Under the current Prop 60, the homeowner cannot buy the new home and transfer their property tax to it because the value of the acquired property would be more than the value of the old property. As such, they would have to pay property tax on the full $3.5 million. Under the new “portability” proposal, if they were to purchase a new home for $3.5 million and then sell their old home for $3 million, then they would pay tax on only $1.5 million (the original tax value of $1 million plus the $500,000 that the new value exceeded the old value).

To local homeowners, that would be bad news. However, this could be considered good news to buyers facing the affordability crisis. Perhaps the strongest opponent to portability are California cities and counties themselves. Naturally, any aggregate savings to taxpayers would come at the expense of local government’s budgets. While it is still too soon to know whether these changes will be enacted, they could represent the most significant changes to California property tax since the late 1980s.

The weather is near perfect, the city’s public schools rank among the top nationwide, and Palo Alto rests adjacent to esteemed Stanford University. World-class companies have also put down powerful roots in the area, including Tesla, Hewlett-Packard, VMWare, and, of course, DeLeon Realty. Palo Alto is also legendary for being home to incredible individuals who have went on to dominate their fields across a wide variety of disciplines. NBA Brooklyn Nets’ Jeremy Lin was a recent Palo Alto High School graduate, along with San Francisco 49ers’ Jim Harbaugh and Green Bay Packer’s Davante Adams. Playing quarterback for 13 seasons with the 49ers, Steve Young and his family also reside in Palo Alto. Olympic champions, including the Schultz brothers and swimmer Matt Blondi, winner of 11 Olympic medals, have also lived here. Even one of America’s most famous politicians, Herbert Hoover, the 31st president of the United States, was enrolled at Stanford University and later called Palo Alto home with his wife. Following suit, Ron Christie, the great pianist and former U.S. Secretary of State Condoleezza Rice, and many other politicians have laid roots in our great city.

Renowned musicians and rock bands have also resided and been formed here, from Third Eye Blind’s rock musician Stephan Jenkins, who is a Gunn High alumnus, to Fleetwood Mac’s lead guitarist and vocalist Lindsey Buckingham who was born and raised in Palo Alto. Joan Baez, the famous folk musician, attended school in Palo Alto before moving to Woodside.

The early incarnations of the rock band The Grateful Dead, active from 1965 to 1995, were also based here. THE COMEBACK KID: JOSEPH EICHLER By Michelle Lee, DeLeon Marketing Dept

A LOOK AT THE HISTORY OF EICHLER HOMES AND THEIR RESURFACING POPULARITY Grab a piece of paper or your smartphone and jot down some of the key elements that are must-haves for your dream home. Do you favor more traditional styles or post-modern designs? Would you add an outdoor kitchen, swimming pool, or guesthouse out back? How close do you want to be to nature or a city center? Chances are that regardless of your personal preference, at least one of your essential features will tie back to Eichler-era architecture. Active from 1949 to the mid-1970’s, legendary real estate developer Joseph Eichler made waves that left him with a reputation as a social visionary that is still recognized today. He and his company, Eichler Homes, constructed over 11,000 homes in twelve communities across Northern and Southern California, as well as a few custom projects in Chestnut Ridge, New York. He advocated for inclusive and diverse communities, establishing a non-discrimination home selling policy and even resigning from the National Association of Home Builders when they rejected his policy in 1958. His homes were built to suit middle-class Americans and young families, using simplistic yet durable materials. Much like Levittown, in Long Island, NY, Eichler’s timing was perfect for GIs returning from war. Eichler himself was influenced when living in a home designed by world-renowned architect Frank Lloyd Wright, whose designs largely revolved around geometric shapes, a strong connection to nature, and unification of building

components so that a structure flows seamlessly together as a whole. Eichler’s distinct style, commonly categorized as mid-century modern and largely considered the defining icon of the “California Modern” aesthetic, features strong indoor-outdoor connections through glass walls, floor-toceiling windows, skylights, and open-concept floorplans that allow for an airy and modern feel throughout. His goal was to always try to bring the outdoors in, even in a suburban

