Students cheer, decry smoke-free SMC By KAYLEE SULLIVAN

S

tudents arrived on the St. Michael’s College campus in Colchester last week and slipped back into the same groove of class schedules and dormitory life. A noticeable difference, though, were the “SMC is tobacco free” decals posted on doors and buildings. As of September 1, a campuswide tobacco-free policy went into effect, banning tobacco from campus. The policy, which follows more than a year of smoking cessation programming from the Office of Student Health Services, aims to create a healthier community, a post on the college’s website said.

Tobacco, however, has not disappeared from the grounds, senior student Thomas Triumph said. Because tobacco is not illegal, there is no punitive response to individuals smoking on campus, he explained. “We realize that no policy change is always an easy one for everyone and there will be people affected both positively and negatively,” Mary Masson, director of health services, said in the college’s post. “It’s a hard thing to police, and we realize it’s a very difficult habit to break.” Masson referred all questions to SMC’s marketing office, which did not respond to interview requests by deadline Tuesday.

Masson told the college the administration hopes if someone sees someone using tobacco, they will respectfully remind the individual of the policy. Triumph, a 7-year smoker, said the policy is confusing and unclear since there’s no enforcement. He has continued to smoke on campus, and no one has told him to stop, he said. If someone were to approach him, Triumph said he would absolutely not stop smoking. “It’s just such a facade [the administration] is putting on,” he said. “Because it’s not punitive, you can still smoke. But their message of helping people isn’t getting across.” See SMOKING, page 2

Police seek park flasher

3-phase Bayside plan OK'd By JASON STARR The Colchester Selectboard endorsed a plan in August to locate a community and fitness center on five acres at Bayside Park, starting with an outdoor pool. The facility would displace some current park amenities onto the undeveloped townowned 14 acres across the street. Voters approved purchase of the undeveloped property between East Lakeshore Drive and Blakely Road in 2004 with an eye toward community recreation. The selectboard also endorsed a three-tiered phasing plan for the community center starting with construction of a $3.3 million outdoor pool and bathhouse. Phase II is construction of a $4.2 million community/fitness center building, and phase III is enclosing the pool. Consultant GreenPlay of Colorado recommended Bayside Park among five proposed locations, and parks and recreation staff recommended the phased approach. A survey of residents GreenPlay conducted in June identified an outdoor pool as a top recreational priority, according to GreenPlay’s Chuck Musgrave. Voter approval is required to borrow the funds for the structures, with revenue from the town’s local sales tax — implemented last year and collecting about $1.2 million annually — a primary source of debt service. “Initially we probably can’t afford an indoor pool, so let’s do this in incremental stages,” parks and recreation director Glen Cuttitta said. “You get the end result you want, but in the meantime, as money is accumulating, we can have an outdoor pool.” GreenPlay and town staff narrowed potential locations to a final two: Bayside Park and Severance Corners. Over the three phases, GreenPlay estimates the Bayside location will cost about $100,000 more than Severance would have, primarily because of the cost of a new on-site septic system as opposed to the sewer connection at Severance Corners. Colchester landowner talks history, new book

hen Malcolm Severance was looking to settle down and raise a family, he and his wife, Gladys, surveyed all the possibilities that would combine proximity to his job at the University of Vermont and the rural lifestyle of his youth. The best choice just happened to be right next to his parents’ farm on Route 7 on a parcel just north of the Colchester road that carries the family name. That is where, 50 years later, Severance began penning a history of an institution where he was educated, taught and served as a trustee. “A Pursuit of Excellence: A History of the University of Vermont School of Business Administration” was published this year. Severance discussed

the book and the future of his 100-plus acres in the geographic center of Colchester last week. His property makes up the northern half of Severance Corners, a state-designated growth center pre-permitted to absorb a majority of the town’s residential and commercial growth over the next 50 years as a bulwark against suburban sprawl. The right answer The Severance family goes back six generations in Vermont. Severance’s father, Herb, grew up on the original family farm in Colchester’s village off Main Street. Herb moved Severance and the family to what is now Severance Road when Malcolm was 5. They owned and farmed the land east of Route 7 and leased some of the fields on the west side, where Severance now

