Message from the Chief Justice Welcome to the final DIFC Courts Bulletin of 2019. The DIFC Courts has always operated in tandem with a large network of partners and in 2019 we worked to forge and strengthen new relationships with several Dubai and UAE entities. A number of cooperation agreements with UAE and Dubai entities were signed in 2019 in order to further communicate and expand the DIFC Courts services. The DIFC Courts and the Dubai Land Department (DLD) signed a cooperation agreement that will focus on ensuring that the Courts’ public service offerings through the Wills Service Centre can complement and reinforce the overall service with the DLD to property purchasers. In addition, a cooperation agreement was forged with Dubai SME, the agency of Dubai Economy mandated to develop the small and medium enterprise sector. The terms of the memorandum state that the two entities will collaborate to provide Dubai SME member companies with information and access to the DIFC Courts services, including the Small Claims Tribunal (SCT). This cooperation agreement demonstrates unity of mission by two Dubai entities, working in tandem to support the growing small and medium enterprise sector. By utilising extensive mediation expertise here at the DIFC Courts, the SCT services are becoming an increasingly popular option for individuals and businesses in Dubai, UAE and beyond. We are very excited about the prospect of collaborating with Dubai SME to educate the community about our userfriendly form of dispute resolution, as well as affording a more robust and innovative consultation service to efficiently resolve matters. In 2019 we have also signed new cooperation agreements with freezones such as Ras Al Khaimah Economic Zone (RAKEZ) and renewed existing cooperation agreements with freezones such as Dubai Multi Commodities Centre (DMCC) and Jebel Ali Free Zone Authority (JAFZA) in order to continue to focus on exchanging knowledge, ideas, studies, and research, as well as jointly shared projects. In November 2019, the DIFC Courts held its inaugural Executive Forum, an event mandated to bring together delegates from the UAE’s courts, Government ministries, departments, freezones, as well as senior executives from the private sector, assembled under a unified mission to develop thought leadership and discuss future developments. The UAE’s commitment to providing a highly competitive business environment is crucial to its long-term vision of economic diversification. The ability of the UAE’s judicial
systems to support and protect the businesses that operate here will prove crucial to the nations’ long-term objective to attract and retain foreign investment. This unique and first of its kind event was organised under the Honorary Patronage of His Highness Sheikh Maktoum bin Mohammed bin Rashid Al Maktoum, Deputy Ruler of Dubai and President of the Dubai International Financial Centre (DIFC) and our partners were acknowledged with a modest certificate of appreciation. DIFC Courts has gone from strength-to-strength in maintaining its position as a leading international commercial court. Our reputation for judicial excellence has only been further extended by the addition in December 2019 of two acclaimed judges from Australia to our judicial repertoire; The Honourable Justice Wayne Martin AC QC and The Honourable Robert Shenton French. To sum up, in 2019 the DIFC Courts has set the path for our future success in the coming years. We remain committed to upholding the highest of standards and providing the best quality service for our court users. We are proud that our reputation for excellence remains our key alluring feature for future litigants. We have been successful in our aim to lead the way in technical advances and are consciously looking at ways in which to improve and progress.

DIFC Courts
On November 12, 2019, the DIFC Courts launched its Work Plan 2020 -2021, unveiling a two-year strategy at an Executive Forum. The Work Plan provides a road map of the future for the DIFC Courts and its role as a public service provider of the UAE. This unique and first of its kind event was organised under the Honorary Patronage of His Highness Sheikh Maktoum bin Mohammed bin Rashid Al Maktoum, Deputy Ruler of Dubai and President of the Dubai International Financial Centre (DIFC), brought together the leadership of the DIFC, Dubai and the UAE, as well as senior government officials helping to drive the vision of the Emirates.
While the DIFC Courts has jurisdiction over matters occurring in the DIFC, or where one of the parties is incorporated or registered in the DIFC, the Courts also deals with any cases and claims in which all parties to the dispute agree in writing to use the DIFC Courts. This is because in 2011, a decree of His Highness Sheikh Mohammed opened the DIFC Courts’ jurisdiction to businesses from all across the GCC region and beyond. Regardless of whether the agreement with another party has any connection to the DIFC or not, parties can opt into the jurisdiction of the DIFC Courts by providing for it in writing in a contract.

The DIFC Courts has recognised the need for dispute resolution services to meet the demands that are challenging traditional disciplinary and geographical boundaries. While every country in the world has some kind of system for resolving commercial disputes, those ranked highest by the World Bank, as well as an increasing number of emerging economies, have recognised that investing in efficient, well-respected business courts. This is not a niceto-have, but rather a need-to-have if they want to compete globally for investment.

DIFC Courts
The DIFC Courts is Dubai’s English language, commercial common law judicial system, and form a key part of the legal system of the United Arab Emirates. It was established with the specific objective to enable the international community in Dubai to have greater confidence in the Emirate’s legal framework, and further strengthen the trade relations with Dubai. And, over a decade later, I believe the Courts has been extremely successful in achieving this objective.

