Message from the Director Welcome to the second DIFC Courts Bulletin of 2021. On behalf of the DIFC Courts I would like to extend my best wishes and prayers to you all. I also wish to extend my gratitude to Dubai’s leadership for placing their trust in me to lead the DIFC Courts through the next chapters of its development. I have witnessed the growing maturity of our young jurisdiction – ever-growing yet maintaining our nimbleness to absorb and re-engineer how we best deliver our services to the public. We continue to develop industry-leading channels to equip our court users with the most advanced tools, creating legal security and certainty for businesses in an era of technological disruption. By combining a modern and flexible digital infrastructure with judicial and service excellence, we believe we are setting the new standard for cultivating access to justice. Judicial excellence reached a new milestone in 2021 when we appointed the next generation of Emirati judges to our Court of First Instance. This follows a decade of dedicated strategy, wherein Emirati judges and registry staff engaged in international training; self-development programmes; drafting rules for the courts; spearheading the introduction of the Small Claims Tribunal (SCT); overseen major commercial and civil cases; forged deep working relationships with regional and global commercial courts; and, driven up service standards and increased administrative efficiency. The launch of the of our Emiratisation Development of Judicial Excellence (EDJE) programme in 2019 is designed specifically to fulfil a three-tier strategy of: (i) increasing the number of Emiratis within the organisation; (ii) developing and retaining talent, and (iii) incubating new talent through graduate programmes. Given the events of the past 24 months, the DIFC Courts continued its ambitious digital transformation drive in 2021, recording over 90% virtual hearings. We pushed further still as the first court in the UAE to acquire the qualified electronic seal solution Ethaq, a paperless initiative that enables digital authenticity of documents with the support of UAE PASS, the secure national digital identity platform for the United Arab Emirates. Digital resources for our Wills Service were further enhanced with the completion of the Full Will template as part of the automated Will drafting facility. The online system also provides comprehensive explanatory notes, should you wish to draft the will yourself. This follows a regional first introduction in 2020 that now enables testators to register their Will remotely through videoconferencing, from the safety and comfort of your own home. In November 2021 the DIFC Courts officially confirmed 100% of internal processes and customer-facing services as now operating fully digital. This follows Dubai’s ambitious Paperless Strategy launched in 2018 by His Highness Sheikh Hamdan Bin Mohammed Al Maktoum in 2018.
I am proud to also confirm that in 2021 the DIFC Courts received three (3) industry leading awards for technology implementations in support of its digital infrastructure. Awards received included Best Blockchain Focused Document Authentication Initiative, Innovative Initiative of the Year, and Best Digital Government Experience. In 2022, we will be launching Phase 2 of our Court Tech Lab initiative, a project built, launched, and progressed to position Dubai as the city that pioneers new industryspecific technologies. This initiative is a world first and it brings exciting new developments within the sphere of court-specific technologies and how we best deliver access to justice. Lastly, but certainly not least, the DIFC Courts has very recently confirmed the launch of the Digital Economy Court, activated to streamline all complex civil and commercial disputes related to the worldwide digital economy. Leading international judicial expertise and the development of domestic Emirati expertise through our EDJE programme, is currently being assigned to oversee and operate the new Court’s cutting-edge digital infrastructure and service capabilities and will run concurrently alongside the recruitment of a global panel of lawyers and industry experts to draft and confirm new specialised Rules for the Digital Economy Court, which will then be released under a 30-day public consultation.

DIFC Courts absorbs escalation of commercial claims with huge increase in virtual hearings In July, the DIFC Courts released its figures for the first six months of 2021, confirming a maturing trend of significant year-on-year increases in claims filed with Dubai’s Englishlanguage common law jurisdiction. Since the onset of the COVID-pandemic in 2020, the DIFC Courts has evolved rapidly to introduce increased remote hearings and digital capabilities, whilst increasing operational efficiency. With 100% of hearings now taking place remotely through digital platforms in 2021, court users have greater choice and flexibility across core service offerings, ensuring more expedient access to justice. The rapid transition to fully digital remote hearings also aligns the DIFC Courts with the directive issued in June 2021 by His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President, Prime Minister and Ruler of Dubai, with the Ministry of Justice instructed to hold 80% of litigation sessions virtually on a permanent basis before the end of 2021. The volume of cases in the main Court of First Instance (CFI) increased by 11% in 2021, from the same period in 2020. The total value of cases across the CFI in the same period amounted to AED 2.8 billion, an increase of 27% year-on-year, with an average case value of AED 56.9 million. Cases within the Arbitration Division under the CFI

also recorded an increase of 36% in 2021. The total value of claims across all Divisions amounted to AED 3.4 billion. Cases brought before the CFI covered a range of sectors including banking and finance, construction, real estate, and manufacturing and involving disputes related to breach of contract, outstanding payments, Wills & Probate, and employment. There was also a noticeable number of ‘opt-in’ cases for the first six months of 2021, with 50% of claims in the CFI cases originating from parties ‘electing’ to use the DIFC Courts to resolve their disputes. Reinforcing the Courts’ record of certainty for business through enforceable judgments, the total value of enforcement claims filed amounted to AED 568 million for the first half of 2021, an increase of 198% year-on-year. The total number of enforcement claims recorded an 8% increase, compared with the first six months of 2020. The operational capacity of the region’s first Small Claims Tribunal (SCT) was strong in the first six months of 2021, with 201 claims filed and overall claim value totaling AED 20 million. Claims were driven primarily by disputes involving breach of contract, employment, banking & finance, and property & tenancy. Greater awareness and the innovative use of technology, including the region’s first “Smart SCT” virtual court, has led to over 64% of claims
registered originating from parties selecting the SCT as their preferred method for dispute resolution. The SCT also held 100% of consultations and hearings in the first six months of 2021 across its digital remote platforms. Zaki Azmi, Chief Justice, DIFC Courts, said: “The growing maturity of the DIFC Courts is now reflected in the increased awareness of, and trust in, our ability to not only offer world class access to court services, but also to ensure the highest standard of judicial expertise and oversight. We continue our drive towards full digital transformation and equipping our court users with the most advanced tools, creating legal security and certainty for businesses in an era of technological disruption. By combining a modern and flexible digital infrastructure with judicial and service excellence, the DIFC Courts now represents the new benchmark for international commercial courts.” In the first six months of 2021, the DIFC Courts became the first court in the UAE to acquire the qualified electronic seal solution Ethaq, a paperless initiative that enables digital authenticity of documents with the support of UAE PASS, the secure national digital identity platform for the United Arab Emirates. Ethaq certificate is powered by Dubai Electronic Security Center (DESC). It recognises the DIFC Courts as the first Dubai entity to acquire the entirely paperless certificate that enables court documents to be electronically signed, issued, and authenticated, providing an end-to- solution that combines both an electronic seal and an electronic signature solution based on digitally verifiable identities. The electronic seal Ethaq will also reinforce the security and integrity of the documentation and eradicates tampering of official documents, enabling users to digitally verify the authenticity of any legal documents through the DIFC Courts website. In 2021 DIFC Courts and the Dubai Future Foundation (DFF) launched a new Courts of the Future initiative, activating Courts of Space. The launch of the project signals to the international space community the intent of the UAE to play a leading role in advancing its judicial systems to specifically direct capacity and capability to commercial space-related disputes.
Consisting of public and private sector bodies and experts, a Working Group has also been tasked with exploring space-related legal innovations and providing an outlook on potential outcomes of scenarios revolving around space-related disputes. Among the many technologies the Courts has pioneered to re-engineer and increase access to justice, is the region’s first e-Registry in 2009, digitally integrated courtroom and state-of-the-art e-Court Management System (CMS) in 2017, as well as the region’s first ‘paperless’ e-bundling solution in 2018. Special project initiatives under the Courts of the Future have also assisted the DIFC Courts with advance R&D activities, uniting individuals and companies helping to prototype and launch the advancement of court technology, such as blockchain-powered initiatives, AIenabled programmes, and cloud-based solutions. As well as reinforcing the current panel of judges in 2021 with additional prominent international expertise from the UK, the DIFC Courts achieved a new milestone by appointing the next generation of Emirati judges with trans-systemic expertise across civil and common law. The appointments by His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President, Prime Minister and Ruler of Dubai, also confirms the DIFC Courts as the first court in the world to appoint a female Emirati judge to a common law court. In line with the DIFC Courts’ continued mission to engage with entities across the UAE and beyond for cooperation and collaboration, new alliances with several UAE entities were also forged in the first half of 2021 – from Chambers of Commerce to free zone authorities and construction developers, such as Emaar Properties. In 2021, international judicial relationships with several court systems across the globe, from Ireland to Brazil, are also being finalised.

