adjustment as per the advice from your supplier. Improperly installed water softeners can cause irreversible damage to metal surfaces that come into contact with drying shower or bath water. This damage is easily recognised by what is known as the pineapple effect on gloss finishes or irremovable stains on brushed finishes. Hotbath fittings corroded this way are not covered by any warranty.

Overhead showers with LED

The 12-volt LED lighting is unique, with one LED per nozzle, creating a light effect with every shower jet. The wireless surface-mounted remote control allows you to adjust the nine standard colours as standard or intensive. There is also a choice between a ‘relaxing’ or an ‘exciting’ chromotherapy program. Cleaning and maintenance advice

The tips and tricks below will help keep your taps nice and shiny. To keep the taps free of limescale, different cleaning methods apply for different finishes:

1. Minimum effort, maximum effect

Taps remain limescale-free for longer if they are dried with a soft cloth or towel after use. Make this a habit after showering. It’s a small task that has a big effect and avoids a ton of cleaning.

2. Prevention is better than cure

Just like with a car, sharp objects can cause scratches on taps. Taps are covered with a very high-quality finish, but just like with cars, this is vulnerable to scratching. Prevent scratches by refraining from using scouring sponges or agents or microfiber cloths. Also beware of scratches caused by jewellery.

3. Remove limescale from your shower head nozzles

When streams of water no longer flow smoothly downwards from the shower head but instead in other directions, this means the nozzles are blocked with limescale. It’s nothing serious, this limescale is easily removed by rubbing your hand over the nozzles.

Follow the cleaning instructions below to prevent damage and issues, both when using and cleaning taps and showers. Damage caused by careless use or cleaning is not included in the terms of our warranty.

Plated: Chrome (CR) and Brushed nickel (GN)

Use the Hotbath sanitary cleaner for maintaining chrome or brushed nickel taps. Always apply the Hotbath spray with a soft cloth or sponge, never spray directly onto the tap itself. Allow the spray to work in for no longer than 1-2 minutes. Rinse everything thoroughly after cleaning the taps, so that no sanitary cleaner remains on the product and wipe the taps dry after cleaning. Hotbath gives a 5-year guarantee on chrome and brushed nickel when the Hotbath sanitary cleaner is used.

Varnished: Matt black (BL) and Matt white (WH)

Taps in matt black and matt white have varnished fittings. For this finish, use the Hotbath sanitary clear to keep the taps free of limescale. To provide the taps with an extra layer of protection, wax can be applied. Car wax prevents dirt and limescale from corroding the taps. Dirt cannot cling to the surface so easily and there is less risk of damage to the finish.

Living Colours: NB, BB, BC, AB and NI

All Hotbath Living Colours are finished without surface protection, which provides a beautiful and vibrant result. This pure metal finish is coloured naturally through external influences. Patina is a result of oxidation and is formed on the surface of the tap. It is created through exposure to air and damp, for example, but also whenever the tap is touched by human hands. The naturally formed patina on the various NB, BB, BC, and NI finishes can be polished using silver or copper polish, if necessary. These finishes cannot be cleaned using a sanitary cleaning agent, but only with water and a soft cloth.

Please note: The AB finish has an industrially-applied irreversibly-aged patina which cannot be polished. AB can ONLY be cleaned using water and a soft cloth.

Colour Plated: AI, RG and BK

Nobody wants to spend ages on their hands and knees cleaning off limescale build-up in the bathroom. Luckily, you won’t need to - follow our advice to keep your bathroom shiny and clean! The tips and tricks below will help keep your taps looking amazing. 2

Use the Hotbath sanitary cleaner for cleaning the taps in one of the colour-plated finishes. Always apply the Hotbath spray with a soft cloth or sponge, never spray directly onto the tap itself. Allow the spray to work in for no longer than 1-2 minutes. Rinse everything thoroughly after cleaning the taps, so that no sanitary cleaner remains on the product and wipe the taps dry after cleaning. Hotbath gives a 5-year guarantee on colour-plated finishes when the Hotbath sanitary cleaner is used

Please note: different cleaning instructions apply for the Rose gold finish. To clean the Rose gold taps, use a gentle liquid soap and not the Hotbath sanitary cleaning agent.