The Dubai International Financial Centre (DIFC) Courts has signed a cooperation agreement with the Dubai Future Foundation (DFF) to launch the world’s first Court Tech Lab. In exploring how judicial systems can be strengthened through technology, the Court Tech Lab will unite individuals and companies helping to prototype and launch the advancement of legal technology, such as Blockchain powered initiatives, AI enabled programmes and cloudbased solutions. The Tech Lab will be mandated to help cultivate those ideas by running a yearly competition cycle, helping to raise support and capital for companies demonstrating promising breakthroughs in the arena of court tech. Harnessing the established framework and talent pool from DFF’s AREA 2071 ecosystem, the competition will invite start-ups, scale-ups and innovative SME participants to submit and present new and viable court tech solutions. Shortlisted finalists will have the opportunity to showcase their innovative solution to a panel of private sector technology partners, as well as officials from the DIFC Courts and the Dubai Future Foundation.

The final chosen concept will then receive financial investment, as well as access to the DIFC Courts to research, test and adapt the technology solution. Technology has been central to the DIFC Courts’ operating model since starting operations in 2006. Among the many technologies the courts have pioneered to increase access to justice, is the state-of-the-art e-filing system, as well as the region’s first ‘paperless’ e-bundling solution in 2018. The Courts of the Future was launched by the DIFC Courts and the Dubai Future Foundation (DFF) in 2017 with a mandate to explore diverse legal tech. topic areas and to provide research and thought leadership on promoting and encouraging contemporary methods of greater accessibility and efficiency to court users across the globe. In 2018, launched as an initiative under the Courts of the Future, the DIFC Courts partnered with Smart Dubai to create the world’s first Court of the Blockchain. Building on existing dispute resolution services, the alliance is exploring how to aid verification of court judgments for cross-border enforcement.
The partnership is the first step in creating a blockchainpowered future for the judiciary which will have far-reaching benefits, including streamlining the judicial process, removing document duplications, and driving greater efficiencies across the entire legal ecosystem. Launched in 2017, AREA 2071 is a space and ecosystem purposefully designed to deeply connect corporates, governments, start-ups, investors, the youth, and the public in order to co-create the future.

Surge in SME Cases The Dubai International Financial Centre (DIFC) Courts today released its figures for the first half of 2019, with the English-language, common law courts continuing to assist global businesses resolve their largest and most complex disputes, while becoming the increasingly prevalent forum for settling the smaller claims of corporations, SMEs and individuals. Signaling strong public confidence, the total volume of cases across all divisions for the first six months of 2019 was 463, a 25% increase from the first half of 2018. The main Court of First Instance (CFI), including arbitrationrelated cases and counter claims, continued to provide business certainty, with the total value of cases recorded as AED 2 billion. The period was also notable for a significant increase in the number of enforcement cases, indicating the assurance

businesses have in the DIFC Courts to collect on money judgments. The total caseload of enforcement claims filed witnessed a 16% increase from the first half of 2018, with a total of 101, rising from 87 in the same period in 2018. The dynamic delivery of the region’s first Small Claims Tribunal (SCT) in the first six months of 2019 was particularly striking, with its case load increasing by 34% to 321 claims (H1 2018: 240 cases). This growth was partly driven by greater awareness campaigns through local strategic partnerships, including a cooperation agreement with Dubai Healthcare City Authority (DHCA) and the launch of the Special Complaints Referral Centre (SCFC). Reinforcing the ‘Smart’ SCT’s increasing appeal to individuals and SMEs, the total value of claims increased by 23% in the first half of 2019, rising from AED 30.6 million to AED 37.5 million.

The first six months of 2019 witnessed a total of 549 wills registered at the DIFC Courts, bringing the total since the inception of this ancillary service to over 5,160, with more than 85 lawyers representing more than 80 law firms, based in the UAE and overseas, registered as Wills Draftsmen. In July 2019, the DIFC Courts announced changes to the rules of wills registrations, which will now accommodate all resident and investor assets across the Emirates, as well as assets held outside the UAE. The DIFC Courts expands scope of wills services across the UAE On July 1, 2019, the DIFC Courts announced changes to the rules of wills registrations, which is now accommodating all resident and investor assets across the Emirates, as well as assets held outside the UAE.
As the first jurisdiction in the MENA region to offer this service, establishing a will with the DIFC Courts ensures your assets will be distributed in accordance with your wishes, providing certainty for you and your family.
Launched in 2015, the DIFC Courts established an additional ancillary service in the form of the Wills Service Centre (the ‘Wills Service’), a joint initiative of the Government of Dubai and the DIFC Courts that gives non-Muslims living and investing in the UAE the option to pass on their assets and/or appoint guardians for their children, in accordance with the instructions in their Will.
Since this service began in 2015, the DIFC Courts have registered over 5,000 wills, with more than 85 lawyers representing more than 80 law firms, based in the UAE and overseas, registered as Wills Draftsmen.
Leasing Tribunal
The DIFC Courts has established the Small Claims Leasing Tribunal (SCLT), which will be authorised to hear and determine claims related to residential and commercial leasing/rental located within the Dubai International Financial Centre where the amount of the claim does not exceed AED 1,000,000 (one million UAE Dirhams). The SCLT shall take effect from November 2019. The DIFC Courts established the region’s first small claims tribunal in 2007 to handle lower value cases in a private, informal setting. Because claims are smaller and often less complex, SCT hearings take place without lawyers, with the emphasis on finding an amicable solution that works for both parties.

