Construction Led by Partner Emanuel Confos, our Construction team provides specialist legal advice on all aspects of construction law – from the inception of a project through to completion – and on all forms of dispute resolution.
We have particular expertise in the construction of technology buildings such as data centre facilities and renewable energy plants, as well as in the hospitality and social infrastructure space.
The team works extensively with industry standards and has drafted and negotiated a range of project documentation including engineering, procurement and construction (EPC), lump sum, design and construct, guaranteed maximum price, cost plus, project management and consultant contracts.
On the litigation front we act for and against developers, major contractors and major subcontractors in the Supreme Court, the Court of Appeal and the High Court.
Standing up for refugees In 2013, Gilbert + Tobin won a decisive victory for two Ghanaian clients who, after six years of legal battle, were finally recognised as refugees and granted protection visas. The two men, who identify as homosexual, had fled persecution in Ghana. On their first appearance before Australia’s Refugee Review Tribunal (RRT), they were found not to be genuine refugees. We appealed this decision on behalf of our clients, whose evidence was taken without an interpreter despite both clients having low levels of English comprehension. On appeal, the Federal Magistrates Court quashed the RRT decision. The failure to provide an interpreter was found to constitute a breach of procedural fairness. In January 2009, our clients returned to the RRT for a second hearing. They had to wait two and a half years before the RRT heard them again in July 2011. During the third stage of their hearing in September 2011, our clients’ applications were dismissed – the tribunal member doubted their credibility and did not accept they were homosexual.
Bringing human rights issues to the High Court Assisted by counsel, in late 2011 we filed for review in the Federal Magistrates Court. Less than one week later, the Australian Government Solicitor, representing the Minister for Immigration and Citizenship, conceded the second RRT decision had not been made according to law, and that the RRT should conduct a third review. In March 2013, our lawyers attended a two-day hearing. Within a week the RRT handed down its decision that recognised our clients as genuine refugees deserving protection. “Our clients were incredibly relieved that their claims were recognised and they had some certainty about their futures,” says Tamara Sims, a lawyer in our Pro Bono group.
In 2013, Gilbert + Tobin set an eminent precedent in the High Court on behalf of an Indonesian client who had lived in Australia since 1985. He had returned to Irian Jaya once, for a brief visit in 1996. In 2009, the Australian Government recognised our client had a well-founded fear of political persecution if he returned to Indonesia, and therefore satisfied the definition of a ‘refugee’. In 2001, our client was convicted of a serious crime. As a result, in 2003 a delegate from the Federal Minister for Immigration and Citizenship determined that he was not someone to whom Australia owed protection under the Refugees Convention. The delegate rejected our client’s application for a protection visa. This decision was affirmed by the Administrative Appeals Tribunal, the primary judge and the Full Court of the Federal Court. In 2012, Gilbert + Tobin appealed the decision to the High Court. On behalf of our client, we argued that when considering whether a person was a person to whom Australia owed protection obligations within the meaning of the Refugees Convention, it is irrelevant that the person has been convicted of a serious crime. Our client was someone to whom Australia owed protection obligations because he was a refugee within the meaning of the Refugees Convention.
Pro Bono Lawyers have a responsibility to ensure the legal system is fair, equitable and accessible to all. Gilbert + Tobin is a pioneer in providing pro bono legal services in the Australian legal sector. In 1996 we were the first law firm in Australia to appoint a fulltime in-house pro bono lawyer. In 2008, the firm broke new ground again by appointing its first full-time pro bono partner, Michelle Hannon. We now have a dedicated Pro Bono group of three lawyers and Michelle as partner.
We are proud advocates of social justice for everyone, and focus on providing advice and support to marginalised and disadvantaged clients. Pro bono work at G+T is particularly focused on Aboriginal and Torres Strait Islander issues, people with disabilities, refugees and the protection of human rights. We take on public interest litigation and regularly advise NGOs on commercial and corporate governance issues. The practice covers many and diverse areas of law such as discrimination, administrative law, defamation and public international law.
On 10 April 2013, the High Court accepted our argument that a person who satisfies the Refugees Convention definition of a refugee is therefore a person to whom Australia owes protection obligations within the meaning of section 36 of the Migration Act 1958 (Cth). When making a decision to refuse a protection visa on character grounds, the Minister cannot do so under section 36 but must do so under parts of the Act directed to this purpose. The impact of this case is far-reaching and will have significant practical consequences for protection visa applicants. For our client, this means he has the opportunity to have the decision whether to grant him a protection visa considered by the Minister anew, taking into account Australia’s nonrefoulement obligation.
Pushing for victims’ compensation Following the introduction of the NSW Government’s new Victims Compensation Scheme in 2013, Gilbert + Tobin was very concerned about a number of our pro bono clients whose applications were yet to be determined. In particular, one of our clients was set to become entirely ineligible for compensation, or only eligible for a very small amount of compensation, under the new scheme. We had already lodged two applications on our client’s behalf under the old Victims Compensation Scheme. The first related to sexual abuse and violence perpetrated against her almost continually between the ages of seven and 15 by her then stepfather. The second application was for domestic violence perpetrated against her by a former partner, with whom she had commenced a relationship after running away from home to escape her stepfather’s abuse. To ensure the best outcome for our client, we worked quickly to overcome several significant legal hurdles. They included a successful submission to have our client’s matter accepted out of time, as our client’s case involved exceptional circumstances.
We also overcame a lack of corroborative evidence by providing a lengthy and detailed statement from our client. As with many victims of child sexual assault, our client had not reported the assaults by her stepfather so no supporting material was available. The difficulty for our client in preparing her statement was vindicated by the fact that the Assessor’s Notice of Determination specifically relied on the level of detail provided in her statement. On the last day before the introduction of the new Victims Compensation Scheme, we received news that our client’s applications had been determined. She was awarded $44,250 in compensation (the maximum amount available was $50,000). Our client was blown away by the result and noted that the most important aspect of the outcome was the recognition of the wrong done to her.
In 2012–13, the firm completed more than 14,811 hours of pro bono work – an average of 54 hours per lawyer – conservatively valued at over $6.67 million.
What’s it like working in the Pro Bono group? Our clerks, graduates and lawyers are encouraged to participate in pro bono work when the opportunity arises. Graduate lawyers in our Sydney office can apply for a first-rotation position with the Pro Bono group, commencing in February each year. In 2013, Graduate Lawyer Clancy King did just that. “It’s been an incredible year with an inspiring team,” she says. “I’ve been given a high level of client exposure and worked closely with barristers, case workers, interpreters, G+T lawyers across many practice areas, and pro bono lawyers from other firms.” Throughout the year, Clancy assisted refugees from many backgrounds as part of the firm’s refugee practice, and homeless clients through the Homeless Persons’ Legal Service. She also assisted Aboriginal and Torres Strait Islander clients with matters related to victims’ compensation.
When asked to name a highlight of her rotation in the Pro Bono group, Clancy lists three: getting involved in litigation in the NSW Supreme Court for a peak disability organisation; representing clients in unfair-dismissal proceedings; and assisting clients being indefinitely detained in Australian immigration detention. “Working in the Pro Bono group has been an invaluable learning experience,” says Clancy. “It’s been a wonderful opportunity to engage with the firm’s deep pro bono culture and to explore the approach to pro bono in the legal profession more broadly.”