Deputy Ruler of Dubai H.H. Sheikh Maktoum Bin Mohammed Al Maktoum appoints new Director to the DIFC Courts
In September, the Dubai International Financial Centre (DIFC) Courts confirmed the appointment of His Excellency Justice Omar Al Mheiri to the position of Director by His Highness Sheikh Maktoum bin Mohammed bin Rashid Al Maktoum, Deputy Ruler of Dubai, and President of the DIFC. This appointment follows the release of Law No. 5 of 2021, which outlines the new appointment and duties of the Director, wherein the Director will assume full responsibility for the general supervision of the administrative affairs of the DIFC Courts, in addition to his duties as the Deputy Chief Justice of the DIFC Courts. Zaki Azmi, Chief Justice, DIFC Courts, said: “I have had the privilege of working alongside the Deputy Chief Justice for almost eight years, during which time he has played an integral role in securing the DIFC Courts’ status as one of the leading commercial courts. His vision and leadership have, more recently, been demonstrated with his tremendous guidance in navigating our journey through the unprecedented COVID-19 pandemic. I look forward to continuing my close working alliance with His Excellency Justice Al Mheiri to ensure the DIFC Courts continues to contribute to the overall value proposition of the DIFC, Dubai, and the UAE.” His Excellency Justice Omar Al Mheiri has been with the DIFC Courts since its operational inception in 2005 and brings to this position a wealth of knowledge and experience across both judicial and administrative functions. Speaking on his new appointment, His Excellency Justice Omar Al Mheiri, said: “The experience I have gained working at the DIFC Courts for over 16 years has been invaluable and it is an honour and privilege to now undertake the role of Director. We have been successful in our aim to lead the way in technical advances and are consciously looking at ways in which to improve and progress. We remain committed to upholding the highest of standards and providing the best quality service for our court users, delivering the necessary climate of certainty that will support the nations’ overarching visions to diversify and grow the economy.” His Excellency Justice Omar Al Mheiri began his judicial career via Dubai Police and as a prosecutor with Dubai Prosecution. With judicial experience spanning across Dubai Courts and the DIFC Courts over the past 30 years, His Excellency Justice Omar Al Mheiri has had the unique opportunity to leverage his transsystemic expertise across both civil and common law jurisdictions. In more recent years, His Excellency Justice Omar Al Mheiri has also been assigned to consult as a Council Member for the Dubai Courts Advisory Council and the Dubai Supreme Legislative Committee.

particularly where both sides of a dispute are represented by persuasive lawyers. Whilst the heavy responsibility of deciding cases rests on the shoulders of the judge, his or her judicial clerk must provide assistance befitting of that responsibility. In practical terms this means leaving no stone unturned, whatever task has been given to me, and occasionally turning them a second or third time for good measure. What are the qualities that make a good judicial clerk?
Ayman Saey Can you describe a day in your life as a judicial clerk? I start my days with a cup of coffee; and that is generally where daily routine ends. Judicial clerks provide assistance to judges and the form that assistance takes is determined by the judge’s work which is determined in turn by the disputes brought to the Court. No two cases are identical and similarly my work has a good amount of variety in it. Some days feature more legal research and others more drafting. Many days include grappling with unfamiliar concepts. I attend hearings also and engage in discussions with judges about cases. The last two activities make for the most enjoyable days. What is the biggest challenge you face? I think the biggest challenge I face as a judicial clerk relates to responsibility. The judges I assist are tasked with hearing disputes and in most cases will resolve them by compulsion in the form of court orders. Frequently, a correct decision can be arrived at only with effort,
I think judicial clerks are like cases: in the end, it is for the judge to decide what makes a good one. Different judges go about their work in different ways and so the assistance required by one judge will differ to that required by another. Generally speaking, however, I think a judicial clerk should be attentive, hardworking, conscientious, optimistic, organised, proactive, responsive, meticulous, determined, flexible and enthusiastic. What advice would you give to your younger self and those who want to enter the legal profession? I wasted a lot of time reading books unrelated to law. I think I would advise my younger self to waste twice as much time! I am constantly seeing how past explorations in seemingly remote subject areas lend support the tasks I do in this job, directly or indirectly. And language plays a central role in law, so it is helpful in my opinion to be interested in language and how it is used and can be interpreted, or the “playing along with the play of language” as it has been put, not least because good lawyers are usually very skilled at that. To those wanting to enter the legal profession, my advice would be to explore all the options you have and keep an open mind. Competition to enter the profession is usually fierce. But I think this is partly because most aspirants converge at only a handful of “gateways”. Most will aspire to be solicitors or barristers but a fulfilling and accomplished career - a dream career - as an arbitrator, mediator or court registrar, for example, may await you; where you are currently based or perhaps elsewhere.

DIFC Courts launches Digital Economy Court
In December, the DIFC Courts announced the launch of a new global Digital Economy Court, activated to streamline all complex civil and commercial disputes related to the worldwide digital economy. The dedicated Court will specialise in addressing sophisticated national and transnational disputes related to current and emerging technologies across areas ranging from big data, blockchain, AI, and cloud services, to disputes also involving unmanned aerial vehicles (UAVs), 3D printing, and robotics. Leading international judicial expertise is currently being recruited to oversee and operate the new Court’s cutting-edge digital infrastructure and service capabilities, complementing an existing portfolio of specialised Divisions, including the Technology & Construction Division and the Arbitration Division, launched by the DIFC Courts to serve an expanding demand for judicial expertise across sector-specific cases. In early 2022, the DIFC Courts will also establish a global panel of lawyers and industry experts to draft and confirm new specialised Rules for the Digital Economy Court, which will then be released under a 30-day public consultation. In 2021, the UAE government also announced several core initiatives related to future digital economy requirements and the nation’s strategic roadmap, including a taskforce of government and business leaders to think beyond the pandemic to a digital economy fueled by imagination. Supporting projects such as Pioneers of the Digital

Economy, an initiative which aims to enhance capabilities of young talents and develop advanced future technology, reinforce charter plans announced in 2021 under ‘The Principles of the 50’, as part of the ‘Projects of the 50’. The 10 principles act as guidelines for all UAE’s institutions as the country approaches a new phase of development. His Excellency Justice Omar Al Mheiri, Director, DIFC Courts, said: “The ability of the UAE’s judicial systems to support and protect business continuity will prove crucial to the nations’ long-term objective to attract and retain foreign investment. Dubai’s strong commitment to providing a highly competitive business environment is also crucial to its long-term vision of economic diversification. The launch of the Digital Economy Court signals to the international business community the intent of Dubai to play a leading role in advancing its judicial systems to specifically direct capacity and capability to resolving digital economy-related disputes, whilst also utilising some of the very same cutting-edge technologies to enable greater efficiency of service to the public. This Court is a world first and it brings exciting new developments within the sphere of how we best deliver access to justice, not just to those businesses operating in the UAE, but also to global businesses wishing to opt-in to our neutral jurisdiction.”