Building on this success, the DIFC Courts identified a need to serve an increasingly mobile population and a busy business community that travels extensively. Launched in 2016, the Smart SCT is equipped with video conferencing and case management technology that enables individuals or small- and medium-sized enterprises (SMEs) to participate in hearings from anywhere in the world.

Fostering regional alliance The DIFC Courts stands on four main pillars, Judicial Excellence, Service Excellence, Innovation, and Connectivity. As part of a mission to maintain the evergoing relations with the Kingdom of Saudi Arabia (KSA), the Courts team, led by H.E. Justice Ali Al Madhani, has exchanged several visits with the Saudi judicial entities. On their 2019 trips to Al Riyadh, Zaki Azmi, Chief Justice; H.E. Justice Ali Al Madhani, Senior Judge of Court of Appeal and Head of International Relations of Judicial Affairs; and Ahmed Al Kamali, Government and International Relations Manager, DIFC Courts, visited the UAE Embassy in Riyadh - KSA, Ministry of Justice - KSA, Saudi Board of Grievances, The Justice Training Center.

Alongside an array of Emirati judicial progression, the DIFC Courts has also focussed intensively with developing its Registry. Chief Registrar, Amna Al Owais, who joined the Courts in 2006, currently oversees operations and quality management, supervising the Courts’ Judicial Officers and Registry personnel, as well as the delivery of a comprehensive suite of court public services. Previous to her employment at the DIFC Courts, she practiced as a lawyer in the litigation department with Hadef & Partners. Amna holds a Bachelor’s Degree of Law from the University of Sharjah and obtained a Masters (LLM) with Commendation in International Commercial Law from Kingston University, London. Over the years, the DIFC Courts has also sought to work in tandem with the UAE legal community and maintain links with leading local and global tertiary institutions to develop intellectual partnerships and launch initiatives aimed at encouraging undergraduates to pursue jurisdictional knowledge in both civil and common law. Since 2017, the DIFC Courts has operated a Scholarship Awards, wherein we award the country’s most promising law students through the DIFC Courts Pro Bono Programme. Each winning student has demonstrated a strong Grade Point Average (GPA), clear commitment to advancing the global legal system, and requirement for financial support with their education. These individuals have earned their scholarships through hard work, dedication and passion, and the DIFC Courts is proud to help them along their journey to become
Our training programmes at the DIFC Courts promote development and succession planning for key positions within the DIFC Courts and we believe it will add to the sustainability and growth of our organisation.
As of 2019, 38% of the DIFC Courts’ workforce are UAE nationals and our strategy for the future will include a five to ten-year life cycle for Emirati employees and will be specifically designed around our existing Judicial and Registry Career Criteria, enhanced by international and domestic secondments, a robust mentoring and training programme and an extension of our induction programme. For the future, the next step is to nurture the transition of more female Emirati women into the legal sector, the Courts and the judicial bench. The DIFC Courts were the first court in the UAE to introduce a female judge and we are now working with some very promising young female Emirati talent in order to assist them with their career development at the Courts.

