My concern is that many uninformed workers assume there is no benefit to filing their IRS Form 1040 this year (or any year) because no federal income tax is due. Many individuals do not know about the EITC (Earned Income Tax Credit) provisions of the federal IRS Income Tax Code. Many income tax businesses do not encourage working-class clients because ‘there is no profit in those low-income tax preparation services.... so why should we bother?’

The outcome may be that many never receive an EITC rebate check they lawfully merit. In my estimation, any wage earner whose income is less than $50,000 per

year needs to look into the possibility that they qualify for EITC rebates in addition to the return of federal income taxes already paid to the IRS. Those earning less than $50,000 during 2014 need to go to the following two websites: <www.irs.gov/ credit> and <www.earned income tax credit.IRS> to learn if you qualify for EITC rebates.

Recently the Rotary Club of San Jose had a speaker from Mobile, Alabama who described its community’s program which provided IRS Form 1040 submittal assistance to its low-income population. In all cases income tax submittals were checked out to determine if qualified for an EITC rebate. Many of those workers received a ‘check’ for their efforts. This 1996 program was designed and put into the IRS tax code to distribute EITC funding to low income areas of this nation. Like many such programs, the IRS did not

Since 1996 this IRS-EITC program has not reduced the number or percentage of those in poverty, it just moved them from being unemployed and impoverished to being employed and impoverished. These developments are indications that the American working class is fed up with current disparate wealth distribution patterns supported by current public policy and tax codes.

Here in Silicon Valley, where the income disparity is very visible, those with modest incomes would do well to take advantage of the current IRS-EITC provisions. A new scam targeting immigrants has gotten the attention of Uncle Sam. Health advocates are concerned that tax preparers have been misinforming, and some even outright scamming, Deferred Action for Childhood Arrivals (DACA) beneficiaries by making them pay a penalty for not having health insurance.

On Wednesday, the Internal Revenue Service (IRS) released a statement clarifying that there is no such penalty for undocumented immigrants or for DACA recipients. DACA is a program announced by President Obama in 2012 that gives temporary protection against deportation to undocumented immigrants who came to this country as children.

“Advocates have been asking [the Obama administration] for a month to provide [tax preparers] some clarity,” said Angel Padilla, a health policy analyst at the Washington, D.C. office of the

National Immigration Law Center. Up until now, he said, “there was not something official we [had that we] could point to from IRS that makes this clear. Now we do.”

The IRS website now reflects the clarity that advocates have been pressuring it to spell out: Individuals who are not U.S. citizens or nationals and are not lawfully present in the United States are exempt from the individual shared responsibility provision. For this purpose, an immigrant with Deferred Action for Childhood Arrivals (DACA) status is considered not lawfully present and therefore is eligible for this exemption. An individual may qualify for this exemption even if he or she has a social security number (SSN).

The confusion arises from a policy under the Affordable Care Act (ACA) that requires nearly all Americans to have some form of health insurance, or face a penalty. That coverage could come from job-based insurance; an individual health plan bought through government-run health care exchanges or elsewhere; Medicaid (known as Medi-Cal in California), a government-funded health insurance program for lowincome people; or Medicare, a health insurance program for those who are over 65 or have a disability.

For 2014, the first year the policy went into effect, the penalty for failing to get such coverage was $95 per adult and $47.50 per child, or 1 percent of taxable household income, whichever was greater. The penalty will increase in subsequent years.

But the requirement to have health insurance does not extend to undocumented immigrants or DACA beneficiaries. That’s because they are not lawful residents. DACA is only a benefit eligibility category, not an immigration status.

It is a distinction that neither the Department of Health and Human Services nor the Internal Revenue Service made clear on their websites until now, Padilla said.

She said one tax preparer asked a DACA client to pay her the penalty directly and in cash, rather than asking the IRS to deduct it from his refund.

“I’m sure some preparers are doing this to undocumented people as well,” Ordaz said.

Los Angeles resident and DACA beneficiary Ana Alcantara, 22, says her tax preparer told her she had to pay the penalty when he discovered she didn’t have health insurance. She reluctantly agreed to have the $95 deducted from her nearly $850 tax refund.