Our aim in joining ABCN is to provide opportunities for all our people, non-legal and legal, in all our offices, to engage with and give back to our local communities.
Environment ABCN has staff in Sydney, Melbourne and Perth who facilitate 10 employability, leadership and skill-building programs in primary schools and high schools. These include reading programs in primary schools and leadership mentoring programs for young women. “ABCN has excellent outcomes across all mentoring programs,” says Caroline Dodson, National Partnerships Manager. “Eighty-five percent of students report feeling more confident and 76% had improved communication skills.” In December 2013, Gilbert + Tobin hosted an interview skills workshop for students from Casula High School in Sydney. “We had excellent feedback from the mentors and students,” adds Samantha Luck, Communications Manager.
Football United We support Football United through an annual donation. This special community organisation provides social and sporting networks for young refugees who have settled in Australia. In June 2013, Partner Moya Dodd, member of the FIFA Executive Committee, escorted FIFA Vice President Prince Ali bin Al Hussein of Jordan to a Football United young leaders training program in Sydney. “Having visited a refugee camp and a number of football clubs in northern Jordan with Prince Ali in January, I was delighted to host him on a visit to Football United while he was in Sydney,” says Moya. “I was very proud to show how Gilbert + Tobin is involved in helping to provide a social and sporting foothold to refugees whose journey brings them to Australia.” In 2014, the firm will partner with ABCN to develop a leadership program for young women participating in Football United.
Sydney Sings In 2014, Gilbert + Tobin continues its support of Sydney Sings, a community choir formed by Creativity Australia. We pay membership fees for staff, and community members who cannot afford a place. Last Christmas, our Sydney Sings members appeared in the firm’s 2013 Christmas card!
Gilbert + Tobin has a proud community-conscious track record on environmental issues. Our ‘Green Team’ is a group of ambassadors working to enhance environmental awareness, both at work and at home. In 2016, Gilbert + Tobin will move its Sydney office to Barangaroo South. We’ll occupy four floors in Australia’s first large-scale carbon-neutral community, with zero net carbon emissions in operation, including energy, waste and commuter carbon emissions. Mbantua Festival Held in Alice Springs, Mbantua is a biannual festival that celebrates Aboriginal desert cultures. In October 2013, Gilbert + Tobin provided sponsorship and pro bono advice to the festival organisers, and sent three of our lawyers to Alice Springs to enjoy the festival, each of whom had completed more than 50 hours of pro bono work in 2013. Lawyer Ghassan Kassisieh was one of them.
“There were so many festival highlights!” he says. “It was haunting to watch Bungalow Song, the opera about the Stolen Generations, at the exact site where children who were taken were housed. The opening scene of the Jeep coming out of the darkness, taking away the child and leaving his mother to wail in the dust was incredibly confronting. “One of my loveliest memories was sitting in the dry river bed watching Missy Higgins sing as people danced under the night sky. We knew we were in Alice Springs when Missy swallowed a bug as she was about to start the chorus to ‘The Special Two’.
“She had to stop to drink water and start the chorus again. Everyone applauded when she continued. It was hilarious. “I was also really moved attending a forum on the constitutional recognition of Indigenous people. A local elder, Aunty Elaine, stood up and spoke about the effect the federal government intervention has had on her life. She spoke about her pension being channelled through a ‘Basics Card’, and the indignity she experienced going to the local shops.”
Reconciliation Gilbert + Tobin has longstanding relationships with Australian Aboriginal and Torres Strait Islander communities and organisations. We released our Reconciliation Action Plan (RAP) in 2008. We were the first Sydney law firm to have a RAP and the second nationally. The RAP covers a number of activities including:

