Griselda came to CVLS for a divorce. Actually, while it began as a simple divorce, it soon became so much more, eventually including a foreclosure, an eviction, a case for building code violations, a tort claim and a partition action to get the husband’s name off of the home where Griselda lived with their children. Griselda got all of her legal needs met at CVLS. Her attorney, Sharon Scott, did it all. She got Griselda divorced and free from all of the other legal entanglements.

Matthew Hulstein, Attorney

Although the Thomases had never missed a mortgage payment, a mistake by their bank put them into foreclosure. Their attorney, Matthew Hulstein, tried to resolve it in mediation, but the bank stonewalled. Finally, Matt asked the court to sanction the bank for wrongful foreclosure and bad faith mediation. The stone wall crumbled. The bank dismissed the foreclosure and the Thomases kept their home.

Kathleen Robson, Attorney

Olukayode and his family were losing their home to foreclosure. Their lender ignored their repeated inquiries and kept losing their financial documents. Kathleen Robson knew her clients were eligible for a federal HAMP loan modification. Refusing to be ignored, she researched federal programs, resubmitted documents, argued and got the lender to pay attention. Kathleen did it all and got her clients the loan modification that kept them in their home.

Robert Bressler, Attorney

Lenora and her family were kicked out of the subsidized housing program because the program said she lied about her income. Robert Bressler tried the case before an administrative judge and proved that she told the truth and filled out the forms in good faith. The result of all that work: Lenora and her family kept their affordable housing.

Joy, who’d lived here for more than 30 years, had a U-visa, which is granted to victims of certain crimes. She wanted an American green card—permanent U.S. residency—so that she and her American born child could feel secure Richard Hanus made it happen. His comprehensive legal work gave Joy peace of mind.

STAFF Peter M. Ashmore, Managing Attorney. University of Missouri (B.A., Political Science, 1991). DePaul University College of Law (J.D., 1994). Hired as a staff attorney with Chicago Volunteer Legal Services upon graduation from law school, Peter had already interned, externed, and volunteered with CVLS. His Managing Attorney designation reflects in-house duties which include directing CVLS’ IT and database needs, organizing staff and management meetings and administration of CVLS’ MCLE program. As director of CVLS’ Guardian Ad Litem for Adults Program, Peter trains, recruits and supervises volunteers who serve as GALs for disabled adults. In addition, Peter still advises volunteers on an eclectic variety of cases, including family law and minor guardianship, tort defense, eviction, contracts, real estate, bankruptcy, probate, tax and public benefits. Peter formally served as President of the Illinois Center for Law & Technology, now known as Illinois Legal Aid Online and as a member of the Illinois State Bar Association’s Delivery of Legal Services Committee. He currently sits on the ISBA’s Standing Committee on Disability Law and Elder Law Section Council and is Co-Editor of the latter’s newsletter. He also is also a member of the Chicago Bar Association’s Probate, Elder Law, Mental Health and Consumer Law committees.

Meg joined CVLS in 1982 to set up the Panel Referral Program, became Deputy Director in 1983 and was elevated to Executive Director in 2003 when her predecessor retired. While responsible for overall program management and funding, Meg also coordinates CVLS’ bench, bar and law firm relations. An experienced family law litigator, Meg helped draft substantive changes to the Illinois Probate Act and still steps in on minor guardianship cases from time to time. Meg regularly speaks on child custody, client and pro bono issues for the ISBA, CBA and IICLE and writes a bi-monthly column on pro bono for the Chicago Lawyer. This fall, she was honored with Association of Corporate Counsel-Chicago Chapter’s Thurgood Marshall Lifetime Achievement Award. Prior honors include the Illinois State Bar Association’s Board of Governors Award in 2007; the Chicago Bar 36

Foundation’s Thomas H. Morsch Public Service Award in 2001; the Lawyers Trust Fund of Illinois’ Esther Rothstein Award in 1999 and Loyola University School of Law’s Public Service Award in 1994. An active member of ISBA’s Legislation Committee, she chairs the ISBA’s LawPac Board. Former chair, she continues to serve on the CBA’s Pro Bono Week Committee and co-chairs its Advisory Committee on Training and Professional Development in Legal Aid. Past activities include: chair of the Illinois State Bar Association’s Delivery of Legal Services Committee, charter member of the Illinois Pro Bono Center’s Board of Directors, speaker at the Midwest Region SPAN Conference on the Future of Legal Services, Board of Directors of the Women’s Bar Association of Illinois and two-term ISBA Assembly member. Meg’s husband, Art Simon, is an active CVLS volunteer.