Police are investigating allegations of a man exposing himself in a Winooski park, a press release said. The Chittenden Unit for Special Investigations and Winooski police are seeking a male suspect who, on two accounts, “lewdly and lasciviously exposed himself to two females” at Gilbrook Natural Area. The first incident occurred the evening of August 31 and the second on the morning of September 1, a press release said. The suspect was described as a 5’10” to 6 feet tall Caucasian male in his late 20s or early 30s with a muscular or stocky build and short blonde hair, police said. St. Michael’s College Public Safety alerted students to the incidents with a Sept. 1 email since the park is adjacent to the campus and can be accessed behind the 300s townhouses. “While the Gilbrook Nature Area is not part of St. Michael’s College, our students, faculty and staff often use this area for recreation,” the email says. “We want our community to enjoy the use of the area, but to be alert for suspicious or concerning behavior.” CUSI reminded visitors to use the “buddy system” when possible, particularly in secluded areas or while walking at night. SMOKING from page 1 Senior Leah Seften, however, is in complete support of the new policy. “It’s not a decision for someone else to make for you – to be exposed to tobacco,” she said, noting tobacco smoke often wafts into

dorm windows and around her while walking to class. As a member of the cross-country team and the school’s mentor program, Seften added it’s unfair for runners and young kids to be exposed to tobacco smoke. Though Seften is pleased the college is sending a message to the community that it cares about students’ health and wellness, she also

is confused about its rollout. “Implementing it in the first place is important, but the follow through about creating a culture now that we say we have it, is important in the coming year,” she said. “You see the signs on all the doors, yet you see people smoking 20 feet away from the sign.” St. Michael’s joins a list of about 1,500 smoke-free campuses in the

United States, of which about 1,140 are tobacco-free, according to tobaccofreecampus.org. The University of Vermont, which became tobacco-free in June 2015, marks the only other Vermont school on the list. Over a year after the policy was put into place at UVM, Sgt. Brandon King of campus police said it’s “hands off as far as law enforce-

ment goes. It’s more of a community awareness thing so people can be open to conversations on it.” At St. Michael’s, Triumph said he’s noticed fewer people smoking in open areas and more people smoking off to the side and behind buildings. “It’s kind of embarrassing to have to smoke behind shadows,” he said.

Sanity evaluation ordered in Molotov cocktail case By JASON STARR

than Kvasnak will undergo psychiatric and sanity evaluation after being charged with possessing homemade explosives at his Forth Ethan Allen apartment in Colchester on August 29. Kvasnak, 28, a native of Middlebury, pleaded not guilty to three counts of possessing a destructive device and one count of unlawful mischief. He is being held at the Northwest State Correctional Facility in Swanton in lieu of $10,000 bail, according to court documents. Colchester Detective Jack Lehneman wrote in arrest records that Kvasnak made delusional statements when confronted by police at his apartment after a neighbor called police about repeated banging noises coming through a closet wall. According to Lehneman, Kvasnak admitted to having “Molotov cocktails” — glass bottles filled with flammable liquid and equipped with a

homemade wick — to throw them at F-35 planes because he was “mad at the war.” Lehneman also wrote Kvasnak claimed to be an Air Force pilot who recently shot down a plane in Canada. He resisted being taken to the University of Vermont Medical Center, saying he was “injected with urine, beaten and raped the last time he was there,” Lehneman’s affidavit says. Kvasnak was previously arrested in June 2015 by Shelburne Police for fighting and was cited for disorderly conduct, according to court records. The charges were later dropped. In 2010, Kvasnak was convicted of driving under the influence, according to court records. Colchester officers Jeremy Wyskiel and Jaime Bressler originally responded to the noise complaint last Monday. Wyskiel said he smelled gas and saw golf clubs sticking into a wall upon entering Kvasnak’s apartment. He also saw several glass bottles, some par-

tially filled with liquid and wicks made of paper towels sticking out, according to court records. A plastic container containing gas was also spotted. Colchester’s and Vermont’s hazardous materials teams and Vermont State Police’s bomb squad all were called to the scene. Essex and Winooski police helped evacuate 23 nearby apartments. According to Lehneman, Vermont’s HAZMAT team tested the liquid in three of the bottles and found ethanol and gasoline as well as caps modified to accept a wick. “The only purpose for the modified glass bottles with the flammable liquid inside was to create a destructive device: Molotov cocktail,” VSP trooper Paul Ravelin said, according to Lehneman’s affidavit. The Champlain Housing Trust, an affordable housing nonprofit, owns the Ethan Allen Apartments where Kvasnak lived.