The variety of work I’ve undertaken in the Banking + Finance group has been great. While on exchange in New York, I had the privilege to take a fashion law course taught by Michael Kors’ in-house counsel, which was fascinating and fun.” “ After completing the final semester of my Juris Doctor at the Cardozo School of Law in New York, I was excited to start my career at a first-tier law firm. The past six months at Gilbert + Tobin in the Banking + Finance group have surpassed all my expectations. “ From the first month I was involved in major marketleading transactions. One of these was the redevelopment of the Sydney International Convention, Exhibition & Entertainment Precinct (SICEEP) though a public– private partnership (PPP). Our client was a syndicate of eight international banks providing the private financing. “ PPPs are seen as the way of the future to fund important social infrastructure. Being at the cutting edge of these deals means lawyers have the opportunity to innovate and creatively solve problems that are unique to 21st-century governments and communities. As a graduate, I contributed by utilising my technical legal skills and commercial knowledge. It was good to know that my work was contributing to a real and tangible part of Sydney – the creation of a new entertainment precinct.

As my first language is French I often undertake French translation work for the group.
“ I predominantly work for one of the Energy + Resources group’s largest clients, Sundance Resources Ltd. I help provide advice on a range of construction, procurement and concessional arrangements for the company’s proposed $4.5 billion port, rail, mining and hydroelectric project in the Republic of Cameroon and Republic of the Congo. This has allowed me to work closely with Energy + Resources partners including Michael Blakiston, and with overseas advisors on Cameroonian and Congolese law.

