Balearics high on list of corruption scandals THE Balearic Islands and Valencia are top of the list when it comes to corruption cases.

Out of 300 politicians implicated in corruption scandals nationwide, there are nearly 100 instances in

the Balearic region alone involving current and former government employees. Most of the cases happened during the last term of former Balearic President Jaume Matas, himself involved in a dozen cases of corruption and irregular financing of the Balearic Popular Party (PP) during his rule. Other high-profile cases are those of Iñaki Urdangarin, Princess Cristina’s husband, who, as President of the Noos Institute, carried out alleged irregular activities, and Pere Rotger, who recently resigned from his position as Balearic President but has kept his seat in the regional parliament. 57 to take the stand ews Nwatch in mega drug trial Graffiti taunt A MEGA-TRIAL of 57 people accused of drug-dealing will begin in Palma on Monday (January 14). It is the culmination of a massive police operation, codenamed Kabul, launched in October 2007 focusing on criminal families in Palma and Capdepera, including the Son Banya settlement.

The investigation led to the seizure of dozens of kilos of heroin, cocaine and hash resin as well as €855,000 in cash, jewellery and documents, and 11 vehicles. Five hundred fighting cocks and 30 horses allegedly used for money laundering operations were also confiscated.

Francisca Cortes Picazo, the alleged matriarch of one of the main clans and already serving time for money-laundering and threats, will take the stand, facing an additional 19-and-a-half years in prison. The prosecution will ask for the 57 defendants to be jailed for a total of 680 years.

Bank manager’s fraud A BANK manager who allegedly stole over half-amillion euros from a client in a two year scam has gone on trial. Vicente CG, the manager of two Baleares bank branches in Palma is said to have taken €528,574 from a client whose wealth he was personally managing. The prosecution is asking Palma Provincial Court to jail Vicente CG, for six years and fine him €7,200 fraud offences. The prosecution is also demanding he repay the stolen money, which his bank, Banco Sabadell, is ultimately responsible for. The irregular actions took place between March 2005 and May 2007, when the branch manager persuaded the victim – whose total wealth of €1.35m was managed by the accused – to issue numerous cheques worth between €6,000 and €130,000 for investments.

Population decline in 27 local towns DESPITE Baleares being a popular destination for immigrants in the last decade, 27 towns in the region are losing population. According to figures published by the National Statistics Institute (INE), the population of Baleares in January 2012 was 1,119,439, just 0.57 per cent more than 12 months earlier. That increase was mainly down to Palma’s growth. The city now has a population of 407,648. On the other hand Calvia has suffered the biggest population loss with 1,337 fewer residents in a year, 2.55 per cent of the total, and Capdepera had an annual drop of 427. The region’s population drop does not follow a pattern, as both coastal tourist towns – including Manacor, Muro and Son Servera – as well as traditional inland ones – including Campanet, Buger or Lloseta – are affected. The population drop seems to be in smaller towns, including Ariany, Escorca and Fornalutx.

Palma metro service is run down SINCE the turn of the year Palma Metro has been closed on holidays and will only run a reduced service on Saturdays in a bid to save €250,000 annually. According to Mallorca Railway Services (SFM), the reduced weekend service will see 32 services running on Saturday mornings – 16 in each direction – down from the previous 120 (30 services in each direction on both Saturdays and Sundays). It is expected the new reduced service will result in €4,865 being saved every weekend. The Saturday service – which is being partially-kept to serve university students, Son Castello industrial estate employees and Son Oliva football field users – will now run every 30 minutes 7am to 2pm from Palma and 7.15am to 2.45pm from the university. There is no Sunday service.

Tourist bus fare hike? PALMA tourist bus fares could increase by €3. City Sightseeing, the company managing Palma’s tourist buses, has asked for town hall permission to raise prices by an inflationbusting 16 per cent. The proposed increase would result in adult fares going from the current €15 to €18; juniors and the retired would see their current €7.50 fare go up to €9. Children under four would ride free and Palma residents get a 50 per cent discount. The company justifies the move by the increase in fuel prices and the Consumer Price Index (IPC), and on staffing costs. It wants the new fares to come into force in April. Profits by the tourist bus service fell last year due to a 7 per cent drop in users between 2011 and 2012 (246,000 for 2011’s first 11 months compared to 230,000 for 2012’s similar period). The drop in numbers has been blamed on fewer cruise ships arriving in Palma as well as on the economic crisis.