SEVERANCE from page 1 lives. At one point, the Severance family owned all four quadrants of what is now the Severance Corners growth center. They have since sold the two southern quadrants, including the southwestern one to S.D. Ireland, where a neighborhood of condominiums and commercial space has sprung up over the last decade. Severance retains the two northern quadrants. Ideas for the land have come and gone, including locating the headquarters of the Colchester Police Department, a neighborhood of single family homes (the developer backed out after waiting for the housing market to recover from the 2009 recession) and most recently community center there (see related story, page 1.) Even the circumferential highway, with a right-of-way that bisects the property, has been tabled. Severance has been involved in all these discussions, as have his three children who all live in Chittenden County. “It’s a good idea, but it had to be fleshed out, and it’s still being fleshed out,�

Severance said of the 2006 growth center legislation that Colchester’s then town planner, Brenda Green, helped write. “There are so many different thoughts that rise, get critiqued, fall away, then another thing comes up. Sooner or later you get the right answer, and what that’s going to be is yet to be determined.� Severance and Gladys describe their family as close knit and without secrets. They get together regularly to discuss the future of the property. “We do know people who are interested, and the town is very interested in helping us find developers, because they want to concentrate growth,� Severance said. “We are happy to talk about it, but we want to make sure that whatever we do is right for the long haul.� Fortunate finale Severance spent the last five years, working from a home office on a part-time basis, researching and writing the history of UVM’s business school. As a former business department chairman who shepherded the department into business school status in 1981, it’s “a history that he, in no small part, created and inspired,�

said former UVM president Daniel Fogel, who wrote the book’s foreword. Severance had the book ready for publication in 2013, when he discovered there would be one essential final chapter. He had heard rumors about a wealthy philanthropist, UVM graduate Steven Grossman, who was preparing a large donation to the school. Last October, Grossman publicly committed $20 million to the school. It was a fitting finale to a story that began with a $50,000 endowment in 1899 from John Converse, whose name bears Converse Hall on the UVM campus. After the public announcement, Severance interviewed Grossman and finished the book. The business school is now named the Grossman School of Business. “John Converse and Steven Grossman are the Alpha and the Omega of this story,� Severance writes at the beginning of the final chapter. “I lucked out because this story has a great beginning and a great ending, but it wasn’t by design,� Severance said. Town administrators have met with Severance Corners landowner Malcolm Severance periodically about the possibility of public acquisition of three of the roughly 110 acres Severance owns for a community center. “They never did ask me [for a land donation], but there was an implication that they expect some sort of favorable treatment, possibly naming the center after me,� the 91-year-old Severance said. S.D Ireland, developer of the southwest side of Severance Corners, also has land assets that could “change the equation,� town manager Dawn Francis said. “Given the information we have today, we are recommending that it be located at Bayside Park. A land donation certainly could change that picture,� Francis said. Severance and his wife, Gladys, both believe Bayside is the better location. “When you think of Colchester, recreation-wise, Bayside Park is that hub of recreation in our community,� Cuttitta said. “With the proximity to the schools, it would really be a benefit to have the center there. It

opens up the bay as a true contiguous property. We felt we could create that recreation destination that we are trying to achieve.� The selectboard’s endorsement came with the caveat that community center plans are “subject to further public comment and refinement.� “This is going to be a source of discussion for another year or two,� Francis said. “I envision much more in terms of public input.� GreenPlay representatives will return to Colchester on September 27 for a master plan presentation for Bayside Park incorportating the undeveloped public acreage across Blakely Road.