Gilbert + Tobin’s clerkship program gives you direct access to market-leading transactions and matters. You’ll work with partners and lawyers in an informal setting, allowing you to challenge yourself and develop your skills. Corporate work will be your main focus, but you’ll also have the opportunity to assist on pro bono matters.
The G+T clerkship experience is open to students in their penultimate year of study. Our clerks have the opportunity to be part of one or more of the firm’s practice groups. You’ll start to understand the mechanics of legal practice and work on a range of tasks, developing valuable skills along the way. This includes researching, preparing and drafting memos; perhaps assisting in litigation processes, attending court, or observing negotiations; and meeting clients, or working as part of a deal team.
You will also build lasting friendships with a talented group of like-minded individuals who may become your peers as you continue your legal career. Plus, there’s plenty of time to attend training, practice group events and firm lunches, and to have fun and network with people across the firm.

At Gilbert + Tobin’s Park Street office, Sydney clerks complete a 10-week placement that consists of two five-week rotations across the firm’s practice areas. As well as becoming immersed in their practice areas of interest, Sydney clerks have the opportunity to contribute to the Pro Bono practice. Clerks are also assigned a research task that involves working closely with lawyers and then presenting the results to partners and lawyers across the firm.
Our Melbourne clerks complete a three-week placement during winter or summer, providing you with a taste of what’s to come in your legal career. Throughout your clerkship, you’ll work closely with lawyers and partners on transactions across the Banking + Finance, Competition + Regulation, Corporate Advisory, and TMT + Project Services groups.
Perth clerks can undertake a three-week placement in summer or a two-week placement in winter. During this time, you’ll work closely with lawyers and partners on matters across the Corporate Advisory, Energy + Resources and Litigation practice groups.

Mentoring is an important aspect of graduate life at Gilbert + Tobin. When you start, you’ll be assigned a mentor – a more experienced lawyer – to guide you through your rotations and your transition into a practice area.

Gilbert + Tobin will support and fund your practical legal training through our tailored in-house program. Our graduates complete their rotations at the same time as their studies, so you’ll be given additional study days to attend exams and complete assignments.
Gilbert + Tobin’s Learning + Development team provides training sessions and accreditation programs in our in-house facilities. Some of the development programs offered to our graduates include: ++ negotiation skills workshops ++ intensive commercial drafting modules ++ client development programs ++ industry-specific training by external consultants and experts ++ specialist practice group–based training ++ senior leadership development programs, including feedback opportunities and individual coaching. We also place considerable emphasis on practical, one-on-one learning with managers, senior lawyers and partners. Throughout the year, we hold seminars and events to help our lawyers earn their continuing professional development (CDP) points. You’ll also be encouraged to attend relevant external seminars.
We encourage our lawyers to undertake postgraduate study. This may include funding assistance for Masters degrees and other postgraduate courses, and study leave to complete essays and attend exams. Our Sydney office wouldn’t be complete without its in-house café, which offers sweeping views over Darling Harbour. It serves coffee, snacks and a range of breakfast and lunch options – all at a subsidised cost for staff. The café is a great space to meet up with your workmates. Our Melbourne office has a kitchen and breakout area where the firm celebrates events and often raises money for good causes, such as Australia’s Biggest Morning Tea, run by the Cancer Council. The office in West Perth has a leafy outdoor courtyard, which is an ideal setting for our Australia Day and Melbourne Cup lunches.
There is no better way to get to know your workmates than with a few drinks. Each month, a different practice group hosts themed drinks. Past themes include AFL, Chinese New Year, Halloween, a tribute to Michael Jackson and the Oscars.
Gilbert + Tobin has a smart business dress code during the week, but everyone is let off the hook on Friday, when you are encouraged to wear your jeans or other comfortable clothes to work – unless you’re appearing in court or visiting clients!
We have a reputation for working hard and having fun. Every year the firm hosts and sponsors a range of social, charity and corporate team events, which are organised by social clubs in each office. These include our endof-financial-year dinners, dress-up lawn bowls, themed charity trivia nights, the fiercely contested Gilbert + Tobin Sydney pool competition, staff Christmas parties and also a children’s Christmas party. The highlight of the social calendar is the firm’s Big Day Out – an afternoon where everyone takes time to relax outside the office and enjoy each other’s company. Last year, teams participated in a 1920s-themed murder mystery bar-crawl adventure tour in The Rocks, Sydney. In June, the Melbourne office takes an afternoon off for the Little Day Out. Last year’s event featured a game of curling, followed by dinner and drinks at a nearby restaurant. Meanwhile in Perth, the team celebrated its Little Day Out with a glamorous end-of-year dinner.
