Requiring Informed Consent Searches

The right to say "no" does not mean much if you don't know you have that right in the first place.

We require hospitals to obtain "informed consent" from patients before they undertake intrusive medical procedures. We demand extensive disclosures from sellers to buyers in real estate transactions. We even make police deliver Miranda warnings to suspects who are arrested, on the premise that nobody can effectively waive the rights to remain silent or to consult counsel otherwise. Yet police routinely demand that people submit to searches that they have a right to decline without advising them that they can just say no. A so-called "consent search" does not need any justification if the individual grants the police permission. Yet in many encounters, it is far from clear that the individual can deny the police request.

Police officers also make their search demands in racially disparate ways, as was abundantly clear throughout the era of New York City's widespread stopand-frisk policy. Often, such consent searches form the basis justified or not - for criminal charges against minorities that whites, who are not often subject to such searches, seldom face.

A recent in-depth report in The New York Times highlighted these disparities as they relate to traffic stops. (1) In Greensboro, North Carolina, The Times found that not only were black drivers stopped disproportionately often, but they were much more likely to be subject to a search by the officer conducting the stop. The pattern was repeated across the other states that track comparable data. And it

echoes in individual stories, such as John Felton's stop in Dayton, Ohio earlier this year, that make their way into the national news cycle.

The problem of conscious or unconscious racial bias in policing is a complex and sensitive one, but the problem of making sure citizens know whether they must agree to be searched is much simpler to solve.

Currently, in most places, it is up to each individual to know and assert his or her rights. Organizations such as the American Civil Liberties Union make efforts to educate the public, but in the moment, even an informed driver may feel intimidated. Officers are not required to tell drivers or passengers that they have the right to refuse a search, and many officers do not bother. Fear of retribution is doubtless more acute for black drivers, considering the recent history of traffic stops that escalated disastrously in cases like those of Sandra Bland and Walter Scott.

Since Fayetteville instituted consent forms, the number of searches conducted has drastically declined - by more than half, according to the Times. This year, a White House task force on policing endorsed this requirement. Durham, North Carolina, has also instituted a policy of requiring written permission for consent searches, and has also seen such searches drop as a result. Two cities in Texas, Austin and Dallas, have likewise adopted written consent policies. But for now, the change has only taken place on the level of individual departments or city councils. It is past time for legislatures and courts to address the problem of consent searches that lack genuine and demonstrable consent. Law enforcement should be required to show, by clear and convincing evidence, that the officer advised the person stopped of his or her right to decline a search, that the information was presented clearly,

If citizens calmly invite an officer to search their property in the full knowledge they can refuse, fine. But the decline in consent searches in jurisdictions that require written consent suggests that a lot of people are saying yes because they do not feel secure in saying no.

As in Fayetteville, we can expect the number of consent searches to decline drastically once policies are in place to make sure that consent is genuine. Such a course correction would at least address one aspect of the selective enforcement problem that is hampering and tarnishing law enforcement across the country. - Larry M. Elkin

The Times story, however, suggested that at least one city has identified an effective way to make sure consent searches are based on true consent. In Fayetteville, North Carolina, a couple of hours from Greensboro, the policy since 2012 has been that officers must get written consent before conducting consent searches. This policy arrived as part of an overhaul to the department's practices, in response to heavy criticism related to traffic data highlighting the racial disparities in the police department's use of consent searches. READINGTON, N.J. - A New Jersey man is facing charges for allegedly wiping “between his butt cheeks” with a police summons before throwing it at an officer. The indictment charging Joseph Greenwood, 45, with a fourth-degree charge of throwing bodily fluids alleges he was issued the summons by Lt. John Insabella of the Readington Police Department on a municipal court charge of threatening to assault another person. The indictment accuses Greenwood of acting “by taking the summons complaint issued to him upon his release from police custody, placing it between his butt cheeks, wiping the paper in an upward and downward motion and throwing it in the direction of the officer.” Greenwood “did pur-