It was established with the specific objective to enable the international community in the UAE to have greater confidence in the Emirate’s legal framework and to further strengthen investment and trade relations with Dubai and the UAE. In 2011, the jurisdiction of the DIFC Courts was extended beyond the financial centre for international businesses, thereby enabling any two parties from any global location to use the DIFC Courts by ‘opting-in’ to this neutral global jurisdiction. In 2017, the think tank Courts of the Future was launched by the DIFC Courts and the Dubai Future Foundation (DFF) with a mandate to explore diverse legal technology topic areas and to provide research and thought leadership on promoting and encouraging contemporary methods of greater accessibility and efficiency to court users across the globe. This think tank has enabled the DIFC Courts to streamline its major Court tech projects under the Courts of the Future, pooling talent and resources from global partners and experts across the fields of law, technology, and business, assembled to help courts systems accommodate and leverage emerging technologies.

for applications and hearings were extended, as well as the issuing of digital Orders and Judgments, and court users were able to access all extensive ‘eServices’ remotely.
Following the launch of the Dubai Paperless Strategy by His Highness Sheikh Hamdan Bin Mohammed Al Maktoum in 2018, the DIFC Courts accelerated the integration of all services into its extensive digital infrastructure.
During the pandemic the DIFC Courts also injected fresh digital systems for the registration of Wills; the new video conferencing facility can be accessed via a smartphone, tablet, or a desktop device. This new digital offering is part of the existing Virtual Registry, which allows those living overseas to create and register a DIFC Courts Will. Investors and former residents can access it from anywhere in the world and be connected, via video link, to a compliance officer sitting in Dubai.
Announced the same week as the launch of the Paperless Strategy, in February 2018 the DIFC Courts initiated the introduction of ‘paperless trials’, implementing the region’s first Courts eBundling system. The secure cloud-based technology allows court documents to be uploaded from anywhere in the world, enabling judges, lawyers, and courts staff to access case information in various formats, across multiple locations, and share with numerous users. As a part of the UAE Government’s commitment to effectively employ advanced technologies and digital platforms to continue services to the public, the DIFC Courts leveraged its digital infrastructure to stay connected with court users during COVID-19 restrictions. EXECUTIVE INTRODUCTION
I welcome you to the DIFC Courts Strategic Work Plan 2022 – 2024. When looking at global legal infrastructures, it becomes apparent that the challenges for commercial dispute resolution run much deeper than superficial procedural obstacles. Perceptions need to change from the Courts as a concrete building to a trustworthy service provider. Dispute resolution needs to be more about providing a service – helping people resolve problems they can’t work out themselves.
Adopting user-friendly procedures, reinforcing the overall courts experience is crucial as a steppingstone to building trust. Effective and lessexpensive access to dispute resolution procedures and regulatory systems need to work in tandem with governments that ensure the rule of law is being honoured. Encapsulated within a four-pillar mandate, our new three (3) year Strategic Work Plan ensures a continued push to integrate the highest international standards of legal procedure and accessibility to court services, thus ensuring business certainty, flexibility and efficiency expected by the global institutions operating in, with and from Dubai and the UAE.
Traditional legal systems often increase fear and anxiety in claimants and defendants across the globe. The physical nature of a traditional court room has allowed for a perception of being a place that is out of touch and too traditional to solve complex and far-reaching disputes. In some cases, this is further amplified by systems that are often outdated, hindered by a shortfall in attempts to adopt modern, practical technology. There is discussion in recent times of artificial intelligence and how it can revolutionise the legal sector. At a very practical level, some dispute
resolution centres are failing to even introduce intelligent automation. It has caused many courts around the world to lag in solving disputes, including arbitration, mediation, or private sector resolutions.
So, the obvious question is: what will the courts of the future look like? We can already say with some certainty that technology will enable them to bridge barriers of language, borders, jurisdiction and currency. For example, AI can reduce clerical burdens, help streamline the case review methodology, create a realistic virtual presence, remove document duplications, and unlock time to take on significantly more complex tasks. This new era of legal technological disruption, working to replace outdated processes with digital technology, is the key to creating real legal efficiency, even during these uncertain times. We start by ensuring that our court systems are smart, hyperconnected and nimble enough to keep pace with global commerce. The DIFC Courts plays an important role in supporting Dubai’s status as a global business hub by engendering trust, confidence, and certainty. Responding to today’s dynamic fast-evolving world, we drive initiatives toward judicial excellence; service excellence; connectivity; and innovation.
Since inception, the DIFC Courts offers a uniquely international and experienced bench able to deal with the most complex transnational disputes. Studies have shown that a well-run and diverse judiciary can have a very real impact on economic growth, with markets with effective commercial justice regimes estimated to grow half a percentage point faster than those without. We were the first court in the world accredited to the International Standards for Service Excellence (TISSE). Research has shown that the better the service a court offers, the higher the chance of the parties settling, which must be the driving preference behind any dispute resolution mechanism. The perception of justice in the market has as much to do with how people view the journey through the courts, as the decision at the end.
Formalising links with our colleagues across the UAE and the world brings additional certainty to business and enables us to support legal excellence through swift enforcement procedures. The interest charged on loans, for instance, is influenced by the risk of a default not being enforced by domestic courts. Evidence suggests that the disparity between credit rates in markets with good commercial courts to those without is as much as 200 basis points. The current coronavirus pandemic has propelled the world into a new, digitally reliant era as
people adapt to remote working. Public and private entities have implemented and introduced various digital mediums to stay connected with clients and customers, ensuring that business can continue and, ultimately, that the economy can be strengthened in these difficult times. المقدمة التنفيذية
أرحب بكم يف مستهل خطة العمل االستراتيجية لمحاكم مركز ديب المايل العالمي .2024 – 2022 عند التمعن يف البنى التحتية القانونية العالمية ،يتضح لنا أن تحديات حل النزاعات التجارية أعمق بكثير من العقبات اإلجرائية السطحية .فال بد من تغيير التصورات عن المحاكم من كونها مجرد مبنى مادي ملموس إىل النظر إليها باعتبارها مزود خدمة جدير بالثقة .وال بد من النظر إىل جوهر حل النزاعات باعتباره يُعنى أ كثر بتقديم خدمة – أي مساعدة الناس يف حل النزاعات التي ال يمكنهم حلها بأنفسهم.
يعد اعتماد إجراءات سهلة على المستخدمين وتوفير تجربة أفضل لهم يف التعامل مع المحاكم بشكل عام أمرا ً بالغ األهمية كحجر أساس لبناء الثقة .وال بد من التناغم بين تيسير إمكانية الوصول الفعّ ال واألقل تكلفة إىل إجراءات تسوية المنازعات واألطر التنظيمية وبين ضمان الحكومات الحترام سيادة القانون.
ويف هذا السياق ،ترمي خطة العمل اإلستراتيجية الجديدة الممتدة لثالث ( )3سنوات ،ضمن إطار مهمة تقوم على أربع ركائز ،إىل ضمان مواصلة التقدم يف دمج أعلى المعايير الدولية يف اإلجراءات القانونية وتيسير سبل الوصول إىل خدمات المحاكم، وبالتايل ضمان الموثوقية والمرونة والكفاءة يف عالم األعمال بالدرجة التي تتوقعها المؤسسات العالمية التي تعمل يف ديب واإلمارات العربية المتحدة عموما ً أو انطالقا ً منهما. فغالبا ً ما تزيد النظم القانونية التقليدية من مخاوف وقلق المدعين والمدعى عليهم يف جميع أنحاء العالم .فقد أفسحت قاعة المحكمة التقليدية المجال ليكون التصور عن المحكمة باعتبارها منفصلة عن مستجدات الواقع وتقليدية لدرجة تجعلها غير قادرة على حل النزاعات المعقدة والبعيدة المدى .ويف بعض الحاالت ،يزداد هذا الوضع تفاقما ً بفعل األنظمة التي غالبا ً ما تكون قديمة ويعوقها القصور يف مساعي تبنّي وموا كبة التكنولوجيا الحديثة والعملية. وثمة نقاش يف اآلونة األخيرة يدور حول الذكاء االصطناعي وكيف يمكن أن يُحدِث ثورة يف القطاع القانوين .ففي بعض النواحي العملية تفشل بعض مرا كز حل النزاعات حتى يف إدخال تقنيات األتمتة الذكية .ولقد تسبب ذلك يف تأخر العديد من المحاكم يف مختلف أنحاء العالم يف حل النزاعات ،كقضايا التحكيم أو الوساطة أو تسوية قضايا القطاع الخاص. لذلك ،فإن السؤال الذي يطرح نفسه بوضوح هنا هو :كيف ستكون محاكم المستقبل؟ يمكننا من اآلن أن نقول بشيء من
اليقين أن التكنولوجيا ستمكن محاكم المستقبل من التغلب على حواجز اللغة والحدود وواليات االختصاص القضايئ والعُ مالت. فعلى سبيل المثال ،يمكن لتقنيات الذكاء االصطناعي التقليل من أعباء العمل المكتبي يف المحاكم ،والمساعدة يف تبسيط منهجية مراجعة الدعاوى ،وتوفير إمكانية المثول يف الواقع االفتراضي، واالستغناء عن نسخ المستندات المكررة ،وتوفير الوقت لتكريسه إلنجاز المزيد من المهام األكثر تعقيدا ً. إن هذه الحقبة الجديدة من التطورات التكنولوجية النوعية يف المجال القانوين ،التي تعمل على استبدال تقنيات رقمية حديثة مكان إجراءات العمل القديمة التي عفا عليها الزمن ،هي المفتاح لتوفير الكفاءة القانونية الحقيقية ،حتى يف هذه األوقات المليئة باالضطرابات التي يمر بها العالم .ونبدأ ذلك بالتأكد من أن أنظمة المحاكم لدينا تتمتع بالذكاء والترابط الكافية لموا كبة سرعة التجارة العالمية. تؤدي محاكم مركز ديب المايل العالمي دورا ً مهما ً يف دعم مكانة ديب كمركز عالمي لألعمال من خالل تعزيز الثقة والطمأنينة واليقين. واستجابة لعالمنا اليوم وما يتسم به من ديناميكية وتطور سريع، نطلق المبادرات الرامية للتميز القضايئ؛ والتميز يف الخدمات؛ والترابط؛ واالبتكار. ومنذ إنشائها ،توفر محاكم مركز ديب المايل العالمي هيئة من القضاة الدوليين ذوي الخبرة والمقدرة على التعامل مع أ كثر النزاعات العابرة للحدود الوطنية تعقيدا ً .وقد أظهرت الدراسات أن النظام القضايئ المتنوع المتمتع بحسن اإلدارة يمكن أن يكون له تأثير حقيقي وقوي على النمو االقتصادي ،إذ تشير التقديرات إىل أن األسواق التي تحظى بأنظمة عدالة تجارية فعالة تنمو نموا ً أسرع من األسواق التي ال تمتلك مثل هذه األنظمة بمعدل نصف نقطة مئوية. ولذلك كنا أول محكمة يف العالم تحظى باالعتماد وفقا ً للمعايير الدولية لتميّز الخدمة ( .)TISSEوقد أظهرت األبحاث أنه كلما كانت
الخدمة التي تقدمها المحكمة أفضل ،زادت فرصة تسوية النزاعات بين األطراف ،والتي ينبغي أن تكون الغاية المفضلة التي تسعى إليها أي آلية لحل المنازعات .إن التصورات السائدة عن مدى العدالة القائمة يف السوق تنبع من نظرة الناس إىل مسيرة التعامل مع المحاكم بنفس القدر الذي تنبع فيه من القرار الذي تتخذه المحاكم يف النهاية. إن إضفاء الطابع الرسمي على عالقاتنا وصالتنا مع زمالئنا يف جميع أنحاء دولة اإلمارات والعالم يمنح دوائر األعمال مزيدا ً من اإلحساس بالطمأنينة والثقة ويتيح لنا دعم التميز القانوين من خالل إجراءات التنفيذ السريعة .فمعدل الفائدة المفروضة على القروض ،على سبيل المثال ،يتأثر بمدى المخاطر المتصورة من عدم تنفيذ المحاكم المحلية لألحكام .ويف هذ الصدد تشير األدلة إىل أن التباين بين التصنيفات االئتمانية لألسواق ذات المحاكم التجارية الجيدة واألسواق التي تفتقد ذلك يصل إىل 200نقطة أساس. وقد دفعت جائحة فيروس كورونا العالم إىل عصر جديد أشد اعتمادا ً على التكنولوجيا الرقمية إذ بدأ الناس يتكيفون مع أساليب العمل عن بعد .وقامت مؤسسات وكيانات القطاعين العام والخاص بتنفيذ وطرح العديد من الوسائل الرقمية المتنوعة للبقاء على اتصال مع عمالئها وزبائنها ،بما يضمن
استمرار األعمال التجارية ،ويف نهاية المطاف ،يمك ّن من دعم وتعزيز االقتصاد يف هذه األوقات الصعبة. ويف هذا اإلطار ،لعبت التكنولوجيا دورا ً محوريا ً يف النموذج التشغيلي لمحاكم مركز ديب المايل العالمي منذ بدء عملياتها قبل أ كثر من عقد من الزمان ،وكان لنا األسبقية يف االبتكارات ذات الصلة ،األمر الذي مكننا من إحداث نقلة نوعية من النظر إىل “المحاكم كمكان” إىل “المحاكم كخدمة”. إن تطلعات القطاع الخاص تتطلب أ كثر فأكثر المشاركة الجريئة من جانب قطاع الخدمة العامة .ولقد استثمرنا بشكل كبير يف التقنيات المستجدة للبقاء يف طليعة الركب .ولعل الوصول الفوري إىل المعلومات كان له التأثير األكبر على الطريقة التي ندير بها عملياتنا ،لما له من أهمية خاصة يف القطاع القانوين ،حيث يجب أن تكون مجاميع البيانات الضخمة متاحة بسهولة. وتطمح محاكم مركز ديب المايل العالمي ،من خالل التواصل المستمر مع األنظمة القضائية حول العالم ،إىل المساهمة يف توفير ميدان متنافس ومتكائف الفرص لألفراد والشركات ،من خالل إعادة هندسة طريقة تصميم سبل الوصول إىل العدالة وتحقيقها .ونرى اآلن أن المنصات الرقمية المتزايدة واعتماد اإلجراءات غير الورقية وجلسات االستماع االفتراضية أصبحت هي الواقع الجديد.

