‘All-change’ for local school hours

We have followed closely the saga endured by people with pensions, who chose to redeem part of those pensions before they were of pensionable age, and to find they lost what they thought they had, and were charged UK Tax on money they never received, and even - in one case - on an enquiry they made. Our initial informant was a lady who owns a property in Adsubia Capsades.

Affected owners have created a Facebook Group (Ark Pensions Class Action) and their action is being defended by David Summerhayes - not a unique name - but one lawyer with that name is described on the Internet as helps business leaders to protect themselves against fraud.

We could have called this local magazine HAVVYER HEARD, but we thought Jávea Jeard would confirm our light-hearted attitude to the serious political and economic problems in Spain, and their effect on Jávea.

Angie has made application for copies of the files of all ARK claimants under the Freedom of Information Act. A similar request has been made to Dairiada.

I could only give you advance warning in our previous issue about school changes in the NEW School year. Junior schools open at 8.30am and will close at 2pm suiting families where one of the parents is not working in the afternoon. Where parents are not at home until later in the afternoon, schools are discussing a range of extracurricual work to fill in.

It would be ironic if those defrauded by HM Revenue in the UK, made to reimburse money they’d never received, should be defended by a person who helps business leaders protect themselves against fraud. Angie Brooks is coordinating claims in respect of Financial Advisers who offered early redemption of UK Pension entitlement, but claimants were unaware that loans in the UK were being processed by ‘Dairiada’ who ARK claim are jointly liable.

Jávea Townhall April meeting

For the second consecutive month I was unable to attend the Councillors’ monthly meeting at Jávea Townhall (I could not climb stairs after being in hospital) but Kacey was present and gave me the notes she’d made.

After declaring the meeting open, the Mayor led Councillors through the Agenda. Point 1 approved the Minutes of the monthly meetings held on 26th November, 19th December 2013 and 20th and 27th February 2014. Jose Luis (PP) said the Minutes might have been approved sooner, had they not been distributed to Councillors in a format that sent Minutes to the ‘Spam’ folder. Approval was unanimous. Point 2 unanimously approved whatever decisions the Mayor had made undelegated powers - since 25th March. Point 3 took into account letters the Townhall had received from Belen Quiroga, the new NUEVA JAVEA Councillor. Point 4 gave the opportunity for the Mayor to suggest how responsibilities and membership of Townhall Committees might be changed now that Belen Guiriga had been recognised as a Councillor. Having explored some of the options he can now go away, consult with others and make his recommendation at the Pleno at the end of May. Point 5 proposed that when the Townhall needed chairs, marquees and the like, having reviewed overall costs, Carpes i Cadires S.L. be considered, Point 6 Councillors agreed on the 5th price increase with Cespa S.A. to cover increased costs between 1st December 2012 and 30th November 2013, which apply to beach cleaning, maintenance and rubbish ollection. Unanimous. Point 7 Councillors approved payment under reference F/2014/22 in the amount of 8,851€. Point 8 allowed Councillors to discuss the procedure for loans and grants and it was agreed to increase the grant to Club Sportiu Xabia, and to

cancel the grant previously planned for the Karate/Judo Club. Point 9 Vicente referred to the availability of a large investment to benefit the local economy and asked to be informed where there was need. The amount was not mentioned. Mayor Chulvi said it was Townhall policy to meet local expenditure using local businesses, unless the job was too big for a local supplier. Oscar said expenditure on sports events and the like, was put out for tender, and most of the awards are to local companies. Point 9 referred to action under Tax Law 217 and Councillors approved that the decision of the Alicante Court of Contentious Administration. Point 10 gave the additional authority for gas provider Endesa Gas to create additional pipework to convey gas from existing pipework on the edge of rural construction, to individual dwellings in the Pueblo, Port and Arenal. Phase 1, will bring natural gas to the Western outskirts of the municipality, at Silvasol. Piped gas available throughout the municipality, including the Pueblo, Port and Arenal may take as long as 4 years. The Townhall will be responsible for inspection of the pipework, with no pipework taking place in Semana Santa and the Summer months. Councillors approved the project but insisted the Town Planner must pre-approve all work. At this stage only the project is authorised, NOT the granting of a Licence, and a Guarantee will have to be provided. Five oil wells possible in the Gulf of Valencia

A study commissioned by the Spanish Association of Research Companies, Exploration, Production of Hydrocarbons and Underground Storage (Aciep) notes that it is expected to find deposits for five oil wells in the Gulf of Valencia containing about 70 million barrels of oil. The most promising area of Spain is actually the Canary Islands, where a volume of 1.200 million barrels is expected. Work in the Gulf of Valencia is in an early stage and could take a couple of decades to accomplish. They considered the project to be a "clear threat" to the economy of the Marina Alta and a risk to vital economic sectors such as tourism, fisheries and food. Tourism department expands range of guided tours

Jávea’s tourism department has expanded its range of guided tours to include a "Gastronomía" route - and several routes based on the richness of local vegetation and its use by different cultures. There will be five routes: Cap Prim and its microreserve of flora; Xàbia Romana which discovers the marks left by the Romans; Cala Tangó and the marine reserve; Santa Llúcia and the conquest chapels; and the windmills of the natural park of Montgó. These routes will also offer the chance to taste local products.

Public Works programme to be financed by 4.2 million surplus

Mayor Jose Chulvi, and the Councillor for Finance, Oscar Anton, have finalised the new public works programme to be financed from the surplus generated from the 2013 accounts. Of the 4.2 million euros saved, €3 million together

The range of the proposed projects falls into the category of ‘financially sustainabl’ in accordance with requirements established by Central Government. New proposals for Port development

The Valencian Government has put forward new proposals for the development of the Port. In contrast to previous plans, this involves reorganisation of the existing port area and not port expansion. The project is budgeted at €8 million with a minimum annual fee for Valencia of €50,000. There will be concessions for the ramp, crane, public moorings and current mooring at the Levante jetty. Spain in world’s top ten for environmental conflicts Spain has the eighth highest number of environmental troublespots in the world, according to the Environmental Justice Atlas (EJA). The new map pinpoints an incredible 35 ‘conflicts’ around the country that are of major concern. The majority of these are linked to industrial and building projects, as well as waste management sites. (Note: the list does not include the controversy over prospecting for oil in the Gulf of Valencia).