KANSAS CITY, MO - A man was burning trash on his property in Clay County when the fire began burning out of control. The man drove his truck back and forth over the fire in an attempt to suffocate it. However, the tires of the van caught fire, which quickly spread to the rest of the van that was loaded with ammunition. Why was it loaded with ammunition? If you live in Missouri you already know the answer to that question. The man managed to run away from the burning van before it exploded. A police officer who was in the middle of a traffic stop in the area saw the black smoke and went to investigate. The officer eventually found the vehicle’s owner watching the fire from a distance. The car owner will not face any charges as the fire occurred on his own property and he only damaged his own vehicle. SARASOTA, Fla. - A Florida DWI suspect allegedly offered authorities an unusual explanation for his vehicle’s erratic movements: “My dog was driving.” The Manatee County Sheriff’s Office said a deputy attempted a traffic stop shortly before 8 p.m. Oct. 7 on a white fourdoor vehicle seek speeding through a neighborhood. The sheriff’s office said the vehicle sped up while attempting a turn and ended up traveling through a ditch on the side of the road. The driver then over-corrected, swerved and ended up going through a ditch on the opposite side of the road before crashing into a house, investigators said. The suspect, later identified as Reliford Cooper, fled on foot and a K9 unit soon found his t-shirt in front of a church. A pastor from the church told a deputy that someone was hiding in the facility’s bathroom. Churchgoers forced Cooper out, and he was placed under arrest. “I wasn’t driving that car.” Cooper allegedly told deputies while he was being handcuffed. “Who was chasing me? You’re slow as [expletive]!” A deputy told Cooper he smelled of alcohol and marijuana, leading him to allegedly offer an explanation for the events. “My dog was driving that car. I ran because I wanted to. You ain’t gonna find no drugs or guns on me,” Cooper allegedly said, before vomiting and complaining of a back injury. Cooper was arrested on charges including DWI with property damage, aggravated fleeing, leaving the scene of a crash with property damage and resisting/obstructing an officer without violence. He was taken to Manatee Memorial hospital for examination and later transported to jail. LANTANA, Fla. - A Florida woman said she mistook super glue for eye drops and ended up with her eye glued shut

for several days. Katherine Gaydos said her ordeal began last week when a piece of debris flew into her eye while a friend was using a leaf blower. “Something blew into my eye and I screamed for someone else to get eye drops out of my purse and they brought super glue,” she told WPBF-TV. “As soon as I felt it in my eye I felt it burn and I closed my eye and screamed ‘Call 911.’” Gaydos said her doctor gave her antibiotic salve and ointment, but refused to attempt to open her eye or give further treatment unless she made a payment. “He was talking about doing surgery to try and save my eye, but now I don’t know what to do — I don’t have a job, no insurance or any money,” Gaydos said. Gaydos said another doctor contacted her after the initial WPBF-TV report aired Wednesday and was able to pry her eye open. “It was the same office, but a different doctor,” Gaydos said. “He put Lidocaine above and below my eye and just pulled on it until it finally opened.” Gaydos said the second doctor told her to return Friday to remove the rest of the glue from her cornea. She said the doctor did not ask her for payment. “He said I should get my sight back, and not have permanent damage,” Gaydos said. Dr. Pankaj Gupta, assistant professor of ophthalmology at Case Western Reserve University in Cleveland, Ohio, said the situation would have resolved itself over time if Gaydos had not received treatment. “The first thing I think everyone needs to know is don’t panic,” Gupta told ABC News. “There is not a single thing that is permanent that will not slough off on its own,” he said. “In time it will go away.” SAN ANTONIO, Texas - It’s called the castle doctrine. It says that when a person is in his or her legal abode they have certain legal protections and immunities which permit them to use force, even deadly force, to defend themselves against an intruder. And you better believe they take the castle doctrine seriously in Texas. Maybe a little too seriously, as in the case of this Texas man who got a little spooked when his wife came home early in the morning. Police said the San Antonio man, whose name was not released, told them he heard some noises coming from the front of the house about 4 a.m. and saw a flash of light. He grabbed a shotgun and went to investigate. The man said he saw a light and someone standing at a distance, so before investigating any further, or trying to determine whether the ‘flash of light’ represented a threat or maybe a headlight or something, he fired a blast from the shotgun. That’s when he realized he had shot his wife. Police tried to resuscitate her when they arrived, but she was pronounced dead at the scene from a gunshot wound to her chest. Authorities aren’t sure whether her husband will be charged in the fatal shooting, which remains under investigation. ENIGMA

The Year Of The Saber In this the year of the saber as some would prefer to call it where the drums of war are already beating the clamor for supremacy has already begun. As so often in the past when sabers rattle has only inhibited the forward progress of humanity. There are many of the powers that be whose self serving ideologies have already intensified what is now a network of global terror. It is known that power struggles whether it is in the animal kingdom or by man have been going on since the beginning of time. It really seems to be as though we are no better than the predators of nature where dominance is always determined by violent confrontation. And, if history is any indication makes us really think about the trajectory of where mankind is actually headed.