The windows, however, are rarely front-facing, which serves as a highly differentiating factor of Eichler homes from many other architectural designs. Structurally, many Eichlers resemble a simple rectangle with low-sloping roofs and clean geometric lines. These homes feature an emphasis on large patios and private outdoor rooms, and occasionally swimming pools on larger lots. The interiors are often left white, allowing sunlight to flood in and bounce around, with brightly-colored doors (traditionally red, but occasionally yellow) for a classic mid-century pop of color. Many of his other distinctive features were very unconventional and innovative for his time, including exposed post-and-beam construction, tongue-and-groove and mahogany paneling along the walls and ceilings, and iconic concrete floors with radiant heating underneath. Some homes, especially those later in Mr. Eichler’s career,

well-suited for the casual California climate and easy, laidback lifestyle found here, which has impacted its resurfacing popularity in the current housing market. AIR TRAFFIC IMPACT ON REAL ESTATE By Michael Repka, pilot As a licensed pilot and Silicon Valley’s most active real estate listing agent, I have a unique perspective on how air traffic impacts local real estate. From this vantage point, I can see and understand the concerns of both sides of the debate as to how we can keep aircraft noise to a minimum. There is no doubt that we have a lot of air traffic passing overhead. The Bay Area is serviced by three large international airports – San Francisco, Oakland, and San Jose. All three of these airports have flights coming and going from around the nation and around the world. While this is very convenient when we’re looking to book a flight somewhere, the frequency of overhead airliners can be an annoyance at best and a significant impact on housing values at worst. Naturally, there has to be a balance between the needs of air travelers and the local residents’ quiet enjoyment of their very expensive properties. Irrespective of the comments in some blogs and other writings, I have found that both pilots and the Federal Aviation Administration (the “FAA”) take noise abatement very seriously.

NextGen

In 2003, the FAA began to implement the Next Generation Air Transportation System (“NextGen”), which was designed with the laudable goal of enhancing the speed and efficiency of airliners arriving at large airports. Currently, the FAA is about halfway through its phase-in of the new system, with completion anticipated between 2025 and 2030. Although a bit simplistic, the concept is similar to airliners passing through a funnel and following a prescribed route to the airport. Generally, this approach has been very effective in improving on-time arrivals at busy airports, saving fuel due to improved routing, and reducing minimum required separation between airplanes. However, it has had the unfortunate side effect of routing multiple aircrafts, one after another, over the same neighborhoods and houses.

General Aviation

When I started taking flying lessons a few years ago, I was pleasantly surprised by how considerate private pilots are when it comes to noise issues and safety. While the FAA promulgates regulations that control pilots’ conduct, it has

been my experience that pilots of small planes are trained to, and do impose further restrictions on themselves. For example, pilots who are learning to fly often have to do certain maneuvers to learn how to control the plane. These include circling at certain bank angles, “ground reference maneuvers” around a field, road or point, and stalls. These maneuvers tend to be loud and repetitive, so pilots generally go over to the ocean or the open space in the vicinity of Tracy, CA to minimize impact to people on the ground. Similarly, pilots coming in to land in local airports are trained to keep power to a minimum during the descent over homes to reduce unnecessary noise. However, just like the NextGen system, there are certain navigational aids in general aviation that result in an enhanced likelihood of unwanted noise. For example, there are particular “reporting points” (e.g., visible landmarks) or VHF Omni-Directional Range (“VOR”) transmitters that are used by many pilots flying in to or out of the area. Knowledgeable local real estate agents can identify these points for buyers’ consideration.

If a buyer is concerned about air traffic noise, whether from commercial airliners or small planes, it is important that they discuss this with their Realtor.® Both the Realtor® and buyer should visit the property at different times of the day and during different weather patterns. Generally, planes land and take off into the wind and most airports have a prevailing runway and direction. This means that air traffic will often land and take off in the same direction and over the same homes. There is a significant difference in the amount of noise generated by a departing aircraft when compared to an arriving aircraft. On the departure end of the runway, planes will be louder because they are heavier and climbing under full power. On the arrival end of the runway, planes will generally be lighter and under very little power because they are descending to the touchdown point. Despite the best intentions of most pilots, there are the occasional outliers that fly in an obnoxious way. The FAA does take this seriously, so please report any concerns to 866-835-5322.

RISK OF USING FRIENDS & FAMILY AS YOUR REAL ESTATE AGENT By Michael Repka, DeLeon Listing Team

When I originally got my real estate license many years ago, a manager pulled me aside and gave me what she considered wisdom. These words were really powerful because they clearly showed me what’s wrong with the real estate industry.

and “Never summarize disclosures or do an investigation of your own.” All of these sayings or instructions illustrate the brokerage's focus on avoiding liability at the expense of the clients’ best interest.