Eric S. Donahue, Controller Purdue University, (B.A., Political Science and History 1996). Eric, who joined CVLS nine years ago after working as a business manager for Indiana law firms, coordinates all of CVLS’ business and operational tasks, including contracts and purchases, insurance and internal organization. He manages the 403(b) retirement plan and other aspects of CVLS human resources. In addition, he handles all dayto-day bookkeeping and aids in the preparation of federal and state filings, quarterly financial reports and the annual audit.

Susan L. DeCostanza, Staff Attorney, Guardian ad Litem for Minor and Adult Programs Boston College (BA in English Literature & Elementary Education, 2001), DePaul University College of Law (JD, 2008). Before joining CVLS as a staff attorney, Susan worked for us as both a law student intern and volunteer attorney. In between, Susan worked for Chicago-Kent College of Law as a public interest career counselor and for DePaul as pro bono program coordinator. In addition, Susan has experience with civil rights litigation in both not-for-profit and law firm settings. Susan is a member of the Chicago Bar Association, the Illinois State Bar Association and the PILI Alumni Network Leadership Council. This summer Susan was awarded the esteemed Kimball R. Anderson and Karen Gatsis Anderson Public Interest Law Fellowship for her demonstrated commitment to public interest work,

A CVLS 711 intern during law school, after graduation Keri worked as a staff attorney and then pro bono coordinator for Lawyers’ Committee for Better Housing, where she supervised volunteers and defended tenants in eviction actions. She joined CVLS’ busy foreclosure mediation program in the fall of 2011, handling cases, assisting volunteers, and performing a myriad of other essential tasks. A member of the Chicago Bar Association’s Legal Aid Committee, Keri taught English as a foreign language to Spanish speakers in a prior life.

During law school, Allegra clerked for the Illinois Attorney General, the Sargent Shriver National Center on Poverty Law and the Legal Assistance Foundation of Metropolitan Chicago. Previously, she contributed to various anti-poverty initiatives in Miami, Chicago and Washington, D.C. After graduating from law school, she worked as a staff attorney for the Family Defense Center, where she represented families in the child welfare system. CVLS hired her in 2011 for the foreclosure mediation program where she handles a substantial caseload and various other tasks. Fluent in Spanish, Allegra serves on the Associate Board of LifeSpan Center for Legal Services and Advocacy and is a member of the Chicago Bar Association.

Michael Edelberg, Clinic Coordinator Roosevelt University, (B.P.S. with honor, 2004). Michael, a certified paralegal, volunteered for CVLS for several years, primarily working on minor’s estate issues and GAL matters. Now, as clinic coordinator, he oversees CVLS’ network of 24 neighborhood legal clinics, developing and attending clinic events, reviewing and maintaining clinic data and schedules, troubleshooting clinic problems, and evaluating client and volunteer satisfaction. Michael also serves as staff liaison to the Client Services Committee. A renaissance man, Michael has been involved in commercial real estate since his teens, is an on-air radio talent/commercial voice-over and also dabbles as an international car exporter, furniture wholesaler and thoroughbred horseman. Michael also works with various groups in Central Asia, notably; the Kyrgyz Republic and the Republic of Kazakhstan, on business strategies, development and outreach programs.

Kristen Harrison, Intake and Receptionist Kristin screens clients for financial and case eligibility, books appointments for clinic and panel interviews and handles the walk-in clients sent directly from the courts. She also excels as the CVLS receptionist for volunteers.

Terri Hooker, Panel Program Administrator. Terri, who has worked with CVLS volunteers since 1973, works closely with more than 1,000 panel attorneys to find them the right case and then support them in their pro bono work. She takes particular delight in finding just the right volunteer to handle a difficult case. In addition to her panel 37


STAFF duties, Terri helps with client intake. Terri completed 2 years of Loop College and graduated from Roosevelt University’s Certified Paralegal program in 1985.