A few years ago, fracking in Spain seemed as likely as bullfighting in Britain. These days, energy companies from Texas, Canada and Ireland are going after exploration and drilling permits in hopes of capitalising on geology indicating Spain has a sizable chunk of the 883 trillion cubic feet of natural gas in shale estimated to sit under Europe.

What’s changed? A sluggish economy for one — the energy industry estimates fracking could eventually create tens of thousands of jobs in a nation with an unemployment rate of 26 percent. Unlocking gas deposits might ease what consumers pay for heating fuel. It’s about triple the U.S. price. As important, the national government, with the economy in mind, took a pro-fracking stance even as regional and local authorities harden what’s long been widespread European environmental opposition to oil and gas development of any kind. Spain’s recovery - Better but not best

..Spain has some of Europe’s highest income-tax rates, but puny overall tax revenue. A report commissioned by Cristobal Montoro, the tax minister, proposes a shift from income tax and social-security contributions to consumer taxes while closing businesstax loopholes. As jobs return, a virtuous cycle of improved confidence, consumer spending and faster growth could begin. Analysts are raising their projections, with some seeing GDP growing by 1.3% this year. Even so, unemployment, now standing at almost 26%, will take a decade to fall substantially. And as it is, the budget deficit barely fell last year, as public spending grew. The public debt has hit 94% of GDP.

Smarter, cheaper and greener ways to get around town

Ever-more costly gasoline, gridlocked traffic, global warming and, above all, the need to save money are just a few of the harsh realities facing the Spanish automobile sector, which is going through its worst slump since 1986. Young people are no longer interested in owning a car, especially if they live in a large city. But that, of course, doesn’t mean they still don’t need to get around. One answer could be car sharing. Dear Readers, We would like to take this opportunity to inform you that a Regulation was passed in 2012 (REGULATION (EU) No 650/2012), allowing EU citizens to leave their Spanish property according to their own national law, instead of the law of their country of residence. It is required to make a Spanish Will in which you state that you wish to leave your property according to UK law and that the Will only applies to your Spanish assets.

This law will come into being in Spain in 2015, so all non-Spanish owners of properties in Spain (residents or non residents), should make a Spanish Will ASAP. In fact, having a property in Spain without making a Will can be a very risky and ultimately a costly decision for you and your legal heirs.

Why? Firstly, because without a Will, inheritance expenses can be prohibitively high (in Probate or Grant of letters of Administration’s costs, plus swore translations and compulsory legalization of documents, legal fees, etc).

Secondly, beneficiaries will face a lengthy and stressful Spanish legal process to claim their Spanish inheritance, whilst a standard inheritance procedure can just take around 3 months where the testator has made a Spanish Will.

Thirdly, because if someone dies without making his or her wishes clear in a Spanish Will, there is a possibility that the Spanish rules on intestacy might apply. Spanish intestate Law differs greatly from UK Inheritance Rules. Whereas the UK law permits individuals, within reason, to leave their assets to whom they choose, the Spanish law imposes strict rules as to inheritance by family members. This is particularly appropriate in situations where there has been more than one marriage and several children from different marriages. According to the Spanish Rules of Intestacy, all children (irrespective of the marriage), would have a preferential equal entitlement to claim their own share. Therefore, if you plan to leave your Spanish property and assets to your heirs without wishing for them to suffer delay and escalating costs, you ought to make a Will in Spain before you pass away. Moreover, it is essential to mention clearly that the scope of the Spanish Will must include any present or future properties or assets, located in Spain only. Otherwise, the Wills could be accidentally invalidated and as a result, the testator’s actual wishes completely overridden.

On the other hand, we have detected an increasing number of people (usually family members) who contact us when they find out that their loved ones have passed away in Spain. Usually our clients are unaware of whether their parents or friends had a Spanish Will or not, and usually come to our offices without having any clue about the number and specific location of the assets and properties owned by the testator.

This situation of uncertainty frequently leads to a lot of stress and delay, which finally results in escalating costs and significant inconvenience derived from having to request for a lot of additional certificates from the Spanish Authorities, which sometimes are not easy to obtain.

Subsequently, in order to prevent this unpleasant situation from happening, it is crucial that you carefully follow these very important final instructions very carefully and in case you might have any question or doubt, please do not hesitate to contact our Law Firm for further clarification or advice:

1º.- We strongly recommend that your Spanish Will is signed shortly after the property purchase and that you also update your Spanish Will, such that your current Will might no longer reflect your actual wishes or if your personal situation might have varied substantially, like for instance getting married, divorce, having new children, etc. Nevertheless, if you change your passport number or your address, you will not need to change the Will.

2º.- Nevertheless, keep all your paperwork in order and let also your beneficiaries know where it is kept. This includes local vehicle tax payments, property rates payments evidence, title deeds, mortgage contracts and details of

Public Meeting on Valencian Government's Jávea Port Project proposals Jávea Town Hall will provide details of Valencia's feasibility study for the construction and operation of a nautical/ sport facility in Jávea Port at a public meeting on Wednesday on May 7th at 8.00pm in the Casa de Cultura. The idea is to obtain the opinions of local groups and citizens over the coming week to incorporate them into a submission of comments to the Department of Infrastructure in Valencia. The deadline for the Town's response is May 10th.

