June 2022 General Membership Meeting Recap AN OVERVIEW OF THE COLLABORATIVE PERMITTING EFFORTS OF NAVFACMAR AND GEPA Capt. Brian Bearden, MS, P.E., BCEE, U.S. Public Health Service Chief Engineer and Water Division Director with the Guam Environmental Protection Agency (GEPA) and Claire Baradi, Environmental Protection Specialist with the Public Works Department of Marine Corps Base Camp Blaz NAVFAC Marianas (NAVFACMAR) presented at our General Membership Meeting held on June 22 at the Hilton Guam Resort & Spa Fisherman’s Cove. As Chief Engineer of GEPA, Capt. Bearden oversees all the activities of the water division including permitting for the Department of Defense (DOD) construction projects. He oversaw the development of many current water regulations, including the 2006 CNMI & Guam Stormwater Management Manual. Capt. Brian Bearden, MS, P.E., BCEE

Ms. Baradi is an Environmental Protection Specialist employed by NAVFAC Marianas for Marine Corps Base Camp Blaz, Public Works Department, Environmental. Through a MOA with Guam EPA, she functions as a temporary liaison to lend onsite DOD support to help meet the increase demands on Guam EPA.

GEPA reviews permitting for Guam Soil Erosion and Sediment Control Regulations, Wellhead Protection Regulations, Guam Safe Drinking Water Regulations, Wastewater Disposal, Hazardous Waste Program, Air Pollution Control, and Solid Waste Management. GEPA AND NAVFACMAR work together to ensure that various federal and local water and water resource permits are processed within compliance of the law. With the success of the WALTERS digital permitting system, which was implemented in June 2021, there is now the Claire M. Baradi capability of store permit documents, track the permit stages, simultaneous review capability, and more. Before WALTERS, a permit took approximately 56 days to process. After its implementation, the process has been reduced to about two weeks. Although GEPA experiences some challenges and limitations with staffing, recruitment, federal funding, vehicle shortage, and such, there is still an upward trend in permits bieng processed. However, incomplete or unsatisfactory permits applications, contractor violations, misunderstandings of permit conditions, lapse in permit coverage, and lack of communication with prime contractors and their subcontractors are some of the main causes for timely review of an application.

To prevent delays in review, it is highly recommended to that prime contractors use resources that are available. The Guam Trades Academy offers Guam Erosion & Sediment Control Course, the GEPA Manual is available on the GEPA website, and familiarizing themselves with the 22 GAR Chapter 10 of the Guam Soil Erosion & Sediment Control Regulations, and submitting correct and complete applications.

Tricia Nauta Hafa Adai Everyone, This month the National Association of Women In Construction (NAWIC) would like to spotlight one of our new members, Tricia Nauta. She is a procurement specialist at Isla Coatings and Roofing Supply. With the support of her employer, she joined NAWIC this year. She joined the organization to learn and eventually take a mentoring position with other professionals in the Construction Industry. True to form, she accepted a position as Election Committee Chairperson. Our elections this year went off without a hitch! We look forward to announcing our new board. In 1985/6, Tricia moved to Guam from Colorado right before her stepfather retired out of the Air Force. She is a woman who appreciates the importance of materials arriving when needed in any industry. But she recognizes that in construction, the materials arriving at their expected due date can be the difference between a project’s smooth, lucrative completion compared to one fraught with schedule changes and unanticipated costs. With Guam’s population being the size it is, there are aspects of projects that need professionals with a special skill set that are not available on island. Without the materials being here, the project gets delayed, and the professionals may no longer be available. This makes procurement an important aspect of the Construction Industry. She recognizes a bottleneck may occur if any cog in the project is not performing as expected. When Tricia is not chasing down vendors, following up on purchase orders, or chasing down availability, she likes to relax at the beach, or on her back porch. She gets most of her inspiration from TV shows like The Food Network or Home Town. As a problem solver of the highest order, when cooking or baking, if she does not have the exact ingredient, she finds out what she can substitute it with. Just like in procurement, if the specified item is not available, what would the best substitute be? Like many of us in construction, Tricia has learned no matter how complex a project may seem, you buckle down, take it step by step and end it with a feeling of accomplishment. With that mentality, she has completed many home projects she never thought she would do. If you ever meet Tricia in person, you will not recognize she is an introvert. In all her business dealings, she is very professional and communicative. She will always listen in a room to see what she can learn while having confidence in what she knows. Though her favorite place is at home, you may catch her at the beach; just look for a beautiful, six foot tall Chamoru woman relaxing on the beach.