Town opens board seats to students Civic opportunities for Colchester teenagers expanded in August when the selectboard added a seat for high school sophomores or juniors on all of the town’s appointed boards, committees and commissions. The move creates an even number of members on the town’s eight boards, committees and commissions. A majority of selectboard members felt the policy’s benefits outweigh the risk of deadlocked votes. Only the selectboard is excluded from the policy. The only other elected board, the library board of trustees, will have only a non-voting youth member. Youth are eligible for full voting membership on the development review board, planning commission, conservation commission, recreation advisory board, governance committee, board of ethics and cemetery advisory committee. Colchester’s School Board has had a non-voting student member for several years. The selectboard debated giving students

full voting membership on the appointed boards or offering only an advisory seat. Board members Marc Landry and Tom Mulcahy voted against granting voting status after joining in with the majority for unanimous adoption of the policy as a whole. “If we are going to do it, we might as well be all in,” board member Jeff Bartley said, suggesting a second student seat could be added if deadlocked votes become an issue. Landry argued student votes on the DRB — the town’s land use approval panel — are particularly risky because that board’s decisions do not require selectboard endorsement. All the other appointed boards provide only recommendations to the selectboard. “I prefer we try it without a vote that counts, and let’s see how it works,” Landry said. Colchester High School principal Heather Baron said she has already fielded student inquiries about the openings. She plans to recruit candidates through home room announcements and electronic communication with students and parents.

Students who serve will be eligible for school credit through a “flexible pathways” process already in place at the high school guidance office for outside experiences. Interested youth will undergo the same application process as adult members, applying for vacancies with the town manager’s office and submitting to a review by the selectboard. “It’s a fantastic opportunity for students to use their voice, apply critical thinking and become active citizens,” Baron said. “Having strong student voices in our town is a win for everybody.” Unlike adult members, youth members will serve only one-year terms. The policy states that each board/commission/committee will designate an adult member to act as a mentor to its youth member. The policy is “an effort to encourage young adults to become active in civic volunteerism, as well as foster an interest in municipal government to heighten civic awareness and boost citizen participation for the future of the town of Colchester,” Town Manager Dawn Francis wrote an Aug. 23 memo to the board.

Letters to the Editor Not ‘smoke and mirrors’ I understand Bob Bouchard’s concern when he stated in last week’s letter to the editor that “I am afraid Curt comes across as a tax and spend liberal Democrat.” Unlike two of the other candidates for state representative, I have a very short track record of public votes. And in one instance I did indeed support “taxing and spending.” As a member of the Town’s Governance Committee, I helped research and write our report to the selectboard regarding a local option tax for Colchester. I supported the LOT and the requirement that LOT funds be spent only on town debt service and future voter-approved projects. The selectboard and Colchester voters approved that tax increase. As a result, Colchester saw a one-time 5.4 percent de-

crease in municipal taxes. Compare your 2014/15 municipal tax rate of $0.5714 to your 2015/16 tax rate of $0.5405. The LOT has brought in nearly $1 million of revenue. When annualized, that is close to the projected $1.29 million we hope to receive each year. I currently serve on the Colchester School Board. There, too, Colchester saw a surprising 1.89 percent tax rate decrease in the homestead education tax rate from 2015/16 ($1.4386) to 2016/17 ($1.4113). I can’t claim much of an influence toward that reduction. It was the result of what may be a unique coincidence of events at the local and state levels. But one of the contributing factors was a continued emphasis on thoughtful frugality by our entire district school board and administration. I urge readers to view the LCATV.org tapes

Explanations of these reductions may appear to be what Mr. Bouchard calls “smoke and mirrors,” but the bottom line is undeniable: In both cases where I had a marginal influence, tax rates decreased. Tax policy is complicated. A small increase here may result in a large decrease there. With Vermont’s education funding formula, it’s anyone’s guess what each year’s tax rates will be. Any change in tax policy requires careful, thoughtful consideration based on research and common sense. And there may well be unintended consequences. Most “village-side” Colchester voters know me as the yellow-shirted cyclist that comes around every