Arenal's Canal de la Fontana out to tender

After years of delay, the Valencia Government has finally put the contract for the construction and operation of the Canal de la Fontana out to tender. According to the Official Gazette, this project to privatise the management of the canal is valued at €5,008,017. The deadline for submitting tenders is two calendar months. The process will be

open and will be awarded to the most advantageous proposal. Besides the investment of five million euros in the works, the company will have to pay an annual fee of €65,000 plus VAT to the regional government. The most worrying aspect is what will happen to the 350 members of the Aexamar association, who make up 85% of the current users of the canal, and which used to be involved in managing the channel.

Montgó forest fire highlights vulnerability of houses

A forest fire in the Montgó Natural Park near Jesus Pobre (cause unknown, but being investigated), affected 40 hectares of forest on the Col de Pous and Barranc de l`Huera area. 50 people had to be evacuated from their homes, while helicopters and planes doused the fire from the air. Firefighting went on late into the night since embers were rekindled by gusts of wind and had to be smothered once again. Next morning aerial firefighting assets cooled and secured the perimeter of the fire. There had been fears that flames might spread over the Col de Pous onto the Denia side of the mountain, where there are many more houses. As things were, there were no hydrants to protect the houses on the south side of the mountain, the closest hydrant being at the Marriott hotel which had insufficient water pressure. Benidorm aims for a technology park

In an attempt to solve a long standing dispute over land use with the regional government, Benidorm has proposed the construction of a technology park next to Terra Mítica. Development would be done with private capital, and the park managed by a public / private consortium.

Farmers ask for measures against effects of current drought

The Coordinator of Organizations of Farmers and Herders in the Valencia Region, COAG-CV, has called on the Government to implement emergency measures to mitigate the negative effects of drought: Income tax reduction, granting soft loans to the affected farmers, improving the conditions for agricultural insurance and one-year extension of non-repayment of loans etc. As reported by the Coordinator, the lack of rain is seriously damaging most crops and development of trees themselves seriously endangering the survival of many farms. Marina Alta municipalities ask for management of la Xàra Transfer plant

The Valencia Government owned environmental management company Vaersa has withdrawn from the Marina Alta Recycling company, raising fears that it may make off with a big chunk of the €1.5 million profits accumulated over its years of activity. In response, the Marina Alta mayors, as shareholders, have asked for the free transfer of the la Xara rubbish transfer plant to them, with Vaersa still providing its services free of charge. If this is not possible, then they'd like to buy the Vaersa shares in the recycling company at a nominal value, coupled with transfer of the la Xara plant and its use for 30 years.

A famous art collector is walking through the city when he notices a mangy cat lapping milk from a saucer in the doorway of a store and he does a double take. He knows that the saucer is extremely old and very valuable, so he walks casually into the store and offers to buy the cat for two dollars. The store owner replies, "I'm sorry, but the cat isn't for sale.¨ The collector says, "Please, I need a hungry cat around the house to catch mice. I'll pay you twenty dollars for that cat." And the owner says "Sold," and hands over the cat. The collector continues, "Hey, for the twenty bucks I wonder if you could throw in that old saucer. The cat's used to it and it'll save me from having to get a dish." To which the owner says, "Sorry buddy, but that's my lucky saucer. So far this week I've sold sixty-eight cats."

THE STORY BEHIND THE PICTURE OF THE PRAYING HANDS

Back in the fifteenth century, in a tiny village near Nuremberg, lived a family with eighteen children. Eighteen! In order merely to keep food on the table

for this mob, the father and head of the household, a goldsmith by profession, worked almost eighteen hours a day at his trade and any other paying chore he could find in the neighbourhood. Despite their seemingly hopeless condition, two of the elder children, Albrecht and Albert, had a dream. They both wanted to pursue their talent for art, but they knew full well that their father would never be financially able to send either of them to Nuremberg to study at the Academy. After many long discussions at night in their crowded bed, the two boys finally worked out a pact. They would toss a coin. The loser would go down into the nearby mines and, with his earnings, support his brother while he attended the academy. Then, when that brother who won the toss completed his studies, in four years, he would support the other brother at the academy, either with sales of his artwork or, if necessary, also by labouring in the mines. They tossed a coin on a Sunday morning after church. Albrecht Durer won the toss and went off to Nuremberg. Albert went down into the dangerous mines and, for the next four years, financed his brother, whose work at the academy was almost an immediate sensation. Albrecht's etchings, his woodcuts, and his oils were far better than those of most of his professors, and by the time he graduated, he was beginning to earn considerable fees for his commissioned works. When the young artist returned to his village, the Durer family held a festive dinner on their lawn to celebrate Albrecht's triumphant homecoming. After a long and memorable meal, punctuated with music and laughter, Albrecht rose from his honoured position at the head of the table to drink a toast to his beloved brother for the years of sacrifice that had enabled Albrecht to fulfil his ambition. His closing words were, "And now, Albert, blessed brother of mine, now it is your turn. Now you can go to Nuremberg to pursue your dream, and I will take care of you."

All heads turned in eager expectation to the far end of the table where Albert sat, tears streaming down his pale face, shaking his lowered head from side to side while he sobbed and repeated, over and over, "No ...no....no ..no." Finally, Albert rose and wiped the tears from his cheeks. He glanced down the long table at the faces he loved, and then, holding his hands close to his right cheek, he said softly, "No, brother. I cannot go to Nuremberg. It is too late for me. Look ... Look what four years in the mines have done to my hands! The bones in every finger have been smashed at least once, and lately I have been suffering from arthritis so badly in my right hand that I cannot even hold a glass to return your toast, much less make delicate lines on parchment or canvas with a pen or a brush. No, brother ....for me it is too late." More than 450 years have passed. By now, Albrecht Durer's hundreds of masterful portraits, pen and silver-point sketches, water colors, charcoals, woodcuts, and copper engravings hang in every great museum in the world, but the odds are great that you, like most people, are familiar with only one of Albrecht Durer's works. More than merely being familiar with it, you very well may have a reproduction hanging in your home or office. One day, to pay homage to Albert for all that he had sacrificed, Albrecht Durer painstakingly drew his brother's abused hands with palms together and thin fingers stretched skyward. He called his owerful drawing simply "Hands" but the entire world almost immediately opened their hearts to his great masterpiece and renamed his tribute of love "The Praying Hands."