As far back as 1849, use of an unmanned aerial vehicle for warfighting is recorded is history. Unmanned aerial vehicles, or drones, have existed in our history for quite some time, but with a limited use. Recent attitudes have changed resulting in a growing industry with millions of dollars being poured into technological advancements and investment in drone technology. Gone are the days of drones being used solely for military purposes. This attitude shift has resulted in multiples uses for drones, from data gathering to search and rescue operations to a mechanism for the delivery of goods. Coined as one of the Eight Essential emerging technologies by PwC, it is clear the ever-expanding drone market is here to stay and will only grow, creating jobs and adding to the numerous technological assets we have today.

Lee sees value in drones as it creates efficiency in any industry. Companies utilizing drone technology will get things done faster and cheaper. With the rising costs of supplies needed to build, construction companies are able to save some money by using drone technology. Drones can give these companies “eyes in the sky” allowing for a better overview, monitoring change and project progress more effectively, do remote surveillance, monitor equipment, and conduct remote inspections. Companies can also use drone technology to further enhance the business’s marketing.

Lee is a firm believer in the benefits of drone technology. This philosophy rings true in Lee’s goal in integrating drone technology into as many industries throughout the region. “I firmly believe drones can be an agent of change and stimulate growth,” says Lee. Classified as aircraft, drone use requires a FAA certification as a remote pilot. Recognizing the hurdles faced locally to become certified, 2cofly has invested a lot of money in developing a course for emerging pilots. Scheduled to launch in August, 2cofly will offer a structured course for anyone with little to no experience with drones which will prepare them to pass the FAA certification exam. In order to create a burgeoning industry in the region, 2cofly’s commitment to producing more certified pilots speaks volumes. 2cofly has further delved into industry development on island by partnering with the University of Guam and Guam Community College in offering internships and helping students become FAA-certified drone pilots.

Lee believes we are only in the infancy stage of drone technology with the future reliance on drones increasing dramatically. The dependence on drone technology will become the norm just as we rely on our cars to transport us and our cell phones to stay connected with one another. Drones will give industries a competitive edge in their operations. Lee invites the community and those interested to their very first drone expo in August. The expo will showcase the drone companies on Guam and the industry in general, highlighting its many features and benefits. The drone industry is making its mark locally. DOL Proposes Changes to Davis-Bacon Wage Survey Forms On June 15, the U.S. Department of Labor’s Wage and Hour Division published a notice of a proposed revision to the Information Collection Request titled, “Report of Construction Contractor’s Wage Rates.” This ICR governs the WD-10 form used in wage surveys to determine the prevailing wage rate under Davis-Bacon and Related Acts requirements. The WHD’s stated goal of the revision is to streamline the wage survey process and increase response rates. Under the 1931 Davis-Bacon Act and related regulations, contractors and subcontractors on federal and federally funded construction contracts must pay at least the locally prevailing wage and benefit rate, as determined by the WHD, to construction workers. To determine these rates, WHD distributes WD-10

forms to construction employers in a given locality. Under current rules, if at least 50% of workers in a classification are paid the same rate, it is designated as the “prevailing wage.” If no wage prevails, an average rate is calculated. The proposed changes, as seen in the proposed revised WD-10 form and new WD-10A form, include the following: • Respondents are no longer asked to determine a peak week of construction, identify project value or identify contractors or subcontractors; • Respondents will select labor classifications from a provided list instead of manually entering the classification; and • Will add a new WD-10A pre-survey form used to identify potential respondents.

ABC has repeatedly criticized the WHD’s process for determining prevailing wages as statistically inaccurate and biased toward union wage rates, including in May 17 comments responding to the WHD’s recently proposed sweeping changes to Davis-Bacon and Related Acts regulations that exacerbate ABC’s longstanding concerns with this archaic policy. Comments on the proposed revisions to the WD-10 form are due by Aug. 15, and may be submitted with the identifying Control Number 1235-0015 via email to WHDPRAComments@dol.gov. CDW Requests US Supreme Court Review of Property Destruction Decision On June 16, the ABC-led Coalition for a Democratic Workplace and several other employer organizations filed an amicus brief with the U.S. Supreme Court requesting review of the Washington Supreme Court’s recent decision in Glacier Northwest, which stated that the National Labor Relations Board preempts state tort suits, allowing unions and their supporters to intentionally destroy an employer’s property while claiming to be engaged in protected concerted activity.

The brief states that the decision “leaves employers without a remedy for the intentional destruction of their private property” and “encourages the intentional destruction of employer property.” The brief also states that the decision “upsets the balance of power in labor disputes in favor of unions willing to engage in lawless acts and against law-abiding businesses,” and will result in harm to local communities and workers. The CDW and the other organizations argued that the Washington ruling conflicts with past U.S. Supreme

Court precedents and rulings issued by multiple federal circuits and state high courts. CDW has put together a grassroots portal for members to reach out to Congress and urge the NLRB and general counsel against such changes to federal labor law. The portal includes information on some of the NLRB’s most radical policy efforts as well as an already drafted letter to send to members of Congress.