Israel where the latest clash between Jews and Arabs is so reminiscent when the Catholics and Protestants in Ireland broke out in violent reprisals. As tensions mount all around the region the Mid-East is a powder keg already poised to set the whole region in more flames of terror and death. As warring factions continue to grow perpetuating the onslaught that has multiplied the flow of humanity escaping the stench of war. Already with ISIS, the Taliban, and Al-Qaeda along with many Arabs seeking dominance have already secured their footing. The sanctity of life means to nothing to them. Collateral damage as some would say brings little comfort to the multitudes of faceless individuals trying to escape the mayhem, death and destruction.

As cries of desperation swell where hopes and dreams continue wither and die the chances of a ending the quagmire that is in the Mid-East gets slimmer every time sabers are drawn. With violence mounting in

that will defiantly grow. The constant misery that it brings spreads more death and woe. The plight that so many face is just a reminder of how far mankind really has to go before the light of peace and harmony will take it's place. Today, it seems that the world is in darkness where factions have found a way to shield out the light of hope and reason. Perplexed are some of our leaders today who continue to fiddle away is apparent in everything that they say. Without a global resolve those seeds of destruction will only bring more sabers into play. Rouge nations like North Korea and fanatic factions all over the globe have already amassed the resources for more mayhem and destruction. We have to realize that a more unified effort is needed from every country affected by the surge of hostilities in the MidEast and all those who have opened their boarders for the influx of refugees to dispel the notion that the world as we now

know it will soon disappear. To reach that secure future that lies ahead has always been within our grasp. But, we have to first realize that it was the United States through inept foreign policies from the past hat has opened up the flood gates releasing torrential rains of terror that has flooded the entire Middle East. In denial are some of our dubious officials but the fact remains the entire world now is a hot bed of tension ready to explode where the year of the saber has taken hold. Amidst the horrific carnage in Syria that has gone on for far too long now Russia is in the mix. With the United States sabers at the ready leading the charge. Questions now are beginning to surface in the aftermath of so much grotesque savagery where thousands have perished in a brutal civil war. It is known that Russia who is aligned with Assad and now the United States is fueling more aggression by sending arms and munitions to help another cause puts the world


on notice that maybe the United States just can't get it right. We have to remind ourselves that not since the end of World War II has the United States been victorious or totally successful when we have sent troops in harms way. The Korean war ended in appeasement where no clear victor stood over the vanquished foe. Vietnam was yet another futile attempt where thousands of American lives were lost. The first Gulf War was a exercise in global response to securing a region that had fallen into the hands of another tyrannical ruler, only to ignite the flames that exploded on 9/11. What has occurred since, we have become the gun slinger whose quick draw topples regimes. It is no wonder that so many countries perceive America as the fastest gun in the West. We have become what we thought we never be, the War Monger in the eyes of so many. And, the carnage only continues. When the Arab spring exploded on the world's stage just couple of years ago it actually was a prelude of things to come. The violent overthrow of government in Egypt and US backing overthrow in Libya coinciding with the continuing savagery in Syria has once again drawn ire and condemnation from

most of the rest of the world. And, yet we have only continued to put more Americans in harms way, wasted billions if not trillions of dollars in a quagmire that seems to never end and set the stage for more unrest in Europe with all the humanitarian needs from the mass influx of refugees. The year of the saber has already taken it's place. But, it is not only half a world away where the US continues to display an arrogance so typical of late. It is the main stream media and our tough touting politicians who are either too blind to see, to consumed with party loyalties, too interested in gaining more campaign cash, or just oblivious to the continued harsh realities millions of Americans face each and every day that continue to rave how good our economy is. When in reality it has been trade agreement after trade agreement form the past 30 years that made it more lucrative for companies to eliminate untold millions of middle class jobs. In doing so the US has secured the largest income disparity gap in history, put this nation deeper in debt and in essence gravely jeopardized our national security while destabilizing our national economy. When just recently Nabisco closed what was the largest bakery in the

world in Chicago, laying off over 1400 workers just in time for the holiday season, and moving operations to Mexico. This is just one of thousands of outcomes of inept US policies that have been implemented that has made this year of the saber more devastating for Americans. For senior citizens in this the year of the saber are going to feel a most difficult financial pinch. When our dubious legislators passed legislation concerning Social Security where cost of living increases make it possible for seniors to stay in their homes, buy food, pay utilities, and keep paying those Medicare Part B premiums that have increased this year will get no cost of living adjustment. A cost of living adjustment that still won't keep pace with all the other rising costs of today just because gas prices per gallon we pay at the pump today are not as costly as they once were. It really is a perverted sense of equation when it comes to cost of living adjustments for our seniors. To add salt to the wound as they say over 600,000 seniors already are in reverse mortgage foreclosures. And, without a cost of living increase the prognosis is that thousands more