ديب المايل العالمي ،وتوحيد جهود األفراد والمؤسسات يف وضع النماذج األولية وإطالق تكنولوجيا المحاكم ،كالمبادرات التي تعمل بتقنية “بلوكتشين” ،والبرامج التي تدعم الذكاء االصطناعي ،والبرامج المستندة إىل حلول الحوسبة السحابية. يف هذا السياق قال سعادة القاضي عمر المهيري ،مدير محاكم مركز ديب المايل العالمي“ :منذ نشأتها ،كانت محاكم مركز ديب المايل العالمي رائدة يف طريقة تقديم خدماتها من خالل وضع التكنولوجيا والبنية التحتية الرقمية يف صميم عملياتها. وسنواصل مسيرتنا نحو التحول الرقمي لتزويد مستخدمينا تقدما ،وضمان األمن القانوين يف عصر االضطراب بأكثر األدوات ً التكنولوجي .ويف عام ،2022سنطلق المرحلة الثانية من مبادرتنا لمختبر تقنيات المحاكم ،وقد تم إنشاؤه وإطالق هذه المبادرة األوىل من نوعها يف العالم لجعل ديب المدينة الرائدة يف مجال التقنيات الجديدة الخاصة بالمحاكم وكيفية الوصول إىل العدالة على أفضل وجه .ومن خالل الجمع بين البنية التحتية الرقمية الحديثة والمرنة والتميز القضايئ والخدمي ،نسعى لوضع معيار جديدة لتعزيز العدالة للشركات العالمية”. ويف مايو ،2021أضافت محاكم مركز ديب المايل العالمي اللمسات النهائية لترسيخ مكانتها كمحكمة ال ورقية بالكامل من خالل الحصول على حل الختم الرقمي “إيثاق” لتمكين المصادقة الرقمية على المستندات ودعم مبادرتها الالورقية، وهو حل قائم على منصة الهوية الرقمية الوطنية اآلمنة لدولة اإلمارات العربية المتحدة (.)UAE PASS ومع اعتماد “ إيثاق” ،أصبحت محاكم مركز ديب المايل العالمي أول كيان يف ديب يعتمد على هذا الحل الالوريق بالكامل لتمكين توقيع وثائق المحاكم وإصدارها والمصادقة عليها إلكترون ًيا .كما يتكامل “إيثاق” ً أيضا مع منصة الهوية الرقمية الوطنية اآلمنة لدولة اإلمارات العربية المتحدة بالتعاون مع ديب الذكية لتوفير حل شامل يجمع بين الختم والتوقيع اإللكتروين استنادًا إىل هويات شخصية يمكن التحقق منها رقم ًيا. سيعزز الختم اإللكتروين من أمن وسالمة التوثيق ومنع التالعب بالوثائق الرسمية ،األمر الذي س ُيمكّن المستخدمين من التحقق من صحة أي مستند قانوين رقم ًيا عبر الموقع اإللكتروين لمحاكم مركز ديب المايل العالمي.
كما انسجم التحول السريع إىل جلسات االستماع الرقمية بالكامل يف عام 2020مع توجيهات صاحب السمو الشيخ محمد بن راشد آل مكتوم ،نائب رئيس الدولة ،رئيس مجلس الوزراء ،حاكم ديب ،بعقد 80٪من جلسات التقاضي افتراضيا بشكل دائم قبل نهاية عام .2021 ويف عام ،2021حصلت محاكم مركز ديب المايل العالمي على ثالث جوائز رائدة يف مجال التطبيقات التكنولوجية لدعم بنيتها التحتية الرقمية .تضمنت جائزة أفضل مبادرة لمصادقة المستندات قائمة على البلوكتشين ،وأفضل مبادرة إبداعية لهذا العام ،وأفضل تجربة حكومية رقمية.