First, the manager explained that new real estate agents must set aside any insecurity about not knowing what they’re doing. I was told that no one ever knows what they’re doing at the beginning of their career and that I should actively and vocally tell all my friends and family that I am a Realtor®.

As the most active listing real estate agent in Silicon Valley, I see a wide variety of agents through home showings and the offer process. Over the years, I have noticed that many clients are represented by extremely professional and knowledgeable agents that are truly looking out for their best interests. However, when I encounter an agent at the other end of the spectrum, I often come to learn that they are a friend or family member of the buyers.

The rationale was simply that friends and family are more understanding of an agent’s lack of knowledge and experience. Further, it is very unlikely that your friend or family member will sue you if you make a mistake. From the moment I heard this advice, I could see the problems within the real estate industry. There was a remarkable lack of emphasis on the importance of actually gaining knowledge or competency. While I expected the manager to explain the need to thoroughly understand the contract, negotiation strategy, ways to avoid conflicts of interest, and the local housing inventory, what I received instead was instruction not to be a “secret agent.” Further, she emphasized that I should make my friends and family feel obligated to use me by asking them to promise that they will do so when the time comes to sell. Over the years since, I have heard several phrases over and over again from various real estate agents. These include: “Fake it until you make it”; “It doesn’t matter how much you know… it only matters how much the client thinks you know”; “don’t be a source of information… be a conduit of information”; “Never give advice or your opinion… Just give information and let the client make the determination”;

It is undisputed that good agents have friends and family members too. So, it would be overly simplistic to assume that you should never work with a friend or family member. However, both buyers and sellers should carefully consider which agent is the best for them. Buying or selling a home is a very important transaction, and it should be taken quite seriously. Before deciding to work with a friend or family member simply because you know them, you should ask very detailed and comprehensive questions to ascertain their level of competency. Another touchy area is that it is extremely difficult, if not impossible, to fire a friend or family member. Even when Sellers are extremely disappointed with the performance of their agent, they may find it difficult to complain or switch agents at the end of the listing period. Interviewing friends and family members may make sense, but a wise client should also interview other agents to make sure that their friend or family member would truly be the best choice for such an important transaction. Many clients who are unfamiliar with our approach, and even some real estate agents, inquire as to why we are willing to incur the significant expense of employing in-house interior designers rather than just relying upon the creative skills of outside stagers.

The designers that I use on the listing side of the company are quite different from designers that Ken uses when working with buyers on his side of the company. My designers are specifically trained to create an ambience that appeals to an expanded buyer pool. They tend to keep the look of the home somewhat neutral but are also able to refrain from making it boring; and they do it all while retaining a keen eye on the costs involved. This is a feat of both art and science.

Our listing team and designers have a formal background and a great deal of experience in interior design. Additionally, we train them on the specific ways to get a house ready for market, at the lowest possible cost, to achieve the best sales results. This goes far beyond mere staging. To the best of our knowledge, no other real estate agent, team or brokerage has a dedicated interior designer on staff to help Sellers prepare their home for market. Therefore, traditional agents often develop a close relationship with one particular stager. While this is certainly better than an untrained agent trying to do interior design by themselves, it truly does fall short of ideal. There are many reasons for this, but perhaps the most pronounced is that one particular stager is limited to their own personal design aesthetic and staging inventory. Thus, the agent is not able to fully accentuate the style and enhance the look of all different types of homes. This is why you often see a very generic look to other agents’ staged homes. The DeLeon Team is different in that our designers oversee the entire process of getting the house ready for sale. Additionally, they choose between the myriad of different stagers that we regularly use to achieve the look and feel that suits a specific property. That is why the DeLeon Team conducts a “kick off meeting” at the beginning of every listing engagement. At these meetings, I meet at the property with my design team, which is comprised of an interior designer and a field coordinator (either a licensed contractor or handyman), and a few key members of my marketing team. We all walk the property together, but we are each looking at it from our particular vantage point. We then meet back at the office to go over the marketing objectives and other key areas in which design and marketing overlap. Once we have developed the right vision for the engagement, we each do our part to make sure that the house looks as appealing as possible, while always remaining cognizant of the costs involved.