Meanwhile, tax preparers themselves say they don’t always know if their client is a DACA recipient. One tax preparer acknowledged that she had filed tax returns for a number of clients that included the penalty because they had failed to tell her that they were DACA beneficiaries.

Alcantara didn’t know she was exempt from the requirement. She also didn’t know

co-owner of Gonzales Tax Services in Madera, Calif. She said she had assumed they were lawful residents when they told her they had a work permit and social security number.

Since she became aware that her clients were DACA recipients -- and were exempt from the penalty -- Lopez says she has been filing amended tax returns. Alcantara’s tax preparer also has agreed to file an amendment so Alcantara can get her $95 back.

While cake bakes, tint 4 ounces fondant green (formula 353 [1 Y + 1 B]) and tint icing with Color Right base colors QuickCount color formulas: 2cups Blue (formula 7692 [50 B + 8 R + 8 P]) 1cup Green (formula 353 [1 Y + 1 B]) Roll out white fondant 1/16 inch thick; spray with gold food color spray. Let set, about 15 minutes. Use narrow end of tip 7 to cut approximately 140 circles. Set aside confetti and reserve remaining fondant.

Ice cake smooth with blue icing. Pipe tip 4 message and arrow onto cake top; position confetti circles on corners.

For tassel, roll out green fondant 1/16 inch thick. Cut a strip 6-inches long by 4 inches wide; cut slits 1/8 inches wide, leaving 3/4 inch uncut at top of strip. Roll up strip. Using electric mixer, mix at medium speed for 1-2 minutes, until smooth. Add pudding mix, lemon zest and lemon juice; mix until well blended.

Spoon about half of pie filling evenly into bottom of graham cracker crust. Spoon lemon-filling mixture on top and spread evenly. Cover and chill for at least 1 hour.

Spoon remaining pie filling on top just before serving. Garnish with fresh lemon zest if desired.

Chris Thomas SACRAMENTO, Calif. More than half of the online job postings in California are for positions that require at least a four-year college degree - and a new report says it matters a lot what type of degree.

Georgetown University’s Center on Education and the Workforce analyzed online job ads by state to see which career fields are the most promising and says onethird of California job postings are for managerial and professional occupations.

director, describes California as a “new economy” state that is showing a solid recovery from the recession.

“It has a mix of college-level jobs that include the technical, but also include a whole set of jobs which we’ve come to call business services,” he says. “Managerial and professional skills are required in the production of any kind of goods or service nowadays.”

Carnevale says the most California college-level job listings are for software and application developers, wholesale and manufacturing positions, and sales reps.

He explains today, many salespeople are expected to be experts on the medical or

technical products they sell, so degrees often are required.

According to the report, the fastest-growing industry sector for California college grads is leisure and hospitality services, growing 30 percent in the last few years.

Carnevale says that doesn’t mean waiting tables and washing dishes, it means managing restaurants, hotels and recreational facilities.

“It’s been a big growth area for a very long time,” says Carnevale. “What is distinctive about it is that it is very cyclical - it is one of the ones that goes down hard, and comes back fast as the economy recovers.”

He says the report underscores the need to go to college to get a good job, but what may be different now than in past decades is, it isn’t enough to simply get a degree. It has to be relevant to the field of work.

“The texture of what employers are looking for is changing, in the sense that they’re much more focused on specialization and degree specialization,” Carnevale says. “They care what you majored in in college, as much as they care whether or not you went.”

Jobs in engineering and health-care fields figured prominently in online ads across the country.

La cifra duplica el número de solicitudes proyectadas SACRAMENTO El Departamento de Vehículos Motorizados de California (DMV) anunció hoy que casi medio-millón de californianos ha solicitado una licencia bajo la ley AB 60, la cual entró en efecto el 2 de enero de 2015. Este número indica el doble de las solicitudes que el DMV había proyectado recibir en este momento durante el año.

“El interés en este programa es mucho más grande de lo que se había anticipado”, dijo la Directora del DMV Jean Shiomoto.