محاكم مركز ديب المايل العالمي تؤكد مكانتها كأول محكمة الورقية يف المنطقة يف نوفمبر ،أ كدت محاكم مركز ديب المايل العالمي نجاحها يف تحويل 100٪من عملياتها الداخلية وخدماتها الموجهة للعمالء إىل معامالت رقمية بالكامل.
فتنفيذا ً لـ “استراتيجية ديب للمعامالت الالورقية” ،التي أطلقها سمو الشيخ حمدان بن محمد بن راشد آل مكتوم يف عام ،2018س ّرعت محاكم مركز ديب المايل العالمي دمج خدماتها ضمن بنيتها التحتية الرقمية الواسعة.
وكانت محاكم مركز ديب المايل العالمي قد أعلنت يف نفس أسبوع إطالق االستراتيجية الالورقية يف فبراير 2018عن مبادرة التقاضي بال ورق ،عن طريق اعتماد أول نظام لإليداع اإللكتروين للمحاكم يف المنطقة .حيث تسمح التكنولوجيا اآلمنة والمستندة إىل الحوسبة السحابية بتحميل مستندات القضايا من أي مكان يف العالم ،ما يمكّن القضاة والمحامين وموظفي المحاكم من الوصول إىل معلومات القضايا بمختلف تنسيقاتها ومشاركتها مع المستخدمين اآلخرين. وكجزء من التزام حكومة اإلمارات بالتوظيف الفعال للتقنيات المتقدمة والمنصات الرقمية لمواصلة تقديم الخدمات إىل الجمهور ،بادرت محاكم مركز ديب المايل العالمي باستحداث وتنفيذ منصات رقمية مختلفة للمحافظة على االتصال مع العمالء والمراجعين طوال فترة الجائحة .حيث مددت خاصية

االتصال عبر الفيديو لتشمل طلبات رفع الدعاوى وجلسات االستماع ،إضافة إىل إصدار األحكام ،ليتمكن مستخدمو المحاكم من الوصول إىل جميع “الخدمات اإللكترونية” الشاملة عن بُعد. ويف عام ،2020طورت المحاكم خاصية إجراء مكالمات الفيديو عبر اإلنترنت لربط المتعاملين مع خدمة تسجيل الوصايا عبر الهواتف الذكية واألجهزة اللوحية والحواسيب .ويتيح هذا الخيار إىل جانب السجل االفتراضي لألشخاص الذين يعيشون يف الخارج إمكانية إنشاء وتسجيل وصية لدى محاكم مركز ديب المايل العالمي ،بحيث يمكن للمستثمرين والمقيمين السابقين والحاليين الوصول للسجل االفتراضي من أي مكان حول العالم عبر ربطهم بمكالمة فيديو مع موظف ٍ السجل يف ديب. ومن بين العديد من التقنيات التي قامت محاكم مركز ديب المايل العالمي بتبنيها لزيادة الوصول إىل الخدمات نظام الرفع اإللكتروين للدعاوى ،والذي كان األول من نوعه يف المنطقة عند طرحه يف عام 2009؛ إىل جانب قاعة المحكمة المتكاملة رقم ًيا مع أحدث نظم إدارة المحاكم اإللكترونية يف عام .2017 كما ساعدت المبادرات الخاصة تحت إطار “محاكم المستقبل” على دفع أنشطة البحث والتطوير المتقدمة يف محاكم مركز
رقمي يغذيه الخيال المبدع ،ودعم مشاريع مثل رواد االقتصاد الرقمي ،وهو عبارة عن مبادرة تهدف إىل تعزيز قدرات المواهب الشابة وتطوير تقنيات المستقبل المتقدمة ،وتعزيز خطط الميثاق التي أُعلن عنها يف عام 2021تحت عنوان “مبادئ الخمسين” ،كجزء من “مشاريع الخمسين” .توفر هذه المبادئ العشرة إرشادات توجيهية لجميع المؤسسات يف دولة اإلمارات مع اقتراب الدولة من عتبة مرحلة جديدة من التطور.
وتوفر محاكم مركز ديب المايل العالمي التي تأسست يف عام 2004نظاما ً قضائيا ً دوليا ً يعمل بنظام القانون العام باللغة اإلنجليزية يف ديب وتشكل جز ًءا أساس ًيا من النظام القانوين لدولة اإلمارات .وقد تم تأسيسها بهدف محدد هو زيادة ثقة دوائر المجتمع الدويل يف دولة اإلمارات يف المنظومة القانونية لإلمارة وتعزيز عالقات هذه الدوائر االستثمارية والتجارية مع ديب ودولة اإلمارات عموماً.
من جهته قال سعادة القاضي عمر المهيري ،مدير محاكم مركز ديب المايل العالمي“ :إن القدرة التي تتمتع بها األنظمة القضائية يف اإلمارات يف دعم وحماية استمرارية مشاريع األعمال ستثبت مدى حيويتها البالغة ألهداف الدولة طويلة األجل الرامية الجتذاب االستثمارات األجنبية واالحتفاظ بها .كما أن التزام ديب القوي بتوفير بيئة أعمال تنافسية جدا ً أمر محوري جدا ً أيضا ً يف رؤيتها الرامية إىل التنويع االقتصادي على المدى الطويل .ومن هذا المنطلق فإن إطالق محكمة االقتصاد الرقمي يعطي دوائر األعمال العالمية مؤشرا ً واضحا ً على عزم ديب على القيام بدور قيادي ورائد يف تطوير أنظمتها القضائية لتوجيه القدرات واإلمكانات التي تتمتع بها بشكل خاص نحو تسوية النزاعات المتعلقة باالقتصاد الرقمي ،مع االستفادة يف ذات الوقت من بعض هذه التقنيات الفائقة لزيادة كفاءة الخدمات المقدمة للجمهور .وتعد هذه المحكمة األوىل من نوعها يف العالم وتقدم ابتكارات جديدة ومثيرة يف إتاحة أفضل السبل للوصول إىل العدالة ،ليس فقط للشركات العاملة يف اإلمارات ،بل للشركات العالمية أيضا ً التي ترغب باختيار اختصاصنا القضايئ المحايد”.
ويف عام ،2011تم توسيع نطاق اختصاص محاكم المركز إىل خارج نطاق المركز ليشمل الشركات الدولية ،مما يمكّن أي طرفين يف أي مكان يف العالم من اللجوء لمحاكم مركز ديب المايل العالمي من خالل «اختيار» هذا االختصاص العالمي المحايد. إضافة إىل ذلك ،يف عام ،2017أطلقت محاكم المركز بالشراكة مع مؤسسة ديب للمستقبل مركز أبحاث «محاكم المستقبل» بغرض استكشاف أهم مجاالت التقنيات القانونية المتنوعة وتهيئة القيادات البحثية والفكرية لتعزيز وتشجيع األساليب المعاصرة يف زيادة وتحسين كفاءة سبل سل وصول المستخدمين حول العالم لخدمات المحاكم. وقد مكّن مركز األبحاث هذا محاكم مركز ديب المايل العالمي من التقدم بانسيابية يف مشاريعها التقنية الرئيسية تحت مظلة محاكم المستقبل ،وتجميع المواهب والموارد من الشركاء والخبراء العالميين يف مجاالت القانون والتكنولوجيا واألعمال ،بحيث يمكنهم مساعدة أنظمة المحاكم على استيعاب التقنيات المستجدة واالستفادة منها.

