Informe Presidente Estimados propietarios , En nombre del Consejo Rector, les agradezco su asistencia a la Asamblea General Ordinaria de la Entidad de Conservación Parques de Sotogrande. A continuación y con la ayuda de algunos miembros de esta Junta intentaremos facilitarles información detallada de los asuntos más importantes que afectan a nuestra Entidad.

El Plan General de San Roque, determinaba esta figura para nuestra Urbanización, de ahí que la originaria Asociación de Comunidades de Sotogrande incluyese en su objeto social su transformación en Entidad Urbanística de Conservación. Tras un largo proceso de integración de comunidades y de negociaciones con el Ayuntamiento de San Roque, la Entidad de Conservación quedó definitivamente constituida e inscrita en el Registro de Entidades Colaboradoras de la Junta de Andalucía a mediados del año 2004.

La finalidad de la Entidad de Conservación es la prestación de los servicios generales de la urbanización, que son comunes a las distintas comunidades y entidades establecidas en ella. Se desarrollan sobre viales y zonas verdes de titularidad pública y debido a su especial importancia para el conjunto de Sotogrande, no pueden delegarse en las distintas comunidades que la integran, con el fin de asegurar su correcta prestación y ejecución. El coste de estos servicios constituye el presupuesto anual de la Entidad de Conservación y se distribuye entre la totalidad de las propiedades que conforman la urbanización, en función de la edificabilidad asignada en el Plan General de Ordenación Urbana a cada una de ellas.

general services which are common to all the communities or entities of Sotogrande. These services are mainly on public roads and green areas that due to their importance to the whole urbanisation cannot be assumed individually by the communities that make up the E.U.C. The cost of these services are included in the E.U.C. budget and are distributed between all the properties that make up the urbanisation in relation to building co-efficiency as contemplated by the General Plan for Urbanisations.

2.- Infrastructures of the urbanisation

2.1 Rain water drains

These drains collect the rain water and the waste water from swimming pools that are channelled towards green zones and the Guadiaro River.

2. Infraestructura de la urbanización 2.1 Red de pluviales Esta red canaliza las aguas de lluvias y de vaciado de piscinas hacia zonas verdes y Río Guadiaro. Continuamos realizando la limpieza de la red de drenaje por zonas. Las tuberías se encuentran muy afectadas por el arrastre de tierras provenientes de las obras de construcción y por las raíces de los árboles de los arcenes. Durante el ejercicio 2008 se han reparado la totalidad de las arquetas y rejillas dañadas en años anteriores a consecuencia del alto nivel de obras de construcción de viviendas. Estas arquetas dañadas suponían un serio peligro para las personas. 2.2. Red de alumbrado Se han realizado las obras de iluminación de los accesos a la urbanización y de los cruces de los viales principales. Continuaremos con la ampliación de la red de alumbrado en los viales perimetrales de la urbanización. Las redes de cableado que discurren por los arcenes han sido mejoradas de forma muy importante, reduciéndose el número de averías e interrupciones del suministro de alumbrado que originaban esos daños. Estamos estudiando la implantación de sistemas de alumbrado mediante Leds con el fin de reducir el consumo eléctrico. 2.3 Red de agua potable Nos informa Sotogrande, S.A., empresa concesionaria del servicio, que han realizado mejoras en las instalaciones. El nivel adecuado de los embalses del Campo de Gibraltar permiten asegurar el suministro de agua, complementando las extracciones del acuífero de Sotogrande y del Río Guadiaro. No obstante le recordamos que debe hacerse un uso adecuado del suministro de agua, especialmente en el riego de jardines. Es importante que Sotogrande, S.A. acometa las obras de diferenciación de las redes de agua potable y riego, de forma que siempre tengamos asegurado el suministro de agua potable. 2.4 Red contra incendios En base al informe del Consorcio de Bomberos de la Provincia de Cádiz, en el que se hacen una serie de recomendaciones para adecuar las instalaciones a la características exigidas por el recientemente aprobado Código Técnico de la Edificación, hemos solicitado al Ayuntamiento de San Roque que realice las obras necesarias, directamente o a través de la concesionaria, Sotogrande, S.A. 2.5. Red de saneamiento Nos informa Sotogrande, S.A. empresa concesionaria del servicio por delegación del Ayuntamiento de San Roque, que se han puesto en servicio las mejoras del sistema terciario de depuración que permiten reciclar la totalidad de las aguas depuradas para poder ser utilizadas en el riego del campo de golf, evitando vertidos de aguas depuradas al mar. Es necesario realizar una mejora del sistema de depuración que evite los malos olores que se generan durante el verano, al aumentar el caudal de aguas tratado. 2.6. Mantenimiento de viales Se han asfaltado tramos de Paseo del Parque comprendidos entre Sancho el Mayor y el acceso del Puerto, así como en las calles Bretón, Ramiro el Monje, Duero y Avenida de los Cortijos.