وقبل انضمامه لمحاكم المركز ،خضع ناصر لبرنامج تدريب لدى النيابة العامة يف ديب ومحاكم ديب كمتدرب داخلي .ويعمل ناصر بتعاون وثيق مع القضاة الدوليين واإلماراتيين يف محاكم المركز، مقدما ً لهم الدعم القضايئ من خالل القيام بالبحث القانوين وحضور مداوالت محكمة الدعاوى الصغيرة وحضور مؤتمرات إدارة القضايا وجلسات االستماع الخاصة بالتطبيق. وإىل جانب عملها على االرتقاء بباقة من النظم القضائية اإلماراتية ،ركزت محاكم المركز بشكل مكثف أيضا ً على تطوير نظام السجالت لديها .إذ تعمل آمنة العويس ،مسجل محاكم المركز ،التي انضمت لمحاكم المركز عام ،2006على مراقبة العمليات وإدارة الجودة ،باإلشراف على المسؤولين القضائيين وموظفي السجل لدى المحاكم ،إضافة إىل تقديم باقة شاملة من الخدمات العامة للمحاكم .وكانت قبل التحاقها بمحاكم المركز تعمل محامية يف قسم التقاضي لدى شركة هادف وشركاه للمحاماة .وهي حائزة على درجة البكالوريوس يف القانون من جامعة الشارقة وحصلت على ماجستير القانون مع التقدير يف القانون التجاري الدويل من جامعة كينغستون يف لندن. وعلى مر السنين ،حرصت محاكم المركز على العمل بتناغم مع الدوائر القانونية يف اإلمارات وبناء عالقات مع كبريات المؤسسات األكاديمية المحلية والعالمية لتطوير الشراكات الفكرية وإطالق مبادرات تهدف إىل تشجيع الطالب الجامعيين على متابعة تحصيلهم القضايئ يف القانونين المدين والعام. منذ عام ،2017بدأت محاكم المركز بتقديم جوائز المنح الدراسية، التي تمنح أللمع طالب القانون موهبة عن طريق برنامج “برو بونو” التابع لمحاكم المركز .ولكي يحظى أي طالب يجب أن يحقق متوسط تراكمي عال يف درجاته التحصيلية وأن يظهر التزاما ً واضحا ًبالعملعلىاالرتقاءبالنظامالقانوينالعالمي،والحاجة للدعمالمايللمتابعةتحصيلهالعلمي.
تماشيا ً tمع رؤية صاحب السمو الشيخ محمد بن راشد آل مكتوم ،نائب رئيس الدولة رئيس مجلس الوزراء حاكم ديب، سنطبق يف عام 2020البرنامج التوجيهي للمحامين اإلمارتيين. وبعد أن استقصينا آراء ومقترحات الكثيرين من الممارسين والمعنيين بهذا المجال ،سيعمل البرنامج على تطوير قدرات القوى العاملة من المواطنين اإلماراتيين المحترفين للمهن القانونية وتعزيز قدراتهم التنافسية.
وتشجع برامجنا التدريبية المعتمدة يف محاكم المركز على تطوير القدرات وتخطيط التعاقب الوظيفي على المناصب الرئيسية داخل محاكم المركز، وهو ما نعتقد أنه سيعزز استدامة مؤسستناونموها. ويف عام ،2019شكل المواطنين اإلمارتيين ما نسبته 38% من القوى العاملة يف محاكم المركز ،وستتضمن إستراتيجيتنا للمستقبل دورة حياة تطويرية تتراوح بين خمس وعشر سنوات للموظفين اإلماراتيين تصمم خصيصا ًعلى أساس المعايير المهنية الحالية للقضاة وأمناء السجل ،وتعزيزها ببرامج اإلعارة الدولية والمحلية وبرنامج إشراف وتدريب قوي وتمديد لفترة برنامج التعريف الوظيفي. وبالنظرللمستقبل،تتمثلخطوتناالقادمةيفدعموتعزيزنقل المزيدمن العناصر النسائية اإلماراتية إىل القطاع القانوينوالمحاكم والسلك القضايئ .ومما يجدر ذكره يف هذا المقام أن محاكم المركز كانت أوىل محاكم اإلمارات يف تقديم قاضية أنثى ،ونحن نعمل اآلن مع عدد من الشابات اإلمارتيات الواعدات والموهوبات لمساعدتهنعلىاالرتقاءبمسيرتهنالمهنيةيفالمحاكم.

درست األبحاث الحاجات القانونية للشركات والمؤسسات متعددة الجنسيات فوجدت ضرورة توفر كفاءات واسعة النطاق لدى المحامين وموظفي المحاكم والقضاة لتحقيق القيمة للمتعاملين. وقد ابتكرت محاكم مركز ديب المايل العالمي ،منذ تأسيسها عام ،2004إستراتيجيات لسد الفجوات يف برامج التدريب القانوين التقليدية من خالل التركيز على التدريب المشترك لمسؤويل السجالت والقضاء يف أنظمة القانونين المدين والعام ،موفرة لهم منظورات قانونية دولية والمقارنة .وقد وسعنا إمكانيات الوصول للمعارف من خالل ضمان تقديم التدريب عن طريق دورات باللغتين العربية واإلنجليزية ومهارات الممارسات التدريسية لمساعدة الموظفين على تطوير الكفاءات المطلوبة لتلبية حاجات المتعاملين مع المحاكم على أفضل وجه ممكن. وقد تم وضع األسس لهذه اإلستراتيجية بأكملها من البداية لدى إطالق محاكم مركز ديب المايل العالمي عام .2005فسعادة القاضي عمر المهيري ،الذي يعمل اآلن بصفة نائب لرئيس المحاكم ،كان قد ُع ِّين كمسؤول قضايئ رفيع المستوى يف محاكم المركز عام ،2005 جالبا ً معه للمحكمة الجديدة خبرة تزيد على 15سنة من العمل والمعرفة العميقة بآليات عمل النظام القضايئ يف ديب .ففي عام ،1994عين سعادة القاضي عمر المهيري مدعيا ً عاما ً لدى النيابة العامة يف ديب وظل يعمل كمدع عام حتى عام .1998يف عام 1998 عينه حاكم ديب قاضيا ً يف محاكم ديب ،حيث تعامل مع عدد هائل من القضايا الجزائية والتجارية والمدنية. ويف عام ،2005انضم إىل فريق محاكم المركز أيضا ً سعادة القاضي علي شامس المدحاين ،وقد أرسلت حكومة ديب هذين المسؤولين القضائيين المعينين حديثا ًإىل المملكة المتحدة لحضور برنامج تدريب مكثف يف القانون العام لمدة سنتين .وبالقفز سريعا ً إىل عام ،2019نرى القاضيين وقد أمضيا أكثر من عقد من الزمان وهما منخرطان يف برامج التطوير الذايت؛ وصياغة قواعد عمل المحاكم وقيادة عملية إطالق محكمة الدعاوى الصغيرة واإلشراف على الدعاوى التجارية والمدنية الرئيسية وتوطيد عالقات عمل وثيقة مع المحاكم التجارية اإلقليمية والعالمية واالرتقاء بمعايير الخدمة ورفع مستوى الكفاءة اإلدارية.