محاكم مركز ديب المايل العالمي تطلق محكمة لالقتصاد الرقمي يف ديسمبر ،أعلنت محاكم مركز ديب المايل العالمي عن إطالق محكمة عالمية جديدة لالقتصاد الرقمي ،وقد تم تفعيلها بهدف تبسيط تسوية كافة النزاعات المدنية والتجارية المعقدة المتعلقة باالقتصاد العالمي الرقمي. تختص المحكمة الجديدة بالتعامل مع النزاعات الوطنية والدولية المعقدة المتعلقة بالتقنيات الحالية والمستجدة يف مجاالت شتى بدءا ً من البيانات الضخمة إىل تقنيات البلوكتشين والذكاء االصطناعي ،والخدمات السحابية وصوال ً إىل النزاعات المتعلقة بالمركبات الجوية غير المأهولة ،وتقنيات الطباعة ثالثية األبعاد ،والروبوتات. ويجري حال ًيا توظيف نخبة من خبراء القضاء الدوليين لتشغيل واإلشراف على البنية التحتية الرقمية والقدرات الخدمية المتطورة التي تتمتع بها المحكمة الجديدة ،لتكون هذه المحكمة مكملة لمجموعة أقسام المحاكم القائمة المختصة، التي تشمل قسم التكنولوجيا واإلنشاءات وقسم التحكيم، اللذين أطلقتهما محاكم مركز ديب المايل العالمي لتلبية الطلب المتزايد على الخبرة القضائية يف قضايا كل قطاع بعينه.
ويف أوائل عام ،2022ستؤسس محاكم المركز أيضا ً هيئة عالمية من المحامين وخبراء الصناعة لصياغة وإقرار قواعد جديدة مخصصة لمحكمة االقتصاد الرقمي ،سيتم إصدارها بعد يوما. ذلك بناء على حملة مشاورات عامة مدتها ً 30 كما أعلنت الحكومة اإلماراتية ،يف عام ،2021عن العديد من المبادرات األساسية فيما يتعلق بمتطلبات االقتصاد الرقمي المستقبلية وخريطة الطريق االستراتيجية للدولة بهذا الشأن، ومن ذلك تشكيل فريق عمل من قيادات الحكومة ودوائر األعمال إلمعان النظر يف ما بعد الجائحة والعمل نحو اقتصاد

يوم يف حياة الكاتب القضايئ األول
إىل القرار الصحيح إال بالجهد والتعب ،السيما عندما يمثل كل طرف من طريف النزاع محام يتمتع بقوة اإلقناع .ومع أن المسؤولية الكبيرة المتعلقة بالبت يف القضايا تقع على عاتق القاضي ،لكن ال بد للكاتب القضايئ من تقديم المساعدة التي تتناسب مع تلك المسؤولية .وعملياً ،هذا يعني أال أدخر وسعا ً وأن أبذل كل جهد ممكن ،مهما كانت المهمة التي أوكلت إيل، وأحيانًا القيام بذلك مرة ثانية وثالثة على سبيل االحتياط.
ما هي الصفات التي تجعل من الكاتب القضايئ كاتبا ً ناجحاً؟
أيمن ساعي هل يمكنك أن تصف لنا يوما ً من أيام عملك ككاتب قضايئ؟ أبدأ يومي بفنجان من القهوة؛ وهنا غالبا ً ينتهي الجانب الروتيني اليومي يف عملي .فالكتّاب القضائيون يقدمون المساعدة للقضاة ،ويختلف شكل هذه المساعدة باختالف عمل القاضي الذي يختلف بدوره باختالف النزاعات المرفوعة أمامه يف المحكمة .وليس هناك قضيتان متطابقتان ،وعلى ذات المنوال فإن عملي فيه قدر كبير من التنوع .فبعض األيام يكون فيها الكثير من أعمال البحث القانوين بينما تطغى مهام الكتابة والصياغة على أيام أخرى .وكثيرة هي األيام التي أواجه فيها مفاهيم غير مألوفة .كما أنني أحضر جلسات المرافعة وأشارك يف النقاشات مع القضاة حول القضايا .وهذان النشاطان األخيران هما أكثر أيام العمل متعة لدي. ما هو أ كبر تحد يواجهك؟ أعتقد أن التحدي األكبر الذي أواجهه ككاتب قضايئ يتعلق بالمسؤولية .فالقضاة الذين أساعدهم مهمتهم سماع المنازعات والفصل فيها ،يف معظم الحاالت ،باإللزام من خالل إصدار أحكام قضائية .ويف كثير من األحيان ،ال يمكن الوصول
أعتقد أن الكتبة القضائيين مثل القضايا :ففي النهاية، القاضي هو من يقرر ما الذي يجعل القضية جيدة .فاختالف القضاة يعني اختالف أسلوبهم يف العمل ،وبالتايل فإن المساعدة التي يتطلبها أحد القضاة تختلف عما يتطلبها غيره. ومع ذلك فإنني أعتقد ،بشكل عام ،أن الكاتب القضايئ يجب أن يتحلى باالنتباه واالجتهاد والضمير الحي والتفاؤل وحسن التنظيم وروح المبادرة وسرعة االستجابة والدقة وقوة العزيمة والمرونة والحماس. ما النصيحة التي تقدمها لمن هم أصغر منك أو من يرغبون باإللتحاق بالعمل القانوين؟ لقد أهدرت الكثير من الوقت يف قراءة كتب ال عالقة لها بالقانون .وأعتقد أن نصيحتي لمن هم أصغر مني سنا ً أن ينفقوا ضعف ما أهدرت من الوقت! فقد بت أرى كل يوم كيف أن اطالعايت السابقة على موضوعات كانت تبدو بعيدة جدا ً عن مجال عملي تدعم اليوم المهام التي أقوم بها يف وظيفتي هذه، سواء دعما ً مباشر أو غير مباشر .كما أن اللغة دو ًرا مركزيًا يف القانون ،لذلك من المفيد برأيي االهتمام باللغة وأساليبها واستخداماتها واإلمكانيات التي يمكن أن تفسر بها ،أو “التالعب باأللفاظ” التي صيغت بها العبارات ،ال سيما وأن المحامين البارعين ماهرون للغاية يف ذلك عادة. ولمن يريدون العمل يف السلك القانوين ،نصيحتي لهم أن يدرسوا كل الخيارات المتاحة أمامهم والتعامل معها بعقل منفتح .المنافسة لدخول هذه المهنة عادة ما تكون شرسة. لكنني أعتقد أن جزءا ً من السبب يف ذلك هو أن معظم الطامحين يحتشدون عند عدد قليل من “البوابات” المتاحة لدخولها .فمعظمهم يطمح إىل أن يكون محامي إجراءات أو محامي مرافعات ،لكن المسيرة المهنية التي تلبي أمنياتك وطموحاتك يف العمل كمحكم أو وسيط أو مسجل محكمة، على سبيل المثال ،ربما تكون يف انتظارك؛ يف مكان وجودك اآلن أو ربما يف مكان آخر.

يف سبتمبر ،أصدر صاحب السمو الشيخ مكتوم بن محمد بن راشد آل مكتوم نائب حاكم ديب رئيس مركز ديب المايل العالمي قرارا ً بتعيين سعادة القاضي عمر المهيري مديرا ً للمحاكم. يأيت هذا التعيين عقب إصدار القانون رقم 5لعام ، 2021الذي ينص على التعيين الجديد والمهام الجديدة للمدير ،والذي سيتوىل بموجبه المدير كامل المسؤولية عن اإلشراف العام على الشؤون اإلدارية لمحاكم المركز ،إضافة إىل مهامه كنائب لرئيس محاكم المركز. ويف هذا الصدد قال زكي عزمي ،رئيس محاكم مركز ديب المايل العالمي“ :لقد كان يل شرف العمل جن ًبا إىل جنب مع نائب رئيس محاكم مركز ديب المايل العالمي لما يقرب من ثماين سنوات ،أدى خاللها دو ًرا محوريا ً يف ضمان تبوؤ محاكم مركز ديب المايل العالمي مكانتها المرموقة كواحدة من المحاكم التجارية الرائدة .ولقد تجلت رؤيته وقيادته مؤخ ًرا من خالل توجيهاته لتخطي تحديات جائحة كوفيد -19الغير المسبوقة .وأتطلع ُقدما ً إىل مواصلة التآزر والعمل مع سعادة القاضي عمر المهيري لضمان استمرار مساهمة محاكم المركز يف عرض القيمة الشامل الذي يقدمه مركز ديب المايل العالمي وديب ودولة اإلمارات العربية المتحدة بشكل عام “. وقد عمل سعادة القاضي عمر المهيري لدى محاكم مركز ديب المايل العالمي منذ انطالق أعمالها يف عام ،2005ويأيت لهذا المنصب وبجعبته ثروة وافرة من المعرفة والخبرة يف مختلف الوظائف القضائية واإلدارية. ويف معرض حديثه عن تعيينه الجديد ،قال سعادة القاضي عمر المهيري“ :لقد اكتسبت من عملي يف محاكم مركز ديب المايل عاما خبرة ال تقدر بثمن ،وإنه لشرف وفخر العالمي ألكثر من ً 16 يل أن أتوىل اآلن منصب مدير المحاكم .لقد نجحنا يف تحقيق هدفنا المتمثل يف الريادة على مستوى التقدم التقني ونواصل السعي والبحث عن أفضل الممارسات لالرتقاء والتقدم. وسنبقى على الدوام ملتزمين بأعلى المعايير وتقديم أرىق الخدمات وأعالها جودة لمستخدمي محاكمنا ،بما يوفر البيئة الالزمة من الطمأنينة واليقين الذي سيدعم الرؤى الشاملة للدولة بتنويع االقتصاد وتنميته “. وكان سعادة القاضي عمر المهيري قد بدأ مسيرته القضائية يف شرطة ديب وكوكيل نيابة لدى نيابة ديب. ومن خالل خبرته القضائية الممتدة يف دوائر محاكم ديب ومحاكم مركز ديب المايل العالمي على مدار عاما الماضية ،حظي سعادة القاضي الثالثين ً عمر المهيري بفرصة فريدة الستثمار خبراته بنظم قضائية متعددة كالنظام المدين والنظام األنجلوسكسوين . ويف السنوات األخيرة ،كُلِّف سعادة القاضي عمر المهيري بعضوية كل من المجلس االستشاري لمحاكم ديب واللجنة العليا للتشريعات يف إمارة ديب.