will be faced with foreclosure. All those TV adds that we see more frequently today when either Fred Thompson or Henry Winkler push reverse mortgages as a useful financial tool are really beguiling the public into thinking that it is free money when in reality all reverse mortgages are nothing more than a home line of credit that has to be paid back with compounding interest. Leave it to Einstein who visualized compounding interest as the eighth wonder. With political rhetoric heating up many of today's Presidential contenders are not in tune with the realities of our times. A more brutal harsh world too many face is the reality now. As the harshness of winter fast approaches millions the world over still will be faced with the realities that their world has been turned upside down. For millions of refugees on unfamiliar ground too many dreams have already died. The squalor that many face even here as well as abroad is more apparent with each passing day. In putting the conflict especially in Syria in perspective we have to truly understand the history of Syria and what actually is the driving force behind one of the worlds


most violent civil war. Modern Syria was established after the First World War as a French mandate. After the First World War Syria represented the largest Arab state to emerge from the formerly Ottoman-ruled Arab Levant but didn't become an independent nation until 1946 after World War II. In 1946 the government of Syria was of a parliamentary republic. But, soon afterward began a series of military coups that began a reign instability that lasted over 20 years. It was in between one military coup that Syria had a brief union with Egypt from 1958 to 1961. It was too short lived and another military coup took effect where the whole country was and still is under Emergency Law. This Emergency Law effectively suspended most of the constitutional protections that were established when Syria first gained independence. Today, Syria is probably best describe as a country whose government is that of a non democratic where Bashar al-Assad has ruled since he took over from his farther in 2000. It was Assad's father who took control of the nation in the last military coup of 1970. The aftermath of the United States led Libyan overthrow of Muammar Gaddafi and the subsequent violent overthrow in Egypt set off a tempest of unrest. That unrest spilled over into Syria. As a result ignited protest after protest against an entrenched leader who has done very little to combat the hellish living conditions that have existed in Syria for far too long. When Assad retaliated against anti government protests where tensions turned violent members of the Arab states issued a mandate to stop the violence or be suspended from the Arab League entirely. Since the violence has only escalated Syria 's membership in the Arab League has been revoked sending more shock waves through-out the Mid-East. For the past couple of years the Syrian National Coalition has been the voice of an alternative government. This government was formed to gain entry into the Arab league and has since been recognized as the sole representative of the Syrian people completely cutting off Assad's own governmental rule. Recognized by the United States, Great Britain and even France all have made the case against Assad's regime almost to convincing to turn back now. A little over a year ago the Syrian national coalition

elected a Moderate Islamist preacher, Moaz al-Khatib as the group's leader. Its vice-presidents are a dissident industrialist Riad Seif and Suheir al-Attasi, an antiregime activist from a prominent Syrian family. Now with a semblance of a form of government, an Islamic one, that has already prepared to topple an existing entrenched leader have found out that to do just that requires more resources than are currently available to the Syrian National Coalition. As in every situation there are two sides to tell. One is the Syrian National Coalition's account of atrocities committed by Syrian governmental forces and the other side of more reports of atrocities committed by Syrian rebel forces that could very well be under the guise of Assad's own troops. In either case the continued violence has ruined all creditability of Assad's government and just maybe the Syrian National Coalitions too. The latest attempt by almost all accounts has resulted in the use of weapons that have been outlawed by the International community. Whether or not biological or chemical weapons were used on unsuspecting inhabitants in and around Syria still has to be documented. But, what is being found out is that some sort of outlawed means of destruction was used. But, whether or not Assad authorized it's deployment or did some faction within the Syrian National Coalition purposely set out to deceive the International community by using these weapons against themselves and is trying to convince the rest of the world that Assad was responsible still remains an unanswered question. One that has to be answered before any further involvement by the West is undertaken. That question has never been answered and yet the United States continues to make foreign policy decisions that have only exasperated the on going crisis in the Mid-East.

When you throw in what the US is undertaking by arming known aggressors to Assad and not creating an open dialogue with Russia by indirectly opposing Putin the quagmire will not only continue but get worse. With the economic conditions that remain here in the United States where more financial woes continue to mount for thousands of Americans and our foreign policy that has jeopardized the stability of the entire world is not any wonder then as to why the United States still can't get it's house in order.