“Proyectamos recibir 500,000 solicitudes para julio del 2015, pero han llegado ya a ese nivel y estamos en camino de llegar al doble del número esperado de solicitudes. Le agradezco a cada solicitante que ha estado trabajando con nosotros para lograr que California sea

Paul Pinza is associate principal of William C. Overfelt High School in San Jose, where some 42 percent of students are English language learners. He says it isn’t always clear what accommodation might be most useful for ELL students.

Veronica T. Avendaño EL OBSERVADOR SAN JOSE, Calif. – The new Common Core assessments being rolled out across California are a significant step up in terms of rigor. The computer-based exam leaves the pencil and paper California Standardized Test (CST) behind for a more demanding assessment requiring greater mastery of concepts and proficiency with language.

For the state’s English Language Learner (ELL) population that represents a major challenge.

Angelica Ramsey is the chief academic officer for Santa Clara County Office of Education, which oversees some 32 school districts across the county. “Two years ago, the concern was around ensuring that our students … had access to the technology they needed to be familiar with for the testing,” she says.

But with students receiving lab time and more exposure to tech, she says the concern has shifted now to “ensuring that ELL students and students with disabilities are prepared for the tests and that they have the accommodations they need” come test day.

The testing window opened March 10 and runs through April for students in third through eighth grades and high school juniors. Students

who have been enrolled in the American school system for less than a calendar year are exempt from the test.

ELL students make up roughly 23 percent of all public school students enrolled in Santa Clara County.

They account for about a quarter of all public school students in California.

“We need to make sure that whatever is available to students on the day of testing, they’re familiar with,” Ramsey explained.

The assessments, designed by the California-based Smarter Balanced Assessment Consortium (SBAC), are computer adapted, meaning the level of complexity adjusts based on whether or not students give the correct answer. Students will be expected to provide answers to test questions as well as explain their reasoning in writing.

The eight-hour exam will be given over the course of several days. The results will be used to measure student progress in English Language Arts and math under the new Common Core standards. Districts will send out report cards in multiple languages to parents once testing is complete showing where their children scored.

Experts do anticipate a drop in scores for most students given the more challenging nature of the test.

“There are many different factors in taking the assessment that can cause lower performance for [ELL students], not because of a lack of content knowledge but because of the type of language on the assessment,” said Jamal Abedi, professor of measurement, assessment, and testing at the University of California Davis.

Much of Abedi’s work focuses on educational assessments for EL students. In 2013 he co-authored a study for the Smarter Balanced consortium looking at how the tests could be designed to better accommodate EL and disabled students. <http:// www.smarterbalanced.org/ wordpress/wp-content/uploads/2012/08/Accomodations-for-under-represented-students.pdf>; “One of the major features of the SBAC is that it tries to make assessments more accessible to all subgroups of students,” said Abedi.

The accommodations highlighted in the study range from reading questions aloud and in the native language of the student, to providing smaller group settings and more time during the test, and even dual language translations of the exam. Accommodations are also evaluated on whether or not they risk skewing the results.

Translations of test questions, for example, “double the reading load required to take the test,” he explains, adding that a built-in glossary tool “requires a student to look up an individual word each time.”

Pinza says all juniors at Overfelt will be excused from all classes during our testing days. “We want them to focus all their mental energy on the test as well as give them the freedom to work at a comfortable pace.”

In March students at Overfelt took part in a mock trial of the SBAC test. The purpose was in part to help familiarize them with the computerized format and the tools available to them.

“It was a bit challenging at first to get used to the format,” said freshmen Maria Vargas, who attends William C. Overfelt High School in San Jose. “When you didn’t know the answer, it was difficult to choose and move on through the test.”

Previous multiple-choice tests allowed students to guess at questions they did not know the answer to. On the SBAC students must provide an answer before moving on to the next question.

Junior Jazmin Martinez said she had difficulty with the math portion of the exam. “Drawing everything

on the computer was surprising,” she said, noting she had to graph out problems on the screen using a stylus.

For Ramsey, more important than figuring out how to accommodate ELL students during the test is learning to use the data from the test to teaching practice in the class.

“It’s really tough to say right now what we’re going to learn,” she says, “[but] it’s really important that teachers, parents and students are taught to look at the data and how it can really assist in instruction.”