ويف شهر نوفمبر ،2018عين صاحب السمو الشيخ محمد بن راشد آل مكتوم ،نائب رئيس الدولة رئيس مجلس الوزراء حاكم ديب ،سعادة القاضي عمر المهيري نائبا ً لرئيس محاكم المركز ،فيما يشغل سعادة القاضي علي المدحاين حاليا ً منصب رئيس مجلس إدارة المحاكم يف الشرق األوسط التابع للجمعية الدولية إلدارة المحاكم ،إضافة إىل مسؤولياته كقاض أول لمحكمة االستئناف ورئيس للعالقات الدولية للشؤون القضائية. كما شهد العقد المنصرم قفزة كبيرة يف مستويات توظيف وتطوير المواهب والكفاءات القانونية اإلماراتية .ففي عام ،2010انضم سعادة القاضي شمالن الصوالحي لفريق محاكم المركز ،مضيفا ً للفريق خبرة ومعرفة واسعتين وعميقتين يف مجال النزاعات المتعلقة بالخدمات المالية الدولية سواء يف أنظمة القانون العام أو المدين ،وابتداء من عام ،2017قام صاحب السمو الشيخ محمد بن راشد آل مكتوم ،نائب رئيس الدولة رئيس مجلس الوزراء ،بوصفه حاكما ً إلمارة ديب ،بتعيين سعادة القاضي شمالن الصوالحي قاضيا ً لمحكمة االستئناف يف محاكم المركز. واستمرت عمليات االستقطاب والتوظيف يف السنوات الفائتة، فع ِّين ناصر آل ناصر موظفا ً قضائيا ً تعزيزا ً لمهارات الجيل القادمُ .
يف محاكم المركز يف شهر ديسمبر عام 2012ويف عام ُ 2017عين قاضيا ً ومسجل يف محكمة الدعاوى الصغيرة .تخرج ناصر من جامعة ميدلسيكس بدرجة البكالوريوس يف القانون .ويعتبر ناصر أيضا ً أول إمارايت يف فريق محاكم المركز يتمحور برنامج تدريبه القانوين الرئيسي حول القانون العام اإلنجليزي.

توســع محاكــم مركــز ديب المــايل العالمي نطــاق خدمــات الوصايــا يف جميــع أنحاء دولــة اإلمــارات العربيــة المتحدة أعلنت محاكم مركز ديب المايل العالمي يف األول من يوليو 2019 عن إدخال تغييرات يف قواعد تسجيل الوصايا لتستوعب اآلن أصول المقيمين والمستثمرين من مختلف إمارات الدولة، إىل جانب األصول الموجودة خارج حدود دولة اإلمارات العربية المتحدة. ُيذكر أن محاكم مركز ديب المايل العالمي أنشأت مركز خدمة الوصايا كخدمة تكميلية إضافية يف عام ،2015وهي مبادرة مشتركة بين حكومة ديب ومحاكم مركز ديب المايل العالمي لمنح المقيمين والمستثمرين من غير المسلمين يف الدولة خيارا ً مالئما ً لتوريث أمالكهم و/أو تعيين أوصياء ألطفالهم وفقا ً للتعليمات المذكورة يف وصاياهم.
وتعد محاكم مركز ديب المايل العالمي أول سلطة قضائية يف الشرق األوسط وشمال أفريقيا تتيح لكم وضع وصية تضمنون بموجبها توزيع أمالككم وفق خياراتكم الشخصية ،ما سيوفر لكم وألسرتكم الثقة واالطمئنان. ومنذ انطالق هذه الخدمة يف ،2015سجلت محاكم مركز ديب المايل العالمي أكثر من 5000وصية ،مع أكثر من 85محامياً، يمثلون أكثر من 80شركة محاماة يف الدولة وخارجها مسجلة ومعتمدة لصياغة الوصايا.

محكمــة اإليجارات أنشأت محاكم مركز ديب المايل العالمي محكمة إيجارات متخصصة بالدعاوى الصغيرة ،ستكون مخولة بالنظر يف دعاوى المطالبات الصغيرة المتعلقة بعقود اإليجار/االستئجار الواقعة ضمن مركز ديب المايل العالمي ،التي ال يتجاوز مبلغ المطالبة فيها مليون درهم إمارايت .وينطلق عمل المحكمة ابتداء من نوفمبر .2019 وكانت محاكم مركز ديب المايل قد أنشأت أول محكمة للدعاوى الصغيرة يف المنطقة عام 2007للتعامل مع قضايا الدعاوى ذات القيمة المنخفضة وفق إجراءات خصوصية غير رسمية. وباعتبار أن المطالبات المعروضة أمامها أصغر حجما ً وغالبا ً أقل تعقيداً ،تجري الجلسات دون محامين ،حيث يتم التركيز على إيجاد حل ودي يناسب الطرفين.
وبناء على النجاح الذي حققته هذه المحكمة ،وجدت محاكم المركز حاجة لخدمة السكان الذين يزداد تنقلهم وأصحاب األعمال المشغولين بأعمالهم وأسفارهم الكثيرة. وقد تم تجهيز محكمة الدعاوى الصغيرة الذكية ،التي انطلقت عام ،2016بتقنيات المؤتمرات الفديوية وإدارة القضايا التي تتيح لألفراد والمؤسسات الصغيرة والمتوسطة المشاركة يف جلسات المحاكمة من أي مكان يف العالم.