MAYOR HOLDS ANNUAL MEETING WITH EXPATS

Jávea Mayor, Jose Chulvi seems to regard ‘Facebook’ as a way of selecting Brits whom he thinks are interested in his activities. Javea Jeard attended the meeting at the Parador in 2013 (and gave him what we thought was a fair report) but we didn’t get an invite this year. His meeting had the double purpose of explaning his responsibilities as a ‘Diputado’ in Alicante, and answering the questions of those present. High on the list of topics raised by those present, were IBI and car parking. Attendance was estimated at 100 people, a lot less than in 2013.

The Mayor kicked off proceedings by apologising for what he insisted was his "poor English" and joked that he hadn't slept for a couple of days as a consequence to which he received generous and sympathetic applause from the floor. He explained that he wanted to make the presentation because he felt that it was essential for all residents of Jávea to understand his work in Alicante.

There followed a short clip of the Mayor's formal inauguration on July 16th 2011, after which he explained the purpose of the 'Diputación de Alicante' the Provincial Government of Alicante which is responsible for managing the economic and administrative services and functions within the Province of Alicante whose territory stretches from just north of Dénia to the border from Murcia in the south and inland to just beyond Alcoy and to the border with the historic region of Castile-La Mancha. The Diputación was established in January 1822 by a decree of the Madrid Parliament and currently has 31 MPs representing a population of just under 2 million people. Those representatives are selected from the political parties of the elected municipal councillors in the province with the Marina Alta region providing three, one each from Jávea, Benissa and Ondara. Of the 31 representatives, 20 are drawn from the Partido Popular (PP) and 11 from the Partido Socialista Obrero Español (PSOE) of which José Chulvi is a

member. Individual MPs are selected internally by the vote of the councillors belonging to their political parties in their respective districts which in the case of the Mayor was the Marina Alta.

José then outlined the principal areas of responsibility of the 'Diputación' which included infrastructure and roads, tourism along the Costa Blanca, equality, youth and foreign citizens, promotion and development of the region, the heritage of the region including the support of the 'Museo Arqueológico Provincial de Alicante (MARQ)', the water cycle, the environment and the provision of services to municipalities within its boundaries. Its budget for 2014 is almost 249 million euros, the majority of which is funded by Central Government in Madrid.

As for his own responsibilities in Alicante, José is a member of the Management Committee of MARQ, the archaeological museum in the city, and

he implored those who hadn't yet visited it to do so (it won the 'European Museum of the Year Award' in 2004). He is also a member of the Costa Blanca Tourist Board and meets with fellow MPs to decide policies and development in the Province of Alicante as well as attending monthly plenary sessions of the provincial government. For this, he receives a salary and it has been welldocumented that as a consequence he renounced his right to a salary as Mayor of Jávea, the only mayor to do so, because he strongly felt that in these difficult times no public servant should receive two salaries. Such an action received deserved applause from the floor. He also explained that he bought a new car (on credit) in 2011 - his old one had "expired" after nine years - and that he has driven almost 60,000 kilometres on business travelling to Alicante, Valencia and Madrid.

José went on to explain the benefits of his presence within the provincial government for Jávea which includes better access to grants and subsidies for projects and improvements as well as the ability to lobby provincial departments for funding. He explained that in 2007 Jávea received just over 4,700 euros in annual subsidies and whilst this did rise to over 400,000 euros Continued on page 18

don’t use an auxiliary when the question refers to the subject; hence the questions: ‘Who wrote this speech?’ or ‘What happens when you press this button?’

From now on, the only questions allowed at official functions will be subject questions, thus eliminating all possible confusion.

Where a loan word from another language is perfectly acceptable to an English word, the English word will disappear. Consequently a meeting will become a ‘rendezvous’, a dead end street will be bulldozed to make way for a ‘cul de sac’, shops will reopen as ‘boutiques’ and small will be reborn as ‘petty’.

Officials at the European Union (and France) have finally accepted English as their lingua franca.

Certain concessions are however expected to be part of the agreement that will put vast numbers of interpreters and translators out of a job in Brussels and Stuttgart as politicians of all EU countries conform to the practice of speaking only in English at official meetings, summits, brunches and luppers.

The concessions expected from Britain basically consist of a complete linguistic review, which is expected to bring about a simplification and democratisation of the English language.

To begin with multiple abbreviations will be outlawed in all public places. People caught shouting “you shouldna done that mate” over spilt pints or flattened pedestrians will face stiff sentences involving the learning of French or Swedish.

The confusion between ‘do’ and ‘make’, and whether we make friends, a mess or a bed; or whether we do a favour, a job or the washing up, will disappear, to be replaced by a new verb “domake”. The only abbreviation accepted for this new word will be “doom”.

The quandary as to whether or not to use an auxiliary verb in the interrogative will also vanish. Everybody knows that in the present simple and past simple we

The phrase “good night” will therefore henceforth be perfectly acceptable as a greeting when politicians arrive at parties and soirees.

Member states may use the completely natural and neutral question tag “innit?” on all occasions when they would otherwise be inclined to state “it’s education today, isn’t it?” or we don’t have to read all these papers, do we?”

Malicious exceptions to the rules such as “let’s adjourn for lunch now, shall we?” or “I’m chairman today, aren’t I?” will be phased out over a three year period.

When completely different words have the same pronunciation, such as ‘bare’ and ‘bear’ or ‘I’ll’ and ‘aisle’, the one that is used second in the sentence should be spoken more loudly so as to distinguish it from the first.

The United Kingdom will be given a four year hiatus in which to invent an authentic subjunctive tense and will forthwith refrain from cheating by using the simple past in phrases such as “it’s time we had lunch” or “what would I have to do if I accepted the money in

this envelope?”