En parte a la afiliación con el museo Smithsonian (uno de los museos mas importantes del mundo) el museo Mexicano es y será gratuito, y es eso es uno de los grandes logros del equipo que incluye Gómez. “Eso permite que nuestros programas culturales sean muy amplios y muy ricos. Entonces es también otro orgullo. Estamos muy contentos de eso.”

Estephany Haro EL OBSERVADOR “Hoy le recordamos al resto de la nación, que california es diferente…servimos como un modelo para el país” Congresistas de California lanzaron un nuevo proyecto de leyes, los cuales beneficiaran a los inmigrantes indocumentados en California.

Estas leyes son una respuesta a los republicanos y gobierno federal, ya que no fueron capaces de crear una reforma migratoria que daría alivio a más de 11 millones de indocumentados, dijo el presidente de la cámara del senado en California.

Senadores y congresistas de California, se reunieron el 7 de abril en Sacramento para dar a conocer estas 10 propuestas de leyes. Donde enfatizaron la importancia de los inmigrantes para la economía de California.

“La forma en que tratamos a los inmigrantes reflejará el compromiso de los valores que tengamos como Americanos,” dijo el presidente del senado, Kevin de León, quien aseguró que estas nuevas leyes impactaran positi-

vamente a millones de californianos.

“Los inmigrantes le dan forma a California,” el senador recalcó el logro de las licencias de conducir para indocumentados y la reciente ley SB 1159, la cual permite a personas aplicar para licencias profesionales con su número de ITIN. La ayuda para los estudiantes indocumentados en California, conocidos como los “dreamers”, también fue recalcada por el senador, quien subrayó la importancia de la ayuda financiera para los estudiantes “dreamers”.

Sin embargo, de León dejó claro que la lucha no ha sido fácil y que falta mucho por hacer.

“A que le tenemos miedo a abrir nuestros brazos a estas personas que ya viven entre nosotros,” dijo de León.

“Al forzar a los inmigrantes indocumentados a vivir y trabajar en las sombras… todos perdemos, perdemos salarios, salarios justos, perdemos ingresos, perdemos innovación, perdemos justicia, y lo más importante, perdemos nuestra identidad como californianos, como Americanos.”

El proyecto de leyes es un esfuerzo del senado y la asamblea, para todos los inmigrantes indocumentados, incluyendo a asiáticos e inmigrantes del caribe. Ya que también forman parte de la población indocumentada de California. “respetamos a los inmigrantes y reconocemos las contribuciones económicas que han hecho a california” dijo de León.

El paquete de estas leyes incluye: Ley SB 4, propone cobertura medical para todos los inmigrantes indocumentados.

Ley SB 600, extiende los derechos civiles, al proteger a los inmigrantes indocumentados de la discriminación por parte de sus empleadores por su estatus migratorio.

Ley SB 674, asegura ayuda y asistencia para las personas víctimas de crímenes para aplicar a visas especiales del gobierno federal.

Ley SB 1343, protege a inmigrantes de ser deportados por el gobierno federal.

On Tuesday, April 7, 2015, a special election was conducted by the Registrar of Voters (ROV), County of Santa Clara. That election had only one purpose: to elect the successor to Kansen Chu, former elected representative of District 4 (Berryessa and Alviso Districts). Out of a total of 40,476, only 8,376 (20.69%) of all registered District 4 ballots have been counted up to this point. These results will change a little since about 1,400 Vote-by-Mail and 180 provisional ballots remain to be tallied. In addition, the ROV Director Shannon Buchey is required to count those Vote-by-Mail ballots which are post-marked on or before Friday, April 10th (Election Day plus three days is the new legal standard).

At this point, a Latino named Tim Orozco has the most votes at 1,855 (22.15%).

One of two Asian-Americans will be his opponent in the run-off election to be held next. Candidate Mann Nguyen has 1,599 votes (18.99%) and Candidate Lan Diep has 1,584 (18.91%). Between now and Friday, April 10, 2015 the top two candidates will be determined and participate in the scheduled run-off election which follows. Per existing voting law, the top two

candidates will compete to determine which is favored by San Jose City District 4 voting electorate.

As estimated by ROV staff, this special election experienced a low voter participation (9.956 ballots cast from a total of 40,476 registered voters (about 25%). The final data will be tallied by Friday, April 10th, and may be viewed thereafter at <www. sccvote.org>.