تهدف االتفاقية ً أيضا إىل إبراز الحماية التجارية التي يمكن للشركات الصغيرة والمتوسطة الحصول عليها من خالل مركز خدمة الوصايا التابع للمحكمة ،وهي مبادرة مشتركة مع حكومة ديب لمنح غير المسلمين المقيمين والمستثمرين يف دولة اإلمارات العربية المتحدة خيارا ً مالئما ً لنقل أصولهم وفقا ً للتعليمات المذكورة يف وصاياهم .وتشمل خدمات الوصايا التي تقدمها للجمهور “ملكية األعمال” و”األصول المالية” ،وكالهما يضيف قيمة كبيرة لمجتمع الشركات الصغيرة والمتوسطة. مالحظةللمحررين

“محاكــم مركــز ديب المــايل العالمــي” تقيم تحال ًفــا مــع “محمــد بن راشــد لتنمية المشــاريع الصغيرة والمتوســطة” وقعت محاكم مركز ديب المايل العالمي مؤخرا ً اتفاقية تعاون مع مؤسسة محمد بن راشد لتنمية المشاريع الصغيرة والمتوسطة، إحدى مؤسسات اقتصادية ديب .بموجبه سيقوم الكيانان بمد أعضاء المؤسسة بالمعلومات والدعم لتشجيع االستفادة من الخدمات التي تقدمها محاكم مركز ديب المايل العالمي ،بما يف ذلك محكمة الدعاوى الصغيرة. ووف ًقا لما جاء يف تقرير جديد صدر عن محاكم مركز ديب المايل العالمي يف أغسطس ،2019هناك زيادة ملحوظة يف أعداد األفراد والشركات الصغيرة المتواجدة خارج نطاق مركز ديب المايل العالمي ممن لجأوا إىل حل نزاعاتهم التجارية يف محكمة الدعاوى الصغيرة التابعة لمحاكم مركز ديب المايل العالمي. حيث سجلت المحكمة األوىل من نوعها يف المنطقة للنظر يف الدعاوى الصغيرة أدا ًء قويا ً خالل األشهر الستة األوىل من عام ،2019 مع ارتفاع ملحوظ يف عدد الدعاوى المرفوعة أمامها بنسبة 34%

إىل 321دعوى .وتزامنا ً مع شعبيتها المتنامية يف أوساط األعمال التجارية اليوم ،ارتفع إجمايل قيمة الدعاوى المرفوعة أمامها بنسبة 23%خالل النصف األول من عام ،2019من 30.6مليون درهم إىل 37.5مليون درهم. وتستند استراتيجية حكومة اإلمارات للتنويع االقتصادي إىل حد كبير على إنشاء قطاع قوي وحيوي للشركات الصغيرة والمتوسطة. حيث تتوقع رؤية اإلمارات 2021وصول نسبة إسهام المشاريع الصغيرة والمتوسطة يف االقتصاد غير النفطي للدولة إىل .70٪ وحالياً ،تسهم 400,000شركة صغيرة ومتوسطة بأكثر من 60٪من االقتصاد غير النفطي وف ًقا لتقرير حديث للعام 2019يف حين يوفر القطاع 86٪من إجمايل وظائف القوى العاملة يف القطاع الخاص. وهي تشكل 73٪من قطاع تجارة الجملة والتجزئة يف اإلمارات، و 16٪من قطاع الخدمات ،و 11٪من القطاع الصناعي.

اإلجمايل منذ بدء هذه الخدمة إىل أكثر من 5،160وصية ،مع أكثر من 85محاميا ً يمثلون أكثر من 80مكتب محاماة مسجل ومعتمد لصياغة الوصايا ،سواء من داخل اإلمارات أو خارجها. ويف يوليو 2019أعلنت محاكم مركز ديب المايل العالمي عن إدخال تعديالت على قواعد تسجيل وصايا المقيمين والمستثمرين لتشمل أصولهم عبر مختلف إمارات الدولة إىل جانب تلك المتواجدة خارج حدود الدولة. ودخلت هذه التعديالت حيز التنفيذ اعتبا ًرا من 1يوليو ،2019كما أكد مركز خدمة الوصايا التابع لمحاكم مركز ديب المايل العالمي إمكانية تعديل الوصايا المسجلة لديها مجانًا حتى موعد حددته بنهاية شهر أغسطس ،2019لتشمل األصول والموجودات الواقعة ضمن حدود دولة اإلمارات وخارجها. ويف عام ،2019وقعت محاكم مركز ديب المايل العالمي اتفاقية تعاون مع دائرة األراضي واألمالك يف ديب لضمان تكامل الخدمات العامة لمركز خدمة الوصايا مع الخدمة الشاملة التي تقدمها الدائرة لمشتريالعقارات.