IX: Stainless Steel 316

The use of the Hotbath sanitary cleaner leaves an invisible protective layer which also prevents limescale build-up on the tap. Hotbath advises against the use of stainless steel cleaning agents based on alcohol, chlorine, thinner and similar, as these could cause differences in colour on the surface. The use of chlorine cleaning agents can cause surface corrosion (rust).

PVD: NBP, BBP, BCP, BGP and GNP

Taps in Cobber PVD can be maintained using Hotbath sanitary cleaner. Always apply the Hotbath spray with a soft cloth or sponge, never spray directly onto the tap itself. Allow the spray to work in for no longer than 1-2 minutes. Rinse everything thoroughly after cleaning the taps, so that no sanitary cleaner remains on the product and wipe the taps dry after cleaning.

Hotbath gives a 10-year guarantee on polished brass PVD when the Hotbath sanitary cleaner is used.

Hotbath does not recommend:

• Using a cleaning agent that contains hydrochloric acid, vinegar or any other aggressive acid or chlorine;

• Using an (industrial) cleaning agent that contains phosphorus;

• Mixing different cleaning agents;

• Using aggressive cleaning agents, scouring sponges and microfiber cloths;

• Using agents that contain fluoride or hydrogen peroxide;

Skin and hair care products such as shampoo, colour rinses, shower gels and liquid soap can cause damage. When such products are used, taps must be thoroughly rinsed with water afterwards. Using a soft cloth on taps and showers after showering/bathing keeps the products free from limescale for longer.

Important advice when using a water softener

When using a water softener, you must take into consideration the adjustment as per the advice from your supplier. Improperly installed water softeners can cause irreversible damage to metal surfaces that come into contact with drying shower or bath water. This damage is easily recognised by what is known as the pineapple effect on gloss finishes or irremovable stains on brushed finishes. Hotbath fittings corroded this way are not covered by any warranty.

A warranty period of 60 (sixty) months applies to Hotbath products, with the exception of electronic components of Products, which carry a warranty of 24 (twenty-four) months. If a legally valid claim is made under the warranty, the correction of defects is usually free of charge. The warranty provided by Hotbath is in accordance with the Hotbath Warranty Conditions, which can be consulted here.

Repairs Not Covered by the Warranty

For repairs to Products not covered by the warranty, the Client will be charged call-out charges, labour costs and the costs of any materials. Repairs are not covered by the warranty if the relevant warranty period has expired or if no legally valid claim can be made under the warranty pursuant to article 4 of the Warranty Conditions.

The rates for repairs not covered by the warranty are: Call-out charge: € 8 0,- (incl. VAT)

Labour: € 20,- (incl. VAT) for every fifteen minutes Service calls by a technician are offered only in the Netherlands, with the exclusion of the West Frisian Islands [Waddeneilanden].

If the Client decides against the repair less than 24 hours in advance or does not agree to the (initial or revised) cost estimate in accordance with article 11 of the Conditions of Service, or if the Client rejects a repair request in accordance with article 8 of the Conditions of Service, Hotbath will charge the Client only the call-out charge.

WARRANTY CONDITIONS

1.Definitions

Manufacturing Defects: defects to the products established by Hotbath and/or its suppliers. Hotbath: Hot Bath B.V., registered with the Chamber of Commerce in Den Haag, [The Hague, the Netherlands] under number 27 28 30 30. Products: all Hotbath products sold in the Netherlands and Belgium. 2.Applicability

Hotbath offers a warranty on the Products in accordance with these Warranty Conditions. The service provided by Hotbath under these Warranty Conditions is subject to the Conditions of Service, which can be consulted here.

3.Warranty Period

The warranty period for Hotbath Products is 60 (sixty) months after purchase of the Product, unless specifically stated otherwise in the Catalogue. An exception to this period applies to electronic components of Products, which carry a 24 (twenty-four) month warranty. Products with a BL or WH finish come with a 60 (sixty) month warranty on the finish.

4.Warranty

All defects to Products which can demonstrably be traced back to a Manufacturing Defect and arise within the relevant warranty period stated in article 3, will be corrected by Hotbath free of charge, subject to the conditions below, provided Hotbath is notified of the defect immediately after its discovery (the “ Warranty ”)

A. T he correction of defects is done in such a way that any defective parts are either repaired or replaced by new parts, at Hotbath’s discretion. If a repair or replacement is not possible, Hotbath will refund the amount actually paid for the Product. The assessment of whether a Product is defective will be based on the technical standard applicable on the manufacturing date.