Polysemitic words such as ‘fine’, ‘plug’, ‘stroke’ or ‘badger’ may be interpreted as having any of their legally registered meanings under any circumstances unless a clear definition is previously stated by the speaker using the word. Confusing words will disappear from the language where a sensible alternative is available. People telling others that they look ‘pretty awful’ will be considered to be in violation of EU policy on fraternal relations.

Negative prefixes such as im-, dis-, un-, in-, or suffixes such as –less, will all be immediately replaced by non-. Irregular plurals such as ‘children’ or ‘mice’ will conform to majority plural forms and so become ‘childs’ and ‘mouses’.

Words which double their final consonant because the preceding letter is a vowel will cease to do so; therefore the past form of ‘strip’ will henceforth be ‘striped’. Punning will be officially considered an anti-European activity, although it will not at present be outlawed.

Any sovereign nation not conforming to the new system will have the savings of its less intelligent citizens embargoed.

Have you been ‘touched by an angel’?

I would like to thank all those readers who have visited us at the Oasis Centre or phoned to find out how my husband Clive is progressing after his nine day stay in hospital which left him unable to walk. Progress is slow and occasionally he has a bad couple of days but he is getting better. Clive is now able to walk unaided and to help out in the Oasis Centre each morning where visitors and customers are pleased to see him. When I go into a shop I hate it when an assistant suddenly appears close by to tidy shelves, or generally hang around, obviously to keep an eye on me in case I am going to steal something. I immediately leave the shop because it makes me feel uncomfortable. Some of the Chinese shops are

notorious for this but there is one Chinese shop opposite Mercadona in the town (close to where I live) where I feel completely at ease. The owner (or his staff), have never followed me around or mysteriously appeared to tidy shelves but he is so helpful if I need help to find something I can't find. The shop goes back a long way and he is happy to sit at his desk at the door and let his customers roam around for as long as they want to. Talking of shops, as many of our readers know, in the Oasis Centre in the Port at the back of the dolphin roundabout, we have a large selection of greetings cards, all at 1 euro each and during this past month our selection and quantity of cards has been augmented by 10,000 more cards. Many come to the shop with a list of all the birthdays and anniversaries they have for the next two months and often buy as many as 10 - 15 cards at a time. It's well worth a visit.

The Oasis Centre was opened fifteen months ago following three suicides in the area. We opened the Centre to provide a listening ear to anyone who was going through a difficult time and to generally help anyone who would accept it. For example, as it is now no longer possible to renew passports by filling in a form and sending it to the UK with supporting documents. Now it all has to be done online and many who come to the Centre are elderly and don't have computers. Clive is able to complete the application online and then download the form to his computer, so it can be signed by the applicant and forwarded by courier, overnight - in to Belfast. Often people just come in for a chat, some live alone and are obviously lonely. I have been surprised that when people start to open up, especially if they have problems, how often the conversation comes round to angels. I have also been surprised at how many of them, like me, believe that we have guardian angels that are with us all the time, and help in times of danger. About twelve years ago, Clive and I travelled to Cullera (about half way from Jávea to Valencia), to spend the day with Spanish friends Magda and Enrique at their holiday apartment. Jávea Mayor reports to his Facebook friends on past year´s successes Continued from page 15 in 2009, a consequence of storm damage which necessitated major public works to repair the Tosalet ravine and the banks of the Gorgos, it changed little until 2012 when subsidies climbed to just over 69,000 euros and this year they have risen to almost 490,000 euros (up to February 2014). This figure includes 393,250 euros for the renovation of the Central Cinema in the centre of the old town and 93,750 euros towards the municipal plan to improve energy efficiency. The town has also received 100% funding for several projects including 176,377 euros for resurfacing and repairs to the Carretera Jesús Pobre, 48,422 euros for the resurfacing of Avenida Colomer, which leads out of town from the olive tree roundabout, 241,395 euros for the roundabout at the junction of Carretera Cabo de La Nao and Carretera La Guardia - the Saladar junction - which has looked to both resolving congestion, especially during the busier summer months, and reducing incidents on what had become a major accident blackspot. To date, Alicante has spent just over 16.3 million euros on major improvements and infrastructure projects in the Marina Alta region, a tribute of the work done by its three representatives, including José Chulvi.

He concluded the presentation by showing a few images from the official website of the Department of Tourism in Jávea which he described as a "beautiful presentation of a town we all love" but finished with a warning that "if we wish to maintain all these beautiful aspects of Jávea and protect our environment we have to say - NO to oil exploration in the Mediterranean!" outlined the ongoing battle against the proposed oil exploration project in the Gulf of Valencia including a visit to the European Parliament in Brussels with councillor Antonio Miragall (Tourism) during which PSOE MEP Andrés Perelló arranged several meetings, including an important chat with Nigel Smith MEP,

head of the Marine Division of the EU Environmental Commission, Jo Lienen MEP responsible for oil exploration and fracking issues who promised to follow up the issues by visiting Jávea after the European elections in May, and Linda McAvan MEP, the British coordinator of the EU Parliamentary Commission for the Environment, Public Health and Food Safety. José called for unity against oil exploration just several kilometres off the coast: "Together with the citizens of Jávea we will make every effort to defend our beautiful coastline".

Those present were then invited to ask questions and the first came from a Dutch resident who asked where the Valencian government came into the picture after all the information about Alicante. With the help of George Thomas, president of the PSOE in Jávea, José explained that the position with Valencia is quite complicated and not made any easier by the fact that Jávea is owed a lot of money by the Generalitat. Two main issues are involved: education and health. With regards to the former, the eight schools in Jávea - 6 elementary and two high schools - are the responsibility of the Generalitat, including building repairs although the town hall has carried out necessary window replacements recently. With regards to health, the town hall has been pushing for assurances that medical cover is not reduced over the busier summer season and has been fighting a proposal by Generalitat to reduce the ambulance service. With regards to the latter, the town hall has agreement with the Cruz Roja to provide 24 hour cover for emergencies although it has to find 200,000 euros a year to finance that cover.