طفــرة يف أعــداد دعاوى الشــركات الصغيرة والمتوسطة أفصحت محاكم مركز ديب المايل العالمي اليوم عن أرقامها الرئيسية للنصف األول من عام ،2019مظهرة استمرارها يف مساعدة الشركات العالمية على حل النزاعات األكبر واألكثر تعقيدًا ،كما سجلت أول محكمة للدعاوى الصغيرة يف المنطقة أدا ًء قويا ً خالل رسخت المحاكم التي تطبق القانون العام ،والناطقة باللغة اإلنجليزية، األشهر الستة األوىل من عام ،2019وذلك مع ارتفاع عدد الدعاوى من مكانتها كالمنصة السائدة لتسوية المطالبات األصغر لألفراد المرفوعة أمامها بنسبة 34%إىل 321دعوى (من 240يف عام والشركات الصغيرة والمتوسطة. .)2018ويعزى هذا النمو إىل زيادة الوعي بهذه القنوات القانونية ،عبر ويف إشارة إىل ثقة الجمهور القوية ،بلغ إجمايل عدد الدعاوى يف جميع تدشين حمالت وشراكات محلية استراتيجية مثل اتفاقية التعاون األقسام لألشهر الستة األوىل من العام الحايل 463دعوى ،بزيادة مع هيئة مدينة ديب الطبية وإطالق مركز إحالة الشكاوى الخاصة. قدرها 25٪عن النصف األول من عام .2018واستمرت المحكمة وامتدادا ً للشعبية المتنامية التي تتمتع بها المحكمة الذكية للدعاوى االبتدائية الرئيسية يف توفير الثقة واليقين يف األعمال ،حيث وصل الصغيرة يف أوساط األعمال التجارية اليوم ،ارتفعت القيمة اإلجمالية إجمايل قيمة الدعاوى المرفوعة يف الفترة نفسها ،بما فيها القضايا للدعاوى المرفوعة أمامها بنسبة 23%خالل النصف األول من عام المتعلقة بالتحكيم والمطالبات المضادة إىل 2مليار درهم. ،2019وذلك من 30.6مليون درهم إىل 37.5مليون درهم. كما شهد النصف األول من عام 2019زيادة ملحوظة يف عدد شهدت األشهر الستة األوىل من عام 2019تسجيل ما مجموعه دعاوى التنفيذ ،ما يؤكد على تنامي ثقة الشركات بأحكام تحصيل 549وصية يف محاكم مركز ديب المايل العالمي ،مما رفع عددها األموال التي تصدرها المحاكم .وارتفع عدد دعاوى اإلنفاذ بنسبة 16٪عن النصف األول من عام ،2018مع تسجيل 101دعوى مقارنة بـ 87يف نفس الفترة من عام .2018

المنتــدى التنفيذي يف 12نوفمبر ،2019أطلقت محاكم مركز ديب العالمي خالل المنتدى التنفيذي لخطة عملها ،2021-2020كاشفة فيها النقاب عن إستراتيجيتها للسنتين القادمتين .وتقدم خطة العمل خارطة طريق إىل المستقبل لمحاكم المركز بصفتها إحدى مؤسسات الخدمات العامة يف دولة اإلمارات .وجمعت هذه الفعالية األوىل والفريدة من نوعها ،التي أقيمت برعاية فخرية من صاحب السمو الشيخ مكتوم بن محمد بن راشد آل مكتوم ،نائب حاكم ديب ورئيس مركز ديب المايل العالمي ،نخبة من قيادات المركز يف ديب وعموم دولة اإلمارات ،إضافة إىل لفيف من المسؤولين الحكوميين رفيعي المستوى للمساعدة يف المضي نحو تحقيق رؤية اإلمارات.

من كافة أنحاء منطقة دول مجلس التعاون وخارجها .فيمكن ألطراف أي اتفاق اختيار اللجوء إىل اختصاص محاكم المركز بالنص على ذلك يف العقد ،بغض النظر عما إذا كان االتفاق له عالقة بالمركز أم ال. وقد أدركت محاكم المركز الحاجة إىل خدمات لحل النزاعات تلبي المطالب التي تقف يف وجهها العوائق التنظيمية والجغرافية التقليدية .ومع أن لكل دولة يف العالم نظام ما لتسوية النزاعات التجارية ،أدركت الدول األعلى تصنيفاً ،وكذلك عدد متزايد من االقتصادات الناشئة ،أن االستثمار يف محاكم مختصة باألعمال تتمتع بالكفاءة واالحترام ليس ترفا ً من الجميل امتالكه بل هو حاجة ال بد منها إذا ما أرادت هذه الدول المنافسة عالميا ًعلى استقطاب االستثمارات.