B. If a defect cannot be resolved by Hotbath within a reasonable period or the repair is unreasonably delayed, Hotbath will, if so requested, provide the required replacement parts free of charge. If the product is not/no longer available, this product will be replaced by an item of the same value. When providing a replacement Product, Hotbath reserves the right to charge a reasonable usage fee for the use [of the Product] up to that point.

C. If a valid claim is made under the warranty, Hotbath will not charge any costs in the first year after delivery of the Product. From the second to the fifth year after delivery of the Product, Hotbath will charge only the call-out charge as stated on the Website.

D. O ur warranty does not cover:

• Damage caused intentionally;

• Damage resulting from carelessness, inadequate and/or negligent maintenance, improper use of anti-limescale products and/or anti-scaling systems, and/or contact with substances which the Products cannot withstand.

• Damage resulting from disregard for the instructions for fitting, installation, assembly, use and/or maintenance applicable during assembly;

• Damage or failures caused by the chemical and electrochemical effect of water, the effect of limescale and/or dirt;

• Damage resulting from external influences which negatively affect the installation or configuration (e.g. too high or negative water pressure, water shock) or damage caused by not following the installation instructions provided by Hotbath;

• Damage to materials which are subject to wear and tear, such as filters, check valves, rubber seals, gliders and shower hoses;

• Slight deviations in so far as these have no substantially negative effect on the appearance and functionality of the Products, including scratches to the surface;

• A ny form of transport damage;

• Products purchased by the end user as showroom models

E. A claim under the warranty will lapse:

• If a correction or repair is carried out by persons not authorised by Hotbath;

• If the Products are fitted with any parts, additions or fittings other than original parts.

F. T he removed and defective parts/Products must be returned, carriage paid, to Hotbath at the address stated on the website, with an accompanying letter.

G. Replaced parts will become the property of Hotbath

5.Claim under the Warranty

In order to make a claim under the warranty, the original invoice or receipt for the the relevant Product, with the purchase date clearly legible, must be submitted to Hotbath. The warranty period stated in article 3 will not be renewed or extended as a result of a repair or supply of [replacement] parts.

6.Consumer

For consumers, these warranty conditions do not affect the statutory warranty rights, including the right to free repair or replacement.

Hotbath General Terms and Conditions of Sale and Delivery

1. Definitions Delivery Address: the Client’s standard delivery address recorded by Hotbath. Payment Term: the payment term agreed between the parties, or in the absence thereof the term specified on the invoice sent to the Client by Hotbath. Manufacturing Defects: defects to the products established by Hotbath and/or its suppliers. Warranty Period: t he warranty period as referred to in article 8 (‘Warranty and Liability’). Hotbath: Hot Bath B.V., registered with the Chamber of Commerce in Den Haag, [The Hague, the Netherlands] under number 27 28 30 30. Client: Hotbath’s counterparty Agreement: the (delivery or other) agreement between Hotbath and the Client. Terms and Conditions: these Hotbath General Terms and Conditions of Sale and Delivery

2. Applicability

These Terms and Conditions apply to all offers, quotations, orders, agreements and assignments, offered by Hotbath, or concluded between the Client and Hotbath, either orally, in writing, or electronically. The applicability of provisions and/or terms and conditions of the Client is explicitly e xcluded. Any deviations to these Terms and Conditions can be invoked only if those deviations have been agreed in writing.

3. Acceptance

Agreements will be binding on Hotbath only if they have been confirmed or accepted by Hotbath in writing. Hotbath is entitled to accept placed orders only in part and/ or invoice separately. Hotbath is furthermore entitled to require the price, an advance, or security from the Client before making the delivery or performing the agreement.

4. Prices

Hotbath verkoopt en levert de producten aan Opdrachtgever tegen de op het moment van de bestelling geldende b ruto adviesprijzen, verminderd met de overeengekomen korting en met inachtneming van eventuele andere overeengekomen condities. Offertes, aanbiedingen en prijzen zijn steeds geheel vrijblijvend en exclusief omzetbelasting, tenzij anders vermeld. Kennelijke vergissingen of administratieve fouten kunnen te allen tijde door Hotbath worden h ersteld. Samengestelde prijsopgaven gelden slechts bij afname van de totale offerte. Prijswijzigingen zijn voorbehouden. Van overheidswege opgelegde verhogingen van b elastingen en heffingen, die van kracht worden tussen het tijdstip van de totstandkoming van de Overeenkomst en de levering van de producten, zijn voor rekening van Opdrachtgever en moeten door Opdrachtgever aan Hotbath worden vergoed.