كما شهدت محكمة الدعاوى الصغيرة األوىل من نوعها يف المنطقة نموا ً قويًا يف حجم القضايا المعروضة أمامها خالل النصف األول من ،2021وسجلت 201دعوى بقيمة إجمالية وصلت إىل 20مليون درهم إمارايت .وقد أتت هذه الدعاوى بالدرجة األوىل من قضايا خرق االلتزامات التعاقدية ،وقضايا العمالية ،وقضايا القطاع المصريف ،وقضايا العقارات وعقود اإليجارية .وقد أدت زيادة الوعي بهذه القنوات القانونية واستخدامها المبتكر للتكنولوجيا ،بما يف ذلك إطالق أول “محكمة افتراضية” يف المنطقة يف عام ،2016إىل دفع المزيد من األطراف إىل اللجوء إليها ،حيث جاءت 64%من الدعاوى المعروضة أمام محكمة الدعاوى الصغيرة من أطراف فضلوا اللجوء إليها اختياريًا لحل نزاعاتهم .وقد تمكنت محكمة الدعاوى الصغيرة هي األخرى من عقد 100٪من جلسات استماعها عن بُعد عبر المنصات الرقمية المتاحة منذ .2016 يف هذا السياق قال القاضي زكي عزمي ،رئيس محاكم مركز ديب المايل العالمي“ :أدى النضج المتزايد لمحاكم مركز ديب المايل العالمي إىل تنامي الوعي والثقة بقدراتنا ،ليس فقط يف توفير خدمات ذات مستوى عالمي إىل خدمات المحاكم ،ولكن ً أيضا لضمان أعلى مستويات الخبرة واإلشراف القضايئ. وسنواصل سعينا لتحقيق التحول الرقمي الكامل وتزويد تقدما ،من أجل ترسيخ األمن مستخدمينا بأكثر األدوات ً واليقين القانوين لدى الشركات يف عصر تتسارع فيه التحوالت الجذرية للتكنولوجية .ومن خالل الجمع بين التميز القضايئ والبنية التحتية الرقمية الحديثة والمرنة تمكنت محاكم مركز ديب المايل العالمي من سن معيار جديد للمحاكم التجارية الدولية”. يف األشهر الستة األوىل من عام ،2021أصبحت محاكم مركز ديب المايل العالمي أول محكمة يف اإلمارات تحصل على حل الختم الرقمي “إيثاق” لتمكين المصادقة الرقمية على المستندات ،وهو حل قائم على منصة الهوية الرقمية الوطنية للدولة ( ،)UAE PASSبدعم من مركز ديب لألمن اإللكتروين. وبذلك تصبح محاكم مركز ديب المايل العالمي أول كيان يف ديب يعتمد على هذا الحل الالوريق بالكامل لتمكين توقيع وثائق المحاكم وإصدارها والمصادقة عليها إلكترون ًيا .ما يتيح حال شامال يجمع بين الختم والتوقيع اإللكتروين ويستند إىل هويات شخصية يمكن التحقق منها رقم ًيا.
وسيعزز الختم اإللكتروين من أمن وسالمة التوثيق ومنع التالعب بالوثائق الرسمية ،األمر الذي س ُيمكّن المستخدمين من التحقق من صحة أي مستند قانوين رقم ًيا عبر الموقع اإللكتروين لمحاكم مركز ديب المايل العالمي.
ويف عام 2021أيضا ،أطلقت محاكم مركز ديب المايل العالمي ومؤسسة ديب للمستقبل مشروع “محاكم الفضاء” تحت مظلة مبادرات “محاكم المستقبل” .وقد وجه المشروع رسالة إىل مجتمع الفضاء الدويل تؤكد فيه دولة اإلمارات العربية المتحدة مدى جديتها للعب دور رائد يف تطوير أنظمتها القضائية وتوجيه القدرات واإلمكانات لحل النزاعات التجارية المتعلقة بمجال الفضاء. وتم تشكيل فريق عمل دويل من هيئات وخبراء القطاعين العام والخاص ،وتكليفهم باستكشاف االبتكارات القانونية المتعلقة بالفضاء وتقديم نظرة عامة على النتائج المحتملة لسيناريوهات النزاعات التجارية يف مجال الفضاء. ومن بين العديد من التقنيات التي قامت محاكم مركز ديب المايل العالمي بتبنيها لزيادة الوصول إىل الخدمات القانونية “نظام الرفع اإللكتروين للدعاوى” الذي كان األول من نوعه يف المنطقة عند طرحه يف عام 2009؛ إىل جانب قاعة المحكمة المتكاملة رقميا ً مع أحدث نظم إدارة المحاكم اإللكترونية يف عام 2017؛ وإدخال أول حل يف المنطقة للتجميع اإللكتروين من دون ورق يف عام .2018 كما ساعدت المبادرات الخاصة يف إطار “محاكم المستقبل” يف دفع أنشطة البحث والتطوير المتقدمة بمحاكم مركز ديب المايل العالمي ،وتوحيد جهود األفراد والشركات للمساعدة يف وضع النماذج األولية وإطالق تكنولوجيا المحاكم ،كالمبادرات التي تعمل بتقنية “بلوكتشين” والبرامج التي تدعم الذكاء االصطناعي والبرامج المستندة إىل حلول الحوسبة السحابية. باإلضافة إىل تعزيز هيئة القضاة الحالية يف عام 2021بخبرات دولية إضافية بارزة من المملكة المتحدة ،حققت محاكم مركز ديب المايل العالمي إنجا ًزا جديدًا من خالل تعيين الجيل القادم من القضاة اإلماراتيين ذوي الخبرة المتكاملة يف القانونين المدين واالنجلوسكسوين .وتشمل التعيينات التي قام بها صاحب السمو الشيخ محمد بن راشد آل مكتوم مؤخرا ،أول قاضية إماراتية يف العالم يتم تعيينها يف محكمة القانون االنجلوسكسوين. وكجزء من المهمة المستمرة لمحاكم مركز ديب المايل العالمي يف التواصل مع مختلف الكيانات يف اإلمارات وخارجها من أجل بحث سبل التعاون المشترك ،أقامت تحالفات جديدة مع العديد من الجهات اإلماراتية يف النصف األول من عام 2021 تشمل الغرف التجارية وسلطات المناطق الحرة والمطورينالعقاريين كشركة إعمار العقارية .ويف عام 2021أيضا ،قامت المحاكم بتوطيد عالقاتها القضائية الدولية مع العديد من المحاكم يف مختلف أنحاء العالم ،من أيرلندا إىل البرازيل.