3. Seguridad A lo largo de estos últimos años la urbanización se ha desarrollado de forma muy importante. El aumento de propietarios que han establecido su residencia de forma permanente y el gran número de obras en curso, han incrementado notablemente el número de personas que acceden diariamente a la urbanización. Actualmente el servicio de seguridad está formado por seis vigilantes durante el día y ocho durante la noche, cuatro de ellos en casetas de acceso y el resto en coches patrulla. Durante el verano, hemos reforzado el servicio con dos coches patrulla adicionales. Garantizar la eficacia del servicio de seguridad es una de las prioridades de la comunidad y en este sentido hemos

We continue clearing the drains water network. These drains are continually blocked by the earth movements caused by construction works or where roots of the trees have interrupted the normal flow of water. Within the financial year 2008 we have repaired the manhole and the broken concrete drains covers on the verge, deteriorated over the years due to volume of constructions which were taken place. This broken drains cover were a potential risk of accident for the residents. 2.2. Street Lighting We have installed additional street lighting on many of roads and major crossroads of the urbanisation. We will continue to improve the lighting of the perimeter roads for security reasons. We have notably improved the electrical cables laying underground, reducing failures in the street lighting system. We are also studying the possibility of installing LED lighting to reduce the electrical consumption. 2.3. Water supply. Sotogrande, S.A., as the supplier of water to the urbanisation, has made improvements to their infrastructure. Adequate levels of the reservoirs within the Campo de Gibraltar area, enhanced by the Guadiaro River and the Sotogrande aquifer, enable them to guarantee supplies. However, it is important to remind you that it is essential to make proper use of the water, especially when irrigating the gardens. It is necessary that Sotogrande S.A. continues to make further improvements to separate potable water from irrigation water, in order to guarantee potable water levels for the future. 2.4. Fire Prevention System Following a recent report from the Cádiz Fire Department with recommendations to update the current facilities to approved legislation. We have requested the San Roque Town Hall carry out the necessary works in conjunction with Sotogrande S.A. as holders of this concession. This work has commenced and will continue until the system is upgraded. 2.5. Sewage system Sotogrande, S.A., as holders of the concession granted by the San Roque Town Hall, has installed a three phase purification system which will enable the golf course to use the recycled water, thus avoiding the need to dispose of recycled water. It is however, necessary to carry out improvement to avoid foul smells resulting from the purifying process, particularly in the summer months when the flow of water increases. 2.6. Road maintenance We have resurfaced some sections of Paseo del Parque, between Sancho el Mayor and the access to the Port, as well as Calle Bretón, Ramiro el Monje, Duero and Avenida de los Cortijos.

3.-Security Within the past few years our urbanisation has grown considerably with the number of owners who have established permanent residence and the amount of new constructions which have taken place. This has notably increased the number of persons and vehicles entering and moving throughout Sotogrande every day. At the moment, the service is covered by six guards during the day and eight at nights. One in each of the security gates and the rest patrolling the urbanisation in security vehicles. The coverage is increased during the summer months with two additional patrols on a 24 hours basis. This service is shared by both Parques I and Parques II on an equal basis. One of our main objectives is to guarantee the efficiency of this service and we have asked both the San Roque Town Hall and the Guardia Civil to give us their support by providing further patrols to Sotogrande. It is important that the Sotogrande residents cooperate by following the security recommendations that we set out below. For this purpose we will be grateful