The taste of home HOW was your Christmas? We did something we haven’t done before, we went out for lunch, to quite a fancy pants place. But you know, one of the best things about Christmas, in my opinion anyway, is the leftovers from Christmas dinner. Cold turkey and stuffing (we call it ‘scurly’ it’s my mum’s recipe from Aberdeen, an oatmeal and onion stuffing which is very simple yet completely addictive, and totally compulsory with turkey, if I don’t get my scurly then Christmas frankly hasn’t happened) on granary bread with cranberry sauce, lettuce and mayonnaise? Don’t mind if I do thanks. Well, you don’t get leftovers if you go out for lunch do you? So, thinking ahead I cooked a turkey and the whole shebang on Christmas Eve for exactly that purpose, to have it lurking in the kitchen ready for Christmas pickings. As it turned out I could have taken the turkey with me, as a kind of ‘carry in’. We were there along with approximately 100 of our fellow expats for Christmas lunch in the form of an all you can eat style buffet. It wasn’t one of those sad buffets where the food has been there for three days. No, the spread looked amazing: great starters, lots of variations on the smoked salmon theme

and crunchy salads, fish, ham, lechona, and the all-important turkey, and then some good puds as well. The atmosphere was very much ‘peace and love to your fellow man’ and there was merriment and Christmas cheer. But this all came to an abrupt end when the queue for the carvery stopped moving. Like a Tesco petrol station on the second morning of a fuel shortage, the people at the front were determined to be served exactly what they wanted, and they hadn’t come to get a Diesel Professional double cooked Gammon joint, no they were there for your bog standard entry level petrol, Turkey. The traditional Christmas dinner, you’ve got to have it even down to the hated sprout. But I don’t think the restaurant we were in had truly realised exactly how popular the humble bird was going to be, they seriously underestimated our need for tradition and our hankering for a taste of home. I think of the 100 or so people in the room, that probably 95 per cent of them would have gone with turkey,

I can only imagine the feeling of terror that must have seeped through the server’s veins as he realised that he was faced with a queue of revolting Brits who were all going to want the same thing. We don’t eat turkey any other day of the year, but my goodness, we definitely want it when we’re not in our home country for Christmas.

It’s not the most succulent or popular of foods, but we have to have it, it’s essential. So how can it have felt to have to tell a crowd of suddenly disgruntled customers that Christmas was over as the turkey had run out? There were immediate rumblings through the queue, and the news spread through the room. Some may have overreacted; it is only lunch after all. “They’ve run out of turkey!” “Nooo, how can that be?” It’s an impossibility, how can you run out of turkey on the big day before everyone has had their slice? Well, they did. And everyone who hadn’t yet had a portion just had to have something else to eat, it was disappointing for them but in a way it gave everyone something to talk about in the queue: Brits brought together in the face of adversity and somehow we all managed to struggle on. In fact there you are: three of the most British things ever, turkey, queuing and overcoming adversity. I say this though with a little smile on my face as I knew what I had waiting for me in the fridge back at home. . . New Year’s Resolution number one: plan ahead? FORGET the New Year resolutions to start keepfit regimes. It seems the keep-fit business is booming, with a mere 2 per cent of people admitting that they fail to use club memberships once they have resolved to join a gym. This finding, in a UK survey, puts a lie to the assumption that many consumers buy gym memberships and never use them. And research has also revealed that the budget health and fitness clubs sector has enjoyed the biggest growth in the past year, with this now worth in excess of £145 million (€181.25m), with club numbers rising from 73 to 142 between June 2011 and November 2012, an increase of 95 per cent. Around one in six UK adults use health and fitness clubs.