بفضل تبنيها جلسات االستماع عن بُعد المتزايدة استعابت محاكم مركز ديب المايل العالمي األعداد المتنامية من الدعاوى التجارية يف يوليو ،أصدرت محاكم مركز ديب المايل العالمي إحصاءاتها لألشهر الستة األوىل من عام ،2021مؤكدة استمرار نضج المحكمة العاملة باإلنجليزية بنظام االنجلوسكسوين يف ديب وتحقيقها لزيادة كبيرة يف حجم الدعاوى المرفوعة أمامها. ومنذ بدء الجائحة ،تأقلمت محاكم مركز ديب المايل العالمي بسرعة استكمال جلسات االستماع عن بُعد وتطوير قدراتها الرقمية ورفع الكفاءة التشغيلية .وتمكنت اآلن يف ،2021من عقد 100٪من جلسات استماعها عن بُعد عبر مختلف المنصات الرقمية ،ليتمتع مستخدمو المحاكم بالمزيد من الخيارات والمرونة عند تلقي الخدمات األساسية ،ما يضمن وصوال ً أسرع وأبسط إىل العدالة. وينسجم هذا االنتقال السريع إىل اعتماد الجلسات الرقمية مع التوجيه الذي أصدره يف يونيو صاحب السمو الشيخ محمد بن راشد آل مكتوم نائب رئيس الدولة رئيس مجلس الوزراء حاكم ديب “رعاه هللا” ،بتحويل 80%من جلسات المحاكم يف الدولة إىل جلسات تقاض عن بعد بشكل دائم قبل نهاية .2021 وخالل األشهر الستة األوىل من العام ،ازداد حجم القضايا المعروضة أمام المحكمة االبتدائية بنسبة 11%مقارنة بنفس الفترة من العام الماضي ،مع ارتفاع القيمة اإلجمالية للمطالبات

بنسبة 27٪لتصل إىل 2,8مليار درهم إمارايت ،بمتوسط 56,9 مليون درهم للقضية الواحدة .كما سجلت القضايا المتعلقة بالتحكيم زيادة يف عدد الدعاوى بنسبة 36%خالل األشهر الستة األوىل من .2021ووصلت القيمة اإلجمالية للمطالبات يف مختلف األقسام إىل 3,4مليار درهم إمارايت.
وشملت القضايا المعروضة أمام المحكمة االبتدائية طيفا ً واسعا ً من القطاعات ،بما فيها القطاع المصريف ،والمايل، واإلنشاءات والعقارات ،والتصنيع ،بخصوص نزاعات تتعلق بخرق االلتزامات التعاقدية ،وعدم سداد الدفعات المستحقة، واإلعسار المايل ،والوصايا وإثباتها ،وقضايا العمالية .كما كانت هناك زيادة ملحوظة يف عدد القضايا المعروضة اختياريا ً أمام محاكم المركز يف عام ،2021حيث أتت 50%من الدعاوى المعروضة أمام المحكمة االبتدائية من أطراف اختاروا اللجوء إىل محاكم مركز ديب المايل العالمي لحل نزاعاتهم.
وبلغت القيمة اإلجمالية لدعاوى تنفيذ األحكام المقدمة 568 مليون درهم إمارايت يف النصف األول من عام ،2021بزيادة نسبتها 198%عند المقارنة مع األشهر الستة األوىل من ،2020يف حين ارتفع عدد دعاوى إنفاذ األحكام بنسبة 8% مقارنة مع الفترة ذاتها من عام ،2020ما يشير إىل تنامي ثقة الشركات بقدرة المحاكم على إنفاذ األحكام.

وصل التميز القضايئ إىل مرحلة جديدة يف عام 2021عندما قمنا بتعيين الجيل القادم من القضاة اإلماراتيين يف محكمة االبتدائية. يأيت ذلك بعد عقد من اإلستراتيجية المخصصة ،حيث شارك القضاة وموظفو التسجيل اإلماراتيون يف تدريب دويل ؛ برامج التطوير الذايت؛ صياغة قواعد المحاكم؛ قيادة تقديم محكمة الدعاوى الصغيرة؛ اإلشراف على القضايا التجارية والمدنية الكبرى؛ إقامة عالقات عمل عميقة مع المحاكم التجارية اإلقليمية والعالمية؛ ورفع معايير الخدمة وزيادة الكفاءة اإلدارية. تم تصميم إطالق برنامج تطوير التوطين يف التميز القضايئ يف خصيصا لتحقيق استراتيجية من ثالث مستويات)1( : عام 2019 ً زيادة عدد اإلماراتيين يف المنظمة؛ ( )2تطوير المواهب واالحتفاظ بها )3( ،احتضان المواهب الجديدة من خالل برامج الدراسات العليا.
كما أؤكد بكل فخر أن محاكم المركز حصلت يف 2021على ثالث ( )3جوائز رائدة على مستوى الصناعة تقديرا ً لجهودها يف تطبيق التقنيات الداعمة لبنيتها التحتية الرقمية .وتتضمن الجوائز التي حصلنا عليها جائزة أفضل مبادرة لتوثيق المستندات المركزة على تقنية البلوكتشين ،وجائزة أفضل مبادرة إبداعية لهذا العام ،وجائزة أفضل تجربة حكومية رقمية. ويف عام ،2022سنطلق المرحلة الثانية من مبادرة مختبر تقنيات المحاكم ،التي تمثل مشروعا ً تم بناؤه وإطالقه وتطويره لتعزيز مكانة ديب بوصفها المدينة الرائدة يف تبني التقنيات الجديدة الخاصة بهذه الصناعة .وتعد هذه المبادرة األوىل من نوعها يف العالم ومن شانها أن تحقق تطورات جديدة ومثيرة يف مجال التقنيات الخاصة بالمحاكم وتوفير أفضل السبل للوصول إىل العدالة.
ويف ظل األحداث التي شهدتها األشهر األربعة والعشرين الماضية، واصلت محاكم مركز ديب المايل العالمي مسيرتها الطموحة يف التحول الرقمي خالل عام ،2021حيث أجرت أكثر من 90٪من جلسات االستماع بتقنيات الواقع االفتراضي .وواصلنا المضي قدما ً كأول محكمة يف دولة اإلمارات تحصل على حل الختم اإللكتروين المعتمد “إيثاق” ،وهو عبارة عن مبادرة ال ورقية تتيح إمكانية المصادقة الرقمية على الوثائق بدعم من منصة الهوية الرقمية الوطنية اآلمنة لدولة اإلمارات العربية المتحدة.
أخيراً ،وبالطبع ليس آخراً ،أكدت محاكم مركز ديب المايل العالمي مؤخرا ً إطالق محكمة االقتصاد الرقمي ،الرامية إىل تبسيط تسوية كافة النزاعات المدنية والتجارية المعقدة المتعلقة باالقتصاد الرقمي يف جميع أنحاء العالم.
ويف شهر نوفمبر ،2021أكدت محاكم مركز ديب المايل العالمي رسميا ً أن 100٪من عملياتها الداخلية وخدمات التفاعل مع العمالء تتم اآلن بشكل رقمي بالكامل .ويأيت هذا متناغما ً مع استراتيجية ديب الطموحة للمعامالت الالورقية التي أطلقها سمو الشيخ حمدان بن محمد آل مكتوم يف عام .2018

كما واصلنا تعزيز الموارد الرقمية لخدمة الوصايا لدينا ،باستكمال نموذج الوصية الكاملة كجزء من تسهيالت صياغة الوصايا المؤتمتة .ويوفر نظام الوصايا عبر اإلنترنت أيضا ً مالحظات توضيحية شاملة إذا ما رغبت بصياغة وصيتك بنفسك .ويأيت هذا التطور بعد طرح هذا النظام ألول مرة على مستوى المنطقة يف عام ،2020الذي بات اآلن يتيح للموصين تسجيل وصاياهم عن بُعد بواسطة تقنية مؤتمرات الفيديو ،وهم آمنون يف منازلهم.
ويجري حاليا ً توظيف نخبة من خبراء القضاء الدوليين لتشغيل واإلشراف على البنية التحتية الرقمية والقدرات الخدمية المتطورة التي تتمتع بها المحكمة الجديدة لتعمل جنبا ً إىل جنب مع هيئة عالمية من المحامين وخبراء الصناعة لصياغة وإقرار قواعد جديدة مخصصة لمحكمة االقتصاد الرقمي ،سيتم إصدارها بعد ذلك بناء على حملة مشاورات عامة مدتها 30يوماً.