Phillip J. Mohr, Deputy Director. University of Illinois, Champaign, (B.A., Economics, 1987). De Paul University College of Law (J.D., 1991). Formerly a CVLS volunteer, Phillip joined staff in 1991, became the Family Law Director in 1996, and was named the Deputy Director in 2006. In addition to being Deputy Director, Phil continues to direct our Family Law Program. His own large caseload and the work of his volunteer panel does much to meet our greatest need: representation of clients on contested family law matters. In addition to trial work, he has gained experience with appellate work as well, arguing, along with a CVLS volunteer, before the Illinois Supreme Court. As an experienced family law practitioner, Phil spends many hours tutoring young volunteers, both individually and through seminars, gradually guiding them from simple to complex cases. His talent with training has given him the responsibility of overseeing the summer student program. Phil is a regular speaker on family law and pro bono issues, speaking at NLADA Equal Justice Conference, statewide Legal Advocates Conferences, the ISBA mid-year meeting, and on the ISBA’s cable production. He is the former chair of the Chicago Bar Association’s Legal Aid Committee. Phil was the chair of the subsection of the legal service’s consortium which has both created pro-se family law forms and materials and assisted with the creation of the Domestic Relations Division’s Self-Help Center. He also is a Legal Content Editor of the Family Law and Adoption practice area of the Illinois Legal Aid Online’s websites and co-chair of the Clerk of the Circuit Court Pro Se Litigants Advisory Committee. Phil is a member of the Illinois State Bar Association and a former ISBA Assembly and ISBA Family Law Section Council member. In 2004, Phil was selected by the Law Bulletin Publishing Company as one of the “40 Attorneys Under 40 in Illinois to Watch”.

Patricia M. Nelson, Director, Chancery Court Access to Justice and Foreclosure Mediation Programs. University of Illinois, Champaign (B.A., Economics, 1990). DePaul University College of Law J.D., 1996). Patty is the Director of both our Chancery Court Access to Justice Program and Foreclosure Mediation Program. Through the programs, CVLS 38

accepts appointments from the court to represent low-income pro se litigants in mortgage foreclosure litigation and mediation, in Chicago Housing Authority terminations and in title fraud, mortgage fraud, and predatory lending cases. Under her leadership, CVLS represented more than 2,000 homeowners in mediation and litigation last year. Patty handles many of these complex housing cases herself. She also actively recruits, trains and supports more than 400 volunteers as well as arranges ongoing seminars and training workshops in these areas. Patty has been a featured speaker on the issues of mortgage foreclosure defense and title and mortgage fraud for Metropolitan Family Services, the Illinois Paralegal Association, the Chicago Bar Association, the Chicago Daily Law Bulletin and Illinois Continuing Legal Education. She is the author of a foreclosure defense instruction manual, and the co-author of a manual for landlords wishing to evict their tenants. Previously, Patty spent eight years as our utility attorney. She is experienced in real estate litigation, foreclosure litigation and mediation, probate, landlord tenant, contract disputes, adoption, DCFS administrative hearings and acting as guardian ad litem in contested custody disputes. Patty also has experience drafting legislation, lobbying for its passage, and testifying in support of that legislation to the Illinois House of Representatives Judiciary Committee. Honored as Advocate of the Month by Illinois Legal Aid Online, Patty serves on the CBA’s Legal Aid and Real Estate Law Committees and is an active member of the Illinois State Bar Association.

Arizona State University, (B.S., Mechanical Engineering, 2005). Before joining CVLS in July 2007, Matthew worked as a mechanical engineer for 6 years in Chicago and Phoenix. While toiling in the world of big business he developed a desire to give back to the community and found his way to CVLS. His creative instincts mixed with a solid background using computer systems for both design and management made him a perfect fit to be our Community Relations & Development Coordinator. Working closely with the executive director to target new sources of funding, Matt coordinates Race Judicata®, writes grant proposals, serves as liaison to CVLS’ Junior Board, and composes press and marketing materials as well as CVLS’ monthly newsletter. CVLS’ official webmaster, Matt helped to design and build, and continuously updates CVLS’ new and improved website.

Dan’s CVLS adventure began in 2008 when he started as a part-time administrative assistant in the Chancery Court Access to Justice Program. His job expanded to full time after CVLS added the Cook County Foreclosure Mediation Program. That led him to discover his true calling— convincing CVLS volunteers to take mediation cases. Dan also excels at directing law student interns and the John Marshall Law School evening clinic, and helping to keep this large and hectic program under control. Once a year, look for him running the high-striker at Race Judicata®.