Es muy importante la colaboración de todos los propietarios, en cuanto a la seguridad se refiere. Por ello les agradeceríamos que presten la máxima atención a las siguientes recomendaciones de nuestros expertos en seguridad: • El servicio de vigilancia de la Urbanización está para ayudarle, ante cualquier duda o sospecha llame al 956795194. • Piense que la prevención es la mejor forma de protección. • Si dispone de un sistema de alarma, no olvide conectarlo. • Si no tiene sistema, considere su instalación, le ayudará a proteger su domicilio. • La conexión de los sistemas a una central de alarmas facilitará una atención más inmediata de los servicios de seguridad en caso de necesidad. • Un mantenimiento periódico del sistema de alarmas va a permitir su correcto funcionamiento. En caso de avería o dudas en el manejo llame a la empresa instaladora. • En su vehículo, considere la instalación de dispositivos de seguridad antirrobo, alarma o sistemas de seguridad de posicionamiento (GPS). • No deje objetos en el interior de su vehículo. • Tenga presente los accesos a su vivienda, así como las ventanas con fácil acceso desde el exterior, es recomendable la instalación de puertas blindadas y ventanas con cierres o rejas. • Ante personas desconocidas sea prudente y discreto, no divulgue los viajes que vaya a realizar. • Si se va a ausentar durante largos periodos considere la instalación de equipos que permiten, durante intervalos, la conexión/desconexión de luz, radio, etc.. • No se confíe, si se trata de personal externo solicite referencias. • Pida a los empleados de empresas (gas, luz, etc.) que se identifiquen, y si es necesario confírmelo con las empresas que correspondan. • Recuerde que el Servicio de Seguridad está para ayudarle. llame al 956 795194.

4. Obras en curso Estamos trabajando con el Ayuntamiento de San Roque en el establecimiento de un convenio de colaboración con la E.U.C. que nos permita potenciar el control sobre el cumplimiento de las Ordenanzas Municipales, de forma que se actúe con mayor prontitud y dureza en aquellas obras que no respetan las normas elementales de cuidado con el entorno, seguridad e higiene, etc... Las obras deben estar valladas, contar con un acceso adecuado y mantener los viales y arcenes libres de materiales. El incumplimiento de estas normas básicas deterioran los viales y redes de servicios de drenaje, alumbrado, etc, y en el caso de accesos inadecuados a obras facilitan el arrastre de barro a los viales creando situaciones de peligro para las personas y vehículos que circulan por ellos. La Entidad remite al Ayuntamiento de San Roque, en quien recae la competencia en materia urbanística, información sobre las infracciones que las constructoras cometen, siendo el propietario el responsable final de las sanciones a que dan lugar los expedientes de disciplina urbanística de la autoridad municipal. En este sentido queremos insistir ante aquellos propietarios que estén construyendo su vivienda para que exijan a sus constructores el cumplimiento de la normativa de limpieza y seguridad de obras.

5.Retirada de restos de poda La EUC de Sotogrande, como sabemos, estableció un servicio de recogida de restos de poda, evitando su vertido en zonas verdes y parcelas no construidas. Estos vertidos constituían un serio peligro de incendio y facilitaban la propagación de roedores, además de presentar un efecto estético muy negativo. Los restos de poda y césped resultantes del mantenimiento normal del jardín, se recogen semanalmente durante todo el año, depositados en contenedores rígidos de 1m3 de capacidad. Es muy importante que no se viertan otro tipo de residuos en los contenedores. Queremos llegar a tener un contenedor por chalet. Para las grandes podas se establece un periodo comprendido entre los meses de Octubre a Marzo ambos inclusive, en los que se retirarán los restos de poda del arcén, debidamente colocados y atados. Fuera de este periodo, la comunidad no prestará este servicio, ni se permitirá su depósito en el arcén.

if you could take note of the following recommendations from our Security experts. • The security service of the Urbanization is here to help you, in case of any doubt or suspicious, please call 956 795194 . • Bear in mind that prevention is the best way of being protected. • If you have an alarm system, do not forget to connect it. • If you do not have an alarm system, consider the possibility of having it installed, it will help you protect your property. • The connection of the alarm system to an automatic reception centre will enable immediate attention of the security services in case of necessity. • A periodical maintenance of the alarm system will guarantee its perfect performance. In case of failure or doubts regarding its use, please call your technician. • Consider the possibility of installing a burglar, alarm or GPS (Global Positioning System) for your vehicle. • Do not leave personal belongings inside your vehicle. • Check the entrances to your house as well as your windows for easy-entry, it is recommended that you install reinforced doors and windows with locks or security bars. • In front of strangers be careful and discreet, do not talk about your planned travels. • If you plan to be away for long periods, consider installing a system that will enable your lights to be turned on and off at random times. • Do not trust strangers, if you are to contract outside staff or contractors, ask for personal references. • Ask all callers or workers of services or repairs, (gas, water, etc) to identify themselves, and if necessary ask for confirmation from the firm involved. • Remember that the Security Service is here to help you 24 hours a day. 4.- Constructions which are taking place. Recommendations We are working with the San Roque Town Hall, to establish an agreement with the E.U.C. in order to enable us to enforce the control of Municipal Ordinances, by taking prompt action and applying stronger sanctions to constructions that do not follow the elementary rules such as, care of the surrounding area, safety and hygiene, etc.. All plots must be fenced, and be provided with an appropriate access, maintaining the road and verges free of debris and building materials. The noncompliance of these essential rules deteriorates the roads and damages the drains and street lighting systems, and in case of inappropriate access to the site, creates danger to vehicles and residents, due to the spreading of mud and loose gravel on the roads. The Community Office sends information of non-compliance to the San Roque Town Hall, regarding any constructions sites not maintaining the rules. The property owners themselves are liable for any fines or measures arising from any decision taken by the Planning Office, Disciplinary department. We would like to stress to all those property owners who are carrying out any construction, of the importance in insisting that their builders observe the Regulations for the safety and cleanliness of their work.