Through participation in civic volunteerism today, we hope to increase future citizen engagement for a strong and vibrant Colchester tomorrow. It’s an opportunity for the town to encourage interest in municipal government and broaden citizens’ awareness of local issues and initiatives, and it’s a great way for interested students to become involved in their community in a meaningful way; to share their views, opinions and fresh ideas while getting a taste of local government in a friendly, positive atmosphere. The goal of Get Engaged is to bring a Colchester student to each of the town boards and commissions. With the guidance of a board member-mentor, the student will take part in shaping the direction of town growth and initiatives while gaining valuable life experience in teamwork, problem solving, and presentation and communication skills. The one year terms are open to sophomores, juniors and seniors who are Colchester residents. Town boards and commissions cover a wide scope and variety of interests, including conservation and preservation of natural resources; planning recreation activities and events, long-term planning for growth, library operations, programs and policies; neighborhood development

and zoning issues and cemetery restoration, maintenance and local history. The town has also expanded its use of student interns in town departments to offer practical work experience to students, expose them to local government and future career opportunities, perform work for which we lack resources and to meet goals established in the Town’s Heritage Plan and Colchester School District’s Strategic Plan. The following is a summary of work performed over the summer by paid college interns, seasonal employees and volunteers: For the town clerk, planning and zoning office, assessor and public works, they updated cemetery information, scanned files, permits and documents and updated spreadsheets; perofmed preliminary field assessments for sidewalk and paving spot repairs (due to limited contractors’ interest, we will attempt re-bid next year) and more. For the police: carried equipment at calls (within limits of law and safety), sorted property to be returned, participated as actors at Vigilant Guard and assisted in police K9 training. For parks and rec: assisted with afterschool programs and served as camp counselors, lifeguards, lacrosse assistants and camp counselors and as track & field, football, baseball and soccer camp coaches. Scotland Yard Inspector Ian Rutledge is sent to the north coast of Cornwall to investigate the attempted murder of a young man, a local banker’s son. He was out in a boat on the River Camel, when his craft began sinking. Four young women were also out on the river; a witness on shore claims the women approached the young man, but instead of helping him, one struck him on the head, knocking him unconscious. The four accused are all upstanding young woman and were acquainted with the victim. Before he can be questioned, the victim takes a turn for the worse and dies of his injuries. The charge is now murder, and the investigation begins to take twists and turns, while the angry family members of the accused want their release. Rutledge must find the evidence to clear them.

“Scarlet” By A. C. Gaughen Young Adult Fiction, 2012 Reviewed by Kelsey Psaute, Young Adult Services Most probably know or have heard of Robin of Locksley, and there are many variations on the tale of the

(in)famous bandit who stole from the rich to give to the overtaxed poor. However, Will Scarlet, his famed companion and best friend, has fewer adaptations. Enter this book. Not only does it focus on a different member of Robin Hood’s merry men, but in this version, Will is secretly a she. Scarlet is good with her knives and even better with her sticky fingers, fighting beside Robin and John Little to save the people. She’s fierce, protective and dangerous. Things heat up when a worldclass thief catcher comes to Nottingham and knows her—could recognize her and jeopardize everything they’ve worked for. This adventure novel almost reads like a thriller, action on every page and plenty of intrigue to keep you guessing. I never saw the ending coming!