5. Delivery

Images, dimensions, weights and other specifications found in catalogues, price lists, online content and adverts are intended only to give a general impression of Hotbath’s designs or products. Slight and non-essential deviations, or products not being in stock, do not constitute a failure in the performance of the Agreement. Delivery dates are only an indication, unless the Agreement expressly states otherwise. Delivery by Hotbath will be made exclusively to the D elivery Address. The Client must notify Hotbath promptly of any changes to the Delivery Address. Hotbath will offer the delivery at the Delivery Address on the ground floor behind the first door, unless agreed otherwise. Hotbath will charge the Client additional costs for d elivery to any address other than the Delivery Address. Any additional costs resulting from repeated attempts to deliver at the Delivery Address or an attempt to deliver at an incorrect address provided by the Client, are to be borne by the Client. No claims may be made for late delivery resulting from this. Before accepting the delivery, the Client must check if the delivered products are in accordance with the accompanying delivery document supplied by Hotbath and are undamaged.

Any complaints relating to a delivery must be sent to Hotbath in writing by the Client within a complaint period of n o more than 5 (five) calendar days commencing on the delivery date as stated on the accompanying delivery document supplied by Hotbath. If the delivery has a total invoice v alue, not including turnover tax, below or equal to the minimum agreed between the parties, Hotbath will charge the Client for the transport and insurance costs. In the absence of an agreed minimum, this is set at €150 exclusive of turnover tax.

6. Force Majeure

If Hotbath is unable to meet its obligations due to Force Majeure, its obligations will be suspended by operation of law for the duration of the Force Majeure situation. If such a Force Majeure situation has lasted for 6 (six) months, the parties are entitled to terminate the Agreement in whole or in part, in which case Hotbath will be entitled to reimbursement of the costs it has incurred for the part to be terminated. Force Majeure includes in any case: war, mobilisation, epidemics, pandemics, riots, industrial action, industrial disputes, excessive sickness absence of Hotbath personnel, fire, storm damage, danger of war, special weather conditions, floods, natural disasters, explosions, power cuts, lock-outs, business interruptions, machinery breakdowns, problems with and/or serious disruptions of the production processes of suppliers, including utility companies, f ailure by third parties to supply necessary materials, wilful misconduct or gross negligence of auxiliary persons, large-scale production problems, transport problems, traffic congestion, transport delays and government measures, both at a national and international level (including import and export barriers), at Hotbath and/or its suppliers.

7. Payments

Payments must be received by Hotbath within the Payment Term. The Client’s right to claim suspension or set-off is expressly excluded. Failure to pay in full within the Payment Term will mean that the Client is in default, without any notice of default being required. The Client owes statutory commercial interest on all amounts not paid within the Payment Term, commencing on the first day after expiry of the applicable Payment Term and calculated until the date of payment in full. All payments are first deducted from the outstanding costs, the interest owed, and subsequently from the oldest outstanding invoices.

8. Warranty and Liability

All products delivered to the Client by Hotbath are subject to a warranty period of 60 (sixty) months. An exception to the above applies to products or components of products containing electronics, which are subject to a warranty period of 24 (twenty-four) months. A warranty period of 120 (one hundred and twenty) months applies to specific products, specified in the warranty conditions. The Warranty Period commences on the invoice date as stated on t he invoice from Hotbath to the Client. During the Warranty Period, any Manufacturing Defects will be repaired o r or replaced by Hotbath, at Hotbath’s discretion. If repair or replacement is not possible, Hotbath will refund the amount actually paid by the Client. Contrary to the above, products at new value [nieuwwaardige producten] only qualify for repair, replacement or refund if and as long as they are still part of the Hotbath stock range. For products at new value, Hotbath will pay the Client a refund not exceeding the amount actually paid by the Client, less the processing costs incurred by Hotbath as specified on the Hotbath website. Defects to products resulting from incorrect assembly, fitting, use or maintenance by the Client or third parties, or from external causes, are excluded from the warranty. Wear and tear resulting from normal use or the need to replace components during a routine inspection are also excluded from t he warranty. Hotbath excludes all warranties other than those stated above and, in particular, does not guarantee that the products are suitable for the purpose intended by the Client: the products are sold ‘as is’. Hotbath excludes all liability for damage or loss resulting from non-conformity or the failure to meet the agreed delivery dates or for damage or loss otherwise suffered by the Client as a result of or in connection with the performance of the Agreement. This warranty applies exclusively to the Client and cannot be transferred to third parties. Hotbath cannot be held responsible in any way for content provided by the Client in any form whatsoever.