Rebekah Rashidfarokhi, Director, Guardian Ad Litem for Minors Program The University of Georgia (BBA—Marketing & B.A--Spanish, 2003). The University of Georgia School of Law (J.D. 2007). Joining CVLS as a staff attorney in 2007, Rebekah has handled family law, guardianship, immigration, foreclosure litigation and foreclosure mediation. She became director of the GAL for Minors Program in October, 2011 and, in addition to handling a caseload of challenging cases, she supervises more than 200 program volunteers. In addition, Rebekah is responsible for recruiting and training new program volunteers. Prior to joining CVLS, Rebekah worked at an immigration clinic at the US-Mexico border, the United National Office on Drug and Crime (UNODC) in Bogota, Colombia, and two international law firms in Madrid. She is fluent in Spanish and represents many of CVLS’ Hispanic clients. Rebekah is also a Director of the Young Lawyers Section of the Chicago Bar Association, the Chicago chapter representative to the National Board of Directors of the Iranian American Bar Association (IABA), and a member of the Junior Leadership Council of the National Immigrant Justice Center.

Eric Allen Sutton, Supervising Attorney, Cook County Foreclosure Mediation Program Carleton College (BA Chinese, 2003), University of Pittsburgh School of Law (JD, 2009), The Chinese University of Hong Kong (LL.M., International Economic Law). Eric began volunteering in CVLS’ foreclosure mediation program shortly after his admission to the Illinois bar and was made a full-time staff attorney in June 2011. A year later he was promoted to supervising attorney of this busy, intense program. In law school, he participated in the Niagara International Moot Court Competition, where he was awarded with the Best Applicant Memorial prize. Prior to practicing law, Eric worked in a variety of professions, including non-profit fundraising, human resources, advertising, and small-business management. NOTES TO THE FINANCIAL STATEMENTS NOTE A – NATURE OF ACTIVITIES AND SUMMARY OF SIGNIFICANT ACCOUNTING POLICIES Nature of Activities Chicago Volunteer Legal Services Foundation (the “Foundation”) is organized as an Illinois not-for-profit corporation. Its purpose is to administer programs to assist in securing legal assistance and related service for persons of low income in the Chicagoland area. The Foundation’s support comes primarily from individual and corporate contributions, foundations, and law firms, as well as fundraising activities.

Financial Statement Presentation Financial statement presentation follows the recommendations of the Financial Accounting Standards Board’s Accounting Standards Codification (“FASB ASC”). As specified in FASB ASC 958, Not-for-Profit Entities, the Foundation is required to report information regarding its financial position and activities according to three classes of net assets: unrestricted, temporarily restricted, and permanently restricted net assets. Unrestricted net assets are net assets not subject to donor-imposed stipulations on their use in the Foundation’s operations, as reported in the statements of activities. Temporarily restricted net assets are donor contributions with stipulations that are to be met by actions of the Foundation or others and/or the passage of time. When a donor restriction expires, temporarily restricted net asset are reclassified to unrestricted net assets and reported in the Statement of Activities as released from restrictions. Restrictions fulfilled in the same period as the funds were received are classified as unrestricted net assets. Permanently restricted net assets are subject to donor-imposed restrictions that they be maintained permanently by the Foundation. Generally, the donors of these assets permit the Foundation to use all or part of the income earned on related investments and/or unrestricted income for the Foundation’s operations.

Contributions Contributions are recognized when the donor makes a promise to give to the Foundation that is, in substance, unconditional. All contributions are considered to be available for unrestricted use unless specifically restricted by the donor. Amounts received that are designated for future periods, or restricted by the donor for specific purposes, are reported as temporarily restricted or permanently restricted support that increases those net asset classes.

Donated Assets Donated marketable securities are recorded as contributions at their estimated fair value at the date of donation and adjusted to market value at the end of the year. Donated shares at June 30, 2012 and 2011, were valued at $1,384, and $4,961, respectively.

Donated Services The programs of the Foundation utilize volunteered legal services, which are provided directly to beneficiaries of the Foundation. No amounts have been reflected in the financial statements for donated volunteers’ time because the criteria under FASB ASC 958, Not-for-Profit Entities, have not been satisfied. However, a substantial number of volunteers have donated significant amounts of time towards activities of the Foundation.