Indeed, this seems like the most logical and effective system. However, Spanish law regards your problem as a civil matter between two citizens. This means you must go to court against your neighbour. You will claim that he has illegally invaded your land and his structure has caused you problems with flooding. You have your surveyor’s report and any other evidence, such as photos, to back your claim. You will seek an order against him to remove the wall and compensate you for the damages suffered. You will also seek to have your legal and court costs paid. I am very surprised that none of your three lawyers pointed this out nor explained why the planning office did not act. Unless there is more to the story you are almost sure to win the case. UK Inheritance Tax And The Expatriate Do you remember John Major telling us that he wanted “to see wealth cascading down the generations” in the UK? All these years later and inheritance tax is still with us. It remains with us even when we leave the UK to live abroad - you cannot leave inheritance tax behind you as easily as many other taxes. Your liability to UK inheritance tax is not directly linked to where you are resident; instead it is determined by domicile. Many British expatriates remain liable for this tax even if they have lived abroad for many years. Inheritance tax threshold and rate Inheritance tax is a combination of a death duty and in some circumstances a gifts tax. If you are a British domicile, it is charged on your worldwide estate at the time of your death, plus any assets you have given away as gifts over the last seven years. It is also payable on certain lifetime gifts. The tax rate is a fixed 40%. Since April 2012 this will be reduced to 36% if you leave at least 10% of your estate to qualifying charities. The first £325,000 is taxed at 0% – the ‘nil rate band’ per individual. This threshold usually increases each year in line with inflation, but as part of austerity measures it has been frozen since April 2009.

It is now scheduled to increase in 2015/16, but again only by 1% (rounded up to £329,000) instead of by the rate of inflation as in the past. There is therefore little relief for your heirs. UK assets are always liable to inheritance tax regardless of domicile. Spouses/civil partners There is no inheritance tax on assets passing between spouses and civil partners. There is one exception. If you are a UK domicile but your spouse is not, they do not benefit from the blanket spousal exception. They would currently only receive a one-off allowance of £55,000, on top of the general £325,000 nil rate band (so a total tax free allowance of £380,000). This should improve following plans announced at the 2012 Budget. If it goes ahead, from April

2013 the one-off allowance will increase to £325,000, giving nonUK domiciled spouses a total allowance of £650,000. When it comes to leaving assets to the next generation (or indeed to anyone you wish), spouses and partners can benefit from double the nil rate band. Since April 2008, any unused portion can be carried forward and used by the second partner on their death, giving a couple a potential combined threshold of £650,000. It is the unused portion that gets carried forward, rather than the actual value. So if the first spouse uses 50% of their allowance, the second spouse will have a nil rate band of £487,500 on their death (£325,000 of their own, and £162,500 from the first deceased spouse). The domicile factor Domicile is a much more permanent concept than residence. It is notoriously difficult to change your domicile, but not impossible if you have permanently left the UK, do not plan to return, have moved to a new country and plan to remain there permanently. The basic rule is that you are domiciled in the country where

your life is centred, and which you regard as your homeland. Even if you do successfully adopt a new domicile of choice, you will still be ‘deemed’ to be a UK domicile by HM Revenue & Customs (HMRC) for the next 36 months. Also, if you or your spouse returns to the UK in future, you are likely to immediately regain your UK domicile of origin. Determining and changing domicile is complex and can be very costly for your heirs if you get it wrong, so it is essential to take professional advice. Paying inheritance tax In most cases, inheritance tax bills should be settled within six months of the end of the month of death; after this interest starts to be applied. This can cause problems for your heirs if your estate does not have enough illiquid assets, or if it takes longer than six months to obtain probate. If much of your assets are overseas, e.g. property and bank

accounts here in Spain, bank accounts in Isle of Man, etc, then probate can be particularly complicated as it needs to be obtained in each country. You may be able to use arrangements for some of your assets that do not need to go through probate and should seek advice on this. Inheritance tax is often described as a ‘voluntary tax’ since you can often take steps to lower the tax liability for your heirs. You should take advice on this, as well as on how inheritance tax interacts with Spanish succession tax. pick up the nearest mobile or to play Angry Birds on the iPad. She can turn on the television with the remote control, she can flick through photographs on the mobile phone and she can play games on the iPad. All these things she is fascinated by and if she was allowed, would spend hours doing. She’s not the only one. All the children I know are

entranced by technology. They sit glue-eyed to the telly. They whine if you

take the mobile phone from their hands and they would push buttons on the computer for hours rather than read a book.

Just the other day I saw a wooden laptop in a toyshop, that when opened, has a blackboard to colour on inside. And according to Mattel, the top-selling product in 2012 has been a mobile phone case. That suggests not only that traditional boardgames and toys just cannot compete with new exciting technology, but also that technology is taking up more and more of the children’s time, leaving less need for other toys. So does this spell the end of traditional toys? Will toddlers and children from now on be requesting a pricey tablet in their stocking rather than a Barbie doll or play truck? You’d better get saving!