Exposure to BPA, PCBs and other contaminants not just an issue for women.

Roddy Scheer and Doug Moss EARTHTALK Indeed, women aren’t the only ones who should be worried about environmental threats. A recently released report (“Men’s Health: What You Don’t Know Might Hurt You”) by the nonprofit Environmental Working Group (EWG) concludes that environmental exposures may have major negative impacts on men’s health as well, and outlines ways that guys can avoid some of the major risks.

Research during the last few decades — including a recent report by the Environmental Working Group — has shown that environmental exposures may contribute to major diseases and health concerns that especially affect men, including heart disease, prostate cancer and infertility. Credit: Carlos Newsome, FlickrCC “Most men understand that smart lifestyle choices—such as exercising regularly, eating a healthful diet and not smoking—make a big difference in staying healthy,” says EWG researcher and report author Paul Pestano. “However, what many men might not know is that research in the last few decades has shown that environmental exposures may contribute to major diseases and health concerns that especially affect men, including heart disease, prostate cancer and infertility.” He adds that toxic substances in drinking water, food, food packaging and personal care products have all been linked to serious health problems that affect millions of American men.

According to EWG, men’s heart disease risks are exacerbated by exposure to mercury in certain seafoods, Teflon chemicals in non-stick cookware, and bisphenol-A (BPA) in hard plastic containers and canned foods. Additionally, arsenic and lead in drinking water supplies is a contributing factor in elevated heart disease risks for men. Meanwhile, certain agricultural

pesticides common on fruits and vegetables as well as polychlorinated biphenyls (PCBs) that build up in meat and dairy products have been associated with prostate cancer, the second most common cause of cancer for American men. And exposures to lead, pesticides and chemicals in personal care products contribute to low sperm counts, infertility and other reproductive issues for men. EWG also underscores the importance of limiting sun exposure, as men face a higher risk of developing melanoma than women.

Some tips include: investing in a water filter system specifically designed to reduce exposure to lead, arsenic and other drinking water contaminants (see EWG’s “Water Filter Buying Guide” to find the right one); avoiding canned foods and plastic containers with the recycling code #7 to limit BPA exposure; using personal care products that don’t contain phthalates, parabens or other potential contaminants (see EWG’s “Skin Deep” database that lists toxic chemicals in some 69,000 personal care products);choosing conventionally grown fruits and vegetables that have the fewest pesticide residues and buying the organic versions of certain types of produce that otherwise rely heavily on chemicals (EWG’s “Dirty Dozen” guide lists apples, grapes, strawberries, celery, peaches, spinach and sweet bell peppers as the worst offenders among others); and, using proper sun cover and getting regular skin checks with a dermatologist to reduce melanoma risks.

By following these guidelines along with eating a healthy, varied diet and getting regular exercise, men can significantly reduce their health risks and potentially add years to their lives.

Hinge, OKCupid, and Zoosk are all players, and niche apps such as JSwipe (Jewish Tinder), Happn (location-based dating), Bumble (women have to be the ones who initiate the conversation) and The League (“curated” members have to be selected to join) have all found an audience.

The Numbers Are Compelling According to an infographic entitled Big Data Seeks Online Love by the Berkeley School of Information, one in 10 Americans has used a dating site or mobile app, and 23 percent have met a spouse or long-term partner through these sites. In fact, 11 percent of American couples who have been together for 10 years or less met online.

The matching has improved. In 2005, 47% of people agreed that online dating allows you to find a better match; in 2013, that number went up to 53%. Is online dating a good way to meet people? Forty-four percent said yes in 2005, while 59% said yes in 2013.

Does Data Science + Big Data = Love?

Not according to experts cited in a recent San Francisco Chronicle article entitled Critics Challenge The ‘Science’ Behind Online Dating

by Kristen V. Brown. She reports: “‘There is no evidence that dating sites do anything much more than increase the pool of potential partners,’ said Eli Finkel, a psychologist at Northwestern University who studies relationships.

Or, as Stanford sociologist Michael Rosenfeld put it, ‘The algorithms for matching at dating sites are mostly smoke and mirrors.’”