5.- Collection of garden refuse The E.U.C. Parques de Sotogrande has established a garden refuse collection service to avoid deposits on green zones and empty plots. This practice used to create a serious fire risk and increased the rodent population, in addition to the negative aesthetic. The refuse and cuttings resulting from the normal maintenance of garden.waste, such as grass cuttings, small pruning of trees and hedge cuttings will be collected on a weekly basis during the whole year and should be placed in the green containers. It is important not to dispose any other kind of material

6.Estatutos de la Entidad Urbanística de Conservación Prosigue la tramitación, en el Ayuntamiento de San Roque de la modificación de Estatutos de la EUC, aprobada en el Asamblea de 24 de Marzo de 2008.

7.Revisión de los valores catastrales del Término Municipal de San Roque El Ministerio de Economía y Hacienda ha iniciado los trámites para proceder a la revisión de los valores catastrales de los bienes inmuebles del término municipal de San Roque, al que pertenece nuestra urbanización. La ponencia de valores efectuada por la oficina del Catastro, organismo dependiente del Ministerio de Economía y Hacienda, recoge un incremento notable del valor medio sobre la valoración realizada en 1993 y actualmente en vigor. Este incremento se aplicaría de forma escalonada a lo largo de los próximos diez años. Como ustedes saben, la valoración catastral de los inmuebles se toma como base en la aplicación de determinados impuestos, entre ellos el Impuesto sobre Bienes Inmuebles, que con periodicidad anual gira el Ayuntamiento de San Roque La Entidad de Conservación, recogiendo el sentir de los propietarios de Sotogrande y contando con el asesoramiento jurídico necesario, presentará las alegacio-

The community will collect this from the verges and wherever possible should be tied in small bundles. Outside these dates the community will no longer provide this service free of charge, neither may property owners or their gardeners deposit this garden refuse on the verges. Under no circumstance may garden rubbish be deposited in the roads as this may be the cause of accidents.

6. Statutes The proposed modifications of the Statutes which were approved at the General Meeting of the EUC held on 24th March 2008 have been submitted to the San Roque Town Hall.

7. Revaluation of the Rateable Value within the San Roque Municipality. The Ministry of Treasury and Economy is carrying out a collective revaluation of the Rateable Value for the San Roque Municipality, to which we belong. The official tables of values elaborated by the Local Tax Offices, which belongs to the Ministry of Treasury and Economy, contemplate a considerable increase with respect to the last revision which was done in 1993 and still in force. This increase will be applied gradually every year, for a period of 10 years. As you might be aware, these values form the basis to calculate the Land Tax (Rates), which is invoiced every year by the San Roque Town Hall. The EUC, following the opinion of the majority of the Sotogrande Property Owners and seeking the necessary legal advise, will present allegations and initiate legal procedures against the proposed increase.

8.Jardinería. • Recuperación del arbolado de Avenida de Paniagua: Los arcenes de la Avenida de Paniagua han sufrido un deterioro importante con el paso de los años. Con el objeto de restablecer la arboleda de esta avenida de la urbanización se han suprimido los árboles muertos o en muy mal estado y han sido sustituidos por otros nuevos. Se trata de devolver a esta avenida el aspecto original que presentaba cuando se creó la urbanización. La idea inicial era conseguir un paisaje que diera sensación de naturalidad con una arboleda sencilla pero que contrastara en altura, volumen y color. La variedad de árboles plantados son los siguientes: Cupressus sempervirens, pyramidalis, Acacia dealbata Link injertada y Cupressus arizonica Green, dispuestos en grupos. Con esta idea hemos estado trabajado recientemente en los arcenes