NOTES TO THE FINANCIAL STATEMENTS Cash Cash includes petty cash and amounts deposited in the checking account and custodial account. Amounts deposited in the custodial account are required to be maintained in a separate account.

Contributions and Other Receivables Total contributions and other receivables were $525 and $0 at June 30, 2012 and 2011, respectively. They are composed primarily of contributions and grants and are deemed to be fully collectable by management based on historical experience.

Property and Equipment Property and equipment are reported at original cost. All property and equipment purchases in excess of $750 for the years ended June 30, 2012 and 2011, were capitalized, while lesser amounts were charged to expense. Depreciation is calculated on the straight-line method over the estimated useful lives of the assets (5 to 8 years). Depreciation expense was $10,946 for the year ended June 30, 2012, and $12,513 for the year ended June 30, 2011.

Functional Allocation of Expenses The costs of providing various programs and other activities have been detailed in the statements of functional expenses. The costs have been summarized in the statements of activities. Accordingly, certain costs have been allocated among the programs and supporting services benefits.

Comparative Financial Information The financial statements include certain prior-year summarized comparative information in total, but not by detail and net asset class. Such information does not include sufficient detail to constitute a presentation in conformity with U.S. generally accepted accounting principles. Accordingly, such information should be read in conjunction with the Foundation’s financial statements for the year ended June 30, 2011 from which the summarized information was derived.

Income Taxes The Foundation is not-for-profit entity as described in Section 501(c)(3) of the Internal Revenue Service Code (“IRC”) and is exempt from federal and state income taxes for related income. It qualifies for a charitable contribution deduction in regard to its donors, and is subject to income taxes only to the extent of unrelated business income. In addition, per letter dated March 1972, the Internal Revenue Service has determined that the Foundation is a public foundation within the meaning of Section 509(a) of the Internal Revenue Code.

Use of Estimates The presentation of financial statements in conformity with generally accepted accounting principles requires management to make estimates and assumptions that affect certain reported amounts and disclosures. Accordingly, actual results could differ from those estimates..

Unrealized gains and losses are included in the change in net assets. NOTE E – PERMANENTLY RESTRICTED NET ASSETS AND FSP FASB ASC 958 The Foundation received an initial endowment (the “Endowment”) in 1993 in the amount of $200,000; and the Foundation has raised additional funds from various contributions to this endowment fund in the amount of $126,549. The Endowment has been established as a permanently restricted fund for which the income may be used to support the Foundation’s operations and activities, per the donor gift instrument. In August 2008, the Financial Accounting Standards Board issued Staff Position FSP FASB ASC 958, Endowments of Not-for Profit Organizations: Net Asset Classification of Funds Subject to an Enacted Version of the Uniform Prudent Management of Institutional Funds Act, and Enhanced Disclosures for All Endowment Funds (“FSP FASB ASC 958”). This standard provides guidance on classification of donor-restricted endowment funds for a not-for-profit organization that is subject to an enacted version of the Uniform Prudent Management of Institutional Funds Act of 2006 (“UPMIFA”) and provides other disclosures about an organization’s endowment funds.

Description of the Governing Board’s Interpretation of the Law(s) that Underlie the Organization’s Net Asset Classification of Donor-Restricted Endowment Funds The Board of the Foundation has interpreted the Uniform Prudent Management of Institutional Funds Act as requiring the preservation of the fair value of the original gift as of the gift date of the donor-restricted endowment funds, absent explicit donor stipulations to the contrary. As a result of this interpretation, the Foundation would classify as permanently restricted net assets (a) the original value of the funds donated to the permanent endowment, (b) the original value of subsequent gifts to the permanent endowment, and (c) accumulations of the permanent endowment made in accordance with the direction of the applicable donor gift instrument at the time the accumulation is added to the funds. The remaining portion of the donor-restricted endowment fund not classified in permanently restricted net assets would

In accordance with UPMIFA, the Foundation considers the following factors in making a determination to appropriate or accumulate donor-restricted endowment funds: 1) 2) 3) 4) 5) 6) 7)

As provided by UPMIFA, its guidelines for expenditure of a donor-restricted endowment funds apply in the absence of overriding, explicit donor stipulations. Specific provisions of donor gift instruments will take precedence over the general default provisions of UPMIFA, and these have been specified in the first paragraph of this note.