I froze, unable to tear myself away from the dreadful truth unfolding in front of my eyes. How could he disrespect me in that way? I should have known that being whisked off one’s feet seldom happens in the real world, and was too good to be true for me. Clearly here was another woman - poor soul just like me - consumed by his masculinity, fooled by his words. Determined not to let him ruin my girls’ night out any more by remaining in the same club, I decided to leave, for by now it was 6.30am and the sun would soon be rearing its head over the horizon. So with our false eyelashes now jaunted and our pristine hair resembling a frizzy mess, we all retreated home to our respective beds. Not hungover the following morning, I wondered if what I had seen had truly happened. Had the man who encouraged the ‘L’ word into my mind three weeks ago just broken my heart? I had to privately admit to being crushed. And now there is the predicament of whether to accost him with what I had seen, should I wait for a confession, or merely refuse to answer any phone calls? Part of me wants to humiliate and expose him. But another side wants him to admit his sins and explain why he would risk hurting me so much. Why he appeared to treat me with such grace in the past, only to shatter my illusions of 2013 altogether. Only my dog Stella can comfort me now, and help me move on towards making 2013 start with happiness. She has always been a good listener.

Counting cost of taximen who are cheats ONCE again we have been ripped off by the taxi drivers. Today - my birthday - we went to Calahonda, had a great day, and took a taxi home to avoid drink driving. The charge was €17 for what is normally about €12. When we asked why, the taximan said: “Oh, it’s Sunday.” We need to have meters. These people need to be sorted out as expats will not come here to be taken advantage of. I lived here 28 years ago. Then there were three prices: one for tourists, another for the Englishspeaking expats living here, and a third rate for the Spanish. Today if they want to continue trying to have us over, they need to be fair, because expats will go somewhere else. I really have had enough. John Nesbitt (By email)

Apart from ordinary cars I have noticed vans and delivery lorries that do this. Surely if there is NOT a rule to allow this, an easy solution would be for the police to clamp them. If this were to happen and the word started spreading, unauthorised vehicles would not park in the bays. Better care WHEN I went to my doctor in England with a huge lump in my breast I was told to go away as there was ‘nothing wrong with me.. When I saw a doctor in Spain I was sent for a mammogram and then a scan and then for a biopsy. I had two tumours and a month later had an operation to remove them. For the past four-and-a-half years they have been taking care of me.

of the seemingly endless supply of young girls, eager to exchange sexual pleasures with me or my band members was underage or not. It’s ridiculous in the extreme. It is almost as though the authorities were getting their own back on the showbiz people who were offered these pleasures. Back in those days, many of the present older members of these various

departments did, I’m sure, seethe with jealousy as their peers were reported indulging in those ‘swinging’ activities while they were stuck in the not so privileged corners of their own careers. What better way to create a ‘he who laughs last’ situation by finally bringing down those who were the objects of their jealousy? Don’t dismiss this idea as typical Leapy ranting. Some people harbour this type of resentment for years; don’t be naïve enough to think there’s no chance of it lingering in a maggoty mind somewhere out there. Broken any New Year resolutions yet? HAT’S it then; adieu 2012 and bonjour 2013 (pardon my French but I have been reading about King Charles the First, his (alleged) lover the Duke of Buckingham and their disastrous attempts to invade France). Now I love a good reminisce as you all know (or maybe you don’t in which case, pay attention at the back) but sometimes looking back gives you nothing but a cricked neck and a deep sense of dissatisfaction. It’s gone, leave well alone I say. News presenters, celebrities and even the old lady who destroyed a masterpiece (don’t get me started) have all had their say. They have carped, crowed, hummed and hawed about the good/bad old times of the outgoing year. “What has 2012 ever done for me?” they call like dumped lovers desperately

The old year has slunk away shamefaced recalling, for the sake of its self-esteem, all the good things it gave us and bemoaning the ingrates that it leaves behind. Meanwhile, we kick at the dust, heads downcast, refusing to look it in the eye as we spill a

plethora of tired excuses at its feet: “It’s not you it’s me… I need space… you deserve someone better than me… I’ll always love you, I’m just not IN love with you.” So in the spirit of free and honest discourse and influenced by the afore-mentioned spiritual blindness of King Charles (who ordered beggars and workmen to remain in their houses as he travelled to one or other of his palaces so as not to sully his sight with the everyday) I say, well done, 2012, you were beautiful, while at the same time crossing my fingers behind my back. On the subject of looking back, quite out of the blue I was contacted by an old art school friend (not that she’s old, just a person from the time before reality set in). Michele was the first person who really listened to me.