Thinking Things Are Not Reliably Predictable I have heard many different data scientists describe their strategic approaches to big dating algorithms.

Thod Nguyen, CTO of eHarmony, describes its approach as a compatibility matching system consisting of a “very sophisticated three tier process.” A compatibility matching model identifies potential matches based on a proprietary 29-dimensional array. eHarmony’s affinity matching model predicts the

probability of communication between two people, and finally, the match distribution model helps ensure that eHarmony delivers “the right matches to the right user at the right time and to deliver as many matches as possible across our entire active network.”

While this sounds interesting and may actually work as a matching strategy, the inherent problem is bi-directionality. When Amazon recommends a camera for you, the camera has no say in the matter. This is not true with human beings. Someone may be your perfect match, but there are any number of reasons the feeling might not be mutual.

That said, there is an axiom working in favor of all big dating algorithms: boys and girls are genetically predisposed to be attracted to one another and attempt to reproduce (otherwise none of us would be here).

Some Number of Nos Equal a Yes The problem at the Chainsaw Sisters Saloon was not the very low odds; it was the extended investment of time required to achieve success. If you had a onein-100 chance (1/100) to take someone home, you’d need 100 trips to the bar, on average, to accomplish your mission. This adds a bit of a twist to big data’s role in big dating. Sure, you can answer the 150 questions on Match.com and hope to be matched to your soul

mate, or you can just play the numbers.

Data Science + Big Data = Exponential Increase in Deal Flow Tinder saves time. It offers an exponential increase in opportunities over bar crawling.

On his blog, crockpotveggies.com, Justin Long provides the code for “Tinderbox,” a Tinderbot that taps into Tinder’s APIs and uses Eigenfaces to build an invariant model of the face you’re most likely to “swipe right.”

You can think of it as your “perfect model.” A model with all of the characteristics you love most. He also uses Stanford NLP to help the bot analyze the sentiment of chat responses. After about 60 manual swipes, the program has learned enough to start making choices for you – at a speed you could not possibly replicate. Read his blog post – it will make you smile.

If you have the time (and inclination), go ahead and build a Tinderbox for yourself. You may never visit the Chainsaw Sisters Saloon again.

San Jose CALIFORNIA The San Jose Sharks (@ SanJoseSharks) announced today that forward Joe Pavelski has been selected as the Sharks Foundation “Sharks Player of the Year” for 201415 in a vote by the Bay Area media. The award is given to the player contributing most to the success of the Sharks in the 2014-15 regular season.

The award will be presented prior to tonight’s game against the Dallas Stars at SAP Center at San Jose.

It is the second time Pavelski has been named “Sharks Player of the Year.” Pavelski was also named “Sharks Player of the Year” in 2013-14, making this the fourth time in franchise history a player has won the award in back-to-back

During the 2014-15 season, Pavelski has posted 69 points (37 goals, 32 assists) and a +12 rating in 79 games played. Along with ranking 1st on the Sharks in goals (37) and points (69), Pavelski currently ranks 2nd in the NHL in power-play goals (19), T-4th in the NHL in goals (37), T-15th in the league in points (69), 11th in faceoff percentage (55.6%), and 4th in blocked shots amongst forwards (83).

In addition, Pavelski reached a variety of individual and franchise milestones this season. He reached the 30-goal, 30-assist mark for the third season of his career, becoming only the second player in franchise history to have three or more “30/30” seasons (Patrick Marleau, seven). On

Dec. 22 vs. Anaheim, Pavelski scored his 207th career goal with the team, passing Owen Nolan to become the 2nd highest goal-scorer in franchise history. Pavelski also notched his fourth career hat-trick on Feb. 13 at Arizona, moving into a tie for 2nd place (with Patrick Marleau) for most hat-tricks in a Sharks uniform (four).

Pavelski was also named the Sharks Foundation “Sharks Player of the Month” during the month of December. During the month he posted the most goals of any NHL player (nine) and led all San Jose scorers with 12 points (nine goals, three assists).

The five-foot-eleven, 190-pound native of Plover, Wisconsin was originally selected by San Jose in the seventh round (205th overall) of the 2003 NHL Draft.