Description of the Foundation’s Endowment Spending Policy The Board of the Foundation has interpreted the income and the changes in realized and unrealized value of investments as unrestricted, and available to be spent per the terms of the donor instrument gift referenced above.

Description of the Foundation’s Investment Policies The Endowment has been invested in cash and the investments described in Notes B and C, with the objective of maintaining its funding power over time. It relies on a total return strategy in which investment returns are achieved through both capital appreciation (realized and unrealized) and current yield (interest and dividends). Actual returns may vary.

Nature and Types of Restrictions Per the terms of the Endowment instrument, the original gift is held in perpetuity. Subsequent gifts are treated in the same manner.

Information on Deficiencies The Endowment was not deficient as of June 30, 2012, or June 30, 2011.

NOTE F – LEASES Rental Property The Foundation currently leases its office space under a 10-year, non-cancellable operating lease, which expires November 14, 2013. The initial annual minimum lease payments were $95,310, which increase to $114,372 by the end of the lease term. The Foundation is also responsible for its share of common area maintenance costs and real estate taxes. Total rent expense under all leases was $163,155 and $166,132 for the years ended June 30, 2012 and 2011, respectively. Total future minimum lease payments are as follows:

Office Equipment Leasing The Foundation leased certain office equipment under a non-cancellable operating lease, which expired April 2011. The Foundation has not entered into a new lease and is currently month-to-month. Lease expenses were $10,602 for the year ended June 30, 2012 and $7,860 for 2011, respectively.

NOTES TO THE FINANCIAL STATEMENTS NOTE G – SPECIAL EVENTS The Foundation sponsors a 5K run/walk and a golf outing as special events during the year to raise funds to support the Foundation’s purpose of providing legal services to low-income clients. The gross receipts and related costs of these events were as below and include in-kind revenue and expenses in the amount of $4,800 for 2012 and $750 for 2011, respectively. JUNE 30TH

NOTE H – DEFERRED REVENUE Deferred revenue includes amounts received prior to year-end related to the Foundation’s annual 5K run/walk special event held subsequent to the fiscal year end. Deferred revenue for the years ended June 30, 2012 and 2011, totaled $99,152 and $131,226, respectively. NOTE I – REDEPOSITS PAYABLE Redeposits payable represents the Foundation’s client retainer for their case settlement and court costs. Redeposits payable for the year ended June 30, 2012 and 2011, totaled $6,414 and $18,829, respectively. NOTE J – EMPLOYEE 403(b) PLAN The Foundation sponsors a defined contribution 403(b) plan for its employees. Eligible employees are responsible for their investment in the plan and may make elective deferrals of their compensation, on a pre-tax basis, to the plan. The Foundation makes a discretionary contribution. The Foundation’s contributions to the Plan for the years ended June 30, 2012 and 2011, were $38,300 and $38,600, respectively. NOTE K – SIGNIFICANT CONCENTRATIONS Donations The Foundation had two contributors who contributed approximately 58.3% of the total Foundation support for the year ended June 30, 2012, and 59.0% for the year ended June 30, 2011. Cash The Foundation maintains its cash balances at financial institutions in the Chicago metropolitan area, which at times may exceed federally insured limits.

NOTES TO THE FINANCIAL STATEMENTS NOTE L – UNCERTAIN TAX POSITIONS As of June 30, 2012, Chicago Volunteer Legal Services Foundation did not have any uncertain tax positions that it is obligated to disclose in accordance with FASB ASC 740, Income Taxes. Additionally, there were no returns open to review or under review by taxing authorities in excess of annual statutory periods. The Foundation follows a conservative approach of research and open disclosure in regard to its tax-exempt status and positions held. NOTE M – SUBSEQUENT EVENTS The management of the Foundation has evaluated events subsequent to the statement of financial position date of June 30, 2012, through September 14, 2012, the date the financial statements were available to be issued. It has concluded that there are no effects that provide additional evidence about conditions that existed at the statement of financial position date that require recognition in the June 30, 2012 or June 30, 2011, financial statements or related note disclosures in accordance with FASB ASC No. 855, Subsequent Events.