• Reforestation along Avenida de Paniagua: The verges along Avenida de Paniagua have considerably deteriorated over the years. With the purpose to restore the landscape of this part of the urbanization, we have removed the dead trees and those that were in bad condition and replaced them with new ones. We have intended to restore the avenue to its original state when the urbanization was initially created. The initial idea was to achieve a natural landscape with trees contrasting in height, colour and volume, The variety of trees are: Cupressus sempervirens L pyramidalis, Acacia Dealbata Link Injertada and Cupressus Arizonica Green, laid in groups. We have recently been working on the verges of the Avenue following this criteria and have planted 73 Acacia Dealbata, 50 Cupressus Sempervirens and 61 Cupressus Arizonica on both sides of the road, between the Guard House and the three palm trees roundabout. We have chosen trees of 1,5 m or 2 mts in height as these kind of trees take roots easily. • Pruning of trees: Within the past year and according to the established programme, we have pruned the trees in Calle Esmeralda, Avenida del Carmen, Ramiro el Monje, Sancho el Mayor, Pedro el Grande and Ordoño de León. At the beginning of autumn, we will continue with the pruning programme of other areas. • Plague of the Palm Trees in Sotogrande (red palm weevil): Over the past year, we have informed about the plague of an insect which affects palm trees. This is a species of Beetle (Rhyncophorus ferrungineus), mainly know as “red palm weevil”. This plague had been detected in 2008, as some trees were found affected. An informative campaign was initiated by sending circular letters to property owners, to the local newspapers and visiting the individual gardens of the urbanization. Despite the effort of both the property owners and the EUC, some trees have been

Durante el pasado año y en base al plan establecido, se han llevado a cabo la poda del arbolado de las calles Esmeralda, Avenida del Carmen, Ramiro el Monje, Sancho El Mayor, Pedro el Grande y Ordoño de León. A partir del comienzo del otoño, proseguiremos con los trabajos en distintas calles de la urbanización. • Plaga de palmeras (Picudo rojo): Venimos informando desde hace casi un año de la presencia en Sotogrande de un insecto que ataca las palmeras. Se trata de una especie de escarabajo (Rhyncophorus ferrugineus) conocido como “ Picudo rojo”. Esta plaga se detectó en el año 2008, cuando se encontraron algunos ejemplares afectados, por lo que la Entidad de Conservación inició una campaña informativa con envío de circulares a los propietarios, notas de prensa y visitas a los jardines de la urbanización. A pesar del esfuerzo realizado tanto por los propietarios como por la E.U.C. algunas palmeras han sido severamente afectadas, llegando incluso a morir y tener que ser taladas. Hay que destacar que 10 de las que estaban severamente afectadas, se han podido recuperar después de aplicarles el tratamiento recomendado.

9. Annual Accounts for the year 2008 and Budget for the year 2010. The Accounts for the year 2008 have been audited by Ernst & Young. They present a positive balance of 101.470 euros. The Auditors report contemplated two observations; firstly; with respect to the Debtors for the amount of 654.414 euros, similar to the previous year and secondly; a negative Reserve Fund for the amount of 165.912 euros, which has improved with respect to the previous budget as result of applying the positive balance of (101.470 euros). The Budget for the year 2010 is in line with the previous year (3.998.000 euros) maintaining the same level of services. It is necessary to pay the quotas on the voluntary period (from 1st January to 31st March) as this is the only way to be able to provide the general services for the urbanization

9. Cuentas anuales del ejercicio 2008 y Presupuesto para el ejercicio 2010. Las cuentas anuales correspondientes al ejercicio 2008 han sido auditadas por la compañía Ernst & Young y presentan un resultado del ejercicio positivo por un importe de 101.470 euros. El informe de auditoria mantiene las salvedades correspondientes a la cifra de deudores por cuotas pendientes de pago por importe de 645.414 euros, similar al del ejercicio anterior, y al saldo negativo del Fondo de Reserva, por importe de 165.912 euros, que mejora en relación con el del ejercicio anterior al aplicar el Resultado positivo del ejercicio (101.470 euros). El presupuesto para el ejercicio 2010 se mantiene en el mismo importe total del ejercicio anterior (3.998.000 euros) conservando el mismo nivel de servicios. El importe de las cuotas a satisfacer por los propietarios permanece invariable. Es necesario atender el pago de las cuotas puntualmente en el plazo establecido (01 de Enero hasta el 31 de Marzo) como única forma de poder llevar a cabo la prestación de los servicios generales de la urbanización.