The next question concerned the marina which, once again, comes under the authority of Valencia. José explained that there are proposals to improve the port although not to enlarge it - which would mean that more boats could use it. There are also plans to improve the marina of the Fontana canal, also under the wing of Valencia, and an assessment is to be made to identify requirements.

Cleanliness in the Arenal brought up the issue of land ownership and responsibility. The original question asked what the town hall could do to ensure that the back of the Arenal around Avenida Tamarits and Scallops was kept clean, the inquirer pointing out the return of a funfair as a cause for concern. José said that owners of private property across the municipality were requested to keep it clean and tidy and if they complied to the request then good. However he agreed that cleanliness of the town should be ensured due to its status as a tourist destination. The talk inevitably turned to the long-running saga of the roundabout at Barclays Bank which he admitted was a special problem. He explained that there were four parts that affected the roundabout, two of which have been accepted by the townhall but the other two belong to developers and they should have paid a share to develop the roundabout but have failed to do so. He added that the town hall was looking towards a solution. He also confirmed that the temporary roundabout at the junction of Avenida del Pla and Avenida del Arenal was being made permanent this year. beach to swim but I explained to Magda that Clive couldn't swim and it would have to be a safe beach. "No problem" she said. "There is a very safe beach close by where you can walk out a long way before the water is up to shoulder height." So off we went. Enrique stayed on the beach with our clothes near to the lifeguard station while Magda took the opportunity to do some supermarket shopping. It was lovely in the water, I was swimming along quite happily and Clive was plodding beside me, his feet always on the ground and we were aware that we were quite alone out there. We were a long way out before Clive decided we had walked out far enough as the water was now well above his waist. We turned round and looked at the beach, saw the flags of the lifeguard station and started making our way back. I was swimming ahead of Clive and he was walking at his own pace behind me. Suddenly he shouted "Anna." Now when he calls me Anna I know there is a problem. I turned round to see him go down under the water and then come up again, gasping and coughing. Down he went again, and up again. I swam quickly back to him knowing I could put my lifesaving certificates and medals into practice. This would be the first time I had actually saved a person drowning, all the other people I had "saved" had wanted to cooperate as they were all confident swimmers. What I didn't expect was that as soon as I came close to Clive, instead of him waiting for me to turn him over and save him, he grabbed me with both arms and we both went down. He was so strong and so heavy I was powerless, we were both drowning. While we were under the water I tried to push his bottom up so he was floating and easier to manage but he wasn't having any of it, he was like an upright heavy brick. When we surfaced I shouted at him in desperation "Let go of me, you're panicking," to which he replied, "Of course I'm panicking, I'm drowning!!" When we surfaced for about the sixth time, I was amazed to see two men swimming quite close to us, I hadn't noticed anyone out there, I thought we were quite alone. In my best Spanish I shouted to them and said my husband couldn't swim and ‘HELP’!! Within seconds they were with us, each of the men took one of Clive's arms and he let go of me. They turned him on his back and without saying a word, swam back to the beach while I

swam on ahead. It was then that I noticed a strong current below the surface and it was very hard for me, even though I am a strong swimmer, to swim against it. Finally we arrived at the beach, the men dropped Clive onto the sand and I ran over to him to help him up. As I helped him to his feet, his first words were "We must thank those men for saving me." We looked round the beach, there was no sign of any wet men, they had disappeared. I am convinced God had sent two angels. When we talked about our experiences with Enrique he explained that when we went out we had walked in a semi-circle and of course when we turned back and saw where the lifeguard station was, we made a direct course back and unbeknown to us, the strong currents had swept away the sand and left big holes and Clive had walked into one of the holes when he found he was out of his depth. When I was thinking about our terrible experience during the following days, I knew that I couldn't have forced Clive's arms away from me and saved myself while watching him drown, we would have stayed clung together until we both drowned. There is no doubt in my mind that they were angels. They didn't speak a word, didn't wait to see if he was alright when they dropped him on the sand, they just did the job God had sent them to do and disappeared!! But I must admit that an experience like that does make you do a lot of thinking afterwards. You go through the "what if?" questions. What would have happened to the Church we pastor? What would have happened to all the other work we were involved with? Nobody is indispensable and we realised all our activities we were involved with would either have been taken over by someone else or ceased. It did give us a lot of soul searching over the next few weeks and caused us to slow down, back off from some of our activities that others could do just as well, and spend more quality time with each other and God. On another occasion a few years later, Clive was driving alone on the road from Benitachell to Jávea. It was dark and a wild boar crossed the road, so Clive swerved to miss it and ended up going off the road and tearing into a field until the car stopped. The first I knew about it was when he arrived back home and asked me "Do you want the good news or the bad?" The good news was that he was still alive and the bad news was that the car was probably a write-off. The next morning we called for a taxi and went to

look for the car. The taxi dropped us off at the point where Clive had come off the road (close to the entrance to Residencia Lluca) and we could see the broken bushes where he had left the main road. On the ground was a front bumper which was lying next to a gulley and a little further along, a low stone wall. We carried on through the undergrowth and finally found the car in the middle of a field. We examined the car and found to our amazement that the front bumper was still there. The only damage to the car was a few scratches where the branches of trees had caught it on iys journey through. "Try and start the car" I told Clive. He got inside and low and behold, it started first time. The field where the car was standing was full of big boulders so we would have to be careful how we drove it out. We found the only place we could drive back onto the main road without hitting any of these boulders was close to a tree but the branches were so low it was impossible. Clive sawed the bottom branches off and we were ready to drive to the main road. I walked on ahead beating the long undergrowth down to locate the boulders and pointed a route out to Clive. He slowly followed me through the thick undergrowth and before you know it we were back on the main Benitachell road. When we went back a few days later to the point where Clive had come off the road, we found that the car had gone through the hedge, clearing the bunker, bounced over the wall and driven right into the middle of the field without hitting any of the hidden boulders. It was a miracle Clive wasn't killed and he is convinced he had angels guiding his car that day. These are just two occasions when our guardian angels rescued us. rescue. After the fire which destroyed 40 hectares in the Montgo area at the beginning of this month, I really believe that we have to think about.......