Perspective Candidates raise legit jobs questions By ERIC DAVIS

overning” is a non-partisan magazine based in Washington that focuses on state-level politics and policy. It recently ranked the economies of all 50 states, using a range of indicators measuring employment, state GDP, and the income of state residents. Vermont ranked 25th, in the middle of the pack both nationally and in New England — lower than Massachusetts and New Hampshire, about the same as Maine, and above Connecticut and Rhode Island. The left-leaning Public Assets Institute, a Montpelier think tank, came to a similar conclusion about Vermont’s economy, issuing a report last week headlined “Vermont’s Job Market Makes Pokey Progress.” The data in the report show that more Vermonters are working today than a year ago. However, Vermont, unlike the nation and the New England region as a whole, still has fewer people working than was the case at the pre-recession peak in 2007. The reports from “Governing” and the Public Assets Institute demonstrate why Republicans Phil Scott and Randy Brock should be seen as slight favorites to be elected governor and lieutenant governor in November, at the same time Vermont gives substantial majorities to Democratic candidates Hillary Clinton, Patrick Leahy and Peter Welch. Vermont Republicans are focusing intently on jobs and the economy in their campaigns this fall. Unlike in previous cycles, when some Republicans emphasized social issues, this year Republicans are talking nearly exclusively about the slow growth of Vermont’s labor force, the stagnation of middle-class incomes since 2010, and the impact of higher health care premiums, property taxes and other fees on affordability for Vermont middle-income households. Republican candidates argue that, after six years of single-party Democratic control in Montpelier, it is time for a change. While they do recognize that some of Vermont’s economic problems are due to national and international forces that are largely outside state government’s control, they are also asking the voters to give a new leadership group a chance to try out a new set of policies. For the next few years, the Republicans say, the emphasis in Montpelier should be on making state government more efficient and effective, delivering existing programs better before adding still more responsibilities to state government’s agenda. Vermont Democrats could well have difficulty refuting this argument. The state’s economic performance over the past six years has not been especially strong. Gov. Shumlin’s relative unpopularity at the end of his term does not make Vermont voters enthusiastic about keeping the Democrats in control. Additionally, the positions of Democratic candidates Sue Minter and David Zuckerman on issues such as wind tower siting and gun control may mean they receive fewer votes from rural areas of Vermont than successful Democratic candidates in past elections. Phil Scott and Randy Brock have made clear that they do not support Donald Trump, and will not vote for him in November. Scott first spoke out against Trump as far back as December 2015. Scott and Brock have probably inoculated themselves against the damage that Trump could well do to the Republican Party in much of the Northeast. Voters in other northeastern states that are otherwise strongly Democratic have recently voted for moderate Republican gubernatorial candidates. In Massachusetts and Maryland, voters in 2014 elected Republicans Charlie Baker and Larry Hogan, respectively, to succeed Democratic governors who did not seek re-election. Baker is now the most popular governor in the nation, with an approval rating over 70 percent, and Hogan has a positive rating as well. Both Baker and Hogan have disassociated themselves from Trump and the congressional Republican agenda. While the election outcome is by no means settled, Vermont voters could decide in November that Phil Scott should join Charlie Baker and Larry Hogan as moderate Republican governors in otherwise strongly Democratic states. Vermont tops the nation in chicken pox vaccinations, according to newly published results from the 2015 National Immunization Survey for Teens, but there is more work to be done to ensure all Vermont teens are protected against cancercausing human papillomavirus, commonly known as HPV. The annual telephone survey conducted by the Centers for Disease Control and Prevention found that Vermont adolescents age 13 to 17 had the highest rate of varicella (chicken pox) immunization in the country. More than 96 percent of teens in Vermont were fully vaccinated, which is significantly higher than the national average (83 percent). Vermont teens also had higher than average vaccination rates for Tdap (tetanus, diphtheria and pertussis), meningococcal disease and HPV. The CDC’s Advisory Committee on Immunization Practices recommends adolescents age 11 to 12 receive vaccines to prevent diseases, including one that protects against HPV infection. HPV infection can result in certain types of cancers, most notably cervical can-

cer, but also cancers of the throat, tongue, tonsils and genital and anal cancer, as well as genital warts. The HPV vaccine is the first highly effective vaccine to prevent multiple types of cancers. Administered as a three shot series over six months, the HPV vaccine has been recommended for girls since 2006 and for boys since 2011. In Vermont, nearly 69 percent of girls and 66 percent of boys have received at least one HPV shot. “This new data is encouraging,” said Dr. Erica Gibson of the University of Vermont Children’s Hospital and the Vermont Child Health Improvement Program. “We’re seeing that overall, Vermont

While the trends are good for the initial dose of the HPV vaccine, the challenge is to make sure teens get their additional shots to be fully protected by this safe and effective vaccine.” Many Vermont teens that start the vaccine series do not get back to the doctor’s office for the full course of shots. Since it was first recommended for them nine years ago, 54 percent of girls in Vermont had completed the full vaccination series. In just four years since being recommended for boys, their immunization rates for the series have risen to 40 percent. Closing the gap so that teens get the full series of shots is a priority for Vermont health officials and providers. “I’m pleased with the progress to date and the strong support of our health care partners,” Vt. Department of Health immunization program manager Christine Finley said. “We need to continue to build on the work of parents, primary care providers and schools to protect teens.” Finley cited the department’s work with the National Improvement Partnership Network collaborating with health care providers to improve systems that help deliver recommended immunizations to Vermonters. “My hope is that in the very near future, all teens will be able to realize the full potential of the HPV vaccine to prevent cancer,” Finley said. Gibson offered reassurance to teens that may not have finished the full course of shots. “Even if things get off track after you get the first dose, don’t worry,” she said. “It’s never too late to go back and get your additional doses.