رســالة رئيــس المحاكم مرحبا ً بكم يف النشرة النهائية لمحاكم مركز ديب المايل العالمي لعام .2019 ٌ عالقات وطيدة بطائف ٍة لطالما جمعت محاكم مركز ديب المايل العالمي واسعة من الشركاء .وقد سعينا خالل عام 2019لبناء شبكة عالقات جديدة وترسيخها مع العديد من المؤسسات يف ديب واإلمارات العربية المتحدة .وأثمر ذلك عن إبرام عدد من اتفاقيات التعاون مع بعض هذه المؤسسات ،وكان الهدف من ورائها نشر خدمات محاكم مركز ديب المايل العالمي وتوسيع نطاقها. فقد أبرمت كل من محاكم مركز ديب المايل العالمي ودائرة األراضي واألمالك بديب اتفاقية تعاون تتيح عروض الخدمة العامة للمحاكم عبر مركز خدمات الوصايا ،وتعزز الخدمة العامة التي توفرها دائرة األراضي لمشتريالعقارات. محمد بن راشد وإضافة إىل ذلك ،تم إبرام اتفاقية تعاون مع مؤسسة ّ لتنمية المشاريع الصغيرة والمتوسطة ،بوصفها مؤسسة منبثقة عن دائرة التنمية االقتصادية بديب ،المكلفة بتطوير قطاع المشاريع الصغيرة والمتوسطة .وتنص االتفاقية على تعاون الجانبين لتمكين محمد بن راشد لتنمية المشاريع شركات األعضاء يف مؤسسة ّ الصغيرة والمتوسطة من الوصول إىل المعلومات والخدمات التي تقدمها محاكم المركز ،ومنها محكمة الدعاوى الصغيرة. وإذا ما استعرضنا هذه االتفاقية ندرك مدى وحدة رسالة الطرفين، وسعيهما المشترك لدعم القطاع المتنامي للمشاريع الصغيرة والمتوسطة .فمن خالل االستفادة من خبرات محاكم مركز ديب المايل العالمي الواسعة يف مجال الوساطة ،شهدت خدمات محكمة الدعاوى الصغيرة رواجا ً متزايدا ً يف أوساط األفراد والشركات بإمارة ديب ودولة اإلمارات العربية المتحدة لتتخطى حدودهما إىل البلدان األخرى. محمد ويحدونا تفاؤل عظيم حيال مستقبل التعاون مع مؤسسة ّ بن راشد لتنمية المشاريع الصغيرة والمتوسطة من حيث إحاطة المجتمع بالنهج المبسط الذي انتهجناه لفض المنازعات ،يضاف إىل ذلك المقدرة على توفير خدمات استشارية أكثر قوة وابتكارا ً لحل القضايا بكفاءة عالية. كما وقعنا يف 2019اتفاقيات تعاون جديدة مع بعض المناطق الحرة كمنطقة رأس الخيمة االقتصادية (راكز) ،وجددنا عددا ً من اتفاقيات التعاون القائمة مع بعض المناطق الحرة كمركز ديب للسلع المتعددة وسلطة المنطقة الحرة لجبل علي ،يف إطار حرصنا على تبادل المعرفة واألفكار والدراسات والبحوث ،وكذلك المشروعات المشتركة. وال ب ّد من التنويه أيضا ً أن محاكم مركز ديب المايل العالمي عقدت يف نوفمبر 2019المنتدى التنفيذي األول ليكون ملتقى يجتمع تحت مظلته وفود المحاكم اإلماراتية والوزارات والدوائر الحكومية والمناطق الحرة ،جنبا ً إىل جنب مع كبار المسؤولين التنفيذيين من القطاع الخاص ،الذين تجمعهم رسالة واحدة تتمثل يف النهوض بالقيادة الفكرية ومناقشة التطورات المستقبلية .ويعد التزام دولة اإلمارات العربية المتحدة بتوفير بيئة عمل عالية التنافسية داعما ً مهما ً لرؤيتها للتنوع االقتصادي على المدى البعيد .وسيكون لقدرة النظم القضائية
يف دولة اإلمارات العربية المتحدة على دعم وحماية الشركات العاملة يف الدولة دورا ً مهما ً يف بلورة األهداف طويلة األجل للدول الستقطاب االستثمارات األجنبية واالحتفاظ بها. وقد أقيم هذا المنتدى الفريد ،واألول من نوعه ،تحت الرعاية الكريمة لصاحب السمو الشيخ مكتوم بن محمد بن راشد آل مكتوم ،نائب حاكم ديب رئيس مركز ديب المايل العالمي ،ومنُح شركاؤنا شهادات تقدير كتكريم متواضع لهم. كما انتقلت محاكم مركز ديب المايل العالمي سريعا ً من نجاح إىل نجاح كمحاكم تجارية عالمية رائدة .ومما زاد من صدى شهرتنا وتم ّيزنا القضايئ أننا أضفنا إىل خبرة القضاة يف شهر ديسمبر من هذا العام اثنين من أشهر القضاة يف أستراليا ،هما القاضي وين مارتن ،الحاصل على وسام الشرف األسترايل ،والمستشار القانوين للملكة ،القاضي روبرت فرنش. وبوجيز العبارة ،فإن محاكم مركز ديب المايل العالمي مهدت الطريق يف 2019أمام تفوقنا المستقبلي يف قادم السنين .ونؤكد تمسكنا بالتزامنا بإعالء أرفع المبادئ وتقديم أفضل الخدمات لمتعاملي المحاكم .وإننا لنفخر بأن تبقى سمعتنا المرتبطة بالتميز أهم ما يجذب المتقاضين الناشدين للعدالة مستقبالً .ولقد تكللت جهودنا بالنجاح يف مسعانا ألن نحرز قصب السبق يف التطورات التقنية ،وهذا ما يحدونا إىل مواصلة البحث عن كل سبيل نحقق به تطورنا وتقدمنا.