9.

Complaints

Any complaints will lapse unless they are communicated in writing to Hotbath within 30 (thirty) calendar days commencing on the invoice date (as stated on the invoice) of t he relevant agreement or within 30 (thirty) calendar days after the problem arose.

The Client and third parties are obliged to take measures to prevent or limit any damage to products during receipt, packaging, storage, transport, installation, use and maintenance.

10 . Returns

If the Client believes a claim may be made under the warranty as referred to in article 8 (“Warranty and Liability”), t he Client will inform Hotbath thereof in writing before returning the products, stating the product specifications, the goods returned and the reason for the return. Products may be returned only if Hotbath has agreed to this in writing. The Client must ensure that the returns are packaged appropriately for the specific shipment method, are addressed and have the accompanying documents. The Client will not be compensated for returns with transit damage resulting from insufficient, unsound or absent packaging or transport. Such products will be sent back at the Client’s expense. If Hotbath, after inspecting the product, has established that the Client’s claim under the warranty is justified, Hotbath will bear the reasonable and necessary transport costs incurred. In all other cases, the transport costs for returning the products to Hotbath and then sending them back to the Client are to be borne by the Client.

11. Termination

In the event of failure to pay any amount due in time, deferment of payment, suspension of payments [surseance] or a request for this, the death of the Client, bankruptcy of the Client, or if the Client’s business is liquidated in whole or in part, Hotbath will be entitled to terminate the Agreement, or the part thereof not yet performed, without being obliged to pay any compensation in this respect. In that case, Hotbath’s claims against the Client will be immediately due and payable, without any demand or notice of default being required.

12. Ownership and Right of Retention

All products sold by Hotbath will remain the property of Hotbath until the payment for them, plus any interest and costs owed, is made in full. The Client is prohibited from renting, pledging, creating security interests on, or otherwise encumbering or disposing of unpaid Hotbath products and/or products owned by Hotbath. Hotbath always has the right right to claim back unpaid goods as referred to in Article 7:39 et seq. of the Dutch Civil Code [BW]. The Client is obliged to point out to anyone wishing to exercise any right in respect of such products present at the Client’s [premises] (in particular by attachment) that these products are the property of Hotbath, and to notify Hotbath immediately of such attachment.

A ll content made available by Hotbath are protected by copyright. This content may be used only with Hotbath’s consent and provided the source is acknowledged.

13. Costs

All costs for legal assistance incurred by Hotbath in connection with a dispute between Hotbath and the Client are to be borne by the Client. This also applies in the event of non-payment by the Client. The extrajudicial costs owed will then amount to 15% (fifteen percent) of the invoice amount on the first €2,270 (two thousand two hundred and seventy euros) and 10% (ten percent) on the part exceeding that, plus turnover tax. The minimum amount owed for extrajudicial costs is set at €150 (one hundred and fifty euros) exclusive of turnover tax.

14. Conversion

If any of the provisions in these Terms and Conditions are void, voidable or non-binding, this will not affect the validity of the remaining provisions. If one or more provisions are/become void, voidable or non-binding, it/these will be replaced by a valid provision which is as close as possible to the content and purport of the provision proven void, voidable or non-binding.

15. Changes in Terms and Conditions

Hotbath has the right to make changes or additions to these Terms and Conditions. Changes and additions to these Terms and Conditions will come into force 30 (thirty) days after their publication.

16. Disputes

The Agreement and other juridical relationships between Hotbath and the Client are exclusively subject to Dutch law. The Vienna Sales Convention of 1980 does not apply. All disputes will be heard in the first instance by the competent court in Den Haag, [The Hague, the Netherlands], with the proviso that Hotbath is also entitled to submit any disputes to the court which has jurisdiction to hear this dispute under the regular statutory provisions.