EDUCATION AND AWARENESS and PREVENTING FOREST FIRES

Conserving and protecting our forests means conserving and protecting one of the most valuable heritages in our territory. Its value stems from its ecological function as well as from its social function as it is a source of wealth, work and recreational activities. This is why the fight against forest fires is fundamental. It is a battle against the most important threats faced by our forests. The fight against forest fires is a priority for the Generalitat (Valencia Region Government) and important efforts are being made to acquire the best means and resources to confront them. Nonetheless the best and most effective tool we have in the fight against forest fires is to avoid them, that is to say, prevention. Only 23 per cent of forest fires in the Valencia Region are caused by natural factors such as lightning. The rest are caused by negligence or are set intentionally. Therefore, the most coherent message we can send is that it is in our hands. All of us, who either for work or recreation and leisure activities, use our forests must mitigate and reduce this percentage and the number of forest fires. Of course, it is difficult to fight the foolishness of pyromaniacs but as normal and concerned citizens, we should keep in mind certain rules and obligations. The basic rules below are mandatory in all circumstances and for

any activity, whenever you're in the forest or within 500 metres of it. You can make fire only in the places prepared and authorized to that effect. Never throw them on the ground and even less lit, use the existing litter bins or dispose of them at home.

Continued from page 18 refunds. José gave a long explanation about the situation which saw IBI rates rise 10% of the value of the property every year after the new rates were set in 2006. The Townhall set the wheels in motion to make claims against the rises, citing 345 properties which proved that the rates had been misvalued. It seems that the problem was passed from pillar to post until it eventually came back to Jávea with the Supreme Court ruling in favour of the townhall although only in the case of the 345 properties. After the elections in May 2011, the incoming coalition decided to reduce rates for 2012 and in June the Supreme Court judgement arrived which meant that the town hall would have 8 million euros less in its pot for 2012 and would have to make adjustments. Assessments had to be made using a specialist and the town hall investigated the possibility of reimbursing any money whilst individuals set about taking the town hall to court to force a refund of the overpayment. However judgements ruled in favour of the town hall who had no obligation to repay. Once again, income had to be adjusted for 2012-2013 as rates were set to 2009 levels meaning some 6 million euros less in the pot. José acknowledged it was a long and complicated issue. At the end of the day, the money was taken, it was spent and consequently it cannot be returned. However he said it showed that there had to be good economic management in order for the eleven councillor who run the council to achieve their sole objective and that is to improve Jávea. To this end, they have also worked to bring in those people who had been avoiding paying their fair share of IBI contributions and these residents have had to pay up to four years of back-dated tax.

A question about the controversial oil exploration project brought a simple but passionate response from the mayor. The inquirer asked for a comment on the prolobby who said that the exploration project would actually bring jobs to the region. José quoted Councillor Antonio Miragall (Tourism) who said: "Xàbia's oil is tourism" before explaining that studies have suggested that any such exploration and subsequent discovery would provide just 1% of the country's energy and it wouldn't create jobs in Jávea but rather work to destroy them, such as the fishing industry. He said that the only benefit would be to the company who would sell their findings for a profit.

The session concluded with random questions on parking meters (the cost of running them was more than the income) and the issue of responsibility for the removal of infected palm trees (which came down to Valencia once again) before it was wrapped up with another request for residents to register with the Townhall and get on the 'padrón' to help make sure that the town gets the right funding for its services.

It was a very useful session and, as José Chulvi agreed during a chat afterwards, the importance of getting information out to everyone in Jávea was paramount. Chats like this serve to prove that the Mayor and his councillors are moving in the right direction.

Next year’s Municipal Election

In a year’s time, those of us living in Jávea will have cast our vote in local elections, and it will be for the horsedealing local politicians to carve agreements under which they can succeed and prosper. If the town prospers it will be an interesting fringe benefit. Last month Jávea Jeard included an editorial setting out the need for political restructuring. We were surprised how many readers wanted to support proposed changes, but the writer of the article ‘for reasons you will understand‘ chose NOT to be identified, If you would like to explore this once in 4 years opportunity, write to ‘Time4Change’ and (assured of confidentiality) place your ideas in the buzon on the outside of the Oasis Centre, or leave it inside with Ann and Clive. An explorarory meeting will be held in the next month.

S1 forms for early retirees Moving abroad or Studying abroad Changed rules from July 1 2014

What will be changing? From July 1 2014 you will no longer be able to apply for a residual S1 (formerly residual E106) under which you could currently be entitled to up to 30 months of UK-funded healthcare if you retire early to another EEA country.

What does this mean for me? Before moving to live abroad, it is important that you check how the healthcare system works in that country and what your entitlement will be if you intend not to work, as this varies from country to country. This means that you will have to access that country’s health system under their rules. If you are moving abroad on a permanent basis, you will no longer be entitled to medical treatment in the UK under normal NHS rules. This is because the NHS is a residence-based healthcare system. Most people will also not be entitled to use a UK-issued EHIC card to access healthcare abroad.

What if I already have a residual S1? If you already have a residual S1 this will not affect you – it will continue to be valid until its original expiry date.

What about state pensioners? If you are a UK state pensioner this will not affect you – S1 forms will still be issued to state pensioners.