THE PAST: Don’t look back, but instead look forward to the year ahead. She was slightly older than me and had a tranquillity about her that drew people to her. Her honesty, sensitivity and ability to get right to the heart of a problem always astounded me and had more to do with her character than her age. So I hope that 2013 sees us re-establish our friendship (sorry, 2012, I know it was you who brought us together) as I for one will relish flights of nostalgia and journeys of remembrance in our tentative first steps towards a renewal of friendship. Now back to Chaz the First, is it any wonder there was a civil war? He ruled a country

Resales, make sure you have a Licencia de Segunda Ocupación RECENTLY, I wrote about the importance of obtaining a Licencia de Primera Ocupacion before you pay any money for your new build property in Spain. This is an essential document and you should never sign an Escritura, unless this has been issued and your lawyer has confirmed, in writing, that he has a copy. However, much the same applies to resale properties although the relevant document is called a Licencia de Segunda Ocupacion. Like the Licencia de Primera Ocupacion, this document is issued by the local town hall and, in theory, certifies that a property is legal and therefore entitled to be connected to all the necessary services, such as electricity, mains water and a landline telephone. Unfortunately, not all lawyers acting for a buyer apply for a Licencia de Segunda Ocupacion during their conveyancing of a resale property and few buyers know about its importance sufficiently well to insist upon it being an inherent part of the conveyancing process. As a consequence, it is not uncommon to find property owners with very significant problems with their properties and sometimes potentially considerable financial liabilities. Indeed, being unable to obtain a Licencia de Segunda Ocupacion should act as a ‘red flag’ to you, as a buyer. It indicates that your intended property may be subject to infra-structure works (‘Land Grab’) and certainly means that obtaining mains water, electricity or a landline will be impossible, should the property lack any (or all) of these services. Furthermore, it may mean that the property concerned has serious legality issues. Over the past few weeks, I have been contacted by

several people who have fallen foul of buying a resale property that lacked a Licencia de Segunda Ocupacion. Equally, over the past few months, Iberdrola have been threatening to cut off the electricity of a number of properties in my area because they are still on ‘builder’s electrics’. Iberdrola have stated that they will not continue supplying electricity to the home owners, unless they can provide a Licencia de Segunda Ocupacion. This is something that many town halls will not issue unless a property has been fully urbanised (i.e. it is situated in an area with street lighting, pavements, mains drainage, mains water, electricity, landline telephone etc.). In fact, many old housing estates in Spain are only partly urbanised, which can make life tricky for foreign buyers, who may be ill advised by their lawyer or agent and think that their property is free from potential liabilities just because it is located on an estate. This is not always the case. If an estate has not been fully urbanised then the owners of properties will have to pay for the costs of completing the urbanis-

You may already have mains water, electricity and landline telephones but this does not mean your area has been fully urbanised. The Licencia de Segunda Ocupacion is far from a property buyer’s problem ‘catch all’ and you must not consider it as such. However, being unable to obtain it should be an indication that all is not well with your intended property. Equally, if you do obtain a Licencia de Segunda Ocupación then check carefully what it says. So, if you are a cautious

buyer ask your lawyer to apply for a Licencia de Segunda Ocupación and, if one cannot be obtained, find out why. You may save yourself thousands of Euros and serious problems.

Newest Bentley convertible to be unveiled THE Continental GT Speed Convertible, Bentley’s new open-top performance flagship, makes its international debut next Monday at Detroit’s International Auto Show. No prices have yet been disclosed for what the company has called “the world’s fastest fourseat convertible.” The new Bentley combines roof-down luxury touring with the performance of a 625 PS (616 bhp) twinturbocharged 6.0 litre W12 engine, while delivering a 15 per cent improvement in fuel efficiency. Taking its place at the pinnacle of the Bentley Continental range, the new GT Speed THE new McLaren 12C Spider was presented at the 37th edition of the Bologna Motor Show, in Italy. As with the mechanically identical 12C, the Spider is a midengine two-seat reardrive sports car. The lightweight 12C Spider uses the upgraded 625PS engine, which is part of the 12C Model Year 2013 upgrade. Acceleration from 0 to 100 Kph takes 3.1 seconds when fitted with Pirelli P Zero Corsa tyres, the same as the coupé.