When the United States has in the past responded like we did in the aftermath of 9/11 we have done so with sabers rattling only to end up creating more of a tinderbox waiting to catch fire. To further add fuel to this tinderbox it is a well known fact that Russia who has a military base located in Syria has remained steadfast and supportive with the Assad's government pitting the US against Russia. Just maybe if the world isn't engulfed in flames of more terror and just maybe someone will come up with policy decisions that would actually evoke a resolve just like the Good Friday agreement that ended much of the violence in Ireland back in 1990's. Sad to say though like today in Israel where the Jewish population is still very wary of the Arab population where tensions have now turned to violent reprisals the same is happening all over again in Northern Ireland. Why can't we all just get along.? The year of the Saber has already begun.

Falcons Stumble And Fumble and Fumble Sunday’s Falcons game against Tampa Bay was painful to watch. As Matt Ryan’s pass fell incomplete on fourth down in overtime after Tampa Bay’s Connor Barth had put them ahead, it was easy to realize that Atlanta lost the game 23-20 and that the Buccaneers did not defeat Atlanta.

Looking at the stat sheets this was a blowout. There is no way this game could have been close. The Falcons out-gained the Bucs by over 200 yards. Matt Ryan had one of his best passing days in over a year throwing for three yards short of 400 yards and once again the running game hit the century mark. However, it was Tampa Bay who was ahead late in the third quarter 20-3. It was as if the Falcons were playing cat and mouse with their divisional rival. Unfortunately this cat and mouse game was as if played between Tom and Jerry or Itchy and Scratchy.

His football team had just been anointed by Forbes Magazine as the most valuable sports franchise in the world at an estimated worth of $4 billion. Not a bad return on a $140 million investment. The only problem Jerry was facing – of his own making – was the cruel fact his football team was pretty worthless on the field. In order to understand why the Cowboys are currently mired in their five-game losing funk – the fifth time it has occurred in franchise history – with little or no hope of it ending any time soon, it’s important to understand how it all happened.

Dallas had built the foundation of a dominant offense in 2014. It started with a young and talented offensive line that was anchored by three All Pros, four of if you want to count tight end Jason Witten. Ironically his last game on an NFL roster was against the Falcons, the team that ruined his playoff run and spectacular season of 1998. Moon is one of a handful of Oilers/Titans in the Pro Football Hall of Fame. You can literally count the number of Oilers/Titans on one hand that have been inducted into Canton. Compare that to members of the 1972 Miami Dolphins who have more members from that team inducted than the Oilers/Titans in their entire franchise history. That says a lot about personnel decisions of the team, more so than coaching. The team has had a

Some of you may say Derrick Mason, but he was marginal at best. I can’t name a single Houston Oilers receiver off the top of my head and besides Wycheck and Mason the only other receivers I can name off the top of my head were/are former Atlanta Falcons. Young butted heads with Fsiher and it was well known by everyone that Fisher was not a fan of Young. When Young went down with an injury he replaced Young with journeyman quarterback Kerry Collins who played for Carolina, the Giants and Raiders before being signed as a security blanket to backup Young. Fisher knew what he was doing. Collins took over and didn’t give the job back to Young until after a public power play between Adams and Fisher not because of ineffectiveness with the Titans coach obviously (although they were), but because losing. of injury. And while they haven’t had a winning record under him they are considered an up and coming franchise and are in first place in the NFC West as of this writing. The Titans continue to flounder and haven’t been above .500 since 2011. To give you and idea of the historical dysfunction and poor choices of the Oilers/Titans here is fact to boggle the mind. In their 55? seasons the franchise has won a total of 402 games. Hall of Fame coach Don Shula who was a head coach in the league from 1964 to 1995 won 328. And while Whisenhunt did nothing to help himself in Nashville, his fate was probably already sealed before he signed his contract.

Pomona police arrested 50 people for having fake identification. …The Korean hit chart system has come under scrutiny after several media outlets reported on the practice of “hoarding,” which describes actions carried out either by fans or “brokers” to help a song travel quickly up the charts just after it is released. Real-time music charts are refreshed constantly, which means an artist can claim to have had a “No. 1 hit” even if its song occupied that position for an hour, according to the Korea Herald. These rankings play a

major role when TV shows and other music-related media, such as awards ceremonies, make lists of artists to feature. At issue are music service providers and “brokers” who, for a fee, offer to help manipulate charts in the customer’s favor. Four of the country’s biggest entertainment agencies asked a government ministry to investigate the practice but the case was rejected due to “insufficient evidence.” Streaming services can rig their systems to push certain songs up the charts, allowing management companies behind these songs to earn more streaming revenue and gain more traction for media appearances. The entertainment agencies dispute this interpretation and say they ask the service