Spain still has best healthcare in Europe claims report

SPAIN’s healthcare system is the best in Europe, claims a new study, and the country is ranked fifth best in the world, in the study by Bloomberg which measured efficiency, life expectancy and cost. The report comes after a number of studies showed that Spanish health care has deteriorated dramatically over recent years due to national budget cuts. British medical journal ‘The Lancet’ recently slammed its quality following drastic 30% cuts over the last few years. Despite this, Spain’s efficiency rating was 68.3, its life expectancy was 82.3, and the cost of healthcare as a percentage of GDP per capita: 10.4%. This is compared to the UK’s efficiency rating of 55.7, life expectancy of 80.8, and healthcare cost percentage of 9.4%. Hong Kong topped the list of the ‘most efficient healthcare countries in the world’, followed by Singapore. Japan and Israel also made the top five, while the UK came 14th, and the US ranked 46th. The results were greatly affected by Bloomberg’s decision to take cost into account. This sent countries with good but very expensive healthcare – like the US – far down the list.

As an engineer in an upscale hotel, I was asked to repair or replace the television in a guest room. When I arrived, the couple were watching a picture one-third the size of the screen. I knew all our spare sets were in use, so I figured what the heck: I struck the side of the TV with the heel of my hand. The picture returned to full size. "Look, honey," said the wife to her husband. "He went to the same repair school as you."

Having recently looked at buying and selling a property in Spain, here’s the first part of a short guide to buying land to build your own home. Alejandro Giménez Ferrer who is the principal of Alejandro Giménez Architects was asked what prospective purchasers of plots should look into, and be prepared for, in Spain. “The first thing is find out is what kind of plot is being offered,” Alejandro says. Traditionally, land here is classified as urban, urbanisable, or green belt. The latest Land Act, passed in 2007, changed the definitions a little, but, in practice, the only land you can legally build on is an urban plot. This means it must have, at least: vehicle access, power, water and sewage connections, and street lighting. “If the basic infrastructure is not in place,” Alejandro points out, “there could be problems.” Neither green belt (which is protected, for scenic, historic, scientific or cultural reasons or due to environmental risks, public-domain issues, or agricultural or natural importance) nor urbanisable land (which is not protected and could be transformed into urban land, if town planning and infrastructure are developed) can be built upon. The next step is to ask the local townhall for a planning certificate (certificación urbanística) that determines what can be built on the plot. This will confirm the type of land and detail any requirements, such as: minimum plot size and separation boundaries, maximum built area (expressed as a ratio of plot size and only including square metres above ground), floor area (again, a ratio of plot size), roof height, and any style restrictions. You can request this yourself from the townhall or ask an architect to produce a technical report, for which they will be legally liable, detailing what will be permitted on the plot in line with the general town plan (Plan General de Ordenación Urbana). You should also ensure there are no development restrictions in either the town plan or the Property Registry (Registro de la Propiedad), due to proximity to the coast, rivers, or highways, third-party rights (like power, water and drainage connections) and other rights of way. Any of these could mean a building license will not be issued and, if work begins without one, could result in it being halted, demolition ordered, and fines levied. Once you’ve confirmed building on the plot is possible, Alejandro says the basic things to think about are: the direction the house would face (southfacing being the best), type and topography of the soil (if it’s rocky,

unstable, or on a slope, construction costs climb), the view, and any existing or potential neighbours. After all, if you plan on building a house in Spain, you don’t want your dream home turning into a nightmare in the future. Having looked at the things you need to know before buying a plot to build on in Spain, the next ´hurdle´is to review the process, and costs, of going from having a piece of land to the plans for your new home. The first thing needed to comply with Spanish law is a geotechnical report, to determine the correct type of foundations for your build. Specialist geotechnical engineering companies, which must be registered providers, produce this kind of report. This normally takes a week and costs 1,0003,000€. Depending on the plot, you may want a topographic report to see how your land lies. Alejandro particularly recommends this for plots on a slope or with difficult terrain. This is done by a topographer, also takes a week, and costs 300-1,000€, depending on the plot’s size and characteristics. The next step is to employ an architect (arquitecto) who is responsible for drawing up your plans, subject to all the relevant rules and regulations, and directing the build: “You should always check he or she is a member of the provincial Architects’ Association and is up to date with membership and

insurance payments,” Alejandro says, “Your plans have to be approved by the Association (often referred to as the Collegio), too.” The architect not only designs the basic plans (proyecto básico) of what goes where in your new home, but also the installation and structural plans (proyecto de ejecución) that detail how it all works. While he or she is ultimately in charge of the design, a good architect always conceives a building in line with the client’s ideas: “My goal is to make a made-to-measure suit, just like a tailor would; something that fits perfectly.” You’ll also need a technical architect (aparejador), to manage the build on a day-to-day basis. Your architect will probably have one, or more, they regularly work with, who you may interview for the job, but you’re free to choose your own. Bear in mind, however, both professionals will see a lot of each other, and of you, so try to hire one you and your architect get on with. Architects usually charge 7-10% of the projected build cost for their work, while a technical architect normally costs about 30% of what your architect will charge. Once you have the plans and other documents prepared, you can apply for a building license (licencia de obra) from the local Townhall. You should have a careful look at what’s required in your town but, given the paperwork and hassle involved, you’re probably best advised to let your architect look after this, too. Getting a license can take 1-3 months and the process is overseen by the town’s technical staff. They may request changes, which your architect will handle, to ensure your plans comply with the law and planning guidelines but, sooner or later, you should get them approved (informe favorable.) Costs vary, depending on the town, but are usually 4-5% of the projected build price, calculated using standard tables. Then, unless you plan on getting your hands really dirty, all you need next is a builder…

Writing to the director of the hospital or medical clinic preferably by Burofax or certified letter, is the best option when all previous “friendly attempts” have failed. Remember that the letter should clearly warn that, failing to hand it over to you, you will formally report the Doctor and the Clinic to the Spanish Data Protection Agency, with recourse to the Courts, if necessary.

Usual Problems encountered:

Hospitals do not like being requested for that kind of information because they will suspect that the application is made in order to bring a malpractice lawsuit against them. Be very careful, because they might try to give you an incomplete or mutilated medical record, with the perverse intention of avoiding facing potential civil or criminal liability.
